If a plan for consolidat•on is prepared, the Commission shall

consider in that plan the follow•ng:

1. The governing Board shall be as s•all as possible to be

responsive, w•th a balance of at-large and d•strict members.

2. The for• of goverrment shall be the Council-•anager Plan.

I£ the Cc®•ission prepares and agrees upon a plan for consolida-

ing the City of Charlotte and •eoklenbu•g County into a single government,

the Commission ahall call a referendum on Ire proposed plan of governmental

consolidation. A decision by the C•iselon to call a referendu• shall be

effective when ratified by the Charlotte City Councll and the Mecklenburg

County Board of Commissioners. The referendum may be held on the same day

as any other referendum or election in the City of Charlotte or the County

of Mecklenburg, but •ay not otherwise be held during the period beginning

30 days before and ending 30 days after the (Lay of any other referendum or

election to be conducted by the Board of Elections conductln• the referendum

and already validly called or scheduled by law. Expenses dlrectly involved

in the election shall be shared by the City and the County.

The proposition submitted to the voters shall be in substantlally

A motion was made by Couwcilmember Campbell and seconded by

Councilmember Martin for the adoption of the followlng Resolution, and upon being put to a vote was duly adopted:

WHEREAS, the City Code of the City of Charlotte, in Section 14-57(d) requires that all traffic controls conform to either the "manual and specifications approved by the State board of transportation or resolution adopted by City Council", and

WHEREAS, residents of the Medearls, Queen's Grant, and/or Stonehaven neighborhoods have requested the installation of 4-way stops at two locations supported by petitions representing at least 75% of the affecte• resldents, and

WHEREAS, the installation of the 4-way stops do not conform to the Manual on Uniform Traffic Control Devices (MUTCD),

NOW, THEREFORE, BE IT RESOLVED, by the Charlotte City Council, in re•j•lar session duly assembled,

THAT, in the interest of protecting and promoting public safety and convenience, the City Council of the City of Charlotte directs that 4-way stops be installed at the following intersections:

I. Burlwood Road and Lido Avenue 2. Jester Lane and Redcoat Drive

The Issuer and the Bond Registrar (as hereinafter defined) will recognize the Securities Depository Nominee, or the

Securities Depository, as the case may be, while the registered

owner of Bonds, as the owner of Bonds for all purposes, including payments of principal of, and redemption premium, if any, and interest on the Bonds, notices and voting. The principal of an•

any redemption premium on each Bond shall be payable to the Securities Depository Nominee or any other person appearing on

the registration books of the Issuer hereinafter provided for as

the registered owner of such Bond or his registered assigns or

and all references in this resolution to any predecessor Securities Depository or Securities Depository Nominee shall thereupon be deemed to mean such other depository

or its nominee. If the Issuer fails to identify another qualified Securities Depository to replace the predecessor Securities Depository, th• Issuer will deliver replacement Bonds in the form of fully- registered certificates in the denomination of $5,000 or any multiple thereof ("Ce rtlflcated Bonds") in exchange for the

outstanding Bonds as required by the predecessor Securities Depository and others. Upon the request of the Securities Depository, the Issuer may also deliver one or more

available for such purpose, either in whole on any date not

earlier than March i, 1997, or in part on any interest payment date not earlier than March I, 1997, at the principal amount of

the Bonds to be redeemed, together with interest accrued thereon[ to the date fixed for redemption, plus a redemption premium of

the registered owner or his attorney or legal representative in

,such form as shall be satisfactory to the Bond Registrar. Upon ,iany such registration of transfer, the Bond Registrar shall

authenticate and deliver in exchange for such Bond a new Bond or

Bonds, registered in the name of the transferee, of any denomina• Ition

or denominations authorized by this resolution, in an

laggregate principal amount equal to the unredeemed principal amount of such Bond so surrendered, of the same maturity and

bearing interest at the same rate.

In all cases in which Bonds shall be exchanged or the

Itransfer of Bonds shallbe registered hereunder, the Bond

Registrar shall authenticate and deliver at the earliest

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHARLOTTE CONCERNING PROCUREMENT OF ARCHITECTURAL AND/OR ENGINEERING SERVICES

FOR CAROLINA STADIUM

WHEREAS, the 1987 General Assembly enacted House Bill 27? (Ch. 102) which establishes a general public policy that procurement of engineering and architectural services for state and local construction projects should normally be based upon a merit selection process with later negotiation on the fee, rather than through a competitive bidding process based primarily on the fee; and

W•EREAS, the act allows a governing body to deviate from the general public policy and use estimated costs as a factor in the selection process, if the particular project is exempted in the sole discretion of the local governing body; and

WHEREAS, the City Council of the City of Charlotte has determined that it is desirable and in the best interests of the City of Charlotte to exempt the Carolina Stadium project from the requirements of the act.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Charlotte •hat:

(1) For the following reasons, the City Council of the City of Charlotte hereby finds that the Carollna Stadium project shall be exempt from the general public policy requirements concerning the selection of architectural and engineering services:

Carolinas Stadium is a high priority project with very severe schedule constraints. These tight time constraints require a familiarity with the project site in order to get the work done on schedule. The potential for liability makes it advantageous that one firm perform services.

(2) The City Council hereby authorizes the City Manager to use whatever method or procedure is most manageable and likely to result in the acquisition of competent,professional architectural or engineering services at a reasonable cost for said project.

RESOLUTION DECLARING AN INTENT TO ABANDON AND CLOSE A PORTION OF RARLEE AVENUE LOCATED BETWEEN THE SOUTHERLY RIGHT-OF-WAY LINE OF OLD DOWD ROAD AND THE SOUTHERLY RIGHT-OF-WAY LINE OF THE SOUTHERN RAILROAD IN THE CITY OF CHARLOTTE, MECKLENBURG COUNTY, NORTH CAROLINA.

WHEREAS, the Aviation Department of the City of Charlotte has ffiled, a Petition to close a portion of Harlee Avenue in the City of! Charlotte; and

WHEREAS, the portion of Harlee Avenue petitioned to be closed liies in the proximity of Old Dowd Road the Southern Railroad as shown on a map marked "Exhibit A", and is or particularly de!scrlbed by metes and bounds in a document marked "Exhibit B", bolth of which are available for inspection in the Office of the Ci!ty Clerk, City Hall, Charlotte, North Carolina.

WHEREAS, the procedure for closing streets and alleys as oultllned in North Carolina General Statutes, Section 160A-299, re•ulres that Council first adopt a resolution declarln its In•ent to close the street and calling a public

hearlnggon the qu•stlon; said Statute further requires that the resolution shall he,published once a week for two successive weeks prior to the he•rlng, and a copy thereof be sent by registered or certified

RESOLUTION AtFrHORIZING THE REFUND OF CERTAIN TAXES

Reference is made to the schedule of "Taxpayers end Refunds Requested" attached to the Docket for consideration of the City Council. On the basis of that schedule, which is incorporated herein, the following facts are found:

1. The City-County Tax Collector has collected certain taxes from the taxpayers set out on the list attached to the Docket.

2. The City Tax Collector has certified that those taxpayers have made proper demand in writing for refund of the amounts set out on the schedule within eight years fro• the date the amounts were due to be paid.

3. The amounts listed on the schedule were collected through clerical error or by a tax illegally levied and assessed.
