EditorialTHIRD ALL INDIA CONFERENCE AT KOLKATA

All India Bharat Sanchar Nigam Limited Executives’ Association is holding its 3rd All India Conference at Kolkata w.e.f.30th December 2010 to 1st January 2011.All India BSNL Executives’ Association i.e.AIBSNLEA was formally launchedon 1st May 2005 after merging 10 DoT recognized Group B Officers Associations. The Association represents all thecadres in all disciplines of BSNL i.e. Telecom Engineering wing, Telecom Accounts and Finance Wing, Telecom (C/E/Arch./TF) Engineering Wings, PAs/PSs/ADOL/CSS/CSSSs and other General Line Disciplines Executives’. It is the onlytrue Association representing all BSNL Executives’. After its inception several legitimate issues of BSNL Executives’were taken up and resolved e.g. implementation of Executives’ Promotion Policy, Grant of Perks to Executives’, Fillingup of vacant Group A level and Group B level Executives’ posts in BSNL, implementation of transperent transfer policy,GSM Mobile connection with STD facility and handset to all Executives’, Settlement of AAOs pay scale, discontinuationof FR22I(a)1 pay fixation in SDE and Sr. SDE grades from prospective date, issuance of BSNLMS RRs, regularisationof Adhoc STS level Executives’, filling up of DGM posts, implementation of 2nd PRC recommondations with 30% fitmentbenefits, Settlement of JTO 2005 Batch Pay Anomaly,restoration of ACP withdrawl benefit, consideration of request/tenure transfer cases of Executives’etc but even then there are so many cases are pending which needs immidiatesettlement e.g. DPE OM dated 02.04.2009 regarding 78.2% fitment benefit instead of 68.8%, Payment of PLI, ITSOfficers absorption, IDA pension revision of BSNL pensioners who retired before 01.01.2007, Transport Allowance,Change of Designations on Each upgradation. AIBSNLEA has proved its presence and it is regarded as a strongAssociation of Executives’ in BSNL. AIBSNLEA is committed to function democratically and to take up the grevieancesof even the smallest cadre with the same importance as to be given for the larger cadres. As a result, the membershipof AIBSNLEA has increased.

As per the Govt. of India policy of restructuring of a Govt. Department i.e. DTS/DTO to BSNL, a Corporateentity, on October 1, 2000 around 400,000 employees were transferred on deemed deputation to BSNL and MTNL. Theabsorption process started in 2003 and so far, Group B, C and D officers totaling about 3,98,000 have been absorbedin these two organisations. The Group ’A’ officers were given option to be absorbed in BSNL or MTNL or to revert tothe Government by October 15, 2005. The period of deemed deputation ended on 30th September 2005. The majorityof Gr. A officers belonging to various disciplines i.e. Telecom Finance & Accounts, Telecom Civil/Electrical/Architectural/Telecom Factory Engineers have taken absorption in BSNL/MTNL but the majority of the ITS Gr. A have not takenabsorption in BSNL/MTNL. These ITS officers are heading the Circles/SSAs and holding the policy making posts ofBSNL/MTNL. There are about 2,000 ITS officers across the country who are working on deputation in BSNL, MTNL,Telecom Regulatory Authority of India, Department of Post and Department of Telecom. The majority of these officersare managing the operations of BSNL. Due to there continuous deputation to BSNL/MTNL they do not feel responsibilityand sense of belongingness to these CPSUs which is adversely affecting the viability of BSNL/MTNL.

AIBSNLEA is fully concern towards the viability of BSNL as it is concern for the settlement of HR issues ofBSNL Executives’. As and when the organisational call is given by Joint Action Committee/ Joint Forum, AIBSNLEAalways participated actively to defeat the wrong policies of the Government which are directly affecting the interestof BSNL workers and BSNL as a whole viz.30% disinvestment of BSNL, VRS to 1 Lakh employees, unbundeling ofBSNL’s copper conductor, delay in ITS Officers absorption, non-procurement of GSM equipment for the last threeyears, non-revision of IDA pension of BSNL pensioners retired before 01.01.2007 and will retire after 01.01.2017 and01.01.2027, non implementation of DPE OM 02.04.2009 regarding 78.2% IDA fitment benefit etc. AIC will certainlydiscuss all these issues and will decide further strategies.

AIBSNLEA is holding its 3rd All India Conference at Kolkata on a very crucial juncture when BSNL is facinglosses and its market share is continuously declining. It is a matter of serious concern to all of us. AIC will certainlydeliberate on these issues and will decide the srategies wherein BSNL can regain its original position. The Governmentpolicies which are weekning BSNL and helping private operators have to be protested strongly.The ITS Officersabsorption in BSNL, IDA pension revision, Transport Allowance, Change of Designations on Eachupgradation,implementation of DPE OM dated 02.04.2009 regarding 78.2% fitment benefit instead of 68.8%, Paymentof PLI, filling up of all vacant DGM / AGM /SDE equivalent cadre posts needs immidiate settlement. Thus this AIC has gota special significance.The financial viability of BSNL and many other issues will be the agenda of discussions and todecide the future course of actions. The activities of United Forum of BSNL Executives’ Association and its outcomewill also be the important issue of discussions in the AIC.

Let us , therefore, utilize this important occasion to meet at Kolkata and to take pledge to further strengthenAIBSNLEA to safeguard the interests of the entire BSNL Executives’ community and BSNL Employees. Let Kolkata bethe our next meeting point.

AIBSNLEA WRITES1. Calculation of monthly contribution towards costof Pension of absorbed employees in BSNL reg.

Letter no.7-45/2008/TA I dated 07.12.2009 fromDirector (Accounts), New Delhi.

In continuation of our letter dated14.06.2010,09.02.2010and 25.03.2010, it is to bringto your kind notice that, DoT has endorsed vide letterunder reference, a copy of O.M. No. 2/34/2008-Estt(Pay II) dated 19.11.2009 (copy enclosed) vide whichit has been clarified that pension contributionpayable in respect of a government employee duringthe active period of his foreign service shall be basedon the existing basic pay (i.e. pay in the Pay Bandplus Grade Pay) of the post held by him at the time ofproceeding on foreign service and in case hereceives proforma promotion/financial up-gradationwhile on foreign service, on the basic pay (Pay in thePay Band plus Grade Pay) fixed on such promotion/financial up-gradation. It has also been clarified byDOP&T that the rates of pension contribution will becalculated as per above formula with effect from thedate they opt to come over to the revised scale intheir parent cadres. For the earlier period, thepension contribution will be as per extant order i.e.the orders in force period prior to 01.01.2006 fromtime to time.Based on this BSNL CO circular no. 176 dated27.01.2009 all the circles have remitted the pensioncontribution in respect of the above mentionedemployees to the concerned CCA. Obviously thepayment made on this account from 01.01.2006 toDecember 2009 is in excess of the amount actuallyto be paid based on the clarification issued byDOP&T already mentioned. 2. Revision of pay scale of Hindi cadre RajbhashaAdhikari (AD OL) – reg.

In continuation of our letter dated10.06.2010, we constraint to bring to your kind noticethat pay revision of Hindi cadre Rajbhasha Adhikariis pending in BSNL since last one year.Parliamentary Committee on Official Language andsome Hon’ble MPs have also reminded to yourgoodself for early action.Similarly the pay scale revision of Junior and SeniorHindi Translators of BSNL is also pending whereas

the pay revision for all non-executives has beencompleted. As per the 6th CPC recommendationsthe pay scales of BSNL Rajbhasha Adhikari, Juniorand Senior Hindi Translators need revision. The RRof Rajbhasha Adhikari, Junior/Senior HindiTranslators are equivalent to DOT RRs, hence equalstatus and pay scales should be given in BSNL.

Before merging in BSNL RajbhashaAdhikari (ADOL) was drawing 6500 pay scale in DOTand accordingly pay revised as 9850 but now ADOLof DOT is getting 8000 pay scale at present henceADOL of BSNL should get equal pay scale.

We would therefore request you to kindlyintervene in the matter so that the pay scales of Hindicadre Rajbhasha Adhikari, Junior and Senior HindiTranslators are revised at the earliest at par withDOT AD OL and Junior/Senior Hindi Translators.

3. Case of regularization of qualified and trainedTTAs now officiating as JTOs-reg.

This Association’s letter No. AIBSNLEA/CHQ/CMD/2010 dated 17-2-2010.

In continuation of our letter dated23.04.2010, your kind attention is invited to our lettercited and the subsequent discussions we had withyou on the above matter.

We have mentioned that no protection wasgiven in the JTO Recruitment Rules-2001, toaccommodate TTAs who have already qualified inaccordance with the previous RR. A good number ofofficials qualified as per JTO RR –1996 were giventhe required pre-appointment training and they arenow officiating in the cadre of JTO in various parts ofthe country.

We have been pursuing the case ofregularization of these officials for the past severalyears. In order to find a permanent solution for thislong pending issue, we have already suggested thatan amendment to the effect that “ the TTAs alreadyqualified in accordance with 1996 RR (previousRRs) will be deemed to have been qualified underthe current RR also” may be incorporated in thepresent RR so that all the Qualified/ officiating JTOscan be appointed as regular JTOs immediatelywithout any hitches of rules.

However, now it is learnt that, acommunication has been issued from your office bythe AGM (Pers-IV) vide letter No.3-9/2007/Pers-IV(Pt)dated 26-3-2010, which states that, the case islinked with RA No.148/2009 in CWP No.5608/2007

in High Court of Punjab and Haryana and the matteris sub-judice and no action can be taken in thisregard. e would like to inform you that the contentsof the above letter issued by the AGM (Pers-IV) isincorrect and misguiding with regard to the matterof one time measure up-gradation of qualified TTAsas JTOs. No court of law has ever issued any orderbarring BSNL from up-gradation of posts oramendment of RRs etc. The suggestions putforward by this Association and in the matter ofregularization, are not against standing orders ofany of the court of law in the country and the questionof sub-judice does not arise , as nobody haschallenged these suggestions in court of law.

Once the matter is settled amicably, all thepending court cases will become in fructuous andwill be withdrawn automatically.

We therefore once again request you tokindly take following steps immediately for thesettlement of the issues :

1. Do the needful to settle the matter amicably.2. Do away with the present inert attitude of the

Company in the matter of regularization ofqualified TTAs as JTOs.

3. Convene a meeting of al l concerned atappropriate level to arrive at a logical/ workablesolution.

4. Do not permit anybody to manipulate things infavor of some vested interest groups.

4. ITS officers reject offer to get absorbed inBSNL/MTNL – regarding.

On behalf of All India BSNL Executives’Association we extend our sincere gratitude for theconcern your goodself has shown for the revival ofBSNL. In this connection we would like to draw yourkind attention to the main issue i.e. delay incompleting the absorption of ITS officers in BSNL /MTNL which is adversely affecting the viability ofBSNL / MTNL. It is in continuation of our letter dated27.01.2010, we would like to bring to your kind noticethat as per the Govt. of India policy of restructuring ofa Govt. Despite assurances from the Departmentof Telecom almost all of the 2,000 officers of theIndian Telecom Services (ITS) have opted againstgetting absorbed in Bharat Sanchar Nigam Ltd. TheGovernment had earlier issued a deadline to theITS officers to either get permanently absorbed ineither BSNL or MTNL or move to the central pool bymid December 2008. But the issue has beenpending since 2005 and the Government hadallowed several extension after the ITS officerssought to negotiate better terms for getting absorbedin the State-owned companies. ITS officers said theyrefused to get absorbed in BSNL because theGovernment did not implement the suggestionsmade by the committee.

The ITS officers are continuously defyingthe deadline set by the Government of India forabsorption in BSNL/MTNL. In the recent indefinitestrike call given by United Forum of BSNL and MTNLExecutives’ Associations during the meeting the Secy(T) on 19th Dec 2008, it was assured that as soon asthe issues related to pensionary benefits areresolved the ITS officers will exercise option forBSNL/MTNL. DoT vide letter dated 05.01.2009 hasalready clarified regarding family pension butthereafter ITS Officers Association is stating that theirabsorption issue is a settled issue as most of theITS officers have decided against gettingabsorbed. As of now everyone continues to workon deputation in different organizations includingBSNL. It is up to the Government to decide wherethey are to be sent. Meanwhile, the Department ofPersonnel and Training have already written to theDepartment of Telecom to prepare a list of the ITSofficers who may be appointed in various ministriesor department under the Central Staffing Scheme.mentioned above. It clearly reflects that ITS officers

will never exercise option for absorption in BSNL/MTNL on the pretext of one or the other reason.

The ITS officers working on deputation toBSNL are enjoying all the benefits of BSNL i.e. PLI,perks, Blackberry handsets/service, 3G Mobileservice connections, IP TV, vehicles, STD/ISD,Inspection Quarters, regular foreign trips in businessclass and promotion against BSNL’s JAG/SAG/HAGlevel posts against the terms of reference of Gr. 5. Creation of post of Sr. PPSs with Directors of

BSNL Board-regIt is understood that BSNL Board has

approved creation / upgradation of one post of Sr.PPS recently in BSNL. In this connection we wouldlike to bring to your kind notice that presently thereare six PPSs working in BSNL, attached with CMD/Board of Directors, who are drawing their pay in E-5/R-6 grade that is equivalent to the rank of Sr. PPS.

They have taken absorption in the year 2004in BSNL on an assurance given by way of record ofdiscussion in the meeting taken by the then Addl.Secretary, Deptt. Of Telecom, which was attendedto by Director (HR), Sr. DDG (Pers) and other seniorofficers from BSNL that we will not be placedlesser than the level of their counterpart in theDeptt. of Telecom and due care is taken in regardto future prospects in the grade. In the Governmentset, the CSSS cadre comprises of PS, PPS, Sr.PPS and PSO whereas in BSNL till now thepromotion is up to PPS only. All the present PPS are

quite senior and as already mentioned they aredrawing their pay in E-5/E-6 grade. In thegovernment set up Additional Secretary is entitledfor the taking the assistance of Sr. PPS and Secretaryis entitled for Principal Staff officer (PSO).

Since in BSNL the CMD and Board ofDirectors are holding equivalent to the rank ofAdditional Secretary in the Govt. of India, they arealso entitled for the assistance of Sr. PPS, posts ofSr, PPSs can be created for them. Therefore, if fiveposts of Sr. PPSs are created with the remainingBoard of Directors also, there will not be anyfinancial implication on BSNL and this will be amoral boost to the present PPSs that will enablethem to work with higher responsibi l i ty andadministrative efficiency.

We would therefore, request you to kindlyconsider for the creation of five more posts of Sr.PPS in BSNL in the same manner as has alreadybeen by created one post of Sr. PPS.

6. Dept. promotee JTOs of 2005 Batch payanomaly-reg

In the year 1999, 500 JTOs vacancies wereannounced for the Deptt. candidates, those whopassed in second screening test as well ascompleted their phase-I training and were allottedin the year of recruitment ‘2005. The announcedvacancies were evenly distributed to all the circleson some ratio basis.

In these vacancies, 70 vacancies were allotted toTN circle, and the eligible candidates from theseniority list, sent for one month field training on26.10.2006 and completed on 20.01.2007. After thecompletion of field training, they were appointed asregular JTOs on 22.01.2007.But in some circles, theeligible candidates were sent for training earlier andposted as regular JTOs before Dec 2006.Now theyare enjoying the fitment benefit in the 2nd PRC from1-1-2007.But TN Circle Departmental Promotee JTOs in 2005batch suffered a lot and drawing their basic pay itselfaround Rs.6000/- less than their batch mates in thesame year of vacancy. Now the case of DR JTOs of2005 batch was accepted as anomaly and settledeven though they got appointment in the end of theyear 2007.

But Dept. promotee JTOs in TN circle were sent fortraining on Dec 26, 2006 and got appointment onJan 22, 2007, was refused for fitment benefit. Thecase is replica as for the DR JTOs 2005 batch.

7. Clarification regarding counting of residencyperiod and consequent upgradation under EPP/ACP.

This has reference to the clarification issued by thePersonal Branch of BSNL Corporate office vide letterNo. F.No.15-84/2010-Pers.II dated 13.10.2010addressed to CGMT, Kerala Circle, contraveningOrder No. 400-61/2004-Pers.I dated 24.08.2007issued with respect to counting of residency periodfor the Personal Assistants and PersonalSecretaries.

BSNL Corporate Office vide letter F. No. 15-84/2010-Pers.II dated 13.10.2010 has issued certainclarification regarding applicability of counting ofresidency period and granting of f inancialupgradation under ACP to the cadre of PAs/PSs inthe field unit of BSNL. The clarifications in the aboveletters are as below:

1. Letter No. 400-61/2004-Pers.I dated24.08.2007 in respect of counting of residency periodw.e.f. 01.10.2000 for the first time bound promotionunder Executive Promotion Policy is only forexecutives whose pay scales have been revised/upgraded by the Company after 01.10.2000. Sincethe PAs were Grade I / Grade II Stenographers, i.e.non executives prior to restructuring of PA Cadre on01.01.2004, the above order is not applicable tothem. Prior to 1.1.2004, these PAs were nonexecutives, hence they are governed by the Non-Executive Promotion Policy issued vide letter No.27-7/2008-PE-II dated 23.03.2010.

2. As per Clause 1(d)(7) of the EPP, the firstreview under Executive Upgradation Policy is to bemade with reference to 01.10.2004 based on earlierTime Bound Policies, such upgradation due to theExecutives on the basis of options as one timerelaxation if he/she is willing for such promotionand adjudged fit in accordance with concernedregulatory conditions. Since all these PAs weremade Executives only w.e.f. 1.1.2004 they are not

Clause 1 (d) (8) of EPP states that with theimplementation of IDA time bound pay scaleupgradation scheme with effect from 01.10.2004,provisions with regard to arrangements like in-situ/ACP or any other time bound promotion/upgradationscheme of Government set up shall standwithdrawn. Since some of the PAs were grantedACP after 01.10.2004, such upgradation standswithdrawn w.e.f. 1.10.2004 as per clause 1(d)(d) ofthe EPP.

All the above clarifications are issued withoutconsidering the earlier decisions taken by thecompetent authorities of DOT and BSNL on thesubject matter either based on therecommendations of well studied ExpertCommittees or based on the directions fromHonourable High Courts / CATs as the case may be.

It may kindly be noted that Order No. 400-61/2004-Pers.I dated 24.08.2007 was issued by thecompetent authority based on the recommendationof an Expert Committee consisting of 3 joint DDGsand 2 ADGs, who had made detailed studies into allaspects relating to the implementation of revised/upgraded pay scales with effect from 01.10.2000 inrespect of various cadres of Civil, Electrical,Architecture, Telecom Factory, CSS, PrivateSecretaries, Personal Assistants of field units andJAOs, etc. whose pay scales have been revised/upgraded/restructured later to 1.102000 due tovarious departmental reasons. Residency periodorder is issued to give a common date of effect ofexecutive promotion policy to all the executives. Accordingly all the PAs were given first time boundupgradation on 1.10.2006 and subsequentlyundergone 15 days mandatory training. Residencyperiod is not required had PAs were executives ason 1.10.2000. All the cadres those who becomeexecutives as on 1.10.2000 is by default entitled forconsideration for granting first t ime boundupgradation as on 1.10.2000.

All the PAs have been placed in the executive payscale of Rs.9850-14600 (E1A scale) or 11875-17275(E2A scale) due to grant of 1st or 2nd ACP upgradationas per the decision taken by the CMD vide OrderNo.15-70/2007-Pers.II dated 21.04.2009 based onthe direction of Hon’ble High Court of Kerala in WPCNo.28735/07 & 28989/07 and WPC No. 5789/2008in the Hon’ble High Court of Judicature at Madras.As per the clarification issued by BSNL CO videNo.13-2/2010-TE dated 20.08.2010 , it was clarifiedthat “as per the provisions, only non-executiveemployees in a substantive non-executive post anddrawing non-executive pay scale of NE1 to NE-10will be covered under NEPP”. As such the present

clarification that “Prior to 1.1.2004, these PAs werenon executives, hence they are governed by the Non-Executive Promotion Policy issued vide letter No.27-7/2008-PE-II dated 23.03.2010 is illogical andincorrect. They were granted the revised restructuredE1A and E2A replacement scales by the Hon’bleCMD after hearing the representatives ofAssociations and Petitioners based on the directionsfrom the Hon’ble High Courts. The same cannot betaken away through a clarification. Since they aredrawing E1A & E2A scales and functioning asExecutives, they should be covered under EPP from01.10.2000 by counting the residency period andthe Clause 1(d)(7) of EPP should be madeapplicable to the PAs / PSs also.

Vide Para 9 (a) of Order No. BSNL/26/SR/2002 dated07.08.2002, where ACP system is in operation, itwill continue till it is revised by an Agreement. Sincethe EPP was notified only on 18.01.2007, the officersmay kindly be permitted to opt for the benefits grantedunder the above provision on or before the date ofnotification of the EPP; otherwise these officers willlose the benefits granted under ACP Scheme from01.10.2004 to 01.10.2006.

The Hon’ble CMD has issued the order to grantfinancial upgradation under the ACP Scheme asenvisaged in BSNL CO letter No. 25-5/2005-Pers.IIdated 12.09.2005 vide letter No. 15-7/2007-Pers.IIdated 21st April 2009. By issuing a clarification on13.10.2010, the decision taken by the CMD on21.04.2009 cannot be overturned. Since theExecutive Promotion Policy was introduced only on18.01.2007, the benefits of ACP may also beextended up to that period.

We fail to understand the logic behind issue of suchclarifications on a case settled by the Hon’ble CMDbased on the directions of the Hon’ble High Court ofKerala. The issue is of a very serious nature and weare constrained to put on record our deepestresentment on the totally illogical decisions takenby the Personal Branch with utter disregard to thedecisions and promises given by the top levelmanagement of BSNL.

Under the circumstances, we demand withdrawalof the clarif ication issued vide order dated13.10.2010 forthwith and issue instructions to allthe Head of Circles to consider residency period asordered vide Order No. 400-61/2004-Pers.I dated24.08.2007 immediately.

We are sure good sense will prevail and orders, asdemanded by the Association will be issued withoutfurther loss of time.

8. Anomaly due to BSNL Time Bound PromotionPolicy - granting of stepping up at par with junior inorder to protect the seniors from inevitable loss inBasic Pay vis-à-vis juniors - regarding.

We want to draw your kind attention towards our letterunder reference regarding the pay anomaly due toimplementation of BSNL Time Bound PromotionPolicy.

As explained in the above referred letter, TheExecutives who joined as SDE on promotion fromJTO prior to their 1st BSNL Time Bound promotionare getting less pay than their juniors who got their1st BSNL Time Bound Promotion in JTO cadrefollowed by regular promotion to SDE (T) cadre.

The matter was explained in the above cited letter bygiving comparative statement of seniority / payparticulars in one such case. Due to above anomalya number of SDEs throughout all the Circles aregetting less pay as compared to their juniors sinceJanuary-2005 in spite of the fact that they are seniorin all respect viz. year of Rectt in JTO cadre, date ofappointment as JTO, date of joining as SDE etc.This is against the natural justice.

The reason of this anomaly is that there is noprovision in BSNL Time Bound Promotion Policy forSTEPPING UP in such cases where seniors aregetting less pay as compared to their juniors. Hencethe concerned Accounts Wings are not entertainingsuch cases for stepping up.

We, therefore, again request you to kindly intervenein the matter so that suitable clarification may beissued to remove pay anomaly wherein seniors aredrawing less pay than their juniors whileimplementing Executive promotion policy.

implementation of BSNL Time Bound PromotionPolicy :

1. Following SDEs (T) of Rajasthan Circle, whoserecruitment year in JTO cadre is 1990, werepromoted from JTO cadre to SDE (T) cadre underseniority-cum-fitness quota vide BSNL CO Pers-IICell order no. 1-32/2004-Pers.II dated 16.09.2004and joined as SDE on or before 30.09.2004 :

S/Shri R.S.Palsania, Rajesh Sharma, M.K.Gupta,M.S. Rawat, S.S.Rathore, M.C. Gupta, SureshSharma etc.

2. Following SDEs (T) of Rajasthan Circle, whoserecruitment year in JTO cadre is later than 1990,were also promoted to SDE (T) cadre underseniority-cum-fitness quota and joined after01.10.2004 :

S/Shri Manoj Kumar (JTO-1991), Jitendra Shukla(JTO-1992), B.L.Goyal (JTO-1992) etc.

These JTOs got their 1st BSNL Time BoundPromotion on 01.10.2004 followed by regularpromotion to SDE (T) cadre.

SDEs (T) listed at Sr. No. 1 above and others ofRajasthan Circle (probably with so many in otherCircles also) are getting less pay as compared totheir juniors (for example listed at Sr. No. 2 above)since January-2005. Comparative statement ofseniority / pay particulars in one such case is given,for example, on the next page.

4. There is no provision in BSNL Time BoundPromotion Policy for STEPPING UP in such caseswhere seniors are getting less pay as compared totheir juniors. Hence the concerned Accounts Wingsare not entertaining such cases for stepping up.

We, therefore, request you to kindly intervene in thematter so that suitable modifications in BSNL TimeBound Promotion Policy are made to allow a seniorExecutives getting less pay than his junior due toTime Bound Promotion policy to take stepping up toprotect his pay against the junior.

BSNL for executives and non executives from 01.01.2007.One of the new features in the recommendation is grant of annual increment at 3% of basic pay instead offixed amount as was prevailing all through. In many of the PSUs the annual increment date is common forall the employees. For such organizations, the % of increment concept would not make any difference asevery employee will be getting the increment on the same date with reference to the revised basic pay onthat date.

In BSNL, we are not following any uniform date forgrant of annual increment and the date of incrementwill be different for different employees dependingup on his/her date of appointment/promotion to thehigher post etc. As a result, the % of incrementconcept has created an anomaly wherein certainjunior officials will be drawing more pay than theirseniors. This happens in almost all the cases wherethe juniors and seniors are in the same scale andthe difference in their pay on the pre-revised scale isonly one increment. This situation will be occurringin all non-executives scales (NE-1 to NE11) and alsothe executive scales.For clarity, a few cases are given in annexure –‘A’The issue of anomaly was addressed by PAT, BSNLC.O and an order on this count was issued vide No.2-

8/2009-PAT(BSNL) dated 23.09.2009. As per thisorder, anomaly has to be settled by ante-dating theincrement of the senior to that of the junior whodraws more pay than the senior after implementingthe 2nd PRC. Antedating the increment of the seniorwas the only solution available in these cases andthe above order has been implemented by manyCircles.Now vide letter No.2-8/2009-PAT(BSNL) dated14.06.2010, PAT, BSNL C.O has modified the aboveorder. The revised order says that wherever, theanomaly occurs, the pay of the senior has to bestepped up to that of the junior without antedatingthe increment and the senior will draw his/her nextincrement after 12 months from the date of suchstepping up.

From a cursory glance on the sample cases ofanomaly given in the annexure, it can be seen thaton the date of the anomaly the difference betweenthe pay of the junior and senior is less than theamount that may accrue to the senior @ 3%increment he/she will be drawing on the due date.For example, in the case of the junior and senior inthe pre-revised scale of Rs. 13000-350-18250, whowere drawing the basic pay Rs. 16150/ and 16500/- respectively on 31.12.2006 in the pre-revised scaleand Rs.35440 and Rs.36210 on 01.01.2007 in therevised scale, on 01.02.2007 the junior gets 3%increment on his revised pay of Rs. 35440/- and hispay will be Rs. 36510/-. Thus the junior will bedrawing Rs. 300/- pm in basic pay more than thesenior from 01.02.1007 to 31.07.2007. In this caseif the senior’s pay is stepped up to that of the juniorfrom 01.02.2007, the total increase in basic pay forthe senior for one year will be Rs.3600/- (Rs. 300/-*12) and the rate of increment in this case will bejust 0.83% instead of 3%. On the other hand if the senior does not seeksettlement of anomaly and retain his normalincrement of 3% from 01.08.2007, the total increasein basic pay for one year will be Rs.13080/-(Rs.1090*12). Hence the settlement of anomaly inaccordance with the revised PAT order will result inhuge loss to the senior and in this case the loss inbasic pay for one year will be Rs.9480.(Rs.13080-3600). Thus the seniors will be subjected to recurringand perpetual loss in pay on application of therevised PAT order. However, if the anomaly is notsettled, the junior will always be drawing more paythan the senior every year during the period fromFeb to Jul in this particular case.In all the cases of anomaly that may occur as shownin annexure, the seniors will be losing heavily, if theanomaly is settled in accordance with the revisedorder. However, in the case of scale E9, thedifference in between the Junior and senior is equalto 3% of increment and the revised order does notinvolve any loss to the senior. This is due to theapplication of the bunching formula for fixation ofpay in the revised scale.Hence, it can be seen that the modified PAT orderprovides only two situations and they are (i) if thesenior seeks settlement of anomaly with the junior,then he/she should be prepared for permanent andrecurring drop in his basic pay or(ii) the senior canlet the junior to draw more pay for the period fromthe increment date of the Junior to that of the seniorfor all the years to come.Stepping up the pay of the senior to that of the juniorto address the anomaly as was prevailing prior tothe implementation of 2nd PRC will settle the issueonly if the increment is of a fixed amount as wasprevailing earlier . This is no more a solution afterthe implementation of 2nd PRC, where increment hasbeen introduced as certain % of basic pay.

It is an accepted principle that settlement of payanomaly should not result in drop in pay for thesenior. However, it is clear that the solution forsettlement of pay anomaly on account of 2nd PRCimplementation communicated by PAT, BSNL C.Ovide the revised order dated 14.06.2010 does exactlythe same.

The junior official draws more basic pay by Rs.300/- from 01.02.2007 to 31.07.2007 than the senior.Every year during this period the junior will bedrawing more pay than the senior.

The Senior was drawing more basic pay in the pre-revised pay scale on 31.12.2006

Both the Junior and senior are fixed at the samebasic pay on 01.01.2007 as per the bunchingformulae.The Junior official draws more basic pay by Rs.2040/pm from 01.01.2007 to 31.05.2007 than the Senior.Every year during this period the junior will be drawingmore pay than the senior.The Senior was drawing more basic pay in the pre-revised pay scale on 31.12.2006

We would, therefore, request you to restore theoriginal order dated 23.09.2009 wherein provisionfor ante-dating the increment of the senior to that ofthe junior was envisaged. Alternatively, managementcan think of any other solution that will address theissue of anomaly wherein the junior does not drawmore pay than the senior and also the senior doesnot face any drop in his basic pay which he/she willbe drawing by virtue of the 3% annual incrementprovided in the rule.

We would like to draw your kind attention towardsthe letter under reference. While going through thedetails of entitlement for journey on tour/transfer inrecently declared amendment to TA/DA rules-2002,it is found that no clear cut rule is given forexecutives drawing revised IDA pay more than Rs.43669/- in the scale other than E5. On analysis ofpage No. 8 of the office memorandum No. 7-6/2006-EF/vol.II (Pt) of EF Section of BSNL CO where theruling for E5 is given in the 1st row. The executives ofBSNL are not under any Grade pay so the 2nd columnis not meant for them. The Executives come under1st column only where clear cut entitlement forexecutives drawing IDA revised pay more than Rs.43670/- is not shown.

It is therefore requested to kindly intervene in thematter so that the clarification from the competentauthority is issued.

11. Non-settlement of grievances of OfficialLanguage staff – reg.

We would like to draw your kind attention towardsnon-settlement of the grievances of the OfficialLanguage staff, the following points for your kindconsideration please :

Official Language cadre posts are unique in thesense that the minimum qualification prescribedfor the post is Post Graduation. For no other postin Gr. A or B cadre, Post graduation is prescribedas minimum qualification in BSNL. OL staff is singlehandedly performing special ized work of OLImplementation as directed in the Constitution ofIndia. But still they are victims of discriminationpertaining to service matters viz. non framing of RRfor AD (OL) since 1981, blocking promotionalavenues by not conducting DPCs or not consideringACP scheme by DOT and BSNL, non-up gradationof pay scales at par with the other analogous cadresetc.

Official Language cadre is created by Govt of Indiato monitor the Official Language policy of the union.They were appointed as Sr/Jr Hindi Translators afterpassing Competitive Examinations conducted byDeptt of Telecom. They were awarded with scales atpar with Official Language Staff of other Central GovtMinistries/Departments.

2. Till 5th Central Pay Commission, pay scales ofADOL were at par with other Group-B officers of DOTViz. SDE/AO etc. Consequent upon the conversionof DOT to BSNL, OL cadre staff also exercised theabsorption option to BSNL. Other BSNL cadresdrawing analogous pay scales viz. JAO, PAs etc. withOfficial Language cadre were upgraded from 6500/- to Rs.7500/- without appearing any LICE, whereas ignoring Official Language BSNL RR-2002 forADOL cadre, BSNL RR-2005 were framed andpromoted the Hindi Translators as RajbhashaAdhikari (ADOL) conducting LICE without upgradingthe pay scales. We would like to bring this to yourkind attention that injustice has been done to OL

cadre by depriving their cadre comparing with othercadres mentioned above.

3. Dept of Expenditure has recommended Ministriesand Depts on the basis of 6 th central paycommission to upgrade the pay scales of ADOL, SrHindi Translators and Jr.Hindi Translators to pre -revised pay scales Rs.8000/-,7500/- and 6500/-respectively. In spite of various requests madeindividually and through the Association, no actionhas been taken so far resulting in frustration amongOL staff for discriminatory attitude of the erstwhileDOT and BSNL and they are constrained toapproach High court. BSNL has adopted stepmotherly treatment to OL Cadre and brought ‘stay’in Hon’ble Supreme Court on Hon’ble High CourtAllahabad and Calcutta decisions to consider theirrequests. If BSNL is really concerned about itsemployees, it is requested to withdraw the SLP filedagainst OL Cadre and consider their long pendingissues and give them the fair justice.

4. Hindi Officers working in various Central Govt.Offices are designated as Assistant Director (OfficialLanguage). Consequent upon the conversion of DOTto BSNL they were designated as Asst. Dir (OL) evenin the RRs framed by BSNL Corporate Office, NewDelhi in the year 2002. But all of a sudden withoutimplementing the same, RRs for AD (OL) werereframed and degrading their skill and specializationdesignated us as Rajbhasha Adhikari (Asst.Dir-OL)such designation does not exist in Central GovtOffices Undertakings and Nigams etc. Dept of OL.New Delhi has given Rajbhasha Adhikaridesignation is given to only such officers belongingother cadres to look after the work of Hindi Officerswhere OL posts are not Existing/Justified as per thenorms prescribed for the creation of OL posts. Henceit is requested to intervene in the matter so that thislapse is corrected immediately and they are re-designated as ASST. DIR (OL).

Ignoring Official Language BSNL RR-2002 for ADOLcadre before expiry of the periodicity of the Rule, onemore Recruitment Rule -2005 was framed.According to which the Sr./Jr. Hindi translators hadto face one more competitive examination to getpromoted to Rajbhasha Adhikari post. The LICE wasconducted, based on the results the HindiTranslators were promoted as Rajbhasha Adhikari(ADOL) without upgrading the pay scales. Here alsosome senior officials were deprived of the promotionas they came below in the ranks for which age isalso a factor.

We would, therefore, request you to kindly look intothis matter sympathetically and redress the abovecited grievances viz. Pay Scale Anomaly,Restoration of Designation as ADOL, Effecting thePromotion with Retrospective Dates immediately.

If BSNL feels their services are no more required,kindly repatriate them back to Dept of Telecom, sothat they get the long pending pay scales andpromotion prospects which are deliberately notgiven so far to them.

With reference to above subject matter it is constraintto bring to your kind notice that the main issue, whichis adversely affecting the viability of BSNL/MTNL i.e.delay in completing the absorption of ITS officers inBSNL / MTNL is yet to be resolved by DOT.

Government of India, Ministry of Personnel, Publicand Pensions, Department of Personal andTraining, Letter NoAB.14017/37/2009-Estt.(RR)dated the 8th October 2010, is directed to the abovesubject and to state that the instructions on mattersrelating to regulation of service conditions ofGovernment employees on transfer to autonomousorganizations have been issued by the Departmentof Pension and Pensioners’ welfare. The provisionsincluded in the relevant portion of Rule 37 (A) of theCentral Civil Service(Pension) Rules 1972 refers.This Department has examined issues pertainingto service conditions, promotions/confirmation, tc.in respect of the deemed deputationists on areference received from the concerned dministrativeMinistries. It has been decided that in such caseswhere there is a conversion of a GovernmentDepartment into PSU/ utonomous/statutory body,there must be a time frame within which a new bodyshall frame its rules and regulations . At the end ofthis period, all employees on deemed deputationshould have opted either to get permanentlyabsorbed in the new organization or revert to theGovernment. A maximum period of 5 years forframing of rules and another 2 years for phasing outrepatriation to those opting to come back toGovernment has been prescribed. All the MinistriesDepartments are accordingly advised to adhere tothe time frame whenever a proposal for transfer ofemployees is considered as above.The ITS officers are continuously defying thedeadline set by the Government of India forabsorption in BSNL/MTNL. In this connection we would like to brief you theevidential details & facts of unlawful & vindictive actof Shri Anthony Ekka, GMTD Bhandara (MaharashtraTelecom Circle) for further suitable step.

Bhandara AIBSNLEA Branch had taken a Resolutiondemanding for Immediate Transfer of Shri AnthonyEkka, GMT Bhandara from Bhandara SSA for hisvindictive & unlawful act against the executives ofBhandara BSNL

The situation at Bhandara gone worst as GMTDBhandara is selectively targeting our executives &hence creates a reign of terror. It is difficult to work inBhandara SSA as most of executives were workingunder a tremendous tense atmosphere even doingtheir best & at Circle level also now Bhandara SSAis doing well due to efforts taken by our executives atBhandara. Even to disrupt the smooth functioning ofassociation & using SPLIT & RULE policy, ShriAnthony Ekka is selectively targeting the executivesof our association as we have strongly protestedagainst the harassing, intimidating & callous attitudeof GMTD Bhandara organizationally.

It has lot of incidents of Harassments to executives.As such torture & mental harassments/tensionsbeyond limits & bearing capacity of executives, sevenexecutives from Bhandara SSA have opted for VRSand have resigned from services. Details as below:From above incidence of MASS VRS taken byexecutives due to tremendous fear & terror ofvindictive act of Shri Anthony Ekka GMTD Bhandara,but for future peaceful life all above executives optedfor VRS.

Such a dirty policy adopted by GMTD Bhandara hadbeen counterattacked by our association & wesucceeded in getting stopping of further VRS fromour executives as they got a tightened shelter underthe banner of AIBSNLEA.

One major incident happened forunwarranted pressure of Shri Anthony Ekka GMTDBhandara which crossed the limits where our SDElate Com B.C.Wasnik who was working as SDECommercial had met suspected death during officehours in GMTD BSNL Office Bhandara on 15th

September 2009. The inhuman treatment of ShriEkka, GMTD Bhandara seen from the incident thatNo Departmental Enquiry OR other agency enquirywas made, even widow of our SDE late ComB.C.Wasnik demands high level enquiry to bring outthe truth behind the suspicious death occurred inthe premises of GMTD Bhandara during duty hours,but GMTD Bhandara had not shown any interestrather continue his harsh treatment.

Another incident was a sudden death of lateCom A.P.Gondane SDE on 22nd October 2008, mayagain a result of huge torture & mental tension inoffice working hours. But GMTD Bhandara hadforgotten all human approach as neither a singlecondolence meeting was conducted for Departedexecutives of BSNL Bhandara nor expressedsympathy to the families of departed executives.

Recently at Bhandara SSA a WTP/OFCProject team was attacked by a serious incidence,where two departmental peoples were fell into theCable Duct while doing their duties & got suspiciousdeath within minutes. While carrying out the work noimmediate departmental help were provided by ShriAnthony Ekka, GMTD Bhandara being an Inchargeof Bhandara SSA. The departed officials were takenout from duct by the local peoples as the ANIMALSTREATMENT as their funerals were kept lying oneabove other. The NATIONAL NEWS PAPER TIMESOF INDIA & Yugdharm published the incident & putdoubt as FUMES ON Suspicious death. Still nodepartmental enquiry started & GMTD Shri Ekka triedto cover the suspicious death as natural cause.However when our Association approach to him heshown uninterested to talk with them & avoid them& instruct the PA to GM not to allow Mr. Shaikh, DS,

AIBSNLEA in GM Office. Such a piteous condition isbeing observed now a days. We strongly condemnthe act of GMTD Bhandara for not allowing ourAssociation for discussion. As such of inhumannature for not a condolence observe by GMTDBhandara, our executives & officials observecondolence at respective places.

However, very next day GMTD Bhandara issued letterwith a suitable instructions to follow rules to workwhile on Cable Duct without giving a simplecondolence. This shown his inhuman treatment toall working for BSNL.

Recently Shri Anthony Ekka GMTDBhandara has issued a Baseless Charge sheet toour AIBSNLEA Bhandara Branch President ComL.M.KATRE SDE on flimsy, fabricated & baselessgrounds just to disrupt the smooth functioning ofassociation. The fact was brought to notice of GMTDBhandara by our association in a letter to GMTDBhandara & put our strong protest against the illegalact of Shri M.U.Gadpayle AGM Admn & MarketingBhandara who has acted upon on the directionsgiven by GMTD Bhandara from Mumbai as he wason official tour at Mumbai, to put a lock to Cabin ofL.M.KATRE SDE & Shri Gadpayale acted accordingly(Copy enclosed). Shri M.U.Gadpayle had given aDOG treatment to Com. L.M.KATRE SDE by keepinghim outside the office, whole day & disallowed theofficer from his daily work. Unfortunately No inquirymade & GMT Bhandara acted as Dictator & didsupport to illegal act of Gadpayle as it was predefinedplan & supported by GMTD Bhandara. Very importanthere to say that L.M.KATRE SDE is a heart patient &undergone heart bypass surgery. On the ill heathground he was posted at Bhandara but in spite ofhis ill health Com L.M.KATRE SDE Project UdanBhandara did hardship alone & has broughtBhandara position to top three levels in all SSA ofMaharashtra in project Udan work at Bhandara. DGMProject Udan even appreciates the Udan work atBhandara. Even to disrupt him & his work, he hasgiven such a harsh treatment without any reason.We demand for immediate removal of unwarrantedcharge sheet & definite action again againstM.U.Gadpayle AGM Admn who did maladministration.

Such incidents are common & our Executives arevictimizing by the apathetic & vindictive attitude ofGMTD Bhandara.

As you are aware Bhandara SSA covers two revenueDistricts namely Gondia & Bhandara Districts whichare in last corners of Maharashtra covering mainlyforest areas. As a routine there was a basic problemof water, food, and education, town facilities to majorproblems of Life Safety while working in forest &naxalite activities areas. In such odd conditions ourexecutives are working & serving BSNL withdedication & making all efforts to serve BSNLcustomers as per its motto. Till Shri Anthony Ekkaresumed to Bhandara as GMTD, even in oddconditions of Jobs on duty all executives werecarrying on services with full dedication & jobsatisfactions. Even they had a two crore profit beforeMr. Ekka join BSNL Bhandara. But after joining of Mr.Anthony Ekka since September 2008, on his requestto nearest place of Maharashtra to Raipur where hisfamily is working, the situation of Bhandara haschanged dramatically & our executives were putunder tremendous pressure & mental harassmentsdue to adamant attitude & undemocratic behavior ofShri Anthony Ekka. As per his nature he starteddictatorship & keep all executives under his toes.Hence our members of AIBSNLEA Bhandaraunanimously decided that as he completed morethan 08 TO 10 years of service (longest period ) inall corners of Maharashtra & even completed 02years at Bhandara , he may be given his choiceposting in Chhattisgarh near to his home town toavoid administrative complications & conflicts. Wedemand his immediate transfer out of Maharashtrato save further victimization of executives of BSNLMaharashtra & necessary enquiry may be initiatedagainst him.

Further to say many things, but his level of Bossinghas reached below the bottom line of anymanagements he is abusing the executiveirrespective of age & that to in presence of juniorstaff, officials or even customers in singular wordslike: “SALE TUM CHORE HO”, TUM NIKKAMME HO”,TUMHARI AUKAT KYA HAI”, MAI TUMHARI NAUKARIKHA JAUNGA” MAI TUMKO SUSPEND KAR DUNGA”MAI TUMHE ADHURA NAHI PURA MARUNGA”.Without respecting as regards to age of any staff orofficers he uses single pronounces even with ladiesalso in words like :”TU, TEREKO,NIKKAMMI KAHINKI” etc. Hence we demand impartial inquiry & actionagainst the unparliamentarily words used by him tothe executives of BSNL Bhandara.

The corrupt practices he did & supports are: Wedemand search enquiry & action.

1. As he got nearest station to his hometown, hehimself avails National Holidays, TH & about allSundays for visiting to his family at Raipur. On theway to hometown journey he will arrange surpriseexchange visits & inspections justifying his PersonalTour as Official Tour & visits. On the name of Visitshe uses departmental vehicles to such a long route& also he was accompanied by one or two officersalways in his service or say Bodyguards. Suchofficer’s duties were bond to his personnel use only.Hence his all visits in last two years may have tocheck as there was a heavy leakage of revenue onthe name of tour or inspection of exchange visits.

2. In the year 2008-2009, 2009-2010, the InspectionQuarter was hardly allotted to any of executives orvisitors on tour, but all time two Window ACs, TV,Fridge & other electrical & electronic equipmentswere mis-utilized by Mr. Anthony Ekka GMTDBhandara himself. There was a huge amount of(Approx lacks of rupees) electricity Bill of InspectionQuarter, BSNL Bhandara has paid even for NILallotment. The fact has been taken to his notice byBSNLEU in his LCM agenda. He made escape bysaying it was misused by some other one else. Butthe fact is that he is staying on top floor of Inspectionquarter & hence used both quarter plus Inspectionquarter for his personnel use. It is learnt from reliablesources that previously also Necessary Recovery ofHRA was made from him at Chandarapur District,Maharashtra, for misuse of official quarter. Wedemands necessary inquiry into the matter & leakageof revenue must be recovered from him.3. Similarly the incident of locking the GM officeBhandara main Gate as well Exchange gate & CSCat Bhandara BSNL building on dated 05/07/2010 bythe order of GMT Bhandara, Our Associationregisters its strong protest & demands high levelenquiry into the matter but he dared to put the matterin dustbin. In this regards also our sister associationjoined us & NFTE Bhandara branch also demandsnecessary inquiry as to why he supported the socalled anti national act by disallowing the customers& No business on that day at CSC Bhandara (Copyenclosed). We strongly demand action against hisantinational act to support the so called bandh.

4. The irregularities while floating of USO-OFCTender at Bhandara SSA & request for i ts

cancellation, all unions & associations at Bhandararegistered strong protest against the floating oftender under huge pressure of some politicalpressure & influence & to please them by callingUN-Experienced contractors. (Copy enclosed). Wedemands necessary inquiry into the matter as GMTD,Bhandara tried to wind up the issue.5. One biggest issue of supporting themalpractices & maladministration seen by hisvindictive & insulting act to executives of BSNLBhandara is that he has clearly violating the BSNLcorporate rules by deploying a TTA as SDOTBhandara Incharge as well had pleased the dirtyfellow TTA by allotting additional charge of WLLservice of Bhandara SSA as a whole. Thus by doingso he kept the eligible executives on side & appointthe corrupt fellow on both the posts. The issue wastake strongly in the agenda & asked themanagement to correct the situation but GMTDBhandara gone in amnesia & seen blind for the issueraised by us. This all GMTD did to show that a TTAsuperior that our regular JTO & SDEs. No doubt weappreciate the work of BSNL official but even afterseeing the TTA fellow had did mal-practicing,misappropriation of money in advance taken by him& above all exercising the power of SDOT with thehigh blessing of the authorities (the power neverdelegates to him who he is using). As per BSNLcorporate guidelines work distribution was definedby BSNL Bhandara & in which Shri J.S.TembhareTTA has been shown as JTO Offtg. (WLL), but oneach & every official paper he declared himself asSDOT Bhandara in addition to JTO WLL Bhandara.(Some copies enclosed).

6. The matter was strongly protested & taken up withmanagement where it was assured by GMTD itselffor action against the TTA fellow but there was acomplete wind up the matter as the TTA fellow had astrong influence & might GMTD had handshake withTTA fellow in WLL section estimated costs amountwhere GMTD had direct control. Hence GMTDBhandara had given him a clear way to do anythingwhich he wants. There is nobody to watch on theworking style of TTA & hence he started doingbossing to all EXECUTIVES. GMTD Bhandara haddone partiality by giving both major sections to theTTA fellow neglecting the availability of regular JTO/SDEs. The association hence demands immediateaction on the corrupt & dirty acts.

7.In the regime of Shri Anthony Ekka as GMTDBhandara there was a complete violation of BSNLcorporate office guidelines & hence all executives ofBSNL Bhandara feel cheated. & uneasy. The minutesissued by the AGM Admn have not yielded fruitfulresults. The ADS & Treasurer of AIBSNLEA Bhandarabranch were not provided immunity for transfer onrequest so far, even committed in minutesREALEASED. The unhealthy situation realized by hisact that there is a heavy delay in grant of Medicalfacil ity & timely help to one of sufferer ComS.S.Jangde JTO due to which he had to arrange lacksof amount on loan & from others. Even there is a payanomaly to his cadre, not solved till date in spite ofrepeated applications & agenda. Secondly the Timebond promotion case of Com D.Miri SDE (ExecutiveMember of AIBSNLEA Branch Bhandara), DPC shallbe taken as assured in minutes but no action & thejuniors were facilitated with a higher grade. This allhappened as GMTD Bhandara had vindictive &partial attitude towards our association executives.He had wrong assumption that we only doingassociation activities & hence selectively targetingour members in all corners. Association demandsstrong & quick action to resolve the pending transferon immunity to our ADS & Treasurer ComR.D.KAMBLE SDE & Com B.D.Walde SDE,settlements of pay anomalies- Case of S.S.JangleJTO & early settlements of Time Bond – Case ofCom D. Miri SDE.

8. Similarly with a vindictive attitude at the start of histenure at Bhandara SSA he had issued so manycharge sheets to nearly 05 to 06 executives, butdeliberately lingering the charge sheet case of ComB.B. Patil JTO at Salekasa & hence Com Patil couldnot get his promotions. 14. Problems being faced by BSNL CO employeesfor withdrawal of GPF-Reg.

Respected Madam, We would like to draw your kindattention that since formation of BSNL, takingwithdrawals from GPF has become such a difficulttask that each BSNL Corporate Office employee isbound to roam from BSNL CO to DOT Hqrs. SancharBhavan for taking his GPF money. Further more, evenafter repeated requests at DOT Hqrs. The requiredinformation about cheques is not being given.

In the changed situation, officials of BSNL CO arenot having entry pass of Sanchar Bhavan, as sucheven the Reception Officer is not issuing them theentry pass to enquire about their cheques. It is alsoseen that whenever our officials enquire on phoneabout the GPF cheques they are not getting suitablereply. It has become embarrassing that we have to

After secrutiny of the bills,DOT may issue a consolidated cheque in favour ofA.O.(Cash),BSNL, on daily basis, which may thenbe handed over to applicants by Cash Section, BSNLCO.

2. BSNL may be authorized to prepare and scrutinizethe bills with reference to GPF rules and thereafterthe cheques may be issued by A.O.(Cash),BSNL tothe applicants. 16. Non filling up of Director (Finance) post inBSNL-Reg.

As your good office is fully aware, BSNL, the fullyowned Public Enterprise isgoing through a very badphase. In the initial years, the Company was doingvery well and it had played a very pivotal role inaccelerating/revolutionizing the progress/expansionin telecom scenario and bringing down the telecomtariff at its present level, which is by on all accountthe cheapest in the world. BSNL has also beenmandated to discharge the social obligation ofproviding the services at every nook and corner ofthe country including the remotest of the remote area,where none of the private operators are interestedto enter due to the cost factor and non profitability. Infact, BSNL is spending a considerable share of itsresources for expanding the telecom servicesthroughout the country as telecom services are veryvital for accelerating the economic activities of theNational and State Governments.

However, over the years, market share and profitabilityof the organization have fallen steadily due to numberof factors. For the financial year 2009-10, for the firsttime, BSNL has reported a loss to the tune of Rs.1822 crores, While stiff competition from the privateoperators who have entered the telecom cenario ina big way is one cause for shrinking the marketshare/revenue/profits, certain policies viz. withdrawalof ADC, payment of license fee, USO charges to DOTand various taxes to Central/State Govts. of theGovernment of India have also contributed to a greatextent for the present state of affairs of BSNL.

We know that the present state of BSNL has been agreat concern for the Government of India and PMOhas taken a number of initiatives for improving theperformance of the Company. One such initiative isthe constitution of ommittee headed by Shri. Sam GPitroda with a direction to suggest ways and meansto bring BSNL back on the track. While, we theemployees and executives are not in agreementwith some of the suggestions of Pitroda Committee,we definitely agree with recommendations forproviding an efficient and proactive management to

the company, which can stand up to the challengesfrom various quarters and initiates policies bestsuited for the company and the country, by appointingbest talents in the market as Directors and CMD ofBSNL. Unfortunately, in spite of the clear directionsfrom the top, nothing has happened on this countso far. Sir, you being a top notch economist knowvery well that for any organization to exist, performand grow it has to have a robust financial health andthe financial health depends to a large extent on theefficiency of the finance wing of the Organization.While BSNL has got best and talented pool of financeofficers below the Board level, at Board level, thepost of Director(Finance) is vacant for the last twoyears ever since the then Director(Finance) retiredin Dec 2008.Since Dec 2008, the functions and responsibilitiesof Director (Finance) are shouldered by otherfunctional Directors in rotation in addition to theirarea of responsibilities. Although many inputs forfinancial decisions are emanated from below theBoard level, for policy decisions to be taken, Boardlevel representation is a must. A senior and efficientfinance officer with complete familiarity of the strengthand weakness of BSNL needs to be appointed asDir (finance) immediately.

Selection process for the appointment of Director(Finance) was initiated some time back and we havelearnt that a panel of probable appointees has alsobeen finalized. However, recently, we have come toknow that the selection process has beenchallenged by certain individual through a court case.We also understand, as a result of the court case,the appointment of Director (Finance) is likely to bedelayed further.

It will not be out of place, if we mention here that forthe past few years each and every initiative of BSNLfor procurement of switching equipment for itsexpansion has been facing hurdles in the form ofcourt case or other disputes and as a consequenceBSNL has been very badly hit in the process. Whilethe court cases and disputes were so far limited toits procurement plan, now it has even started hittingthe process for making the Board levelappointments. This turn of events force us to stronglybelieve that vested interest from different cornersare bent upon destroying BSNL and Government,

Regarding the Court case challenging theappointment process of Director(Finance) in BSNL,we assume that Government of India/administrativeMinistry i.e. Ministry of Communications being theowner of the Company can definitely take certainsteps for early resolution of the court case so thatBSNL geta Director (Finance) immediately.

As we already explained, BSNL is going through avery bad phase and is in a total mess. Continuationof the present state of affairs of the company is goodneither for the Government nor for the BSNL workforce numbering about 3 lakh men and women,whose livelihood depends on the survival and growthof BSNL. We, therefore, request your august officeto take urgent measures for the appointment of afull time Director (Finance) for BSNL urgently.

JAC finalizes strike notice on 13.10.2010 and Dates of strike and March to Parliamentchanged :- The JAC meeting took place on 12.10.2010, at New Delhi. In the meeting, thedemands to be incorporated in the 3 day strike notice were finalized. The JAC has made achange in the dates of the 3 day strike. This was necessitated due to the fact that the countingof votes for Bihar assembly elections is to take place on 24.10.2010. Similarly, the date for“March to the Parliament” is also changed in view of the fact that the US President is visitingDelhi and will be addressing the Indian Parliament. Now, the final dates of the strike and“March to Parliament” will be as follows.

3 days strike - 1st, 2nd and 3rd December, 2010 “March to Parliament” - 15th November, 2010

Circle and District Secretaries are requested to make fullest mobilization for the Strike and “Marchto the Parliament”.

15.10.2010: Date of Dharna changed to 28.10.2010 :-The JAC had earlier given call to conductNation Wide dharna on 19.10.2010. However, it came to the notice of the JAC leaders that ShriGopal Das, CMD BSNL had gone on a foreign tour and would be returning to the Delhi only around23.10.2010. In view of this development the JAC, in its meeting held today, decided to change thedate of the dharna to 28.10.2010, since there is no use in holding the dharna when the CMD hasgone on foreign tour.

Successful one day hunger strike by General Secretaries on 15.10.2010 :- :-As per the decision ofthe JAC the General Secretaries went on a one day hunger strike today, the 15.10.2010, at theCorporate Office, New Delhi, demanding immediate payment of bonus to the Non-Executives andExecutives of BSNL. Most of the General Secretaries and the Convenor of the JAC participated inthe hunger strike. The programme is very successful. On behalf of the management, shri R.K.Agarwal, Director (Planning) invited the fasting leaders for discussion. After detailed discussion,the Director (Planning) assured that our demand for payment of bonus would be strongly taken upin the next Board meeting. Inspite of the assurance given by the management, the leaders continuedtheir fast till the evening.

MASS DHARNA on 28.10.2010: Convener JAC met CMD BSNL and discussed about payment ofBonus before Diwali. CMD reiterated the stand that Bonus cannot be paid since Company is inloss. However, he may put the issue before BSNL Board. All the Circle / Branch Secretaries arerequested to implement JAC programme of MASS DHARNA on 28th Oct, 2010 successfully.

Third circle conference of AIBSNLEA J&K was held on 9 th and 10th November 2010 in City of emplesJammu circle. NEW DELHI: A government panel has rejected somekey recommendations of the Sam Pitrodacommittee set up by the prime minister to suggesta turnaround strategy for loss-making BSNL, sayingdrastic changes in a state-owned company couldimpact the running of all public sector units.

This four-member department of telecom panel has rejectedthe Pitroda committee recommendation that BSNL sell a30% stake by listing on the bourses, and said that the IPOmust be ‘deferred for two years to allow the telco to improveits performance and get the right valuation’.

It has also rejected the Pitroda’s committee’s proposal toallow BSNL to bring in top professionals, including a CEOfrom the private sector, and said that ‘implementing such amove selectively for top-level positions, and also in justone PSU would have wider repercussions’.

Earlier this year, Prime Minister Manmohan Singh , worriedabout the steep decline in BSNL’s profitability over theyears, called in Sam Pitroda along with banker DeepakParekh to suggest measures for revival. They in turnrecommended a strategic 30% stake sale, staff cut by100,000 and also raising funds from sale of itsinfrastructure, such as signal towers and real estate, torevive the flagging fortunes of state-owned BSNL.

BSNL has been deteriorating in financial performance overthe years as it could not expand in time. It could not competewith the nimble-footed private mobile phone firms whichwere taking decisions quickly. The state-owned telco’sperformance has been touching new lows every yearsince 2007. It posted a loss of Rs 1,822.65 crore for theyear to end-March, a first in the company’s history. Lossesare set to mount this fiscal, indicating that the performanceturnaround the PMO is waiting for is unlikely in the immediatefuture.

The DoT panel also added that while it agreed with thePitroda committee that BSNL must urgently reduce excessemployee headcount, the required staff cut may be lessthan 100,000. This panel has also partially agreed with MrPitroda committee’s recommendations that BSNL share itsinfrastructure with private companies to improve its revenuestreams, launch a venture fund with its Rs 30,000-crorecash surplus and also hive its land bank into a separatecompany and monetise it.

This DoT panel has rejected the recommendation that BSNLsplit the cost of its chairman and managing director (CMD)into two–a chairman and an MD–and said that in a ‘PSUenvironment, it was better to continue with the post ofCMD like in other PSUs’. However, the panel, agreeing withthe Pitroda committee, has said that BSNL must completeits ongoing restructuring by March 2011.

NEWS AND VIEWSImportantly, this panel has also accepted the Pitrodacommittee’s proposal that BSNL dump its equipmentprocurement process and adopt the ‘managed capacity’model’ followed by private operators.

5. THE state-owned Bharat Sanchar Nigam (BSNL),which suffered a Rs 2,611-crore loss last fiscal, thefirst in the company’s history, has decided toauction surplus capacity on its long-distancenetwork to private companies, as it attempts toopen up new revenue streams.

The surplus bandwidth is likely to be auctioned in two lotsof 2.5 GB and 10 GB, a senior company executive told ET.BSNL’s move to share its optical fire cable (OFC) networkwith private players is seen as an extension of its earlierdecision to share its infrastructure with private players ona rent or lease basis. The PSU will soon seek governmentapprovals for the auctions after identifying the surpluscapacities and fixing a valuation for it.

Optic fibre cables carry long-distance traffic acrossdifferent parts of the country. Even mobile calls are firsttransmitted wireless to the nearest tower to the consumerand then carried on OFC networks to the closest tower tothat of the receiver. Demand for OFC bandwidth is set torise substantially with the launch of 3G services, whichwill involve high speed internet and data hungry applicationson the mobile.

“The modalities are being worked out and we will submit adetailed blueprint to the telecom department after doing avaluation of this bandwidth resource and getting a fix onwhere surplus capacities exist,” a BSNL director told ET.

BSNL will have to compete with private operators such asBhart i Airtel , Reliance Communications , TataCommunications , all of whom have extensive OFCnetworks in place across the country and share it withother operators for a fee. “The auction proceeds shouldhelp BSNL tide over its immediate financial crisis triggeredby the huge losses last fiscal, but the company shouldideally have gone for infrastructure sharing of its surplusOFC bandwidth much earlier. But it is a bold step that willunlock value for this financially stretched organisation,”said senior principal at Dua Consulting and former CMD ofthe erstwhile VSNL, BK Syngal.

Private players pitching for this BSNL resource will be ableto use this bandwidth in circles where they do not havetransmission links to establish customised closed usercommunication groups across their organisations,executives with the telco said. “Private operators will alsohave access to ready-made infrastructure since BSNLproposes to auction lit optic fibres, which unlike the darkfibre, already has the end-terminals in place,” added aBSNL executive .

GS, AGS (HQ) met Sr. GM (Pers) on 19.10.2010 anddiscussed :(a) Filling up of vacant DGM Engg posts : Werequested to fill up all vacant DGM Engg posts. Sr.GM (Pers) mentioned that DPC to fill up vacant DGMEngg posts is in progress as soon as the VCRs arereceived and action on below bench mark cases istaken by Circles and intimated to BSNL CO DPC willbe completed and promotion order will be issued tofill up vacant DGM posts.(b) Consideration of request / tenure transfer casesof SDEs (T) / DEs : We requested to consider allpending request / tenure transfer cases of SDEs (T)/ DEs. Sr. GM (Pers) mentioned that all pending casesare being examined and early action will be taken toissue the transfer orders and clarified that normallyrequest / tenure transfer orders will be issued inOctober and March.(c) Modification of posting order on promotion to DEAdhoc ? case of six SDEs of STP Circle : Werequested to intervene for allowing joining of sixSDEs of STP Circle on promotion to DE Adhoc inDNW Circle, since CGM DNW is not allowing themto join. Sr. GM (Pers) assured to look into the matter.(d) Regularisation of Adhoc DEs : We requested tofill up about 1000 DE regular posts from adhoc DEs.Sr. GM (Pers) assured to look into the matter.

GS, President met PGM (FP) on 19.10.2010 andrequested for consideration of request / tenuretransfers of CAOs / AOs / JAOs who completed morethan 2 years. PGM (FP) assured an early action.

GS discussed with PGM (BW) on 27.10.2010regarding :

(a) DPC to regularise adhoc EEs (C) : PGM (BW)informed that the DPC to regularise about 220 EEs

(C) adhoc is in progress. Most of the ACRs / VCRshave been received. Efforts are being made tocomplete DPC at the earliest and issuing regularpromotion order after the approval of the competentauthority.

(b) Consideration of request / tenure transfers ofSDEs / EEs (C) : We requested for consideration ofrequest / tenure transfers and modification of some

transfer orders of SDEs (C) / EEs (C). PGM (BW)assured to look into the matter.

GS, President, AGS (HQ), FS met CMD BSNL on27.10.2010 and discussed :

(a) Payment of PLI : We requested for payment ofPLI for the year 2009-10 since BSNL got goodgrading and the provision for payment of PLI wasalready made in the balance sheet of BSNL for year2009-10. CMD mentioned that since BSNL is notmaking profit and as per DPE guidelines PLI cannotbe paid. He immediately spoke to CMD MTNL andinquired about PLI payment in MTNL. CMD MTNLreplied that since MTNL has made 2500 crores lossfor the year 2009-10 and as per DPE guidelines PLIcannot be paid to employees. After discussion withCMD MTNL, CMD BSNL tried to convince that Unionsand Associations should drop the issue at thisjuncture and should call upon the employees forearning profit for BSNL. He further mentioned thateven small acts can earn profit e.g. one employeeshould bring one broadband customer everyday andSDOs / JTOs should hold regular meetings with theirline staff at least twice in a week to discuss thedevelopmental and maintenance activities. It willprovide leadership and involvement of staff. Whenwe apprised him about the shortage of drop wireand telephone instruments in f ield units, heimmediately spoke to Dir (CFA) and asked the store/ material position. Dir (CFA) apprised him that dropwire is being directly procured by Circles fromTelecom Factory and regarding shortage oftelephone instruments no Circle has reported toBSNL CO. In this regard, CMD advised to providethe feedback to Dir (CFA) for necessary action. CMDlastly assured to put up the PLI issue in the nextBSNL Board meeting for consideration.

(b) Implementation of DPE order regarding 78.2%IDA fitment benefit instead of 68.8% : We furtherrequested for implementation of DPE orderregarding 78.2% IDA fitment benefit instead of68.8%. CMD mentioned that the matter wasdiscussed in the BSNL Board meeting but BSNLBoard advised to implement the order only whenthere is a sign of profit in BSNL. He advised thatefforts should be made to earn profit in this current

financial year so that such issues can be considered.He informed that BSNL is to borrow Rs. 2000 croresshortly to meet out the regular expenses. If this DPEorder is implemented Rs. 1000 crores financialimplications will be there immediately. We furtherrequested that it is the DPE order which needsimplementation like 6th CPC recommendationsimplementations.

(c) DPC to fill up vacant DGM (Engg) posts and DEsregularisation : We requested to fill up all vacantDGM (Engg) posts and to regularise adhoc DEsagainst vacant DE regular posts. CMD informed thatboth the DPCs are in progress and shortly theprocess will be completed.

(d) Cancellation of transfer orders of Gr. B levelExecutives on the basis of ODI lists : CMD mentionedthat the matter has already been taken up with DOTfor clarification about Gr. B level Executives transferson the basis of ODI lists. However, he assured tofurther discuss the matter with Member (S) for earlyclarification.

(e) Unlawful recoveries of PAs / PSs of Kerala Circlebased on BSNL CO Pers section clarification : Weexpressed our serious concern against BSNL COclarification issued to CGMT Kerala Circle regardingnot considering the period from 01.10.2000 to01.01.2004 for the purpose of counting of residencyperiod for EPP in case of PAs / PSs for whom theRRs were notified on 01.01.2004. After BSNL COclarification, CGMT Kerala Circle has issued orderfor recoveries of 81 PAs / PSs of Kerala Circle, whowill be facing Rs. 2.5 to 3 lakhs (each) recoveries.We requested to withdraw the order in view of earlierBSNL Management decision and requested to stoprecoveries. CMD assured to look into the matter.

GS, AGS (F), AGS(GD), AGS(HQ) met Sr.GM (Pers.)on 01.11.2010 and discussed:-

(A) Harassment and victimization of Executives ofBhandara SSA by GMTD Bhandara:- We stronglyprotested against the harassing attitude of the GMTDBhandara towards BSNL Executives’ and requestedfor immediate intervention. Sr. GM(Pers) assured tolook into the matter

(B) Immediate withdrawal of clarification regardingcounting of residency period and consequent up

gradation under EPP/ACP- Sr.GM (Pers.) assuredto reexamine the case.

(C) Holding of LDCE to fill up about 5000 vacantSDEs(T) posts:- We demanded to hold LDCE to fillup about 5000 vacant SDEs(T) posts at the earliest.Sr.GM (Pers.) assured an early action.

(D) Posting of SDEs(T)/ DEs in DoT cell- Sr.GM(Pers.) informed that DoT cell has demanded tosend about 250 SDEs(T)/DEs to DoT cell in all circles(about 7-8 DEs in each Circle) and shortly BSNL COwill call for the volunteers.

(E) Withdrawal of clarification issued treating Sr.AO/AAO and Sr. SDE of DoT as pure time boundpromotion- We strongly protested and demandedto withdrawal the clarification issued of Sr.AO/AAOand Sr. SDE as pure time bound promotion, whereasin DoT these were post based promotions. Sr. GM(Pers.) assured to look into the matter.

GS, AGS(HQ), AGS(F), FS and Org. Secy(N) met CMDBSNL , Director(CFA) BSNL, Director (CM) BSNL &other Sr. Officers of BSNL HQ on 02.11.2010 andgreeted them on Diwali festival. On the issue ofpayment of PLI; CMD mentioned that he will takingup the matter in the next BSNL Board Meeting by theend of this month only. (a) Regarding 78.2% fitmentbenefit:- CMD BSNL mentioned that the matter hasbeen discussed in BSNL Board meeting but Boardadvised that DPE order can be implemented whenBSNL makes profit. We further pleaded that on thedate of issuance of DPE order i.e. 02.04.2009; BSNLProfit Before Tax (PBT) was more than 570 Cr, henceDPE order needs implementation. CMD furthermentioned that at this juncture BSNL not in a positionto afford additional expenditure of about 1000 Cr inimplementing DPE order. However he mentionedthat at this stage DPE order for 78.2% fitment benefitcan be implemented when the earlier pay fixationbenefit of 30% is reduced to 24%, which we stronglyopposed. (b) Promotion of DE to DGM & DEregularization: - CMD further mentioned that DPCare under process & shortly promotion order will beissued. He further mentioned that recently 37 DGMsfrom other PSUs/Private Companies has joinedBSNL & they are under going for training at ALTTC,GZB, which will provide new experience to BSNL.
