THE CONTRACT involves the rehabilitation of Bridge 0350 (Rowland RutherfordBridge) on Commissioner Street / Township Road 80 in Embro in the Township ofZorra in the County of Oxford. Rehabilitation required generally includes chippingand patching of deck top concrete, waterproofing, expansion joint modification,asphalt paving of deck top and approaches, and steel beam guiderail installation.

PART A

INFORMATION TO TENDERERS

A.1 DESCRIPTION OF THE WORK

The following is a general but not necessarily a complete description of thework for Bridge 0350 (Rowland Rutherford Bridge) Rehabilitation in Embroin the Township of Zorra in the County of Oxford:

The structure is an existing single span reinforced concrete deck on CPCIgirders located on Commissioner Street / Township Road 80, approximately600 metres east of Oxford County Road 6 in the Village of Embro. The workgenerally comprises of chipping and patching the existing concrete decktop, expansion joint modification, deck waterproofing and paving, paving ofroadway approaches and approach guiderail installation.

A.2 DATE AND PLACE FOR RECEIVING TENDERS

Tenders will be received at the place, date and time specified in the officialadvertisement calling for tenders.

A.3 FORM OF TENDER

Tenders shall be submitted on the tender form supplied by the Corporationand shall be accompanied by a Tender Deposit. Tender envelopes ifsupplied by the Corporation, must be used.

All items on the tender form must be bid. All unit prices must be clearlyindicated, and written in figures. Extensions and lump sum prices must bewritten in figures.

Tenders which are incomplete, conditional, illegible, or obscure, or thatcontain additions not called for, reservations, erasures, alterations, orirregularities of any kind, may be rejected as informal.

Tenders that contain prices which appear to be so unbalanced as likely toaffect adversely the interests of the Corporation may be rejected.

Wherever in a tender the amount tendered for any item does not agree withthe extension of the estimated quantity and the tendered unit price, the unitprice shall govern and the amount shall be corrected accordingly.

The Corporation reserves the right to waive informalities at its discretion.

Adjustments by telegram or letter to a tender already submitted will not beconsidered. A bidder desiring to make adjustments to a tender mustwithdraw the tender and supersede it with a later tender submission.

The tender form must be signed and witnessed in the spaces provided onthe form, with the signature of the tenderer or of a responsible official of theorganization bidding. If a joint tender is submitted, it must be signed andwitnessed on behalf of each of the tenderers and if the signing authority foreach tenderer is vested in one individual he shall sign separately on behalfof each tenderer.

The tender must be completely legible and the meaning of all entriesentirely clear.

A.4 DISQUALIFICATION OF TENDERERS

More than one tender from an individual firm, partnership, corporation orassociation under the same or different names will not be considered.Collusion between bidders will be sufficient cause for rejection of all tendersso affected.

Tenders shall not be considered if they are received after the advertisedtime on the closing date for tenders or are not accompanied by a certifiedcheque in the amount specified.

A.5 EXAMINATION OF PLANS, SPECIFICATIONS AND SITE OF WORK

The tenderer shall carefully examine the several portions of the ContractDocuments and visit the site of the work in order to satisfy himself byexamination as to all local conditions affecting the contract and as to thedetailed requirements of construction.

He shall not claim at any time after submission of his tender that there wasany misunderstanding of the terms and conditions of the Contract relating tosite conditions.

A.6 QUESTIONS

Tenderers shall carefully examine the drawings and Specifications. Shoulda tenderer find any discrepancies in, or omission from the drawings orSpecifications, or if he is in doubt as to their meaning, he shall at oncenotify the Contract Administrator, who may issue a written addendum orinstruction to all tenderers.

Questions must all be received by the Contract Administrator, by the fourthday before tender close and written instructions covering all questions willbe sent to all tenderers on the third day before tender close.

Addenda issued during the tendering period shall be allowed for by thetenderer.

All questions should be addressed to the Contract Administrator, to theattention of Mr. Trevor Hoard, CET., Kitchener Office (Phone 519-748-1199x 229, e-mail [email protected]).

A.7 QUANTITIES ESTIMATED

The quantities shown for the items in the Form of Tender are estimated onlyand are for the sole purpose of indicating to tenderers the generalmagnitude of the work. For any work done or materials supplied on a unitprice basis, the Contractor will be paid for the actual measured quantities atthe respective unit prices tendered.

A.8 INTERPRETATIONS

No oral interpretations shall be made to a tenderer as to the meaning of anyof the contract documents, or be effective to modify any of the provisions ofthe contract documents. Every request for an interpretation shall be madein writing, addressed and forwarded to the Contract Administrator.

A.9 TENDER DEPOSIT

Every tender shall be accompanied by a Certified Cheque or Bid Bondmade payable to the order of the Township of Zorra for an amount of$6,000.00.

The Certified Cheque or Bid Bond must be enclosed in the same sealedenvelope as the tender.

All such certified cheques will be returned to the respective bidders withinseven days after the tenders are opened except the lowest two which theCorporation may elect to hold until the successful bidder has executed thecontract. Thereafter, all remaining cheques will be returned, except that ofthe successful bidder which will be returned with the first progress payment.

A.10 WITHDRAWAL OF TENDER

A tenderer will be permitted to withdraw his tender unopened after it hasbeen deposited if such a request is received in writing prior to the timespecified for the opening of tenders.

A.11 AGREEMENT TO BOND

The Tender for this Contract must be accompanied by an "Agreement toBond". This bond is a guarantee that the bonding company will bond theContractor with performance, labour and material payment bonds.

On acceptance of the Tender, the Contractor shall furnish a performancebond in the amount of 100% of the contract price covering the performanceof the construction and the correction of any deficiencies and a labour andmaterial payment bond in the amount of 100% of the contract price,covering the payment of labour, materials or both. All bonds shall be issuedby a licensed Canadian bonding company. Bonding shall cover extensionsto the Contract, modifications thereof, and maintenance guarantee for aperiod of one year after acceptance of the completed contract by theCorporation.

Tenders which are not accompanied by a proper agreement to bond asspecified shall not be accepted. No work shall begin on the project until theproper bonds have been received by the Corporation. The cost of thebonds shall be borne by the Contractor.

A.12 WORK PLACE SAFETY INSURANCE BOARD

The Contractor shall at the time of entering into any contract with theCorporation, make a statutory declaration or furnish a satisfactory clearanceletter from the Work Place Safety Insurance Board stating that allassessments or compensation payable to the Work Place Safety InsuranceBoard have been paid and the Corporation may at any time during theperformance or upon the completion of such contract, require further proofthat such assessments or compensation have been paid.

The selected tenderer shall submit such statutory declaration or clearanceletter to the Corporation together with the Agreement executed by the saidtenderer.

A.13 FAILURE TO EXECUTE CONTRACT

Failure to execute the contract, to supply bonds and insurance documentsas provided herein all within ten (10) working days of the date ofacceptance of the tender, or start work as specified shall be just cause forthe annulment of the award and the forfeiture of the deposit to theCorporation, not as a penalty, but in liquidation of damages sustained.

A.14 ACCEPTANCE OR REJECTION OF TENDERS

The Corporation reserves the right to reject any or all tenders and to waiveformalities as the interests of the Corporation may require without statingreasons therefore and the lowest or any tender will not necessarily beaccepted. The Corporation shall not be responsible for any liabilities, cost,expenses, loss or damage incurred, sustained or suffered by any Tendererprior or subsequent to or by reason of the acceptance or non-acceptanceby the Corporation of any tender or by reason of any delay in theacceptance of a tender save as provided in the contract. Tenders aresubject to a formal contract being prepared and executed.

A.15 HARMONIZED SALES TAX (HST)

The Tenderer shall NOT include in his tender prices the amount of the HST(Harmonized Sales Tax) on all labour, materials, equipment rental and allother related charges necessary for the complete construction of theproject.

The Township shall pay the Contractor the applicable HST at the legislatedrate at the time of payment with each monthly progress payment inaccordance with the Contract Administrator’s progress payment certificate.

A.16 DATE OF COMPLETION

Work under this Contract shall commence anytime after award of contractand must be completed in 15 (FIFTEEN) working days from the date ofcommencement but not later than October 15, 2016. Once the road isclosed at the site, the Contractor shall proceed as quickly as possible tocomplete the construction.

A.17 OCCUPANCY OF THE WORKS

The use or occupancy of the works or any part thereof by the Corporationshall not be deemed, for any purposes whatsoever, as an acceptance orassumption of the said services by the Corporation; and further and withoutin any way limiting the generality of the agency relationship so constitutedthat, notwithstanding such entry and undertaking by the Corporation asprovided in this paragraph, all duties, responsibilities and liabilities withrespect to such works and services otherwise imposed on the Contractor byvirtue of this contract shall remain in full force and effect as against theContractor as if the Contractor had himself undertaken and performed thesaid works and services.

A.18 GENERAL CONDITIONS

The General Conditions incorporated in this Contract are the OntarioProvincial Standard General Conditions of Contract (OPSS.MUNI 100). Forthis Contract the terms “Owner” and “Corporation” shall be synonymous.

A.19 VALIDITY OF TENDER PRICES

The unit, lump sum and tender price shall be valid for not less than 60calendar days after the closing date for the tenders.

A.20 STANDARD SPECIFICATIONS

Included in the Contract Documents are certain Ontario Provincial StandardSpecifications. Copies of these standards are in common use in Ontario.Copies are on display at the office of the Consulting Engineer. Thesespecifications must be studied thoroughly in conjunction with the tenderitems to which they pertain. If there are differences between these standardspecifications and special provisions, the special provisions shall govern.

A.21 CLOSING OF ROAD

The Contractor will be permitted to close the road at the structure for therehabilitation. Once the road is closed, the Contractor shall proceed asquickly as possible to complete the construction. When the Contractorwishes to close the road, he shall give the Corporation seven days noticebefore the date when he wishes to close it. The Township will supply, erectand maintain all detour signs. The Contractor shall supply, erect andmaintain barricades and flashing lights at each side of the construction zonewarning motorists of the bridge closure, all in accordance with OTM Book 7and the Manual of Uniform Traffic Control Devices, for the duration of thework. The contractor will provide access to local residents during theclosure of the road. The Contractor will notify Emergency Services andother affected parties of the road closure and re-opening upon completion(a list will be provided by the Township).

A.22 OCCUPATIONAL HEALTH AND SAFETY

It is specifically drawn to the attention of the tenderer that the OccupationalHealth and Safety Act provides in addition to other things that,

“A constructor shall ensure, on a project undertaken by the constructor that,(a) the measures and procedures prescribed by this Act and the

regulations are carried out on the project;(b) every employer and every worker performing work on the project

complies with this Act and the regulations; and(c) the health and safety of workers on the project is protected.”

A.23 COST OF POWER AND FACILITIES AT SITE

The Contractor shall provide and shall bear the costs of all electricity, fuel,water and sanitary facilities required for, or at the site of, the works up to thedate of final completion and acceptance of the work by the ContractAdministrator.

A.24 MATERIALS TO BE SUPPLIED BY THE CONTRACTOR

The Contractor shall supply all materials required on this project, whereOntario Provincial Standard Specifications indicate to the contrary, suchclauses shall be deemed to be deleted from the Contract.

A.25 PROTECTION OF THE WATERCOURSE

During construction there must be no pollution of any watercourse byforeign material of any kind, particularly gasoline and oil. Refuelling ofmachinery must be carried out well back from the banks of anywatercourse. The Contractor shall not dispose of any concrete, asphalt, orother debris at or near the site of the bridge. All such material is to bedisposed of offsite.

A.26 EMERGENCY AND MAINTENANCE MEASURES

Whenever the construction site is unattended by the generalsuperintendent, the name, address and telephone number of a responsibleofficial of the contracting firm shall be given to the Contract Administrator.This official shall be available at all times and have the necessary authorityto mobilize workmen and machinery and to take any action directed by theContract Administrator in case of emergency or maintenance measures arerequired regardless of whether the emergency or requirement formaintenance was caused by the Contractor’s negligence, Act of God, orany cause whatsoever.

Should the Contractor be unable to carry out immediate remedial measuresrequired, the Corporation will carry out the necessary repairs, the costs forwhich shall be charged to the Contractor.

A.27 INSURANCE

Refer to OPSS.MUNI 100 General Conditions of Contract.

Further to Section GC6.03 of the General Conditions, the successful bidderwill be required to provide a certified copy of an insurance policy coveringPublic Liability and Property Damage in the amounts of not less than$5,000,000.00. The insurance policy must provide adequate protectionand generally indemnify and save harmless the Corporation in respect to allclaims of third parties in any way arising out of the Contract and shall

provide that notice in writing will be given to the Corporation thirty (30) daysbefore it is altered or cancelled during the period of this contract.

The insurance policy shall name the Corporation (The Township of Zorra)and the Contract Administrator (K. Smart Associates Limited) as hereindescribed as a joint insured and shall insure the Contractor, the ContractAdministrator and the Corporation in the same manner and to the sameextent as if a separate policy had been issued to each.

A.28 PERMITS AND IN- WATER WORK RESTRICTION PERIODS

The Contractor shall adhere to the Department of Fisheries and OceansMeasure to Avoid Harm to Fish and Fish Habitat.

There is no in-water work associated with this project.

The Contractor shall at no time claim any damages for any delay in theowner obtaining permits from the conservation authority.

A.29 LIQUIDATED DAMAGES

As further set forth in the General Conditions of this Contract, theContractor shall pay to the Corporation $500 per day for each and everycalendar day that the works shall remain unfinished after respective datesspecified.

A.30 EQUIVALENTS

When an article is specified by its trade or other name (whether such nameis followed by its phrase "or approved equal" or not), the Tenderer shallbase its tender price on the supply of the named article and no other.

After award of the Contract, the Contractor may submit requests to theContract Administrator for substitution of equivalent material. Suchsubmissions shall be accompanied by complete information on the materialproposed for use, together with revisions of costs that would result.

The Contractor shall submit requests for substitution within three weeks ofthe award of the Contract.

A.31 JOB SITE MEETING

The Contractor shall be prepared to attend a pre-construction and sitemeetings whenever requested by the Contract Administrator. He shall alsocause his Sub-Contractors, if any, to attend any or all meetings asrequested.

A.32 REVIEW OF SHOP DRAWINGS

The Contractor (or Sub Contractor or equipment supplier acting on behalf ofthe Contractor) shall submit to the Contract Administrator in accordancewith a procedure to be stipulated by the Contract Administrator all shop,working or setting drawings required in order to make clear the workproposed. The Contractor shall make any changes in such drawings thatthe Contract Administrator may require.

When submitting such drawings, the Contractor shall notify the ContractAdministrator in writing of all respects in which such drawings differ from therequirements of the Contract or from previously notified requirements of theContract Administrator. The Contract Administrator's review of suchdrawings shall not be construed as approval of such differences unless theContractor has complied with the preceding sentence hereof and unless theContract Administrator has specifically approved such differences in writing.The Contract Administrator's review of such drawings shall not relieve theContractor from responsibility for the correctness of the drawings or theadequacy of the details shown on the drawings.

Work shall not be carried out before the Contract Administrator's review ofthe shop, work or setting drawings relating to such work has been given.

A.33 MATERIALS TO BE SUPPLIED BY THE CONTRACTOR

The Contractor shall supply all materials required on this project, whereOntario Provincial Standard Specifications indicate to the contrary, suchclauses shall be deemed to be deleted from the Contract.

A.34 CONTRACTOR'S RESPONSIBILITY FOR USE OF TOWNSHIP ROADSOUTSIDE CONSTRUCTION ZONE

The Contractor shall take reasonable care in using the Township roadsoutside the construction zone. Overloading of trucks, hauling in very poorconditions or spillage of material are not considered reasonable and theContractor shall be responsible to repair any damages to the Townshiproads caused by his carelessness at his own expense and to thesatisfaction of the Contract Administrator.

A.35 LAYOUT OF THE WORK

The Contractor shall assume full responsibility for the alignment, elevations,and dimensions of each and every part of the work.

A.36 MAINTENANCE GUARANTEE

a) The Contractor shall guarantee that the material and work shall for a 12month period from the acceptance date as witnessed by the Certificateof Substantial Completion remain in such condition as will meet with theContract Administrator's approval, and that he will make good in apermanent manner, satisfactory to the Contract Administrator, anyimperfections due to materials or workmanship used in theconstruction, and any damage caused by such imperfections. Thedecision of the Contract Administrator shall be final as to the nature andcause of such imperfections and the necessity for remedying them.

Should the Contractor fail to comply with the directions of the ContractAdministrator, the Contract Administrator may, after giving theContractor forty-eight (48) hours written notice, perform the necessarywork, and the cost shall be borne by the Contractor.

b) Notwithstanding the provision of subsection (a) of this clause, theContract Administrator may, in cases of danger or public safety, makesuch immediate arrangements for repair as he sees fit, and theContract Administrator will inform the Contractor of such action. Thecost of such emergency work shall be borne by the Contractor.

c) If the Contract Administrator notifies the Contractor, in writing, ofimperfections prior to the termination of the guarantee period, theContractor shall make good the imperfections as required in subsection(a) above, notwithstanding that such work of making good maycommence after or extend beyond the end of the guarantee period.

A.37 PAYMENT CERTIFICATE

Further to Section GC8.02 'Payments' of the General Conditions, thefollowing shall apply.

Payment during the contract will be made at the rate of ninety (90) percent ofthe amount due under the Contract with 10 per cent being retained by theCorporation as the statutory holdback.

Upon acceptance of the work as "substantially performed" as defined underthe Construction Lien Act 1983 and as determined by the ContractAdministrator, a certificate of "Substantial Performance" shall be issued tothe Contractor. After the expiration of forty-five days (45) from the date of"Substantial Performance" and provided the provisions of the Contract andthe conditions stipulated under the Construction Lien Act have been fullycomplied with, payment will be made at the rate of ninety-seven and one half(97.5) per cent of the amount due under the Contract with 2.5 per cent beingretained by the Corporation for the maintenance guarantee period of 12

months. A certified cheque payable to the Township for the amount of theholdback may be requested in lieu of the holdback guarantee.

The certified cheque (tender deposit) will be returned after the contractor hasexecuted the Contract Agreement.

A.38 CERTIFICATE OF SUBSTANTIAL PERFORMANCE

The Contract Administrator will issue a Certificate of SubstantialPerformance on submission by the Contractor of the following documents:

a. Written undertaking by the Contractor to complete expeditiously anyoutstanding work and to fulfill obligations under the contract.

b. Statutory declaration in a form satisfactory to the Contract Administratorthat all liability incurred by the Contractor and the Sub-contractors in carryingout the contract has been discharged and that all liens in respect to thecontract and subcontracts have expired or have been satisfied, discharged,or provided for by payment into court.

c. Satisfactory Clearance Certificate from the Work Place Safety InsuranceBoard.

d. Extension of bonding, in a form satisfactory to the Contract Administrator,to cover the maintenance guarantee period of 12 months from the date ofthe 'Substantial Performance' certificate.

The Contract Administrator shall fill out in the Certificate of SubstantialPerformance the date in which the contract was satisfactorily performed.

On the expiration of the 12 months maintenance period from the date ofsubstantial completion, as set out in the Certificate of SubstantialCompletion, and after all known imperfect work has been rectified inaccordance with the Contract and to the satisfaction of the ContractAdministrator and the Contract Administrator is satisfied to the best of hisknowledge that the Contractor has discharged all his obligations under theContract, the Contract Administrator will issue the Final Certificate and theFinal Payment Certificate approving the release to the Contractor of theremaining holdback (or certified cheque), if any, less any deductions asprovided for in the Contract.

B.5 CONTINGENCY

The Tenderer shall ADD the amount bid for contingency work to obtain theTOTAL AMOUNT OF TENDER in a manner similar to all other items.

The Tenderer agrees that he is not entitled payment for the ContingencyItem except for additional work authorized by the Contract Administrator andcarried out by him in accordance with the Contract and then only to theextent of such additional work.

B.6 SPECIFICATIONS NUMBERS

Wherever an Ontario Provincial Standard Specification as noted on theSchedule of Drawings, Specifications, and Conditions of Contract is relevantto an item, the item shall conform to this Specification.

B.7 HARMONIZED SALES TAX

The Tenderer is referred to Item A.15 of the Instructions to Bidders,regarding the Harmonized Sales Tax.

The Tenderer shall NOT include in the Unit Prices Bid in his Tender theHarmonized Sales Tax for materials, labour, equipment, etc. which arenecessary for the completion of the project.

The Township shall pay the successful bidder the applicable HST at thelegislated rate for the period in which the work was performed at the time ofpayment with each monthly progress payment in accordance with theContract Administrator's progress payment certificate.

SP1 BONDING AND INSURANCE – Item 1

One hundred percent (100%) of the contract lump sum price for this item will be paidon the first Progress Payment Certificate.

Bonding for this item includes a 100 % Performance and Maintenance Bond and a100 % Labour and Material Payment Bond to be maintained for 12 months.

SP2 TRAFFIC CONTROL, MOBILIZATION AND DEMOBILIZATION,CONSTRUCTION LAYOUT – Item 2

The Contractor will be permitted to close the road at the structure, for thereplacement of the structure. Once the road is closed, the Contractor shall proceedas quickly as possible to complete the construction. When the Contractor wishes toclose the road he shall give the Township of Zorra a minimum of seven (7) days’notice before the date when he wishes to close it.

Work under this item shall include the supply, erection and maintenance of allnecessary barricades and signage at the limit ends of the project. The Township ofZorra will provide, place, maintain and remove all necessary detour signage asrequired beyond the limit of the project. All traffic signage, detour, barricades, etc.shall be in accordance with the latest edition of the Occupational Health and SafetyAct (OHSA) and Book 7 of the Ontario Traffic Manual (OTM) for the duration of theproject.

The Contractor shall maintain vehicular and pedestrian access to all propertiesabutting this Contract whenever possible.

This item shall also be deemed to include mobilization and demobilization as well asany construction layout required.

Payment will be made at the contract lump sum price and shall be compensation infull to complete the work as specified herein.

SP3 CONCRETE REMOVAL – PARTIAL DEPTH, TYPE A – Item 3

Work under these items shall include the removal of concrete and surfacepreparation of repair areas for patching including abrasive blast cleaning. Prior tostarting work on this item, the Contract Administrator shall inspect the structure andmark areas of removal. The Contractor shall then begin to complete the work asspecified herein. All work shall be in accordance with OPSS 928 and OPSS 929.

If reinforcing steel bar is exposed, the limit of concrete removal shall be at least25mm clearance around the steel bar. Exposed reinforcing steel bar shall beabrasive blast cleaned and painted with rust resistant paint prior to placing newconcrete. Rust resistant paint shall be approved by the Contract Administrator priorto application.

Areas of concrete demarcated for repairs shall be sawcut 25mm deep or to the firstlayer of reinforcing steel, whichever is less, around the perimeter of the repair areaprior to concrete removal. All loose concrete shall be removed to sound concrete.

Removed material shall become the property of the Contractor. The Contractor shalldispose of the material an approved dump site. The Township of Zorra will acceptclean concrete for disposal at their shop.

Measurement for payment will be measured in cubic metres (m³) of concreteremoved from the deck. The depth shall be measured to the nearest millimetre.The total volume shall be calculated to the nearest 0.1m³.

Payment will be made at the unit price bid in the Form of Tender and shall be fullcompensation for all labour, equipment, and material required to do the workincluding disposal of unwanted material as specified above.

SP4 REMOVAL OF CONCRETE APPROACH CURBS PER DRAWINGS – Item 4REMOVAL OF ASPHALT AT APPROACHES – FULL DEPTH – INCLUDINGSAWCUTS – Item 5

Under these items the contractor shall remove the concrete curb and gutters to thelimits shown at the west approach and remove the approach asphalt to the limitsshown.

Removals shall be in accordance with OPSS 510.

Existing asphalt pavement at the west approach is approximately 90mm thick.Existing asphalt pavement thickness at the east approach is unknown but likelyapproximately 50mm. Removals shall include the saw cutting of asphalt at ends ofasphalt removal as directed by the Contract Administrator.

There will be no measurement for payment for Curb Removal (Item 4).Measurement for payment for asphalt removal will be in square meters of asphaltremoved to full depth regardless of thickness.

Payment will be made at the respective price bid in the Form of Tender and shall befull compensation for all labour, equipment, and material required to complete thework.

SP5 CONCRETE PATCHING – UNFORMED SURFACE (DECK TOP) – Item 6

Work under this item shall include all labour, equipment and materials required toplace the unformed concrete in patch areas of Type A removals on the deck surfacein accordance with OPSS 930. Concrete shall be as per Table 1of OPSS 930.

All surfaces to be patched shall be coated with bonding agent. The ContractAdministrator will inspect the surface preparation prior to the placement of concreteoverlay. Concrete patching materials may be used in lieu of concrete. Concrete

patching material shall be placed in accordance with the manufacturer’srecommendations. The type of the concrete patching material and themanufacturer’s recommendations shall be submitted to the Contract Administratorfor approval.

Measurement for payment shall be of the volume of concrete or patching materialplaced in cubic metres (m3). The total volume shall be calculated to the nearest 0.01m3.

Payment will be made at the unit price bid in the Form of Tender and shall be fullcompensation for all labour, equipment, and material required to do the work.

SP6 CONCRETE CURB AND GUTTERS AND GUTTER OUTLETS PERDRAWINGS – Item 7

Work under this item shall include the concrete gutters and 90° gutter outlets asshown on the contract drawings. Work shall be in accordance with the OPSDdrawings referenced on the Contract Drawings. Concrete shall be in accordancewith OPSS 1350. Gutters and outlets shall be constructed in order to ensure positivedrainage from the road to the ditches and spillways.

No measurement for payment will be made for this item.

Payment will be made at the lump sum price bid in the Form of Tender and shall befull compensation for all labour, equipment, and material required to do the work.

SP7 SUPPLY AND PLACE GRANULAR “A” FOR ROAD AND UNDER CURBS –Item 8

Under this item the Contractor shall supply and install granular “A” material for theroadway base in accordance with OPSS 314 and OPSS 501.

The work under this item shall include trimming, grading, shaping and compaction to100% Standard Proctor Density and calcium chloride for dust control purposes.

Work under this item shall also include, at no additional cost to the Owner, theapplication of water for the purposes of compaction.

Measurement for payment shall be in tonnes (t). The Contractor shall provide theContract Administrator with copies of all printed truck tickets for materials used onthis project.

No measurement for payment will be made for this item. The condition of theexisting deck top concrete can be inspected by the Contractor prior to tender andsurface imperfections shall be accounted for in their bid.

Payment will be made at the lump sum price bid in the Form of Tender and shall befull compensation for all labour, equipment, and material required to do the work.

Work under this item shall also include any fine grading and compaction of basematerials, including any necessary handwork, and tack coats as required.

Measurement for payment will be made in tonnes (t) of asphalt placed.

Payment will be made at the unit price bid in the Form of Tender and shall be fullcompensation for all labour, equipment, and material required to do the work. Therewill be no AC Index Price Adjustment made for asphalt placed under this contract.

SP11 STEEL BEAM GUIDE RAIL WITHOUT CHANNEL – Item 15

Work under this item shall include the steel beam guide rail as shown on theContract Drawings within the minimum limits. This item includes the guide rail, theconnection to the bridge structure and all required measures for the approaches andconnection to the bridge structure, the radius guiderail elements and the terminalsections.

Measurement will be made in metres of the installed guide rails between the bridgestructure and the end of the system at each corner. Measurement shall include theportion of guide rail attached to the bridge structure. Guide rail under this item shallinclude the guide rail required for the limits as shown on the Contract Drawings.

SP12 ENVIRONMENTAL PROTECTION AND EROSION AND SEDIMENTCONTROL – Item 18

Work under this item shall include acceptable industry standards and practises toensure that the watercourse is protected from any deleterious substances.

It will be the Contractor's due diligence to ensure proper sediment and erosioncontrol is employed to prevent concrete rubble and concrete dust, fresh concrete,waterproofing, sealants, asphalt, etc., from getting into the watercourse. Also, it istheir due diligence to ensure no other deleterious substances reach the watercourse- i.e. oil/grease/fuel from the machinery or vehicles, concrete leachate, etc.

This item will only be paid if it is demonstrated by the Contractor that they haveimplemented acceptable erosion and sediment control measures and is not in

contravention at any time with current accepted practises with respect toenvironmental protection. Some examples of acceptable erosion and sedimentcontrol measures include, but are not limited to, silt fence installation, blocking deckdrains when material could fall through, misting concrete during removals, havingspill kits on site, etc.

Upper Thames River Conservation Authority Inspectors will make unannouncedvisits to ensure that the site is in a satisfactory condition.

No measurement of quantities will be made under this item.

Payment will be made at the respective lump sum price and shall be compensationin full to complete the work.

SP13 SITE RESTORATION INCLUDING TOPSOIL, SEEDING – Item 19

Work under this item shall include the complete restoration of the site and/or anyareas disturbed by the Contractor to a preconstruction state or better.

Topsoil and seed and mulch shall be placed on roadway side slopes and back slopesand elsewhere as directed by the Contract Administrator. All construction debris shallbe removed from the site.

No measurement of quantities will be made under this item.

Payment will be made at the respective lump sum price and shall be compensationin full to complete the work.

SP14 RENTAL OF HYDRO EXCAVATION TRUCK – Item 20

The work of this item shall include all labour, equipment and materials required toexpose expeditiously, existing utilities where a potential conflict may arise andrequire support and/or protection.

Measurement for payment will be by the number of hours that the Hydro ExcavationTruck is actually engaged in the work and rounded to the nearest one quarter of anhour. Payment will be at the contract hourly rate and shall be full compensation tothe Contractor for all labour, operator, equipment and material required to exposeand backfill the subject utility to an acceptable or similar condition.

The Contractor is further advised that great care must be taken when excavatingnear utilities.
