    1.Controlandsupervisionofcivilaviation

    TheMinistershallberesponsiblefortheformulationofpoliciesandstrategiesforthepromotionand

    encouragementofCivilAviationinNigeriaandthefosteringofsoundeconomicpoliciesthatassurethe

    provisionofefficientandsafeservicesbyaircarriersandotheraviationandalliedserviceprovidersas

    wellasgreateraccesstoairtransportinasustainablemannerandtoassistwithensuringthatNigerias

    obligationsunderinternationalagreementsareimplementedandadheredto.

    TheNigerianCivilAviationAuthority

    2.EstablishmentoftheNigerianCivilAviationAuthority

    (1)ThereisestablishedabodytobeknownastheNigerianCivilAviationAuthority(inthisActreferred

    toastheAuthority).

    (2)TheAuthority:

    (a) shallbeabodycorporatewithperpetualsuccessionandacommonseal;

    (b) maysueorbesuedinitscorporatename;and

    (c) mayacquire,holdordisposeofpropertywhethermoveableorimmovable.

    of

    the

    Authority

    3. MembershipoftheGoverningBoard

    (1)TheAuthorityshallhaveaGoverningBoard(inthisActreferredtoastheBoard)whichshallconsist

    of:

    (a) achairman;

    (b) onerepresentativenotbelowtherankofaDirectorofthefollowingMinistries

    (i) theFederalMinistryofAviationortheMinistryforthetimebeingresponsiblefor

    Aviation,

    (ii) theFederalMinistryofDefenceortheMinistryforthetimebeingresponsiblefor

    Defence,and

    (iii) theFederalMinistryofCommunicationsortheMinistryforthetimebeingresponsible

    (2)TheChairmanandmembersoftheBoardotherthantheDirectorGeneralshallbeappointedonpart

    timebasisbythePresidentontherecommendationoftheMinister.

    (3)TheChairmanandmembersoftheBoardincludingtheDirectorGeneral,shallbepersonsof

    recognisedexpertknowledge,qualificationandexperienceofnotlessthantenyearsinoneormoreof

    thefollowingfields

    (a) AeronauticalEngineering;

    (b) AviationLaw;

    (c) AirTransportManagement;

    (d)

    AerodromeEngineering;

    (e) AircraftPiloting;or

    (f) Telecommunications.

    (4)ThesupplementaryprovisionssetoutintheSixthScheduletothisActshallhaveeffectwithrespect

    totheproceedingsoftheBoardandtheothermatterscontainedtherein.

    4.TenureofOffice

    AmemberoftheBoard,otherthantheDirectorGeneral,shallholdoffice:

    (a) foratermof4yearsinthefirstinstanceandmaybereappointedforafurthertermof4years

    andnomore;and

    (b) onsuchtermsandconditionsasmaybespecifiedintheletterofappointment.

    5.CessationofOffice

    (1) NotwithstandingtheprovisionsofSection4ofthisAct,apersonshallceasetoholdofficeasa

    memberoftheBoardif

    (a) hebecomesbankrupt,suspendspaymentorcompoundswithhiscreditors

    (b) heisconvictedofafelonyoranyoffenceinvolvingdishonestyorfraud

    (c) hebecomesofunsoundmindorisincapableofcarryingonhisduties

    (d) heisguiltyofaseriousmisconductinrelationtohisduties:

    (e) inthecaseofapersonpossessedofprofessionalqualification,heisdisqualifiedorsuspended

    frompractisinghisprofessioninanypartoftheworldbyanorderofacompetentauthority:or

    (f) heresignshisappointmentbyaletteraddressedtothePresident.

    (2)AmemberoftheBoard,otherthantheDirectorGeneral,mayberemovedasthePresident;onthe

    recommendationoftheMinisteriftheMinisterissatisfiedthatitisnotintheinterestoftheAuthority

    orthepublicforthemembertocontinueinoffice.

    (3)IfamemberoftheBoardceasestoholdofficeforanyreasonwhatsoeverbeforetheexpirationof

    thetermforwhichheisappointed,anotherpersonrepresentingthesameinterestasthatmembershall

    beappointedtotheBoardfortheunexpiredterm.

    6.Allowances,expenses,etc.,ofChairmanandmembers

    TheChairmanandmembersoftheBoardshallbepaidsuchallowances,expensesandbenefitsin

    accordancewithextantFederalGovernmentFinancialGuidelines.

    7.FunctionsoftheBoard

    TheBoardshall

    (a)fixtermsandconditionsofserviceincludingremunerationoftheemployeesoftheAuthorityin

    accordancewiththeprovisionofSalaryandWagesCommission;

    (b)receiveandreviewannualreportsfromtheManagementoftheAuthorityandsubmitsametothe

    PresidentandtheNationalAssembly,throughtheMinister,notlaterthan30thJuneineachyearand

    thereportshallbeontheactivitiesoftheAuthorityduringtheimmediatelyprecedingcalendaryearand

    shallincludeacopyoftheauditedaccountsoftheAuthorityforthatcalendaryear;

    (c)submitnotlaterthan30thSeptemberineachyeartotheMinisteranestimateoftheexpenditure

    andincomeoftheAuthorityforthenextsucceedingyear;and

    (d)causetobekept,properaccountsoftheAuthorityinrespectofeachyearandproperrecordsin

    relationtheretoandshallcausetheaccountstobeauditednotlaterthan6monthsaftertheendof

    eachyearbyauthorityappointedfromthelistandinaccordancewiththeguidelinessuppliedbythe

    AuditorGeneraloftheFederation.

    PARTIV

    StaffoftheAuthority.

    8.DirectorGeneraloftheAuthority

    (1)ThereshallbefortheAuthorityaDirectorGeneralwhoshallbeappointedbythePresident,onsuch

    termsandconditionsasstipulatedintheAct,subjecttotheconfirmationbytheSenate.

    (2)TheDirectorGeneralshallbeprimarilyresponsibleforthefosteringofthesafetyofCivilAviationin

    Nigeriaandshallbe

    (a) thechiefexecutiveandaccountingofficeroftheAuthority

    (b) responsibleforthedaytodayadministrationoftheAuthority

    (c) appointedforatermof5yearsinthefirstinstanceandmaybereappointedforafurtherterm

    of5yearsandnomore:and

    (d) apersonwhopossessesrelevantandadequateprofessionalqualificationandshallhavebeenso

    qualifiedforaperiodofnotlessthan15years.

    (3)TheDirectorGeneralmaybesuspendedorremovedfromofficebythepresidentifhe

    (a) hasdemonstratedinabilitytoeffectivelyperformthedutiesofhisoffice:

    (b)

    hasbeen

    absent

    from

    5(five)

    consecutive

    meetings

    of

    the

    Board

    without

    the

    consent

    of

    the

    Chairmanunlessheshowsgoodreasonforsuchabsence;

    (c) isguiltyofseriousmisconductinrelationtohisdutiesasDirectorGeneral;

    (d) inthecaseofapersonpossessedofprofessionalqualifications,heisdisqualifiedorsuspended

    frompractisinghisprofessioninanypartoftheworldbyanorderofacompetentauthority;or

    (e) isguiltyofaconflictofinterestasstipulatedinSection10ofthisAct.

    (4)TheDirectorGeneralshallnotberemovedfromofficeexceptinaccordancewiththeprovisionsof

    thisAct.

    9.AppointmentofsecretaryandotherstaffbytheAuthority

    (1)TheBoardshallappointfortheAuthorityaSecretarywhoshall

    (a) bealegalpractitionerandshallhavebeensoqualifiedforaperiodofnotlessthan12years;

    (b) conductthecorrespondenceoftheBoardandkeeptheofficialsealandrecordsofthe

    Authority;and

    (c) performsuchotherfunctionsastheBoardortheDirectorGeneral,mayfromtimetotime

    assignto

    him.

    (2)TheAuthorityshallappointsuchnumberofemployeesasmaybeexpedientandnecessaryforthe

    properandefficientperformanceofitsfunctionsunderthisAct.

    (3)Notwithstandingtheprovisionsofsubsections(1)and(2)ofthissection,theAuthorityshallhave

    powertoappointeitherdirectlyoronsecondmentfromanypublicserviceintheFederationorofa

    State,suchnumberofstaffasmay,initsopinionberequiredtoassistitinthedischargeofanyofthe

    AuthoritysfunctionsunderthisAct.

    (4)Nothinginsubsection(3)ofthissectionshallprecludetheAuthorityfromappointingpersonsfrom

    outsidethepublicserviceoftheFederationofaState.

    10.Conflictofinterest

    (1)TheMinisterofAviation,MembersoftheGoverningBoard,DirectorGeneralandemployeesofthe

    MinistryofAviationandtheAuthorityshallnotcontrol,manageoroperateanyaviationenterprisewhile

    inoffice.

    (2)Anyofthepersonsspecifiedinsubsection1,havingafinancialinterestinanyaviationenterprise

    shallmakefulldisclosureofsuchinteresttotheirrespectiveappointingauthorities.

    (3)Anyofthepersonsmentionedinsubsection(1)aboveisprohibitedfromparticipatinginanyaction

    ordecisionthatmay,whetherdirectlyorindirectly,affecttheirfinancialinterest(s)inanyaviation

    enterprise.

    11.PensionsActNo.2,2004

    (1)ServiceintheAuthorityshallbeapprovedserviceforthepurposeofthePensionReformActorany

    otherActforthetimebeinginforce.

    (2)TheofficersandotherpersonsemployedintheAuthorityshallbeentitledtopensions,gratuitiesand

    otherretirementbenefitsinconformitywithprovisionsofthePensionsReformAct.

    (3)Nothinginsubsections(1)and2)ofthissectionshallpreventtheappointmentofapersontoany

    officeontermswhichmayprecludethegrantofapension,gratuityorotherretirementbenefitsin

    respectofthatoffice.

    (4)ForthepurposesoftheapplicationoftheprovisionsofthePensionsAct,anypowerexercisable

    thereunderbyaMinisterorotherauthority(otherthanthepowertomakeregulationsthePensions

    Act)isherebyvestedinandshallbeexercisablesolelybytheBoard.

    FinancialProvisions

    12.Airticketandcargosalescharge

    (1)Thereshallcontinuetobea5%airticketcontract,charterandcargosaleschargetobecollectedby

    theairlinesandpaidovertotheAuthority.

    (2)TheAirTicketandCargoSaleschargemaybereviewedbytheAuthorityinconsultationwiththe

    stakeholdersfromtimetotime.

    (3)Fundsaccruingfromthesaidchargeshallbesharedinthefollowingmanner:

    (a) theNigeriaCivilAviationAuthority 58%;

    (b) NigerianAirspaceManagementAgency 23%;

    (c) NigerianMeteorologicalAgency9%;

    (d) NigerianCollegeofAviationTechnology 7%;

    (e) AccidentInvestigationBureau3%;

    Providedthatifanyoftheabovelistedagenciesisprivatizeditshallimmediatelyceasetoshareinthe

    fundsasaforesaidandtheMinistermaybyregulationspecifyhowtheshareofsuchprivatizedagency

    shallbe

    applied

    or

    disbursed.

    13.FundoftheAuthority

    ThereshallbeestablishedandmaintainedfortheAuthorityafundintowhichshallbepaidandcredited

    (a) allsubventionsandbudgetaryallocationfromtheGovernmentoftheFederation;

    (b) allfeesandfundsinrespectofservicesprovidedbytheAuthority,andaccruingfromthegrant

    of

    (i)AirTravelOrganizersLicense,

    (ii)AirTransportLicense/AirlineOperatingPermit/Permitfornoncommercialflights,

    (iii)AirOperatorCertificate,

    (iv)calibrationofnavigationalaidswhereapplicable,

    (v)personnellicenses,

    (vi)58%oftheairticketandcargoandchartersaleschargeimposedinsection12ofthisAct,

    (vii)ApprovedMaintenanceOrganization(AMO)approval,

    (viii)Aircraftregistrationandcertification,

    (ix)CertificateofAirworthiness(issueandrenewal),

    (x)rentalofproperty,plantandequipment,

    (xi)medicalexaminationfees,whereapplicable,

    (b)specifythetimesandtheformandmannerinwhich,anyinformationrequiredunderparagraph(a)

    ofthissubsectionshallbefurnished.

    (2)IncarryingoutthefunctionsconferredontheAuthority,anauthorizedofficeroftheAuthorityshall

    haveunrestrictedaccesstothebusinesspremises,aircraft,structuresandotherapparatususedbyany

    operatorfor

    the

    purpose

    of

    air

    transport

    or

    related

    operations.

    (3)Inthissection,authorisedofficermeanstheDirectorGeneraloranyotherofficeroftheAuthority

    specificallyorgenerallyauthorisedbytheDirectorGeneraltocarryoutthefunctionsoftheAuthority

    underthisAct.

    20.RestrictiononDisclosureofInformation

    (1)Noestimates,returnsorinformationrelatingtoanairtransportundertakingobtainedunderthe

    foregoingprovisionsofthisAct,shall,withoutthepriorconsentinwritingofthepersoncarryingonthe

    undertakingwhichisthesubjectoftheestimates,returns,orinformation,bedisclosedexcept

    (a)inaccordancewithdirectionsgivenbytheAuthorityforthepurposeoftheexerciseofanyofits

    functionsunderthisAct;or

    (b)forthepurposesofanyproceedingsunderthisAct.

    (2)Anypersonwhodisclosesanyestimates,returnsoranyinformationincontraventionofsubsection1

    ofthissection,commitsanoffenceandisliableonconvictiontoimprisonmentforatermnotlessthan1

    monthorafinenotlessthanN25,000.00orboth.

    21.ServiceofNotices

    (1)AnynoticerequiredorauthorisedunderthisActtobeservedonanypersonmaybeservedeitherby

    (a)deliveringittothepersonorhisagentsorservants;

    (b)leavingitatthepersonsproperaddress;or

    (c)postingittothepersonsprincipalofficebyregisteredpostorcourier.

    (2)Anynoticerequiredorauthorisedtobeserveduponabodycorporateshallbedeemedtohavebeen

    dulyservedifitisservedonadirectorofortheSecretarytothebodycorporate.

    (3)Forthepurposesofthissection,theproperaddressofanypersononwhomsuchanoticeistobe

    servedshall

    (a)inthecaseofabodycorporate,bethatoftheregisteredorprincipalofficeofthebodycorporate;

    and

    (b)inanyothercase,bethelastknownaddressoftheperson.

    theprovisionsofthisActshallbeservedbydeliveringsametotheofficeoftheDirectorGeneralofthe

    AuthoritysituateattheHeadquartersoftheAuthority.

    PARTVII

    MiscellaneousProvisions

    23.PowertoAcquireLand

    (1)TheAuthority,maysubjecttotheLandUseAct,acquireanylandforthepurposeofdischargingits

    functionsunderthisAct.

    (2)IfthereisanyhindranceintheacquisitionofanylandbytheAuthorityunderthisAct(includingany

    failurebytheAuthoritytoreachanagreementastotheamounttobepaidinrespectofthe

    acquisition),theAuthoritymayapplytotheMinisterforadeclarationundersubsection(3)ofthis

    section.

    (3)TheMinisteronreceivinganapplicationfromtheAuthorityandaftersuchenquiryashemaythink

    fit,mayrequesttheGovernoroftheStateinwhichthelandissituatedtodeclarethatthelandis

    requiredfortheserviceoftheAuthorityandaccordinglyforanoverridingpublicpurpose.

    (4)Whereadeclarationismadeundersubsection(3)ofthissection,thelandtowhichthedeclaration

    relatesshallbedeemedtobelandrequiredforthepublicpurposeoftheFederationwithinthemeaning

    oftheLandUseActandtheAuthorityshallacquirethelandaccordingly.

    (5)Whereadeclarationhasbeenmadeundersubsection(3)ofthissectioninrespectofanylandand

    (a)thelandhasbeenacquiredpursuanttosubsection(4)ofthissection;or

    (b)theGovernoroftheStatewherethelandissituatedissatisfiedthattherearenorightssubsistingin

    respectoftheland,

    theGovernormayvestthelandintheAuthoritybyissuingacertificateofoccupancyinrespectthereof,

    infavourandinthenameoftheAuthority.

    (6)Thecompensation,ifany,payableundertheLandUseActfortherevocationofanyrightsrelatingto

    theland,whereapplicable,shallinthefirstinstancebepaidbytheFederalGovernment,butthe

    AuthorityshallrefundtotheFederalGovernmentanycompensationsopaidandallincidentalexpenses

    incurredbytheGovernment.

    (7)Aplanofanylandreferredtoinsubsection(2)ofthissection

    (a)containingmeasurementsoftheboundariesoftheland;

    (b)showingtherelationshipofthelandtoanysufficientidentifyingmark(s);and

    24.LimitationofsuitsagainsttheAuthority

    (1)Notwithstandinganythingcontainedinanyotherlaworenactment,nosuitshalllieagainstthe

    Authority,amemberofitsBoard,itsDirectorGeneral,oranyotheremployeeoftheAuthorityforany

    actdoneinpursuanceorexecutionofanypublicdutyunderthisActoranylaworenactment,orin

    respectofanyallegedneglectordefaultintheexecutionofanypublicdutyunderthisActorsuchlawor

    enactment,unlessitiscommencedwithinone(1)yearnextaftertheact,neglectordefaultcomplained

    the

    25.RestrictiononExecutionagainstPropertyoftheAuthority

    (1)InanyactionorsuitagainsttheAuthority,noexecutionorattachmentorprocessinthenature

    thereofsaveagarnisheeprocessshallbeissuedagainsttheAuthority.

    (2)Anysumofmoney,whichmaybytheJudgmentofanycourtbeawardedagainsttheAuthority,shall,

    subjecttoanydirectiongivenbyacompetentcourtwherenoticeofappealofthesaidjudgmenthas

    beengiven,bepaidfromthefundoftheAuthority.

    26.IndemnificationofOfficers

    AmemberoftheBoard,theDirectorGeneraloremployeeoftheAuthorityshallbeindemnifiedbythe

    Authorityagainstanycivilproceedingbroughtagainsthimarisingfromthelawfuldischargeofanyof

    thefunctionsortheexerciseofanyofthepowersconferredontheAuthorityunderthisActorany

    otherenactment.

    PARTVIII

    InvestigationandEnforcement

    27.Power

    to

    investigate,

    impose

    fines

    and

    enforce

    (1)TheAuthorityshallhavepowertocarryoutinvestigationsintocomplaintsandoccurrences,savefor

    accidentsandseriousincidents,afterduenoticetothepersonconcerned.

    (2)IftheAuthorityissatisfiedaftersuchhearingthatsuchpersonisviolatinganyprovisionsofthisAct,

    regulations,rulesororders,asthecasemaybe,itshallbyorderrequirethepersontotakesuchaction

    consistentwiththeprovisionofthisAct,regulations,rulesorordersasmaybenecessaryintheopinion

    oftheAuthoritytopreventfurtherviolationoftheprovisionsofthisAct,regulations,rulesororders.

    (3)TheAuthorityshallhavepowertotakeallstepsreasonablynecessary,includingthepowertoground

    anyaircraftandtosealthepremisesofanyairtransportserviceproviderorproviderofalliedaviation

    service,inorder

    to

    ensure

    compliance

    with

    the

    provisions

    of

    this

    Act

    and

    the

    regulations,

    rules

    and

    ordersmadepursuanttoit.

    28.DirectionsbytheMinister

    (1)TheMinistermayafterconsultationwiththeAuthoritygivesuchdirections,notinconsistentwiththe

    provisionsofthisAct,totheAuthorityonmattersofpolicy

    (a)intheinterestsofnationalsecurity;

    (b)inconnectionwithanymatterappearingtohimtoaffecttherelationsofNigeriawithacountryor

    territoryoutsideNigeria;

    (c)inordertodischargeorfacilitatethedischargeofanobligationbindingonNigeriabyvirtueofits

    beingamemberofaninternationalorganizationorapartytoaninternationalagreement;

    (d)inordertoobtainorfacilitatetheattainmentofanyotherobjectofwhichisinhisopinion

    appropriateinviewofthefactthatNigeriaisamemberofaninternationalorganizationorapartytoan

    internationalagreement;or

    (e)inordertoenableNigeriabecomeamemberofaninternationalorganizationorapartytoan

    internationalagreement.

    (2)TheAuthorityintheexerciseofitsfunctionsandpowersshallbeguidedbysuchdirections.

    (3)TheAuthorityshallfurnishtheBoardwithsuchinformationorfacilitiesforobtaininginformation

    withrespecttoitsactivitiesastheMinistermayfromtimetotimerequire.

    29.InvestigationofAccidents/AccidentInvestigationBureau

    (1)ThereisestablishedanAccidentInvestigationBureauhereinafterinthisActreferredtoasthe

    Bureauwhichshallbeabodycorporatewithpowertosueandbesuedinitscorporatenameexcept

    formattersassociatedwithaccidentreportsandtoacquire,holdanddisposeofpropertywhether

    movableorimmovable.

    (2)TheBureaushallbeanautonomousagencyreportingtothePresidentthroughtheMinister.

    (3)(a)TheBureaushallbeheadedbyaCommissionerofAccidentinvestigationwhoshallbeappointed

    bythePresidentontherecommendationoftheMinister.

    (b)TheCommissionerofAccidentInvestigation,whoshallbetheChiefExecutiveOfficeroftheBureau,

    shallbeappointedforaperiodoffour(4)yearsrenewableonceforanotherperiodoffour(4)years.

    (a)allsubventionsandbudgetaryallocationfromtheGovernmentoftheFederation;

    (b)3%oftheairticketcontractcharterandcargosaleschargeimposedinSection12ofthisAct;

    (c)allsumsaccruingtotheBureaubywayofgifts,endowments,bequests,grantsorothercontributions

    bypersonsandorganizations;

    (d)returnsoninvestments;

    (e)foreignaidandassistance;and

    (f)allothersumswhichmay,fromtimetotime,accruetotheBureau.

    (6)TheservicesofallpersonscurrentlyemployedintheAccidentInvestigationandPreventionBureau

    oftheMinistryofAviationareherebytransferredtotheBureau,

    (7)TheCommissionerofAccidentInvestigationmaywiththeapprovaloftheMinisterrecruitsuchstaff

    asisnecessaryfortheexecutionofitsfunctionsunderthisAct.

    (8)ThereshallbeappointedfortheBureaualegaladviserwhoshallbeaLegalPractitionerofnotless

    than10yearspostcallexperience.

    (9)TheBureauintheexecutionofitsfunctionsunderthisActshallfollowandadheretotheregulations

    foraccidentinvestigationmadebytheMinster.

    (10)TheMinistermaymakeregulationsprovidingfortheinvestigationofanyaccidentorincident

    arisingoutoforinthecourseofairnavigationandeitheroccurringinoroverNigeriaoroccurringto

    Nigerianaircraftelsewhere.

    (11)Withoutprejudicetothegeneralityofsubsection(10)ofthissection,theregulationsmadethere

    undermayinparticularcontainprovisions

    (a) requiringnoticetobegivenofanysuchaccidentorincidentasaforesaidinsuchmannerandby

    suchpersonsasmaybeprescribed;

    (b) applyingforthepurposeofinvestigationsheldwithrespecttoanysuchaccidentorincidentany

    oftheprovisionsofanylawinforceinNigeriarelatingtotheinvestigationofdeathsor

    accidents;

    (c) prohibiting,pendinginvestigation,accesstoorinterferencewithaircrafttowhichanaccidentor

    incidenthasoccurredandauthorisinganyperson,sofarasmaybenecessaryforthepurposes

    alicense

    granted

    by

    acompetent

    elsewhere,whereitappearsoninvestigationthatthelicense,certificateorvalidationoughtto

    besodealtwith,andrequiringtheproductionaccordinglyofanysuchlicenseorcertificate;

    (e) incorporatingtheprovisionsofAnnex13totheConventiononInternationalCivilAviation,

    (12)ThesoleobjectiveoftheinvestigationofanaccidentorseriousincidentunderthisActshallbethe

    preventionofaccidentsandincidentsanditshallnotbethepurposeofsuchaninvestigationto

    apportionblameorliability.

    (13)Onthebasisofthefindingsofaccidentinvestigation,theAuthorityshallbeinformedandthe

    DirectorGeneral

    shall

    take

    corrective

    actions

    that,

    inthe

    judgment

    of

    the

    Authority,

    will

    prevent

    similar

    accidentsinthefuture.

    (14)NotwithstandingtheprovisionsoftheEvidenceAct,thecontentsofanairaccidentinvestigation

    (q)forspecifyingthefeestobepaidinrespectoftheissue,validation,renewal,extensionorvariationof

    anycertificate,licenseorotherdocumentortheundergoingofanyexaminationortestrequiredby

    virtueoftheregulationsandinrespectofanyothermatterinrespectofwhichitappearstothe

    Authoritytobeexpedientforthepurposesoftheregulationstochargefees;

    serviceproviders;

    (t)regardingthedesign,constructionandmodificationofaircraftandallothermattersconnectedwith

    thedesign,constructionandmaintenanceofaircraft;and

    (u)regardingsecuritycontrolandscreeningtowhichpassengersandbaggage(whetheraccompaniedor

    unaccompanied)wouldbesubjectedtobeforeboardingorbeinglaidonanaircraft.

    (3)TheAuthorityshallhavepowerto

    (a)freeandunobstructedaccesstoallcivilaviationpersonnel,aircraft,aviationfacilities,toinspect

    aircraft,aircraftmanufacturersandmaintenancefacilitiesororganizations,trainingfacilities(including

    simulators),andotherappliancesdesignedforuseinairtransportation,asmaybenecessarytoenable

    theAuthoritytodeterminetheissuanceorgrantingofacertificateofregistrationorapprovaltosuch

    aircraft,aircraftmanufacturerandmaintenancefacilityororganizationandotherapplicableappliances;

    (b)issue,amend,vary,cancel,refuseandsuspendapprovedmaintenanceorganizationcertificatesin

    conformitywithregulationsmadeunderthisAct;

    (c)issue,amend,vary,cancel,refuseandsuspendaproductioncertificate;

    (d)issueorvalidatetypecertificatesandprescribeinsuchcertificates,terms,conditionsandlimitations

    themintoconformitywithairworthinessregulations;

    (h)establishflightoperations,airworthinessengineeringandairworthinessinspectionorganizations,

    necessaryfortherequirementsofsafetyofairnavigation;

    (i)establishapersonnellicensingsystemtolicenseaircraftmaintenancepersonnel,flightcrew,air

    trafficcontrollers,flightoperationsofficersandsuchotherpersonsengagedintheuseoroperationof

    aircraft,aircraftfacilities,aerodromesandotheractivitiesrelated,incidentalorsupplementarythereto,

    inaccordance

    with

    the

    provisions

    of

    this

    Act,

    regulations

    and

    the

    licensing

    requirements

    specified

    in

    Annex1oftheChicagoConvention;

    (j)specify,monitorandsupervisetheconditionsunderwhichanaircraftmaycarrypassengers,mailand

    cargoorbeusedforotherproposes,andprohibitanaircraftfromthecarriageofsuchclassesofgoods

    astheAuthoritymayprescribefromtimetotime;

    (k)certify/grantlicensesinrespectofaerodromesandcertifyairways,navigationalapproachesand

    landingaidsinNigeriatoensuresafetyofairnavigation;

    (l)prohibitandregulatetheinstallationofanystructure,whichbyvirtueofitsheightorpositionis

    consideredtoendangerthesafetyofairnavigation;

    (m)instituteandregulatetheuseofcivilairensignandotherensignestablishedforpurposesconnected

    withairnavigationinNigeria;

    (n)regulatetheactivitiesofairnavigationserviceprovidersinaccordancewithICAOStandardsand

    RecommendedPracticesandnationallaws;

    (o)regulateandparticipateinaeronauticalsearchandrescueoperations;

    (p)determinetheneedforcommercialairtransportoperations;

    (q)regulatethestandardsfortheprovisionsofairtrafficservicesandprescribeairtrafficregulations,

    rulesorconditionsonaircraftflights(includingsafealtitudes)forthepurposeofnavigating,protecting

    andidentifyingaircraft,protectingindividualsandpropertyongroundandpreventingcollisionbetween

    aircraftandlandorwatervehiclesandbetweenanaircraftandairborneobjects;

    (r)regulatethestandardsfortheprovisionofaeronauticalmeteorologicalservicesforthesafeconduct

    ofcivilaviationoperations;

    (s)regulatethestandardsfortheprovisionofcivilaviationsecurityinNigeria.

    (4)Notwithstandingtheprovisionsofsubsections(1)and(3)ofthissection,theAuthorityshallhaveand

    exercisethepowersgenerallyto

    (a)regulate,superviseandmonitortheactivitiesofNigerianandForeigncarriers,travelandother

    aviationagentsoperatinginNigeria,andtokeeparegisterinrespectthereof;

    (b)requireperiodicstatistical/financialandspecialreturnsandspecialreportsfromanyaircarrier,

    prescribethemannerandforminwhichsuchreportsorreturnsshallbemade,andrequirefromanyair

    carrierspecificanswerstoquestionsuponwhichitdeemsinformationmaybenecessary;

    (c)prescribetheformoffinancialrecordsandmemorandatobekeptbyaircarriersincludingaccounts,

    recordsandmemorandaofthemovementoftrafficandthereceiptofandexpenditureofmoneyand

    lengthoftimesuchaccounts,recordsandmemorandamaybepreserved;

    (d)requireeveryNigerianandForeigncarriertotheandkeepopenforpublicinspection,tariffsshowing

    allrates,faresandchargeschargedbyit,insuchformandmannerasmaybeprescribedbythe

    Authorityfromtimetotime,andtoapproveorrejecttariffssofiledwhichareinconsistentwith

    approvedratesspecifiedbytheAuthorityundertheprovisionsofthisAct,regulations,rulesandorders

    madethereunder:

    Providedthattherates,faresandchargesshowninanytariffshallinthefirstinstancebedenominated

    inlocalcurrency,withoutprejudicetothesebeingdenominatedinforeigncurrenciesinthecaseof

    foreigncarriers;

    (e)requireanaircarriertomaintainreasonableandadequateratesofcompensationandother

    conditionsofserviceforitsemployeessoastobringthemintoconformitywithprevailinglabourpracticesintheindustry;

    (f)requireadomesticaircarriertosubmitannuallyandatsuchothertimesasitmaydeemfit,alist

    showingthenamesofitsshareholdersoranypersonholdingmorethan5percentofthesharesinthe

    aircarriertogetherwiththenamesofanypersononwhosebehalfsuchsharesareheld;

    (g)requireeveryNigeriancarriertofilewithitatruecopyofeverycontractoragreementaffectingair

    transportationoranymodificationorcancellationthereof,betweentheaircarrierandanyotherair

    carrierorotherbodies,forleases,poolingorapportioningearnings,losses,traffic,serviceorequipment

    orrelatingtoestablishmentoftransportationfares,chargesorclassifications,orforpreservingand

    improvingsafety,preventingorotherwiseeliminatingdestructive,oppressiveorwastefulcompetition

    orforanyothercooperativeworkingarrangement;

    (h)disapproveofsuchcontractoragreementdescribedinparagraph(g)whetherornotpreviously

    approvedthatisfoundtobeadversetothepublicinterestortobeinviolationoftheprovisionsofthis

    Act,regulations,rulesandordersmadebytheAuthorityunderthisAct;

    (i)investigateanddetermineuponitsowninitiativeoruponreceiptofacomplaintbyanyaircarrier,air

    travelagent,consumerofairtransportserviceorotheralliedaviationserviceprovider,whetheranyair

    carrier,airtravelagentorproviderofanyotheralliedaviationservicehasbeenorisengagedinunfairor

    deceptivepracticesorunfairmethodsofcompetitioninairtransportation,thesaleofticketsthereofor

    intheprovisionofotheralliedaviationserviceandordersuchaircarrier,airtravelagentorotherallied

    aviationserviceprovidertodesistfromsuchpracticesormethodsofcompetition;

    (j)establishproceduresforinvestigationanddeterminationofrequestsorapplicationsforspecial

    operatingauthorisations;suchproceduresmayincludewrittennoticetoholdersofairoperators

    certificatestomakesubmissionswhichmaybeheardorallyinsupportofsuchapplicationaswillnot

    undulydelaytheissuanceofthespecialoperatingauthorisation,takingintoconsiderationthedegreeor

    emergencyinvolved;

    (k)participateinandadvisetheMinisterontechnicalmattersincludingBilateralAirServices

    Agreements,andgenerallyonactivitiesofinternationalaviationorganizations;

    (l)settrainingstandardsforandapproveairtransporttraininginstitutions;

    (m)instituteprogrammesfortheprotectionofconsumerinterests;

    (n)specifythefeestobepaidfortheissue,validation,renewal,extensionorvariationofanycertificate,

    licenseorotherdocumentissuedpursuanttothisActortheundergoingofanyexaminationortest

    requiredwhichmaybeexpedientforthepurposeoftheregulationoffeescharged;

    (o)prescribetheminimuminsurancecovertobetakenoutbyanyairoperatorcertificateholder,

    aerodromeoperatororairtrafficcontrolserviceprovidertakingintoaccount,asthebasisforsuch

    minimum,therespectiveriskinvolvedinsuchoperations;

    (p)ensurethattheextentofinsurancecoverundertakenbyanyholdershallnotbelessthanthat

    prescribedbytheAuthority;

    (q)fixandimposechargesinrespectofthegrantofanylicense,permit,certificateorother

    authorisationtoanypersonunderthisActorregulationsmadepursuanttheretoandinrespectofthe

    registrationofaircraftsormortgagesinrespectthereof,approvals,consentsandanyotherformof

    benefitconferredonanypersonpursuanttothisActortheregulationsmadepursuantthereto;

    (r)conducteconomicregulationofairlines,aerodromes,airnavigationservices,otheraviationandallied

    aviationserviceproviders.

    (5)ThepowersconferredupontheAuthorityunderthissectionincludesthepowerstodevelop,make,

    issueandreviseregulations,rules,orders,termsandconditionsinrespectofanymatterrelating,

    incidental,orsupplementalthereto,orsuchmatterastheAuthoritymaydeemnecessaryinthepublic

    interestandsafetyofairnavigation.

    (6)IntheexerciseofthepowersconferreduponitandthedischargeofitsfunctionsinthisAct,the

    approvaloforbeboundbythedecisionsorrecommendationsofanyperson,bodyororganization,but

    shallheguidedbysafety,securityandpublicinterestconsiderations.

    (7)The

    powers

    conferred

    on

    functions

    of

    the

    Authority

    inthis

    Act

    are

    vested

    on

    the

    Director

    GeneraloftheAuthoritywhomayexercisethemdirectlyorthroughtheDirectorsinchargeoftheunder

    listedDirectorates

    (a)AirWorthinessStandards;

    (b)AirTransportRegulation;

    (c)OperationsandTrainingStandards;

    (d)AerodromeandAirspaceStandards;

    (e)LicensingStandards;

    (f)AeromedicalStandards;

    (g)Legal;

    (h)FinanceandAccounts;

    (i)AdministrationandCorporateAffairs;

    orotherstaffoftheAuthority.

    (8)TheDirectorGeneralshallestablishthecredentialsoftheSafetyInspectorsoftheAuthority.

    (9)TheDirectorGeneralmaydelegateanyassignedpowersanddutiestoanyproperlyqualifiedprivate

    person,subjecttosuchregulation,supervisionandreviewasmaybeprescribedbytheAuthority

    althoughtheDirectorGeneralshallensurethatsuchfunctionsarenotdelegatedinsuchawaythat

    aircraftoperators,airportCivilAviationActoperators,aerialworkserviceproviders,generalaviation

    operatorsandmaintenancefacilityoperators,ineffect,regulatethemselves.

    (10)RegulationsmadeunderthissectionshallprovidefortheimpositionofPenaltiesforoffences

    againsttheregulations,includingthesuspensionorrevocationofcertificates,licensesand

    authorisations,andinthecaseofanyparticularoffencesuchfineasmayfromtimetotimebe

    prescribedbyregulation9madebytheAuthorityandorimprisonmentforatermnotlessthansix

    months,and,subjecttoChapterIVoftheConstitutionoftheFederalRepublicofNigeria(whichrelates

    tofundamentalrights),forthetakingofsuchsteps(includingtheinterceptionofaircraft)asmaybe

    prescribedasrespectsaircraftflyingoverareasofNigeriaoverwhichflyingisprohibitedbythe

    regulations.

    (11)Regulationsmadeunderthissectionmaymakedifferentprovisionswithrespecttodifferentclasses

    ofaircraft,aerodromes,personsorpropertyandwithrespecttodifferentcircumstancesbutshall,sofar

    aspracticable,besoframedasnottodiscriminateinlikecircumstances.

    (12)Intheexerciseofitspowertomakeregulationsunderthissection,theAuthorityshallconsultwith

    stakeholdersincluding

    airlines,

    aerodrome

    operators,

    air

    traffic

    control

    service

    providers,

    consumers

    andotherrelevantbodiesandorganizationsintheaviationindustry.

    PARTX

    FunctionsoftheAuthority

    31.FunctionsoftheAuthority

    TheAuthorityshallberesponsiblefor

    (a) theregistrationofanyaircraftinNigeriaandissuancetotheownerthereof,ofacertificateof

    registration;

    (b)theestablishmentandmaintenanceofasystemorregisterforrecordingthetitletooranyinterestin

    anyaircraftregisteredinNigeria;

    (c)theprohibitionofanyNigerianorforeignregisteredaircraftfromoperatingwithintheNigerian

    airspace,unlessacertificateofairworthinessinrespectthereof,isissuedorvalidatedunderthe

    regulationsinforcewithrespecttotheaircraft:

    Providedthattheforegoingprohibitionshallnotapplytoaircraftundergoingtestflightsorflightsto

    placeswhereprescribedmaintenanceorrepairsaretobecarriedout;

    (d)theinspectionandregulationofaerodromes,inspectionofaircraftfactoriesandfortheprohibition

    orregulationoftheuseofaerodromeswhicharenotlicensedinpursuanceoftheregulations;

    (e)theprohibitionofanypersonfromengaginginairnavigationinanycapacitywhatsoeverunlessthe

    AuthoritydeterminesthatsuchapersonsatisfiestherequirementsofthisActandtheregulationsmade

    thereunder;

    (f)ensuringtheefficiencyandregularityofairnavigationandthesafetyofaircraft,personsand

    propertycarriedinaircraftandforpreventingaircraftfromendangeringpersonsandproperty;

    (g)theprohibitionofaircraftsfromflyingoversuchareasinNigeriaasmaybeprescribed;

    (h)theissue,validation,renewal,extensionorvariationofanycertificate,licenseorotherdocument

    requiredbytheregulations(includingtheexaminationsteststobeundergone)andcustody,and

    production,cancellation,suspension,endorsementandsurrenderofanysuchdocument;

    (i)theregistrationofbirthsanddeathsoccurringinaircraftandofparticularsofpersonsmissingfrom

    aircraft;and

    (j)thecollationandmaintenanceofadatabankofaviationandaircraftaccidents,incidents,and

    occurrencesandpromoteaccidentpreventionprogrammes.

    PARTXI

    ControlofAirTransportUndertaking

    32.Licensingofairtransportundertakings

    (1)Subjecttotheprovisionsofsection34ofthisAct

    (a)noaircraftshallbeusedbyanypersoninNigeriaforflying,whilecarryingpassengersorcargofor

    reward,onsuchjourneysorclassesofjourneys(whetherbeginningandendingatthesamepointorat

    differentpoints)orforsuchflyingundertakingforthepurposeofanytradeorbusiness,exceptunder

    theauthorityofandinaccordancewithalicense,permit,orotherauthorizationissuedtohimbythe

    Authority.

    (b)noaircraftshallbeusedbyanypersoninNigeriaforanyotherpurposesaveformilitary,police,

    customs,orimmigrationoperations,exceptundertheauthorityofandinaccordancewithalicense,

    permit,orotherauthorisationissuedbytheAuthority.

    (2)TheAuthoritymaybyregulationsprescribethetypesoflicenses,permits,certificatesorother

    authorisation,whichmaybeissuedandthetermsandconditionsuponwhichtheymaybeissued.

    (3)Nothinginthissectionshallrestricttherightofadesignatedairtransportundertaking,havingits

    principalplaceofbusinessinanycountryoutsideNigeria,toprovidetransportforpassengers,mailor

    cargo

    (a)inaccordancewiththetermsofanyagreementforthetimebeinginforcebetweenthegovernment

    oftheFederalRepublicofNigeriaandthegovernmentofthatcountry;or

    (b)inaccordancewiththetermsofanypermissiongrantedbytheMinisterpendingthecompletionof

    thenegotiationsforsuchanagreementreferredtoinParagraph(a).

    (4)Anapplicationforthegrantofalicense,permit,certificateorotherauthorisationmustbemadein

    writingtotheAuthorityandcontainsuchparticularswithrespecttosuchmattersastheAuthoritymay

    specifyinanoticepublishedintheprescribedmannerandwhereanapplicationismadeforthegrantof

    anysuchlicense,permit,certificateorotherauthorization,theAuthorityshallsubjecttosubsection(6)

    ofthis

    section,

    either

    grant

    such

    license,

    permit,

    certificate

    or

    other

    authorisation

    to

    the

    applicant

    inthe

    termsrequestedintheapplication,orinthosetermswithsuchmodificationsastheAuthoritythinksfit,

    orrefusetograntsuchlicense,permit,certificateorotherauthorisation.

    (5)WhereanapplicationismadetotheAuthorityandtheAuthorityissatisfiedthattheapplicanthas

    metandcompliedwithalltherequirementsnecessaryforgrantofalicense,permit,certificateorother

    authorisation,theAuthorityshallgivenoticeofsuchcompliancebytheapplicant.

    (6)Uponreceiptofthenoticeaforesaid,theAuthoritymayapproveordisapprovethegrantofsuch

    license,permit,certificateorotherauthorisationandtheAuthorityshallproceedtograntthesaid

    license,permit,certificateorotherauthorisation;

    Providedthat,theAuthorityshallnotapproveanyapplicantforthegrantofalicence,permit,certificate

    orother

    authorisation

    inrespect

    of

    whom

    the

    Authority

    has

    given

    notice

    that

    such

    an

    applicant

    has

    met

    andcompliedwithalltherequirementsforthegrantofsuchlicense,permit,certificateorother

    authorisation.

    33. Eligibilityforlicenses,permits,etc.

    (1)Notwithstandingtheprovisionsofsection17oftheNigeriaInvestmentPromotionCommissionAct,

    theAuthorityshallrefusetograntalicensepermit,certificateorotherauthorisationinpursuanceofan

    applicationifitisnotsatisfiedthat

    [1995No.16]

    (a)theapplicantis

    (i) acitizenofNigeria,or

    (ii) beingacompanyorabodycorporate,isregisteredinNigeriaandhasitsprincipalplace

    ofbusinesswithinNigeria,andiscontrolledbyNigerianationals;

    (b)theapplicantis,havingregardto

    (i) hisandhisemployeesexperienceinthefieldofaviationandhisandthepastactivities

    generally,and

    (ii) wheretheapplicantisabodycorporate,theexperienceinthefieldofaviationandthe

    pastactivitiesgenerallyofthepersonsappearingtotheAuthoritytocontrolthatbody,

    afitpersontooperateaircraftsundertheauthorityofthelicense,permit,certificateorother

    authorisationwhichtheAuthorityconsidersshouldbegrantedtohiminpursuanceofthe

    application;or

    (c)theresourcesoftheapplicantandthefinancialarrangementsmadebyhimareadequatefor

    discharginghisactualandpotentialobligationsinrespectofthebusinessactivitiesinwhichheis

    engagedifany,andinwhichhemaybeexpectedtoengageifheisgrantedthelicense,permit,

    certificateorotherauthorisationwhichtheAuthorityconsidersshouldbegrantedtohiminpursuance

    oftheapplication.

    (2)Theprovisionsofsubsection(1)ofthissectionshallnotapplytoanylicense,permit,certificateor

    otherauthorisationneededbyapersonforthepurposeofoperatinganaircraftforprivateuseonly.

    34.AirOperatorCertificate(A.O.C.)andothersafetycertificates

    (1)TheAuthorityshallissueAirOperatorsCertificatesandallothercertificatesrelatingtothesafetyof

    airtransportundertakings.

    (2)TheAuthorityshallbyregulationprescribetheminimumsafetystandardsandallotherrelevant

    requirementsforthegrant,issuance,operation,variation,andrenewalofsuchcertificates.

    (3)TheAuthorityshallbyregulation,issueoperationspecificationsthatdefinetheapprovedterms,

    conditionsandlimitationsofsuchoperations.

    (4)TheAuthorityshallbyregulationprescribeconditionsfortherevocation,suspensionorother

    limitationofAirOperatorCertificates.

    35.Variation,suspensionandrevocationoflicenses,permits,etc.

    (1)Anapplicationforthevariation,suspensionorrevocationofalicence,permit,certificateorother

    authorisationmaybemadetotheAuthorityatanytimeinsuchmannerandbysuchperson(s)asmay

    beprescribedinwritingbytheAuthority.

    (2)TheAuthoritymayatanytimevary,suspendorrevoke,alicence,permit,certificateorother

    authorisationifitconsidersitappropriatetodoso,whetherornotsuchanapplicationwithrespectto

    thelicense,permit,certificateorauthorisationhasbeenmadepursuanttosubsection(1)ofthissection.

    (3)TheAuthoritymayexerciseitspowersundersubsection(2)hereoftorevoke,suspendorvarya

    license,permit,certificateorauthorisation(whicheverisappropriateinthecircumstances)ifitisnotor

    isnolongersatisfiedthat

    (a)theholderofthelicenseis,havingregardto

    (i) hisandhisemployeesexperienceinthefieldofaviationandhisandtheirpastactivities

    generally,and

    (ii) wheretheholderofthelicenseisabodycorporate,theexperienceinthefieldof

    aviationandthepastactivitiesgenerallyofthepersonsappearingtotheAuthorityto

    controlthatbody,

    afitpersontooperateairtransportbusinessundertheauthorityofthelicense,permit,

    certificateorotherauthorisation;or

    (b)theresourcesoftheholderofthelicense,permit,certificateorotherauthorisationandthefinancial

    arrangementsmadebyhimareadequatefordischarginghisactualandpotentialobligationsinrespect

    ofthebusinessactivitiesinwhichheisengaged;

    (c)theholderofalicense,permit,certificateorotherauthorisationsubjecttosection34(2)isacitizen,

    ofNigeriaorsuchacompanyorbodyasmentionedinparagraph(a)(ii)ofsubsection(1)ofsection33;

    (4)TheAuthoritymayexerciseitspowersundersubsection(2)hereoftorevoke,suspendorvarya

    license,permit,certificateorauthorisation(whicheverisappropriateinthecircumstances)ifitisnotor

    isnolongersatisfiedthattheholderofalicensehasnotcontravenedanyoftheprovisionsofthisActor

    anyregulationmadethereunderespeciallyprovisionsandregulationsrelatingtosafetyandsecurityor

    anyprovisionorregulationthebreachofwhichconstitutesanoffenceunderthisActorsuchregulation.

    (5)Theprovisionsofsubsections(2)and(3)conferringontheAuthoritypowertorevoke,suspendor

    varyalicense,

    permit,

    certificate

    or

    other

    authorisation

    shall

    be

    construed

    as

    conferring

    on

    the

    Authoritypowertoprovide,byanoticeinwritingservedintheprescribedmannerontheholderofthe

    license,permit,certificateorotherauthorisationthatthelicense,permit,certificateorother

    authorisationshallnotbeeffectiveduringaperiodspecifiedinthenotice.

    (6)TheAuthoritymay,whilealicense,permit,certificateorotherauthorisationisineffectivebyvirtue

    ofsuchanotice,byafurthernoticeinwritingservedintheprescribedmannerontheholder,provide

    thatthelicense,permit,certificateorotherauthorisationshallbeeffectiveonandafteradatespecified

    inthefurthernoticebutthefurthernoticeshallnotprejudicetheAuthorityspowerstosuspendthe

    license,permit,certificateorotherauthorisationagainortorevokeorvaryit.

    36.Supplementary

    provisions

    relating

    to

    licensing,

    permits,

    etc.

    (1)WheretheAuthoritytakesadecisionrefusingtogrant,vary,suspendorrevokealicense,permit,

    certificateorotherauthorisation,theAuthorityshallsubjecttosubsection(2)below,furnisha

    statementofthereasonsforthedecisiontotheapplicantforthelicense,permit,certificateorother

    authorization,orasthecasemaybe,totheholderandtoanyotherpersonwhoinaccordancewith

    rulesmadepursuanttothisActhasfiledanobjectioninthecaseorrequestedsuchastatement,

    providedthat,nostatementofreasonsneedbefurnishedinpursuanceofthissubsectioninacasein

    whichthedecisionistakeninpursuanceofarequestbytheholderofalicense,permit,certificateor

    otherauthorisationforthevariation,suspensionorrevocationofit.

    (2)TheAuthoritymayrefrainfromfurnishingastatementofreasonsinpursuanceofsubsection(1)of

    thissection,ifithasreasontobelievethatitmightadverselyaffectthesecurityinterestsofNigeriaor

    therelationsofNigeriawithanyothercountry.

    (3)TheAuthoritymaypublishinsuchmannerasitthinksfitparticularsof,andofitsreasonsfor,any

    decisiontakenwithrespecttoalicense,permit,certificateorotherauthorisationoranapplicationfor

    suchalicense,permit,certificateorotherauthorisation.

    (4)Apersonwho,forthepurposeofobtainingforhimselforanotherpersonalicense,permit,

    certificateorotherauthorisationorwithregardtoavariationorthecancellationorsuspensionofa

    license,permit,certificateorotherauthorisationknowinglyorrecklesslyfurnishestotheAuthorityanyinformationwhichisfalse,commitsanoffenceandliableonconvictiontoimprisonmentforatermof

    notlessthan6monthsorafineofnotlessthanN500,000.00(FiveHundredThousandNaira)orboth.

    37.Generaldutiesinrelationtolicensingfunctionoftheauthority

    (1)TheAuthorityshallperformitsairtransportlicensingfunctionsinthemannerwhichitconsidersbest

    toensurethatNigerianregisteredairlinescompeteaseffectivelyaspossiblewithotherairlinesin

    providingairtransportservicesoninternationalroutes:andinperformingthosefunctionstheAuthority

    shallalsohaveregardto

    (a)anyadvicereceivedfromtheMinisterwithrespecttothelikelyoutcomeofnegotiationswiththe

    governmentofanyothercountryorterritoryforthepurposeofsecuringanyrightrequiredforthe

    operationby

    an

    airline

    inNigeria

    of

    any

    air

    transport

    services

    outside

    Nigeria;

    and

    (b)theneedtosecurethemosteffectiveuseofaerodromeswithinNigeria.

    (2)Inconsideringwhethertograntalicense,permit,certificateorotherauthorisation,theAuthority

    shallhaveregardtotheeffectonexistingairtransportservicesprovidedbyNigerianregisteredairlines,

    ofauthorisinganynewservicestheapplicantproposestoprovideunderthelicense,permit,certificate

    orotherauthorisation.

    (3)Wheretwoormoreapplicantshaveappliedforthesamelicense,permit,certificateorother

    authorisationunderwhicheachproposestoprovidesimilarservices,theAuthorityshallhaveregardin

    particularto

    any

    benefits

    which

    may

    arise

    from

    enabling

    two

    or

    more

    airlines

    to

    provide

    the

    services

    in

    question.

    PARTXII

    ProvisionofAerodromes,ControlofLandforAviationPurposesetc.

    38.Powerofministertoapprovetheestablishmentaerodromes

    (1)TheMinistermayapprovetheestablishmentanddevelopmentofaerodromesanywhereinNigeria.

    (2)Roads,approaches,apparatus,equipment,buildingsandotheraccommodationsinconnectionto

    suchaerodromesshallbemaintainedbytheownersinconformitywithrulesandregulationsmade

    underthisAct.

    39.Eligibilityforanaerodromelicense

    Alicenseforanaerodromeshallnotbegrantedtoanypersonotherthan

    (a)acitizenofNigeria;or

    (b)theFederalGovernment,aStateGovernment,aLocalGovernmentoranycompanyorcorporation

    ownedorcontrolledbyeitherofthesaidGovernments;or

    (c)acompanyoracorporationregisteredinNigeriaandhavingitsprincipalplaceofbusinessinNigeria.

    40.Dutyoftheauthoritytoconsiderenvironmentalfactorswhenlicensingaerodromes

    TheAuthorityinexercisingitsfunctionsinrelationtothelicensingofaerodromesshallhaveregardto

    theneedtominimizesofaraspracticableanyadverseeffectthepresenceofsuchaerodromesmay

    haveontheenvironment.

    41.Fixingbyreferencetonoisefactors,thechargesforusinglicensedaerodromes

    Withoutprejudicetoanypowerofanaerodromeoperatortoenterintoanagreementonsuchtermsas

    heoritthinksfit,anaerodromeoperatormayforthepurposeofencouragingtheuseofquieteraircraft

    andofdiminishinginconveniencefromaircraftnoise,fixhisoritschargesbyreference,amongother

    things,to

    any

    fact

    or

    matter

    relating

    to

    (a)theamountofnoise,vibrationoremissioncausedbytheaircraftinrespectofwhichthechargesare

    made;or

    (b)theextentornatureofanyinconvenienceresultingfromsuchnoise,vibrationoremission.

    42.Requirementsforapprovalofaerodromesecurityprogramme

    (1)Noaerodromeoperatorshallpermithisoritsaerodrometobeusedforoperationofairtransport

    serviceunlessheorithastheairportsecurityprogrammeapprovedbytheAuthority.

    (2)Theaerodromeoperator,hisoritsrepresentativesandservantstocomplywiththeprovisionsofthe

    approvedsecurityprogramme.

    (3)Everybreachoftheprovisionsoftheapprovedairportsecurityprogrammeshallattractafineofnot

    lessthanN200,000.00(twohundredthousandnaira),

    43.Requirementsforapprovalofairlinesecurityprogramme

    (1)Noairlineoperatorshalloperateairtransportserviceto,fromandwithinNigeriaunlesshehasa

    securityprogrammeapprovedbytheAuthority.

    (2)The

    airline

    operator,

    its

    representatives

    and

    servants

    shall

    comply

    with

    the

    provisions

    of

    the

    approvedsecurityprogramme.

    (3)Itshallbethedutyoftheairlineoperator,itsrepresentativesandservantstocomplywiththe

    provisionsoftheapprovedsecurityprogramme.

    (4)Everybreachoftheprovisionsoftheapprovedairlinesecurityprogrammeshallattractafineofnot

    lessthanN200,000.00(twohundredthousandnaira).

    44.Securitysurveys,audits,testandinspections

    TheAuthorityoranyotherpersonauthorisedbyitbygeneralorspecialorderinwritinginthisbehalf

    may

    (a)conductsurveysandinspectionsofsecuritymeasuresrelatingtopassengersandtheircabinbaggage,

    checkedbaggage,cargoandothergoods,accesscontrolsandaerodromedesign;

    (b)conductanexercisetochecktheprofessionalefficiencyofthosepersonnelresponsiblefor

    implementingtheaviationsecurityproceduresandalsototesttheadequacyofsecuritymeasuresat

    anyaerodromeinNigeria.

    45.Securitychecksofpersonsandbaggage

    (1)Everypersonenteringanaerodromeandeverypersonbeforeproceedingforboardinganaircraft

    andhishandbaggage,ifany,shallbeliabletobesearchedandshallpermittobesearchedbyan

    aviationsecurityofficeroranyotherpersonauthorizedinthatbehalfinwritingbytheMinister.

    (2)Baggageofeverypersonboardinganaircraftandallunaccompaniedbaggageshallbescreenedor

    subjectedtoprescribedsecuritycontrolbeforetheyareplacedonboardorcarriedonanaircraft.

    (3)Baggageofeverypersonboardinganaircraftandallunaccompaniedbaggageshallbescreenedor

    subjectedtoprescribedsecuritycontrolbeforetheyareplacedonboardorcarriedonanaircraft.

    (4)EverybreachoftheprovisionsofthisSectionshallattractafineofnotlessthanN50,000.00(fifty

    thousandnaira).

    46.Obstructionsnearaerodromes

    (1)IftheAuthorityissatisfied,withrespecttoanybuildingorstructureinthevicinityofanaerodrome

    towhichthissectionapplies,thatinordertoavoiddangertoaircraftflyinginthatvicinityindarknessor

    conditionsofpoorvisibility,provisionoughttobemade(whetherbylightingorotherwise)forgivingto

    suchaircraftwarningofthepresenceofthatbuildingorstructure,itmaybyorderdirect(subjecttoany

    conditionsspecifiedintheorder)theoperatoroftheaerodromeandanypersonactingunderthe

    operatorsinstructions

    (a)toexecute,install,maintain,operate,andasoccasionrequiresrepairandalter,suchworksand

    apparatusasmaybenecessaryforenablingsuchwarningtobegiveninthemannerspecifiedinthe

    order,and

    (b)sofarasmaybenecessaryforexercisingofthepowersconferredbytheorder,enteruponandpass

    over(withorwithoutvehicles)anysuchlandasmaybespecifiedintheorder:

    Providedthat,nosuchordershallbemadeinrelationtoanybuildingorstructureifitappearstothe

    Authoritythattherehavebeenmade,andarebeingcarriedout,satisfactoryarrangementsforthe

    givingofsuchwarning.

    (2)TheAuthorityshall,beforemakinganysuchordercausetobepublished,insuchmannerasitthinks

    bestforinformingpersonsconcerned,noticeoftheproposaltomaketheorderandoftheplacewhere

    copiesofthedraftordermaybeobtainedfreeofcharge,andtakeintoconsiderationany

    representationswithrespecttotheorderwhichmaywithinsuchperiodnotbeinglessthan14

    (Fourteen)daysafterthepublicationofthenoticeasmaybespecifiedtherein,bemadetoitbyany

    personappearingtoittohaveaninterestinanylandwhichwouldbeaffectedbytheorder,andatthe

    endofthatperiodtheordermaysubjecttotheprovisionsofthissection,bemadewithsuch

    (3)Everysuchordershallprovidethat

    (a)except

    inacase

    of

    emergency,

    no

    works

    shall

    be

    executed

    on

    any

    land

    inpursuance

    of

    the

    order

    unless,atleast14(fourteen)dayspreviously,theoperatoroftheaerodrometowhichtheorderrelates

    hasservedinthemannerspecifiedbytheorderontheoccupierofthatland,andoneveryotherperson

    knownbytheoperatortohaveaninterestintheland,awrittennoticecontainingsuchparticularsofthe

    natureoftheproposedworks,andthemannerinwhichandthetimeatwhichitisproposedtoexecute

    them,asmaybespecifiedbytheorder;

    (b)ifwithin14(fourteen)daysfromtheserviceofthesaidnoticeonanypersonhavingsuchaninterest,

    theoperatoroftheaerodromereceiveswrittenobjectiononthepartofthatpersontotheproposals

    containedinthenotice,then,exceptinsofarastheobjectioniswithdrawn,nostepsshallbetakenin

    pursuanceofthenoticewithoutthespecificauthorityoftheAuthority;and

    (c)theoperatoroftheaerodrometowhichtheorderrelatestopaytoanypersonhavinganinterestin

    anylandaffectedbytheorderadequatecompensationforanylossordamagewhichthatpersonmay

    sufferinconsequenceoftheorder;andforthepurposesofthissubsectionanyexpensereasonably

    incurredinconnectionwiththelawfulremovalofanyapparatusinstalledinpursuanceofsuchanorder,

    andsomuchofanyexpenseincurredinconnectionwiththerepair,alteration,demolitionorremovalof

    anybuilding,structureorerectiontowhichsuchanorderrelatesasisattributabletotheoperationof

    theorder,shallbedeemedtobelossordamagesufferedinconsequenceoftheorder.

    (4)Theownershipofanythingshallnotbetakentobeaffectedbyreasononthatitisplacedin,or

    affixedto,anylandinpursuanceofsuchanorder;and(subjecttotheprovisionsofthenextfollowingsubsection)solongasanysuchorderrespectofanaerodromeisinforce,nopersonshall,exceptwith

    theconsentoftheoperatoroftheaerodrome,willfullyinterferewithanyworksorthingswhich,tothe

    knowledgeofthatperson,areworksorthingsexecutedorplacedinonoroveranylandinpursuanceof

    theorder.

    (5)Anypersonwhocontravenestheprovisionofsubsection(4)ofthissection,commitsanoffenceand

    isliableonconvictiontoimprisonmentforatermnotlessthan6monthsorafinenotlessthan

    N100,000.00orboth;andanypersonwhowillfullyobstructsapersonintheexerciseofanyofthe

    powersconferredbysuchanordercommitsanoffenceandisliableonconvictiontoimprisonmentfora

    termnot

    theFederationresponsiblefordefence,or

    (ii) anypremiseswhich,inpursuanceofregulationsmadeundersection30ofthisActare

    forthetimebeinglicensedasanaerodrome,and

    (b) theexpressionoperatoroftheaerodromemeans

    47.TrespassonLicensedAerodromesetc

    (1)Subjecttosubsection(2)ofthissection,anypersonwhotrespassesonanylandformingpartofan

    aerodrome,oruponwhichnavigationalaidsoranyancillaryfacilityissituatedcommitsanoffenceandis

    liableonconviction,toimprisonmentforatermnotlessthan1monthorafineofnotlessthan

    N100,000.00orboth.

    (2)No

    person

    shall

    be

    liable

    under

    this

    section.

    unless

    itisproved

    that

    at

    the

    material

    time,

    notices

    warningtrespassersoftheirliabilityunderthissectionwereposted,soastobereadilyseenandreadby

    48.CarriersLiability

    (1)TheprovisionscontainedintheConventionfortheUnificationofcertainrulesrelatingto

    InternationalCarriagebyAirsignedatMontrealon28thMay,1999setoutintheSecondScheduleof

    thisActandasAmendedfromtimetotune,shallfromthecommencementofthisActhaveforceoflaw

    andapplytointernationalcarriagebyairtoandfromNigeria,inrelationtoanycarriagebyairtowhich

    thoserulesapplyirrespectiveofthenationalityoftheaircraftperformingthecarriage,andshall,subject

    totheprovisionsofthisAct,governtherightsandliabilitiesofcarriers,passengers,consignors,

    consigneesandotherpersons.

    (3)Inanycaseofaircraftaccidentresultingindeathorinjuryofpassengersthecarriershallmake

    advancepaymentsofatleastUS$30,000.00(thirtythousandUnitedStatesDollars)within30(thirty)

    daysfromthedateofsuchaccidenttothenaturalpersonorsuchnaturalpersonswhoareentitledto

    claimcompensationinordertomeettheimmediateeconomicneedsofsuchpersonsandsuchadvance

    paymentsshallnotconstituterecognitionofliabilityandmaybeoffsetagainstanyamounts

    subsequentlypaidasdamagesbythecarrier.

    49.Actionintrespass,nuisanceanddamagefromAircraft

    (1)Noactionshalllieinrespectoftrespassornuisancebyreasononlyoftheflightofanaircraftover

    anypropertyataheightabovethegroundwhich,havingregardtowind,weatherandallthe

    circumstancesofthecaseasreasonable,ortheordinaryincidentsofsuchflight,solongastheflight

    oversuchpropertydulycomplieswithanyregulationsinforcemadeinrespectthereto.

    (2)Whereinjury,lossordamageiscausedtoanypersonorpropertyonlandorwaterbyanarticleora

    personinorfallingfromanaircraftwhileinflight,takingofforlanding,then,withoutprejudicetothe

    lawrelatingtocontributorynegligencedamagesinrespectoftheinjury,lossordamageshallbe

    recoverablewithoutproofofnegligenceorintentionoranyothercauseofaction,asiftheinjury,lossor

    damagehadbeencausedbythewillfulact,neglectordefaultoftheowneroftheaircraft:

    Providedthatwheretheinjury,lossordamageiscausedincircumstancesinwhich

    (a)damagesarerecoverablefromtheownerinrespectoftheinjury,lossordamagebyvirtueonlyof

    theforegoingprovisionsofthissubsection;and

    (b)alegalliabilityexistsinsomepersonotherthantheownertopaydamagesinrespectoftheinjury,

    lossordamage,

    theownershallbeentitledtobeindemnifiedbythatotherpersonagainstanyclaiminrespectofthe

    saidinjury,lossordamage.

    (3)Whereanyaircrafthasbeenbonafidedemised,letorhirednottoanypersonbytheownerthereof

    andnopilot,commander,navigatororoperativememberofthecrewoftheaircraftisinthe

    employmentoftheowner,thissectionshallhaveeffectasthoughreferencestotheownerherewere

    substitutedforreferencestothepersontowhomtheaircrafthasbeensodemised,letorhiredout.

    50.ApplicationtoAircraftoflawofwreckandsalvage

    (1)Anyservicesrenderedinassisting,orinsavinglifefrom,orinsavingthecargoorapparelof,an

    aircraftin,onorovertheseaoranytidalwater,oronorovertheshoresoftheseaoranytidalwater,

    shallbedeemedtobesalvageservicesinallcasesinwhichtheywouldhavebeensalvageserviceifthey

    hadbeenrenderedinrelationtoavessel.

    (2)Wheresalvageservicesarerenderedbyanaircrafttoanypropertyorperson,theownerofthe

    aircraftshallbeentitledtothesamerewardforthoseservicesashewouldhavebeenentitledtoifthe

    aircrafthadbeenavessel.

    (3)Theprovisionsofsubsections(1)and(2)ofthissectionshallhaveeffect,notwithstandingthatthe

    aircraftconcernedisaforeignaircraftandthattheservicesinquestionarerenderedelsewherethan

    withinthe

    limit

    of

    the

    territorial

    waters

    of

    Nigeria.

    (4)TheMinistermaybyregulationsdirectthatanyprovisionsofanylawforthetimebeinginforcein

    Nigeriawhichrelatetowreck,tosalvageoflifeorpropertyortothedutyofrenderingassistanceto

    vesselsindistressshall,withsuchmodificationsandexceptions(ifany)asmaybeprescribed,applyin

    relationtoaircraftasthoseprovisionsapplyinrelationtovessels.

    (5)Forthepurposesofthissection,anyprovisionsofanylawinforceinNigeria,whichrelatetovessels

    laidby,orneglectedasunfitforseaserviceshallbedeemedtobeprovisionsrelatingtowreck.

    51.Patentclaims

    (1)AnylawfulentryintoNigeriaoranylawfultransitacrossNigeria,withorwithoutlandings,ofan

    aircrafttowhichthissubsectionapplies,shallnot,entailanyseizureordetentionoftheaircraftorany

    proceedingsagainsttheowneroroperatoroftheaircraftoranyotherinterferencewiththeaircraftby

    oronbehalfofanypersoninNigeriaonthegroundthattheconstruction,mechanism,parts,

    accessories,oroperationoftheaircraftisaninfringementofanypatent,designormodel.

    (2)TheimportationintoandstorageinNigeriaofsparepartsandspareequipmentforanaircraftto

    whichthissubsectionappliesandtheuseandinstallationthereofintherepairofsuchanaircraft,shall

    not,entailanyseizureordetentionoftheaircraftorofthesparepartsorspareequipmentorany

    proceedingsagainsttheowneroroperatoroftheaircraftortheownerofthesparepartsorspare

    equipmentoranyotherinterferencewiththeaircraftbyoronbehalfofanypersoninNigeria,onthe

    groundthatthesparepartsorspareequipmentortheirinstallationareorisaninfringementofany

    patent,designormodel:

    Providedthat,thissubsectionshallnotapplyinrelationtoanysparepartsorspareequipmentwhich

    aresoldordistributedinNigeriaorareexportedfromNigeriaforsaleordistribution.

    (3)Subsections(1)and(2)ofthissectionappliesto

    (a)anyaircraft(otherthananaircraftusedinmilitary,customsorpoliceservices)registeredinacountry

    orterritoryinthecaseofwhichthereisforthetimebeinginforceadeclarationmadebytheMinister

    with,aviewtothefulfilmentoftherelevantprovisionsoftheConventionmentionedinsection30(1)

    (a)of

    this

    Act,

    that

    the

    benefits

    of

    those

    subsections

    extend

    to

    that

    country

    or

    territory;

    and

    (b)suchotheraircraftastheMinistermaybyorderspecify.

    52.Infringementofpatent

    (1)Whereitisallegedbyanyinterestedpersonthataforeignaircraftwhichisnotanaircrafttowhich

    section51(1)ofthisActappliesandwhichismakingapassagethroughoroverNigeria,infringesinitself

    orpartofitanyinvention,designormodelwhichisentitledtoprotectioninNigeria,subjecttoandin

    accordancewithanyordermadebytheMinister,itshallbedetaineduntiltheownerofitdepositsor

    securesinrespectoftheallegedinfringementasum(hereafterinthissectionreferredtoasthe

    depositedsum);

    and

    thereupon

    the

    aircraft

    shall

    not,

    during

    the

    continuance

    of

    the

    passage,

    be

    subject

    toanylien,arrest,detentionorprohibition,whetherbyorderofacourtorotherwise,onaccountofthe

    allegedinfringement.

    (2)Thedepositedsumshallbesuchsumasmaybeagreedbetweenthepartiesinterestedor,indefault

    ofagreement,asmaybefixedbytheMinister;andthepaymentofthedepositedsumshallbemadeor

    securedtotheMinisterinsuchmannerasmaybespecifiedbyordersmadebytheMinister.

    (3)Thedepositedsumshallbedealtwithbysuchtribunalandinaccordancewithsuchprocedureas

    maybeprescribedbyordersmadebytheMinister,andtheordersmayprovidegenerallyforcarrying

    theprovisionsofsubsections(1)and(2)ofthissectionintoeffect.

    (4)Forthepurposesofsubsection(1)ofthissection,theexpressionownershallincludetheactual

    ownerofanaircraftandanypersonclaimingthroughorunderhim,andtheexpressionpassageshall

    includeallreasonablelandingsandstoppagesinthecourseofthepassage.

    53.Detentionofaircraft

    Anyregulation,ruleorordermadeunderorinpursuanceofthisActinrelationtoaircraftmay,provide

    forthedetentionofaircrafttosecurecompliancewiththeregulation,ruleororderandmaymakesuch

    furtherprovisionsasappearnecessaryorexpedientforsecuringthedetention.

    Offences

    54.Offences

    (1)AnyactdonebyanypersononaNigerianaircraftoutsideNigeriawhich,ifithadbeendonebyhimin

    anypartofNigeriawouldhaveconstitutedanoffenceunderthelawinforceinthatpartshall,forthe

    purposesofanycriminalproceedingsinthatpartofNigeriaagainstthatpersoninrespectofthatact,be

    deemedtohavebeendonebyhiminthatpartofNigeria.

    (2)ExceptwiththeconsentoftheAttorneyGeneraloftheFederation,noproceedingsshallbe

    institutedbyvirtueoftheforegoingsubsectionagainstanyperson.

    (3)WhereitisallegedthatanoffenceunderthisActorregulationsmadebyvirtueofthisActhasbeen

    committed,proceedingsinrespectoftheoffencemaybebroughtinanycourtinNigeria,whichwould

    havehadjurisdictioninthematterifthatoffencehadbeencommittedinthepartofNigeriaforwhich

    theCourtacts.

    55.Dangerousflying

    (1)Whereanaircraftisflowninsuchamannerastocausedangertoanypersonorpropertyinthe

    aircraft,onlandorwater,thepilotoranyotherpersoninchargeoftheaircraftandtheownerorany

    personhavingresponsibilityforsafenavigationoftheaircraftcommitsanoffenceandisliableon

    convictionto

    imprisonment

    56.HijackingandInterference

    (1)TheprovisionscontainedintheConventionfortheSuppressionoftheUnlawfulSeizureofAircrafts

    signedattheHagueonthe16thdayofDecember1970setoutintheFirstScheduletothisActandas

    amendedfromtimetotimeshallfromthecommencementofthisActhaveforceoflawinNigeria.

    (2)Whosoeveronboardanaircrafteitherongroundorinflightunlawfully,byforceorthreatofforce,

    orbyanyotherformofintimidation,seizesorexercisescontrolofthataircraft,commitsoffenceof

    section

    (4)Anypersonwhocommitstheoffenceofhijackingisliableonconvictiontoimprisonmentforlifeand

    alsotoafineofnotlessthanN10,000,000.00(tenmillionnaira).

    (5)Anypersonwhointhecourseofcommittingtheoffenceofhijackingofanaircraft,commits,in

    connectionwithsuchoffence,anyactofviolenceagainstanypassengerormemberofthecrewofsuch

    aircraft,isliabletothesamepunishmentwithwhichhewouldhavebeenliableunderanylawforthe

    timebeinginforceinNigeriaifsuchacthadbeencommittedinNigeria.

    (6)The

    Courts

    of

    the

    Federal

    Republic

    of

    Nigeria

    shall

    have

    jurisdiction

    to

    try

    offenders

    under

    this

    sectionwhere

    (a)theoffenceiscommittedonboardanaircraftregisteredinNigeria;

    (b)theaircraftonboardwhichtheoffenceiscommittedlandsinNigeriawiththeallegedoffenderstill

    onboard;

    (c)theoffenceiscommittedonboardanaircraftleasedwithoutcrewtoalesseewhohashisprincipal

    placeofbusinessinNigeriaorifhehasnoprincipalplaceofbusiness,hispermanentresidenceisin

    Nigeria;and

    (d)theoffenceiscommittedonboardanonNigerianregisteredAircraftwhilstsuchanaircraftiswithin

    theterritoryoftheFederalRepublicofNigeria.

    57. Offencesofendangeringsafety,destroyingordamagingofanAircraftinflight,etc.

    (1)Anypersonwhounlawfullyandintentionally

    (a)commitsanactofviolenceagainstapersononboardanaircraftinflightwhichislikelytoendanger

    thesafetyofsuchaircraft;or

    (b)communicatessuchinformationwhichheknowstobefalsesoastoendangerthesafetyofan

    aircraftinflight,

    commitsanoffenceandshallbeliableonconvictiontoimprisonmentfor5yearsorafineofnotless

    thanN2,000,000.00(twomillionnaira).

    (2)Anypersonwhounlawfullyandintentionally

    (a)destroysanaircraftinserviceorcausesdamagetosuchaircraftinsuchamannerastorenderit

    incapableofflightorwhichislikelytoendangeritssafetyinflight;or

    (b)placesorcausestobeplacedonanaircraftinservicebyanymeanswhatsoeveradeviceor

    substancewhichislikelytodestroythataircraftortocausedamagetoitwhichrendersitincapableofflightortocausedamagetoitwhichislikelytoendangeritssafetyinflight,

    commitsanoffenceandisliableonconvictiontoamaximumoflifeimprisonmentandhisassetsmay

    beconfiscatedortoboth.

    (3)Whoeverattemptstocommitorabetsthecommissionofanyoffenceundersubsection(1)or(2)of

    thissectionshallalsobedeemedtohavecommittedsuchoffenceandbeliableonconvictiontothe

    punishmentforsuchoffence.

    58.Prohibitionofunrulyandindecentconduct

    TheAuthoritymaybyregulationsprohibitcertainactswhichconstituteunrulyorindecentbehaviouron

    boardaircraftinoroverNigeriaandsuchregulationsmayincludeappropriatecriminalsanctions.

    59.Offencesataerodromes

    (1)Anypersonwho,atanyaerodrome,unlawfullyandintentionally,usesanydevice,substanceor

    weaponto

    (a)commitanactofviolencewhichcausesorislikelytocausegrievoushurtofanyperson,or

    (b)destroyorseriouslydamageanyaircraftorfacilityatanaerodromeordisruptanyserviceatthe

    aerodrome,

    commitsanoffenceandliableonconvictiontoimprisonmentforlifeortoafineofnotlessthan

    N10,000,000.00(tenmillionnaira).

    (2)Anypersonwhoattemptstocommit,orabetsthecommissionofanyoffenceundersubsection(1)of

    thissectionisalsodeemedtohavecommittedsuchoffenceandisliableonconvictiontothe

    punishmentprovidedforsuchoffence.

    60.Destructionof,ordamageto,airnavigationandotherfacilities

    (1)Any

    person

    who

    unlawfully

    and

    intentionally

    destroys

    or

    damages

    air

    navigation

    and

    meteorological

    facilitiesorinterfereswiththeiroperationinsuchamannerasislikelytoendangerthesafetyofaircraft

    inflightcommitsanoffenceandisliableonconvictiontoimprisonmentforatermofnotlessthan1

    (one)yearortoafineofnotlessthanN500,000(fivehundredthousandnaira)orboth.

    (2)Anypersonwhoattemptstocommit,orabetsthecommissionofanyoffenseundersubsection(1)of

    thissectionisalsodeemedtohavecommittedsuchoffenseandisliabletothepunishmentprovidedfor

    thatoffense.

    61.Dutiesofoperatorandpersonnel,etc.

    (1)Eachoperatorshallmakeorcausetobemade,suchinspection,maintenance,overhaul,and/orrepairofallequipmentusedincivilaviationandtoensurethattheoperationsconductedarein

    accordancewiththisActandtheregulations,bylaws,directivesandordersoftheDirectorGeneral

    issuedbythisAct.

    (2)Eachholderofanairoperatorcertificateshallensurethatthemaintenanceofaircraftand

    operationsofthatairoperatorareconductedinthepublicinterestandinaccordancewiththe

    requirementsofthisActandtheregulations,bylaws,directivesandordersissuedunderthisActbythe

    DirectorGeneral.

    (3)Eachholderofanairmancertificateshallobserveandcomplywiththeauthorityandlimitationsof

    thatcertificate,therequirementofthisActandtheregulations,bylaws,directivesandordersissued

    underthis

    Act.

    (4)Everypersonperformingdutiesincivilaviationshallobserveandcomplywiththerequirementsof

    thisActandtheorders,rules,regulationsandbylawsissuedunderthisActrelatingtotheirtasks.

    (5)Everypersonwhooffers,oracceptsshipmentofcargo,orbaggageforcivilairtransport,whether

    originatingorarrivingininternationalflightstoorfromNigeria,orforflightswithinNigeria,shallofferor

    acceptsuchshipmentofcargo,orbaggageinaccordancewiththeprovisionsofAnnex18totheChicago

    ConventionandtheICAOTechnicalInstructionsfortheSafeTransportofDangerousGoodsbyAirorany

    regulati
