Town Clerk's Report.

TO HIS WORSHIP THE MAYOR AND COUNCILLORS, CITY OF MALVERN.

Gentlemen,

I have the honour to submit the Annual Report for the year 1941-42 as follows:--

At the conclusion of another Municipal year we find our nation fighting against Dictatorships -the War taking on another phase-Japan linking up with the Axis Powers attacked America a t Pearl Harbour, and America thus joining up with the Allies. This action of Japan brouyhi the War closer to Australia, thus forcing its people to apply themselves more seriously to the conduct of the War. We trust and pray that before the close of another financial year, the world will be a t peace, and made safe for the peoples of the world.

WAR ACTIVITIES.

The various activities in Malvern since the prosecution of the War have been maintained throughout the year. The financial position of the various Organisations, is as follows:-

(a) CITY OF MALVERN WAR FUND.-Efforts have been made to increase support to this Fund, particularly with regard to weekly collections in the various streets of Malvern and the Salvage of waste. The aim is to have a Collector for every street for each of these two Branches. If this were done, i t is considered that a sum of 37000 could be raised by Weekly collections, and $2000 by the sale of waste.

(b) WAR SAVINGS CERTIFICATES.-The aim is to increase the number of War Savings Groups in Malvern. At the present time we have 67 Groups, and for the year ending 30th September, 1942, taken up 37058 nf War Savings Certificates. I t is hoped that ultimately every street will be included in a Group, and the amount raised in this manner will be con- siderably above that a t present collected. I t is pointed out that this money is not a gift but a loan bearing good interest for the investor, and a t the same time helping the Government to prosecute the War.

(c) WORK BRIGAD8E.-This Organisation is maintaining its good work for the Red Cross, and during the year expended £49;'10/4 for material to work up into useful articles Its produc- tion of articles for the year is 773.

(d) RED CROSS.-This activity is carrying on i ts good work, and during the year raised 21857 and spent $1890 on materials. The number of articles sent in was 10,033.

(e) COMFORTS FUND.-This Organisation is also continuing its activity, and collected in the year $3785, and spent S3738/15/8 on materials. The number of articles sent is 30,646.

ENLISTMENTS FOR OVERSEAS SERVICE.

Owing to the compulsory Call-up consequent on the entry of Japan into the War, the Council limited the presenting to each one who enlisted for Overseas service, a morocco wallet embossed with the City Coat of Arms, together with a letter under the Seal of the Council, expressing the gratitude of Malvern citizens to them for their service, to those who enlisted prior to 1st August. 1941. This decision is subject to review in 1943. The number of enlistments recorded on the

Honor ~ o l l is 2090. Whilst this is a large number, there are a number of Malvern citizens who have enlisted, the names of whom the Council has not yet received, and i t would appreciate infor- mation regarding any Malvern citizen who has enlisted for Overseas service, so tha t the Honor roll might be complete.

CASUALTIES.

The record of casualties amongst Malvern citizens as recorded on Council's books is 115.

MUNICIPAL ELECTIONS. ANNUAL ELECTIONS.

The Government gazetted a National Security Regulation suspending the Annual Municipal Elections which were to have taken place in August, 1942, extending the term for which the Councillors who would have retired in August, 1942, for one year. Those Councillors were:-

STAFF. During the year, F. Robinson (Accounts Clerk in Town Clerk's Office) was given leave for

the duration of the War to join the A.I.F. and W. J. Downie (Assistant Rate Collector) to join the R.A.A.F., and R. McKinnon to join the 37th Eattalion.

VALUATIONS. The Return submitted by the Valuer (Mr. E. L. Bennett) for the year 1941-42 showing the

valuation of Rateable property within the City and the total after subsequent reductions on Appeal, was as follows :-

LEGISLATION. The following Acts passed during the year by the State Parliament directly concern or are

likely to be of interest to Municipal Councils.

4832. COUNTRY ROADS BOARD FUND ACT, 1940, is a similar Act to one that has been passed every year since the Financial Emergency Legislation in 1932. Provides that Motor Drivers' Licence fees shall during the current financial year be paid into Consolidated Revenue instead of the Country Roads Board Fund. Also pl-ovides for the suspension for another year of the payment of $50,000 from Consolidated Revenue into the Country Roads Board Fund which was provided for in Section 38 (2) of the Country Roads Board Act, 1928, out of which amount the sum of E40,000 was distributed among Metropolitan Municipalities and certain provincial Cities in the form of Grants for the upkeep of main traffic routes.

4840. STATUTE LAW REVISION ACT amends Section 2 of the Local Government Act, 1928, which repeals previously existing Local Government Acts for the purpose of saving the operation of the Thirteenth Schedule of the Local Government Acts of 1874, 1890 and 1903 when in force by virtue of any Muncipal By-Law.

4851. LOCAL GOVERNMENT (FRANKSTON STREET CONSTRUCTION) ACT validates a scheme of street construction a t the cost of owners of adjoining lands which was pre- viously considered to be invalid for the renso:l that the Council had included in the cost of construction apportioned to the owners the cost of purchasing land to widen a street and the cost of construction of the widened portion.

4852. MELBOURNE (SUBWAYS) ACT authorises the Melbourne City Council to construct sub- ways with the consent of the Governor-in-Council, to maintain any subway so constructed and to erect shops or show-cases in any such subway and to lease such shops or showcases. Provides for co-operation between the Council and other Public Authorities with respect t o works affecting such Public Authorities. Authorises the borrowing of $250,000 for the purposes of the Act.

4356. DOG ACT amends the definition of "Owner" in the Principal Act. Provides for a penalty on owners of greyhounds not muzzled and not under the effective control of some person by means of a leash when elsewhere than Gn the premises of the owner. Provides that "effective control" shall not be deemed to include the control by one person of more than four (4) greyhounds. The Section relating to control of greyhounds applies in Cities, Towns, Boroughs and to such Shires or parts of Shires as are specified in the proclamation of the Governor-in-Council. Provides for a penalty on owners of dogs found a t night in certain Municipal districts specified by order of the Council of the Municipality where such dogs are elsewhere than on the premises of the owner and are not under effective control. Provides for a penalty on owners of dogs which are not effectively muzzled found in rail- way trucking yards while sheep are present in such yards.

4860. MOTOR CAR (REGULATION) ACT amends the Motor Car Act 1928 by authorising the making of regulations by the Governor-in-Council with respect to the use of gas producers fitted to or on motor cars.

4863. LOCAL GOVERNMENT (SEPTIC TANKS) ACT authorises a Council to instal a septic tank on State School grounds or on Crown lands reserved for the purposes of public recrea- tion or any other public purpose, and to accept a guarantee of payment satisiactory to the Council of the cost of the installation from any persons, whether members of the Committee of Management or not. Authorises the Committee of Management to pay the cost of the installation to the Council out of its funds.

4867. HEALTH ACT contains a new definition on "public building." Empowers the Governor- in-Council" on receipt of a complaint from the Council of any Municipality to order the fitting of a device to prevent emission of dust, gri t or ashes from a chimney. Provides for payment of a fee of 5/- to a Council for examination of plans, etc., of a septic tank system. Contains an interpretation of the word "establish" in connection with offensive trades. Provides that a Council shall nctify an objector if i t grants an application for an offensive trade and fixes a time for appeal against consent by a Council to the establish- ment of an offensive trade. Provides that Councils may not establish an offensive trade or add to, extend or alter premises in which an offensive trade is carried on without tho Commission's consent. Provides that an abattoir in a meat area is not to be altered without approval of the Commission, and that an abattoir after eredtion, alteratlion, extension or addition is not to be used without approval of the Commission. Provides that a Council, in the case of a public abattoir in a meat area, and the owner, in the case of a private abattoir, shall when required by the Commission, provide a chilling room of such capacity as the Commission requires. Extends the definition of "dangerous trade" to include any trade which may become dangerous to the health of persons employed therein or other per- sons. Provides that all premises used for the purpose of carrying on a dangerous trade must be registered with the Commission. Empowers the Governor-in-Council to make Regulations in respect of dangerous trades. Provides that a Council shall not add to, extend or alter a cattle saleyard without the Commission's consent. Provides that the sum recoverable by a Council from an infectious disease patient treated in a hospital shall be such sum as is fixed by the agreement between the Council and the hospital, subject to a proviso that in determining the amount to be paid, regard shall be had to the means of the patient. Extends the definition of "public buildings" which must be registered with the Commission, and provides for the making of regulations as to the construction of public buildings. Authorises the Governor-in-Council to make regulations as to boarding houses and lodging houses relating to means of egress, sanitary conveniences and baths. Amends Section 249 of the Principal Act regarding division of samples taken for analysis, permitting such samples to be divided into more than three parts if considered necessary. Provides tha t the purchaser for resale of any food, drug or substance may demand a warranty from the vendor that the food complies with the provisions of the Health Act, and that in the event of proceedings, if the defendant proves that he purchased the food, drug or substance with a written warranty as aforesaid and that he sold the food, etc., in the same state as when he purchased it, he shall not be convicted. Empowers Councils to employ slaugh-

termen on behalf of persons using the abattoirs, and carters to deliver meat from the abattoirs. Prescribes a scale of fees that may be charged for the use of a public abattoir for slaughtering. Provides that Meat hspectors may be appointed for private abattoirs in meat areas only. Provides tha t all meat brands shall be procured by the Commission and rendered to Councils. Provides for the licensing of vehicles after inspection and approval By (the Council for the conveyance of carcases and meat. Deletes from the category of offensive trades forming part of and used in connection with tanneries or stores for grading and packing dried rabbit and other dried fur skins. Reduces the maximum fee for regis- tration of offensive trades premises used for fa t extracting or melting or rendering works a t premises occupied principally as a butcher's shop.

4869. LOCAL GOVERNMENT ACT, 1941-

Section l-Short title.

Section 2 P r o v i d e s that where a road, railway, stream or water course has been described as a boundary of a Municipal district, a line along the centre of such road, rail- way, stream or water course shall be deemed to constitute such boundary.

Section 3-Provides for the time as from which orders constituting new Municipalities will take effect.

Section 4-Provides that no unnaturalized alien may be a Councillor or may vote a t an election of Councillor for any Municipality. Repeals the Chinese Act, 1928.

Section 5-Provides that every Councillor shall take the oath of allegience.

Section &Provides for reimbursement of Councillors' travelling expenses incurred outside the Municipality.

Section 7-Provides tha t notice of holding of Revision Court may be placed either on the outer door or outer wall or on a notice board outside some public or conspicuous building.

Section 8-Makes verbal amendments in Sections 117 and 126 of the principal Act regard- ing the time for holding extraordinary elections and the time of giving notice of a n election.

Section 9-Makes provision for voting a t Municipal elections by a person whose name is omitted in error from the Municipal roll, and sets out procedure to be followed.

Section 10-Extends from six months to twelve months the period between the date of an election and the destruction of ballot papers:

Section 11-Provides for a recount of votes in respect of polls on proposals for the constitu- tion, etc., of Municipalities, rating on unimproved values and borrowing for per- manent work.

Section 12-Provides that where a Council proposes to remove, discharge, or terminate the employment of any officer, the Council must either order an inquiry or suspend him. On suspension the officer may apply for an inquiry. In the event of an inquiry being held the Council shall not give a decision until after the reading of the report of the inquiry.

Section 13-Substitutes the term "Municipal Engineer" for "Municipal Surveyor." Gives power to the Municipal Clerks' and t,he Municipal Engineers' Board to make regulations relating to the qualification of Municipal Clerks and Municipal Engineers respec- tively.

Section 14-Authorises the making of By-Laws for the following purposes :-

(a) Prohibiting or regulating the sale of goods from stalls, etc., on roads or public places.

(b) Requiring the removal of undergrowth, etc., from land in a populous or resi- dential area where such undergrowth, etc., constitutes a fire menace.

(c) prohibiting or regulating the soliciting or collection in any road or street or from house to house of gifts of money or subscriptions.

(d) Controlling the uqe of footways or roadways by children using skates, trucks, scooters, etc.

(e) Prohibiting or regulating camping on roadways. (f) Authorising the placing on loads (subject in the case of certain roads to the

approval of the Country Roads Board) of stands for milk cans and regulating the nature, size, situation and use of such stands.

(g) Providing for the proper custody of animals in cattle saleyards.

Section 15-Authorises the making of By-Laws, subject to the approval of the Governor-in- Council for requiring the demolition and removal of the remains of buildings which have been wholly or partly burnt down or demolished.

Section 16-Repeals and re-enacts Sections 208 and 209 of the Principal Act for the purpose of removing an inconsistency which existed between the two former sections.

Section 17-Provides that house numbers must be placed on the gate or gatepost or in such other conspicuous position as the Council determines.

Section 18-Amends Clause 19 of Par t 1 of the 13th Schedule to provide tha t in the construc- tion of a crossing in streets where the kerb is of concrete, brick, or other per- manent material, the crossing shall be kerbed with the same material.

Section 19-Gives power to Councils to use or licence any person to use town or shire halls for providing entertainment, etc.

Section 20-Gives power to Councils to repay moneys overpaid or wrongly paid to the Council.

Section 21-Exempts frgm rating:- (a) land in the occupation of or under the management and control of any religious

body upon which is situated any hall or other building used in connection wit:] any church exclusively for any purposes connected with or in support of the objects of such religious body.

(b) land vested in or held in trust for any religious body and used exclusively a3 the residence of a practising Minister of Religion.

Provides further that land shall not be deemed not to be used exclusively foi any of the purposes referred to in paragraphs (c), (g), (h) or (i) of sub-sectiou (2) of this section by reason only of the fact that any building on such land is used not only for any purposes referred to in the said paragraphs, but also for any purposes connected with or in support of the objects of any religious, educational or charitable body or authority occupying or controlling sucn land. The provisions of Section 249 of the Principal Act amended by the forego- ing are applied t o the Cities of Melbourne and Geelong. The exemption from rating

of property of religious bodies provided for in this section are not to apply for the purposes of any other Act under which land is rateable by reference to the pro- visions of Division b of Par t X of the Principal Act. This section shall be deemed to have come into operation on the first day of October, 1941.

Section 22-Provides that where a supplementary valuation of any property is returned the amount of rate payable in respect of such property shall be calculated pro rata on the existing valuation for the period up to and including the date on which the supplementary valuation is returned and on the supplementary valuation for the remainder of the year.

Section 23-Provides tha t where a new Municipality is created by severance from one in which rating on unimproved values is in force, such system of rating shall be continued in the new Municipality.

Section 24--Reduces the period during which land must be vacant and unoccupied before i t can be sold for recovery of rates under Sections 366 and 379 of the Principal Act from 10 years to 7 years.

section 25-Simplifies the procedure involved in producing evidence in proceedings to enforce a charge on land.

Section 26-Provides for the Governor-in-Council determining the limit of overdraft that may be incurred by a newly-constituted Municipality.

Section 27-Empowers an auditor or inspector, in cases where any officer of a Council having custody of books or moneys is also an officer of a Waterworks Trust or other local governing body with a similar duty, to demand the production of any cash books, etc., belonging to the Waterworlts Trust or local governing body of which such officer has custody or control.

Section 28-Provides that where i t is impracticable to serve notice of intention to take land com- pulsorily in the manner provided in Section 510 of the Principal Act service may he effected by posting the notice on the land.

Section 29-Amends Section 526. Provides that a mortgagee in possession may consent to the amendments of title of land consequent on the purchase of an old road or the open- ing of a new road.

Section 30-Amends Section 531 by permitting a Council to reduce the width of a road in certain cases without the concurrence of certain owners, and provides for the disposal of land taken from a road reduced in width.

Section 31-Gives power to the Governor-in-Council in cases where under the present Act he may authorise the erection of uiilocked swing gates on a road to authorise or require the provision of cattle pits, ramps or other suitable means of passage.

Section 32--Clarifies Section 553 of the Principal Act in regard to the width of tree reserves on any street.

Section 33-Authorises a Council to refuse to seal a Plan of Subdivision if the width of any new street or road shown in such plan is less than 66 feet.

Section 34-Authorises a Council to refuse to seal a Plan of Subdivision unless the owner agrees to transfer any reserves shown on the plan to the Council.

Section 35-Amends Section 70 of the Local Goverment Act 1934 in regard to plans of Sub- division by requiring that such plans shall show lands reserved for reticulation of telephone services.

Section 36-Provides for the establishmeht of standard survey marks and for fixing alignment of streets.

Section 37-Applies the provisions of Division 5 of Par t XXI. of the Principal Act to the Cities of Melbourne and Geelony.

Section 38-Gives Councils powers to make By-Laws regulating the use of dams made by '

Councils on roads.

Section 39-Provides tha t Council may enlarge or improve any existing Waterworks which have been provided ,for the gratuitous supply of water, and thereafter may charge for the supply of water from such waterworks.

Section 40-Amends Section 725 of the Principal Act by providing tha t rents or dues may he charged for the sale in a Municipal market of any goods in addition to charges for the sale of produce and cattle.

Section 41-Provides tha t in a Municipal market to be used solely for the sale of cattle, it shall not be necessary to provide weighing appliances.

Section 42-Authorises a Council to apply the Municipal Fund to the providing of scholar- ships a t schools referred to in paragraph (A) of Section 773 of the Principal Act.

Sestion 43-Provides tha t in legal proceedings the production of maps, plans or documents certified under the hands of the Municipal Clerk shall be evidence until the con- t rary is proved.

Section 44-The provisions of Section 824 are applied to the Cities of Melbourne and Geelong. Authorises Councils to apply their lVIunicipa1 Fund towards establishing, main- taining or otherwise aiding ambulance services.

Section 45-Authorises Councils to sell timber removed during road-making operations. Section 46-Authorises Councils to place and maintain horse troughs in any street or road,

and provided a penalty for the destruction, removal or injury of such troughs, o r the pollution or waste of water therein.

Section 47-Provides that no person shall without the consent of the Council place any bee- hives on or within 10 feet of any street or road.

ITEMS OF MUNICIPAL INTEREST. LOCAL GOVERNMENT.

The Local Government Bill referred to in last year's report was slightly amended so f a r as rating of Church property was concerned and passed by Parliament. As a result of the passing of this Act, the Council is of the opinion tha t i t loses Rates to an amount approximately $250 per annum. Another Bill is now before the Legislative Assembly with regard to procedure for con- struction of Private Streets. Municipalities for a number of years have been aware of the pitfalls regarding such work, and have over that period a ~ i t a t e d for simplification of the procedure governing same. The Bill now before the House promises to accomplish this. Under the Bill every person proposed to be charged for construction of a street may, before the work is carried out, appeal to a Court of Petty Sessiona, which will decide the question, without any right to appeal to a higher Court. I t is hoped that the Bill will be finally passed by Parliament this year, thus pro- viding a simpler form of procedure for construction of Private Streets in the future. Municipali- ties are asking that procedure be made retrospective with regard to streets, monies for construc- tion of which are still owing to the Council.

RECORDS OF ENLISTMENT. With regard to the compilation of the "Honor Roll" of Malvern, citizens who have enlisted

for Overseas Services, the Council has decided to call a halt for the time being, and only place thereon those who enlisted prior to 1st August, 1941, and only give to those the Letter under Seal of the Council and the gift Wallet. It has decided to re-consider the matter in six months' time. The City of Malvern War Fund is sending out Christmas and Birthday cards and Canteen Orders to the men. The Roll now consists of the following-Army 1461, Navy 106, Air Force 523.

MUNICIPAL OFFICERS' SALARIES AND CONDITIONS. A Log claiming a new Award for Municipal Officers with regard to salaries and conditions 01

employment was served a t the beginning of the financial year on the Council by the "Municipal Officers' Association." The matter has been the subject of discussion between the Municipal Asso- ciation Executive Committee and the Association. Jus t a s the year closed, notification was received that a new Award was to be made by the Court :IS a result of the negotiations, which was practically the same as the old one with the cost of living allowances made during the period of the two Awards added to the salaries.

WAR DAMAGE. During the year the Commonwealth approached Municipalities through the State Premier

with regard to coIlection of contributions from property owners for War Damage. This the Municipalities undertook to do, and were recompensed for so doing by the War Damage Com- mission to the extent of 1/3 per assessment. The final figures for the year have not yet been reached, but i t is anticipated tha t the contribution will practically meet the cost to this Munici- pality with regard to the matter. The total amount collectable in Malvern was di27,527/0/9, and the amount thereof collected to 30th September, 1942, was 222,785/8/3.

MUNICIPAL ELECTIONS. Under authority given by Commonwealth Regulations, the Premier made an Order extending

the term for which Councillors who would have retired in the ordinary way in 1942, would be extended for twelve months, and that no Municipal Elections would be held in 1942,

NATIONAL EMERGENCY.

Under the heading of National Emergency, Municipal Councils had been called upon, generallj a t the request of the Government, to expend money, and were promised contributions from the Government as follows :-

Towards construction of Trench Shelters 75%. Provision of 1st Aid Posts 100 %. A.R.P. Organisation (including provision of Control Room) 50%. Provision of Post-Raid Welfare Accommodation 75%. Food Stores for same 75%.

This Council has submitted Accounts on account of amounts expended on the abovementioned, and has received cheques less deductions - the main one being for Overtime worked on construction of various works, and also maintenance of same. My Council is of the opinion that because condi- tions have changed somewhat during the year, the Government should not leave the whole of these items to Municipalities to bear, and has submitted the matter to the Metropolitan Sectional Council of the Municipal Association to take up with the Government.

PLAYGROUNDS. UNION STREET PLAYGROUND.

The Play Leader (Mrs. Wilson) submitted her Annual Report of Playground activities, as under :-

During the past year the activities on the Playground have been carried on in a quiet way. The holiday periods a re always busy, and full use is made of the equipment. We a re finding i t very difficult t o

keep a stock of sport materials going, and owing t o the shortage of rubber and the number of balls tha t a re lost, we have had to ask the children to supply their own. '

A number of the children have been very interested in making scrap books for the Children's Ward a t one of the hospitals.

About twelve tiny tots attend early in the afternoons and enjoy their usual games in the sand t rays with tea- sets and dolls.

The Tennis Courts a re not so full these days owing to the number of young men away. Saturday afternoons a re the busiest time but with warmer evenings the young folk a re making the most of the daylight saving and enjoy a game.

Miss Netta Gilbert, Assistant Playleader, joined the W.A.A.A.F. early in the year, and is now s e r v i n ~ a t Point Cook. Miss Lucas has taken her place.

Mr. Edwards also has been missed by the boys on the grounds. He was very popular with them, always taking a keen interest in their sport and behaviour on the grounds.

Once again I wish to express my thanks t o the Council for their continued support of the work among the children on the Playgrounds.

ARDRIE PARK PLAYGROUND.

The Play Leader (Mrs. Guest) submitted her Annual Report of Playground Activities, as under :-

The last twelve months have been satisfactory considering the times. Tennis has suffered somewhat because of our young men, but on the w h ~ l e sunny days always bring a fa~r . . pumber of young people seeking recreation.

During the last year a record number of children have been attending the Playground, and some of the equipment is showing signs of wear. Daylight saving was welcomed both last and this summer.

Mothers often remark t h a t i t is indeed a t reat to ge t away from their worries fo r a while and enjoy such peace and pleasant surroundings a s Ardrie Park Play,~round has to offer.

The addition of the telephone has helped both for Tennis and mothers inquiring about their children. The tiny tots never t i re of playing here. Sand trays, little chairs and swings are always a delight to them, and now, with the addition of a large rocker which has recently been donated t o the Playground, well, the days are just not long enough for the children. We all wish to thank Cr. Hyslop very much indeed for the pleasure he has given the children by this donation, also f o r his interest a t a!l times where the children's welfare is concerned.

The Ardrie Park Knitting Circle still prospers. Tournaments this year have not been played by the ladies. Instead, a straight-out giving has been adopted. Since the inception of the Circle, sufficient money has been raised to purchase our own wool, from which 1507 articles have been knitted and donated to the Malvern Branch of the Comforts Fund. Donations have also been given t o the Prisoners of War Fund, Our Bill, Xmas Hampers for our boys, and Heidelberg and Caulfield Hospitals from special efforts.

MALVERN AND EAST MALVERN BABY HEALTH CENTRES. ANNUAL REPORT FOR THE YEAR ENDED 30th JUNE, 1942.

The President and Committee of the Malvern Centres have much pleasure in presenting the 22nd Annual Report and Balance Sheet.

During the year eight meetings have been held. The Committee go into recess from November to March, and a t the commencement of this year it was agreed that the Meetings in future be held every three months for duration of the Wm.

We greatly regret to record the death of a very valued member of our Committee, namely, Mrs. H. L. James, who was a foundation member of the Malvern Centres since the inception of the movement, and for many years Treasurer. Mrs. Kingsley Henderson was granted three months' leave of absence. Four new members were nominated for the Committee, namely, Mrs. E. Pyke, Mrs. C. Rice, Mrs. Plastra and Miss Sutherland.

Mrs. L. M. Kingston's resignation was received with regret owing to Mr. Kingston having moved to New South Wales. Mrs. R. Treloar was appointed Treasurer in June. We are very grateful to Mrs. Treloar for taking on these duties, as she is a very busy person. We wish her every success.

The Delegates to the Victorian Baby Health Centres Association monthly meetings are, namely, Mrs. L. Thomson and Mrs. N. Brodribb, and Councillor W. W. Cummins.

The Committee wish to thank the State Govt:t.nment, the Malvern Council and the Lord Mayor's Fund for their Grants, also the various mothers for their donations in money, etc., especially Miss Lummis, for making the sets of infants' clothes for both Centres. These were beautifully made. Also Mrs. Mollard and Mrs. Needham for making and supplying material for an Emergency Travelling Cot, Mrs. Hughes and Mrs. Stainsby for their gifts. , n

The money raised for V.B.H. Centres Appeal from Malvern was 5136;'5/5. This was from the sale of badges E27/14/-, Card afternoon and other efforts 575/5/5, Donations 213/6/-, and Concert per Miss Adderley 520.

Last February a fruit pulping, bottling and drying (demonstration was held in the Malvern Town Hall. Miss Peel was the Demonstrator from the Burnley Cottage. We are indebted to Miss Peel for giving her services gratis.

The Committee are very indebted to the Malvern Council for the continued use of a car for the Sisters on their visiting rounds. The advice covers that to expectant mothers. This advice is important; because the health of the child begins before birth, and many cases of malnutrition are attributable to incorrect and inadequate diet of the mother during pre-natal period. Home visiting enables the Sisters to advise each mother with a full knowledge of her home environment and help given her in overcoming any special difficulties.

The Committee are deeply grateful to the Sisters. viz., Sister G. B. Tapp, Malvern, and Sister E. B. McKay, East Malvern, for their continued and arduous duties carried out in such excellent manner, especially as their work has increased by leaps and bounds, as the figures of the attend- ances show, and we hope in the near future that they will be relieved somewhat with the proposed two new Sub-Centres opening in the Municipality.

IMMUNISATION.-The Council pmvided facilities for parents to have their children im- munised against diphtheria free of charge with the assistance of the Sister in Charge of the Centres. We congratulate the Council for providing this service to the mothers, and thus assisting in preventing the incidence of this disease.

SHATTERING GLASS.-At both Centres the windows have been treated against shattering glass. One room a t the Malvern Centre is set aside as a Shelter, and the arrangements a t the East Malvern Centre have been approved by the Sector Warden.

The Council showed great foresight in installing the gas fire a t the East Malvern Centre. This has been very much appreciated by the mothers and all concerned.

Special thanks are due to Mrs. Bingle, the Pattern Superintendent, who has cut out hundreds of patterns during the year. The Committee are very indebted to the various voluntary helpers who devote regular time each week to help the Sisters in Charge of the babies. Their help is greatly valued and appreciated by the Committee, and by their work they are rendering a very great service to the community, as the health and wellbeing of the mothers and babies is of special National importance.

In conclusion, I wish to thank the Committee for their valuable interest and co-operation with the work of the Centres. Their work can he considered a very real and necessary contribution to the War effort.

SUNDAY MORNING AND ALL-NIGHT TRAMS.-The travel on the Sunday morning Tram and Bus service continues to improve, 2,691,623 passengers being carried, an increase of 879,380 for the year. The revenue a t 330,273 was 40 per cent. greater, and the surplus on operation 213,044.

The All-night Tram and Bus services showed an increase in passengers for the year of 1,322,884, and additional revenue of 231,909-the operating surplus for the year being 213,307.

FINANCIAL STATEMENT. The Government Auditor (Mr. G . E. Fitzgerald) has completed his audit of the Council's Books

and Accounts for the year ended 30th September, 1942, and submitted his report to the Mayor and Councillors in accordance with the Local Government Act, 1928. The Report and Annual Statement of Accounts were submitted to the Statutory Meeting of the Council held on the 7th December, 1942, when the Statement of Accounts was finally examined, settled and allowed.

Health Officer's Report.

TO HIS WORSHIP THE MAYOR AND COUNCILLORS,

CITY OF MALVERN.

Gentlemen,

I have the honour to present herewith the Annual Health Report for the City of Malvern for

the year 1941.

BIRTHS AND DEATHS.-The Birth Rate for the year has been 620, divided into males 310

and females 310, a s compared with 545 for the preceding year. This is equivalent to 13.29 pel

1000, which is an increase over 11.85 for 1940. estimating the population a t 45.827, and, in fact,

is the highest ra te per 1000 for 17 years. The rate in Greater Melbourne over the same period

was 17.35.

The Death Rate for 1941 was 551, divided i;ito males 238 and females 313, compared with 552

for 1940. The Rate per 1000 was 11.81, t ha t f5r the preceding year being 12.0.

INFECTIOUS DISEASES.-The frequency of the Infectious Diseases is shown in the follow-

ing table, a s well a s a comparison with tha t for 1940.

The large number of Scarlatina cases was due to an epidemic of t ha t disease which is now

subsiding. The frequency of the remainder of the Infectious Diseases does not call for remark.

DIPHTHERIA IMMUNISATION was commenced in the latter par t of the year and continued

to the middle of December only, owing to the School holidays intervening. Approximately 2000

children were tested and 1900 protected. I t will be resumed in March and continued until all the

Schools are overtaken.

Major works during the year comprised reconditioning and overhauling No. 4 truck; re-ducoing truck No. 8. General overhaul and ducoing furniture van for conversion into Ambulance to carry six stretchers ; repairs and ducoing truck for demolition work; servicing and general repairs to plant and equipment, including trucks, rollers, tractors, gang and hand mowers, official car>, cutting and welding and sundry minor repairs and replacements to depot plant.

A.R.P. - FIRST AID POST No. 38. Following conferences and negotiations, the Crown Motor garage, opposite the City Hall, was

altered and equipped to meet the requirements of the first aid administrator. The building is 58 ft. X 58ft. on ground floor, with residential tiuarters, 58ft. X 26ft., above.

The division of the building was effected by masonite partitions on timber framing, and the following accommodation was provided:-General reception room, 40ft. X 16ft., with entry to men's or to women's first aid dressing rooms, each 26ft. X 29ft., each opening in to waiting room a t the Glenferrie Road end, 16 feet wide. The ambulance entry is from Myamyn Street to avoid roadway congestion and provide suitable light lock accommodation.

The following works had to be undertaken:-- Sewerage and water supply extensions to provide for sinks and basins on each side of the

building, also sanitary conveniences a t the rear. Gas to provide for an instantaneous and unlimited quantity of hot water, also for cooking services.

Electric light extensions for both light and power. The removal of all skylights, glass fronts, and generally blacking out the building. The build-

ing of light lock a t the rear to permit the ambulance to load or unload in the light. The building of pitcher walls a t front and real to safeguard against blast. Draining the old and new work to the lane a t rear. Fitting up the office with cupboard and suitable accommodation; fixing shelves and cupboards

in dispensary and in each first aid room, also in the waiting room. The supply of sterilizers with gas stands and general equipment for first aid outfits. These alterations cost about $700, and in addition, cupboards were fitted to the quarters up-

stairs, and blackout arrangements provided.

A.R.P. DEMONSTRATIONS.

Sunday a t Glen Iris Park-Demonstration of rescue, demolition and decontamination work (in conjunction with all A.R.P. and national emergency services).

Sunday a t Central Park and Malvern Cricket Ground, as part of general A.R.P. demonstration. Incidents in rescue, demolition and decontamirlation.

Saturday afternoon and Sunday afternoon exercises in conjunction with area wardens carry- ing out area practices. Night exercises carried out during the past two months in connection with area practices.

During the year, key men attended a fortnight's School of Instruction a t State Emergency Council's A.R.P. Instruction Centre.

Since attending the school, these men have passed on the knowledge received, and we now have about 30 men. experienced in this work.

Night classes in elementary work have bee11 held, and well attended, a t the Council.

HOUSE GARBAGE SERVICE.

The annual cost of the household garbage s~rv ice is as follows:-Collection, 44036; Destructor, $1273; Tip, 22354; Total $6163.

3392 tons of refuse were destroyed a t the Destructor, and a larger amount tipped a t Scotch- man's Creek Reserve, Waverley Road.

The old brick hole near York Road has been gunped out and is being filled with clean materials. Owing to manpower difficulties a weekly cnllection was substituted for the twice a week

service.

LIGHTING.

Lighting of the streets was greatly restricted during the year. All large lights were removed, and shaded 100 watt. lamps fixed.

The City Lighting now consists of 1310 lamps of 100 watt, and 313 similar lamps on the tram tracks.

WARRIGAL ROAD.

During the year the road was centre lined by the Country Roads Board. The maintenance of the roadway was negligible, as bitumen and stone material were not made available. It is anticipated these materials will be released for the spraying of the road during the summer months.

LINE MARKING.

To facilitate traffic in our more important streets, during lighting ways were centre lined. The list is as follows:--

PARKS AND GARDENS. The Curator (Mr. G. T. Styles) reports as follows:- "Owing to severe labor shortage, i t has not been possible to keep all parks, gardens and

reserves a t their usual high standard. No new work has been done during the year. The folloff- ing parks have been kept in fair order:--Central, High Street Gardens, Hedgeley Dene, Ardric.. Glen Iris and the Cricket Ground.

"Street trees have all been pruned. New streets planted were Bruce, Tkomas, Short, and Sylvester Crescent.

SICK FUN^. The Malvern City Council Employees' Sick Fund is in a sound financial position. The receipts

SAMPLES. During the year 132 samples of foodstuffs were obtained for analysis, viz. :- Cocoa, 2 ; Lemos, l ; Tomato Sauce, 1 ; Milk, 75 ; Oatmeal, 8 ; Vinegar, 10 ; Powdered Milk, l ;

Sausagemeat, 34. One sample of milk and two of sausagemeat did not comply with the Regulations. Proceed-

ings were taken in each case, and convictions obtained in each instance, with fines amounting to 212, and costs amounting to .Bi1/6.

FACTORIES. During the year 20 premises were inspected an3 approved of, and permission granted to use

Engineering and Press Metal Work, 1 ; Engineering and Refrigeration Maintenance, 1 ; Film Developing, 1 ; Home-Made Cakes, 1 ; Joinery and Saw-milling, 1 ; Picture Framing, 1 ; Porcelain Electric Goods, 1 ; Pottery, 1 ; Toys, 1 ; Weaving, 1 ; Wooden Toys, 1 ; Woven Fabrics. 1 ; Woodcti Articles, 1.

FEES. The following fees were also collected, viz. :- - Dog Registrations, $402/8/9 ; Health Act Registrations, 267/7/ 6 ; Place of Safekeeping.,
