    We are providing this statement of Continental Steel & Tube Companys C la ims Po l i c y to establish amutual agreement between our companies in advance of the transaction. We think your complete

    understanding of our C la ims Po l i c y now will avoid problems and misunderstandings in the future.Please demonstrate that you have carefully read, completely understand and agree with our C la imsPo l i c y stated below by signing and returning this form to us via FAX to (954) 332-2296. Your order iscurrently being held in abeyance and cannot be processed pending our receipt of an executed copy of

    this form by one of your authorized corporate signatories.

    1.) NOTIFICATION: You are required to submit a notification of claim to us within thirty (30) daysfrom the date of the delivery. Notifications after 30 days will NOT be honored. At the time of

    notification, you will receive a Return Materials Number (RMA.) You must reference the RMA

    on all correspondence related to your claim. No claims will be discussed or honored without

    this number. Debits or deduction from your remittances will NOT be honored unless they have

    been authorized by a member of Continentals Senior Management Team.

    2.) TRACEABILITY: Claimant must provide Continental Steel & Tube Companys original tagnumber before the claim can be processed.

    3.) Claimed material must be surrendered to Continental IN ITS ORIGINAL FORM ONLY. Thebuyer relinquishes his or her right to a claim if the materials original form has been altered IN

    ANY WAY. Please note, Continental Steel & Tube Company does NOT guarantee any materialas suitable for a specific part or application. Continental sells metals ONLY on the basis of

    chemical composition, surface hardness as measured by Rockwell and ductility as measured by

    Olsen.

    4.) CHARGES: The buyer must solicit and receive approval from Continental to recover any costsbeyond the cost of material/s and freight.

    5.) SAMPLES: Except for claims involving dimensional discrepancies or weight shortages, thesubmission of all claims MUST be accompanied by a SAMPLE or a PHOTOGRAPH that clearly

    shows the reason for rejection.

    6.) RUST: Claims submitted for rust will only be accepted within ten (10) days from the date ofthe shipment. Claims for WET or DAMP material must be submitted to Continental within two

    (2) days from the date of shipment and must be accompanied by a signed Carriers Receipt that

    indicates that the material was wet upon arrival.

    7.) WEIGHT DISCREPANCIES: When material is sold on an actual weight basis, Continental willNOT honor claims for discrepancies of less than one (1) percent of Continentals reported

    weight. Weight discrepancy claims for amounts greater than one (1) percent of Continentals

    reported weight will be considered on an individual basis. To be considered, these claims must

    be fully supported by printed, certified scale tickets or an original copy of a light/heavy scale

    ticket from a certified public scale.

    8.) REMOVAL OF MATERIAL: If properly and safely prepared for transport, Continental willremove approved rejected material within two (2) weeks from the date your company obtains

    an RMA claim number from Continental. Continental reserves the right to refuse removal if the

    rejected material is improperly and/or unsafely prepared for transport.

    9.) DISPUTE RESOLUTION/GOVERNING LAW: Continental and its customers hereby agree thatany and all disputes between Continental Steel & Tube Company and its customers shall be

    adjudicated in the County of Broward in the State of Florida in accordance with federal laws

    and the laws of the State of Florida. At the conclusion of any/all litigation, Continental and its

    customers agree that the prevailing party shall be entitled to full recovery of any/all attorneys

    fees and court costs incurred during the tenure of the legal proceeding. Continental and its

    customers further agree that any/all legal action undertaken by Continentals customers must

    be filed within one (1) year from the date of the customers claim. Continental and

    Continentals customers agree that any/all legal action initiated after one (1) year from the

    date of the customers claim will be barred nothwithstanding any statuatory limitations to the

    contrary.

    An authorized signatory from your company can demonstrate your companys COMPLETE agreement to

    comply with the formalities contained within this OFFICIAL Claims Policy by signing below and

    returning this agreement to us by fax (954-332-2296) or email ([email protected].)
