Residents Requests and Comments from the Floor

Mr. Ken Sherrard requested to park a mobile home at 2785 Laport Drive and live in it for three years while he was going to school. The Council informed Mr. Sherrard that to do so is against the Municipal Code.

Administrator Zylla announced that the State Highway Department has tentatively scheduled the installation of one or two traffic signals on Highway #10 at County Road H2 and County Road I during the fiscal year beginning July 1, 1974. The highway department is presently doing a signal coordination study.

Administrator Zylla suggested that a park fund be created in which all monies from cash dedication for park lands resulting from subdivisions be placed.

architect had a meeting with the Civil Defense Area Commander to discuss Federal participation in the City Hall addition and that an additional meeting is scheduled on January 21st. He added that the City will be expected to prepare a communications plan before any funds may be given.

Councilman Johnson's Report

The City Council will meet Jan. 22 at 8:00 P.M. for a meeting to discuss whether or not the City wants to proceed with the recruitment of a Public Works Superintendent or instead a Public Works Director who would be a registered engineer.

Councilman Baumgartner's Report

Councilman Baumgartner read the Recreation Commission minutes of December 22nd. Councilman Baumgartner stated that on January lOth, the Council and Recreation Commission held interviews for the Director of Parks and Recreation. Five individuals were invited to be interviewed but three declined due to the acceptance of other positions.

MSP (Baumgartner-Hodges) To offer the position of Director of Parks and Recreation to Mr. Douglas Bryant commencing about February 15th or March 1st at a gross salary of $13,000.00 per year with a car allowance of $25.00 per month. 5 Ayes

Councilman Baumgartner read the Planning Commission minutes of December 26th.

MSP (Baumgartner-Pickar) To approve the subdivision request of Gerald Foss to subdivide Lot 4, Auditor's Subdivision #89 except the South 30 feet of the East 300 feet, into three lots with a width of 85 feet and 252 feet by 280 feet depth on Spring Lake Road. 5 Ayes

MSP (Ba~gartner-Pickar) Relative to Lot 8 and the East 1/2 of Lot 9, Spring Lake Park Knolls Addition, to concur with the Planning Commission's request of December 26th and confirming that no building permits will be issued for this development until the Council receives its recommendation from the Planning Commission. 5 Ayes

Councilman Pickar'S Report

Councilman Pickar reported the Lakeside Park Commission met on January 10th. He requested that notice of their meetings be put in the Newsletter. He confirmed that the Human Rights Commission was seeking two new members.

Attorney Meyers' Report

Attorney Meyers brought up the matter of severance pay for James Schlichtmann. He was instructed to research the matter to determine if Mr. Schlichtmann had a valid claim to severance pay and report back to the Council.

MSP (Neisen-Johnson) To approve the minutes of January 14, 1974 subject to the addition of the name Gordon Fedor to a 3 year Recreation Commission appointment under the mayoral appointments.

Residents Requests and Comments from the Floor

Keith Harstad presented plans for 72 townhouse units on County Road H2 and Long Lake Road. The City Council approved the concept of townhouses on this property at a hearing held on June 12, 1972 subject to the presentation of detailed plans. The Mounds View Planning Commission approved the final site plan on December 26, 1973. Mr. Harstad requested issuance of building permits for his proposal.

He informed the Council that during plan review by the fire chief the question of adequate water supply was raised. The fire chief has recommended a minimum fire flow of 1500 gallons per minute before any permits are issued, and the location of one additional hydrant. The fire chief has also advocated the extension of an eight inch water main adjacent or replacing an existing six inch main on H2 and the extension of an eight inch main from the existing six inch main on H2 to the 12 inch main on Long Lake Road.

Mr. Harstad stated that he agrees to the placement of an additional hydrant on the site, but questioned whether the existing water system would not supply 1500 gallons per minute. He added that he has had the fire flow computed and that he was informed that the system will put out 1500 gallons per minute. He said that when the system was designed in the area the engineer at that time, Shelley Boehm, who has since left the firm of Comstock and Davis, knew that townhouses would be planned for the area and he designed the system accordingly. Mr. Harstad questioned why a system that was satisfactory two years ago is no longer satisfactory.

Engineer Bearden replied that he does not know that to be a fact, but figures that by extending an eight inch water main from the existing six inch main to Long Lake Road on County Road H2 the system would generate 1500 gallons per minute. The estimated cost would be $5,000.00 to $6,000.00 0

The Council, fire chief, and Mr. Harstad agreed to a field test to ascertain whether the system can generate 1500 gallons per minute. Mr. ,Harstad stated that if the 'system does not generate 1500 gallons per minute, he would agree to a water main extension.

MSP (Neisen-Johnson) To grant a special use permit to Keith Harstad in accordance with Section 40.05 subdivision ~ (3) (g) of the municipal code in conformance with the site plan dated November 12, 1973 and initialed by the administrator subject to the following conditions:

1. That in one bedroom units both the upper and lower levels be finished.

2. That there be constructed on the site a swimming pool and a tennis court.

3. That there be no more than 33 percent one bedroom units.

~ . That the plan be constructed in accordance with the approval of the Rice Creek Watershed District, building inspector, and fire chief.

5. That the bylaws and covenants of the association be presented to the Council for approval. 5 Ayes

MSP (Neisen-Johnson) To issue a building permit for a six unit townhouse building on the westerly edge of the site plan since there is ~eneral agreement that at this location there is the required 1500 gallons per minute fire flow capacity.

MSP (Pickar-Johnson) To recess the Regular Meeting at 8:45 P.M.

Mayor Neisen called the hearing on street improvement Project 1973-6 to order at 8:46 P.M. Administrator Zylla read the legal notice and attested to its publication in the New Brighton Bulletin on January 24, 1974. Certified letters were sent to Mr. Blair Wolfson, Mr. William Reimer, and Mr. Bill Edes, parties affected by the improvement.

Mayor Neisen called for questions or objections from the floor. There were none.

MSP (Johnson-Baumgartner) To order street improvement Project 1973-6 and to direct the engineer to prepare final plans and specifications.

MSP (Hodges-Johnson) To adjourn the special hearing at 8:50 P.M.

Administrator Zylla read a letter from Mr. Edes requesting a water main and a storm drain extension into frogrammed Land 1st Addition and agreeing to be assessed 100% percent of the cost.

MSP (Hodges-Pickar) Accepting the petition for improvement for water and storm drainage in Programmed Land 1st Addition, incorporating the improvement with Street Improvement Project 1973-6, ordering the improvement, and directing the engineer to prepare final plans and specifications. 5 Ayes

Attorney Meyers presented a copy of an agreement to be entered into between Programmed Land and the City of Mounds View in which Programmed Land agrees to pay the City $8,500.00 in conformance with Municipal Code No. 42.07 (2).

Mr. Edes took the copies and indicated that the agreement seemed satisfactory to him, but he would submit them to his attorney for his review.

MSP (Neisen-Hodges) To approve the final plat of Programmed Land 1st Addition and to authorize the Administrator to sign it subject to the receipt of the agreement between the City of Mounds View and Programmed Land relative to the cash dedication for park land and the receipt of the first payment. 5 Ayes

Mayor Neisen's Report

MSP (Neisen-Baumgartner) To grant an amendment to the peddlers license for Daniel McFarlane to sell fire extinguishers.

Mayor Neisen announced that the Ramsey County Delegation will be meeting on Tuesday, January 29, 1974, from 7:30 to 9:30 P.M. at the State Capitol.

Mayor Neisen acknowledged receipt of letters from the First State Bank of

Mayor Neisen read a letter from Chairman Bernard of the Gas Regulatory Board indicating specific objections to House File #1835 relating to State utility regulation.

MSP (Neisen-Baumgartner) To appoint Larry Decheine as acting Public Works Superintendent for the City of Mounds View at a salary over and above his normal salary at $75.00 per month effective January 1, 1974 subject to the approval of the City's labor consultant Cy Smythe. 5 Ayes

Mayor Neisen directed that letters be sent to all persons that have applied for the Public Works Superintendent position notifying them that the position has been filled.

MSP (Pickar-Hodges) To adopt Resolution No. 623 authorizing needed engineering and technical services from the Minnesota Department of Highways. 5 Ayes

Administrator Zylla acknowledged receipt of notification from Northern States Power Company informing the City of a community wide 15 percent electric rate increase effective March 19th and an approximate six percent gas rate increase, and an increase in street lighting and municipal water pumping rates.

Administrator Zylla noted that the community will be required before July 1, 1975 to develop a municipal shore land ordinance as stringent as a model State ordinance which is being developed.

Administrator Zylla reported that in 1973 our fiscal agent did a study on bond debt assessments and our tax levy. Two assumptions that were made in the study were that reinvestment earnings would earn five percent and unit charges would total $57,500.00. Administrator Zylla reported that unit charges for 1972-73 totaled $29,000.00, interest received over the estimate in 1973 totaled $9,161.00, and that together with interest received in 1972 over estimate and the fact that all of the investments now are earning anywhere from 6 to 8 percent, that it is no longer necessary to deposit the unit charges collected directly into the Improve­ment Bond Fund. Rather it would be more advisable to continue to collect the unit charges and water hookup charges and deposit the money directly into the utility fund in order to postpone any future utility rate increases.

Mayor Neisen read a letter from Mayor Cohen of St. Paul asking for his support in the employment of qualified handicapped individuals.

Mayor Neisen asked Mr. Hawkinson if he could arrange for someone from the business community to represent Mounds View on an employment council for the handicapped.

Mayor Neisen noted that the Planning Commission had recommended approval of a special permit subject to the endorsement by the Rice Creek Watershed District and P.C.A. and that a mutually satisfactory agreement be reached between Smith Trucking and the representative of Towns Edge Mobile Home Park on the implemen­tation and operation of a buffer zone between the Mobile Home Park and the terminal.

Mr. Lee Liljengren of Stanton Realty made the general comments on behalf of Smith Transfer Corporation. He was assisted by Mr. Joe Monroe, an engineer of the company.

The site was generally north of Mustang Drive directly across from Century­Mercury Motor Freight. He said he has been unable to get written PCA approval since they feel they are not involved in issuance of any permits. He also has been unable to get together with a representative of the mobile home park because the individual has been out of town.

Discussion centered on the site plan which did not conform to the zoning ordinance relative to green area in the front yard, and the prohibition that there be no front yard parking.

Mr. Monroe stated that the only way the terminal could be built economically and to provide security to the dock area was to provide parking in the front of the office. He felt that it was unreasonable to require that the area be landscaped since by so doing would increase the cost to Smith and cause them to have to maintain the area. The Council individually approved the concept of the terminal, but refused any final approval pending receipt of some other acceptable site plan and receipt of a signed special use permit which is to be prepared by Attorney Meyers at some later date.

Attorney Meyers felt that the agreement should include:

Councilman Baumgartner's Report

Councilman Baumgartner stated that last Sunday there was a dedication of Nelson Rink at Woodcrest Park. He thanked Mr. Wallace Nelson of the Lee Bogle Company for the donation of the plaque.

Councilman Pickar's Report

Councilman Pickar announced that the Lakeside Park Commission would be meeting on Thursday, February 14 and the Human Rights Commission will meet on a regular basis on the third Tuesday of each month.

Attorney Meyers' Report

Attorney Meyers present ed a proposed ordinance def ining the position of Public Works Superintendent and amending the subdivision regulation relative to the dedication of land or cash for parks.

MSP (Hodges-Baumgartner) To approve the agreement between Programmed Land and the City of Mounds View in which Programmed Land agrees to pay the City $8,500.00 within three years to be deposited in the City Park and Playground Fund, acknowledging receipt of $2,125.00 and authorizing the Mayor and the Administrator to sign the agreement subject to receipt of the second mortg?ge and certificate of title.

A special meeting to consider the addition to and alteration of the City Hall and alteration to the Public Works BUilding was called to order by Mayor Ne isen at 6:30 P.M. on February 25, 1974.

Mayor Neis~n announced that notice of the hearing was published in the February City Newsletter and called attention to in stories written in the New Brighton Bulletin and the St. Paul Dispatch.

Mayor Neisen introduced Mr. Kenneth Walijarvi, architect, who made the presentation for the City to the approximate 15 persons in attendance.

Mr . Walijarvi explained that he was commissioned in October to work with the Administrator in formulating a solution to the City's lack of space problem. Based on his study, he found it more economical to remodel the present structure and use it for police purposes, and to build an addition onto the south of the existing facility which would house the Council chamber and the new administrative offices, than to build new. A basement which would serve as an emergency operating center would be planned under the administrative offices and federal money would be sought to share in its cost. The police department would move out from the existing public works bUilding and it would be remodeled for use exclusively by , public works .

Mrs. Isabelle Wille, 7911 Spring Lake Road, asked if there was room for expansion. Mro Walijarvi replied that in addition to the basement area, there was room to expand out from the administrative offices south toward the highway.

Mr. Robert Glazer, 2375 Hillview Road, asked if the Council was planning on holding a referendum o Mayor Neisen replied that a referendum was not necessary since no bond issued was planned.

Mr. Walijarvi stated that the total construction cost of the upper level including the remodeling for the police was $1]8,523.00. The estimated cost of construction with lower level was $234,683.00. With fees and contingencies, the total estimated cost of the project without lower level came to $210,657.00, with lower level $276,926.00.

Administrator Z~lla explained that there has been two meetings with the Federal Civil Defense staff and that the City is requesting that the federal government participate in the basement cost in the amount of $53,240.00.

Mr. Gene Skiba, reporter for the New Brighton Bulletin, asked if library space will be provided. The Administrator explained that he had spoken to someone from the Library previously while the project was in preliminary planning stages and that a follow-up contact will be made with library personnel.

Nancy Burmeister, 7565 Knollwood Drive, asked what was the construction scheduleo Mr. Walijarvi explained that it takes three to four months for plans, one month to bid, and approximately one month to get congracts signed once they are awarded.

Mayor Neisen explained that the project is actually in three parts:

1. Construction of the new addition. 2. Remodeling of existing space at the City Hall. 3. Remodeling of the Public Works Building o

Mrs. Barbara Haake, 3024 County Road I, encouraged the Council to construct the basement even if federal monies are not available.

Robert Glazer asked since no bonds were to be sold for this project, whether or not bonds will have to be sold for some other project in the near futureo Mayor Neisen answered that there are no plans for other bond issues at this time. Residents Requests and Comments from the Floor

It appeared that the routing of the main just south of 8248 Spring Lake Road was satisfactory to those in attendance.

Park would also have a landscaped berm with trees.

Mr. Johnson felt that the City is interpreting IIfront yard" to mean the area from the front of the bUilding line to the property line and, that his interpretation was that the IIfront yard" consisted of the area between the property line and the bUilding setback line. If his definition was correct, the n no variance for front yard parking would be ne cessary.

Mr. Johnson noted that the area between the blacktop terminal lot and the mobile home park would be seeded. He added upon a question by the Administrator that the front of the building could be redone at no increase in cost to make it more esthetic and that Smith's Transfer would be willing to accept such a stipulation in the special use permit agreement. Mr. Johnson said Smith Transfer was willing to agree to all conditions specified at the February 11th meeting.

Councilman Johnson was concerned about sleeping quarters on the second floor. The architect assured the Council that these quarters were strictly f.or Smith's Transfer drivers.

Councilman Pickar asked if there would be a curb within the property around the parking area. Mr. Johnson stated that it would probably be a bituminous curb or precast concrete.

The height of the berm was estimated at four to five feet. Mr. Johnson said that there would be no vehicles stored in the seeded area on the property. The Administrator suggested moving the gate to the seeded area over the City's easement possibly avoiding obtaining a new easement to the west of this prope rty in order to gain access to the water tower.

Councilman Johnson noted that when the special use permit agreement is prepared it may contain more or less terms and conditions specified in the Council minutes of February 11, 1974.

MSP (Neisen-Pickar) To grant the special use permit to Smith's Transfer Corporation to build a motor freight terminal on part of Lot 3, Mounds View Industrial Park, contingent upon the preparation and signature of a written special use permit agreement with an attached final site plan. 5 Ayes

Mr. Robert Eibensteiner, appeared to request the vacation of five feet of a twenty (20) foot easement for sanitary sewer in order to build a $51,000 . 00 home on Lot 40, Block 1, Red Oak Estates No.2. The sewer main was originally constructed between the time the preliminary plat and the final plat for Red Oak Estates No. 2 was approved. Instead of the easement being 1/2 on Lot 40 and 1/2 on Lot 39, the entire easement ended up on Lot 40.

MSP (Neisen-Baumgartner) To set a hearing to vacate the east five feet of the twenty (20) foot sanitary sewer easement located on Lot 40, Block 1, Red Oak Estates No.2 for March 25th at 8:30 P.M. with the condition that the house footings adjacent to the easement be of a depth equal to the sanitary sewer, and
