    Violations of Chapter Provisions Prohibited ResponsIbility-It sliall be unlawful for any person,firm or corporation to erect, construct, enlarge, alter, move, improve, remove, convert, demolish,equip, use, occupy or maintain any building or structure or .cause or permit the same to be donewhich does not comply with the standards or requirements set forth in this chapter. Nothing in thischapter shall preclude a rental or lease agreement from providing that a lessee, sublessee, tenant oroccupant has the responsibility for repair or maintenance. Such provision notwithstanding, theowner shall be responsible to ensure compliance with this chapter, unless otherwise specified, andshall repair, remove, reconstruct or correct any condition in any building, structure or portionthereof, which does not comply with the standards or requirements of this chapter.

    '---.Substandard Housing-No person, firm corporation whether asowner or agent thereof, lessee,sublessee, tenant or occupant shall construct, enlarge, alter, move, equip, use, occupy or maintainany substandard building or shall cause or permit the same to be done. No person, firm orcorporation take any action or allow any action to be taken in violation of any provision of thischapter or any order issued pursuant thereto.Improper Occupancy-All building or portions thereof occupied for living, sleeping, cooking ordining purposes which were not designed and permitted to be used for such occupancies. Allbuildings or portions thereof which are occupied in excess of the maximum occupancy loadallowed by any applicable provision of the San Jose Municipal Code or state law.

    Q;easeall improper occupancies in the unpermitted detached garage conversion, the two (2)units located in the unpermitted approximated 18'X 27' unpermitted addition attached to therear of the garage building to include the unpermitted addition attached to the rear of the singlefamily residence listed as 471 Y : z .

    Call Code Enforcement Inspector Doug Perasso at (408) 535-7936 to schedule an appointmentto verify that all improper occupancies have ceased from the unpermitted living units located inthe rear yard for living/sleeping purposes.

    24.01.130 Compliance with Title Provisions Required-It shall be unlawful for any person to erect,construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy ormaintain any building or structure in the City, or cause or permit or suffer the same to be done, inviolation of this Title 24 of the Municipal Code or in violation of any of the provisions of theCodes adopted hereunder.

    24.02.100 Permits Required (UAC 301.1)-No building, structure or building service equipmentregulated by this Title 24 of the Municipal Code and the technical codes shall be erected,constructed, enlarged, altered, repaired, moved, improved, removed, converted, ordemolished unless a separate, appropriate permit for each building, structure or buildingservice equipment has first been obtained from the Building Official.Changes include, but are not limited to, unpermitted building, electrical, plumbing andmechanical additions/alterations to a detached garage converted to a separate dwelling, anapproximate 18' X 27' addition attached to the rear of the detached garage consisting of two (2)dwelling units and another unpermitted addition attached to the rear of the single-family residencewithout the required permits from City of San Jose Planning and Building Divisions.1. Approximate 10 X 10' addition-attached to the rear ofthe single-family residence with signposted on exterior wall as 471 1/2 . Property owner Khoa Nguyen did not provide access/key toinspect interior of building.

    2. Det. Garage-converted to living unit with a kitchen sink, gas stove, vent hood, bathroom withsink, toilet and shower. Bedroom area with bed located at front of garage where door openingwould be located-now walled offwith a window. Living room and kitchen in same room.Window of living room within 5' of West side property line-concrete block wall. Propertyrecords list garage as 324 sq. ft. .

    3. Unpermitted Addition-attached to rear of detached garage is approximately 18' x 27'consisting of two (2) dwelling units. 1st unit behind garage unit consists of room usedforsleeping/living purposes. No kitchen, wall heater or furnace. Bathroom consists of sink, toiletand shower. Window on West wall over 44' from floor and within' 5' of West side property line-concrete block wall. Property ownerKhoa Nguyen did not provide access/key to inspectinterior of 2nd unit of addition located at the rear of the building.

    1. On or before March 29, 2012, call Code Enforcement Inspector Doug Perasso at 408-535-7936 todiscuss compliance regarding the building code violations.
