What is Discrimination?

The act of distinguishing one

person or group of persons

from others, either

intentionally, by neglect,

or by the effect of actions

or lack of actions based on

their protected bases.

New Non-discrimination

Statement

“The U.S Department of Agriculture (USDA) prohibits discrimination against its customers,

employees, and applicants for employment on the bases of race, color, national origin, age,

disability, sex, gender identity, religion, reprisal, and where applicable, political beliefs, marital

status, familial or parental status, sexual orientation, of if all or part of an individual’s income is

derived from any public assistance program, or protected genetic information in employment or

in any program or activity conducted or funded by the Department. (Not all prohibited bases will

apply to all programs and/or employment activities.)

If you wish to file a Civil Rights program complaint of discrimination, complete the USDA Program

Discrimination Complaint Form, found online at www.ascr.usda.gov/complaint_filing_cust.html ,

or at any USDA office, or call (866) 632-9992 to request a form. You may also write a letter

containing all of the information requested in the form. Send your completed complaint form or

letter to us by mail at U.S Department of Agriculture, Director, Office of Adjudication, 1400

Independence Avenue, S.W., Washington, D.C 20250-9410, by fax (202) 690-7442 or email at

[email protected].

Individuals who are deaf, hard of hearing or have speech disabilities may contact USDA through the

Federal Relay Service at (800) 877-8339; or (800) 845-6136 (in Spanish).

• The non-discrimination statement has changed

• When notified, revisions will have to be made to

printed public material with revised statement

• “And Justice for All” posters with the new statement

have not been made available by the USDA; continue

to utilize current posters

Recognizing a Civil Rights

Discrimination Complaint

• Can be verbal or written

• Must be discrimination based on one or more

of the 6 protected classes

• Can be made to any volunteer or staff

member at the sub-distributor/agency, the

Recipient Agency/Food Bank, the Florida

Department of Agriculture, or USDA

Processing the Civil Rights

Complaint

• Immediately forward complaint

• RA notifies Bureau of Food Distribution

• Bureau notifies USDA

• State/Recipient Agency has 3 days to notify

USDA of complaint

• Complaint investigation and resolution will be

determined by the USDA

Procedures for Handling a

Civil Rights Complaint

• Listen to the person making the

complaint

• Practice good customer service

• Write it down using an

established form (form can be

found on TEFAP Manual)

• Immediately move complaint up

to person in charge

Formalize Your Civil Rights

• Update process when procedures

change (e.g., updated sample

Limited English Proficiency

(LEP)

• Individuals who do not speak English as their primary

language and who have a limited ability to read,

speak, write, or understand English

• Sub-distributors of TEFAP have a responsibility to

take reasonable steps to ensure meaningful access to

their programs and activities by persons with limited

English proficiency (LEP).

• Example – having a copy of the Certification of

Eligibility form available in the individual’s primary

language, such as Spanish, as provided by the Bureau

Factors to Consider in

Addressing LEP

• Number or proportion of LEP persons served

or encountered in the eligible population

• Frequency with which LEP individuals come

in contact with the program

• Nature and importance of the program,

activity, or service provided by the program

• Resources available to the recipient and costs

Civil Rights Training

All staff and volunteers at both the Recipient Agency/Food Bank as well as their sub-distributors should receive training on all aspects of civil rights compliance on an annual basis. Training should include:

• Effective public notification systems

• Complaint procedures

• Compliance review techniques

• Resolutions of non-compliance

• Requirements for reasonable accommodation of persons with disabilities

• Requirements for language assistance

• Conflict resolution

• Customer service

incorporated in all agreements

between the State Agency, Recipient

Agency, and all sub-distributors in

order to ensure that ALL households

have access to TEFAP commodities.
