The Board of Trustees of the Northern Mariana Islands Retirement Fund hereby notifies the general public that it has adopted amendments to its Administrative Rules and Regulations as published in Volume 11, No. 5, Commonwealth Register, on May 15, 1988, pursuant to Section 3 of Public Law 5-48, 1 CMC 8314(f) and the Administrative Procedures Act, 1 CMC 9101, et seq.

The adopted regulations amended the Retirement Fund's Administrative Rules and Regulations with respect to the applicability of Constitutional Amendment No. 19 and the implementation of Public Law 5-48.

EMERGENCY: The Board of D i r e c t o r s of t h e Commonwealth U t i l i t i e s Corpora t ion hereby f i n d s , pursuant t o 1 CMC §9104(b) , t h a t i t is i n t h e p u b l i c i n t e r e s t t o adopt e l e c t r i c s e r v i c e r e g u l a t i o n s on an emergency b a s i s . On t h e b a s i s of f i e l d i n v e s t i g a t i o n s , i t i s found t h a t an i n o r d i n a t e percen tage of commercial, governmental and r e s i d e n t i a l s t r u c t u r e s i n t h e Commonwealth have improper and/or unsa fe e l e c t r i c s e r v i c e connec t ions which c r e a t e a hazard t o p u b l i c h e a l t h , s a f e t y and w e l f a r e . The emergency r e g u l a t i o n s , among o t h e r t h i n g s , e s t a b l i s h s a f e s t a n d a r d s f o r e l e c t r i c s e r v i c e connec t ions and a u t h o r i z e CUC personne l and r e p r e s e n t a t i v e s t o e n t e r p r i v a t e and p u b l i c premises t o r e p a i r , o p e r a t e , m a i n t a i n , remove, r e p l a c e , and conduct compliance surveys on, a l l o r any p o r t i o n of C U C t s power d i s t r i b u t i o n and meter ing system a s a c o n d i t i o n f o r r e c e i v i n g e l e c t r i c power. P a r t 3. Right of Way - Right of Access

3.1 A s a cond i t i on f o r r e c e i v i n g e l e c t r i c s e r v i c e by cus tomers , t h e CUC and i t s au tho r i zed a g e n t s s h a l l have t h e f r e e r i g h t and a u t h o r i t y t o e n t e r upon t h e r o a d s , r i g h t s of way, and o t h e r p u b l i c o r p r i v a t e p r o p e r t y , f o r t h e purpose of c o n s t r u c t i n g and i n s t a l l i n g i t s power d i s t r i b u t i o n system and a l l necessary f a c i l i t i e s connected t h e r e w i t h , and f o r r e p a i r i n g , o p e r a t i n g , ma in t a in ing , removing, r e p l a c i n g , and conduct ing compliance surveys on a l l o r any p o r t i o n of its d i s t r i b u t i o n system.

3.2 No compensation s h a l l be due t o o r from any customer, p u b l i c o r p r i v a t e , f o r c l e a r a n c e work around t h e e l e c t r i c d i s t r i b u t i o n system which i s performed on such cus tomer ' s premises ( e . g . t r e e tr imming, e t c . ) .

3.3 A l l f a c i l i t i e s i n s t a l l e d on a cus tomer ' s p remises , i n c l u d i n g , b u t no t l i m i t e d t o , conduc tors , t r ans fo rmers , p o l e s and m e t e r s , which a r e fu rn i shed by t h e CUC i n o r d e r t o r ende r e l e c t r i c s e r v i c e s h a l l remain t h e s o l e p rope r ty of t h e CUC. The CUC s h a l l have t h e r i g h t o f a c c e s s t o t h e cus tomer ' s premises wi thout payment of any cha rge o r r e n t t h e r e f o r e , a t a l l r easonable hours f o r any purpose r e l a t e d t o t h e f u r n i s h i n g of e l e c t r i c s e r v i c e , i n c l u d i n g , b u t not l i m i t e d t o , meter r ead ing , t e s t i n g , i n s p e c t i o n , c o n s t r u c t i o n , maintenance, compliance surveying , and r e p a i r of f a c i l i t i e s . Upon t e r m i n a t i o n of s e r v i c e , and f o r a reasonable pe r iod t h e r e a f t e r , t h e CUC s h a l l have t h e r i g h t of a c c e s s t o t h e cus tomer ' s p remises t o remove i t s f a c i l i t i e s i n s t a l l e d the reon .

3.4 The a p p r o p r i a t e governmental e n t i t i e s s h a l l p rov ide t h e CUC w i t h t h e necessary a r e a s of p u b l i c p rope r ty f o r t h e l a y i n g o u t of t h e works on p u b l i c p rope r ty . S p e c i a l ar rangements , where n e c e s s a r y , s h a l l be made between t h e CUC and owners of p r i v a t e p r o p e r t y f o r t h e l a y i n g ou t of t h e works on p r i v a t e p r o p e r t y .

P a r t 4. General C h a r a c t e r i s t i c s of Se rv i ce

4.1 The works i n s t a l l e d by t h e CUC s h a l l comply w i t h t h e codes and s t a n d a r d s enforced i n t h e CNMI.

4.2 The d i s t r i b u t e d c u r r e n t s h a l l be e i t h e r three-phase o r s i n g l e - phase , a l t e r n a t i v e .

4.3 The frequency s h a l l be s e t t o approximately 60 Her t z .

4.4 Voltage supp l i ed s h a l l be des igna t ed by t h e CUC accord ing t o a v a i l a b i l i t y and t h e cus tomer ' s needs .

7 .2 The d e l i v e r y p o i n t is t h e p o i n t where t h e CUC's s e r v i c e d r o p a t t a c h e s t o a s e r v i c e mast . The d e l i v e r y p o i n t must b e i n clear view of a power p o l e . The CUC s h a l l n o t own o r m a i n t a i n any f a c i l i t i e s beyond t h e p o i n t of d e l i v e r y , e x c e p t f o r t h e meter. The CUC s h a l l p r o v i d e o n l y one d e l i v e r y p o i n t p e r s t r u c t u r e . Such s i t e and r e l a t e d improvements, i n c l u d i n g proper f enc ing , s h a l l b e accord ing t o s p e c i f i c a t i o n s p r e s c r i b e d by t h e CUC. I f a t r ans fo rmer room o r underground v a u l t is provided , it s h a l l conform t o t h e requi rements of t h e CUC p e r t a i n i n g t o s a f e t y , grounding, s i z e , v e n t i l a t i o n , s e c u r i t y , and access .

P a r t 8. Customer's I n s t a l l a t i o n

8.1 The CUC r e s e r v e s t h e r i g h t t o r e f u s e new s e r v i c e and t o d i sconnec t e x i s t i n g s e r v i c e , where customer i n s t a l l a t i o n s do not comply wi th t h e s e r e g u l a t i o n s o r w i th any code o r s t anda rd a p p l i c a b l e i n t h e CNMI, o r where t h e customer o p e r a t e s equipment


which may cause i n t e r f e r e n c e wi th s e r v i c e , o r where t h e r e is o r may be an unsa fe cond i t i on .

8 .2 The customer s h a l l be r e spons ib l e f o r i n s t a l l a t i o n of a l l equipment and m a t e r i a l s necessary t o p rov ide s a f e meter ing from t h e p o i n t of d e l i v e r y i n t o and through t h e cus tomer ' s b u i l d i n g . Such equipment and m a t e r i a l s i nc lude , bu t a r e no t l i m i t e d t o , s e r v i c e mast , weatherheads , back guys, deadend i n s u l a t o r s , meter b a s e s , grounding, w i r e and c a b l e , underground l a t e r a l s , t e r m i n a t i o n s , c u r r e n t t r a n s f o r m e r s , p o t e n t i a l t r ans fo rmers , over load p r o t e c t i o n d e v i c e s , e n c l o s u r e s , and f i t t i n g s .

8.3 For e x i s t i n g customers, t h e CUC may e l e c t t o i n s t a l l s t a n d a r d e l e c t r i c a l s e r v i c e equipment and/or meter ing s y s t e m s i n t h e event t h e customer does not c o r r e c t a non-complying and unsa fe e n t r a n c e meter ing i n s t a l l a t i o n wi th in s i x t y (60 ) days and t h e customer a g r e e s t o such i n s t a l l a t i o n . The c o s t f o r such i n s t a l l a t i o n by t h e CUC s h a l l be charged t o t h e customer.

8 .4 A t t h e t ime of power s e r v i c e connect ion t o t h e p o i n t of d e l i v e r y f o r t h e new CUC i n s t a l l e d meter ing i n s t a l l a t i o n , a l l e l e c t r i c a l equipment and m a t e r i a l o t h e r t han t h e meter i t s e l f s h a l l become t h e p r o p e r t y and r e s p o n s i b i l i t y of t h e customer.

8.5 P r o t e c t i v e dev ices ( e .g . main c u r r e n t b r e a k e r s , main f u s e s ) s h a l l be c a l i b e r a t e d according t o t h e cus tomer ' s power demand, approved by t h e CUC, and i n s t a l l e d by and a t t h e cus tomer ' s own expense.

8 . 6 I n no case s h a l l a n e u t r a l conductor be used a s a ground conductor .

9.5 A s e p a r a t e meter s h a l l be used f o r each s e r v i c e o u t l e t / c o n - n e c t i o n on a cus tomer ' s premises and any s e r v i c e t o o t h e r p remises by ex t ens ion cord , weatherhead t o weatherhead connec t ions , o r o t h e r means, s h a l l be a cause f o r d i scont inuance of s e r v i c e and any o t h e r remedies al lowed by law.

11.1 When it is found t h a t an e r r o r i n a mete r r e a d i n g is due t o dev ice mal func t ion , t h e d a t e of which can be r e l i a b l y e s t a b l i s h e d , t h e overcharge o r t h e undercharge s h a l l be computed back t o bu t not beyond such d a t e .

P a r t 12 . Temporary Suspension f o r Repa i r s o r Maintenance

1 2 . 1 The CUC s h a l l have t h e r i g h t t o t empora r i l y suspend t h e d e l i v e r y of e l e c t r i c i t y over whatever a r e a is n e c e s s a r y , and whenever neces sa ry , f o r t h e purpose of making r e p a i r s , improvements o r maintenance t o i t s system.

1 2 . 2 In c a s e s of planned temporary suspension o f s e r v i c e , a s c i rcumstances p e r m i t , t h e CUC s h a l l g ive a minimum of t h r e e days n o t i c e t o customers . Radio announcements r e g a r d i n g temporary suspens ion of s e r v i c e s h a l l be deemed r easonab le n o t i c e f o r t h i s purpose.

1 2 . 3 The CUC s h a l l perform such r e p a i r s , improvements o r maintenance a s r a p i d l y as p r a c t i c a b l e and, i f p r a c t i c a b l e , a t such t i m e s a s s h a l l cause t h e l e a s t inconvenience t o customers .

P a r t 13. Power Fac to r

1 3 . 1 The CUC may r e q u i r e t h e customer t o p r o v i d e , a t t h e cus tomer ' s


own expense, equipment t o i n c r e a s e t h e o p e r a t i n g power f a c t o r of t h e cus tomer ' s e l e c t r i c a l l oad t o not less than 95% l a g g i n g o r l ead ing .

13.2 When t h e a p p l i c a b l e r a t e schedule a l l ows , t h e CUC may apply p e n a l t i e s f o r low power f a c t o r s .

P a r t 14. Rendering of B i l l s

14.1 B i l l s f o r e l e c t r i c a l s e r v i c e s h a l l be rendered monthly a s provided i n t h e r a t e s chedu le s .

14.2 A l l customers s h a l l be metered.

14.3 B i l l s f o r metered s e r v i c e s h a l l be based on meter r e g i s t r a - t i o n s . Meters s h a l l b e r e a d a s r e q u i r e d f o r t h e p r e p a r a t i o n of r e g u l a r b i l l s , opening b i l l s , and c l o s i n g b i l l s .

14.4 I t may not always be p o s s i b l e t o read meters on t h e same day of t h e month, and i f a monthly b i l l i n g pe r iod c o n t a i n s l e s s than 27 days o r more than 34 days , a p r o r a t e d computation s h a l l be made i n t h e b i l l .

P a r t 15. S e p a r a t e Meters f o r Same Customer

15.1 When a s i n g l e customer r e q u i r e s e l e c t r i c s e r v i c e on s e p a r a t e p remises , t h e customer s h a l l have a s many meters a s t h e r e a r e d i f f e r e n t l o c a t i o n s f o r s e r v i c e , and each meter s h a l l be cons idered a s a d i f f e r e n t customer.

15.2 For t h e purposes of b i l l i n g , each meter upon a cus tomer ' s p remises s h a l l be cons ide red s e p a r a t e l y , and t h e r ead ings of two o r more meters s h a l l not be combined except a s fo l lows :

15.2.1 Where combinations of meter read ings a r e s p e c i f i c a l l y p rov ided f o r i n t h e r a t e s chedu le ;

15.2.2 Where t h e C U C ' s o p e r a t i n g convenience r e q u i r e s t h e u se of more than one meter .

15.3 Where premises a r e used f o r bo th r e s i d e n t i a l and commercial purposes , t h e s e r v i c e s h a l l b e b i l l e d a s commercial s e r v i c e . I f t h e a r e a of r e s i d e n t i a l u se and commercial use is c l e a r l y d e f i n e d , t hen t h e r e s i d e n t i a l a r e a may be se rved under t h e r e s i d e n t i a l r a t e i f a s e p a r a t e meter is i n s t a l l e d .

15.4 There s h a l l be only one s e r v i c e drop o r l a t e r a l f o r any b u i l d i n g o r s t r u c t u r e .

P a r t 16. Payment of B i l l s

18 .3 I n t h e event of disagreement and/or a d j u d i c a t i o n of a b i l l , t h e customer s h a l l pay t h e undisputed p o r t i o n of a cha l lenged b i l l i n g and any unchallenged a d d i t i o n a l b i l l i n g s rece ived b e f o r e agreement i s reached o r t h e a d j u d i c a t i o n p roces s is completed. 23.4 If a customer e l e c t s t o change t o a n o t h e r a p p r o p r i a t e and a p p l i c a b l e r a t e s c h e d u l e , t h e change s h a l l b e made p r o v i d e d :

The change s h a l l become e f f e c t i v e f o r t h e b i l l i n g p e r i o d du r ing which t h e customer has r eques t ed t h e change.

P a r t 24. R e s p o n s i b i l i t y

24.1 The customer s h a l l e x e r c i s e reasonable c a r e t o p revent f a c i - l i t i e s of t h e CUC i n s t a l l e d on t h e cus tomer ' s p remises from be ing damaged o r des t royed and s h a l l r e f r a i n from tampering o r i n t e r f e r i n g w i t h such f a c i l i t i e s , and i f any d e f e c t t h e r e i n is d i scove red by t h e customer , t h e customer s h a l l promptly n o t i f y t h e CUC t h e r e o f .

24.2 I t s h a l l be t h e cus tomer ' s s o l e r i s k and expense t o f u r n i s h , i n s t a l l , i n s p e c t , and keep i n good and s a f e c o n d i t i o n a l l e l e c t r i c a l f a c i l i t i e s r e q u i r e d f o r r e c e i v i n g e l e c t r i c energy from t h e l i n e s of t h e CUC, r e g a r d l e s s of t h e l o c a t i o n of t h e t r a n s f o r m e r s , mete rs o r o t h e r equipment of t h e CUC, and f o r u t i l i z i n g such energy , i n c l u d i n g a l l necessary p r o t e c t i v e d e v i c e s and s u i t a b l e housing t h e r e f o r , and t h e customer s h a l l be s o l e l y r e s p o n s i b l e f o r t r ansmis s ion and d e l i v e r y of a l l e l e c t r i c energy over o r through h i s w i r e s and equipment, and t h e CUC s h a l l not be r e s p o n s i b l e f o r l o s s o r damage occasioned by t h e f a i l u r e of t h e customer t o comply wi th t h e requirement t o t h i s paragraph.

24.3 A l l s e r v i c e s w i t c h e s , f u s e s , b r e a k e r s , and s i m i l a r d e v i c e s r e q u i r e d i n connect ion w i t h s e r v i c e and meter i n s t a l l a t i o n on t h e cus tomer ' s premises s h a l l be f u r n i s h e d , i n s t a l l e d , and mainta ined by t h e customer i n accordance wi th C U C ' s s p e c i f i c a t i o n s and t h e NEC.

24.4 The customer s h a l l acknowledge i n w r i t i n g r e c e i p t o f , and r e s p o n s i b i l i t y f o r , t h e meter ing dev ice a t t h e t ime of t h e meter i n s t a l l a t i o n . No meter s h a l l be i n s t a l l e d wi thout such w r i t t e n acknowledgement by t h e customer o r t h e cus tomer ' s au tho r i zed r e p r e s e n t a t i v e .

P a r t 25. I n t e r r u p t i o n of Se rv i ce and L i a b i l i t y

25.1 The CUC s h a l l e x e r c i s e reasonable d i l i g e n c e t o f u r n i s h a cont inuous and s u f f i c i e n t supply of e l e c t r i c i t y t o i ts customers. The CUC cannot , however, gua ran tee complete freedom from i n t e r r u p t i o n .

25.2 The CUC s h a l l no t be l i a b l e f o r i n t e r r u p t i o n s of s e r v i c e o r s h o r t a g e of supp ly , nor f o r l o s s o r damage occasioned the reby , u n l e s s occasioned by t h e neg l igence o r wrongful a c t of t h e CUC.


Part 26. NEC - 26.1 The American National Electric Code, as amended or revised, is hereby adopted and made the applicable standard in the CNMI.

Part 27. Severability

27.1 If any provision or provisions of these regulations, or the application of any such provision or provisions to any person or circumstance, shall be held invalid by a court of competent juris- diction, the remainder of these regulations, or the application of such provision or provisions to persons or circumstances other to those to which it is held invalid, shall not be affected thereby.

Part 28. Previous 'Regulations

28.1 These regulations supercede all previous regulations.
