76th Legislative Session is UnderwayOn January 10, 2011, Oregon kicked off the 76th Legislative Assembly. The State of Oregon has a Citizen Legislature consisting of the Senate, whose 30 members are elected to serve four-year terms, and the House of Representatives, which has 60 members elected for two-year terms.

The Legislature convenes annually at the State Capitol in Salem, but sessions may not exceed 160 days in odd-numbered years and 35 days in even-numbered years. Five-day extensions are allowed by a two-thirds vote in each house.

In odd-numbered years, the Legislative Assembly convenes on the second Monday in January, to swear-in newly elected officials, elect legislative leaders, adopt rules, or-ganize and appoint committees, and begin introducing bills. In even-numbered years the Legislative Assembly convenes in February.

Oregon’s representative form of government is governed by rules, laws, and proce-dures. Although the process is long, complex and dominated by committees, all laws begin as someone’s idea.

Legislative DictionaryThe following are some common terms used during the legislative process:

Effective Date: ORS 171.022 reads that except as otherwise provided in an Act, an Act of the Legislative Assembly takes effect January 1 of the year after the passage of the Act.

Emergency Clause: A statement added to the end of a measure which causes a the act to become effective before the accustomed date.

Engrossed Bill: A measure that is printed with its amendments included. It will have “A” (or B, or C, etc) Engrossed at the top which signals that the bill has changed from its original form.

Enrolled Bill: The final copy of the bill which has passed both houses of Legislature and has been specially reprinted for the signatures of President of the Senate and Speaker of the House. After these confirmatory signatures, the enrolled bill goes to the Governor.

Measure: A written document used by the Legislative Assembly to propose a law. A mea-sure may be a bill, a memorial or a resolution.

Readings: The recitation of the measure’s number, title and sponsor. The First reading the measure is referred to a committee by the Speaker or the President. The Second reading occurs after the measure has been referred to the committee, worked on and reported back to the floor of the house it originated in for a vote. The Third reading occurs on the floor by either house usually before the final vote.

Changes in Oregon Lien LawA new law sponsored by the State of Oregon, House Consumer Protection and Govern-ment Accountability Committee, (HB 3689) becomes effective January 1, 2011.

The new laws will have a significant impact on:• Material Suppliers and Subcontractors, • Home Builders and Remodelers.

Material Supplier and Subcontractor Lien Rights Material suppliers and subcontractors that provide material, labor or equipment for reno-vation, remodel or repair on an existing owner-occupied residence are prohibited from perfecting a lien on a home owner’s property if the contractor they provided the material, labor or equipment to is unlicensed.

Contractors can help protect their lien rights by utilizing the e-Watch feature of their CCB myLicense account to monitor the licenses of contractors they subcontract to. Contrac-

tors using e-Watch are automatically notified when the status of the license they are monitoring changes. Licensed con-tractors can register for a CCB myLicense on the CCB website. CCB myLicense and e-Watch are an available benefit of your CCB license.

The CCB is working to expand the feature to material suppliers, or others that typically do not have a CCB license. There will likely be a small annual fee. As always, the status of a CCB license can be checked online at www.oregon.gov/CCB.

Contractors that build (or remodel) and sell Contractors that sell newly built homes or condos, or homes or condos that have had a recent, major remodel can no lon-ger obtain as a method of lien protection, a waiver of the lien protection rights from a buyer.

In 2003, lawmakers enacted the Oregon Homebuyer Protection Act (HPA) requiring the seller of a new home, or a recently remodeled home that had $50,000 or more in improvements, to complete a “Notice of Compliance with the HPA” form indicating the action they will take to provide protection for the buyer from lien claims.

Beginning January 1, 2011, a seller can:

1. Purchase title insurance with coverage to protect against possible liens;2. Retain sufficient funds in the closing escrow to pay any liens;3. Obtain a bond or letter of credit sufficient to pay any liens;4. Obtain written waivers from subcontractors and material suppliers; or5. Complete the sale at least 75 days after the completion of all construction.

These five options remain unchanged. The law removed a sixth option which was the ability of the seller to obtain a waiver of these protection requirements from the buyer.

Becoming certified to work on Energy Efficiency and Sustainable Technology projectsThe Energy Efficiency and Sustainable Technology (EEAST) is a new program managed by Oregon’s Department of En-ergy (ODOE). Under the program, utility companies loan funds to customers who will use the money for energy efficiency projects based upon an energy audit. Contractors that want to work on EEAST projects must be certified by the Construc-tion Contractors Board (CCB).

Starting January 1, 2011, CCB will begin accepting applications for EEAST certification. The fee for the certification is $50 and may be renewed annually. CCB will certify contractors that meet the following requirements. 1. The contractor must have a current, valid license with CCB. 2. The contractor must be a qualified business entity (equal opportunity employer or other). 3. The contractor, or a contractor’s employee, must have one of the following certificates. a. ENERGY STAR Building Performance Institute (BPI) Silver Star contractor b. ENERGY STAR Building Performance Institute (BPI) Gold Star contractor c. BPI certificate as: i. Building Analyst ii. Envelope iii. Heating iv. Air conditioning/heat pump v. Manufactured housing vi. Multifamily

d. Oregon Energy Coordinators Association Residential Energy Analyst Program (REAP) certificate as: i. Energy Analyst-1 ii. Energy Analyst-2 iii. Shell Tech-1 iv. Diagnostic Tech-1 v. Building Performance Specialist-1 4. The contractor must be eligible to receive a public works contract.5. The contractor must not have violated CCB rules or orders.6. The contractor must not have violated WCD rules or orders.7. The contractor must not have violated OR-OSHA rules or orders.8. The contractor must not have violated federal or state wage or hour laws.9. The contractor must certify the following. a. It will use local employees for its EEAST projects, if sufficient skilled labor is available. b. It will pay wages for EEAST projects at a rate of 180% of state minimum wage, unless federal prevailing wages are higher. c. It will pay prevailing wages for work on EEAST projects involving commercial structures.

Mercury Thermostats Annual Notification ORS 701.550(The Construction Contractors Board provides this annual notification in compliance with ORS 701.550)It is against the law for any person to install a thermostat containing mercury in commercial or residential buildings. This rule does not prohibit the installation on thermostats containing mercury on industrial equipment used for safety controls. (ORS 455.355) (OAR 918-440-0510)

The 2001 Oregon Legislature passed The Oregon Mercury Reduction Act which phased out theuse of mercury in certain consumer products for which there are readily available alternatives.

Oregon Minimum Wage Increase for 2011Oregon’s minimum wage rose to $8.50 an hour on January 1 this year. This is a 10 cent an hour increase and the first increase since January 1, 2009. The increase reflects a 1.15% increase in the Consumer Price Index (CPI) since August 2009.

In 2002 Oregon voters passed Ballot Measure 25 requiring a minimum wage adjustment annually based on changes in inflation as measured by the CPI.

Oregon is one of 10 states including Washington that annually adjusts the minimum wage based on inflation and the CPI. Washington’s minimum wage rose by 12 cents an hour to $8.67, effective January 1.

When announcing the increase last fall, State Labor Commissioner Brad Avakian said, “it is critical with our economy still straining to regain its momentum— that Oregon’s lowest wage earners not lose ground by falling behind inflation. At the same time, this modest increase will not shock businesses in a way that hurts the economic recovery.”

Special Licenses and Certifications have a List ServeThe CCB has set up individual list serves for contractors that have specific, required licenses or certificates (Home Inspec-tors, Locksmiths, Lead-based paint renovation or activities contractors). The Oregon Construction Contractors Board (CCB) recently announced final orders assessing civil penalties issued to Oregon

contractors for violation of the Construction Contractors Law (ORS 701). Oregon law requires all construction contractors to be

licensed with the CCB before they advertise, bid on, or perform construction, remodeling, or repair work.

The CCB issued 316 penalties between October 01, 2010 and December 31, 2010. Contractors receiving penalties include (see
