Petition of New England Power Company for permission to construct overhead transmission line and Joint Petition of New England Power Company and Massachusetts Electric Company for exemption
from the Zoning Bylaws of the Town of Westborough
Notice is hereby given that on January 13, 2012, New England Power Company d/b/a National Grid (“NEP”) fi led with the Department of Public Utilities (“Department”), pursuant to G.L. c. 164, § 72, a peti-tion seeking approval to construct and operate an overhead 115 kilovolt (“kV”) electric transmission line within an existing cleared corridor upon land owned in fee by NEP in the Town of Westborough; on the same day, NEP and the Massachusetts Electric Company (“MEC”; NEP and MEC are hereinafter col-lectively referred to as the “Companies”) fi led a petition pursuant to G.L. c. 40A, § 3, seeking individual and comprehensive exemptions from the Zoning Bylaws of Westborough for the Project (hereinafter collectively referred to as the “Petitions”) in connection with the construction of such a transmission
line and associated substation expansion. The Department will conduct a public hearing on the
Petitions at Room 23, Forbes Municipal Building, 45 West Main Street, Westborough, Massachusetts, on February 28, 2012, at 7 pm to receive
public comment and questions about the Companies’ proposal.NEP proposes to construct a new overhead transmission line within an existing cleared corridor upon land owned in fee by NEP and on which NEP currently operates and maintains one 115 kV transmission line on single-circuit wood poles. The proposed line will extend for 0.3 miles from the East Main Street No. 314 Substation, located at 188 East Main Street in Westborough, Massachusetts, to an intersection point at Structures 165 and 166 within a separate existing right-of-way that contains NEP’s E-157 trans-mission line. The proposed transmission line will be constructed on a single set of poles, consisting of four wood poles and one steel pole ranging from 65-80 feet above grade. The proposed substation expansion will occur at the East Main Street No. 314 Substation and consist of an expansion of the sub-
station fence and the installation of new equipment owned by the Companies. Electronic copies of the Petitions are available on the DPU Website, www.mass.gov/dpu. Hard-copy Petitions are available for public inspection during normal business hours, and starting no less than
fourteen (14) days before the public hearing, at the following locations: • The Department of Public Utilities, One South Station, 5th Floor, Boston, Massachusetts 02110;
• The Westborough Public Library, 55 West Main Street, Westborough, Massachusetts 01581; • The Westborough Town Clerk’s offi ce, 34 West Main Street, Westborough, Massachusetts 01581;
• The Companies’ offi ces at 40 Sylvan Road, Waltham, Massachusetts 02451.Any person who desires to submit written comments on the Petitions may do so by fi ling an original and fi ve (5) copies of such comments no later than the close of business (5:00 p.m.) on March 6, 2012, with Mark D. Marini, Secretary, Department of Public Utilities, One South Station, 5th Floor, Boston, MA 02110. Any person who desires to participate in the evidentiary phase of this proceeding must fi le a written petition to intervene or to participate in the proceeding with Mark D. Marini, Secretary, Department of Public Utilities, One South Station, 5th Floor, Boston, MA 02110 no later than the close of business (5:00 p.m.) on March 6, 2012. A petition to intervene must satisfy the timing and substantive requirements of 220 C.M.R. § 1.03(1). Receipt by the Department – not mailing or postmark – constitutes fi ling and determines whether a petition has been timely fi led. A petition fi led late may be disallowed as untimely unless good cause is shown for waiver pursuant to 220 CMR § 1.01(4). To be allowed, a petition fi led
pursuant to 220 CMR 1.03(1) must satisfy the standing requirements of G.L. c. 30A, § 10. A copy of any petition to intervene and any written comments also must be served upon counsel for the Company: Bess B. Gorman, Esq.; Mark R. Rielly, Esq., and Christopher J. Novak, Esq., at National Grid,
40 Sylvan Road, Waltham, MA 02451. A petition to intervene also should be submitted to the Department in electronic format using one of the following methods: (1) by e-mail attachment to dpu.efi [email protected] and to the Hearing Offi cer [email protected] ; or (2) on a CD-ROM. The text of the email or the CD-ROM label must specify: (1) the docket numbers of proceeding (D.P.U. 12-02); (2) name of the person or company submitting the fi ling; and (3) a brief descriptive title of the document. The electronic fi ling should also include the name, title and telephone number of a person to contact in the event of questions about the fi ling. Text responses should be written in Microsoft Word (naming the document with a “.doc” suffi x) or as an Adobe PDF fi le (version 7 or higher) (naming the document with a “.pdf” suffi x). Data or spread-sheet responses should be compatible with Microsoft Excel (version 2000). The Department strongly encourages fi lers to avoid submitting scanned fi les but will accept them for posting when an alterna-tive version does not exist in electronic format. In addition, if NEP or any other entity has already fi led a document relevant to this proceeding, such as the initial petition, application, or fi ling without provid-ing an electronic copy of that document, such entity is directed to do so in compliance with the above electronic fi ling requirements as soon as possible. All written pleadings or comments submitted in
electronic format will be posted on the Department’s Website, http://www.mass.gov/dpu. Any person desiring further information regarding this Notice, including
information regarding intervention or participation in the adjudicatory proceeding, may contact the Hearing Offi cer at the address or telephone number below:
