1. Permitted areas (i.e. dogs free from leash)Dogs are permitted to run free on all parks and reserves which are not prohibited or restricted provided they:• Are under effective control (this means the dog will come back

when called at all times).• Are accompanied by someone who is capable of controlling the dog.• Do not attack other dogs, people or wildlife.• Are close to their owner so the leash can be quickly attached if

they become aggressive.

2. Prohibited areas (i.e. dogs not permitted)Dogs are not allowed in these areas:• Blackwall Reach Reserve• Point Walter Reserve (Bicton)• Burke Drive Foreshore Nature Reserve (Attadale)• Deepwater Point Reserve (Mt Pleasant)• Heathcote Heritage Precinct (Applecross)• Piney Lakes - Northern Bushland on Piney Lakes Reserve (except

on leash on sealed paths), western and eastern core conservation area, man made lakes and sensory playground

• Jeff Joseph Reserve (Applecross)• Point Dundas (Applecross)• Bicton Swimming Area (Bicton)• Oz Park (Palmyra)• All foreshore reserves which are not “restricted areas”• An area set aside by a wall, fence, sandpit or other softwall

surface as a children’s playground

3. Foreshore areas between:• Flannagan Road and Canning Bridge, Applecross• Queens Road and Cranford Avenue, Mt. Pleasant.

• Any reserve on which a sporting activity is in progress• Shared pathways other than in the “Prohibited Areas” (sign posted)• All streets

Some offences which can incur on-the-spot infringements include:

• Having unregistered dogs• Failure to remove dog excreta• Dog causing a nuisance (e.g. barking)• Dog Attack• Dog not held by a leash in public places (e.g. streets)• Dog/s in a public place without collar with owner’s name and address• Failure to give notice of new owner/s• Keeping more than two dogs per property• Breach of a kennel establishment licence• Failure to control dog in exercise areas• Greyhounds not muzzled (unless successful completion of training

program)• Dog/s on property without consent• Failure to take steps against parasites• Failure to submit dog for veterinary examination• Failure to produce documents issued under the Dog Act• Failure of alleged offender to provide name and address

RegistrationAll dogs over three months of age must be registered. Dogs should be registered with the Council where they normally reside. Should you move within the State, you do not have to re-register your dog, but the change of address must be given to the Council where the dog is currently registered. Registrations for one year or three years are due on the first of November each year. A life time registration is also available.

Registration helps you to recover your dog if lost and assists the Council to encourage responsible dog ownership and provide services to dog owners for the benefit of the entire community .

A person under 18 years of age may not lawfully register a dog in his / her name. The dog must be registered by a parent or another adult who will then be regarded as the lawful owner.

Dog attacksAn “attack” may include allowing a dog to attack or chase a person, animal or bird, whether or not injury occurs, and may incur a penalty of $10,000. The Council may declare individual dogs “dangerous” for offences such as attacking or repeatedly rushing, threatening or chasing people or animals.

Restricted dog breedsOwners of American Pit Bull Terriers and Pit Bull Terrier breeds (or cross breeds) must have these dogs leashed and muzzled in public places.

These dogs must wear a specified collar indicating it is a dangerous dog. Property access points must display signs indicating that a dangerous dog is housed on the property and the property must have escape-proof and child-proof fencing.

When in public places, the dog must be under the control of a person 18 years of age or older. The person must be physically able to control the dog.

Restricted dog breeds must also be sterilised.

BarkingA dog that makes a noise, by barking or otherwise, that persistently occurs or continues to such a degree or extent that it unreasonably interferes with the peace, comfort or convenience of any person in any place; or is shown to be allowed to behave consistently in a manner contrary to the general interest of the community may be considered a nuisance. A person may lodge a complaint alleging a dog is a nuisance.

Microchipping Please note that as from 1 November 2015 State Government regulations require all dogs to be microchipped. This is a permanent way to identify the dog and its owner.

ExcretaPermitting your dog to excrete on a street or public place and failing to remove it constitutes an offence under the City of Melville Dog Local Laws. The Council has provided pooch pouches and bins on reserves to dispose of dog excreta.

Fencing requirementsPersons wishing to register a dog must make a declaration to certify that the fences and gates at the premises where the dog is kept are capable of confining the dog within those premises. Gates must have effective self-closing mechanisms.Significant penalties apply for breach of the Dog Act and Local Laws.
