Minutes of the 1st Goa State Environment Impact Assessment Authority

(Goa- SEIAA) meeting held on 24th

February 2011 at 11. 30 a.m. in the

Conference Room of the Goa State Pollution Control Board (GSPCB),

Patto, Panaji.

The first meeting of the Goa-SEIAA was held on 24th

February 2011 at the

Conference room of the GSPCB under the Chairmanship of Mr. Jose Manuel Noronha,

Chairman, Goa-SEIAA. The list of members is annexed herewith.

At the outset, Mr. Michael M. D’Souza, Member Secretary, Goa-SEIAA welcomed

the Members and informed that the Ministry of Environment & Forests (MoEF) has

constituted the State Expert Appraisal Committee (Goa-SEAC) and State Environment

Impact Assessment Authority (Goa-SEIAA), as mandated in the Environment Impact

Assessment (EIA) Notification, 2006, in April 2010. Further, he requested Dr. Mohan R.

Girap, Secretary, Goa-SEAC to appraise the members on two important issues namely – (a)

salient features of the Environment Impact Assessment (EIA) Notification, 2006 and the

mandate as well as objectives for the constitution of SEIAA & SEAC in respective States

and (b) Modus operandi to scrutinize project proposal seeking prior Environmental

Clearance (EC) for construction-related projects.

Subsequently, Secretary, Goa-SEAC made PowerPoint (.ppt) presentations on these

aspects with reference to the State of Goa. Further, he informed that the Committee had

received seven proposals (07) from various project proponents which were ‘screened’ (in

the absence of issuance of any guidelines, till date, by the MoEF as regard to its sub-

categorization into B1 and B2) under category 8(a) (B2) – i.e. Building and Construction

projects with built-up area ≥ 20,000 sq. m. and < 1,50,000 sq. m.

2. The details of the proposals to be considered for issuing prior Environmental

Clearance (EC) are as under:-

1. Goa Cricket Association (GCA) for the proposed construction of international

cricket stadium in Acoi village near Thivim, Bardez taluka, North Goa.

2. M/s Alcon Constructions (Goa) Pvt. Ltd., Panaji for the proposed construction of

250-bedded Hospital-cum-hotel in Taleigao, Tiswadi taluka, North Goa.

3. M/s Rockfirst Real Estate Ltd., Mumbai for the proposed construction of residential

apartment in Reis-Magos, Alto-Betim, Bardez taluka, North Goa.

4. M/s Nitin Developers Pvt. Ltd., Panaji for the proposed extension of a construction

of residential complex in Socorro village, Bardez taluka, North Goa.

5. M/s Buildmore Infrastructure (India) Pvt. Ltd., Panaji for the proposed residential-

cum-commercial complex in Khorlim village near Mapusa, Bardez taluka, North

Goa.

6. M/s Gera Developments Pvt. Ltd., Pune for the proposed construction of premium

housing and commercial development in Khandola village, Ponda taluka, North

Goa.

7. M/s K. Raheja Universal Pvt. Ltd., Mumbai for the proposed construction of

residential complex in Carmona village, Salcete taluka, South Goa.

Further, Minutes of the First Goa-SEAC meeting were placed before the Authority for

detailed discussions and consideration. Chairman, Goa-SEIAA opined that common

recommendations of the Goa-SEAC be made mandatory for all the project proponents

except sr. no. (6) related to Corporate Social Responsibility (CSR), for which it was opined

that it would not be in the mandate of the SEIAA to so recommend. However, it is open for

the Government to decide in the matter. Thereafter, the matters were taken up on case-to-

case basis for detailed scrutiny.

Project-wise decisions are as under:-

A. Goa Cricket Association (GCA) has proposed to construct international cricket

stadium in 32 acres (i.e. 1,30,328 sq. m.) of land in Acoi village near Thivim in

Bardez taluka of North Goa district.

Member Secretary, Goa-SEIAA informed the members about the

communication received from the Ministry of Environment & Forests (MoEF)

dated 3rd

February 2011 conveying that the decision to issue forest clearance for the

proposed international cricket stadium has been kept in abeyance. In response to

the same, the Authority agreed to the observations / comments of the Goa-SEAC

and considered that the matter, being subjudice / under legal intervention, the

project proposal be granted prior conditional EC subject to the following:–

1. Compliance to the High Court directives in the matter related to the Writ

Petition No. 321/2010 and PIL W. P. No. 14/2010 filed in the Hon’ble High

Court of Goa at Bombay by M/s Goa Foundation as well as other Writ

Petitions filed, if any.

2. Response / NOC from the Ministry of Environment & Forests (MoEF) in the

matter related to forest clearance towards diversion of private forest for the

proposed developmental activity.

3. Submission of the Geotechnical soil analysis/report to ascertain the soil

characteristics as well as groundwater status and its recharge potential.

4. Provision of widening the State Highway – the only approach road to the

proposed project site, in addition to the provision for an alternate exit-road /

secondary road along the north-east periphery of the plot boundary to

minimize traffic congestion / vehicular movement.

5. Submission of location-specific details of the proposed bore well as well as

32 numbers of rainwater harvesting pits, superimposed on the contour map

of the proposed plot area on a decipherable scale (1:500).

6. Provision for exclusive fire-escape routes / staircase to avoid stampede

during such eventualities.

B. M/s Alcon Constructions (Goa) Pvt. Ltd., has proposed to construct a 250-bedded

hospital-cum-hotel (42 rooms) comprising of G + 5 upper floors and 1 basement in

11,988.67 sq. m. of land in Taleigao village of Tiswadi taluka of North Goa district.

The Authority agreed to the observations/comments of the Goa-SEAC and

considered that the project proposal be granted prior conditional EC subject to

compliance to the following:-

1. The proposed plot area, being an abandoned waste dumping site, 5 to 6 m of

top material is organic-rich fertile soil and should be utilized for landscaping

development in non-construction areas.

2. The project proponent (PP) must ensure that the effluents / waste water in

the adjoining St. Inez nallah should not infiltrate within the project site and

contaminate the groundwater quality as E. Coli concentration and Fe content

is reported to be higher in the bore-well water. Accordingly, PP should

indicate the modus operandi / technological intervention to be adopted to

tackle high bacteriological concentration in water, as it is likely to

contaminate operation theatre (OT) and other sensitive zones.

3. PP, on priority, should beautify the St.Inez nallah and its surrounding as

well as sufficiently widen the approach road to the site.

4. The proposed site, being very low-lying area, bears a sandy aquifer regime

and as such, it is advisable to built individual sump rather than soak pits to

treat waste-water effectively.

C. M/s RockFirst Real Estate Ltd., has proposed to construct residential apartment

“Ashoka Beleza” comprising of G + 3 storied complex (A + B + C) in 29,120.13 sq.

m. of land in Alto-Betim village of Bardez taluka in North Goa district.

The Authority agreed to the observations/comments of the Goa-SEAC and

considered not to grant prior EC for the proposed extension / developmental activity

in plot ‘A’.

D. M/s 2itin Developers Pvt. Ltd., proposes to construct residential complex in

22,896.38 sq. m. of land in Soccorro village in Bardez taluka of North Goa district.

Member Secretary, Goa-SEIAA informed the members about the

communication received from the project proponent in response to the Goa-SEAC

recommendations on the proposed project proposal claiming/justifying to be an

extension of an ongoing activity. Further, the PP has claimed that 60% of the

project has already been completed. As such, it appears that the said developmental

activity has been initiated without obtaining prior EC from the competent authority.

The Goa-SEAC has examined all issues in great detail and has provided its

comments / observations. The Authority agreed to the observations/comments of

the Goa-SEAC and considered not to grant prior EC for the proposed extension /

developmental activity.

E. M/s Buildmore Infrastructure India Pvt. Ltd., proposes to construct residential

building-cum-commercial complex in 9,416 sq. m. of land in Khorlim village in

Bardez taluka of North Goa district.

The Authority agreed to the observations/comments of the Goa-SEAC and

considered that the project proposal be granted prior conditional EC subject to

compliance to the following:-

1. The PP should opt for additional provision towards storage of optimum

quantity of rainwater to be utilized during fair-weather season, considering

the post-project usage of water.

2. The bore well drilled to carry out geotechnical soil investigation be

recharged suitably and be utilized in case of need-based urgency.

F. M/s Gera Developments Pvt. Ltd., proposes to carry out premium housing and

commercial development in net plot area of 1,21,383.27 sq. m. in village Khandola

in Ponda taluka of North Goa district.

The Authority agreed to the observations/comments of the Goa-SEAC and

considered that the project proposal be granted prior conditional EC for the

developmental activity which is proposed in phase-I and phase-II only, subject to

compliance to the following:-

1. The PP although, has submitted the ‘Sanad’, however, it should submit the sale

deed / power of attorney indicating the ownership status of the said plot area.

2. Geotechnical report (Annexure – III) enclosed with the project proposal does not

mention about (a) bore hole location and (b) soil profile. As such, it needs to be re-

submitted, preferably superimposed on contour map on 1:500 scale of the proposed

plot area.

3. Considering the shallow hydrogeological condition at the site, the PP should

indicate the modus operandi to treat / dispose-off the sewage.

4. The PP should opt for additional provision towards storage of optimum quantity of

rainwater to be utilized during fair-weather season, considering the post-project

usage of water. Accordingly, PP should indicate the site-specific locations of

storage tanks, recharge pond, existing water body, as applicable, without affecting

the natural drainage / storm water flow.

G. M/s K. Raheja Universal Pvt. Ltd., proposes to construct a residential project

“Raheja Chrysalis” in a plot area of 88,868 sq. m. in Carmona village of Salcete

taluka of South Goa district.

Member Secretary, Goa-SEIAA informed the members about the revision

petition under reference no. 138/2010 filed in the District Court at Margao, Goa, by

residents of Carmona village communication challenging the issuance of final NOC

for sub-dividing the 88,00 sq. mts. of land into 15 plots by the TCP. The complaint

filed by Shri. Victor G. Souza Egipsy & Shri. Orlando S. A. Da Silva was placed

before the Authority. The Authority, considering the above legal intervention,

opined to undertake a site-inspection of the proposed plot area on 3rd

March 2011 in

the presence of project proponents and complainant. As such, the Authority has

reserved its decision, pending the observation to be made during the field-visit as

well as the decision of the District Court in the matter.

Minutes of the 2nd

Goa State Environment Impact Assessment Authority

(Goa- SEIAA) meeting held on 24th

October 2011 at 03.30 p.m. in the

Conference Room of the Goa State Pollution Control Board (GSPCB),

Patto, Panaji.

The second meeting of the Goa-SEIAA was held on 24th

October 2011 at the

Conference room of the GSPCB under the Chairmanship of Mr. Jose Manuel Noronha,

Chairman, Goa-SEIAA. The list of members is annexed herewith (Annexure -1).

At the outset, Mr. Michael M. D’Souza, Member Secretary, Goa-SEIAA welcomed

the Members and briefed about the purpose to convene the said meeting after a period of 8

months. Further, he stressed the need to convene the Authority meeting on regular basis.

Subsequently, he placed the agenda items (Annexure – 2) before the Members for favour of

discussion, consideration and suitable decision in the matter.

Accordingly, project proposals submitted by (a) M/s �itin Developers Pvt. Ltd.,

Panaji and (b) M/s Rockfirst Real Estatae Ltd., Mumbai, who have requested for re-

consideration of their respective proposals were taken up initially for discussion followed

by fresh proposals submitted by following project proponents (PP) for seeking prior

Environmental Clearance as mandated under the EIA Notification, 2006 –

a. M/s Susheela Homes Properties Pvt. Ltd., Vasco-da-Gama for the proposed

expansion of Group Housing Project ‘Sea Winds’ in Vaddem village of of

Vasco-da-Gama in Mormugao taluka of South Goa district.

b. M/s Sattva Builders Pvt. Ltd., B’lore for the proposed construction of

residential project ‘Sattva Water’s Edge’ in Sancoale village of Mormugao

taluka of South Goa district.

c. M/s Phoenix Alcobevz Pvt. Ltd., Mapusa for the proposed establishment of

Pot-still distillation plant in Latambarcem village of Bicholim taluka of North

Goa district.

d. M/s Model Real Estate Developers, Panaji for the proposed construction of

residential complex ‘Models’s Status’ in Taleigao village of Tiswadi taluka of

North Goa district.

e. M/s Akar Creations Pvt. Ltd., Margao for the proposed construction of Group

Housing and Commercial project ‘Akar Excelsior’ in Vanelim village of Salcete

taluka of South Goa district.

In addition, the matter related to disbursement of remuneration towards ‘Sitting fees

/ site inspection’ to Goa-SEAC as well as Goa-SEIAA Members was discussed in light of

the Goa-SEAC recommendations.

Further, minutes of the Second, Third, Forth and Fifth Goa-SEAC meeting were

placed before the Authority for favour of perusal and information.

Project-wise decisions are as under:-

H. Re-consideration of the project proposal by M/s 2itin Developers Pvt. Ltd.,

Panaji for the proposed construction of residential complex in Socorro village

(survey no. 402/2, 404/5 & 402/2-C) of Bardez taluka in North Goa district.

Based on the Goa-SEAC comments, namely –

1. The PP is seeking prior EC from the Goa-SEIAA for the extension of the

ongoing construction / development as the built-up area, with the proposed

extension, exceeds 20,000 sq. mts. as per the EIA Notification, 2006.

2. Almost 40% of the total plot area has been developed and as a result,

appreciable proportion of naturally grown vegetation has been lost along the

moderate to steep sloping hill-slopes thereby disturbing the natural drainage,

green cover.

3. The proposed extension would further degrade the ecological set-up of the area

as the proposed construction-activity would invariably require cutting of trees

(loss of green cover) hill-slope cutting (slope instability and disturbance to

natural drainage).

4. The proposed activity is likely to affect the adjacent nala which may get silted /

diverted / flooded, especially during monsoon causing severe soil erosion.

5. The revised plan envisages construction of additional villas, which was believed

to be not a part of original proposal, submitted earlier.

The Authority agreed to the observations / comments of the Goa-SEAC and

considering the likelihood of environmental implications due to the proposed

developmental activity vis-à-vis project ambiguity. The Site needs to be re-

inspected by the SEIAA with Secretary, SEAC to ascertain the on-site conditions

prior to deciding the matter.

I. Re-consideration of the project proposal by M/s Rockfirst Real Estate Ltd.,

Mumbai for the proposed construction of residential apartments ‘Ashoka Beleza’ in

Alto-Batim, Reis Magos village (survey no. 57/1) of Bardez taluka in North Goa

district.

Based on the Goa-SEAC comments, namely –

1. The proposed project “A” is an extension of the ongoing work, being developed,

within two adjacent plots namely – ‘B’ and ‘C’ and is seeking prior

Environmental Clearance (EC) from the Goa-SEIAA, as the built-up area, taken

together, exceeds 20,000 sq. mts. as per the EIA Notification, 2006.

2. Almost 30% of the total plot area has been developed and as a result,

appreciable proportion of naturally grown vegetation has been lost along the

hill-slopes.

3. The proposed extension would further degrade the ecological set up of the area

as it would invariably require to clear green-cover / hill-slope cutting which is

likely to disturb the natural drainage as well as forest cover.

The Authority agreed to the observations / comments of the Goa-SEAC and

considering the likelihood of environmental implications due to the proposed

developmental activity vis-à-vis project ambiguity. It was decided that the PP should

look into the aspects of the observations made out by the SEAC and consider a proposal

for rejuvenation of alternate landmass for vegetation growth in the area / property to

ensure stability in the area. The PP should also look into the alternatives by maintaining

the existing ecological set up and construction to avoid hill / slope cutting so as to not

disturb natural drainage and forest cover. These aspects need to be looked at before

deciding the matter and representation made by PP.

J. M/s Susheela Homes Properties Pvt. Ltd., Vasco-da-Gama has proposed for

expansion of Group Hosuing Project “Sea Winds” in Vaddem village (Chalta No.

26(Part) of P.T. Sheet No. 69 & Plot Nos. 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20

of Chalta No. 2 of P. T. Sheet No. 68) of Vasco-da-Gama in Mormugao taluka of

South Goa district.

Based on the comments of the Goa-SEAC, the Authority agreed to the

recommendations and accordingly has decided to accord prior EC to the said project

as mandated in the EIA Notification, 2006, subject to the obtaining the ‘Structural

Stability Certificate’ from the competent authority concerned.

K. M/s Sattva Builders Pvt. Ltd., B’lore has proposed for construction of residential

complex “Sattva Water’s Edge” in Sancoale village (survey no. 199/2) of

Mormugao taluka of South Goa district.

Goa-SEAC, based on the site inspection vis-à-vis project presentations, has

recommended the project to accord prior EC subject to certain site-specific

modification / compliance as regards to hill-slope stability / soil excavation for the

cliff portion within the proposed plot area.

However, Dr. Mohan R. Girap, Secy., Goa-SEAC presented the e-mail

communication, dated 20th

September 2011, received from Mr. Piyush Agarwal –

representative of the firm, informing the O/o the Goa-SEAC that the PP intends to

“Revise” the proposed plan and would submit the modified plan in due course of

time for favour of suitable appraisal as mandated under the EIA Notification, 2006.

He further informed that the PP has submitted the revised plan with calculations in

which it is seen that area of 1913.58 sq.mts. has been reduced from the earlier

proposed 24,700 sq.mts. In view of the Goa-SEAC recommendations, the said

proposal may be considered to issue a prior EC.

L. M/s Phoenix Alcobevz Pvt. Ltd., Mapusa has proposed to establish a Pot-still

distillation plant in Latambarcem village (survey no. 299/1(part) & 301/0(part)) of

Bicholim taluka of North Goa district.

Based on the project details, site-inspection observations as well as

presentation made by the PP, the Goa-SEAC has requested to ascertain the distance

between proposed plot area and the nearest inter-state boundary. Accordingly, it

was conveyed by the PP vide its letter no. PAPL/GOA/007 dated 26th

September

2011 that the nearest distance from the proposed distillation plant (Survey no. 299/0

& 301/0) at Latambarcem to inter-state boundary (i.e. Maharastra) is 3.74 kms.

In view of the above and as per the General Conditions annexed to the

‘Schedule’ to the EIA Notification 2006, which states that - “Any project or

activity specified in Category ‘B’ will be treated as Category ‘A’, if located in

whole or in part within 10 km from the boundary of, and (iv) inter-State

boundaries and international boundaries:

Provided that the requirement regarding distance of 10 km of the inter-State

boundaries can be reduced or completely done away with by an agreement between

the respective States or U.Ts sharing the common boundary in case the activity does

not fall within 10 kilometres of the areas mentioned at item (i), (ii) and (iii) above”,

the Authority opined that the said project proposal is to be treated as Category ‘A’

and as such, the PP may be requested to forward the same to the Ministry of

Environment & Forests (MoEF) for further needful.

M. M/s Model Real Estate Developers, Panaji has proposed to construct a residential

complex in Taleigao village (survey no. 213/2) of Tiswadi taluka in North Goa

district.

Based on the project details, site-inspection observations as well as

presentation made by the consultant to the PP, Goa-SEAC has observed that the

proposed development is complete in all the respect and the PP is seeking Ex-post

facto EC (as against prior EC as mandated in the EIA �otification, 2006). Further,

the Committee has noted the phase-wise development of the said project in the

following manner –

1. Size of the proposed project – Total plot area – 27,389 sq. mts.

Total Built-up area – 32,636.16 sq. mts.

2. Date and Issue of Construction license – vide letter no.

VP/TLG/CONST.LIC/121/2005-2006/2276 dated 3rd

January 2006 issued

by Taleigao village Panchayat.

3. Date of starting of construction – 4th

January 2006

4. Date of completion – 15th

May 2008

5. Date and Issue of Completion Certificate – vide letter no.

149/1/PWD/DV/(B-N)/2008-09/SDI/478 dated 23rd

July 2008 issued by

PWD.

6. Date and issue of Occupancy Certificate – vide letter no. VP/TLG/09-

09/2330 dated 21st November 2008 issued by Taleigao Village Panchayat.

Based on the project details, referred above, the Authority has

convinced that the aforesaid developmental activity attracts either EIA Notification,

1994 (as the activity has started in January 2006) and would require prior EC from

the then Authority concerned (i.e. MoEF) or alternatively, as the project has been

completed in 2008 and as the total built-up area exceeds 20,000 sq. mts., the PP

needs to comply with EIA Notification, 2006 and require prior EC from the State

Authority concerned, being categorized as Category ‘B’ projects (8(a) – Building

and construction projects).

Thus, the Authority opines that the PP has violated / impinged upon the law, in

force at the relevant point of time. This issue needs to examin in light of instructions

issued by MoEF from time to time which covers such cases. Authority opined that

both Authorities Goa-SEAC and Goa-SEIAA recommend projects for prior EC and

not for Ex post-facto EC. It recommends to the State Government to take an

appropriate view based on the instructions of the MoEF before deciding the matter

and also explore the possibility from legal ambit whether any punitive action can be

taken for such ex post-facto cases.

N. M/s Akar Creations Pvt. Ltd., Margao has proposed to construct Group Housing

and Commercial complex in Vanelim village (survey no. 40/0) in Salcete taluka of

South Goa district.

Based on the project details, site-inspection observations as well as

presentation made by the PP, Goa-SEAC has observed the following –

1. Two communications received from the Ministry of Environment & Forests

dated 26th

May 2010 addressed to the Project Proponent (PP), copy of which

was endorsed to the Goa State Pollution Control Board (GSPCB), Goa-

SEIAA & CCF (refer Annexure – 3) and (b) 21-37/2009-iA III dated 7th

December 2010 addressed to the GSPCB – copy of which was endorsed to

Member Secretary, Goa-SEIAA and Chairman, Goa Coastal Zone

Management Authority (GCZMA) (refer Annexure – 4) were referred.

Accordingly, the letter referred to at (a) above has informed the project

proponent that the MoEF has closed the said project file and has delisted the

same from pending list and has requested to obtain the prior Environmental

Clearance (EC) by submitting a fresh proposal to SEIAA of Goa. While, the

letter referred to at (b) above seeks additional information from GSPCB on

(i) status of project at site/violation, etc., (ii) High Court Order / issues in the

complaint and (iii) any CRZ issue in the project so as to enable the MoEF to

examine and process the case further.

2. Further, latest communication received from the MoEF vide letter F. No. 21-

37/2009-IA.III dated 10th

June 2011 (refer Annexure – 5) has requested the

State Government to initiate necessary action under Environment

(Protection) Act, 1986 against the violation by the PP as the firm is in the

final stages of completion of 6 building blocks without obtaining prior EC.

In response to (1) and (2) above, the Authority opines that the PP has

violated / impinged upon the law, in force, by not obtaining the prior EC from

MoEF. It is not clearly known whether the project is actually de-listed by MoEF

or the same continues to receive the attention of the EAC of MoEF. This aspect

need to be clarified from MoEF. Further since there are specific directions to

State Govt. to initiate action under EPA, 1986; this information would be vital

to propose to the State Government to initiate suitable proceedings under

Section (5) of the Environment Protection Act (EPA), 1986. The legality of the

matter needs to be ascertained in consultation with MoEF as there are other

guidelines issued in regards with post facto clearances of projects.

O. It was also decided to approve Rs. 1,000/- (Rupees one thousand only) as sitting

fees per meeting attended as well as Rs. 500/- (Rupees five hundred only) per site

inspection conducted per day to Goa-SEAC as well as Goa-SEIAA members. It was

also agreed upon to establish a SEAC/SEIAA Secretariat at the Goa State Pollution

Control Board (GSPCB), Patto, Panaji and provide optimum required infrastructural

facility as well as Human Resources Component to enable smooth functioning of

SEAC/SEIAA. The Chairman, Goa-SEIAA also desired to coin a suitable ‘Logo’

and issue Identity and Visiting cards to all the Members.

of 220 KVA to be installed as a back-up facility.

Solid waste generated (residential-cum-floating) – 285

kgs./day (173 kgs. of organic & 114 kgs. of inorganic

garbage). Organic Waste Converter is proposed to be

installed to convert wet waste into manure. While,

inorganic waste is to be disposed through Municipal

Authorities.

Environment Management Plan (EMP) provides recurring

cost of 6.60 lakhs per year.

Water requirement - during construction 45 lpcd of water

requirement and during operation phase, 188 KLD of water

requirement is to be entirely sourced from Public Water

Department (PWD). During operational phase, about 150.4

KLD of waste water generated is expected to be treated in

170 KLD capacity STP. About 145 KLD of treated water

(at 95% of STP efficiency) will be utilized for landscaping

(28 KLD), car washing (20 KLD) and Municipal

authorities for watering public garden 997 KLD). In

monsoon season, this water will be discharged to the low-

lying areas.

Power requirement – During construction phase, 71 KVA

to be sourced from the Goa Electricity Dept.

During operational phase, 1355 KVA has been approved

by Goa Electricity Dept., However, Total Maximum

Demand is 1208 KVA. It is also proposed to install 7 nos.

of 25 KVA and 1 no. of 50 KVA D.G. sets as back-up

power supply. This would generate about 200 liters of

waste oil per annum to be disposed-off through authorized

recycler.

Solid waste generated – About 625 kgs./day to be treated

after due segregation at source, separately for

biodegradable and non-biodegradable wastes.

Environment Management Plan (EMP) has been prepared.

Goa-SEIAA has been communicated

accordingly on 19th September 2011.

Remarks: Considering the

uncertainty of the Regulatory

Authority (whether MoEF or Goa-

SEIAA), the Goa-SEIAA may

Goa State Environment Impact Assessment Authority (Goa-

SEIAA) meeting held on 5th

April 2012 at 10.00 a.m. onwards in the Conference Room

of the Goa State Pollution Control Board (GSPCB), Patto, Panaji

The third meeting of the Goa-SEIAA was held on 5th

April 2012 at the Conference

room of the GSPCB under the Chairmanship of Mr. Jose Manuel Noronha, Chairman, Goa-

SEIAA. The list of members is annexed herewith (Annexure -1).

At the outset, Mr. Michael M. D’Souza, Member Secretary, Goa-SEIAA welcomed

the Members and briefed about the purpose to convene the said meeting. Further, he

placed the agenda items (Annexure – 2) before the Members for favour of discussion,

consideration and suitable decision in the matter.

Subsequently, Dr. Mohan R. Girap, Secretary, Goa-SEAC briefed the Authority

about salient project details, developmental activities proposed by following four project

proponents namely –

(a) M/s Four Seasons Shelters – proposed construction of residential complex in

survey no. 20/1 (part), Sub. Div. No. 1(P) in Bainguinim village in Tiswadi taluka

in North Goa district.

(b) M/s Prithvi Consultant Pvt. Ltd., - proposed construction of residential complex

Survey no. 20/1 (part), Sub. Div. No. 1(P) in Bainguinim village in Tiswadi taluka

in North Goa district.

(c) M/s 2anu Estates Pvt. Ltd., - proposed construction of commercial-cum-

residential project in Chalta no. 27 of P.T. sheet no. 245 and Chalta no. 100 of P.T.

sheet no. 225 of Aquem village near Margao city in Salcete taluka of South Goa

district.

(d) M/s Commonwealth Developers Pvt. Ltd., - proposed construction of residential-

cum-commercial project in Chalta no. 3 (Sub. Div. 1 & 2) / P.T. sheet no. 118 and

Chalta no. 4(P), 5(P) & 18(P) / P.T. sheet no. 119 in village Gogol, near Margao

city, Salcete taluka, South Goa district.

Further, he conveyed the project-specific recommendations of the Goa-SEAC and

informed that Chairman, Goa-SEIAA has visited all the respective four sites on 17th

January 2012 so as to ascertain the ground status of proposed developmental activities.

Based on the Goa-SEAC recommendations, project-wise decision of the Goa-SEIAA is

as under:-

A. M/s Four Seasons Shelters – proposal is for construction of residential complex in

survey no. 20/1 (part), Sub. Div. No. 1(P) in Bainguinim village in Tiswadi taluka

in North Goa district.

Based on the comments of the Goa-SEAC, the Authority agreed to the

recommendations and accordingly has decided to accord prior EC to the said project

as mandated in the EIA Notification, 2006 subject to compliance to all the site-

specific observations of the Goa-SEAC.

B. M/s Prithvi Consultant Pvt. Ltd., - proposal is for construction of residential

complex Survey no. 20/1 (part), Sub. Div. No. 1(P) in Bainguinim village in

Based on the comments of the Goa-SEAC, the Authority agreed to the

recommendations and accordingly has decided to accord prior EC to the said project

as mandated in the EIA Notification, 2006 subject to compliance to all the site-

specific observations of the Goa-SEAC.

C. M/s 2anu Estates Pvt. Ltd., - proposal is for construction of commercial-cum-

residential project in Chalta no. 27 of P.T. sheet no. 245 and Chalta no. 100 of P.T.

sheet no. 225 of Aquem village near Margao city in Salcete taluka of South Goa

district.

Based on the comments of the Goa-SEAC, the Authority agreed to the

recommendations and accordingly has decided to accord prior EC to the said project

as mandated in the EIA Notification, 2006 subject to compliance to all the site-

specific observations of the Goa-SEAC.

D. M/s Commonwealth Developers Pvt. Ltd., - proposal is for construction of

residential-cum-commercial project in Chalta no. 3 (Sub. Div. 1 & 2) / P.T. sheet

no. 118 and Chalta no. 4(P), 5(P) & 18(P) / P.T. sheet no. 119 in village Gogol, near

Margao city, Salcete taluka, South Goa district.

Based on the comments of the Goa-SEAC, the Authority agreed to the

recommendations and accordingly has decided to accord prior EC to the said project as

mandated in the EIA Notification, 2006 subject to compliance to all the site-specific

observations of the Goa-SEAC

This was followed by a brief powerpoint (.ppt) presentation by M/s Berger Paints

(India) Ltd., Kundaim on its proposed on-site expansion in the production capacity of

paint products / ranges (i.e. Water-based emulsion and Distemper paint). Accordingly,

Authority sought clarification with regards to the following -

1. Detail process methodology proposed to be adapted during the contemplated

expansion activity vis-a-vis its variation, if any, in the requirements of – (a) raw

materials, (b) water and power consumption, (c) generation of pollutants / effluents

/ discharge, if any.

2. Environmental implications on land, water or air, if any, due to the proposed

expansion considering the unit’s close proximity to Boma village which is located

at the lower reaches along the periphery of the Kundaim Industrial Estate.

3. Impact on groundwater as well as modus-operandi proposed to be adapted for

rainwater harvesting and effective groundwater recharge.

Further, in order to clarify above-referred points as well as to ascertain the process

methodology, being adapted / proposed to be adapted, the Authority decided to conduct on-

site inspection of the said unit on 13th

April 2012 (Tuesday) from 10.00 a.m. onwards to

decide further course of action.

Accordingly, on-site inspection of the said unit was conducted as scheduled by Mr. Jose

M. Noronha, Chairman, Goa-SEIAA, Dr. A. G. Untawale, Member, Goa-SEIAA, Dr.

Mohan R. Girap, Secretary, Goa-SEAC, Mrs. Anita Barreto, Member, Goa-SEAC in the

presence of Mr. Prasenjit Chakrabarty, General Manager (Works) of M/s Berger Paints

(India) Pvt. Ltd., Kundaim. Later, he briefly explained about the batch process

methodology being adapted in the manufacture of paint variants. During the discussions

and subsequent deliberations as well as site-specific observations, following points were

emerged out namely –

a. The project proponent should ascertain the information pertaining to census data

(i.e. total population as well as SC/ST proportion), socio-economic status of

surrounding villages.

b. The environmental consultant should have been made aware about the local

site-specific geographical status vis-a-vis land use/land cover within the

immediate periphery of the project site.

c. It was felt necessary that a project proponent should prepare a contour map, on a

decipherable scale (i.e. 1:500 or 1:1,000), so as to understand the localized

topography as well as slope gradient within the project site for effective

implementation and execution of micro-level planning to adapt Rainwater

Harvesting initiatives.

d. The project proponent should prioritize the recharging capacity of the existing

bore-well by adapting to roof-top rainwater harvesting measures so as to meet

its in-house water requirements with less dependency on external water source.

e. The project proponent should adapt to appropriate technological intervention so

as to minimize and conform to ‘Zero Discharge’ concept considering its site-

specific location, being on the hill-top with settlement areas along the foot-hills.

Accordingly, it was decided to obtain relevant details from the project proponent to

comply with points (1) to (3) and as (a) to (e) above prior to decide the matter and may be

considered during the next Goa-SEIAA meeting.

Subsequently, Dr. A. G. Untawale, Member (Goa-SEIAA) desired to know the modus-

operandi as well as to revisit the ‘penalty clause’ against the violators while invoking

Section 5 of the Environment (Protection) Act, 1986. However, Chairman, Goa-SEIAA

opined to deliberate the issue in detail and take up the same as an independent Agenda Item

during the next Goa-SEIAA meeting on priority.

E. Consideration of the proposed on-site expansion by M/s Berger Paints India Ltd.,

Kundaim in production capacity of paint products / ranges (i.e. Water-based

Emulsion and Distemper paint). The said proposal has already been appraised by

the EAC (i.e. Expert Appraisal Committee) of the Ministry of Environment &

Forests (MoEF), New Delhi in 2010 in the absence of constitution of Goa-

SEAC/Goa-SEIAA at that time. Subsequently, the MoEF had suggested Terms of

Reference (ToRs') to conduct the EIA study and accordingly, M/s Kadam

Environmental Consultants - NABET / QCI accredited Consultant has carried out

the study incorporating these ToRs' and has submitted the same to the O/o the Goa-

SEIAA for seeking prior EC as mandated under the EIA Notification, 2006.

(Accordingly, the proposal was presented at the Sixth Goa-SEAC meeting held on

7th

December 2011 and has recommended the project, pending on-site inspection.).

Minutes of the 4th

Goa State Environment Impact Assessment Authority

(Goa-SEIAA) held on 10th

August 2012 at 11.00 a.m. in the Conference room of

the EIA Secretariat, O/o Goa State Pollution Control Board (GSPCB), Patto

The forth meeting of the Goa-SEIAA was held on 10th August 2012 in the Conference room

of the GSPCB under the Chairmanship of Mr. Jose M. Noronha. The list of members is annexed

(refer Annexure – 1.

At the outset, Chairman welcomed the Members and informed about the purpose of

convening the meeting in order to consider the project proposals as per the ‘Agenda Items’ (refer

Annexure – 2) for detailed deliberation / discussions as well as suitable decision in the matter for

onward perusal of the State Government.

To begin with, a request forwarded by M/s Prithvi Consultants Pvt. Ltd., Panaji for

rectification/correction to be made in respect of (i) Total plot area, (ii) Total built-up area

and (iii) Parking facility as against mentioned in the prior EC granted by Goa-SEIAA on

30th

April 2012 for the proposed residential-cum-commercial project in Bainguinim village

in Tiswadi taluka, North Goa district. The requested submission was verified with the

original documents, as forwarded by the proponent at the time of project submission,

available with the O/o the EIA Secretariat and accordingly, it was decided to issue relevant

‘amendment’ to the prior EC in respect of above-referred parameters.

This was followed by a brief presentations by –

a. M/s Bandekar Brothers Pvt. Ltd., Vasco-da-Gama for proposed construction

of Ore-loading Jetty at Kotambi in Bicholim taluka of North Goa district.

Based on the comments / recommendations of the Goa-SEAC vis-a-vis

clarification provided by the Project Proponent (PP) in response to project-

specific observations, the Authority agreed to the recommendations and

accordingly has decided to accord prior EC to the said project as mandated in

the EIA Notification, 2006 subject to conducting site-specific bathymetric

mapping / hydro-dynamic study of the estuarine portion within close proximity

of the proposed site.

b. M/s Ganesh Benzoplasts Ltd., Mumbai for proposed construction of two

storage tanks at Marmagoa, in South Goa district.

Based on the comments / recommendations of the Goa-SEAC vis-a-vis

clarification provided by the PP in response to project-specific observations,

the Authority conducted site-inspection on 13th

August 2012 so as to clarify

and ascertain on-site / off-site emergency preparedness mechanism proposed

to be adapted by the firm on operationalization of the proposed storage

facility. Accordingly, the PP has been requested to submit the details for

further scrutiny and suitable consideration prior to initiate any further action

in the matter.

c. The project proposals submitted by M/s Raj Housing Development Pvt. Ltd.,

Ponda for proposed construction of residential-cum-commercial projects at two

locations namely –

1. ‘Ral Enclave’ in P.T. sheet No. 8 of Chalta No. 01 within Mapusa Municipal

limits, Mapusa. (Built-up area – 30,244.17 sq.mts.)

2. ‘Raj Ryle Residency’ in P. T. sheet No. 14 of Chalta Nos. 40, 41, 42, 43, 45,

46, 47 & 48 and P. T. sheet No. 32 of Chalta Nos. 4 & 36 within Mapusa

Municipal limits. (Built-up area – 22,626.44 sq. mts.)

were deferred subject to clarification regarding– (i) submission of

Memorandum of Understanding (MoU) between the two parties regarding the

proposed demolition of private school and its re-location / re-construction at (1)

above and proposed demolition of three houses and their re-location within plot

premises at (2) above. (ii) to conduct project-specific inspection of two project

sites to understand location-specific characteristics vis-a-vis proposed

development.

d. This was followed by the discussions on compliance to site-specific

observations / revised EMP to be submitted by following Project Proponents

(PPs’), namely -

1. M/s 2itin Developers – On scrutiny of PP’s submission in response to project-

specific compliance sought vide this office letter no. 3/181/2010/STE-DIR/08

dated 30th

April 2012, the Authority deferred the decision pending site-

inspection as well as clarification/verification of project-specific details so as to

understand the current status of the proposed developmental activity at Socorro.

2. M/s Rockfirst Developers Pvt. Ltd., - On scrutiny of PP’s submission in

response to project-specific compliance sought vide this office letter no.

3/181/2010/STE-DIR/10 dated 30th

April 2012, the Authority deferred the

decision pending clarification/verification of project-specific details so as to

understand the current status of the proposed developmental activity at Alto-

Batim.

3. M/s Berger Paints (India) Pvt. Ltd., - On scrutiny of PP’s submission in

response to project-specific compliance sought vide this office letter no.

3/181/2010/STE-DIR/12 dated 7th

May 2012, the Authority has decided to

accord prior EC to the said project as mandated in the EIA Notification, 2006

for the proposed expansion at Kundaim.

e. Later, Mr. Michael D’Souza, M. S. (Goa-SEIAA) informed about the Hon’ble

Supreme Court “Order” issued dated 27th

February 2012 in a matter S. L. P. (c)

No. 19628 – 19628 of 2009 between Deepak Kumar & Others V/s State of

Haryana & Others, regarding the applicability of Environment Impact

Assessment (EIA) Notification, 2006 and requirement of EC to be granted by

the Goa-SEIAA prior to renewal or issuance of new lease (upto 50 ha.) for

extraction of minor minerals (i.e. Basalts, Sands, Laterite and River-pebbles) by

the Directorate of Mines and Geology – DoMG. Accordingly, it was suggested

that minor mineral lease holders will be directed to route their respective

applications, through the DoMG, being the Nodal Department vis-a-vis

custodian towards effective implementation of MMDR Act as well as the Rules

made there under.

Further, he also proposed that henceforth prospective project proponents

seeking EC, as mandated under the EIA Notification, 2006, be directed to pay

administrative-cum-processing charges, at the time of filing the applications

seeking prior EC, @ 0% – 5% of the entire project cost or Rs. 25,000/- per

proposal, whichever is higher. The charges, so collected, is intended to be

utilized towards project assessment / scrutiny, conducting site-inspection, sitting

fees, utility–cum-routine office expenses / consumables by the Goa-SEAC /

SEIAA.

Further, in response to non-compliance to the SCN issued by the Authority

to M/s Model Real Estate Developers, vide letter no. 3/181/2010/STE-DIR/09

dated 30th

April 2012, the Authority decided to direct the PP to submit

compliance within a week so as to consider the proposal during the forthcoming

Authority meeting for appropriate decision in the matter otherwise the proposal

is proposed to be de-listed.

Goa State Environment Impact Assessment Authority

(Goa-SEIAA) held on 18th

December 2012 at 11.00 a.m. in the Conference room

of the EIA Secretariat, O/o Goa State Pollution Control Board (GSPCB), Patto

The fifth meeting of the Goa-SEIAA was held on 18th December 2012 in the Conference

room of the GSPCB under the Chairmanship of Mr. Jose M. Noronha. The list of members is

annexed (refer Annexure – 1.

At the outset, Chairman welcomed the Members and informed about the purpose of

convening the meeting in order to consider and suitably forward the comments to the State

Government for its perusal and appropriate /approval decision in the matter. Accordingly, the

project proposals as per the ‘Agenda Items’ (refer Annexure – 2) were taken up for detailed

deliberation / discussions, namely -.

A. CO2SIDERATIO2 / DECISIO2 O2 OLD PROJECT PROPOSALS (03)

C. Final considerations / decision on the project proposals of -

1. M/s 2itin Developers, Panaji – proposed construction project at Socorro.

2. M/s Rockfirst Real Estate Ltd., Panaji - proposed construction at Alto-Batim

3. M/s Model Real Estate Developers, Panaji – proposed construction at Taleigao

a. M/s 2itin Developers, Panaji – The Project Proponent (PP) has sought EC for the

proposed expansion activity to the already constructed area involving built-up area

(BUA) of 19,934.70 sq.mts. at survey nos. 402/3, 404/5 and 402/C in village

Sucorro in Bardez taluka of North Goa district. It was informed that with the

proposed expansion to the said project, the total built-up area would increase to

29,007.74 sq.mts. of BUA (i.e. additional BUA of 9,073 sq.mts. is proposed during

the expansion).

b. M/s Rockfirst Real Estate Ltd., Panaji. – The PP has sought EC for the proposed

expansion activity in survey no. 57/1 of Reis-Magos village in Bardez taluka of

North Goa district, wherein it is understood that the proposed project ‘A’ is an

extension of the ongoing work being developed in plots ‘B’ and ‘C’, covering

BUA of 19,841.86 sq.mts, thereby resulting into total built-up area of 32,452.52

sq.mts. (i.e. additional BUA of 12,610.66 sq.mts. is proposed for construction in

plot ‘A’).

Based on the above facts, the Authority has understood that above-referred project

proponents (i.e. (a) and (b)) have sought post-facto EC (i.e. for proposed expansion to the

already constructed / developmental work resulting into the exceeding the total Built-Up

Area (BUA) more than 20,000 sq.mts.) as against Prior EC as mandated in the EIA

Notification, 2006.

In view of the above, the Authority has proposed to consider the proposals subject

to invoking penalty charges to respective Project Proponents (PP) to be mandatorily

payable @ Rs. 200/- per sq.mts. of built-up area being consumed on-site during the

existing construction / developmental work already completed. A such, the Government

may like to approve the same.

c. M/s Model Real Estate Developers, Panaji – The PP has sought Post-fact EC for

already constructed residential complex – ‘Model’s Status’ in survey no. Survey

no. 213/2 of Taleigao village in Tiswadi taluka in North Goa District covering total

built-up area (BUA) of 33,752.08 sq.mts.

The Authority has opined to defer its decision pending certain project-specific

clarifications vis-a-vis site-inspection of the project area.

B. CO2SIDERATIO2 OF DEFERRED (during last Authority meet) PROJECT

PROPOSALS (03)

E. Proposal by M/s Ganesh Benzoplasts Pvt. Ltd., Mumbai for construction of two

storage tanks for Butane and Propane within MPT port limit area at Sada in Marmagoa

of South Goa district.

Based on the site-inspection conducted by the Authority, the PP has been requested

to submit additional information pertaining to on-site and off-site emergency

management plan / preparedness initiatives proposed to be adapted. Accordingly, the

matter has been deferred subject to clarification sought.

F. Two proposals by M/s Raj Housing Development Pvt. Ltd., Ponda for construction

of residential-cum-commercial project namely –

3. ‘Ral Enclave’ in P.T. sheet No. 8 of Chalta No. 01 within Mapusa Municipal limits,

Mapusa. (Built-up area – 30,244.17 sq.mts.)

Based on the project details submitted, it is understood that –

1. In case of proposed developmental activity in (1) and after referring to

compliance/clarification sought on MOU between the school and the

Project Proponent (PP), the PP has submitted that it would demolish the

existing old private primary school and re-construct and relocate the same

within the plot area prior to initiate / undertake proposed developmental

activity of residential project on site. However, PP has no official records

w.r.t. any execution of sale deed / MOU in this regard being effectuated in

the past.

2. In case of proposed developmental activity in (2) above, as well as

compliance/clarification sought on MOU between the existing three house

owners (i.e. Vendors) and the Project Proponent (PP), the PP has submitted

the ‘Agreement’ to this effect.

Based on the above respective submissions by the PP, the Authority has proposed to re-

inspect these two sites in order to ascertain the site-specific environmental issues, likely to

be impacted vis-a-vis current land-use / land-cover of the proposed areas.

I. CO2SIDERATIO2 OF 2EW PROJECT PROPOSALS

A. Construction / Residential projects

Proposal by M/s Palacio Property Developers Pvt. Ltd., Panaji for proposed

expansion of a residential project comprising of 17 residential buildings with amenities –

playground, swimming pool in survey nos. 181/(P), 181/2, 181/3, 181/5(P), 182/7, 183/9,

180/1(P), 180/2(P), and 184/3 of St. Andre – (Near Lobo Garage), Goa Velha village in

Tiswadi taluka of North Goa district.

Considering the proximity of the proposed expansion activity to Zuari estuarine zone

vis-a-vis CRZ applicability, the Authority has proposed to conduct site inspection to

ascertain on-site status of the developmental activity prior to further recommendations.

B. 2ew / Renewal of Minor Minerals (road metal / laterite stones) quarrying lease

i. Renewal of one ‘Stone Quarry’ lease belonging to M/s Shailaja Vasudev Tamba

bearing no. 04/BA/07 located in Survey No. 11/1, 2 & 6 at St. Pedro, Village

Panelim, Tiswadi taluka, North Goa district. (SITE I�SPECTED BY Goa-SEAC)

ii. Renewal of two ‘Stone Quarries’ lease with common boundary belonging to M/s

Vasudev Tamba bearing no. 5/BA/MU/91 and 3/Basalt/05 located in Survey No.

11/1, 2 & 6 at St. Pedro, Village Panelim, Tiswadi taluka, North Goa district. (SITE

I�SPECTED BY Goa-SEAC)

iii. New lease of one “Laterite Quarry’ (proposed extraction – 240 cubic mt. per

month) belonging to Mr. Shirish Kamat covering lease area of 8,000 sq.mts. in

Survey no. 29/4 of Soliem village in Cacora of Quepem taluka in South Goa

district. (SITE I�SPECTED BY Goa-SEAC).

The Authority agreed to the recommendations of the Goa-SEAC and

considered the issuance of prior EC, subject to the compliance to the following

by the Directorate of Mines and Geology (DMG), Govt. of Goa, namely -

a. ‘Goa Mineral Concession (Amendment) Rules, 2012 notified by the

Directorate of Mines and Geology (DMG) and published in Official

Gazette Series-I, No. 24 dated 17th

September 2012.

b. Submission of ‘approved quarrying plan’ by the competent officer as

per Sub-rule (7) as well as specific compliance to Sub-rules 7(A) to 7(D)

of the above-referred Rules, as applicable.

c. Ascertaining the compliance to “Order” issued by National Green

Tribunal (NGT) dated 21st September 2012 in a matter related to Review

Application no. 8/2012 in Application No. 26/2012 and verifying that

the minor minerals lease areas referred in (i), (ii) and (iii) above do not

fall within the Ecologically Sensitive Zone (ESZ-1) as defined in the

Western Ghats Ecology Expert Panel (WGEEP) report.

Minutes of the 6th

Goa State Environment Impact Assessment Authority

February 2013 at 03.30 p.m. in the Conference room

of the EIA Secretariat, O/o Goa State Pollution Control Board (GSPCB), Patto.

The sixth meeting of the Goa-SEIAA was held on 7th February 2013 in the Conference

room of the GSPCB under the Chairmanship of Mr. Jose M. Noronha. The list of members is

annexed (refer Annexure – 1).

At the outset, Chairman welcomed the Members and informed about the purpose of

convening the meeting in order to consider and suitably forward the comments to the State

Government for its perusal and appropriate /approval decision in the matter. Accordingly, the

project proposals as per the ‘Agenda Items’ (refer Annexure – 2) were taken up for detailed

deliberation / discussions, namely -.

1. A proposal by Goa Industrial Development Corporation (Goa-IDC) seeking Renewal /

Extension of the prior Environmental Clearance (EC) for establishment of Common

Hazardous Wastes Treatment, Storage and Disposal Facility (CHWTSDF) in a land

admeasuring 1,10,390 sq.mts. in Survey No. 193/1 of Dharbandora village in Sanguem

taluka of South Goa district.

Comments - Based on the project-specific observations and recommendations of the

Goa-SEAC, the Goa-SEIAA decided to accord renewal / extension to the Prior

Environmental Clearance (EC) for the proposed establishment of landfill site for

storage, treatment and disposal of landfilliable part of the Hazardous Wastes (HW)

generated by the industries concerned located in the State of Goa specifying certain

“General” as well as “Project-Specific” conditions.

2. Final consideration / decision on the deferred project proposal of M/s Model Real

Estate Developers, Panaji for seeking post-facto EC, as against the prior EC as

mandated in the EIA Notification, 2006.

Comments – The Authority has decided to –

(a) Issue fine to the tune of Rs. 500/- per sq.mt. of already constructed built-up area

(calculated as per EIA Notification), as proposed, however subject to Government

approval to be payable by the Project Proponent (PP) for not complying with the

provisions of EIA Notification, as applicable.

(b) Issue Show Cause Notice (SCN) to the Town and Country Planning (TCP)

Department for violating the provisions of the erstwhile EIA Notification, 1994

considering the year of granting TCP clearance which was incidentally prior to

enforcement of the existing EIA Notification, 2006, in force from 14th September

2006.

3. M/s Ganesh Benzoplasts Pvt. Ltd., Mumbai for proposed construction of two storage

tanks for Butane and Propane within MPT port-limit area at Sada in Mormugao taluka

of South Goa district.

Comments - The Authority has decided to defer the aforesaid expansion proposal

considering occurrence of a past accidental disaster resulted due to sulphuric acid

leakage from one of the existing storage tanks located within the same complex and

thereafter proponent’s inability to tackle such hazards in timely safeguarding the

environmental consequences through on-site emergency response mechanism. It was

also decided to seek post-disaster safety audit report of the said accident from

Marmagoa Port Trust (MPT) prior to decide further course of action.

4. M/s Raj Housing Development Pvt. Ltd., Ponda for construction of TWO

residential-cum-commercial complexes within Mapusa Municipal limits.

Comments – The Authority, based on the submission of compliance by the Project

Proponent (PP) to site-specific observations, decided to accord prior Environmental

Clearance (EC) to the said developmental activity.

5. M/s Palacio Property Developers Pvt. Ltd., Panaji for proposed expansion of a

residential project in St. Andre, Goa Velha in Tiswadi taluka of North Goa district.

Comments – The Authority, subsequent to site-inspection conducted on 15th February

2013 and on-site observations / compliance, decided to accord prior Environmental

Clearance (EC) to the said expansion activity of a construction project.

6. M/s Pascoal Trindade Panaji for proposed constructions of “two independent

residential complexes” in separate survey numbers in Bambolim village of Tiswadi

taluka in North Goa district.

Comments – The Authority has decided to conduct site-inspection prior to consider the

proposal and decision in the matter.

7. As regard to following proposed developmental activities, the Authority deferred and

reserved its decision w.r.t. the following proposals, pending their site-inspection of

project areas concerned,–

1. M/s Trinitas Developers India Pvt. Ltd., Pune for proposed construction of

residential complex in Sancoale village in Mormugao taluka of South Goa district.

2. M/s Rajendra Prasad Singla, Margao for proposed construction of group

housing and commercial project in Bainguinim village of Tiswadi taluka of North

Goa district.

3. M/s Mahindra and Mahindra, Chennai for proposed construction of eco-resort

in Moitm village in Bardez taluka of North Goa district.

4. M/s Prive Realty Pvt. Ltd., Mumbai for construction of residential development

n Bambolim village of Tiswadi taluka of North Goa district.

8. 2ew / Renewal of Minor Minerals (road metal / laterite stones) quarrying lease

i. Renewal of one Laterite stone quarry – Lease no.13/Lat. Boulder/2007 –

The Authority agreed to the recommendations of the Goa-SEAC and considered the

issuance of prior EC, subject to the compliance to the following by the Directorate of

Mines and Geology (DMG), Govt. of Goa, namely -

d. ‘Goa Mineral Concession (Amendment) Rules, 2012 notified by the

Directorate of Mines and Geology (DMG) and published in Official Gazette

Series-I, No. 24 dated 17th September 2012.

e. Submission of ‘approved quarrying plan’ by the competent officer as per

Comments – The Authority considered the above-referred proposal as per the

‘Schedule’ annexed to the EIA Notification, 2006 and accordingly, it was appraised

that the total built-up area, proposed to be consumed, is less than 20,000 sq.mts.

and as such, the aforesaid project does not come under the purview of the EIA

Notification and hence does not require prior EC as mandated in the said

Notification. However, the proposal is required to be appraised as per the

provisions of the Coastal Regulation Zone (CRZ) Notification, 2011.

The seventh meeting of the Goa-SEIAA was held on 15th March 2013 in the Conference

8. Final decision on the Show cause notice dated 10/09/2012, issued to M/s Akar

Creations Pvt. Ltd., Margao to clarify and explain as to why the Environmental

Clearance bearing no. 3-181-2010/STE-DIR/20 dated 15/06/2012 should not be

revoked for concealment of the factual position/ misrepresentation by M/s Akar

Creations Pvt. Ltd to the Goa- SEIAA, with regard to the group housing and

commercial project “Akar Exclsior” in survey no. 40/0 of Vanelim village in Salcete

taluka, South Goa.

At the outset, Chairman informed the Members about the sequence of events with

reference to the above-referred project since its receipt by the Goa-SEIAA till date.

This sequence of events is contained in the ‘Background note’ enclosed with Annexure

– 2. The Chairman further informed the Members, that in accordance with the

directions of the National Green Tribunal (NGT), contained in Order dated 22nd

February 2013 passed in Appeal no. 52/2012, the Authority is required to decide the

said Show cause notice dated 10/09/2012.

The members perused the Background note’ enclosed with Annexure – 2 in detail

and also perused the documents with the Authority pertaining to the grant of

Environmental Clearance bearing no. 3-181-2010/STE-DIR/20 dated 15/06/2012, to by

M/s Akar Creations Pvt. Ltd. The documents/replies submitted by M/s Akar Creations

Pvt. Ltd. And the Colva Civic Consumer Forum in the matter of Show cause notice

dated 10/09/2012 were also perused.

On considering the submissions made by both the parties as per records with the

Authority and also on consideration of all the documents and records available with the

office of the Goa SEIAA with regard to the grant of Environmental Clearance dated

15/06/2012, and with regard to the Show cause notice dated 10/09/2012, the Authority has

noted as follows;

a. The Goa –SEIAA at its meeting held on 24/10/2011 had initially observed that the

project proponent had violated the provisions of the EIA Notification by not

obtaining prior Environmental Clearance before undertaking Construction

/expansion activity and as such issued a Show Cause Notice dated 30/04/2012 to

M/s Akar Creations Pvt. Ltd. directing them to Show Cause as to why action under

Section 5 of the Environment (Protection) Act, 1986 should not be initiated against

them for carrying out construction activity at their project without obtaining prior

Environmental Clearance.

b. M/s Akar Creations Pvt. Ltd. vide their letter dated 04/05/2012 has informed the

Goa SEIAA, that it had given an undertaking to the Hon. High Court of Bombay at

Goa (which is referred to at para 12 of order dated 20/03/2012 passed in WP No.

297/2009) that they undertake to deposit 6 lakhs with the concerned Authority that

was earlier MoEF but which is presently Goa-SEIAA and that Hon. High Court

has accepted the undertaking to pay the said amount to the Goa –SEIAA.

c. After considering the reply and clarifications submitted by M/s Akar Creations Pvt.

Ltd. the Goa- SEIAA vide order dated 14/06/2012, discharged the Show Cause

Notice dated 04/05/2012 and directed the project proponent to pay a penalty in the

form of a fine of Rs. 6 lakhs as per the submissions by the proponent to the Hon.

High Court in Writ Petition No. 297/2009.

d. On receipt of complaints dated 23/06/2012 and 13/08/2012 from the Colva Civic

and Consumer, the Goa SEIAA, has issued the present Show Cause Notice dated

10/09/2012, directing M/s Akar Creations Pvt. Ltd., to clarify and explain as to

why the Environmental Clearance bearing no. 3-181-2010/STE-DIR/20 dated

15/06/2012 should not be revoked for concealment of the factual position/

misrepresentation by M/s Akar Creations Pvt. Ltd to the Goa- SEIAA, as stated by

the CCCF.

e. M/s Akar Creations Pvt. Ltd. has replied to the aforesaid Show Cause Notice vide

reply dated 26/09/2012, wherein they have now specifically stated that the

undertaking given by them to the Hon. High Court of Bombay at Goa which is

referred to at para 12 of order dated 20/03/2012 passed in WP No. 297/2009, was

an undertaking to pay the amount of Rs. 6 lakhs to the Deputy Collector and Sub

Divisional officer towards conversion fees.

f. The Authority has also considered the Office Memorandum bearing no. J-

11013/41/2006—IA.II(I) dated 12/12/2012, issued by the MoEF. This Office

Memorandum deals with “Consideration of proposals for TORs/Environment

Clearance involving violation of the Environment (Protection) Act, 1986 /

Environment Impact Assessment (EIA) Notification, 2006 / Coastal Regulation

Zone (CRZ) Notification, 2011”

It further sates as follows

“ 2. Instances have come to the notice of this Ministry where without

obtaining the required clearance under the aforesaid Environment Impact

Assessment �otification, 2006 and / or CRZ �otification, 2011, the construction

/physical / operation activities relating to the projects have been started at the

sites. Such activities amount ot violations under the Environment (Protection_ Act,

1986 / EIA �otification, 2006 / CRZ �otification, 2011 (henceforth referred to as

violations).

3. �ow, it has been decided in that in supersession of this OM, the procedure

henceforth stated in this OM will be followed while dealing with such cases.

4. The violations could come to the notice of the Ministry at various staged of

processing of the proposals, i.e.:

i. Processing the case in the Ministry before referring the same to the Expert

Appraisal Committee (EAC) for TOR / Environment Clearance / CRZ

Clearance.

ii. During the deliberations in the EAC meeting and recorded as such in the

minutes of the meeting; and;

iii. Processing the case in the Ministry after the receipt

of recommendations of the EAC but before granting TOR/ Environment

Clearance /CRZ Clearance.

5. As soon as any case of violation comes / is brought to the notice of the

Ministry/EAC, the Ministry /EAC will proceed to verify the veracity of the

complaint though the concerned Regional Office of MoEF/ State Government,

/CMZA. Of Course, such verification will not be required in case the project

proponent does not content the allegation of violation. Once the Ministry / EAC is

satisfied that it is a violation case, before proceeding any further in the natter, the

following will need o be ensured in the matter.

i. The matter relating to violation will need to be put up by the Project

Proponent to the Board of Directors of its Company or to the Managing

Committee / CEO of the Society, Trust, Partnership /individually owned

concern for considering of is environment related policy / plan of action

as also a written commitment in the form of a formal resolution to be

submitted to MoEF to ensure that violations will not be repeated. For this

purpose, a time limit of 60 days will be given to the project proponent. In

the meantime, the project will be delisted. In the eventuality of not having

any response from the project proponent within the prescribed limit of 60

days, it will be presumed that it is no longer interested in pursuing the

project further and the project file will be closed, whereafter the

procedure will have to be initiated de novo by such project proponents.

ii. The State Government concerned will need to initiate credible action on

the violation by invoking powers under section 19 of the Environment

(Protection) Act, 1986 for taking necessary legal action under section 19

of the Environment (Protection) Act, 1986 for taking necessary legal

action under Section 15 of the Act for the period for which the violation

has been taken place and evidence provided to MoEF of the credible

action taken.

iii. The details of the project proponent and a copy of the commitment, etc.,

mentioned at (i) above will be put on the website of MoEF for information

of all stakeholders.

6. Once action as per para 5 above has been taken , the concerned case will

be dealt with and processed as per the prescribed procedure for dealing with

cases for grant of TORs/ Environment Clearance and appropriate

recommendation made by the EAC/decision taken by the Ministry as per the merit

of the case.

7. It may be clarified that the consideration of proposals for giving TORs/

Environment Clearance / CRZ clearance for violation cases will not be a matter

of right for teh project proponent. In cases of serious violations, the Ministry

reserves the right to outrightly reject such proposals and not consider the same at

al.

8. the aforesaid procedure, as stated in para 4 to 7 above will apply mutatis

mutandis to the cases handled at the State Level by the State Environment Impact

Assessment Authorities (SEIAAs) / State level Expert Appraisal Committees

(SEACs).

Decision:

On considering the aforesaid position the Authority is of the considered opinion that the

present case falls squarely within the ambit of the Office Memorandum bearing no. J-

11013/41/2006—IA.II(I) dated 12/12/2012, issued by the MoEF, and hence The Authority

decided as under;

i) M/s Akar Creations Pvt. Ltd. has carried out construction activity at their project, namely

“Group housing and commercial project “Akar Exclsior” in survey no. 40/0 of Vanelim

village in Salcete taluka, South Goa without obtaining prior Environmental Clearance.

ii) M/s Akar Creations Pvt. Ltd has concealed the factual position from the Goa SEIAA with

regard to the payment of the aforestated amount of Rs. 6 lakhs, thereby causing the Goa

SEIAA to discharge the Show Cause Notice dated 04/05/2012 issued to the project

proponent and to further issue the EC dated 15/06/2012 to M/s Akar Creations Pvt. Ltd.

iii) Notwithstanding initiation of criminal action by way of prosecution of the project

proponent for having constructed the project in question without obtaining prior

Environmental Clearance, and notwithstanding the fact that the Goa SEIAA, has

regularized the construction of the concerned project by issuing an Environmental

Clearance for the same, after payment of the aforestated sum of Rs. 6 lakhs, it is seen that

the present matter falls squarely within the ambit of the Office Memorandum bearing no. J-

11013/41/2006—IA.II (I) dated 12/12/2012, issued by the MoEF.

iv) As such M/s Akar Creations Pvt. Ltd is hereby directed to ensure compliance with the

guidelines as contained in para 5(i) of the Office Memorandum bearing no. J-

11013/41/2006—IA.II (I) dated 12/12/2012, issued by the MoEF.

v) It is directed to delist the said project, (in terms of the guidelines as contained in the OM

dated 12/12/2012, as referred to above) and to ensure that immediate action is initiated

against M/s Akar Creations Pvt. Ltd., (in terms of the guidelines as contained in para 5(i) of

the Office Memorandum bearing no. J-11013/41/2006—IA.II (I) dated 12/12/2012, issued

by the MoEF), under section 19 of the Environment (Protection) Act, 1986.

9. Two residential projects proposed by M/s Pascoal Trindade (a) in survey no. 93/2 of

Banbolim village and (b) 93/4 of Bambolim village of Tiswadi taluka in North Goa

district.

Decision : The Authority, subsequent to the detailed discussions/ deliberation on the

compliance submitted by the Project Proponent (PP), has considered the proposal for

issuance of prior EC subject to submission of additional scientific information on

existing flora existing within respective plot areas vis-a-vis its likelihood impact due to

proposed construction activity.

10. Subsequently, the Authority has considered the recommendations of the Goa-SEAC

and accordingly has decided to accord prior Environmental Clearance (EC) in

respect of the following new constructional projects, namely –

b. Proposed construction of residential complex in survey no. 117/1-A of Sancoale

village by M/s Trinitas Developers (India) Pvt. Lltd., Pune.

c. Proposed Group housing and Commercial project in survey no. 20/3 of Baiguinim

village by M/s Rajendra Prasad Singla, Margao.

d. Proposed construction of Eco-resort in survey no. 16 and 7 of Moitem village in

Bardez taluka by M/s Mahindra and Mahindra, Chennai.

e. Proposed expansion of residential development in survey no. 103/1, 103/2 and

104/1 of Bambolim village by M/s Prive Realty Pvt. Ltd., Mumbai.

f. Proposed expansion of residential complex in chalta no. 13 & 15 of P. T. sheet no.

299 of Margao city by M/s SRE Estate Developers, Margao.

11. Later, following proposals submitted by various Project Proponents seeking prior EC

so as to either renew or obtain new minor mineral quarry lease, as applicable, were

considered and accordingly, Authority has decided to –

1. Consider the following proposals,

a. 2ew ‘Laterite stone / rubble quarry’ (plot area – 4 Ha.) located in

Survey No. 15/2 of Costi village in Sanguem taluka of South Goa

district by Dr. Damodar T. Gaonkar, Sanguem.

b. Renewal of one ‘Basalt stone quarry’ (lease no. 05/Basalt/03 – 3.30

Ha.) located in Survey No. 70/1 of Santona village in Sanguem

taluka of South Goa district by Smt. Maria Alda Pinto, Sanguem.

c. 2ew ‘Laterite rubble stone quarry’ (plot area –15,000 sq.mts.)

located in Survey No. 38 of Codar village in Ponda taluka of North

Goa district by Shri. Shriram V. Gaonkar, Margao.

d. 2ew ‘Laterite rubble quarry’ (plot area –20,000 sq.mts.) located in

Survey No. 150 (Part-B) of Verna village in Salcete taluka of South

Goa district by Mr. Jaiwas 2aik, Sancoale.

e. Renewal of two ‘Basalt stone quarries by Mr. Manual Da Coasta.

i. Lease no. 05/Basalt/89 – plot area - 5 Ha. and

ii. Lease no. 04/Basalt/89 – Plot area - 4.9 Ha. Both located in

Survey no. 77/1(Part) and 72/1(Part) respectively of Santona

village in Sanguem taluka of South Goa district.

as recommended by the Goa-SEAC, for issuance of prior EC subject to

the compliance to the following by the Directorate of Mines and Geology

(DMG), Govt. of Goa, namely –

g. ‘Goa Mineral Concession (Amendment) Rules, 2012 notified by

the Directorate of Mines and Geology (DMG) and published in

Official Gazette Series-I, No. 24 dated 17th September 2012.

h. Submission of ‘approved quarrying plan’ by the competent

officer as per Sub-rule (7) as well as specific compliance to Sub-

rules 7(A) to 7(D) of the above-referred Rules, as applicable.

i. Ascertaining the compliance to “Order” issued by National Green

Tribunal (NGT) dated 21st September 2012 in a matter related to

Review Application no. 8/2012 in Application No. 26/2012 and

verifying that the minor minerals lease areas referred in (i), (ii) and

(iii) above do not fall within the Ecologically Sensitive Zone (ESZ-

1) as defined in the Western Ghats Ecology Expert Panel (WGEEP)

report.

2. Defer the decision of the following proposals pending site-specific

compliance w.r.t the proposed quarrying plan vis-a-vis Environment Management Plan

(EMP) as sought by the Goa-SEAC.

(a) Renewal of two ‘Basalt stone quarry’ leases by M/s Halarnkar

Industries, Mapusa. i. Lease no., 09/Basalt/90 – 5,200 sq.mts. located in Survey No.

i. Lease no. 03/Basalt/93 (Plot area – 2.32 Ha.) located in Survey no.

6/2(P) of Piliem village in Dharbandora taluka of South Goa

district.

ii. Lease no. 04/Basalt/93 (Plot area – 3.42 Ha.) located in Survey

no. 11/1(P) of Piliem village in Dharbandora taluka of South Goa

district. (This lease does not have a valid explosive magazine)

(e) 2ew ‘Laterite stone quarry’ (plot area – 7,180 sq.mts.) located in

Survey No. 42/0 of Muguli village in Sanguem taluka of South Goa

district by Shri. Rumaldo Fernandes, Sanguem.

3. Undertake site-inspection in respect of proposals mentioned at 1(e) and

2(a) to (d) above so as to ascertain project-specific status.

12. Later, the Authority considered following project proposals, forwarded by GCZMA, to

be appraised as per the New Hotel Policy framed by the State Government as well as

EIA Notification 2006. Accordingly and based on detailed deliberation, it was decided

to communicate to the GCZMA stating that these projects do not come under the

purview of said Notification however, respective Project Proponent (PP) needs to

obtain NOC from the Ministry of Environment & Forests (MoEF) / GCZMA, as

applicable, as mandated in the CRZ Notification, 2011 and the said hotel policy.

Minutes of the 8th

Goa State Environment Impact Assessment Authority

(Goa-SEIAA) held on 1st April 2013 at 04.00 p.m. in the Conference room of the

EIA Secretariat, O/o Goa State Pollution Control Board (GSPCB), Patto.

The eighth meeting of the Goa-SEIAA was held on 1st April 2013 in the Conference room

of the GSPCB under the Chairmanship of Mr. Jose M. Noronha. The list of members is annexed

(refer Annexure – 1).

At the outset, Chairman welcomed the Members and informed about the purpose of

convening the meeting at the very short notice. Accordingly, Agenda Items (refer Annexure – 2)

were taken up for detailed deliberation / discussions and suitable decision in the matter, namely -

13. The Authority, w.r.t. the matter pertaining to strengthening the EIA-Goa State

Secretariat has agreed to undertake –

a. Recruitment of staff on contract / temporary / deputation basis

b. Hiring / purchase of office premises to function independently

c. Charging of scrutiny fees from prospective project proponents (PPs’) at the rate

of 0.02% of the project cost but limited to Rs. 1 lakh only.

Accordingly, it was decided to put up a detailed proposal, justifying the need to strengthen

the Authority, to the Government for its approval prior to initiate any further action in the

matter.

14. The Authority decided to consider the following two expansion proposals

subject to payment of ‘penalty’ @ Rs. 500/- per sq.mts. of already constructed

area as on date and issue prior Environmental Clearance (EC) with a mandatory

compliance to provisions of the Office Memorandum (O.M.) issued by the

Ministry of Environment and Forests (MoEF), Govt. of India, New Delhi dated

12th

December 2012 namely – (a) ‘M/s Rockfirst Real Estate Developers,

Panaji and (b) M/s 2itin Developers Ltd., Panaji.

15. Following proposals, seeking New / Renewal for Minor Mineral Quarry Lease were

discussed / deliberated in response to the compliance to SEAC’s observation submitted

by respective project proponents followed by site-inspections conducted by the

Authority on 3rd

and 5th April 2013. Accordingly, the Authority has decided to

recommend the following proposals for grant of prior EC namely -

i. Renewal proposals by M/s Halarnkar Industries, Mapusa of two ‘Basalt stone

quarries’ namely –

1. Lease no., 09/Basalt/90 – 5,200 sq.mts.) located in Survey No. 272(P) of

village Casarvarnem in Pernem taluka of North Goa district.

Minutes of the 9th

Goa State Environment Impact Assessment Authority

(Goa-SEIAA) held on 12th

April 2013 at 12.30 p.m. in the Conference room of

The ninth meeting of the Goa-SEIAA was held on 12th April 2013 in the Conference room

of the GSPCB under the Chairmanship of Mr. Jose M. Noronha. The list of members is annexed

(refer Annexure – 1).

At the outset, Chairman welcomed the Members and informed about the purpose of

convening the meeting at the very short notice. Accordingly, Agenda Items (refer Annexure – 2)

were taken up for detailed deliberation / discussions and suitable decision in the matter, namely -.

1. As regard to proposal by M/s Leading Hotels Ltd., Panaji for setting up of a 18-hole

PGA-standard Golf course and Eco-tourism resort facility in survey nos. 2 to 13 of

Terekhol village in Pernem taluka of North Goa district admeasuring total area of 244.6

acres, the Authority, in response to a request by the Project Proponent (PP), has re-

appraised the said development activity as per the ‘Schedule’ annexed to the EIA

Notification, 2006 (as amended upto 13th March 2013) w.r.t. category 8(a) – Building and

construction project.

Decision – The Authority has appraised the aforementioned construction / development

activity as category ‘B’ project – 8(a) involving total proposed built up area (BUA) of

58,416 sq.mts. (i.e. ≥ 20,000 and < 1,50,000 sq.mts.) for which ‘General Conditions’ are

not applicable and has accordingly decided to grant prior EC. However, the Authority

argued that applicability of provisions under any other Notification, as applicable, needs to

be ascertained by competent authorities concerned.

2. As regard to non-compliance by M/s Model Real Estate Developers, Panaji, w.r.t the

issuance of communication directing the firm for payment of penalty charges for violation

of provisions of the EIA Notification, 2006, the Authority decided to file a case before the

Court of Junior Magistrate First Class (JMFC) as per the provision mandated in the

Environment (Protection) Act, 1986.

3. Following proposals, seeking New / Renewal for Minor Mineral Quarry Lease were

discussed / deliberated in response to the compliance to SEAC’s observation submitted by

respective project proponents. Accordingly, the Authority has decided to recommend the

following proposals for grant of prior EC namely –

i. Renewal proposals by M/s Joao Lourenco Baptista of two ‘Basalt stone

quarries’ namely –

a. Lease nos. - 01/Basalt/04 (7,150 sq.mts.) and 0 4/Basalt/04 (5,080

sq.mts.) located in survey no. 52/0 of Ugeum village in Sanguem

taluka of South Goa district.

ii. Renewal of one ‘Basalt stone quarry’ (Lease no.05/Basalt/00 – 7,000

sq.mts.) located in survey no. 62/1 of Santona village in Sanguem taluka of

South Goa district by M/s Mario Mascarenhas, Margao.

iii. 2ew ‘Laterite stone quarry’ (plot area – 2,000 sq.mts.) located in survey

no. 24/1 of Menkurem village in Bicholim taluka of North Goa district by

Shri. M/s 2ilu Jaidev Shetye, Bicholim.

iv. 2ew ‘Laterite stone quarry’ (plot area – 7,180 sq.mts.) located in survey

no. survey no. 42/0 of Muguli village in Sanguem taluka of South Goa

district by Shri. Shri. Rumaldo Fernandes.

v. 2ew ‘Basalt stone quarry’ (plot area – 4,000 sq.mts) located in survey no.

19/1(P) of Goculdem village in Quepem taluka of South Goa district by

M/s Anil Shaba Fal Dessai, Cuncolim.

vi. Renewal of ‘Basalt stone quarry’ (Lease no. 15/Basalt/88 - plot area –

5,400 sq.mts.) located in survey no. 12/1 of Damochem village in Sattari

taluka of North Goa district by M/s Kaloshi Granites, C/o Mr. B. A.

Xavier, Margao.

subject to the compliance to the following by the Directorate of Mines and Geology (DMG),

Govt. of Goa, namely –

a. ‘Goa Mineral Concession (Amendment) Rules, 2012 notified by the Directorate of Mines

and Geology (DMG) and published in Official Gazette Series-I, No. 24 dated 17th

September 2012.

b. Submission of ‘approved quarrying plan’ by the competent officer as per Sub-rule (7)

as well as specific compliance to Sub-rules 7(A) to 7(D) of the above-referred Rules, as

applicable.

c. Ascertaining the compliance to “Order” issued by National Green Tribunal (NGT) dated

21st September 2012 in a matter related to Review Application no. 8/2012 in Application

No. 26/2012 and verifying that the minor minerals lease areas referred in (i), (ii) and (iii)

above do not fall within the Ecologically Sensitive Zone (ESZ-1) as defined in the

Western Ghats Ecology Expert Panel (WGEEP) report.

In addition, it was decided that the renewal of lease in respect of “3(i) above” is subject to

ascertaining (a) update / outcome of the Public Interest Litigation (PLI) Writ Petition no. 10/2012

(i.e. Francis Xavier Carvalho V/s Dept. of Mines and Geology) and (b) current status / follow-up

action on ‘Suspension cum Show Cause Notice’ issued by the DMG dated 8th October 2012.
