A culture of respect for privacy starts at childhood. To promote thisculture, the PCPD has produced a DVD based on the show “Tellingyou my secret” which toured more than 50 schools and waswatched by an estimated 10,000 children in 2004 and 2005. Theshow, hosted by children’s entertainer Harry Wong, features music,magic, puppets, drama and games to illustrate the importance ofpersonal data privacy. The interactive DVD uses a similar formatand will be distributed to primary schools in Hong Kong.

The Data Protection Officers’ Club (DPOC) continued to providea critical two-way communication platform on compliancy practicebetween the PCPD and public and private sector organizations. TheDPOC was established in 2000 with the primary aim of providing achannel for two-way communications between the PCPD and dataprotection officers across a broad range of organizations. It hassince grown to a membership of 237 data protection officers froma range of commercial and professional backgrounds.

In May 2005, leading privacy scholar, Professor Colin Bennett, ofthe University of Victoria, Canada, delivered a talk on the globalizationof personal data privacy protection to DPOC members. Memberswere also updated on prevailing policy instruments used for dataprotection across the globe.

As in previous years, a series of data protection workshops wereconducted from September to October 2005 exclusively formembers. Members took the opportunity to learn the applicationof data protection principles in the context of human resourcemanagement and monitoring at work and received certificates uponcompletion of the courses.

In January 2006, a meeting was held on the protection of personaldata in relation to property management. Adopting an innovative

interactive framework,PCPD staff acted somecommon cases on stageso as to encouragemembers expressingtheir views in a morerelaxed atmosphere.

Contemporary privacy issues transcend national boundaries. Forthis reason, the PCPD participates extensively in the work of regionaland international privacy organizations where representativesinfluence discussions and benefit from the experiences of otherjurisdictions.

On 1-2 June 2005, the PCPD hosted the first technical assistanceseminar for the APEC Electronic Commerce Steering Group(ECSG) to implement the APEC Privacy Framework, as membereconomies agreed during the course of 2005. Some 90 delegatesfrom 15 member economies attended the seminar in June 2005.

The majority of participants were senior government officials,representatives of the business community and civil society,consumer advocates and members of academia. The seminaraddressed key issues such as maximising the benefits of privacyprotection and information flows, public education on domesticprivacy protection and furthering cooperation between public andprivate sectors. The group also looked at appropriate remedies forsituation where privacy protection is violated and a mechanismfor reporting the domestic implementation of the APECPrivacy Framework.

In November 2005, the Privacy Commissioner represented HongKong’s interests at the Asia Pacific Privacy Authorities Forum(APPA) held in Melbourne. APPA is expanding membership acrossthe region to encourage more efficient sharing of information througha website, a system of secondment and web-based training seminars.It is also developing a regional infrastructure and secretariat that willfacilitate debate on privacy issues with a view to adopting a collectiveposition on matters of common concern.

Training seminars focussing on Hong Kong’s compliancyrequirements were organized throughout the year. TheCommissioner and his staff also participated in local andinternational conferences relating to personal data privacy issues.One focus has been the protection of personal data privacy as itrelates to young people and job seekers. To convey messagesand policies in this area, staff of the PCPD participated in theEducation and Careers Expo 2006, held in February 2006.

Liaising with international agencies remains a priority. It isimportant for Hong Kong to participate in the work of regionalprivacy organizations as a means both of influencing discussionsand benefiting from the experiences of other jurisdictions. The PrivacyCommissioner has attended international conferences andworkshops to gain insights into privacy protection legislationand how agencies responsible for protection operate.

Both the public and private sector community in Hong Kongare keen to remain abreast of developments. As a result, the PrivacyCommissioner and his staff undertook 65 speaking engagements,addressing business, professional and community groups onthe status and requirements of legislation and the protection itoffers individuals.

In 2005, The PCPD and the Hong KongFederation of Youth Groups undertook ajoint survey of young people’s attitudestowards technology and personal dataprivacy. The aim was to better understandhow young people react to the privacy-intrusive nature of certain technologiesand their applications.

More than 1000 young people agedbetween 15 and 29 were surveyed onthree key themes: attitudes towards

personal data protection in an environment where technologycan be privacy intrusive, protection practices adopted by youngpeople during recruitment and perceptions of the importance ofpersonal data privacy.

The survey revealed that young people, while accepting oftechnology, are not necessarily well-informed about the privacyimpact of technological applications. Virtually 60 per cent ofrespondents indicated they would consent to placing medicalrecords on patient medical records database proposed by theGovernment. There was a similar level of acceptance in terms ofadditional applications for Hong Kong ID cards, library cards anddriver’s licences.

Most respondents did not regard the installation of CCTV camerasin public car parks, shopping malls and residential lifts as a privacyintrusion. While the findings suggest a relatively high level oftrust among respondents over the administration of data, thesurvey noted that it is possible that young people have becomeacclimatized to privacy risks. The survey also revealed howeverthat young people are aware of the privacy dimension to phototaking in public and that to resort to this behaviour is disrespectfulof others.

On Internet usage patterns, the survey highlighted perceivedpersonal data risks associated with online shopping. Most ofthose surveyed claimed they were vigilant and many used multiplesecurity measures. In terms of selection and recruitmentprocesses, respondents indicated that they were both aware oftheir privacy rights and cautious about the use and retention oftheir personal data by a potential employer.
