NOTICE OF PROPOSED AGENCY ACTION
The Florida Department of Environmental Protec-tion (FDEP) gives notice that it proposes to approve a No Further Action Proposal with an Institutional Control and a Site Rehabilitation Completion Order with Conditions for a contami-nated site. The Utility Board of the City of Key West, Florida d/b/a Keys Energy Services, is seeking this order in reference to FDEP Project Number COM_303264, which encompasses the property located at 1001 James Street (101-111 Geraldine Street), Key West, Monroe County, FL, and intends to restrict exposure to contamination through the implementation of an Institutional Control, to restrict groundwater use, and recordation of a restrictive covenant to ensure the preservation of the restrictions. Complete copies of the No Further Action Proposal, the draft restrictive covenant, and the FDEP’s preliminary evaluation are available for public inspection during normal business hours from 8:00 a.m. to 5:00 p.m. Monday through Friday, except legal holidays at FDEP, South District, 2295 Victoria Avenue, Suite 364, Fort Myers, Florida 33901.
