Notice is hereby given that a majority of the Common Council and Plan Commission may be present at the above-noticed meeting to gather information about a subject over which they have decision-making responsibility. This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. COMMUNITY DEVELOPMENT AUTHORITY MEETING December 8, 2020

Blaska called the virtual meeting to order at 4:00 pm and confirmed that appropriate notice was given. Members Present (virtual): Manke, Moomey, Kozinski, Chairman Blaska, Mayor Magnus and Ald. Zapfel Members Excused: Carlson Staff Present: Duffy, Trebatoski (virtual) and Wallace Comments from audience: None. Minutes of November 19, 2020: Motion by Zapfel to approve the November 19, 2020 minutes as presented; second by Kozinski. Motion carried 6-0. New Business: Discussion/Action: Resolution 20-RCDA2900 Certifying the Redevelopment Plan for Olympia Fields Redevelopment Area: Blaska stated in the packet was a Memorandum from Duffy stating the background of what the CDA has been doing since November of 2020. She read into the record. Duffy stated this lays out the process. He stated as the memo states by statute the final step in the process in accordance with the redevelopment planning statute is the CDA needs to certify the plan. That gives staff the authorization to continue to work towards pursuing redevelopment opportunities within these boundaries and the plans set forward. Motion by Magnus to approve Resolution 20-RCDA2900 certifying the redevelopment plan for Olympia Fields redevelopment area; second by Zapfel. Motion carried 6-0. Magnus stated Moomey and himself met with the Fleming’s and the Fellow’s last week. They walked the property to get a better understanding and get a better handle of some of the things they voiced at an earlier meeting. He stated we are trying to find ways to meet some of their goals and needs within the boundaries of what we can do at the roundabout area and at the retention pond. Moomey stated that he walked the property with Fleming Group and their discussion points were very similar to what they addressed in their letter. They had concerns about the entry drive off Hwy 67 going away from their property and taking some line of sight away. He agreed with some of it that there might be opportunity for us to look at re-segmenting or moving some of the retention pond area or redrawing some of the lines. The DOT will be the big driver of what we have to work with. He is looking to appease them. Magnus stated he is trying to set up a meeting on December 14th with Fleming and the developer to go through the areas with the engineers and consultants to come up with a good resolution. Discussion/Action: Oconomowoc Business Loan – Mullen’s Dairy Bar – 120 E. Wisconsin Ave: Duffy stated Mullens Dairy Bar is looking to occupy the rear space where Tricia Troop’s use to be and modifying the building to add a walkup window for a second location for Mullens. Their loan request is $25,000 at 1% with a 5-year payoff. Their business plan is to be opened from Memorial Day to Labor Day unless they find a demand in the winter to continue to operate year-round. Staff has reviewed the business plan with Bank Five Nine and recommends approval. Moomey asked what our historical practice is on giving business loans to local entities. Duffy gave an overview on the Business Loan Pool. Members discussed extending the loan pool to Olympia. Duffy stated extending the loan pool further out is a policy conversation we could have with Council if Bank Five Nine is comfortable in doing so. Motion by Kozinski to approve the Downtown Business Development Loan for Mullen’s Dairy Bar located at 120 E. Wisconsin Ave; second by Manke. Motion carried 6-0. Comments from CDA Members: Duffy stated the Collins Street parking lot has been completed. He stated a new entity bought a building on Summit Avenue as a home décor store. Duffy stated this Thursday, the City Administrator, the Mayor and himself have a conference call with the owners of Whitman Park to talk about the available space and the Loan Pool Program. Mayor Magnus stated he looks forward to meeting everyone in person. Motion by Manke to adjourn; second by Kozinski. Motion carried 6-0. The meeting adjourned at 3:32 PM. BACKGROUND

As part of the approved Tax Increment District #7, the City had identified the acquisition of the 11.8 acre Park Studios LLC property, which is necessary for the installation of the infrastructure planned for the Olympia Fields area. The City approved a Relocation Order 20-R2880 dated May 19, 2020 to begin the eminent domain process.

Since the Olympia Fields area has been designated as a blighted district, when authorized and empowered, the CDA is the body to implement the plan for blighted areas in need of blight elimination and carry out urban renewal projects as described in ss. 66.1333(6)(b).

In accordance with our City Code, the City Council by resolution will need to authorize the CDA and City Staff to take the next steps in preparing documents necessary to acquire the property through serving a Jurisdictional Offer (JO) to the property owners and/or representatives.

It is our intent to also have a Committee of the Whole Closed Session with the City to share information related to the necessary documents and receive direction on a dollar amount for the Jurisdictional Offer.

After the City Council direction, the CDA will need to meet to approve the Jurisdictional Offer to be issued to the property owner(s).

FINANCIAL IMPACT

Amount to be determined by the City Council. Funds had been designated in the TID #7 project plan necessary for the property acquisition of this parcel.

RECOMMENDATION

Staff recommends proceeding with the condemnation process to continue the momentum forward for the Olympia Fields development area.

SUGGESTED MOTION

Motion to approve the resolution authorizing the City Attorney & Staff to serve a Jurisdictional Offer to acquire lands through condemnation. For TID #7.

Wisconsin Avenue Oconomowoc, WI 53066 RE: Business Development Loan Approval Dear Community Development Authority Members: The Business Development Loan Committee met to review the Application of Brian Borkowski to open The Etcetera at 118 E. Wisconsin Avenue in Downtown Oconomowoc. The committee is recommending loan approval for the expansion, renovation and remodeling costs to accommodate the operation based on the following factors:

• Proven experience in restaurant & hospitality enterprise; • Occupy & update a building in downtown, and the opportunity to bring additional customers

to downtown. • The applicant’s experience in elevating the experience for a similar business; • A strong potential for business success due to applicant’s relationships & experience. • Investment into a downtown building which will result in an increased property value.

The recommended loan amount is $25,000 and terms are 1% interest with a 10 year payoff. It is also our belief that this is the type of loan that the Business Development Loan Pool was intended as it incorporates a highest & best use business downtown, and provides the funds for reinvestment into a downtown building. The Committee would request the Oconomowoc Community Development Authority’s approval for this loan application. About the Owner Brian Borkowski is a seasonal professional that is driven by customer interaction and service. Coming from a bar owned family, my dream has always been to follow in my grandfather’s footsteps and live it! My father always said “Brian people don’t always come to the bar for a drink, they come to see Grandpa.” I believe in this and I believe you only get one first impression, make it GREAT! Uses of Funds Our plan from an aesthetic standpoint will be modern, clean, and very open. To do this we plan to use the funds to significantly update the interior. Adding a fresh clean look to the walls, updated bathrooms, creating an enclosed kitchen, new flooring, update the drop ceiling, and a furniture update. The Etcetera will offer over 16 beers on draft, amazing views to our Village Green. Our menu will be professionally created, simplified, with added creativity in our offerings.
