Registration

The registration desk will be situated on the 7F at the BUNKA KAIKAN OF SUNSHINE CITY during

the following time:

08:00-17:30 Thursday, December 3, 2015

08:30-17:00 Friday, December 4, 2015

Please note that there will be no scientific program and registration on December 2.

For onsite registration, payment must be made in cash (USD or JPY). Credit card is not

acceptable.

Lunch

Lunch will be served at Room 501, 5F in the Bunka Kaikan of Sunshine City during the following time:

Name Badges

Every registered participant will be issued a name badge upon registration. For identification purposes,

participants are strongly requested to wear badges at all times during conference session.

A Polite Request to All Participants

Participants are requested to arrive in a timely fashion for all addresses, whether to their own, or to those of

other presenters. Presenters are reminded that the time slots should be divided fairly and equally between

the number of presentations, and that they should not overrun. The session chair is asked to assume this

timekeeping role and to summarize key issues in each topic.

All presentation rooms are equipped with a screen, an LCD projector, and a laptop computer installed with

Microsoft PowerPoint. You will be able to insert your USB flash drive into the computer and double check

your file in PowerPoint. We recommend you to bring two copies of the file in case that one fails. You may

also connect your own laptop to the provided projector; however please ensure you have the requisite

connector.

Topic: The Impact of Forensic Science on Geotechnical Engineering and Its Legal

Implication on the Liability of Consultants

Abstract of Speech

Geotechnical Engineering is a branch of Civil Engineering that deals with the

behaviour of earthen materials and how they interact with man-made elements such

as foundations, flatwork, or pipelines. Issues that Geotechnical Engineers may be

asked to evaluate include the suitability of potential construction sites, how the soils at

the site will behave in their native state or when they are reworked as fill, the ease

with which soil and/or rock can be excavated, or if materials at a site are able to

support the proposed construction. A new discipline known as forensic geotechnical

engineering has been created to deal with investigation of soil-interaction related

failures of engineered facilities or structures. In the entire process of failure

investigation, the geotechnical forensic engineer should be careful to ensure that all

the procedures as well as the selected parameters for tests and analysis fully conform

to the field conditions. The work should be comprehensive and intelligible to a legal

person also. One should realize that the association of the consultant engineer with the

project is based on the principle of “contract of skill”. Hence the consultant should

ensure competent and reliable advice to the client. It is also imperative for the

consultant to explicitly detail the risks that might be involved or expected in using the

conclusions and recommendations. The fact should be true and non-erroneous while

the anticipation or interpretation skill is highly demand. Forensic Geotechnical

Engineer prepares civil engineers to read, think, speak, and analyse like a lawyer. The

forensic engineer must be able to apply the art and science of engineering during the

entire process, from the extreme conditions encountered in the field, through the

intense pressure experienced in the courtroom, and never lose sight that seeking the

truth is all that matters. In addition, it familiarizes him/her with jurisprudence system

so that he/she is much able to understand and deal with legal issues since he/she has

to work closely with statutes and regulations may become involved in litigation, or

who may serve as an expert witness. For engineers it is only a myth to believe that

practicing perfect engineering, or conforming to normal standards of care, will provide

immunity from civil liability. Unfortunately, when problems or failures occur, all

parties including engineers get named in the lawsuit regardless of their

innocence. .Overall, it is emphasized that application of standard of skill and care is

expected from a professional, irrespective of quantum of remuneration. However, the

liability of the consultant is also limited as the owner pays for the “skill and service”

and not for “insurance”.

Brief Introduction of Prof. Ir. Dr. Ramli Nazir

Prof. Ir. Dr. Ramli Nazir is a Professor of Geotechnical Engineering at Geotechnical and

Transportation Department, Universiti Teknologi Malaysia since 1989. He served as

an Assistant Engineer in Public Works Department Malaysia for four years after

graduated from Diploma in Civil Engineering. Holds a B. Eng from UTM and PhD from

the University of Liverpool in Geotechnical specialization. 25 years' experience in the

field of Geotechnical Engineering, especially Foundations, Ground Improvement and

Geotechnical Forensics Engineering. In addition as a Lecturer in Geotechnical

Engineering, he is also a Professional Engineer who has numerous experience as a

design engineer, Design Checker and Geotechnical Technical Advisor to various

government and private agencies. In addition to engineering education and

consultation activities, he was a Member of the Technical Committee on Eurocode 7

Malaysian Annex, which is responsible for developing of Malaysia Annex in Eurocode 7

for National use. He also assist Standards and Industrial Research Institute of Malaysia

(SIRIM), Public Work Department of Malaysia (JKR), in giving short courses in

Geotechnical Design and the preparation of work specification for specialized work

such as Soil Anchor, Soil Nail, Pile Foundation, Ground Improvement and Load Testing.
