Comme espéré, l’année 2013 a connu un début de redressementdes activités maritimes grâce à une reprise économique encoreprudente, au niveau mondial, beaucoup de pays ayant réussi àstopper la crise et même à renverser la tendance.
Ceci a profité à quasiment l’ensemble des armements qui commen-cent, après plusieurs années difficiles, à voir le bout du tunnel malgré,une fois de plus, une baisse des taux de fret (– 3 %). Ceci apu s’opérer grâce à des applications stratégiques d’économiesimportantes au niveau opérationnel, organisationnel et navigation.La capacité de l’offre de transport en 2013 a augmenté de 978 000teus net (+ 5%) et l’offre de transport pour l’année 2014 augmenterade 1 200 000 teus (+5,5%) avec la livraison d’approximativement105 navires VLCS (very large container ships de 7 500à 19 000 teus).En ce qui concerne les ports français, ils ont continué à prendre desparts de marché au niveau européen et l’ensemble des ports aaffiché une augmentation de leurs trafics.Les travaux dans les ports de Marseille/Fos et Le Havre sont presqueterminés et permettent d’offrir des infrastructures et des espaces degrande qualité à leurs clients. Le seul point noir est, et reste, pourl‘instant, l’insuffisance des moyens au niveau du pré et post transport,au niveau ferroviaire et fluvial et il convient de donner une prioritéabsolue et rapide à leur développement afin d’être capable de gérerles flux futurs.Les autres ports ont tous commencé des travaux importants : prolon-gements des quais, amélioration de tirant d’eaux, augmentation dessurfaces, qui leur permettrons de tenir, voire de renforçer leur position.Nous constatons également une amélioration importante au niveau del’organisation administrative dans nos ports avec des développementsde logiciels par IMG et SOGET en étroite collaboration avec lesDouanes Françaises et l’ensemble des acteurs maritimes et terrestres.Une fois de plus, on peut constater que notre monde de transportévolue à une vitesse ”grandV” et qu’il nous appartient d’être très attentifs.Avec la livraison de très grands navires dont 62 de taille entre14 000 et 19 000 teus, les rapprochements opérationnels entreplusieurs groupes d’armateurs, les développements rapides dans nosports, l’évolution de moyens inland et administratifs nous obligeront àêtre très présents et performants. Notre syndicat continuera à suivrede très près cette évolution.En 2013 nous avons créé ensemble avec la FACAM une nouvelleentité l’AMCF -– Agents Maritimes et Consignataires de France –et ensemble nous avons réussi à faire avancer plusieurs dossiersimportants que nous comptons finaliser cette année.Nous continuons également d’intensifier des contacts avec l’ensemblede nos partenaires dans le métier de transport afin de trouver lesbonnes solutions qui doivent nous permettre d’avancer de manièreefficace et rapide et nous vous remercions de votre soutien dans nosdémarches.

We have seen that 2013, as hoped, has shown a slight increasein maritime activity thanks to a cautious worlwide economicupturn; many countries having succeeded in stopping the crisisand reversing the tendency towards a certain recovery.
This situation has benefited all Shipping Companies after severaldifficult years and the end of the tunnel seems to be in sight,despite yet another decrease in freight rates ( – 3%). This has beenmade possible largely thanks to some major strategic economydrives on the operational, organizational and navigational fronts.
The net transport capacity in 2013 went up by 978.000 teus(+ 5%) and 2014 will see a growth of some 1.200.000 teus(+ 5,5%), due to the delivery of approximately 105 VLCS (verylarge container ships, of between 7.500 and 19.000 teus).
As far as French ports are concerned, market share has increasedand all have experienced increased volumes. In Marseille/Fos andLe Havre, major works are nearing completion offering high qualityinfrastructures and space to their clients. The only stumblingblock is and remains, that of insufficient means of pre and posttransport, be it by rail or water. Top priority must be given foran efficient and rapid development in this area to better handlefuture volumes.
The other ports have all begun major works, lengthening quays,improving draft capacity and expanding space in order tomaintain, or increase their competitiveness.
We have noticed a marked improvement too in the administrativeorganization of our ports with software developments made byIMG and SOGET in close collaboration with French Customs aswell as with the entire Maritime and Land transport community.
Once again we realize that our world of transport is in constantand rapide evolution and it is up to all of us to be extremelyvigilant and attentive to these changes.
With the delivery of these new huge vessels, 62 of which are of14.000 to 19.000 teus capacity, the operational merging of severalShip Owner groups, the fast development in our ports, coupledwith ongoing inland transport developments, all means that wewill have to be both present and proactive; most certainly ourorganization will be following all these changes very closely.
Together in 2013 we created alongside the FACAM – AgentsMaritimes et Consignataires de France – whose collaborationhas resulted in significant headway in certain important caseswhich we are certain will be brought to fruition this year.
We continue to strengthen contacts with all our partners in theworld of transport generally, in order to find solutions allowingus all to move forward quickly in y-the most efficient way, andfor this, we would like to thank you for your continued support.

DEFINITION DE L’AGENT MARITIME
L’Agent Maritime est un prestataire de servicesqui agit comme mandataire pour son Principal(c’est-à-dire pour le transporteur maritime delignes régulières) dont il détient tout pouvoir
pour négocier les contrats de transport, coter,recruter, et encaisser éventuellement les frets,émettre et signer les connaissements correspon-dants, assurer la gestion des conteneurs etnégocier éventuellement tout contrat relatif auxopérations annexes.
Article 2
OBJET DU SYNDICAT
1. L’étude et la défense des intérêts généraux del’ensemble de ses membres et de la Profession,
2. L’harmonisation des rapports et le resserre-ment des liens de confraternité qui doivent existerentre les membres des diverses branches del’activité commerciale qu’ils représentent,
3. L’essor de la profession et la sécurité des opé-rations commerciales,
4. La création, l’organisation et le fonctionne-ment de tout service d’intérêt professionnel ousocial,
et généralement d’exercer tous les droits et pré-rogatives prévus par la loi.
A cet effet, le Syndicat se constitue en manda-taire permanent de ses membres auprès desPouvoirs Publics, des entités publiques ou pri-vées et des Organisations professionnelles. Ilexamine, soit à la requête de ceux-ci, soit de sapropre initiative, toutes les dispositions d’ordrelégislatif et réglementaire intéressant la profes-sion et toutes mesures d’ordre administratif,financier, économique, environnemental etsocial conformes à son objet en vue de participerà leur réalisation.

OBLIGATIONS DE L’AGENT MARITIME
L’Agent Maritime doit :
1. S’acquitter de façon constante de ses obliga-tions envers son ou ses commettants avec honnê-teté, intégrité, impartialité et fidélité.
2. Respecter une norme de compétence afin de
fournir d’une manière consciencieuse, diligenteet efficace, toutes les prestations qu’il s’engage àfournir en sa qualité d’Agent Maritime.
3. Respecter toutes les lois et autres réglemen-tations nationales ayant trait aux obligations qu’ilcontracte.
4. Exercer les soins attentifs et raisonnablespropres à se garder des pratiques frauduleuses.

Each INCOTERM refers to a type of agreement for the purchase andshipping of goods internationnally. Threre are 11 different terms,each of which helps users deal with different situations involving themovement of goods. For example, the term FCA is often used withshipments involving Ro/Ro to container transport; DAP assists withsituations found in intermodal or courier service-based shipments.INCOTERMS also deal with documentation required for globaltrade, specifying which parties are responsible for which documents.Determining the paperwork required to move a shipment is an importantjob, since requirements vary so much between countries. Two items,however, are standard: the commercial invoice and the packing list.INCOTERMS were created primarily for people inside the world ofglobal trade. Outsiders frequently find them difficult to understand.Seemingly common words such as “responsibility” and “delivery”have different meanings in global trade than they do in other situations.In global trade “delivery” refers to the seller fulfilling the obligation ofthe terms of sale or to completing a contractual obligation. “Deliverycan occur while the merchandise is on a vessel on the high seas andthe parties involved are thousands of miles from the goods. In the end,however, the terms wind up boiling down to a few basic specifics:Costs: who is responsible for the expenses involved in a shipmentat a given point a shipment’s journey?Control: who owns the goods at a given point in the journey?Liability: who is responsible for paying damage to goods at agiven point in a shipment’s transit?It is essential for shippers to know the exact status of their shipment interms of ownership and responsibility. It is also vital for sellers &buyers to arrange insuranceon their goods while the goods are intheir ”legal” possession. Lack of insurance can result in wasted time,lawsuits and broken relationships.INCOTERMS are most frequently listed by category. Terms begin-ning with F refer to shipments where the seller does not pay for the pri-
mary cost of shipping. Terms beginning with C deal with shipmentswhere the sller pays for shipping.E-terms occur a seller’s reponsibilities are fulfilled when goods areready to depart from their facilities. D terms cover shipments where theshipper/seller’s responsiblity ends when the goods arrive as some specificpoint. Because shipments are moving into a country. D terms usuallyinvolve the services of a customs broker and a freight forwarder. Inaddition, D terms also deal with the pier or docking charges found atvirtually all ports and determining who is responsible for each charge.EExx--WWoorrkkssThe shipment arrangement allows the seller to deliver (without loading)the goods at the disposal of the buyer at the seller’s premises. It placesminimum obligation on the seller with greater responsibility on thebuyer. In an Ex-Works transaction, goods are basically made availablefor pickup at the shipper/seller’s works factory or warehouse and “deli-very” is accomplished when the merchandise is released to theconsignee’s freight forwarder for insurance, exports clearance andhandling all other paperwork.FOB (Free On Boad)The shipper/seller used his freight forwarder to move the merchandiseto the port or designated point of origin. FOB specifically refers toocean or inland waterway transportation of goods. Risk passes tobuyer, including payment of all transportation and insurance costs,once delivered on board the ship by the seller. Delivery is accopli-shed at this time. A further step than FAS.FCA (Free Carrier)The seller is responsible for arranging the transportation and possiblyalso for clearing the goods for export but the seller is acting at the riskand expense of the buyer. Where in FOB the freight forwarder orcarrier is the choisce of the buyer, in FCA the seller chooses andworks with the freight forwarder or carrier. “Delivery ” is accompli-shed at a predetermined port for destination point and the buyer isresponsible for insurance cover.

One is dealing with the actual cost of the merchandise“C” and the other “F” refers to the freight charges to a predetermineddestination point. It is the shipper/seller’s responsibility to get goodsfrom their door to the port of destination. “Delivery” is accomplishedat this time. Risk passes to the buyer once the goods are on boardthe vessel for insurance cover from the port of origin of shipment to thebuyer’s door. Given that the shipper is responsible for transportation,the shipper also usually chooses the forwarder.CIF (Cost, Insurance and Freight)This arrangement is similar to CFR, but instead of the buyer insuringthe goods for the maritime phase of the voyage, the shipper/sellerdoes so. In this arrangement, the seller usually chooses the forwarder.“Delivery” is accompllished at the port of destination.CPT (Carriage Paid To)In CPT transactions, the shipper/seller has the same obligations foundin CIF where the seller has to buy cargo insurance cover naming thebuyer as the insured while the goods are in transit.
CIP (Carriage and Insurance Paid To)This term is primarily used for multimodal transport. Because it relies onthe carrier’s insurance, the shipper/seller is only required to purchaseminimum insurance cover. When required by the buyer, the seller shallprovide additional insurance cover at the buyer’s expense. When thisagreement is in force, freight forwarders often act in effect as carriers.DAP (Delivered At Place)The goods are considered to be delivered once it is placed at the disposalof the buyer on the arriving means of transport ready for unloading at hedestination. The seller bears all risks involved in bringing the goods tothe buyer’s named place. Seller clears goods for export, not import DAPreplaces DAF, DDU.DAT (Delivered At Terminal)The seller delivers goods (unloaded) from the delivering ship or othermode of transport and places same at the disposal of the buyer at thenominated terminal or place of destination such as a quay, ware-house or container yard. The seller bears all rtisks involved in thebringing of the goods and unloading them at the terminal.Demurrage or detention charges may apply to the seller. Seller clearsgoods for export, not import. DAT replaces DEQ, DES.DDP (Delivered Duty Paid)DDP terms end to be used in intermodal or courier-type shipmentswhereby the shipper/seller is responsible for dealing with all tasksinvolved in moving the goods from the manufacturing plant to thebuyer/cosignee’s door.
