1. Purpose The Credit Card Accountability, Responsibility and Disclosure Act (“CARD Act”) requires the

Consumer Financial Protection Bureau (“CFPB”) to submit to the Congress, and to make

available to the public, an annual report that lists information submitted to the Bureau

concerning agreements between credit card issuers and institutions of higher education

(“institutions”) or certain affiliated organizations (“college credit card agreements” or

“agreements”).a Affiliated organizations include fraternities, sororities, alumni associations, or

foundations affiliated with or related to an institution of higher education. As this report

demonstrates, the majority of college credit card agreements are between issuers and affiliated

organizations.

This is the fourth annual report pursuant to this provision of the CARD Act. The first two

reports were submitted by the Federal Reserve Board. Pursuant to Title X of the Dodd-Frank

Wall Street Reform and Consumer Protection Act of 2010, responsibility for collecting and

submitting to the Congress annual reports regarding college credit card agreements transferred

from the Federal Reserve Board to the CFPB on July 21, 2011.

2. Introduction Title III of the CARD Act contains a number of provisions designed to provide protections to

younger consumers. For example, the Act restricts the marketing of credit cards to college

students on or near college campuses or at school-sponsored events by prohibiting the use of

gifts or any tangible items to induce students to apply for credit cards.b In addition, the Act

prohibits the marketing of preapproved offers to a consumer under the age of 21 without the

consumer’s consent.c The Act also prohibits credit card issuers from extending credit to

persons under age 21 without a written application demonstrating the consumer’s independent

ability to make payments or a cosigner age of 21 or over with the means to make payments.d

The Bureau’s recent report on the CARD Act addresses the effectiveness of these provisions in

protecting younger consumers.e

Section 305 of the CARD Act was intended to bring greater transparency to the college and

university credit card market. Specifically, credit card issuers are requiredf to submit to the

CFPB each year the terms and conditions of any college credit card agreement that was in effect

at any time during the preceding calendar year between the issuer and an institution of higher

education, an alumni organization, or a foundation affiliated with an institution of higher

education (an “affiliated organization”).g Issuers also are required to submit the following

information with respect to each agreement: (1) the number of credit card accounts covered by

the agreement (“college credit card accounts”) that were open at year-end (regardless of when

the account was opened); (2) the amount of payments made by the issuer to the institution or

organization during the year;h (3) the number of new college credit card accounts covered by

the agreement that were opened during the year; and 4) any Memorandum of Understanding

(MOU) between the issuer and institution or affiliated organization that directly or indirectly

relates to any aspect of the agreement.

Issuers were required to make their fourth annual submission by April 1, 2013. This

submission comprised college credit card agreements to which the issuer was a party during

2012 and information regarding payments and accounts as of December 31, 2012.

As part of its effort to achieve greater transparency, Congress directed the Bureau to issue a

report each year on the information and documents provided by card issuers, including the

number of new accounts opened pursuant to agreements between card issuers and colleges and

universities and the compensation paid by issuers to these institutions. This report is based on

the information and agreements submitted to the CFPB by credit card issuers. The report finds

a continuing decrease in the number of colleges and universities sponsoring credit card

programs, the number of new accounts being originated under such programs, and the

compensation paid to the institutions pursuant to these programs.

Because some agreements address the provision of other financial products (such as deposit

accounts) as well as credit cards, payments made by issuers under these agreements may not

relate solely to credit card accounts. In addition, some or all of the accounts opened pursuant

to these agreements may have been opened by individuals who are not students (such as

alumni, faculty, and staff of an institution of higher education). Furthermore, card issuers’

submissions do not include information regarding credit card accounts opened by students

independent of a college credit card agreement (such as when a student responds to an offer

made to the general public). The CFPB also notes that, because issuers were required to submit

all college credit card agreements to which they were a party at any time during 2012, issuers’

submissions may include agreements that terminated in 2012 or 2013 and therefore are no

longer in effect.

Information included in this report also is available on the Bureau’s public website at

www.consumerfinance.gov. In addition, under section 304 of the Credit CARD Act i and its

implementing regulations, 12 C.F.R. § 1026.57(b), an institution of higher education must

publicly disclose college credit card agreements between a card issuer and the institution.

3. Overview of college card agreements

As presented in Table 1, the CFPB received 617 college credit card agreements from 23 credit

card issuers for 2012. Between 2011 and 2012, the number of agreements, total of college credit

card accounts open at year-end, and payments by issuers during the year all declined. The

number of new college credit accounts opened during the year rose slightly in 2012 after falling

in 2010 and 2011. Only the number of issuers increased from 2009 to 2012; all other measures

declined over this period.

3.1.1 New issuers Both of the new issuers in the 2012 submission were credit unions, each of which submitted

agreements with affiliates of a local university – Wright-Patt Credit Union with the Wright

State University Alumni Association and Oregon Community Credit Union with the Alumni

Association of the University of Oregon and the Oregon State University Alumni Association.


MIT Credit Union is also included in this report for the first time. Its agreement with the MIT

Alumni Association was active in 2011, but it did not submit the information to the Bureau. The

MIT Alumni Association and the Wright State University Alumni Association each previously

had agreements with FIA Card Services, N.A. (“FIA”), a subsidiary of Bank of America

Corporation. These agreements were terminated in 2011 and 2012, respectively. The Alumni

Association of the University of Oregon and the Oregon State University Alumni Association

both additionally have agreements with Chase Bank USA, N.A. (“Chase”) that remain active as

of January 1, 2013.

3.1.2 Issuers consolidating reporting Capital One Bank USA, N.A. (“Capital One Bank”) is an affiliate of Capital One, N.A. (“Capital

One”). Both issuers submitted an agreement with the Keystone College Alumni Association in

2011. In 2012 the banks submitted combined information.

3.1.3 Issuers submitting the largest number of agreements As in 2009 through 2011, FIA submitted the most agreements. FIA submitted 412 agreements,

which was nearly 67% of all agreements submitted in 2012. Capital One and US Bank, N.A.

(“US Bank”) submitted the second and third most, respectively, with 55 and 48 agreements. US

Bank, which had the second highest number of agreements for the previous two years, moved

to third in 2012.

3.2 College card agreements As presented in Table 3, issuers submitted 617 college card agreements for 2012, a decrease of

179 agreements—approximately 23%—relative to 2011.

3.2.1 New agreements in 2012 While the total number of college card agreements declined from 2011 to 2012, issuers added

50 new agreements in 2012. Capital One entered into 24 new agreements in 2012, its second

year of rapid growth. UMB Bank, N.A. also experienced strong growth with 17 new agreements


in 2012. The remaining 9 new agreements were distributed roughly evenly across six issuing

institutions.

3.2.2 Agreements terminated in 2011 As Table 3 also shows, 228, or approximately 29 percent, of the 796 college card agreements in

effect during 2011 were terminated at or before year-end 2011, though some educational

institutions re-opened agreements with different issuers. A complete list of terminated

agreements is included in Appendix B of this report. The issuer with the largest number of

agreements terminated was FIA, with 221, or approximately 35 percent of FIA’s total

agreements in 2011, terminated. FIA’s total accounted for 97% of all agreements terminated in

2011.

Most of the agreements terminated in 2011 were associated with college credit card programs

with 5,000 or fewer open accounts. Five agreements with over 5,000 active accounts were

terminated in 2011: (1) Duke Alumni Association, Inc.; (2) Arizona State University Alumni

Association; (3) California State University Long Beach Alumni Association; (4) National

Dean’s List Graduate; and (5) University of Utah Alumni Association. Duke Alumni

Association’s agreement was with Chase, while the remaining four agreements were with FIA.

3.2.3 Terminated in 2012 As shown in Table 4, 202 of the agreements in effect during 2012 were terminated before

January 1, 2013.j The issuers with the largest number of terminated agreements in 2012 were

FIA, with 188 or approximately 45% of its agreements, and US Bank, with 8 or approximately

17% of its agreements. Though some terminations may have resulted in new agreements with

different issuers, we expect the total number of agreements in effect in 2013 to continue to

decline provided that the number of terminated agreements continues to strongly outpace the

number of new agreements being created. Three banks – Compass Bank, Barclays, and PNC

Bank – terminated all their existing agreements in 2012.

3.3 Institutions of higher education, affiliated organizations, and other organizations

As presented in Table 5, approximately 43 percent of college card agreements in effect in 2012

were between an issuer and an alumni association affiliated with an institution of higher

education. An additional 28 percent were between a credit card issuer and an institution of

higher education. Approximately 19 percent were between a credit card issuer and other

organization affiliated with an institution of higher education, just over 8 percent of

agreements in effect were between issuers and foundations, and less than 1 percent of

agreements were between an issuer and multiple organizations.k

The composition of reported affinity agreements has changed significantly since the 2010

year’s report, in which alumni associations constituted 36 percent of affinity agreements and

institutions of higher education constituted 37 percent. The growth in alumni associations’

share of affinity agreements at the expense of the share institutions of higher education is a

continuation of the trend presented in figure 1. Alumni associations have consistently

comprised a larger portion of affinity agreements in each year for which data is available,

passing institutions of higher education as the largest group of college affinity card agreements

in 2011 and continuing to grow in 2012. Universities and other institutions of higher education

have correspondingly comprised a smaller portion of affinity agreements in each year.

3.4 Open college credit card accounts As presented in Table 6, the total number of open college credit card accounts at year-end

declined from 2009 to 2012 by approximately 40 percent. While some issuers had increased

numbers of open accounts at year-end 2012, these increases were offset by larger declines

experienced by other issuers.

3.4.1 Largest numbers of open accounts at year-end Table 7 presents the 10 college card agreements with the largest number of open accounts as of

December 31, 2012. These 10 agreements represent approximately 24 percent of all open

college credit card accounts as of December 31, 2012.

The 7 agreements with the largest number of open accounts at year end 2012 (all issued by

FIA) were also the top 7 in 2011. FIA’s agreement with the University of Georgia Foundation

moved from having the eighth most open accounts in 2011 to the eleventh most open accounts

as of year-end 2012. Purdue Federal Credit Union’s agreement with the Purdue Alumni

Association moved from having the thirteenth most open accounts in 2011 to the eighth most

open accounts as of year-end 2012. As a result, FIA is no longer the only issuer with

agreements among the top 10 largest number of open accounts as of year-end 2012.

3.4.2 Payments by credit card issuers As presented in Table 8, the total amount of payments made by issuers to institutions and

organizations under college credit card agreements declined from 2009 to 2012 by

approximately 40 percent.

3.4.3 Largest payments by credit card issuers Table 9 presents the 10 college credit card agreements with the largest payments made by the

credit card issuer in 2012. These 10 agreements represent approximately 29 percent of all

payments made by issuers pursuant to college card agreements in 2012.

As table 9 shows, all ten of these agreements also were among the eleven agreements with the

largest payments in 2011. The University of Arizona Alumni Association, which had the sixth

highest issuer payments in 2011 with $1,323,944 paid by FIA, declined to 108th with $70,428 in

payments in 2012.

3.4.4 New college credit card accounts As presented in Table 10, the total number of new college credit card accounts opened by all

issuers declined by approximately 18 percent from 2009. Roughly equal numbers of issuers

increased and decreased their new account volume. Even so, larger gains at issuers opening

new accounts offset declining new accounts elsewhere leading the overall number of new

accounts to rise by 2,292 to 45,519 in 2012 from 2011.

3.4.5 Largest number of new accounts opened Table 11 presents the 10 college card agreements with the largest number of new college card

accounts opened in 2012. These 10 agreements represent approximately 39 percent of all new

college credit card accounts opened during 2012.

As table 11 shows, four of the ten agreements listed were also among the ten agreements with

most new accounts in 2011. Of the six agreements in the top ten for 2011 but not for 2012, only

one (FIA’s agreement with the University of Notre Dame with the eleventh most new accounts)

remained in the top twenty for 2012. The rest – Auburn Spirit Foundation, Georgia Tech

Alumni Association, Phi Theta Kappa International Honor Society, and the Association of

Graduates of the United States Air Force Academy – fell to 27th, 37th, 84th, and 34th,

respectively. Barclays Bank Delaware’s agreement with the Harvard Alumni Association, which

ranked second in new account generation in 2011, was terminated in 2012.

Of the six agreements among the top ten for 2012 but not for 2011, four –University of

Southern California, UCLA Alumni Association, Penn State Alumni Association, and the

California Alumni Association – were among the top twenty in 2011. The Brown Alumni

Association agreement with FIA ranked 121st in new accounts in 2011, and the Alumni

Association of the University of Oregon’s agreement with Oregon Community Credit Union is

new in 2012.

3.4.6 Consolidation of college affinity card agreements From 2009 to 2012, the top ten affinity agreements by account size have grown from 18

percent of all college affinity card accounts to 24 percent. The top ten affinity agreements by

payment quantity have similarly grown from 22 percent to 29 percent, and the top ten affinity

agreements by new account volume have grown from 16 percent to 40 percent of all new

accounts. This growth reflects increasing concentration in a number of large agreements as

large issuers shed smaller agreements.

4. Detailed information about college credit card agreements

Pursuant to Section 305 of the Credit CARD Act, Appendix A to this report lists the information

submitted to the CFPB regarding the payments made and accounts opened under college credit

card agreements. The complete text of each agreement submitted to the CFPB is available on

the Bureau’s public website at www.consumerfinance.gov.

Appendix A lists the following information about each college credit card agreement: (1) the

name of the institution or organization; (2) the type of institution or organization;m (3) the city

and state where the institution or organization is located; (4) the name of the issuer; (5)

whether the agreement has been amended or is new;n (6) whether the agreement was still in

Appendix B to this report lists college credit card agreements that were in effect at some time

during 2011 but were terminated by year-end 2011. This table also is organized alphabetically

by the name of the institution or organization. (Agreements terminated in 2012 are included in

Appendix A. These agreements are marked as no longer in effect on January 1, 2013)

In 2013, the Bureau received corrected information from INTRUST Bank and MIT Credit

Union. Both issuers provided information for 2011 that had not been received by the Bureau in

2012. UMB Bank, N.A erroneously reported 3 entities that are not institutions of higher

education for 2011 and Bureau thus removed them from 2011 reporting. The Bureau also

reconciled its 2012 submissions with their associated agreements. Some institutions’ names

did not match their affinity agreements. These institutions’ names were also corrected.

Corrected information 2011 is included in Appendix C to this report. All comparisons to 2011 in

this report reflect these corrections.

APPENDIX C:

Corrected information regarding college credit card agreements In 2013, the Bureau received corrected information from INTRUST Bank and MIT Credit

Union. Both issuers provided information for 2011 that had not been received by the Bureau in

2012. UMB Bank, N.A erroneously reported 3 entities that are not institutions of higher

education for 2011 and Bureau thus removed them from 2011 reporting. The Bureau also

reconciled its 2012 submissions with their associated agreements. Some institutions’ names

did not match their affinity agreements. These institutions’ names were also corrected.
