Construction

We have significant experience handling construction litigation, and consulting with clients to minimize and shift risk before litigation occurs. Our litigation experience extends from small, single-family home matters to the intricacies of handling some of the largest, class action construction cases prosecuted in the United States. In the single-family and multi-family context, we primarily represent general contractors and developers. In the commercial and residential high-rise arena, our work extends to defense of product manufacturers and subcontractors as well.

Our lawyers focus on early case resolution, with a strong emphasis on pursuit of indemnity and additional insured rights possessed by our clients. This resolve is backed by our ability and willingness to try a case to verdict, if required.

We litigate mechanic’s liens, delay claims, and contractual disputes. We also consult on transactional matters, including negotiating and developing contracts for our clients. Mr. Lee is the firm’s founding member and managing shareholder. Mr. Lee graduated with honors from the University of Southern California before attending the Pepperdine University School of Law. Mr. Lee is a member of the Federal and State Bars of California and Nevada, and he has appeared before the Nevada Supreme Court on multiple occasions. Establishing the firm in 1996, Mr. Lee has over 20 years of experience mediating and litigating complex construction and insurance matters. His primary practice regions are located in California, Nevada and Arizona, where he represents "target" defendant contractors (master developers, subdivision developers and general contractors) in construction defect related claims. Mr. Lee tried to verdict the first construction defect case in Southern Nevada.

Mr. Lee is often a featured speaker at County, State and National Seminars on construction defect cases, including a special engagement at the Nevada State Bar Convention. Mr. Lee has also served as one of the Bar’s representatives (on behalf of developers and general contractors) on multiple committees aimed at improving pre-trial and trial procedure for construction defect cases in the State of Nevada. The firm’s first female shareholder, Mrs. Hernandez joined the firm in 2000. She focuses a substantial portion of her practice representing industry professionals, including developers and general contractors involved in construction defect, related insurance disputes, general liability, premises liability, environmental and accessibility matters. Over the course of the last 17 years, she has gained extensive experience in successfully managing and litigating claims that involve significant exposure and risk transfer. She holds the highest Martindale-Hubbell Preeminent AV Peer Review Rating. Mrs. Hernandez shares the distinction as a recognized top lawyer as published in Vegas, Inc., in 2013. She manages the firm’s Colorado office.

Mrs. Hernandez earned dual B.S. degrees from the University of Idaho and her J.D. from the Western Michigan University School of Law. Mrs. Hernandez has achieved success before the Nevada State Legislature (77th Session, 2013) to help secure the enactment of SB 335, a measure to advance the practice of Nevada’s health-care providers through her work as the Nevada representative to the National Association of Chiropractic Attorneys.

Mrs. Hernandez has also served as a guest moderator for professional seminars offered in the southwest region of the United States.

She has extensive experience in all stages of litigation including appeals and has handled matters through verdict receiving successful defense decisions through jury trial.

Ms. Landrum joined the firm in 2001, and became a partner in 2006. In 2000, Ms. Landrum relocated to Las Vegas, Nevada, to join a boutique litigation firm specializing in complex civil litigation (including multi-district litigation) where she handled class actions, commercial and business litigation, construction defect litigation on behalf of homeowners and homeowner associations, CC&R enforcement and interpretation, land use, trademark litigation, personal injury and wrongful death matters. Ms. Landrum also drafted proposed changes for NRS Chapter 116 at the request of homeowner interest groups to submit to the Nevada Legislature.

Currently, the primary focus of her practice is in defending developer, general contractor and subcontractors in construction defect litigation, injury and premise liability suits. Ms. Landrum remains involved in other complex civil litigation involving transactional disputes and environmental torts, as well as employment law and plaintiff injury. Originally, a native of the Northern California Peninsula Bay Area, Ms. Landrum moved on to the University of California at Santa Barbara where she received a dual Bachelor of Arts degree in Political Science and Sociology in 1996. Ms. Landrum later attended California Western School of Law in San Diego, and received her Juris Doctorate in 1999. While in law school, she received the Dean’s Scholarship from 1996 through 1999. After immediately becoming licensed in California, Ms. Landrum originally practiced in the fields of domestic litigation, personal injury and administrative law.

In addition to her active memberships with the State Bars of Nevada and California, Ms. Landrum is admitted to practice before the United States District Courts, Southern District of California and District of Nevada. Ms. Landrum helped spearhead the Southern Nevada construction defect bar’s current efforts to arrive at uniform protocols involving case management and mediation. She has served as a speaker for professional seminars regarding insurance and additional insured endorsements as well as the state of the law in complex construction defect litigation. She also frequently serves as an Arbitrator. Ms. Landrum holds the highest Martindale-Hubbell Preeminent AV Peer Review Rating and was nominated for a fellowship with the Litigation Counsel of America.

Mr. Garofalo is a shareholder with 24 years of experience litigating complex construction, business litigation, and tort cases. He served as lead trial counsel for a subcontractor on the CityCenter Harmon Tower Litigation, a case involving over 12 terabytes of electrically stored information, complex structural and economic allegations, and nearly one billion dollars in total exposure. Jeff secured a very favorable result for his client when the case settled globally shortly after a jury was sworn.

His practice includes the defense of builders and developers in complex and class action residential cases; business and general liability litigation; and representation of developers, product suppliers and contractors in commercial and high-rise litigation. He

Mr. Garofalo has been a guest lecturer to the paralegal program at the University of Nevada, Las Vegas, speaking on construction defect case management. He served for six years on the national Board of Governors for the Human Rights Campaign and he has served as pro-bono counsel for indigent clients through Clark County’s Aids/HIV assistance program. He is an attorney volunteer for Ya Es Hora, a program that assists legally documented residents with applications for U.S. citizenship, and he is currently an attorney mentor in the State Bar of Nevada’s Transitioning into Practice program. From 2009 to 2016, Mr. Garofalo sat on the board of directors for the Nevada Public Employee Benefits Program, having been appointed by Governor Jim Gibbons in 2009 and re-appointed to two successive terms by Governor Brian Sandoval.

published academic and artistic works including, Statutes of Repose – The Design Professional’s Defense to Perpetual Liability 10 St. John’s Journal of Legal Commentary 697. She also co-authored the CLM Construction Claims Wiki for Arizona.

She was licensed in Nevada in 1996 and was involved in the first case successfully tried under Nevada’s construction defect law. Her career is focused on preventing and defending construction litigation. She was with the firm at its inception in Las Vegas and left to pursue a broader experience in the homebuilding industry, including development of comprehensive risk management strategies, implementation and development of safety and quality standards and general land use law for builders and developers. She has advised builders throughout the country, and has served on numerous Boards of Directors for general contractors and developers. Ms. Mullen speaks to conferences of builders and developers on the topics of quality control and effective risk management to reduce construction litigation. She re-joined the firm from her previous position as Risk Manager and General Counsel for one of Nevada’s largest privately held builders.

In 2013, Ms. Mullen relocated to Arizona and now manages our Arizona office. Our Arizona office continues with its strong focus on construction litigation and risk consulting, as well as general civil litigation. The office has enjoyed great success for our clients at both the trial and appellate level courts. With the reemergence of the building industry, Ms. Mullen’s unique ability to coordinate and understand the insurance products available to builders and how they interact with both sales and subcontract documents is proving to be an invaluable resource to our clients.

Mr. Carlson is the managing partner of the firm's Florida office and is board certified as a specialist and expert in construction law by the Florida Bar. He is a member in good standing of the State and Federal bars of Florida, the United States Virgin Islands, and Nevada. Mr. Carlson graduated from the Max M. Fisher College of Business at the Ohio State University and earned his Juris Doctorate from Capital University Law School (cum laude). Prior to joining the firm, Mr. Carlson clerked for the United States Attorney’s Office in Washington D.C. In addition to being board certified in construction law, he holds the highest Martindale-Hubbell Preeminent AV Peer Review Rating. Mr. Carlson’s primary practice is focused on complex tort and commercial litigation where he has successfully represented clients in high value construction, products liability, class action and insurance matters. Mr. Marking is the managing partner of the Southern California office of the firm. He is admitted to the California Bar, as well as all U.S. District Courts in California. He is also a member in good standing of the Orange County Bar Association. Mr. Marking received his B.A. from the University of California at San Diego in 1989, and received his Juris Doctorate from Pepperdine University in 1994. Prior to joining the firm, Mr. Marking spent 10 years with the largest, national construction firm in the country. Mr. Marking’s practice is primarily focused on meeting the complete legal needs of developers, builders, general contractors, and sureties in all aspects of their business transactions "from the ground up", including negotiating contracts, project management and close out of troubled projects. Mr. Marking also has over 15 years of experience litigating construction claims, including commercial torts, contract claims, delay/scheduling disputes and construction defect actions in residential, commercial and industrial matters. Mrs. Ingle-Gernhardt is the managing partner of the Northern California office of the Firm which focuses on construction defect litigation. Mrs. Ingle-Gernhardt more than 10 years of experience litigating complex construction and insurance matters. Since joining the firm in 2012, Mrs. Ingle-Gernhardt’s practice has focused on meeting the complex needs of developers and general contractors while navigating the treacherous waters of construction defect litigation. Her bar admissions include the states of New York and California, including admission to the U.S. District Court, Northern District of California, the U.S District Court, Eastern District, and the Ninth Circuit, Court of Appeals.

Mrs. Ingle-Gernhardt started her legal career working under student practice orders during her third and final year of law school in New York. She worked for the New York County (Manhattan) District Attorney's Office prosecuting misdemeanor domestic violence cases and for the Westchester County Family Court Legal Program providing free legal services for victims of domestic violence. earned a certificate of concentration in International Law after studying for a semester at the University College of London, in London, England. Upon completion of her legal studies, Mrs. Ingle-Gernhardt returned to her native California and redirected her legal interests to civil practice.

Mr. Luckman was a partner with Green & Hall, APC for 12 years and practiced with the firm for over 16 years. He was named a "Southern California Rising Star" by Super Lawyers numerous times. Over his career, Mr. Luckman has successfully handled hundreds of cases with amounts in dispute totaling well into the multiple hundreds of millions of dollars. He can assist clients with all aspects of litigation through dispositive motions, mediation, arbitration, trial and/or appeal.

In the precedential case of ABF Capital Corp. v. Grove Properties Company (2005), 126 Cal.App. 4th 204, on appeal Mr. Luckman successfully argued on behalf of his client that business entities are within the class of persons protected by Civil Code section 1717(a) (reciprocal application of a unilateral attorneys’ fees provision in a contract).

Dennis is a Southern California native. While he spent his earliest years in Los Angeles, he grew up in Joshua Tree where he developed a lifelong passion for the outdoors. He is still an avid hiker, enduro rider and occasional rock climber. After high school he served in the U.S. Army Reserves as a combat medic before continuing with his education. He graduated magna cum laude from San Diego State University in 1994 with a BA in History and the University of San Diego School of Law in 1997 with a JD. Mr. Kostrinsky joined the firm in 2012 after spending fifteen years as in-house counsel within the leisure, hotel, and gaming industries, including Fortune 500 companies. Ms. Maskall earned her Bachelor’s degree in Economics and Political Science from the University of British Columbia in Vancouver, B.C., Canada, prior to attending California Western Law School in San Diego, California. Mr. Lawrence, a California native, graduated from Pepperdine University in 1991 with a Bachelor's Degree in Political Science and English minor. He also graduated from Pepperdine School of Law in 1996 and has practiced construction defect defense ever since.

Mr. Lawrence has worked on over 400 cases from pre-litigation through verdict and appeal. His clients have ranged from developers to designer/architects and subcontractors. As an associate and then partner of a well-respected Southern California firm, Mr. Gaspar worked closely with some of the largest developers and general contractors.

Mr. Gaspar has been a licensed attorney in California since 2001 and in Nevada since 2007. In 2010, he relocated to Las Vegas where he continued his California and Nevada construction law practice. Ms. Lambert has extensive general and multidistrict civil litigation experience. Her practice focuses on the defense of insurers, RRGs, self-insured entities and their insureds against first and third-party claims in state and federal court, arbitration and mediation.

She has successfully defended high-exposure cases involving bad faith, product liability, personal injury, premises liability, wrongful death, catastrophic injury, and construction defects. She also has experience with complex insurance coverage issues and title disputes. While pursuing her J.D. at Western Michigan University Cooley Law School, she embarked on what most would consider a peculiar diversion for a law student and entered the world of trucking. By the end of her first year of law school, she co-owned a trucking company, trucks, and was a licensed freight forwarder/broker. While remaining committed to her legal career, Brandy spent the next few years gaining over-the-road trucking experience few would expect of an attorney. Mr. Vandermey earned his Bachelors of Science in Business with a concentration in Real Estate & Land Use Planning and Finance from California State University, Sacramento in 1998. Mr. Vandermey then earned a Doctorate of Jurisprudence from Willamette University College of Law in 2001.

In response to the tragic events of September 11, 2001, Mr. Vandermey was deployed for over two years with the California Army National Guard as a member of the Military Police, to fight in the war on terrorism. Upon returning from Operation Desert Storm, Mr. Vandermey received his commission in the military and became a Judge Advocate for the California Army National Guard, where he became the Command Judge Advocate for the Counter Drug Task Force for the California Army National Guard. As a JAG, Mr. Vandermey successfully litigated over 30 trials and hearings. Mr. Vandermey was the attorney for the military in a joint law enforcement operation for one of the largest marijuana busts in Northern California, which resulted in the confiscation of over $1.8 billion in illegal marijuana.

Mr. Vandermey retired from his 22 year military career in 2008, and opened his own bankruptcy and civil litigation firm, where he practiced as a sole proprietor in the fields of consumer bankruptcy law, real estate law, landlord/tenant law and civil litigation, where he has helped hundreds of people resolve their debt issues. Mr. Vandermey brings his expertise to this firm, where he can expand his services to a wider client base.

Sergio Stevens has over 25 years of civil litigation experience.
