Welcome to Market Street at Town Center Condominium! This Handbook has been prepared to assist you in becoming familiar with the Unit Owners Association of Market Street at Town Center Condominium, Inc. The paper copy of the Residents’ Handbook is designed to be kept in a loose-leaf binder format to facilitate updating by adding new information as it is made available. The Handbook will be updated as revisions or additions are made by the Unit Owners Association Board of Directors. The most current copy of the Handbook is always available through the Association web site: www.marketstreetattowncenter.com. The information included in the Handbook is intended to complement the Association Bylaws and Policies. The Association Bylaws and Policies can be accessed through the Association web site. In addition, copies of all documents of interest to owners and residents are maintained in the Community Manager’s Office. GETTING STARTED

UTILITIES At Market Street at Town Center Condominium, it is up to each resident to arrange for service for all utilities, except water. If you have not already done so, please call the utility companies immediately to arrange service in your name.

Electric Service

Electric service is provided by Dominion Virginia Power. Each home is separately metered for service. To arrange for service, please contact Dominion Virginia Power at 888-667-3000 or visit www.dom.com. There is a fee for initiation. You will be billed monthly for your regular service.

Gas Service Your home is served with natural gas provided by the Columbia Gas Company of VA. To arrange for service please call 800-543-8911 or visit www.columbiagasVA.com . There is an initiation fee. You will be billed monthly for your regular service.

Telephone, Internet, Television Cable Services

A variety of providers are available to provide telephone, internet, and television cable services. Wiring in the building accommodates Comcast, Verizon Triple Play, and Verizon FiOS. Each of these providers offer a combination of telephone, internet, and television cable services. The contact information for these providers is included in Part 1: Useful Contact Information under “Utilities and Services.” In addition, a variety of independent providers are available to provide telephone service. There usually is a connection charge for all new service. If you have not previously had service through the provider, a deposit and an advanced payment may be required. Rates vary according to the services and the level of services selected, and you will be billed monthly. If you are new to the Washington Metropolitan Area, you should be aware that all local telephone calls require the use of the appropriate area code. If you are interested in using satellite for your television connection, Global Digital Satellite can be reached at the number listed on page 5.

INSURANCE

The Association’s Insurance The Board of Directors of Market Street at Town Center Condominium Unit Owners Association maintains insurance to protect the Association as provided in Article VII of the Bylaws. Our on-site Community Manager maintains

11information as to the insurance company and policy. If you need specific information contact the Community Manager. Fire and property damage insurance cover the Common Areas. The coverage is “all risk” and in an amount equal to the full replacement cost of the property (except for items not normally insured), subject to reasonable “deductible” limits. This property coverage does not insure an Owner’s or Resident’s personal property or betterments and improvements.

Your Insurance It is strongly recommended that each Unit Owner, at their own expense, obtain insurance for their own Unit and for their own benefit. It also is strongly recommended that each Unit Owner and any tenant of such Unit Owner, at their own expense, obtain insurance for their personal property, for any betterments and improvements made to the Unit, and for their personal liability. Each policy purchased and/or maintained by a Unit Owner must contain waivers of subrogation. Refer to Policy Resolution No. 05-07: Maintenance and Repair for more information as to responsibility related to maintenance, repair, and replacement obligations. Also, refer to the Bylaws Article VII, Section 5 for more information and requirements about individual insurance. The Bylaws and policies can be accessed on the Association’s website: www.marketstreetattowncenter.com. You are responsible for any liability claims for events which occur within your home or any events outside your home for which you may be liable (for example, overflowing toilet and/or broken pipes within your unit that cause damage to other units). If you have financed your home, you probably are required by your mortgagee to properly insure the property and betterments and improvements. Check your homeowner’s or renter’s policy to be sure that it includes appropriate liability protection.

MAIL SERVICE

The post office serving our condominium is the Reston Post Office, located at 11110 Sunset Hills Road (703-481-4200). If the U.S. Postal Service has a large envelope or package for you that is too large for your mailbox, it will be given to the concierge. Large envelopes and packages delivered by other delivery services also will be left with the concierge. The concierge will notify you when you have a package or other delivery left at the Front Desk. It is expected that the package or other delivery will be picked up within three (3) days.

PART III

ABOUT RESTON AND THE TOWN CENTER

HISTORY OF RESTON VIRGINIA

In 1961, Robert E. Simon acquired 6,750 acres of land in order to develop a New Town called Reston. It was based on the ideal that a community should have jobs, shopping, and recreation close to home, and should include plenty of open spaces and green areas. At that time such a vision required building an entirely new community. A comprehensive Master Plan was developed for the New Town and Fairfax County agreed to change the existing zoning regulations to permit the proposed pattern of development. Reston was designed to provide: a broad choice of leisure activities; a variety of housing styles; the opportunity to live and work in the same community; access to commercial, cultural, and recreational facilities from the beginning; and a high standard for structural and natural beauty. Over the years Reston has been cited time and again as a model for planned community development. Although it is described as a New Town, Reston is in fact not an incorporated town but is a common-interest property owners association administered by the Reston Association (RA). Among its tasks are the management and maintenance of the

14common areas and design review and enforcement of covenants within a specific geographic area, which is spelled out in the Reston Deed of Dedication. Reston Town Center is in a separate district, which is why RA has no jurisdiction over any of the properties in the Reston Town Center District. RESTON TOWN CENTER

Reston Town Center District is a separate area that is subject to its own legal documents and governed by its own Association. Although it complements the other areas of Reston, it is completely independent of the Reston Association. Begun by Reston Land Corporation in 1987, the District was created to provide a mixed use downtown for Reston. The Urban Core area, with its multi-screen theater, shops, restaurants, fountain, wintertime ice-skating rink, park and businesses, was consciously designed to bring an urban flavor and excitement to the community. The Town Center District has grown steadily to include major employers, new retail opportunities and a variety of housing choices. Information about the Town Center and a current calendar of Town Center events can be accessed at www.restontowncenter.com.

Reston Town Center Association

Certain functions in the Reston Town Center District are administered by the Reston Town Center Association (RTCA), a community association that is the Master Association for the entire Town Center District. The District includes commercial and office property and a variety of residential communities.

15The RTCA, formerly known as The Reston Town Center Joint Committee, is a Virginia non-stock non-profit corporation governed by a nine-member Board of Directors. This Board has representatives from the office, retail, and residential properties. The operations of the RTCA are governed by the Bylaws which address the Board of Directors, meetings, committees, assessments, and other matters. There are two other sub-Associations, the Urban Core Association and the Industrial Association. Design Review, Transportation Information, Stormwater Management Ponds, and Support for Arts and Cultural Events are four of the most important responsibilities of the RTCA. Design Review is intended to maintain the architectural and design integrity of the Town Center. The design review is carried out by a Town Center Design Review Board (TCDRB) which reviews proposals for all new construction and modifications of existing structures and grounds.. Transportation Information. The goal is to mitigate the impact of development on the transportation in the area. This is achieved through LINK, the internal transportation demand management system which provides information on mass transportation and coordinates vanpools and carpools for persons coming to and leaving the Town Center. LINK can be reached at 703- 318-9663 and at www.linkinfo.org. Storm Water Management Ponds. The two ponds, one at Edgewater and one at West Market, are owned by the RTCA. The cost of maintaining the ponds is shared by all the owners in the Town Center District since they benefit from the system. Support for Arts and Cultural Events. The RTCA supports major arts and cultural events in the Town Center through an Arts Fund. All of the office, retail, and institutional property owners contribute to the Arts Fund. The RTCA sponsors the summer series “Reston Concerts on the Town” and is a major sponsor of the Annual Northern Virginia Fine Arts Festival.

Town Center Sub-Associations

Each property in the Town Center is also subject to at least one other association. These associations have their own Boards of Directors, their own Declaration of Covenants, Conditions and Restrictions and their own Bylaws. They include: Reston Urban Core Association (RUCA). This is the property owners association for non-residential property in an area within the Town Center District that is bordered by Reston Parkway on the east, the W&OD trail on the south, Town Center Parkway on the west, and New Dominion Parkway on the north. RUCA owns and maintains the private streets and medians, and the Mercury Fountain and Fountain Plaza within this area. It is anticipated that, as the second and third phases of development are completed, RUCA will be responsible for additional common areas and services. Reston Town Center Industrial Association (RTCIA). The members of this Association include the owners of office/retail/institutional properties outside the Urban Core. Residential Associations. Each residential development in Town Center is governed by either a unit owners association or a homeowners association. The Unit Owners Association of Market Street at Town Center is one of these residential “cluster” associations. They are responsible for the common areas, limited common areas, recreational facilities, and any other services that the Association provides to its residents.

PART IV

ABOUT MARKET STREET AT TOWN CENTER CONDOMINIUM

THE UNIT OWNERS ASSOCIATION

The Unit Owners Association of Market Street at Town Center Condominium (“Association”) is an organization that combines a Board of Directors, committees, members, and the management team into a working partnership for the benefit of all. The overriding objective of the Association is to administer the affairs of the Association in a manner consistent with the safety and well being of the owners and residents, and the protection of their property. It is a non-stock corporation, the members of which are all owners of Units within the Market Street at Town Center Condominium.

GOVERNING DOCUMENTS The Association is governed by a set of legal documents. Declaration, Bylaws, and Rules and Regulations. These documents address Owners' rights and obligations and empower the Board of Directors to administer the affairs of their organization. The governing documents are available on the Association web-site www.marketstreetattowncenter.com The Articles of Incorporation (“Articles”) establish the Unit Owners Association of Market Street at Town Center Condominium as a nonstock, nonprofit corporation and lays out the basic powers and purposes and structure of the organization.

18 The Declaration of Covenants, Conditions and Restrictions ("Declaration") is a statement of legal rights, title and obligation. It describes the property, defines the Units and the Common Area, and the rights and obligations of the Declarant and the Owners. Generally the Declaration may be amended only with the approval of a majority of the Members of record. The Bylaws govern the day-to-day operation of the organization and address meetings, voting, Board powers and duties, committees, insurance, fiscal management, maintenance responsibilities, and restrictions on use of facilities. The Bylaws can only be amended at a regular or special meeting of the Association by 2/3 of the members of the Association (present or by proxy). More easily adopted and amended are the Rules and Regulations, which are adopted by the Board of Directors. These contain rules regarding use of units and common elements. NOTE: It is important that you read the Governing Documents so that you are familiar with your rights and responsibilities as a homeowner and understand the organization of the Association and the actions taken by the Board of Directors. Any questions regarding the documents should be referred to the Community Manager. In the event the information contained in this Residents’ Handbook is inconsistent with the Governing Documents of the Market Street Town Center Condominium Association, the Governing Documents shall prevail.

BOARD OF DIRECTORS The Governing Documents give responsibility for setting policies and administering the Association to the Board of Directors. Article III of the Bylaws details the powers and duties of the Board of Directors. Essentially it sets policy, approves contracts, adopts the annual operating budget and adopts the rules and regulations. Article IV of the Bylaws contains the process for selecting and removing officers and describes their responsibilities. Initially, Directors were elected for staggered terms as follows: two (2) Director’s were elected for a three (3) year term’s; two (2) Director’s were elected for a two (2) year term; and one (1) Director was appointed by GRACE to a one (1) year term. Following the expiration of the initial terms, the successors serve three (3) year terms. GRACE is our Commercial Unit Owner. One member of the Board of Directors must represent the Commercial Unit Owner unless the Commercial Unit Owner does not wish to appoint a representative.

COMMITTEES

Many Condominium Boards of Directors appoint committees to assist them in carrying out their tasks. Six committees have been approved by your Board: Communications, Covenants, Facilities, Finance, Safety and Social. If an owner is interested in joining one of these Committees, please contact the Community Manager.

MEMBERSHIP AND VOTING RIGHTS All Unit Owners are automatically members of the Association, and have the right to vote at business transacted at regular or special meetings of the Association. Each Unit Owner has been allocated a percentage of interest in the Condominium based on the par value of the Unit (see Exhibit B of the Declaration).

FINANCING THE ASSOCIATION

The Condominium Unit Owners Association is funded through assessments paid by the Owners as described in Article VI Section 2 of the Bylaws. There are a number of different assessments that can be collected.

General Assessments

The Association is funded through assessments paid by the Owners. These assessments are based on the annual operating budget adopted by the Board of Directors, which addresses all of the Common Expenses of the Association. This budget must include routine operating expenses, contingencies for the unexpected expenses, and repair and replacement reserves for the Common Elements. Article VI of the Association’s Bylaws addresses the budgeting process, assessments in general, and collection of assessments. In addition, refer to Policy Resolution No. 02-06: Procedures Relating to Collection of Assessments and Charges and Suspension of Rights to Facilities and Services for further information regarding collection of assessments. With some minor exceptions such as late payment charges, interest income and miscellaneous income, the general assessment is the only source of income available to the Condominium Unit Owners Association.

21The fiscal year for the Association is January 1-December 31. The annual assessment for each unit is determined prior to the beginning of the fiscal year. The amount is dependent upon the annual operating budget approved by the Board of Directors the month prior to the start of the fiscal year. .

Special Assessments

In the event that there are extraordinary expenses that were not originally included in the annual budget, the Board of Directors has the authority to levy a special assessment. This may be a one-time lump sum payment or a monthly payment. There are requirements for notification and limits on the amount of the increase. See Article IV Section 2(c) of the Bylaws for more information.

Garage Assessments

The Association is responsible for maintaining the parking garage. Unit Owner’s who have purchased parking spaces will be assessed a separate fee by the Unit Owner’s Association. See Bylaws Article VI Section 2 (e).

OWNER RESPONSIBILITIES

While the Association has principal responsibility for the services and operation of the community, each owner has certain responsibilities as well. These responsibilities include:

• Keeping the Association informed (in writing) of your current billing and correspondence address.

• If leasing your unit, you must provide the Association with a current lease.

• Providing copies of keys to any lock for the unit, and keys to lock’s that have been changed.

• Exercising concern for neighbors in all activities • Complying with the Association instruments and rules in

general and specifically as to pets, parking, design changes and use of your home and the community amenities.

22• Maintaining your property as required (see Part VIII

of this Handbook:). • Attending Association meetings and voting in elections

and on such other matters where owner decisions are required.

The Board of Directors of our Association is responsible for administering the Association. The most significant way in which an owner can exercise influence on how the community is run is to serve on the Board of Directors. If you are not interested in serving on the Board, you can let your voice be heard by serving on one of the Association committees and by attending and voting at Annual and Special Meetings of the Association.

PART V

THE MANAGING AGENT

Management of the services, property and assets of organizations like the Market Street at Town Center Condominium Unit Owners Association is a business requiring experience and specialized expertise. In recognition of this, the Board of Directors of the Unit Owners Association engages a management company to administer the organization on a day-to-day basis. Associa Community Management Corporation is the company contracted with to manage our services, property and assets. The management company’s duties include but are not limited to the following: Property Management

• Contract with vendors for various services provided to the association and oversee the performance of those contracts (e.g. trash removal, landscaping, cleaning of the buildings and insurance for the association).

• Supervise, hire, train and discharge on-site personnel.

• Inspect the property regularly. • See to the maintenance of the property according to

the standards determined by the board and the operating budget.

• Provide a twenty-four (24) hour emergency answering service.

24 Financial Management

• Collect all sums due the Association. • Keep books and records, in accordance with industry

standards and requirements imposed by the bylaws. • Disburse funds from the association's accounts as

authorized by the budget or the Board. • Maintain the association's operating accounts,

monitor income and expenses as compared to the budget and provide monthly statements, with detailed accounts of receipts and disbursements, to the Board.

• Prepare the annual baseline-operating budget. • Advise the Board on asset management.

General Administration:

• Oversee/enforce the Association's policies and procedures including the rules and regulations, collection policy, and any other policies adopted by the Board.

• Provide guidance and support to the association through its Board and committees.

• Provide other services as may be authorized by the Board.

ADMINISTRATIVE STAFF

The administrative staff of the condominium includes a Community Manager who manages the property and oversees all on-site personnel and a Concierge who manages the front desk. The Community Manager is on duty from • Monday through Friday, 8:30 a.m. to 4:30 p.m. A Concierge is on duty during the following times: • Monday through Friday from 9:00 a.m. to 9:00 p.m. • On weekends when the pool is open (Memorial Day to

Labor Day): o Saturday from 9:00 a.m. to 8:00 p.m. o Sunday from 10:00 a.m. to 8:00 p.m.

MAINTENANCE STAFF

The Association contracts with a mechanical engineer who is responsible for overseeing the service of contractors and ensuring the maintenance of common area mechanical equipment and the common areas of the condominium. Please direct questions pertaining to the common areas to the Community Manager at 703-435-7912.

A porter is employed through the Managing Agent. The primary responsibilities of the Porter relate to assuring that common area walls are maintained and light bulbs are replaced. The Association contracts with businesses that provide housekeeping and trash services. Housekeeping personnel assure that the common areas are clean and recycled trash is removed from trash rooms. In addition, they gather trash from garage level trash rooms in preparation for pick up by Trash Service personnel.

PART VII

COMMUNITY AMENITIES & SERVICES

RECREATIONAL AND SUPPORT FACILITIES

As a Unit Owner or Resident of the Market Street at Town Center Community you have use of all of the amenities. Operating hours and guidelines for the use of amenities are posted at the entrance to the Community Room, Fitness Center, Internet Center, and Swimming Pool. In addition, guidelines for use of each facility are posted on the Association website: www.marketstreetattowncenter.com.

Community Room

The Community Room is provided for the enjoyment of residents of the Market Street at Town Center Condominium. The Unit Owners’ Association Board of Directors has established the following rules for use.

1. Use of the Community Room is restricted to residents and their guests, with a limit of four (4) guests at one time. Guests must be accompanied by the resident owner or the resident lease holder (i.e., person with name on the lease of a unit).

282. Unit Owners’ Association functions have priority for

use of the room. 3. The room may be used by residents during the following

hours: Sunday through Thursday from 7:00 A.M. to 10:00 P.M.; Friday and Saturday from 7:00 A.M. to 11:00 P.M.

4. Residents using the room should not assume it is for their exclusive use. Stated another way, other residents and their guests may enter and use the room while occupied by other residents.

5. Residents must exercise discretion in using the room, taking care not to disturb other residents.

6. Games may be used only when the Concierge is on duty. Game equipment (e.g., pool queues and balls) may be obtained from the Concierge.

7. Notify the Community Manager immediately if you observe inappropriate behavior in the Community Room.

8. Pets are not allowed in the Community Room. 9. As in all common elements of the building, smoking is

not permitted in the Community Room. 10. If you have questions or concerns, contact the

Community Manager.

Fitness Center

The Fitness Center is provided for the enjoyment of residents of the Market Street at Town Center Condominium. The Association and its management agent assume no responsibility for accident or injury within the Fitness Center. The Unit Owners’ Association Board of Directors has established the following rules for its use.

1. Use of the Fitness Center is restricted to residents at least 16 years of age.

2. Equipment should be used in the manner intended by the manufacturer. Refer to the instructions on each machine.

3. No food is permitted in the Center. 4. Only drinks in plastic containers with lids are allowed. 5. Appropriate exercise shoes and clothing, including shirt

or tank top, are required.

Internet Center

The Internet Center is provided for the enjoyment and use of the residents of the Market Street at Town Center Condominium. The Unit Owners’ Association Board of Directors has established the following rules for its use.

1. Hours of the Internet Center are 6:00 A.M. to 11:00 P.M. 2. Use of the Internet Center is restricted to residents of the

Market Street at Town Center Condominium. 3. Users under the age of 16 must be accompanied by a

parent or legal guardian. 4. Users must supply their own paper for printing. 5. Respect other users: do not use cell phones, radios

without earphones, or other electronic devices that might disturb other users.

6. DO NOT load software or tamper with the hardware (CPUs, Printer/Copier/Fax, connecting wires). Do not disconnect CPUs or printer from the network. Violators of this provision may be denied use of the Internet Center.

7. Notify the Community Manager if you observe violations of these guidelines.

8. Pets are not allowed in the Internet Center. 9. As in all common elements of the building, smoking is

not permitted in the Internet Center. 10. If you have questions or concerns, contact the

30Swimming Pool and Sun Deck

The Swimming Pool is provided for the enjoyment of residents of the Market Street at Town Center Condominium. Residents and their guests use the pool facilities at their own risk. The Association and its management agent assume no responsibility for accident or injury within the pool or pool area. Operating Period: Memorial Day through Labor Day, subject to adjustment by the Board of Directors. Operating Hours: 11:00 A.M. to 8:00 P.M. The Unit Owners’ Association has established the following rules for its use.

1. All residents and all guests must have a pool pass to enter the pool area. Information related to Pool Passes and the Process for Issuing Passes is available on the Association web site or from the Community Manager.

2. Guests are limited to two (2) guests per condominium per day.

3. Residents must accompany all guest(s) to the pool. 4. No person is permitted in the Pool and Pool Deck area

unless it is officially open and lifeguards are on duty. 5. Persons using the pool must shower before entering the

pool area. 6. Persons with open lesions or sores are not permitted to

use the pool. 7. Children under 16 must be accompanied and supervised

by an adult resident. 8. Children not toilet trained must wear a swim diaper or

diaper covered by tight fitting water proof pants. 9. Food, alcohol, and glass drink containers are prohibited

in the pool area. 10. Smoking is prohibited in the pool area. 11. Pets are prohibited in the pool area. 12. Respect other swimmers: do not use radios or CD players

without earphones. 13. Running and roughhousing in the pool area are not

permitted.

3114. All flotation devices must be Red Cross certified and

are to be used at the sole discretion of the pool management company.

15. No diving is permitted. 16. Chairs may not be reserved for persons who are not in the

pool area. 17. The pool may be closed at any time due to weather,

breakdown of equipment, operational defects or other unavoidable causes.

18. The lifeguards may demand any person to leave the pool area if the rules are not being followed.

SERVICES

DELIVERIES

Large items

Deliveries of oversized items must be taken to the loading ramp located near the parking garage entrance. This includes furniture, appliances, and other large items. Contact the Community Manager to schedule a delivery at the loading ramp. Small Items Small items will be accepted at the front desk and held for three (3) days for pickup. Employees may be authorized to accept packages or other articles to hold or store temporarily for Residents under rules established by the Board of Directors. The Resident will be notified of their arrival. The Association does not assume responsibility for loss or damage of such packages or items.

PARKING

Garage parking spaces are purchased by individual Owners for their use and the use of residents authorized by the Owner to use the space. There are no parking spaces in the parking garage set aside for the use of visitors. Each garage space has a garage pass/card code reader assigned to it. Residents are reminded to use only the parking spaces they own or lease. Guests should be reminded to park in the public parking areas of the Town Center. If a resident finds that an unauthorized person has parked in their space they should call Henry’s Towing at 703-464-5599.

TRASH & WASTE DISPOSAL The building has a system of trash chutes and compactors. There are recycling containers provided in the trash rooms. Three Trash Rooms are located on each of four floors: Plaza level and 2nd , 3rd , and 4th floors. On the Terrace Level there are two Trash Rooms. Guidelines for the disposal of trash: • Regular Trash

All regular trash should be placed in a bag and then put in the trash chute.

Do not put anything in the trash chute (a) that is larger than a 20 gallon trash bag and (b) that might become jammed in the chute.

• Trash to be Recycled All trash to be recycled should be placed in the recycle

containers in the Trash Rooms. Newspapers should be bundled in paper bags or tied with

twine; bundles may include slick inserts and magazines but should not exceed 20 lb.

Glass, aluminum and ferrous metal food cans should be rinsed.

33• Large Items

Packing boxes and cartons should be flattened and placed against the doors of the U/L and L/L garage trash rooms.

Furniture and large non-metal household items are collected at the resident’s expense. Call the Community Manager (703-435-7912) for more information

Ferrous metal/white good items such as appliances will be picked up at the resident’s expense. The resident must arrange this with the current Disposal Service.

Residents should note that it is the responsibility of the resident to haul away or have removed by their contractor any debris generated in the course of the construction of any improvements made to the unit.

SERVICE ELEVATOR

There are Five (5) elevators in the building. Elevator 4, located at the SE corner of the building, is designated as a Service Elevator. Elevator 4 is the only elevator that should be used for move-ins, move-outs, and delivery of large items. Elevator dimensions and Moving Guidelines are available from the Community Manager. Moves and deliveries of large items must be coordinated with the Community Manager. Any items that are too large for the service elevator will have to be carried up the stairwell. No furniture or other items may be transported through the main lobby.

STORAGE SPACES

Storage spaces/bins are located on the upper and lower garage levels and within the building. These spaces have been purchased by Market Street at Town Center Condominium Unit Owners. Storage of personal property will be at the Resident’s sole risk. Neither the managing agent nor the Association shall be liable or responsible for the loss, damage, or theft of any personal property stored in the storage spaces/bins. Storage is subject to Fire Marshal restrictions. The storage bins/spaces are for the exclusive use for Market Street Owners/Residents. Any sale or transfer of these spaces must be approved by the Association Board of Directors.

PART VIII

MAINTENANCE RESPONSIBILITY

THE UNIT OWNERS ASSOCIATION

Common Elements

The Unit Owners Association is responsible for the repair and replacement of the Common Elements as defined in the Declaration. Essentially Common Elements are all parts of the Condominium other than the Units as described in Article V of the Declaration. The maintenance obligation is described in Article VI section 7(a) of the Bylaws and in Exhibit A to the Bylaws. For additional information, refer to Policy Resolution No. 5-07: Maintenance and Repair Policy.

Common Elements include: • grounds, including all landscaped and paved areas and

other improvements thereon including outside the main walls of the buildings

• building exterior, roof, vertical walls, garage aisles/ ramps, foundations, gutters/downspouts, elevators, stairways, entrance lobbies, Community Room, Fitness Center, Internet Center

• central loading and delivery areas • plumbing and related systems and components outside

the boundaries of a Unit • electrical and related systems and components,

including fixtures, that serve more than one Unit • heating and cooling systems that serve Common

Elements

The Unit Owners Association shall keep these areas in clean, attractive, and sanitary condition, order and repair in compliance with the standards contained in the Rules.

36 The Unit Owners Association provides for electrical service to Common Elements including existing exterior lighting on the grounds (other than streetlights). If you see a light out in these areas, please contact the Community Manager’s Office at (703) 435-7912. NOTE: Owners or residents may not paint, alter, install plants or otherwise perform any work on the Common Elements unless approved by the Board of Directors.

Limited Common Elements

The Association is also responsible for maintenance and structural repair and replacement of Limited Common Elements as described in detail in Attachement A to the Bylaws. For additional information, refer to Policy Resolution No. 5-07: Maintenance and Repair Policy. There are basically two kinds of Limited Common Elements for which the Association has some responsibility: • Limited Common Elements Serving Multiple Units:

These are facilities that serve less than all but more than one residential unit.

• Limited Common Elements Serving One Unit: These include areas that are reserved for the exclusive use of the Owners of a specific Unit to which they are adjacent or appurtenant or assigned:

• balconies and patios • underground parking spaces • storage spaces/bins

Owners are responsible for keeping both their Units and any Limited Common Elements associated with their Units in good order and repair, in clean and sanitary condition, and free of debris. For additional information, refer to Policy Resolution No. 5-07: Maintenance and Repair Policy. The Owners shall at their own expense do the routine maintenance and repairs on the following:

• routine maintenance and repairs in the Unit itself, including painting and interior maintenance

• routine maintenance and repairs on the interior entry door hardware, and weather stripping

• maintenance, cleaning and repair of window panes and frames and mechanisms, and replacement of glass and screening

• maintenance, cleaning and repair of sliding glass doors, Juliet doors, patio doors

• routine cleaning and maintenance within patio or balcony boundaries, including plant material, light bulb replacement and snow removal

• maintenance and repair of all portions of plumbing within the Unit that serve that Unit, including fixtures and appliances responsible for water damage to own Unit and other Units from leaks or clogs originating in any part of a Unit

• maintenance and repair of all electrical and related systems and components that serve the Unit, including exterior fixtures that serve the Unit

• maintenance and repair of all HVAC systems that serve the Unit

• maintenance, repair and replacement of floor coverings appurtenant to the Unit and to insure that sound transmission between Units is minimized

RULES

The rules summarized here may be found in Article XI of the Bylaws of Market Street at Town Center Condominium. The Board of Directors may also pass additional rules and regulations. If you have questions, contact the Community Manager at (703) 435-7912.

ACCESS AND KEYS

According to Article XI Section 7 of the Bylaws, each Owner automatically grants the Association right of access to his Unit for specific purposes. These include making inspections, correcting conditions originating in the Unit that threaten other areas, installing, maintaining, or replacing Limited Common Elements, or to correct conditions that violate the mortgage. However, requests for entry should be made in advance in writing and should be at a time convenient to the Resident. In case of an emergency such entry shall be immediate whether the Resident is present or not. The Association requires Owners to provide the Association with key(s) to all locks on entry doors to their unit and to any interior doors that can be locked. This is to ensure that the Managing Agent can gain access in the event of an emergency and for necessary maintenance after notice to the Owner or Resident. Access to these emergency keys is controlled. All keys are kept in a special Key Trak system that controls access. If for any reason you change the locks on any of your doors, you must provide a new key to the Association.

MOVING PROCEDURES

• Reservations are required for all moves. • Move dates must be scheduled and confirmed by the On-

Site Office five or more days before the move. A move in fee of $400.00 must be paid before move.

• Moves can be conducted between 9:00 AM and 4:30 PM. • Generally, moves will be scheduled Monday through

Saturday; however, under exceptional circumstances, the Managing Agent may approve a move for a Sunday or holiday.

• The service elevator and loading dock will be reserved for the exclusive use of the Owner or Resident during the time of the scheduled move. Please see the Community Manager to reserve.

• It is strongly suggested that moving operations be completed within one day. All furniture, furnishings, and packed or stored belongings should be moved in on the scheduled move date. Additional move days may be granted but are based on scheduling availability.

• If other furniture, stored belongings or large items are to be delivered after the moving day, delivery reservations must be scheduled through the Community Manager’s Office.

• Building personnel and staff will be available to assist you with information and directions during your move.

• Carrying and moving of furniture and personal belongings will remain the responsibility of your professional moving firm. Please remember that you or your moving company are responsible for disposing of all packing materials, cartons, wrapping or other debris following your move.

40Permitted animals include no more than one (1) orderly dog, 40lbs or under; two (2) orderly cats; orderly caged birds and aquarium fish. Please refer to Policy Resolution No. 04-06: Rules and Regulations Regarding Pets. The policy can be accessed on the website at www.marketstreetattowncenter.com All pets must be registered with the Association. A Pet Registration Form can be accessed through our web site or by contacting the Community Manager. Pets must be leashed or carried and under the control of a responsible person at all times when they are on the Common Elements. They must not be permitted to wander unattended and they must be curbed. Owners are responsible for cleaning up after their animals. Pets may not be left outside unattended (including on balconies or terraces) or tied to any objects on the Common Elements. Pets may not be kept in violation of Fairfax County ordinances and must be properly inoculated. Pet owners are responsible for any damage to property or injury to persons or other animals that may be caused by their pet. Any Owner or Occupant who keeps a pet on the Property shall be deemed to have indemnified and released the Association, each of the other Owners, Occupants, the Declarant and managing agent from any liability related to that pet. If a pet becomes a nuisance by virtue of behavior, noise or sanitary conditions, the Association may, on ten (10) days written notice, have the pet removed from the property. Such an action should never be required if all pet owners are responsible about their pets.

PARKING GARAGE

The use of the garage is limited to unit owners and authorized residents of Market Street at Town Center Condominium. Refer

41to the Bylaws: Article IX, Section 1(g) and (u) and Article XI, Section 5. The following guidelines should be followed: • Tail-gaiting upon entry to the garage is not permitted. Each

vehicle must gain entry to the garage through use of the garage entry device assigned to owners of garage parking spaces.

• Only vehicles authorized by the owners of garage parking spaces may park in the respective spaces. Non-authorized vehicles will be towed.

• No commercial trucks, buses or any commercial vehicle may be parked overnight in any of the garage spaces.

• No Trailers, campers, recreational vehicles, house trailers boat trailers or boats may be parked in the garage.

• Vehicles, which do not display all applicable current state and local vehicle registration and stickers, will be considered junk or derelict and will be removed from the garage.

• Vehicles may not be repaired on the Condominium Property. • Personal items and property may not be left in parking spaces. Please check with the Community Manager for any additional parking restrictions. The Association may tow vehicles that are in violation of these rules. If your vehicle has been towed call Henry’s Towing 703-464-5599.

USE OF COMMON ELEMENTS The Common Elements and Limited Common Elements of the Market Street at Town Center Condominium exist for the benefit and enjoyment of all residents and owners. Please help the

42Association take care of the Common Elements and Limited Common Elements by picking up trash that you might encounter and by promptly reporting to the Community Manager any items in need of attention or repair. Nothing should be done that impedes others' ability to use and enjoy the Common Elements and Limited Common Elements. These Areas shall be used only for the services and facilities for which they are intended. Nothing may be installed on or removed from these areas without prior written application to and approval from the Board of Directors or a designated committee. Nothing may be stored on the Common Elements or Limited Common Elements. The entranceways must not be obstructed or used for any purpose other than ingress and egress to and from the premises. Nothing can be stored or kept in these areas.

USE OF RESDENTIAL UNITS

Antennas and Satellite Dishes Antennas located entirely within a Residential Unit and not visible from the exterior are permitted. Any antenna or aerial erected or installed on the exterior walls of a Unit or on the Limited Common Elements or Common elements of the Condominium (including the roof) without the written approval of the Board of Directors is subject to removal and disposal without notice and at the cost of the Unit Owner. For units with balconies, Satellite Dishes that do not exceed one (1) meter in diameter are permitted. The Board of Directors or the RTCA Design Review Board may impose reasonable rules and regulations regarding the location and screening of any such satellite dishes, subject to applicable governmental regulations. For units without balconies, Satellite dishes must be secured to the roof of the building by the Satellite Dish provider approved by

43the Board of Directors. Contact the Community Manager for additional information on the installation of Satellite Dishes.

Decorating and Remodeling All interior modifications to a unit must be pre-approved by the Board of Directors. Structural modifications and major remodeling may be performed only after prior written application to and approval from the Board of Directors and, if required, Fairfax County, as provided in Article VI, Section 9 of the Bylaws.

Fireplaces/Grills Owners may not install any type of fireplaces without prior written consent of the Board of Directors. No open flame or gas barbecue grills shall be allowed on the Condominium Property. Storage of flammable fuels is not permitted.

Garage Spaces Garage spaces may only be used for parking automotive vehicles. They shall not be used or altered in any way that would prohibit the parking of such a vehicle.

General Appearance/Lawful Use Residents must maintain Units so that the homes do not become a nuisance by virtue of external appearance, noise or sanitary conditions. Those portions of a Unit that are visible from the exterior must be kept in an orderly condition. No bicycles, motorcycles or other motorized vehicles may be kept on patios or balconies. Owners and residents must obey all laws, orders, and requirements of any governmental agency having jurisdiction over the Condominium Property. No Unit Owner shall permit anything to be done or kept in his Unit or Limited Common Element that will result in an increase in the rate of insurance or cancellation of insurance for the Condominium Property.

Home Occupations

44Home occupations are permitted subject to both local zoning regulations, the Association Bylaws, and the rules and regulations enacted by the Board of Directors. Refer to Policy Resolution No. 03-06: Home Occupation Policy (accessible on the web site: www.marketstreetattowncenter.com). Each Owner or Resident who intends to conduct a home occupation business must inform the Association of the intent to do so and must register with the Association using the “Occupation Disclosure Form” (available on our website). In addition, the home occupation must meet Fairfax County licensing and approval requirements for “Home Occupations.” All necessary licenses and permits must be obtained from Fairfax County. Refer to the Fairfax County web site for more information regarding the county’s Home Occupation Permit Guidelines: www.fairfaxcounty.gov/dpz/zoning/homeoccupation.htm .

Key and Locks

The Board of Directors may retain a pass-key to all Units pursuant to its right of access See Bylaws Article XI Section 1(o). Owners may not alter any lock or install a new lock without the written consent of the Board of Directors. If such consent is given the Owner shall provide the Association with copies of the new key(s).

Laundry

No outdoor clotheslines or similar devices are permitted on any part of the Condominium Property, including Limited Common Elements. Clothes shall not be hung anywhere except in areas, if any, designated by the Board of Directors.

Leasing of Units Owners may lease their homes subject to the provisions of the Bylaws, Article XI Section 1(f). If you decide to do so please contact the Community Manager to get the most recent information as to leasing requirements. In summary, no unit may be rented without a written lease and each lease must contain in its body or in an addendum an indication that the unit is part of an Association and is subject to the Association Instruments and Rules and Regulations. Units may not be rented for transient,

45hotel or motel purposes. They may only be leased for an initial term of at least six (6) months. Owners are responsible for the actions or omissions of their tenants, whether such actions cause damage to the common elements or the unit, or are a violation of the Bylaws or rules and regulations of the Association. For your own protection, as well as your lessee's, you should take steps to assure that tenants are aware of and agree to comply with the rules and regulations.

Residential Use

Except as provided in the Declaration no Residential Unit shall be used for other than housing. As noted in the Fairfax County Home Occupation Guidelines: Home Occupation Permit Limitations, the home occupation must be conducted within the dwelling which is the primary residence of the home occupation permit applicant. Refer to section on “Home Occupations” (above).

Rugs and Floor Padding Although the buildings have been constructed in accordance with current Federal Sound Transmission Standard, they are not soundproof. In Units that are located over other Units, Article XI Section 1(j) of the Bylaws requires that rugs and padding shall be maintained on seventy-five percent (75%) of all floor surfaces.

Security Systems Individual security systems are permitted with prior written approval of the Board of Directors. The Association must be aware of these systems and have codes for access in case of an emergency.

Signs No sign of any kind shall be erected, posted, or displayed upon, in, from or about any Unit or Common Elements without the prior written approval of the Board of Directors.

Sound Transmission and Noise It is both possible and likely that you will hear sounds from other units and from the Common Elements. Those who are

46particularly sound-sensitive people might find sound levels unacceptable at times. All residents are asked to use consideration when practicing voice or instruments or when listening to the radio, television or stereo. Bass sounds in particular seem to travel more and create vibrations, so bass and volume levels must be maintained at a level that will not disturb other residents. Fairfax County regulates noise through its County Codes. Essentially it states that "nuisance" noise (TV, radio, musical instruments, etc.) should not be excessive between the hours of 11 p.m. and 7 a.m. If you wish to report excessive noise to the police, call the non-emergency number (703-691-2131) and ask that the officer come to your location so they can document the noise.

Storage

Items may be stored only in areas designated by the Association for storage.

Terraces and Balconies

The following items and activities are prohibited on terraces and balconies: • Airing or drying of clothing or other materials • Antennas or satellite dishes attached to balconies • Awnings • Bicycles and tires • Bird feeders or statues • Children’s toys • Flags –seasonal and displayed longer than 4 weeks • Hangers installed in the ceiling above • Hanging plants • Items of furnishing which may be pushed or blown off the

Trash

No trash or garbage should be stored or allowed to accumulate in Units or in Common Elements. No trash or garbage should be left outside of a unit’s entry door. Burning or incineration of trash is prohibited. All trash, garbage or other refuse must be bagged and deposited in the Trash Rooms located on each floor. Dirt or other substances must not be swept or thrown from a Unit’s windows or balconies and terraces to the outside.

Waterbeds Waterbeds are not permitted in any Unit without the written consent of the Board of Directors.

RESALE OF A HOME The Virginia Property Owners Act and the Virginia Condominium Act require that a certificate of Resale be provided to prospective purchasers for each Association that has jurisdiction over the property being sold. In this case that means that an Owner should provide information about the Market Street at Town Center Condominium Unit Owners Association and the Reston Town Center Association. The Resale Packet provides information on the status of assessment; whether there are any violations involving the unit, and provides certain information regarding the Associations. It must be requested from the Managing Agent in writing by the seller or seller's agent and the appropriate fee paid in advance. Virginia statute provides for a charge for preparing this document.
