La réforme constitutionnelle de juillet 2011 a réaffirmé le choix irréversible du Royaume du Maroc d’édifier un Etat de droit démocratique, et son engagement à souscrire aux principes, droits et obligations énoncés dans les conventions internationales relatives aux droits de l’Homme tels qu’ils sont universellement

reconnus.

Ainsi le préambule de la constitution, partie intégrante du texte fondamental, stipule que le Maroc s’engage à “protéger et à promouvoir les dispositifs des droits de l’Homme et du droit international humanitaire et contribuer à leur développement dans leur indivisibilité et leur universalité” et à “bannir et combattre toute discrimination à l’encontre de quiconque, en raison du sexe, de la couleur, des croyances, de la culture, de l’origine sociale ou régionale, de la langue, de l’handicap ou de quelque circonstance personnelle que ce soit”.

Parmi les libertés et droits fondamentaux énoncés dans le titre II de la constitution, le droit d’accès à l’information figure à l’article 27 qui stipule :

“Les citoyennes et les citoyens ont le droit d’accéder à l’information détenue par l’administration publique, les institutions élues et les organismes investis de missions de service public. Le droit à l’information ne peut être limité que par la loi, dans le but d’assurer la protection de tout ce qui concerne la défense nationale, la sécurité intérieure et extérieure de l’Etat, et la vie privée des personnes, de prévenir l’atteinte aux libertés et droits fondamentaux énoncés dans la présente constitution et de protéger les sources des informations et les domaines déterminés avec précision par la loi”.

Conformément à ses attributions dans le domaine de la protection et de la promotion des droits de l’Homme, telles que prévues par le Dahir portant sa création, le CNDH a inscrit parmi ses priorités la contribution à l’animation du débat national au sujet des dispositions constitutionnelles en matière de libertés et de droits humains.

The constitutional reform of July 2011 reiterated the irreversible choice of the Kingdom of Morocco to build a state under the rule of law committed to the principles, rights and obligations set forth in the international conventions on human rights.

Thus the preamble, an integral part of the Supreme Law, stipulates that Morocco is committed «to protect and to promote the devices of international humanitarian law and human rights and contribute to their development in their indivisibility and their universality» and « to banish and combat any discrimination against anyone, because of sex, colour, beliefs, culture, social or regional origin, language, disability or any personal circumstances whatsoever.»

Among the freedoms and fundamental rights set out in the constitution, the right to access information is guaranteed by article 27 which stipulates :

“Citizens have the right to access information held by public authorities, elected institutions and bodies invested with a public service. The right to information can be restricted by law, in order to protect national defence, internal and external security of the state, the privacy of individuals, the prevention of infringements on the rights and freedoms enshrined in this Constitution and to protect sources and areas specifically determined by law.”

In line with its mandate in the protection and promotion of human rights, such as laid down by the founding law of the National Human Rights Council (CNDH) sets among its priorities the contribution to the national debate on the implementation of the constitutional provisions on freedoms and human rights.

C’est dans ce cadre que le Conseil national des droits de l’Homme organise une conférence internationale sur le droit d’accès à l’information. L’objectif de cette conférence est de réunir autorités publiques, institutions élues, entreprises publiques et privées, organisations de la société civile et experts internationaux pour débattre des normes internationales pouvant inspirer la loi marocaine sur le droit d’accès à l’information et les meilleures politiques et pratiques poursuivies en la matière au niveau international.

Parmi les résultats attendus de cette conférence :

1. Une meilleure compréhension du droit d’accès à l’information pour la protection de la liberté d’opinion et d’expression, le développement de la démocratie participative, la lutte contre la corruption, le renforcement de la capacité des citoyens à participer à la vie publique et pour la garantie des droits économiques, sociaux et culturels ; 2. Une analyse des principes et standards internationaux constituant le régime juridique du droit d’accès à l’information ;3. Une analyse comparative des expériences des pays ayant adopté des lois démocratiques et effectives sur le droit d’accès à l’information en termes de cadre juridique, d’Institutions de contrôle, de recours et de promotion de ce droit ;4. Une présentation de quelques expériences réussies en termes d’application de la loi sur :

Les entreprises publiques et privées ; Les institutions élues comme le parlement et les collectivités territoriales ; La justice.

5. Une présentation des campagnes de plaidoyer au niveau international, régional et national pour le droit d’accès à l’information pouvant être bénéfiques pour la société civile marocaine ; 6. L’identification et l’analyse des défis que soulève dans la pratique une loi d’accès à l’information.

It is within this framework that the CNDH is organizing an international conference on the right to access information. The objective of this Conference is to bring together public authorities, elected institutions, public and private enterprise managers, civil society organisations and international experts, from Morocco and other countries, to discuss international standards and the best policies and practices in democratic countries that can inspire the legislator who will adopt a law on the right of access to information.

Among the expected results of this Conference :

1. A better understanding of the right to access information for the protection of the freedom of opinion and expression, the development of participatory democracy, the fight against corruption, strengthening the capacity of citizens to participate in public life and the guarantee and realisation of economic, social and cultural rights ;2. An analysis of the international norms, principles and standards which constitute the legal system of the right of access to information ;3. A comparative analysis of the experiences of countries which have adopted democratic and effective legislations on the right of access to information in terms of the legal framework and the role of institutions of control, remedy and promotion ; 4. A presentation of some successful experiences in terms of application of the law on :

Private and public enterprises ; Elected institutions such as the Parliament, local councils, and regional authorities ; Justice.

5. A presentation of advocacy campaigns at the international, regional and national level for the right of access to information that may be beneficial to Moroccan civil society organisations ;6. Identification and analysis of challenges that could be raised in practice by a law on access to information.

Abdallah Deguig : Abdallah Deguig a une vingtaine d’années d’expérience dans le secteur des technologies de l’information. Directeur général Afrique du Nord de BT Net2S, il compte également à son actif plusieurs formations spécifiques, notamment dans le management et la gestion des ressources humaines. Après un parcours riche dans plusieurs entreprises, M. Deguig rejoint, en 1997, Microsoft Afrique du Nord où il occupe de nombreux postes à l’échelle locale puis régionale. Son expérience entrepreneuriale débute en 2001 où il prend des participations dans une société de conseil des NTI, Syntone, qui fût rachetée par le groupe Net2s. Après le rachat du groupe par British Telecom Global Services, Abdallah Deguig est nommé Directeur Général Afrique du Nord en avril 2009. En janvier 2010 et après avoir été membre du bureau de la Fédération des technologies de l’information, de télécommunication et de l’offshoring (APEBI), pendant 2 années, il en prend la présidence avant d’être nommé membre du Conseil économique et social en 2011.

General Director of BT Net2S North Africa. He has 20 years of experience in the field of information technologies. He has been trained in several specific areas, mainly administration and the management of human resources. After a long and rich experience in several companies, he joined, in 1997, Microsoft North Africa, where he held several positions at local and regional levels. His leading experience began in 2001 when he took an interest in a consulting firm, NIT, Syntone, which was acquired later by the group Net2s, After the takeover of the British Telecom Global Services, he was appointed as the Director General of North Africa in April 2009. In January 2010, after being member of the Board of the Federation of Information Technologies, Telecommunications and Offshoring (APEBI), for two years, he became the chair and later appointed member to the Economic and Social Council in 2011.

Abdallah Harsi : Abdallah Harsi est Professeur de droit public à la Faculté de droit de Fès. Membre du Conseil National de Transparency Maroc, association avec laquelle il a participé à plusieurs ateliers et études et sur le droit d’accès à l’information. Il a également à son actif plusieurs contributions dont, le système d’intégrité arabe pour la lutte contre la corruption, Source Book Arabe, réalisé en collaboration avec Transparency International, 2005, Les aspects institutionnels, législatifs et réglementaires de la décentralisation et de la régionalisation au Maroc, Bilan et perspectives ; Evaluation du cadre pour l’organisation des élections (élections législatives, référendums et élections locales), Maroc 2007, (DRI et Transparency Maroc) ; Evaluation qualitative de l’élection à la Chambre des représentants, Maroc, 2007 ; Evaluation du cadre pour l’organisation des élections communales – Maroc, 2009, (DRI et Transparency Maroc). M. Harsi a également contribué au Rapport sur le Développement Humain au Maroc, 50 ans d’indépendance du Maroc, 2006 et réalise actuellement, pour Transparency Maroc et en collaboration avec Transparency international, le Rapport National sur le droit d’accès à l’information.

He also contributed to the Report on Human Development in Morocco, 50 years of independence of Morocco, 2006. He is currently drafting a national report on the right to information for Transparency Morocco in collaboration with Transparency International.

Abdessalam Aboudrar : Président de l’Instance Centrale pour la Prévention de la Corruption, Abdesselam Aboudrar est ingénieur des Ponts et Chaussées (diplômé de l’Ecole Nationale des Ponts et Chaussées- Paris 1973), économiste (Université de Rabat 1980), et titulaire d’un MBA (ENPC - Paris 2000). Il a d’abord exercé dans le domaine de l’équipement et du génie civil (1974-1998) à différents postes de responsabilité dans l’administration (Ministère de l’Equipement) dans l’ingénierie (CID, Team Maroc notamment) et dans l’entreprise. En 1998, il a rejoint la Caisse de Dépôt et de Gestion (CDG), d’abord en tant que responsable du pôle Prévoyance et Promotion de l’Epargne (1998-2003) avant d’être nommé Secrétaire général de la CDG (novembre 2002) puis Directeur Général Adjoint (2006). M. Aboudrar est membre-fondateur de Transparency-Maroc, Président de la Commission de lutte contre la corruption de la CGEM (Confédération Générale des Entreprises du Maroc), et membre de l’Observatoire Social International, institution dédiée à la responsabilité sociale de l’entreprise. Il est également expert auprès de l’OCDE en matière de gouvernance d’entreprises.

President of the Central Agency for the Prevention of Corruption. He is a graduate of the National School of Bridges and Roads-Paris (1973), economist (University of Rabat in 1980). He has an MBA from the National School of Bridges and Roads-Paris (2000). He first worked in the field of equipment and civil engineering (1974-1998) and held different positions in the administration (Ministry of Equipment), engineering (CID Team Morocco in particular) and business. In 1998, he joined the Caisse de Dépôt et de Gestion (CDG), first as head of the Pole of Social Welfare and Promotion of Savings (1998-2003) before being appointed General Secretary of the institution (November 2002) and then Executive Vice President (2006). He is a founding member of Transparency-Morocco, chairman of the Commission of the Fight against Corruption and the General Confederation of Enterprises of Morocco. He is a member of the International Social Observatory, an international institution dedicated to corporate social responsibility. He is also an expert at the OECD in the field of corporate governance.

Ahmed Akhchichine : Membre du Conseil national des droits de l’Homme, Ahmed Akhchichine est ancien ministre de l’Education Nationale, de l’Enseignement Supérieur, de la Formation des Cadres et de la Recherche Scientifique (2007-2011). Il est titulaire d’un diplôme de l’Institut Supérieur de Journalisme (ISJ) en 1976, d’un diplôme de l’Institut Français de Presse (IFP) en 1979 et d’un doctorat en sciences de l’information et de la communication en 1982. Enseignant-chercheur puis consultant en communication auprès de plusieurs organisations internationales, M. Akhchichine a occupé le poste d’expert international résident dans la région de l’Afrique de l’Ouest, de 1993 à 1997, pour le compte de diverses agences du système des Nations unies. Il a été également Directeur général de la filiale du bureau d’études canadien «Léger&Léger» au Maroc de 1997 à 2001 avant d’être nommé, en 2003, Directeur général de la Haute autorité de la communication audiovisuelle (HACA). Ahmed Akhchichine est vice-président de l’Association marocaine de recherche en communication (AMRC), membre fondateur du Conseil national de l’Organisation marocaine des droits de l’Homme (OMDH), membre du Bureau national de l’Observatoire national des droits de l’enfant (ONDE) et membre du Bureau national du Conseil supérieur de l’enseignement.

Member of the National Human Rights Council and Ex-Minister of National Education, Higher Education, Staff Training and Scientific Research (2007-2011). He graduated of the Institute of Journalism of Rabat (ISJ) in 1976, and of the French Press Institute (IFP) in 1979. He obtained a Ph.D. in information and communication in 1982. Since 1982, he has been a teacher-researcher and then communication consultant to several international organizations. He served as an international resident expert in the region of West Africa with several UN agencies. He was the Director General of “Léger&Léger“, Canadian market research firm, in Morocco (1997 to 2001), before being appointed, in 2003, as the Director General of the High Authority for Audiovisual Communication (HACA). He is the Vice-President of the Moroccan Association for Communication Research (AMRC). He is a founding member of the National Board of the Moroccan Human Rights Organization, member of the National Board of the National Observatory for the Rights of the Child and a member of the National Council of Higher Education.

Ahmed Moufid : M. Moufid est professeur de Sciences politiques et de droit constitutionnel à la Faculté des Sciences Juridiques Economiques et Sociales de Fés. Titulaire d’un doctorat en droit public de la faculté des sciences juridiques, économiques et sociales de l’université Mohamed I Oujda, et de l’habilitation en droit public de la Faculté des Sciences Juridiques, Economiques et Sociales de l’université Sidi Mohamed Ben Abdellah de Fès, M. Moufid a été, de 1997 à 2002, enseignant vacataire à la même faculté avant d’occuper le poste d’ administrateur au Centre National pour la Recherche Scientifique et Technique (CNRST) à Rabat (2003 à 2004). Il est également enseignant vacataire au Centre de formation administrative à Fès depuis 2004. Il a publié plusieurs ouvrages et articles dont : Théorie générale de droit constitutionnel, première édition 2007 et Droit électoral marocain (ouvrage collectif), première édition 2005. M. Moufid est membre de plusieurs associations et groupes de recherches, notamment, le laboratoire de recherches finances et développement à la Faculté de Droit de Fès, le groupe des études et des recherches administratives, Transparency Maroc, Adala, l’Association marocaine du droit constitutionnel et l’organisation marocaine des droits humains.

Professor of Political Science and Constitutional Law at the Faculty of Law, Economics and Social Sciences in Fez. He has a Ph.D. in Public Law, Faculty of Law, Economics and Social Sciences, University of Mohammed I, Oujda, and a degree in public law, Faculty of Law, Economics and Social Sciences, University of Sidi Mohamed Ben Abdellah, Fez. He was a temporary teacher (1997 to 2002) at the same faculty before taking up the position of executive officer at the National Center for Scientific and Technical Research in Rabat (2003-2004). He has been a temporary teacher at the Administrative Training Centre in Fez since 2004. He has published several books and articles including: General Theory of Constitutional Law and Political Institutions, first edition 2007, and the Moroccan Electoral Law (co-authored) first edition 2005. He is a member of several associations and research groups, including the Finance and Development Research Laboratory at the Faculty of Law in Fez, the Group of Administrative Studies and Researches at the Faculty of Law in Fez, Transparency-Morocco, Adala association, the Moroccan Association of Constitutional Law and the Moroccan Human Rights Organization.

Alexandra Balafrej : Alexandra Balafrej a plus de douze ans d’expérience dans les secteurs du développement et de la communication. Après un début de carrière en France comme directrice de la communication dans le secteur privé, puis dans le mécénat pour de grands projets culturels, elle part pour l’Australie où elle travaille dans le secteur de la philanthropie pour le compte d’une organisation environnementale de renommée internationale, les Royal Botanic Gardens. Elle s’installe au Maroc en 2005 où elle pilote la mise en œuvre de grands projets de développement pour le compte de bailleurs internationaux tels que l’USAID ou le Millenium Challenge Corporation. Alexandra Balafrej travaille alors sur des projets d’éducation, d’alphabétisation, de formation professionnelle, d’entreprenariat et de renforcement de la société civile. Dans ce cadre, elle apporte son assistance à de nombreuses organisations non gouvernementales. En tant que consultante internationale dans les domaines de la communication, des médias et du développement, Alexandra Balafrej a publié, depuis 2010, plusieurs études avec l’UNESCO sur la question des médias et de l’accès à l’information publique au Maghreb. Elle est depuis 2012 Directrice Générale d’une Fondation privée.

She has over twelve years of experience in the development and communication sectors. She began her career in France as director of communication in the private sector and in the patronage for major cultural projects. She moved to Australia where she worked in the field of philanthropy for Royal Botanic Gardens, an internationally renowned environmental organization. She settled in Morocco in 2005. She supervised the implementation of major development projects on behalf of international donors such as USAID and the Millennium Challenge Corporation. She worked on projects of education, literacy, vocational training, entrepreneurship and strengthening of civil society. In this context, she provides assistance to many non-governmental organizations. As an international consultant in the fields of communication, media and development, she has published, since 2010, several studies with UNESCO on the issue of media and access to public information in the Maghreb. She is the director general of a private foundation.

David Banisar : David Banisar est avocat principal d’Article 19, la Campagne mondiale pour la liberté d’expression, qui fournit conseil et expertise en matière de la liberté d’expression et la liberté d’information. Il a été le pivot de l’appui de différentes organisations dans les domaines de l’accès à l’information, protection des données personnelles et les questions des cyber-activisme, des stratégies de développement, documents de politique et de plaidoyer. Driss Aissaoui : Economiste de formation, Driss Aissaoui est consultant auprès d’institutions nationales et internationales dans le domaine du développement. Il gère actuellement une structure privée spécialisée en communication des institutions. Son itinéraire dans le domaine du journalisme a commencé avec des publications d’expression arabophone et francophone. Il a été le correspondant de l’agence UPI (United Press International) au Maroc. Il est également enseignant vacataire en communication d’entreprise. Il est auteur d’études dans le domaine des médias et du journalisme pour le compte d’organismes nationaux et internationaux. M. Aissaoui a dirigé plusieurs quotidiens et s’est chargé de leur restructuration dans le domaine de la presse écrite et de la presse électronique. Il est également consultant auprès d’organismes internationaux dans le domaine de la communication et des médias. M. Aissaoui est chroniqueur pour des médias audiovisuels nationaux et internationaux, et a effectué plusieurs séjours de formation et d’échange professionnels en Europe, aux USA, au Japon et dans les pays arabes.

Driss El Yazami : Président du Conseil national des droits de l’Homme (CNDH), ancien membre de l’IER et du CCDH, Driss El Yazami est le fondateur de Génériques, une association spécialisée dans l’histoire de l’immigration en France et rédacteur en chef de la revue Migrance. Ancien vice-président de la Ligue française des droits de l’Homme, ancien secrétaire général de la Fédération internationale des ligues des droits de l’Homme et ancien membre du Comité exécutif du Réseau euro-méditerranéen des droits de l’Homme, il préside, depuis 2004, la Fondation euro-méditerranéenne de soutien aux défenseurs des droits de l’Homme et fait partie du Conseil d’orientation et du Conseil d’administration de la Cité nationale de l’histoire de l’immigration en France. Il a assuré le commissariat général de plusieurs expositions (France des étrangers, France des libertés en1989 ; Au miroir de l’autre, immigration en France et en Allemagne en1993 ; Générations, un siècle d’histoire des Maghrébins en France en 2009). He is the founder of Générique, an association specialized in the history of foreigners and immigration in France, and chief editor of the Migrance journal. He is a former Vice-President of the French League of Human Rights, former Secretary General of the International Federation of Human Rights and former member of the Executive Committee of the Euro-Mediterranean Human Rights Network. Since 2004, he has been president of the Euro-Mediterranean Foundation of Support to Human Rights Defenders and member of the board of the Cité nationale de l’histoire de l’immigration in France (museum of immigration history). He was entrusted with the secretariat of several exhibitions, including «France of foreigners, France of freedoms» (1989), «In the mirror of the other, immigration in France and Germany» (1993), «Generations”, “A century of Maghrebian history in France” (2009). Imad Meniari : Chargé d’études au département juridique de la Haute autorité de la communication audiovisuelle (HACA). Expert juridique en matière de législation en communication audiovisuelle, il est également chercheur universitaire en matière de diversité culturelle et linguistique. M. Meniari est membre du bureau national de l’association marocaine de recherche et d’échange culturel et membre du bureau exécutif du centre marocain de la diplomatie parallèle et le dialogue des civilisations.

Jamila Sayouri : Membre du Conseil national des droits de l’Homme, Jamila Sayouri, titulaire d’une licence en sciences politiques en 1989 est membre du barreau de Rabat et membre fondateur de l’Union de l’action féminine. Membre de l’Organisation marocaine de droits humains depuis 1999, Mme Sayouri est membre fondateur du centre Annajda d’aide aux femmes victimes de violence, créé en 1996. Elle est également membre du Secrétariat exécutif de la Coalition marocaine pour la Cour pénale internationale. Elle a contribué au rapport sur Les femmes en tant que participante à part entière à la communauté euro-méditerranéenne d’États démocratiques, élaboré par l’Euromesco et a été élue en 2011 présidente de l’association Adala (Justice).

Khadija Ridouane : Khadija Ridouane est depuis 2009, directeur de l’information et des programmes à Radio Aswat. Après des études à l’Institut supérieur de journalisme (ISJ) de Rabat, elle a débuté sa carrière à la fin des années 80 au sein de la radio marocaine où elle était correspondante de la chaîne Inter à Casablanca. S’en est suivie une longue parenthèse en presse écrite, une quinzaine d’années où elle a travaillé pour des supports différents (Le Libéral, Maroc Hebdo, le quotidien du Maroc, Le Matin et l’Economiste). Journaliste politique, elle a dirigé le service politique du quotidien le Matin durant une dizaine d’années. Analyste politique au quotidien l’Economiste dès 2006, elle s’est vue confier la direction du projet éditorial de la radio Atlantic en janvier 2007, apportant ainsi sa contribution à l’émergence des radios privées au Maroc. Détentrice d’un diplôme des études supérieures en journalisme et communication (DES), elle est l’auteur d’une thèse sur l’analyse du discours de la presse indépendante au Maroc à travers le cas de Maroc hebdo international.

Graduating of the Higher Institute of Journalism in Rabat, she began her career in the late 80s in the Moroccan radio as a reporter to La Chaîne Inter in Casablanca. She had a long career of almost fifteen years in print newspapers. She worked for different newspapers, including Le Libéral, Maroc Hebdo, le quotidien du Maroc, Le Matin and l’Economiste. She is a political journalist. She headed the political section at the daily le Matin for ten years. Policy analyst at the daily l’Economiste since 2006, she was tasked with the management of the editorial project of Atlantic radio in January 2007. She contributed to the emergence of free radio in Morocco. She has a diploma in journalism and communication. She is the author of a thesis on discourse analysis of the independent press in Morocco through the case of the weekly Maroc hebdo international.

Lalanath De Silva : Lalanath De Silva est le directeur de ‘Acces Intiative’ (TAI) au ‘World Resources Institute’ (WRI). Lalanath à concouru à l’évaluation des lois relatives à l’accès à l’information, la participation à la vie publique et l’accès à la justice auprès de150 groupes de la société civile à travers 40 pays. Les partenaires de TAI identifient, à travers des évaluations, les failles dans la loi, la pratique et les institutions et organisent des activités. M. Lalanath a été défenseur de l’intérêt public (public interest litigator) pendant plus de vingt ans. Il a contribué à l’élaboration de lois d’intérêt public en matière d’environnement. Dans ce cadre, il appuyé les victimes, les communautés et les organisations non gouvernementales dans plusieurs dossiers concernant l’environnement au Sri Lanka. M. Lalanath a également travaillé, pendant deux ans, pour le gouvernement du Sri Lanka, en tant que consultant juridique au ministère de l’Environnement et des Forêts.

He is the director of The Access Initiative (TAI) at the World Resources Institute (WRI). Since 2005, Lalanath has been focusing on helping over 150 civil society groups in over 40 countries assess the status of access to information, public participation and access to justice in their countries. Through these assessments, TAI partners identify gaps in access laws, practices and institutions and undertake activities that will change the situation on the ground. Lalanath was a public interest litigator and advocate for over two decades. Pioneering the growth of public interest law in the area of the environment, he appeared in many of Sri Lanka’s leading environmental cases on behalf of victims, communities and non-governmental organizations. He also worked for the Government of Sri Lanka for two years as the Legal Consultant to the Ministry of Environment and Forests.

Marouane Tarafa : Diplômé de l’Ecole Centrale de Nantes, titulaire d’un D.E.A. en génie mécanique ainsi que d’un M.B.A. de l’Ecole Nationale des Ponts et Chaussées de Paris. Il est nommé à la Direction Commerciale de COSUMAR puis à la Direction RH du Groupe ONA. En 2004, il rejoint SOPRIAM en tant que Directeur Général Adjoint puis nommé Directeur Général Adjoint de SONASID de décembre 2007 jusqu’à Octobre 2010. Il est aujourd’hui PDG de SOMED. M. Tarafa est président de la commission recherche et développement, e-entreprise et relations avec l’université, à la Confédération Générale des Entreprises du Maroc (CGEM).

Mustapha El Khalfi : Mustapha El Khalfi est ministre de la Communication, porte-parole du gouvernement. Titulaire de trois licences en physique, en droit et en études islamiques, d’un DEA sur le projet politique du mouvement islamique au Maroc, il prépare un doctorat sur les approches anglo-américaines relatives aux mouvements islamiques. Journaliste depuis 1997, il a occupé les postes de rédacteur en chef et de directeur de publication du journal Attajdid. Membre de la Fédération marocaine des éditeurs de journaux (FMEJ), il a suivi une formation à l’Institut américain des études internationales avancées dans le cadre de laquelle il réalisé une étude portant sur l’évolution historique (1975/2005) de la question du Sahara. Mustapha El Khalfi a lancé, en 2009, le Centre marocain des études et des recherches contemporaines, un think-thank marocain qui se propose d’aider les décideurs et la société civile à mieux saisir les changements en cours dans la société marocaine et à développer des politiques publiques.

Mme Canavaggio a également occupé les postes de Secrétaire générale adjointe du Conseil international des Archives (ICA) de 2002 à 2009 et de Secrétaire de la Conférence internationale de la Table Ronde des Archives (CITRA) de 2000 à 2008. Au sein de l’ICA, elle a présidé, de 2003 à 2008, le groupe de travail archives et droits de l’Homme, dont elle est toujours membre. Chef du service des archives à la Présidence de la République de 1974 à 1994, elle a été adjointe au Directeur des Archives de France en 1995 et 1996. Perrine Canavagio a publié, depuis 1980, plusieurs articles sur les archives politiques (archives présidentielles, cabinets ministériels, partis politiques) dans la Gazette des Archives, la Revue administrative, Comma (revue du Conseil international des Archives), ainsi que dans des revues archivistiques étrangères. Rosario Soraide : Assistante spécialiste de programmes à la Division de la liberté d’expression et le développement des médias, la communication et l’information à l’UNESCO, Rosario Soraide a rejoint la Division de l’UNESCO de la liberté d’expression et le développement des médias en Décembre 2009, pour appuyer la planification conceptuelle de la Journée mondiale de la liberté de la presse 2010, qui a été célébrée sous le thème « Liberté d’information : le droit de savoir». Elle a travaillé sur ce sujet depuis 2003, dans différentes régions, y compris les pays arabes. Elle est également impliquée dans des projets favorisant la liberté d’expression, la liberté de la presse et le développement des médias. Avant de rejoindre l’UNESCO, Rosario Soraide a été consultante pour l’Institut de la Banque mondiale sur l’accès à l’information, la transparence, la responsabilité sociale et la participation citoyenne. Elle a également mené des recherches sur l’accès à l’information pour le Bureau du Rapporteur spécial pour la liberté d’expression au sein de la Commission interaméricaine des droits de l’Homme, et pour le Centre d’études sur la liberté d’expression et l’accès à l’information (CELE-École de Droits de l’Université de Palerme, Buenos Aires). Elle est titulaire d’une maîtrise en développement de l’Université d’Oxford, où elle a également travaillé pour l’Institut de journalisme Reuters, et d’une licence en sciences politiques avec une spécialisation en relations internationales de l’Université Catholique Argentine (Buenos Aires).

She also conducted research on access to information for the Office of the Special Rapporteur for Freedom of Expression within the Inter-American Commission on Human Rights, and for the Center for Studies on Freedom of Expression and Access to Information (CELE, Palermo University’s School of Law, Buenos Aires). She holds an MPhil in Development Studies from Oxford University, where she also worked for the Reuters Institute for the Study of Journalism; and an undergraduate degree in Political Science with a concentration in International Relations from the Argentine Catholic University (Buenos Aires)

Rosemary Agnew : Rosemary Agnew a été nommée commissaire à l’information en Ecosse le 1er mai 2012 pour un mandat de six ans. Elle a occupé, auparavant, les postes de directeur général de la Scottish Legal Complaints (Commission écossaise des plaintes légales) et adjoint au Médiateur du gouvernement local. En tant que Commissaire à l’information, Rosemary veille au respect des lois de la liberté de l’information. Elle est responsable de l’application et de la promotion de loi sur la liberté d’information en Ecosse. Elle s’est engagée dans le développement d’un cadre pour une amélioration permanente des pratiques de l’autorité publique chargée de l’accès à l’information. Elle considère que l’obligation légale de la liberté d’information peut également être un catalyseur pour les autorités en termes d’efficacité et de transparence.

Ms Rosemary Agnew was appointed as Scottish Information Commissioner on 1 May 2012 for a fixed term of six years. She previously held the posts of Chief Executive of the Scottish Legal Complaints Commission and Assistant Ombudsman at the Local Government Ombudsman, and so is familiar with operating within a regulatory environment. Her extensive public sector experience (which has ranged from policy and business development to complaints handling) includes managing authority compliance with freedom of information laws. As Scottish Information Commissioner, Rosemary is responsible for the enforcement and promotion of Scotland’s freedom of information law. She has a keen interest in developing a framework of continuous improvement of public authority FOI practice during her term of office. She considers that the statutory obligation of FOI can also be an enabler for authorities in terms of both effectiveness and transparency: FOI is the key to many rights and freedoms in our society and also a significant driver to good public authority practice.

Saadia Belmir : Membre du Conseil national des droits de l’Homme. Magistrate, Conseillère du Ministre de la Justice, Mme Belmir est titulaire d’un doctorat d’État en Droit Public (Université de Paris II), d’un DES en Droit Public (Université de Paris II) et d’un DES en Sciences Politiques (1ère année - Université Mohamed V à Rabat). Elle est titulaire du diplôme International des Droits de l’Homme (Institut International des Droits de l’Homme à Strasbourg). Mme Belmir a entamé sa carrière en tant qu’avocate- stagiaire avant de rejoindre le corps judiciaire en 1967 : juge suppléant en stage à la Cour suprême, juge au Tribunal de 1ère Instance à Rabat, substitut du Procureur Général à la Cour d’Appel de Rabat, conseiller à la même Cour, conseiller détachée auprès de l’Administration Centrale (ministère de la Justice), conseiller à partir de 1995 à la Cour suprême (membre de la Chambre administrative). En 1998, elle accède au grade de Présidente de Chambre à cette Haute Cour. Mme Belmir qui a été membre d’un Groupe de réflexion auprès de Sa Majesté le Roi Hassan II (1996-1999), a aussi été enseignante au sein de l’Institut supérieur de la Magistrature et membre de l’Institut international de droit d’expression et d’inspiration française (IDEF). Elle a été également membre du Conseil Constitutionnel (1999 - 2005), et depuis septembre 2005, elle est conseillère du Ministre de la Justice. Mme Belmir, qui est membre de l’Amicale hassanienne des magistrats, a été élue en novembre 2005, membre du Comité onusien contre la torture. En 2007, elle a été élue vice-président dudit Comité et reconduite dans ce poste en 2009 et en 2012. Ancien membre de la commission nationale pour l’élaboration du plan d’action national en matière de démocratie et des droits de l’Homme, Mme Belmir est membre du Conseil Supérieur des Oulémas.

She began her career as a trainee lawyer before joining the judiciary in 1967: intern deputy judge at the Supreme Court, judge of the court of first instance in Rabat, deputy general prosecutor at the court of appeal in Rabat, advisor at the same court, advisor seconded to the central government (the Ministry of Justice), advisor since 1995 to the Supreme Court (Member of the Administrative Chamber). In 1998, she held the position of Chamber President at the Supreme Court. She was also teacher at the Higher Institute of the Judiciary, member of the Constitutional Council (1999 - 2005) and is currently a member of the Higher Council of Ulema (religious scholars). In 2007, she was elected vice-chairman of the UN Committee and re-elected in 2009. She has been member of this Committee since 2005.

Said Essoulami : Said Essoulami est directeur du Centre pour la liberté des médias dans la région MENA (CMF MENA) et président du Réseau arabe pour la Liberté de l’information, coordonnateur de la Coalition nationale marocaine pour la liberté de l’information, membre du Comité directeur de réseau des défenseurs de la liberté de l’information (FOIANET) et membre du Réseau africain d’accès à l’information. Shailesh Gandhi : Shailesh Gandhi était un brillant entrepreneur avant de devenir un ardent défenseur de la liberté de l’information en Inde en 2003. Il a été nommé commissaire central à l’information en Septembre 2008. M. Gandhi a traité plus de 20000 dossiers reçus par la commission en moins de quatre ans, et a pu assurer le traitement de la plupart des cas dans un délai de 90 jours. Il a également été derrière l’élaboration de nombreuses règles et mesures importantes pour accroître la transparence et la responsabilité de la Commission de l’information. Il a dirigé plus de 500 ateliers pour aider les citoyens et les agents du gouvernement dans les bidonvilles, les clubs, les bureaux, les écoles et les collèges, à accéder au droit à l’information. M. Ghandhi a reçu plusieurs prix pour son engagement : le ‘Distinguished Service Award’, le ‘Distinguished Alumnus’ délivré par l’Institut de Technologie de Bombay, le «Nani Palkhiwala Civil Liberties Award» en 2008 et le Prix «Dubey Satyendra» délivré par l’Institut indien de Technologie de Kânpur.

Mr. Shailesh Gandhi was a successful entrepreneur before turning into a prominent advocate for freedom of information in India in 2003. He was appointed as Central Information Commissioner in September 2008. Mr. Gandhi disposed over 20000 cases in less than four years, and ensuring disposal of most cases within 90 days. He was also responsible for many important orders and measures to increase transparency and accountability of the Information Commission. He conducted over 500 workshops for Citizens and Government officers in slums, clubs, offices, schools and colleges, helping and guiding many Citizens in using RTI responsibly. Mr. Ghandhi has received the Distinguished Service Award and the Distinguished Alumnus Award by IIT Bombay and the Nani Palkhiwala Civil Liberties Award in 2008 and the Satyendra Dubey Award by IIT Kanpur. He was instrumental in using RTI to improve governance.

Tarek Kabbage : Député, Maire d’Agadir et président de l’Association marocaine des éco-villes (AMEV), Tarek .Kabbaj est titulaire d’un Doctorat d’Etat en Chimie organique à l’Université Paul Sabatier (Toulouse, France). Entre 1976 et 1984, il a été enseignant chercheur à la Faculté des Sciences – Université Mohamed V, Rabat, puis à l’Université Paul Sabatier – Toulouse avant de reprendre les affaires familiales, en 1984, en tant que gérant des Domaines Abbès Kabbaj (production d’agrumes et légumes). En 1986, Il a fondé et présidé GPA (Exportation et commercialisation des fruits et légumes frais) puis la société Fresh Fruit (Exportation et commercialisation des fruits et légumes frais) en 1998. M. Kabbaj est également ancien membre du bureau national du Syndicat National de l’Enseignement Supérieur (S.N.E.SUP), membre du comité permanent pour le soutien au peuple palestinien, membre de la Fondation Abderrahim Bouabid, membre fondateur de l’association « Convergences 21 » et de Transparency Maroc. Tarek Kabbaj est membre du Conseil National de l’Union Socialiste des Forces Populaires.

Tina Kraigher : Tina Kraigher est chercheur au Commissariat à l’information de la République de Slovénie; Après des études à la Faculté de droit de l’Université de Ljubljana, elle s’est engagée en tant que volontaire auprès de l’Ombudsman de la République de la Slovénie et a rejoint le Commissaire à l’information durant la même année. Pendant ses études, elle a travaillé comme bénévole au Centre d’information juridique des organisations non gouvernementales (PIC Ljubljana). Elle a poursuivi ses études en droit administratif à la Faculté de droit de Ljubljana. Au sein du Commissariat à l’information, elle travaille dans les domaines de l’accès et la réutilisation des informations du secteur public, ainsi que dans le domaine de la protection des données personnelles et les droits des patients. Tina Kraigher, LL. M, is Researcher with the Information Commissioner of the Republic of Slovenia: After she graduated from Faculty of Law at University of Ljubljana, she performed a short voluntary traineeship with The Ombudsman of RS and joined the Information Commissioner in the same year. During her studies she volunteered with The Legal Information Centre of Non-governmental Organizations (PIC Ljubljana). She continues her Education with post-graduate Studies in Administrative Law at the Faculty of Law in Ljubljana. With the Information Commissioner she works in the fields of access to public sector information and reuse, as well as in the field of personal data protection and patients’ rights. She participated in the (LAPS) project and attended many FOI events.

Toby Mendel : Toby Mendel est directeur exécutif du Centre droit et démocratie, une ONG internationale des droits humains qui a pour mission de pourvoir une expertise juridique relative aux droits fondamentaux et à la démocratie : droit à l’information, liberté d’expression, droit à la participation, droit d’association. Il a occupé pendant 12 ans le poste de directeur principal du programme juridique à Article 19, une ONG internationale spécialisée dans la liberté d’information et l’accès à l’information. M. Mendel a travaillé en tant qu’expert sur ces droits auprès de nombreux acteurs dont la Banque Mondiale, différents organes des Nations unies, institutions intergouvernementales, gouvernements et ONG à travers le monde. Durant toute sa carrière, il a pu jouer un rôle important dans l’élaboration des législations relatives à l’accès à l’information et la régulation des médias.

Is the Executive Director of the Centre for Law and Democracy, an international human rights NGO that focuses on providing legal expertise regarding foundational rights for democracy, including the right to information, freedom of expression, the right to participate and the rights to assembly and association. Prior to that he was for 12 years Senior Director for Law at ARTICLE 19, a human rights NGO focusing on freedom of expression and the right to information. He has provided expertise on these

rights to a wide range of actors including the World Bank, various UN and other intergovernmental bodies, and numerous governments and NGOs in countries all over the world. In these various roles, he has on a number of occasions played a leading role in drafting legislation in the areas of the right to information and media regulation.

Younes Moujahid a été élu président du Syndicat National de la Presse Marocaine en 2008, poste qu’il occupe jusqu’à ce jour. Il est également membre de la Fédération internationale des journalistes.

م�شطفى اخللفي: وزير االت�ضال الناطق الر�ضمي با�ضم احلكومة. حا�ضل على باكلوريا يف العلوم الريا�ضية، ثم االإجازة تخ�ض�ض فيزياء �ضنة من كلية العلوم بالقنيطرة. وح�ضل اأي�ضا على االإجازة تخ�ض�ض الدرا�ضات االإ�ضالمية واإجازة يف العلوم ال�ضيا�ضية من جامعة حممد اخلام�ض اأكدال للحركات اأمريكية - االإجنلو املقاربات مو�ضوع يف دكتوراه اإعداد على منكب وهو التخ�ض�ض، نف�ض يف املعمقة العليا الدرا�ضات و�ضهادة االإ�ضالمية. ا�ضتغل يف جمال ال�ضحافة منذ �ضنة 1997، وكان مديرا للتحرير ومديرا للن�رش بجريدة التجديد وهو ع�ضو يف هيئة نا�رشي ال�ضحف باملغرب. كما ق�ضى فرتة تكوينية باملعهد االأمريكي للدرا�ضات الدولية املتقدمة قام خاللها باإعداد درا�ضة حول التطور التاريخي )1975/2005( القرار اأبحاث مغربي يقرتح م�ضاعدة �ضناع املعا�رشة، وهو مركز للدرا�ضات واالأبحاث املغربي املركز 2009 �ضنة اأ�ض�ض يف ال�ضحراء. لق�ضية

واملجتمع املدين على فهم التحوالت داخل املجتمع املغربي وتطوير ال�ضيا�ضات العمومية.

م�شطفى العراقي: ع�ضو املجل�ض الوطني حلقوق االإن�ضان. حا�ضل على االإجازة يف احلقوق، �ضعبة العلوم ال�ضيا�ضية �ضنة 1980، �ضحايف منذ 1984 مكلف بحقوق االإن�ضان بجريدة االحتاد اال�ضرتاكي منذ �ضنة 1986، رئي�ض حترير من 2005 اإىل 2007. ع�ضو موؤ�ض�ض للمنظمة املغربية التح�ضريية للموؤمتر الوطني حلقوق الطفل �ضنة اللجنة اأع�ضاء اأحد 1988 وع�ضو موؤ�ض�ض للمر�ضد املغربي لل�ضجون وكان حلقوق االإن�ضان �ضنة

برين كنفجيو: اأمينة عامة �رشفية للرتاث. �ضغلت عدة منا�ضب منها م�ضاعدة اأمني عام املجل�ض الدويل لالأر�ضيف )من 2002 اإىل 2009( واأمانة املوؤمتر الدويل للمائدة امل�ضتديرة لالأر�ضيف )من 2000 اإىل 2008(. تراأ�ضت باملجل�ض الدويل لالأر�ضيف جمموعة العمل املعنية باالأر�ضيف وحقوق االإن�ضان )من 2003 اإىل 2008( والتي التزال حتتفظ بع�ضويتها بها. �ضغلت كذلك من�ضب رئي�ضة ق�ضم االأر�ضيف برئا�ضة اجلمهورية الفرن�ضية ما بني 1974 و1994 وم�ضاعدة مدير االأر�ضيف بفرن�ضا ما بني 1995 و1996. ن�رشت منذ 1980 العديد من املقاالت حول االأر�ضيف ال�ضيا�ضي )اأر�ضيف الرئا�ضة والوزارات واالأحزاب ال�ضيا�ضية( يف عدة منابر فرن�ضية واأجنبية تعنى باالأر�ضيف. �ضاركت، رفقة األك�ضندرا بلفريج، يف اإعداد درا�ضة حول احلق يف الو�ضول اإىل املعلومات العامة باملغرب، بدعم من منظمة اليون�ضكو ومركز حرية االإعالم بال�رشق االأو�ضط و�ضمال اإفريقيا

خديجة ر�شوان: مديرة االأخبار والربامج براديو اأ�ضوات منذ �ضنة 2009. بداأت حياتها املهنية يف اأواخر الثمنينات، بعد اإنهاء درا�ضتها يف املعهد العايل لل�ضحافة يف الرباط، باالإذاعة املغربية حيث كانت مرا�ضلة الإذاعة "la chaîne Inter" بالدار البي�ضاء. ا�ضتغلت بعد ذلك، ولفرتة طويلة تراأ�ضت العتبارها واالإيكونوم�ضت(. لوماتان ماروك، لو يومية ايبدو، ماروك ليربال، )لو منابر عدة لفائدة املكتوبة ال�ضحافة �ضنة(، يف 15(�ضحفية يف املجال ال�ضيا�ضي، امل�ضلحة ال�ضيا�ضية بيومية لوماتان ل�ضنوات عدة. حمللة �ضيا�ضية يف �ضحيفة االإيكونومي�ضت منذ 2006، كلفت باإدارة امل�رشوع التحرير ملحطة Atlantic يف يناير 2007، و�ضاهمت بذلك يف ظهور االإذاعات امل�ضتقلة يف املغرب. ح�ضلت على دبلوم الدرا�ضات

الك�شندرا بلفريج: تتوفر على اثني ع�رش عاما من اخلربة يف قطاع التنمية والتوا�ضل. بداأت م�ضارها املهني يف فرن�ضا يف من�ضب مديرة للتوا�ضل يف القطاع اخلا�ض لينتقل اهتمامها بعد ذلك اإىل امل�ضاريع الثقافية الكربى. انتقلت اإىل ا�ضرتاليا لتلتحق ب "رويال بوتانيد غارجنز"، وهي منظمة بيئية ذات �ضهرة عاملية. انتقلت بعد ذلك اإىل املغرب يف 2005 حيث اأ�رشفت على تنفيذ م�ضاريع تنموية كربى لفائدة جهات مانحة دولية مثل الوكالة االأمريكية للتنمية الدولية وموؤ�ض�ضة حتدي االألفية. ت�ضتغل يف م�ضاريع للتعليم وحمو االأمية والتكوين املهني وروح املبادرة وتعزيز قدرات املجتمع املدين. ويف هذا ال�ضياق، تقدم ال�ضيدة بلفريج امل�ضاعدة ملنظمات غري حكومية عديدة. على اعتبارها م�ضت�ضارة دولية يف جماالت التوا�ضل واالإعالم والتنمية، ن�رشت منذ عام 2010، العديد من الدرا�ضات مع اليون�ضكو حول و�ضائل االإعالم والو�ضول اإىل املعلومات العامة يف املنطقة

املغاربية. ت�ضتغل منذ 2012 مديرة عامة مبوؤ�ض�ضة خا�ضة.

دافيد باني�شار: كبري امل�ضت�ضارين القانونيني مبنظمة Article 19 )املادة 19(، التي تقود احلملة العاملية حلرية التعبري، ي�ضهر على تقدمي اخلربة والتوجيه بخ�ضو�ض حرية التعبري وحرية االإعالم. �ضارك يف العديد من التظاهرات الدولية املرتبطة بالو�ضول اإىل املعلومات واخل�ضو�ضية والق�ضايا لالأهداف الدعاية منخرطا يف وكان 2012 ريو قمة �ضارك يف كما والدعاية، ال�ضيا�ضية واالأبحاث اال�ضرتاتيجيات وو�ضع باالنرتنت املرتبطة الدولية واملحلية مبا يف ذلك املحكمة االأوروبية حلقوق اأمام املحاكم الق�ضايا املعرو�ضة القانونية يف االإمنائية لالألفية. ا�ضطلع ب�ضياغة املذكرات

االإن�ضان وحمكمة الدول االأمريكية حلقوق االإن�ضان، باالإ�ضافة اإىل حتليل الت�رشيعات الوطنية.

ادري�ش عي�شاوي: يتوفر على تكوين اقت�ضادي وهو م�ضت�ضارا لعدة موؤ�ض�ضات وطنية ودولية يف جمال التنمية. يدير حاليا موؤ�ض�ضة خا�ضة متخ�ض�ضة يف جمال التوا�ضل املوؤ�ض�ضاتي. بداأ م�ضواره ال�ضحفي مع املنابر الناطقة بالعربية والفرن�ضية. عمل مرا�ضال ليونايتد بر�ض انرتنا�ضونال يف املغرب. وهو اأ�ضتاذ زائر يف جمال توا�ضل املقاوالت وموؤلف لعدد من الدرا�ضات يف جمال االإعالم وال�ضحافة لفائدة منظمات وطنية ودولية. اأدار ال�ضيد عي�ضاوي عدة منابر اإعالمية وكان م�ضوؤوال عن اإعادة هيكلتها يف جمال ال�ضحافة املكتوبة واالإعالم االإلكرتوين. يعمل م�ضت�ضارا لدى منظمات دولية يف جمال التوا�ضل وو�ضائل االإعالم. كاتب اأعمدة يف عدة منابر وطنية ودولية. �ضارك يف عدد من الدورات التكوينية والتبادل املهني يف اأوروبا والواليات

عبد الله دكيك: يف ر�ضيده 20 عاما من اخلربة يف جمال تكنولوجيا املعلومات. مدير عام فرع �رشكة BTNet2S ب�ضمال اأفريقيا. لديه تكوين يف عدة جماالت خا�ضة يف تدبري واإدارة املوارد الب�رشية. بعد م�ضار مهني ممتاز يف العديد من ال�رشكات، التحق ال�ضيد دكيك يف �ضنة 1997 ب�رشكة التحق 2001 عندما �ضنة الريادية يف بداأ جتربته االإقليمي. ثم املحلي ال�ضعيدين �ضغل منا�ضب خمتلفة على اأفريقيا، حيث �ضمال مايكرو�ضوفت باإحدى ال�رشكات اال�ضت�ضارية قبل �رشائها من قبل جمموعة Net2s. مت تعيينه، بعد �رشاء ال�رشكة الربيطانية خلدمات االت�ضاالت العاملية للمجموعة، تكنولوجيات احتاد اإدارة كان ع�ضوا يف جمل�ض اأن وبعد ،2010 يناير اأ�ضبح يف .2009 اأبريل اأفريقيا يف �ضمال ال�رشكة يف لفرع عاما مديرا

عبد ال�شالم اأبودرار: رئي�ض الهيئة املركزية للوقاية من الر�ضوة. خريج املدر�ضة الوطنية للطرق والقناطر بباري�ض )1973( ورجل اقت�ضاد )جامعة حممد اخلام�ض بالرباط �ضنة 1980(، وهو حا�ضل على ماج�ضتري يف اإدارة االأعمال من اأحد اأرقى املعاهد الفرن�ضية. وقد عمل ال�ضيد اأبو درار يف بداية م�ضاره املهني يف جمال التجهيز والهند�ضة املدنية )1974 - 1998 ( مبختلف منا�ضب امل�ضوؤولية باالإدارة العمومية ) وزارة التجهيز( ويف جمال ال�ضناعات الهند�ضية وتقييم واإدارة ومتويل املقاوالت. يف �ضنة 1998، التحق ال�ضيد اأبو درار ب�ضندوق االإيداع والتدبري م�ضوؤوال عن قطب ت�ضجيع االحتياطي االجتماعي وتطوير اآليات االدخار )1998 - 2002(، قبل اأن تتم ترقيته كاتبا عاما لل�ضندوق ) نونرب2002( ثم مديرا عاما م�ضاعدا العام باالحتاد الر�ضوة حماربة جلنة ورئي�ض املغرب( - )تران�ضبارن�ضي لهيئة موؤ�ض�ض ع�ضو درار اأبو ال�ضيد اأن كما .) 2006( نف�ضها باملوؤ�ض�ضة ملقاوالت املغرب وع�ضو باملر�ضد االجتماعي الدويل، وهي هيئة جتمع كربيات املوؤ�ض�ضات واملنظمات النقابية العاملة يف ميدان تعزيز امل�ضوؤولية

ويف هذا االإطار ينظم املجل�ض الوطني حلقوق االإن�ضان ندوة دولية حول احلق يف احل�ضول على املعلومات. وت�ضتهدف هذه الندوة جمع ال�ضلطات العمومية واملوؤ�ض�ضات املنتخبة واملقاوالت العمومية واخلا�ضة ومنظمات املجتمع املدين ملناق�ضة املعايري الدولية التي ميكن ا�ضتثمارها مبنا�ضبة اإعداد

الن�ض القانوين املغربي حول احلق يف احل�ضول على املعلومات وكذا التداول ب�ضاأن ال�ضيا�ضات واملمار�ضات الف�ضلى املتبعة على امل�ضتوى الدويل.

ومن بني النتائج املتوخاة من هذه الندوة :1. الفهم اجليد للحق يف احل�ضول على املعلومة بغية حماية حرية الراأي والتعبري وتنمية الدميقراطية الت�ضاركية وحماربة الر�ضوة وتعزيز قدرات

املواطنني للم�ضاركة يف احلياة العامة و من اأجل �ضمان احلقوق االقت�ضادية واالجتماعية والثقافية؛2. حتليل املبادئ واالآليات الدولية التي ت�ضكل النظام القانوين للحق يف احل�ضول على املعلومات؛

3. حتليل مقارن لتجارب الدول التي اعتمدت قوانني دميقراطية وفعلية للحق يف احل�ضول على املعلومات من حيث االإطار القانوين وموؤ�ض�ضات الرقابة و�ضبل االنت�ضاف وحماية هذا احلق؛

4. تقدمي بع�ض التجارب الناجحة يف تطبيق هذا احلق بخ�ضو�ض: املقاوالت العمومية واخلا�ضة؛

املوؤ�ض�ضات املنتخبة كالربملان واجلماعات الرتابية؛ العدالة.

5. تقدمي حمالت املرافعة على ال�ضعيد الدويل واجلهوي والوطني من اأجل احلق يف احل�ضول على املعلومات التي ميكن اأن تكون مفيدة للمجتمع املدين املغربي؛

6. تعيني وحتليل التحديات التي يطرحها قانون احل�ضول على املعلومات، على م�ضتوى املمار�ضة؛

جدد االإ�ضالح الد�ضتوري ليوليوز 2011 ، التاأكيد على وفاء املغرب الختياره الذي ال رجعة فيه، لبناء دولة احلق الدميقراطية والتزامه باملبادئ واحلقوق وااللتزامات املن�ضو�ض عليها يف االتفاقيات الدولية املتعلقة بحقوق االإن�ضان كما هي متعارف عليها عامليا.

وتن�ض الديباجة كجزء ال يتجزاأ من الوثيقة الد�ضتورية على التزام املغرب "بحماية منظومتي حقوق الإن�سان والقانون الدويل الإن�ساين والنهو�ض "حظر ومكافحة كل اأ�سكال التمييز ب�سبب بهما وامل�ساهمة يف تطويرهما؛ مع مراعاة الطابع الكوين لتلك احلقوق، وعدم قابليتها للتجزيئ" و

اجلن�ض اأو اللون اأو املعتقد اأو الثقافة اأو النتماء الجتماعي اأو اجلهوي اأو اللغة اأو الإعاقة اأو اأي و�سع �سخ�سي مهما كان"

ومن بني احلريات واحلقوق االأ�ضا�ضية املن�ضو�ض عليها د�ضتوريا، احلق يف احل�ضول على املعلومة مبقت�ضى الف�ضل 27 الذي جاء فيه:"للمواطنات واملواطنني حق احل�سول على املعلومات، املوجودة يف حوزة الإدارة العمومية، واملوؤ�س�سات املنتخبة، والهيئات املكلفة مبهام املرفق العام. ل ميكن تقييد احلق يف املعلومة اإل مبقت�سى القانون، بهدف حماية كل ما يتعلق بالدفاع الوطني، وحماية اأمن الدولة الداخلي واخلارجي، واحلياة اخلا�سة للأفراد، وكذا الوقاية من امل�ض باحلريات واحلقوق الأ�سا�سية املن�سو�ض عليها يف هذا الد�ستور، وحماية م�سادر املعلومات واملجالت التي يحددها

القانون بدقة".الوطني حلقوق اأدرج املجل�ض له، الظهري املحدث املن�ضو�ض عليها مبقت�ضى االإن�ضان والنهو�ض بها، طبقا الخت�ضا�ضاته يف جمال حماية حقوق

االإن�ضان �ضمن اأولوياته امل�ضاهمة يف تن�ضيط احلوار الوطني بخ�ضو�ض املقت�ضيات الد�ضتورية املتعلقة بحقوق االإن�ضان واحلريات االأ�ضا�ضية.
