ANIMAL LIABILITyAs outlined in the Holstein Association’s Terms & Conditions For Public Sales, each individual animal in this sale is at the risk of the Seller until struck off by the Auctioneer. Upon being struck off by the Auctioneer, each individual animal then immediately becomes the sole risk and responsibility of the Buyer. It is strongly recommended by Dykshorn Dairy Sales that each Consignor secure insurance on his consignment during trucking to and while at the sale facility. It is also strongly recommended by Dykshorn Dairy Sales that each Buyer secure insurance on his purchase to further protect his investment after being sold and during the trucking after the sale. Mortality Insurance is available from several sources. One source of insurance is American Livestock Insurance Company, Steve Howard, Agent (phone 507-289-4754).

CONTACT INFORMATIONSome of the individual lots in this sale may sell with one or more of the following contracts: A.I. Contracts for Males Embryo Contracts (Domestic and/or Foreign) Female ContractsIt is understood that all contracts are conditional and have specific requirements and expiration dates. It is the Seller’s responsibility to provide the Sale Management with accurate contract information prior to the sale. Reasonable efforts will be made by the Sale Management and the Seller to have the contracts in hand at the sale and available for examination; however it is not uncommon to not have the physical contracts at the sale site. Therefore, it is the Buyer’s responsibility to verify all contracts being offered on the lot(s) of interest. The Buyer should contact the Seller or Sale Management in advance of the sale to determine the details of each contract and/or the contact information for the person responsible for each individual contract. The Buyer should contact each individual company/agent and verify the exact conditions of each contract prior to bidding on the lot(s) of interest.

The Seller and the Sale Management assume no responsibility for the Buyer’s failure to determine the validity of each contract or the conditions, requirements and expiration dates contained within each contract. Furthermore, the Seller and the Sale Management assume no responsibility for the Buyer’s failure to comply with those conditions, requirements and/or expiration dates.

BIOSECURITyWe understand the importance of maintaining strict biosecurity measures and every effort has been made to provide buyers clean and disease free individuals. In addition to the Interstate Health Permit required on every live lot at the sale, we have taken additional measures to help insure your purchase is as healthy as possible. After each milking cow has been milked here at the sale site, the milking unit is disinfected before the next cow is milked. We recommend that any new individuals introduced to your farm be segregated from animals already in your herd for at least 10 days. We recommend that every new milking female that enters your herd be milked last and milk samples cultured before officially mixing with the existing herd. We also feel it would be prudent for each buyer to do additional testing on all cattle entering your herd, as sale management requires only TB & Brucellosis guidelines be met, as required by U.S. Interstate Health Regulations. These additional tests would include testing for BVD, Johne’s and Leucosis and if your herd is not on a regular testing program for any of these diseases, we recommend inclusion of these three diseases in a regular preventive medical program. While precautions have been taken to assure buyer’s protection from any medical problems, it is understood that buyer’s assume full responsibility for all cattle purchased as soon as they are pronounced sold by the auctioneer. It is also assumed that buyers will include prudent measures to avoid any health risks associated with introducing new individuals into their established herds. This would include the care and trucking of the individuals immediately after the sale and how they are handled once they arrive at the buyer’s farm.

PURCHASER’S AGREEMENTProper settlement is expected immediately at the conclusion of the sale. Should Purchaser not be attendance at the sale, proper settlement is demanded no later than 7 days after sale date.

By submitting the highest bid on the respective Lot Number in this sale either in person, by phone, internet or proxy using a personal agent or member of the sale staff, Purchaser expressly agrees to the printed and announced sales terms and conditions, and should Purchaser default on payment, the total amount shall be due and payable upon demand by the sales manager, Dykshorn Dairy Sales. In the event of default, Purchaser authorizes entry of a judgment by confession for the total amount due, together with interest at a rate of 12% plus costs and attorney’s fees, and further consents to the jurisdiction of, and the entry of judgment in, the court of jurisdiction in Sioux County, Iowa. All defenses of demand, notice, dishonor and presentment are hereby waived. Each purchase is the sole risk and responsibility of the Purchaser immediately upon being declared sold by the Auctioneer. Sales Manager, Dykshorn Dairy Sales, their sale staff and other employees are not responsible for accident or loss of property or the individual animal selling.
