    Loss or damage if an accident occurs whilst yourvehcile is being driven, or is in the charge of, anyperson covered by this Policy and that person isconvicted of an offence involving drink or drugs.

    Rights of Cancellation

    If this cover does not meet your requirements, pleasecontact your broker or agent within 14 days ofreceipt. We will return any premium paid less a prorata charge for the number of days for which coverhas been given.

    If you have an enquiry or complaint arising from yourPolicy, please contact the broker, intermediary oragent who arranged the Policy for you. If the brokeris unable to resolve your complaint or it is regardingthe terms and conditions of the policy they will refer itto NIG.

    Policy coverIf the cover shown in your schedule is:

    � comprehensive - all parts of the policy apply;

    � third party fire and theft - part 1 applies when itrelates to loss or damage resulting from fire oryour vehicle being stolen, and parts 2, 3 and 4apply; or

    � third party only - parts 2, 3 and 4 only apply.

    Our insurance contract with youThis policy is a contract between us and you. Nobodyelse has any rights they can enforce under thiscontract, and the Contracts (Rights of Third Parties)Act 1999 shall not apply (except as set out in theRoad Traffic Acts).

    The proposal and declaration you made form thebasis of this policy.

    We will provide insurance as shown in:

    � this policy, as amended by the schedule, whichshows any changes to the policy; and

    � the certificate of motor insurance, which isevidence of the motor insurance you need by law.

    The insurance applies throughout the United Kingdomexcept where we say otherwise.

    The Commercial Vehicle policy is underwritten by U KInsurance Limited and will run for 12 months or asshown on the schedule.

    The Law applicable to this contractUnder European Law, you and we may choose whichlaw will apply to this contract. English Law will applyunless both parties agree otherwise.

    We have supplied this Agreement and otherinformation to you in English and we will continue tocommunicate with you in English.

  • Part 1 | Loss or Damage

    Policy Cover Part 1 | Loss or Damage

    What is insuredYour vehicle if it is damaged, stolen or taken withoutyour permission.

    Accessories and spare parts fitted to your vehicle orin your private garage if they are damaged, stolen ortaken without your permission.

    We will at our option:

    � pay for the damage to be repaired; or

    � repair or replace what is stolen or damaged; or

    � pay the amount of the loss or damage.

    If you are registered for VAT you are required tominimise your loss by recovering VAT on the cost ofrepairs and replacement goods to the extent allowedby law.

    We will not pay more than the market value of yourvehicle at the time the loss or damage happened. Thiswill not be more than the amount you paid for it. Wewill not pay any costs which increase the market valueof your vehicle.

    Where we have agreed to pay the market value ofyour vehicle and payment is made to you the vehiclewill become our property.

    If your vehicle is under a hire-purchase or leasingagreement, we will make any payment for the totalloss of your vehicle to the hire-purchase or leasingcompany.

    We will also pay the reasonable cost of taking yourvehicle to the nearest repairer and returning it to youraddress after the repairs have been carried out.

    Provided that the policy is still current, we will alsotemporarily insure any motor car supplied to youunder the NIG recommended repairer network whilstyour car is being repaired as a direct result of damagecovered by this policy. The cover for a car suppliedunder this paragraph will be comprehensive, even ifthe policy cover is third party, fire and theft.

    If the car is still in your possession at the time thisinsurance expires, you must renew this insurance tomaintain cover for the temporary car.

    What is not insureda Loss of use, loss of market value for any reason,

    deterioration or wear and tear.

    b Mechanical, electrical, electronic or computerfaults, failures, malfunctions or breakdowns.

    c Damage to tyres from braking or by roadpunctures, cuts or bursts.

    d Loss of, or damage to, your vehicle as a result of itbeing stolen or taken without your permissionunless you make a report to the police and get acrime reference number.

    e Loss of, or damage to, your vehicle as a result ofsomeone getting it by fraud or trickery whilepretending to be a buyer.

    f Loss of, or damage to, your vehicle as a result of itbeing stolen or taken without your permission atany time if:

    � an ignition key or any similar device is left in oron the vehicle; and/or

    � all doors, roofs, windows and all otheropenings have not been closed and locked;and/or

    � any security or tracking device, which you havetold us is fitted to your vehicle, has not beenset or is not in working order:

    g Loss of your vehicle resulting from it beingrepossessed and returned to its rightful owner.

    h Confiscation or destruction of your vehicle by, orunder the order of, any government or public orlocal authority.

    i More than £500 for permanently-fitted audio,television, video, computer or computer games,telecommunication and navigational equipmentunless it is standard equipment for your vehiclewhen built and your policy cover is comprehensive.

    j More than £250 for permanently fitted audio,television, video, computer or computer games,telecommunication and navigational equipment, ifthe policy cover is third party fire and theft.

  • Part 1 | Loss or Damage Policy Cover

    What is insuredOther parts, which will have a warranty from theirmanufacturer and our approved repairers, may befitted during repairs.

    If we cannot get a replacement part or accessory, wewill pay the manufacturer’s last list price.

    You may authorise repairs if the estimated cost is notmore than £250, but you must send us a detailedestimate immediately.

    If you have comprehensive cover and you claim forbroken glass in your vehicle windscreen or windowsor scratched bodywork caused by the broken glass, itwill not reduce your No Claim Bonus.

    What is not insuredk More than £500 for accessories and spare parts

    in your private garage.

    l Loss of, or damage to, any trailer or caravan,whether attached to or detached from yourvehicle.

    m The cost of replacing vehicle locks orreprogramming or replacing any vehicle theftdevice as a result of the loss of the vehicle keys.

    n The first amount you must pay shown underendorsements added to the schedule.

    o Loss of, or damage to, your vehicle as a result ofits tipping mechanism in operation.

    p Loss or damage if an accident occurs whilst yourvehcile is being driven, or is in the charge of, anyperson covered by this Policy and that person isconvicted of an offence involving drink or drugs

    q Any amount greater than £125 if you do not useour approved windscreen supplier.

  • Part 2 | Liability to Others

    Policy Cover Part 2 | Liability to Others

    What is insuredWe will insure you for all amounts (subject to thelimits set out below) you legally have to pay forcausing the death of, or injury to, any person ordamage to their property as a result of an accidentcaused by any vehicle which your certificate of motorinsurance allows you to drive or use. This includestowing a trailer, caravan or broken-down motor vehicleif your certificate of motor insurance allows it. Thistowing must be allowed by law and the vehicle beingtowed must be properly attached to your vehicle.

    We will provide the same insurance to the followingpeople:

    � Anyone you allow to drive your vehicle if they areallowed by your certificate of motor insurance.

    � The employer of anyone you allow to drive yourvehicle if they are allowed by your certificate ofmotor insurance.

    If you ask, we will provide the same insurance to thefollowing people in the event of an accident:

    � Anyone you allow to use (but not drive) your vehiclefor social, domestic and pleasure purposes.

    � Anyone travelling in or getting into or out of your vehicle.

    We will insure the estate of anyone insured by thispolicy against any liability covered by this policy thatthey may previously have had if they die.

    As long as the claim is insured by this policy, we will,with our prior agreement, pay for a solicitor orbarrister to:

    � represent anyone insured under this policy at acoroner’s inquest or fatal accident inquiry; or

    � defend anyone insured under this policy in a court.

    If there is an accident insured by this policy, we willpay for emergency medical treatment that must beprovided under the Road Traffic Acts. This will notreduce your No Claim Bonus.

    What is not insureda Liability for death of, or injury caused to, any

    person while they are working with or for anyoneinsured by this policy (except as set out in theRoad Traffic Acts).

    b Anyone who has other insurance covering thesame liability.

    c Liability for loss of, or damage to, property whichbelongs to, or is in the charge of, any person whois insured by this policy.

    d Liability for more than £2,000,000 other than thatwhich is required by the Road Traffic Acts forcausing death or bodily injury.

    e Liability in connection with loading or unloadingyour vehicle when it is off the road.

    f Liability for loss or damage caused in a placewhere aircraft land, park or move, including theassociated service roads, refueling areas, andground equipment parking areas.

    g Liability for pollution or contamination unless it iscaused by a sudden and identifiable event which isaccidental and unexpected.

    h Liability caused by acts of terrorism as defined inthe Terrorism Act 2000 unless we have to providecover under the Road Traffic Acts.

  • Part 3 | No Claim Bonus

    Part 3 | No Claim Bonus Policy Cover

    If no claim is made under this policy, we will reducethe premium you pay when you renew it according toour current scale of No Claim Bonus. You cannottransfer this bonus to another person.

    If you have not paid all the premiums you owe, we willnot issue proof of your No Claim Bonus.

    In the event of a claim being made the No ClaimBonus will be stepped back in accordance with thefollowing scale:

    Your No Claim Bonus will not be reduced as long aswe have got back all that we have paid from thosewho are responsible.

    Protected bonusIf this is shown in your schedule, your No ClaimBonus is protected. You will keep your No ClaimBonus protection unless you have;

    � more than one claim in a period of cover; or

    � more than two claims in any three periods of coverin a row.

    If we have to reduce No Claim Bonus we will do so asfollows.

    Part 4 | Foreign Use

    Compulsory coverThis policy provides the compulsory cover you needby law to use your vehicle covered in:

    � Any country which is a member of the EuropeanUnion.

    � Any country which the Commission of theEuropean Community approves as meeting therequirements of Article 7 (2) of the EuropeanCommunity Directive on Insurance of CivilLiabilities arising from the use of motor vehicles(no72/166/EEC) as amended.

    See list of countries on Page 14.

    Full policy coverYou may ask us to extend the policy to give the covershown in your schedule. If we agree to do this, youmust give us full details including who will drive andwhat your vehicle will be used for, and pay an extrapremium. This will cover your vehicle while it is in andbeing transported between any countries shown inthe International Motor Insurance Card (Green Card)or the United Kingdom.

    If you cannot drive the vehicle because of loss ordamage covered by this policy, we will also pay thereasonable cost of delivering it to your address in theUnited Kingdom.

    We will also pay the amount of customs duty you haveto pay as a result of the loss or damage.

  • General Exceptions

    General Exceptions Policy Cover

    1 This policy does not provide insurance when anyvehicle covered is:

    a being driven by, or in the charge of, anyone notcovered in your certificate of motor insuranceor schedule;

    b being used for purposes that are not shown inyour certificate of motor insurance;

    c being driven with your permission by anyonewho you know has not got a driving licence orwho you know is disqualified from holding orgetting a licence; or

    d being driven by or in the charge of anyone whodoes not keep to the conditions of their drivinglicence

    Any cover you have for loss of, or damage to, yourvehicle continues while the vehicle is beingrepaired or serviced by a member of the motortrade.

    2 This policy does not insure liability which anyonecovered by this policy has as a result of anagreement or contract unless they would have hadthat liability if the agreement or contract did notexist.

    3 This policy does not insure any loss or damagecaused by war, revolution or any similar event.

    4 This policy does not provide insurance exceptunder part 2 (Liability to Others) for any accident,injury, loss or damage caused by:

    a an earthquake; or

    b riot or civil commotion if it happens outsideGreat Britain, the Isle of Man or the ChannelIslands.

    5 This policy does not provide insurance for anyloss, damage or liability caused directly orindirectly by:

    � ionising radiation or contamination by radiationfrom any irradiated nuclear fuel or from anynuclear waste from burning nuclear fuel; or

    � the radioactive, toxic, explosive or otherdangerous properties of any explosive nuclearequipment or any part of it.

    6 We will not insure legal proceedings or courtjudgements unless they result from the use of yourvehicle and the proceedings are brought in acountry which we have agreed this policy willcover. Any other legal proceedings must bebrought in an English or Welsh court.

    If you live in the Isle of Man or the Channel Islands,any legal disputes will be dealt with by the courtsand under the laws of those islands.

  • Conditions

    Policy Cover Conditions

    1 The insurance described in this policy will applyonly if you and any person claiming to be coveredby this policy have kept to all the conditions andendorsements.

    2a You must immediately send us a filled-in reportform or report fully to us, quoting your policynumber, if there is an event which could lead to aclaim being made against you or by you under thispolicy. You must do this even if you do not plan toclaim personally under this policy or if damage toyour own vehicle is not covered by this policy. Youmust also send us any letter, notice, claim form,court proceedings, summons, writ orcommunication connected with any claim arisingout of any event. We will contact the people whowrote to you.

    If you know about any possible future prosecution,inquest or fatal accident enquiry, you must writeand tell us immediately. Our address is: Claims Department, NIG, Commercial Vans, 2ndFloor, 10 Livery Street, Birmingham, B3 2NU.

    You must not pay or agree to settle any claimwithout our written permission.

    2b We are entitled to:

    a take over and carry out the defence orsettlement of any claim in your name, or in thename of any other person insured by thispolicy;

    b take proceedings in your name, or in the nameof any other person insured by this policy, toget back any money we have paid under thispolicy; and

    c any information and help we need from you orany other person insured by this policy.

    3 We or your insurance adviser may cancel thispolicy by sending you seven days’ notice byrecorded delivery to your last known address. Youmust then send us or your insurance adviser thecertificate of motor insurance. When this isreceived we will refund the unused part of yourpremium.

    If you wish to cancel your policy outside of the first14 days (shown on page 2 of this policy) you cancontact us or your insurance adviser. If you orothers have not made a claim in the currentinsurance year, we will refund any premium paidless a pro rata charge for the number of days forwhich cover has been given plus an administrationcharge will be made of £25 (excluding InsurancePremium Tax). Insurance Premium Tax whereapplicable is charged at 6% on the net refund.

    4 You and any other person who is covered by thispolicy must do everything possible to:

    a keep your vehicle in an efficient, safe androadworthy condition; and

    b protect it from loss or damage.

    5 If a claim is made under this policy and there isanother policy that covers the claim, we will payonly our share of the claim.

    6 You must be honest and truthful in your dealingswith us at all times.

    If you, any person insured under this policy oranyone acting on your behalf attempts to deceiveus or knowingly makes a false claim, we have theright to cancel your policy, refuse claims and retainany premium paid. We may recover from you anycosts we have incurred, including the costs ofinvestigating the claim.

    We will not pay a claim which is in any wayfraudulent, false or exaggerated.

    We will also not deal with any claims followingdiscovery of this behaviour regardless of when theclaims occurred.

    In addition, we have the right to cancel any otherproducts you hold with us and share details of thisbehaviour with other organisations to preventfurther fraud. We may also involve the relevantauthorities who are empowered to bring criminalproceedings.

  • Conditions Policy Cover

    7 You must allow us to examine your vehicle at anyreasonable time.

    8 If under the laws of any country where this policyapplies, we have to make a payment which wewould not otherwise have paid under this policy,you or the person who caused the accident mustrepay that amount to us.

    9 If more than one company or person is named asthe insured in the schedule, the insurance willapply to them together and separately.

    This is not part of your policy

    1 Accidents and losses You must report all accidents and losses

    immediately. Either telephone Claim Call on 0845 607 1626 or ask your insurance adviser for areport form. Windscreen claim line number: 0800028 3754.

    Legal procedures now make it vital that you reportany accident at once. Strict time scales have beenset for dealing with claims, in particular thoseinvolving bodily injury. Heavy financial penaltiesmay be imposed by the courts if you do not keepto these. This may affect our ability, as your insurer,to mount the best defence on your behalf.

    Delay can involve us in higher costs which may goagainst your driving record. If the delay is extreme,we may refuse to cover you.

    If your vehicle is damaged in a way which isinsured under the policy, ask for details of thenearest recommended repairers so that you canget your vehicle back on the road as soon aspossible.

    Please do not admit that any accident was yourfault.

    Please try to get the names and addresses ofwitnesses.

    Please take photographs of the accident scene ifat all possible.

    Please send us immediately any letters,summonses, writs or notices you receive and do not answer them.

    2 Changes to the insurance You must tell your insurance adviser about the

    following before you need cover, and receive acover note or certificate of motor insurance:

    � if the owner of your vehicle changes;

    � if you replace your vehicle or modify it;

    � if the drivers or how you use your vehiclechange.

    Please tell your insurance adviser about changesof address or occupation as soon as you can.When you tell us of any change during the periodof insurance and this results in an additional orreturn premium an administration charge will bemade of £15 (excluding Insurance Premium Tax).The applicable IPT rate for fees is 6%. You musttell your insurance adviser about the followingbefore the next renewal date:

    � accidents, thefts or losses (whether covered byinsurance or not and regardless of blame)where these have not been previously reportedto your insurance adviser.

    � motoring convictions (including fixed penaltyoffences) or prosecutions you expect oroutstanding police enquiries. Criminalconvictions or charges for a criminal offence.Physical or mental impairments.

    3 Travel abroad If you are going abroad, please:

    � give your insurance adviser 14 days’ noticewhenever possible; and

    � read carefully ‘Information for travellers abroad’which we will send you with your InternationalMotor Insurance Card (Green Card);

    � check that the countries you are driving in(listed overleaf) are covered by this policy andthat the cover matches that which is shown inyour schedule.

    The Road Traffic Acts state that it is an offence tomake a false statement, or to withhold informationto obtain a Certificate of Motor Car Insurance.

    It is a condition of your policy that you agree to ususing your personal data in the way set out in thedata protection notice.

    Please check that this policy meets your needs, itis based upon information provided to us by you atthe time of quotation. You must take reasonablecare to provide us with accurate information andyou should notify us immediately if anything isincorrect or if you are unsure about any details.Providing inaccurate information could adverselyaffect your policy, including invalidating your policyand claims being rejected or not fully paid.

    Please note that the statement of fact or theproposal form, policy booklet, schedule and anyadditional information on the insurance providedby you will be the basis of the contract between us.

    Why we need your information

    We will use your information to give youquotations, and manage your insurance policy,including underwriting and claims handling.

    Your information comprises of all the details wehold about you and your transactions and includesinformation we obtain about you from third parties.

    We will only collect the information we need sothat we can provide you with the service youexpect from us.

    From time to time we may need to change the waywe use your information. Where we believe youmay not reasonably expect such a change we willwrite to you. When we do so, you will have 60days to object to the change but if we do not hearfrom you within that time you consent to thatchange.

    Who we will share your information with

    NIG insurance policies are underwritten by U KInsurance Limited (UKI).

    During the course of our dealings with you we mayneed to disclose some of your information to otherinsurers, third party underwriters, reinsurers, creditreference and fraud prevention and law preventionagencies and other companies that provideservice to us or you, to:

    � assess financial and insurance risks

    � recover debt

    � prevent and detect crime

    � develop our products, services, systems andrelationships with you

    � understand our customers’ requirements

    � rating and pricing.

    We do not disclose your information to anyoneoutside UKI except:

    � where we have your permission; or

    � where we are required or permitted to do so bylaw; or

    � to other companies who provide a service to usor you; or

    � where we may transfer rights and obligationsunder this agreement.

    Where we transfer your information

    From time to time we may require services fromsuppliers that are based worldwide and yourinformation will be shared with them for thepurposes of providing that service. Where weengage these suppliers we make sure that theyapply the same levels of protection, security andconfidentiality we apply. However, suchinformation may be accessed by law enforcementagencies and other authorities to prevent anddetect crime and comply with legal obligations.

    Motor Insurance Database (MID)

    Information relating to your policy will be added tothe Motor Insurance Database (MID) managed bythe Motor Insurers’ Bureau (MIB). MID and thedata stored on it may be used by certain statutoryand/or authorized bodies including the police, theDVLA, the DVANI, the Insurance Fraud Bureauand other bodies permitted by law for purposesnot limited to but including:

    - Electronic Licensing;

    Continuous Insurance Enforcement;

    - Law enforcement (prevention, detection,apprehension and or prosecution of offenders);

    - The provision of government services and orother services aimed at reducing the level andincidence of uninsured driving.

    If you are involved in a road traffic accident (eitherin the UK, the EEA or certain territories), insurersand or the MIB may search the MID to obtainrelevant information.

    Persons (including his or her appointedrepresentatives) pursuing a claim in respect of aroad traffic accident (including citizens of othercountries) may also obtain relevant informationwhich is held on MID.

    It is vital that the MID holds your correctregistration number. It is our responsibility toupdate your policy to the MID. We fully complywith the agreements in place with the MIB toupdate your details within seven days, however itis important that you check your policydocuments, ensuring that the registration numberis recorded correctly.

    If it is incorrectly shown on the MID you are at riskhaving your car seized by the Police. You cancheck that your correct registration number isshown in the MID at www.askMID.com. If theregistration number is not shown correctly on yourpolicy documents, or you cannot find your car onthe MID, please contact us immediately.

    Brokers or Agencies

    We will discuss your information with your brokeror agency and provide them with information aboutyour policy and dealings with us to enable them tomanage your relationship.

    Sensitive Information

    Some of the personal information we ask you formay be sensitive personal information, as definedby the Data Protection Act 1998 (such asinformation about health or criminal convictions).We may also ask you to provide sensitiveinformation about other people, please ensure thatyou have their agreement before providinginformation to us. We will not use such sensitivepersonal data about you or others except for thespecific purpose for which you provide it and toprovide the services described in your policydocuments.

    Dealing with other people

    It is our policy to deal with your spouse or partnerwho calls us on your behalf, provided they arenamed on the policy. If you would like someoneelse to deal with your policy on your behalf on aregular basis please let us know. In someexceptional cases we may also deal with otherpeople who call on your behalf, with your consent.If at any time you would prefer us to deal only withyou, please let us know.

    Credit Reference Agencies

    UKI carries out a consumer search when anyapplication for insurance is submitted. This is doneusing public data to evaluate insurance risks andno financial information is reviewed as part of thisprocess. There is no visible credit footprint andafter 12 months is automatically deleted.

    Access to your information

    You have the right to see the information we holdabout you. If you would like a copy of yourinformation, please telephone 0870 609 9920, orwrite to The Data Protection Officer, ChurchillCourt, Westmoreland Road, Bromley BR1 1DPquoting your reference and ask for a SubjectAccess Request Form. A fee may be payable

    Fraud prevention and detection

    Please take time to read the following as itcontains important information relating to thedetails you have given or should give to us. Youshould show this notice to anyone whose data hasbeen supplied to us in connection with your policy.

    To prevent and detect fraud we may at any time:

    Share information with other organisations andpublic bodies including the police although weonly do so in compliance with the Data ProtectionAct 1998

    Check and/or file details with fraud preventionagencies and databases and if we are given falseor inaccurate information and we identify fraud, wewill record this. We and other organisations mayalso use and search these agencies anddatabases from the UK and other countries to:

    � help make decisions about the provision andadministration of insurance, credit and relatedservices for you and members of yourhousehold;

    � trace debtors or beneficiaries, recover debt,prevent fraud, and to manage your accounts orinsurance policies; or

    � check your identity to prevent moneylaundering, unless you provide us with othersatisfactory proof of identity

    Law enforcement agencies may access and usethis information.

    We and other organisations may also access anduse this information to prevent fraud and moneylaundering, for example when:

    � Checking applications for, and managing creditand other facilities and recovering debt;

    � Checking insurance proposals and claims;

    � Checking details of job applicants andemployees.

    We, and other organisations that may access anduse information recorded by fraud preventionagencies, may do so from other countries.

    your Policy, please contact the broker, intermediaryor agent who arranged the Policy for you. If thebroker is unable to resolve your complaint or it isregarding the terms and conditions of the policythey will refer it to NIG.
