COPS MORE:Making Officer Redeployment Effective

Overview

The Attorney General has established the Officeof Community Oriented Policing Services(“COPS”) within the United States Department ofJustice to implement the “Cops On the Beat” grantprovisions of the Violent Crime Control and LawEnforcement Act of 1994, signed into law by Presi-dent Clinton on September 13, 1994. Under thislaw, the COPS Office will provide grants and tech-nical assistance to law enforcement agencies andmembers of their communities to develop new andinnovative approaches to solve their communitycrime problems. A wide variety of policing pro-grams will be supported under this law throughthe year 2000.

This COPS MORE Application Kit is only foragencies that wish to redeploy current sworn lawenforcement officers to community policing andto continue these efforts after the conclusion offederal funding. COPS MORE is designed toexpand the implementation of community polic-ing through redeployment, rather than by hiringor rehiring additional law enforcement officers.

COPS MORE will make grants to the law enforce-ment agencies of state, local and Indian tribal ju-risdictions to purchase equipment and technology,to procure support resources (including civilianpersonnel), and to pay overtime. It is anticipatedthat requests from law enforcement agencies willsignificantly exceed the funds available this year,and thus applications will be reviewed competi-tively. The total amount of grants under COPSMORE will not exceed $200 million.

Under COPS MORE, a jurisdiction is requiredby law to demonstrate that the grant requestedwill result in an increase in the number of law

enforcement officers deployed in community po-licing equal to or greater than the increase inthe number of officers that would result from aCOPS grant for hiring new officers. For pur-poses of comparison, COPS hiring grants willsupport during one year on average 75 percentof an entry level officer's salary and benefits (upto $25,000).

Community Policing

Community policing is an integral part of achiev-ing the goals of combatting crime and improvingthe quality of life in the nation’s cities, towns andrural areas. Community policing stresses the im-portance of police-citizen cooperation to controlcrime, maintain order and improve the quality oflife in America. The community is an active part-ner with law enforcement in defining the prob-lems to be addressed, the tactics to be used, andthe measurements of success.

Community policing brings the police and thecommunity into a closer working relationship. Itcalls for greater citizen responsibility, and the op-portunity for citizens to contribute individually andcollectively to public safety. At the same time, itenhances police professionalism by giving offic-ers the skills, technology, authority and motiva-tion to act innovatively to solve community prob-lems. Community policing in many cases alsocalls for a restructuring of law enforcement agen-cies and the refinement of their management tech-niques to allow the fullest use of department andcommunity resources.

This approach is dependent on an effective flowof information, from sources both inside and out-side of the law enforcement agency. To be suc-

assessment of the agency's need for additionalresources under COPS MORE.

Permissible Uses for Funds

Grants awarded under COPS MORE are restrictedto the purchase of technology or equipment, theprocurement of support resources (including ci-vilian personnel) or the payment of overtime whichwill increase the number of sworn officers engagedin community policing and further the achieve-ment of a community policing mission.

“Sworn law enforcement officers” are defined asthose persons hired on a permanent basis who areauthorized by law or by a State or local public lawenforcement agency to engage in or supervise theprevention, detection, or investigation of violationsof criminal laws.

Eligible departments may apply for funds underone or more of the following permissible areasdescribed below. COPS MORE grant funds maynot be used for any purpose other than those ap-proved by the COPS Office. Examples of allow-able expenditures that may be requested are:

1. Equipment and Technology

Equipment and technology includes electroniccommunication or data processing hardware orsoftware that directly contributes to an agency'scommunity policing presence. Examples of per-missible technology are portable computers, au-tomated booking systems, cellular telephones, lo-cal area networks, geo-mapping systems and simi-lar items.

For example, a laptop computer programmed forautomated report generation might be shown tofree up two hours in report writing per officer pereight hour shift. If officers using this technologywere to engage in community policing duringthose two hours, the total amount of redeploymentwould equate to an increased community policingpresence of one quarter year of officer time.

cessful at community policing, the law enforce-ment agency should use this feedback to becomemore effective and equitable in its service deliv-ery. This informed flexibility should allow law en-forcement agencies to become more responsiveto members of the community and their represen-tatives, and to officers and their representatives.

Community policing can change the way crimecontrol is accomplished. The ultimate goal is tomaintain public safety in communities throughbetter police work, while increasing the public’sinteraction and satisfaction with police services.

Grants awarded under COPS MORE must sup-port community oriented policing. That is, onlytechnology and equipment, support resources, orthe use of overtime that increase officer presenceand influence the critical elements of a commu-nity policing mission will be considered for fund-ing.

COPS MORE funding therefore is intended toimprove police-citizen cooperation and commu-nication, to increase police and citizens' ability toinnovatively solve community problems, to facili-tate the restructuring of agencies to allow the full-est use of departmental and community resources,to promote the effective flow and use of informa-tion both within and outside an agency, and to im-prove law enforcement responsiveness to mem-bers of the community.

Under COPS MORE, only applications whichclearly link the funds sought to increase commu-nity policing presence will be considered for fund-ing.

Eligibility Requirements

All law enforcement agencies of state, local andIndian Tribal jurisdictions, as well as consortia ofagencies, are eligible to apply. Any award madeunder COPS MORE will not affect the eligibilityof an agency for other COPS programs. Similarly,agencies which have received other COPS grantsare eligible to apply under COPS MORE, howeverany prior award may be considered in the

ence through redeployment will not be funded. Forexample, the purchase of surveillance cameras andbeepers for use in undercover narcotics investiga-tions would not be permitted under COPS MORE,since this equipment would not contribute directlyto an increased community policing presence.Neither would office furnishings, riot controlequipment or weapons. If the purchase of suchitems cannot be directly equated to actual in-creases in community policing presence, they maynot be funded under COPS MORE.

2. Support Resources

The term support resources refers to the use ofnon-sworn personnel in ways that allow for theredeployment of sworn officers into communitypolicing. Examples of permissible support re-sources include the replacement of sworn officersin administrative or clerical positions with non-sworn employees, programs utilizing volunteersin support of redeployment, additional adminis-trative resources that increase officer presence incommunities, or other systems that serve the goalsof community policing.

Such support systems allow for moving officersfrom desk jobs into the field, and permit organi-zation restructuring to increase the number of of-ficers engaged in actual problem solving in theircommunities.

Support systems which do not directly contributeto increased community policing presence will notbe funded under COPS MORE. For example, thehiring of additional civilian dispatchers or moreclerical employees to supplement ones already onstaff, but which does not relieve sworn officersfrom such duties, will not be funded under COPSMORE.

3. Overtime

The term overtime refers to paying currently em-ployed sworn officers additional monies for work-ing additional hours beyond the normal work weekto engage in community policing activities.

COPS MORE funds may be used to pay for up to75 percent of an officer's overtime wage. For pur-

poses of COPS MORE, an officer's overtime wageis the amount an officer is paid for each hour ofovertime service, and does not include benefits.

Only the payment of overtime for officers actuallyengaging in increased levels of community ori-ented policing activities during the funded over-time period will be funded under COPS MORE.Funding of overtime must also exceed current andplanned overtime payments. Applicants are re-quired to describe current and planned overtimeexpenditures in their application.

COPS MORE grant funds may not be used toreplace funds that eligible agencies otherwisewould have devoted to law enforcement. The useof COPS grant funds for the supplanting of non-federal law enforcement funding is strictly pro-hibited by law. That is, any funding by an agencyunder COPS MORE must be in addition to, andnot in lieu of, an agency's funded budget plansas of October 1, 1994. A more complete discus-sion of supplanting is found on page 10.

Length of Award, Grant Amountsand Local Match

The duration of COPS MORE grants is one year.Title to any purchased items will be vested in thegrantee subject to the conditions set forth in fed-eral regulations,* which limit the disposition ofproperty. Maintenance and upkeep will be theresponsibility of the grantee.

Support resources and overtime grants may berenewed for up to two additional years, contin-gent on a showing of how COPS MORE fundshave resulted in an increase in the number of of-ficers deployed in community policing, and fu-ture appropriations. Renewal requests must besubmitted ninety days before the end of the initialgrant.

The federal share of these grants may not exceed75% of the cost of the technology, equipment,support resources or overtime. If a grant is re-newed, the federal share must decrease over theperiod of the grant, leading to retention of those

A fully executed application should be preparedin the following manner: all applications must besubmitted on 8 1/2 x 11 paper; all of the requiredmaterials should be stapled together and not oth-erwise bound, and should be printed on one sideof the paper; all applications must be typed anddouble-spaced where applicable. Video presen-tations are not permitted.

Waivers or reductions of the minimum 25% lo-cal match may be requested under COPS MORE.However, such requests will be accepted only atthe time of application and will only be grantedin cases of extraordinary local fiscal hardship.

Departments are encouraged to contribute localshares in excess of the minimum amounts required.States and local units of government may use asmatching funds assets received through the assetforfeiture equitable sharing program, the Hous-ing and Community Development Act of 1974,and other funds contributed from state, local orprivate sources or otherwise authorized by law.Funds appropriated by Congress for the activitiesof any agency of an Indian Tribal government orthe Bureau of Indian Affairs performing law en-forcement functions on Indian lands may be usedas matching funds. Federal grant monies receivedfrom other federal agencies only may be used aslocal matching funds if specifically authorized bythe other federal grant program.

How to Apply

COPS MORE applicants need to follow the in-structions contained in this kit and submit a fullyexecuted application to the COPS Office no laterthan March 17, 1995. A summary of the steps tofollow in filing a complete application can befound at the beginning of this application kit. Anoriginal application and two copies are required.Applicants must also complete the standard coversheet found in Appendix A of this application kit.Applicants must also complete the redeploymentequivalency work sheet found in Appendix B. Therequired assurances and certifications are includedin Appendixes C and D.

If an application is submitted on behalf of morethan one agency, the relationships between agen-cies must be fully described in the application. Inaddition, one agency must be designated as thepayee to receive and disburse funds, and to be re-sponsible for the supervision and coordination ofgrant activities.

A complete COPS MORE Application shouldcontain the following:

❒ Standard Application Cover Sheet — Allapplications for federal assistance must in-clude a standard application cover sheet, pro-vided in Appendix A. An example of a com-pleted cover sheet is also included in Appen-dix A. If an application is submitted on be-half of more than one jurisdiction, each co-applicant must sign the cover sheet.

❒ Cost Effectiveness Worksheet — Follow-ing the Standard Cover Sheet is a worksheetwhich will help the applicant demonstratethat the funds requested will result in an ac-tual redeployment of officers equal to theamount that would result from a COPS hir-ing grant. Complete one worksheet for eachitem for which COPS MORE funds are be-ing sought. For example, if a jurisdictionseeks a grant to pay overtime, and also topurchase a particular piece of equipment, oneCost Effectiveness Worksheet should becompleted for each of these purposes. Forequipment and technology, one Cost Effec-tiveness Worksheet should be completed foreach group of items to be purchased.

❒ Assurances — Following the Cost Effective-ness Worksheet is a page of assurances whichseek the applicant’s commitment to abide byseveral provisions of federal law applicableto this grant program. Read and sign the As-surances.

❒ Legal Certifications — Applicants mustprovide the appropriate legal certificationswhich are contained in Appendix C. Readand sign the Certifications.

❒ Application Summary — A brief summaryof the application should immediately followthe Standard Cover Sheet, Cost EffectivenessWorksheet, Assurances and Certifications.Please submit three paragraphs in the follow-ing format:

THE COPS MORE APPLICATION

1) “The City/County/Municipality of (legalname and state of applicant jurisdiction),proposes to purchase (describe technol-ogy, equipment), procure (describe sup-port resources), or pay for (give numberof overtime hours) under COPS MOREto increase the presence of existing swornofficer in community policing activities.The total federal funds requested underthis proposal are $_______. These fundswill result in (give number) of full timeequivalent officers engaged in communitypolicing per year. ”

2) “The geographic location of this agencyis (describe). The number of sworn of-ficers performing law enforcement dutiesfor this agency as of October 1, 1994 was(give agency strength, listing number ofofficers sworn and number of officersbudgeted; do not include officers whoseduties include jails or lockups, processserving, court security or other non-lawenforcement activity, and those officerswho are providing law enforcement tomunicipalities under contract to youragency), and it provides the following ser-vices (list major police services). Theagency serves a total population of (in-clude only actual population served; ifother municipal departments have primarylaw enforcement responsibilities in acounty or state served by your agency sub-tract the populations served by these otheragencies). The total number of 1994 PartI Index Crimes for the agency was (in-clude a total of the following offenses:arson, homicide, rape, aggravated assault,motor vehicle theft, robbery, burglary, andlarceny/theft).”

3) “The jurisdiction’s five year communitypolicing plan includes (list major elementsof the plan). The officers redeployed tocommunity policing will contribute to thisplan by engaging in the following activi-ties (list major activities). This plan wasdeveloped in consultation with (list other

public or private agencies or groups withinthe community). The major public safetyneeds that will be addressed through thehiring of these new officers are (list ma-jor public safety needs of area).”

❒ Budget Summary — A two to three-page de-scription of the applicant’s proposed budgetshould follow the Application Summary. Thebudget summary should describe clearly:

• The proposed amount of federal expendi-tures over the one year grant period.

• The proposed amount of non-federal (in-cluding state and local) expenditures overthe one year grant period, including howthe applicant’s local match will be made.

• An explanation of the sources of theapplicant’s local match.

• An explanation of how the amounts ofthese specific budget items amounts weredetermined.

• If and by how much the local share willexceed the minimum required.

• If a waiver of the local match or maxi-mum federal share is requested, a detaileddescription of the extraordinary local fis-cal hardship that is the ground for thewaiver.

• The agency's current expenditure and bud-get plans as of October 1, 1994 for tech-nology/equipment, support resources orovertime. Also include forecasts for fu-ture expenditures in these areas if a grantis awarded.

• The starting date of the applicant’s fiscalyear, and the applicant's designated Fed-eral cognizant agency. (If you need as-sistance in determining the Federal cog-nizant agency for your agency, please con-tact the Response Center at 1-800-421-6770.)

❒ Redeployment Equivalency Summary —Following the Budget Narrative, applicantsshould provide an overview of their Redeploy-ment Equivalency strategy, addressing the fol-lowing topics. Please limit to 3 pages, ex-cluding worksheets..

• Complete the Cost EffectivenessWorksheet, which may be found in Ap-pendix B.

• Describe how COPS MORE grant fundswill result in increased numbers of cur-rent sworn officers deployed in commu-nity policing.

• How does your plan for redeployment ofcurrent sworn officers fit into your longterm community policing plan?

❒ Community Policing Strategy — Follow-ing the Redeployment Equivalency Summary,applicants should provide an overview of theircommunity policing strategy, addressing thefollowing topics in order. Please number andbegin each section on a new page, and limitthe length of the entire strategy to 18 pages.

1. Describe your agency’s long term communitypolicing strategy and its implementation plan.

• Does your agency currently have a com-munity policing plan? If so, describe thisplan, and your expectations for its con-tinuation and expansion in the future.

• Describe the steps that you have taken toconsult with community members andgroups (e.g., schools, civic, neighborhoodand tenants’ associations, current employ-ees and organizations of employees ofyour agency) in the development of yourlong-term plan. You may attach any let-ters of support for your plan from thesegroups.

• If there is an organization which acts asthe legally authorized bargaining repre-sentative of the law enforcement officers

• Describe any fiscal, budgetary or otherlimitation on your department’s ability toredeploy officers without federal assis-tance.

5. Identify related governmental and communityinitiatives which complement or will be coor-dinated with the proposal.

• What other governmental crime controlprograms exist in your jurisdiction?

• What other community crime preventionand control programs exist in your com-munity?

• How will the redeployment of currentsworn officers for community policingcomplement these other programs?

6. Describe initial and anticipated levels of com-munity support, including financial and othertangible contributions to community policingefforts.

• What programmatic, financial or othersupport do you currently have for com-munity problem solving and crime con-trol?

• What will be the specific levels and typesof community support that your agencyis likely to receive over the next fiveyears?

2. Explain how a COPS MORE grant will be uti-lized to reorient your law enforcementagency’s mission toward community-orientedpolicing, or enhance its involvement in or com-mitment to community-oriented policing.

• How will COPS MORE funds contributeto improved police-citizen cooperationand communication?

• How will COPS MORE funds increase theability of police and citizen to innovativelysolve community problems?

• How will COPS MORE funds facilitatethe restructuring of your agency to allowthe fullest use of departmental and com-munity resources?

• How will the funds requested improve theresponsiveness of your agency's officersto members of the community?

3. Describe how redeploying officers will servea local level public safety need.

8. Describe the impact that redeploying existingsworn officers in your agency will have onother criminal justice agencies in the juris-diction.

• What will be the impact of, and your re-sponse to, increasing the number of of-ficers in your department on the prosecu-tor? Public defense? Courts? Local andstate corrections? Other public and pri-vate criminal justice agencies?

9. Describe any additional factors for consider-ation.

• Are there any other factors which providesupport for favorable consideration of thisapplication?

• Is your agency proposing yearly cashmatches in excess of the minimum re-quired? If so, how much more will bematched?

Assessment Criteria

COPS MORE Applications will be evaluated onthe following criteria:

1) Demonstration by the applicant that theproposed funds will result in deploymentof current officers into community polic-ing in a number equal to, or greater than,the number of officers which would re-sult from COPS grants of the same amount

for hiring new officers;

2) Cost effectiveness;

3) Quality of the applicant's community po-licing plan; and

4) Local level public safety need.

Demonstration of actual redeployment is arequirement of COPS MORE. Applications willnot be considered for funding if this requirementis not satisfied. In assessing applications,preference may be given to those which showlevels of officer redeployment in excess of whatwould be the case under COPS hiring programs.In other words, applications which demonstratecost effectiveness by increasing the number ofcommunity policing officers at a lower cost thanhiring new officers may be favored.

Quality of the applicant's community policing planwill be assessed by examining the extent to whichthe application addresses each of the questionsasked in the Community Policing Strategy of thisapplication kit.

Local level public safety need will be determinedin three ways. First, in their Community PolicingStrategy, applicants have the opportunity todescribe specific local level crime problems andother factors which demonstrate particular needover other jurisdictions. Second, trends in Part Icrime rates may be examined for each applicant,as may how many sworn officers per 1,000population the applicant agency currently hasdeployed in law enforcement. Third, any priorCOPS award may be considered in the assessmentof the agency's need for additional resources underCOPS MORE.

The combination of cost effectiveness, quality ofcommunity policing plan, and local level publicsafety need will determine which applications willbe funded this year, and the level at which theywill be funded. Law enforcement agencies willbe compared to agencies of like size and function.For example, municipal departments will be ratedagainst municipal departments, sheriffs against

sheriffs, and rural agencies against rural agencies.

Monitoring and ReportingRequirements

All successful grantees will be required toparticipate in grant monitoring by the COPSOffice. The monitoring process may include thesubmission of written reports, and telephone and/or on-site reviews concerning the financialadministration of the grant and the progresstowards achieving the application’s communitypolicing plan. Program monitors and auditors willbe particularly interested in assuring thatredeployment of existing law enforcementpersonnel is consistent with the applicant'sproposal.

Evaluation Requirements

A national evaluation, as well as a number of lo-cal level evaluations, will be conducted of COPSMORE. The purposes of these evaluations willbe to assess the process of implementing this pro-gram, as well as examining the possible impactsof redeploying officers. ADMINISTRATIVE REQUIREMENTSFOR APPLICANTS

Grant Funds Must Supplementand Not Supplant

Grant funds may not be used to replace state orlocal funds (or where applicable, provided by theBureau of Indian Affairs) that would, in the ab-sence of Federal aid, be available or forthcomingfor law enforcement. Instead, COPS MORE grantfunds must be used to increase the total amountof such other funds used for law enforcement.

A grant recipient may not use federal grant fundsto pay for technology, equipment, support re-sources or overtime that the recipient already isobligated or funded to pay. For example, if agrantee, prior to submitting a COPS MORE Ap-plication, had committed to purchase certainequipment or had funded a certain number ofhours of overtime in the current budget, then thegrantee must make those expenditures in addi-tion to those requested under COPS MORE.Funds currently allocated to purchase equipmentor technology, procure support resources or payovertime may not be reallocated to other purposesor refunded should a COPS MORE grant be made.Non-federal funds must remain available for anddevoted to these purposes, with COPS MOREfunds serving as a supplement to those non-fed-eral funds.

Finally, the non-federal funds used as matchingfunds for a COPS grant must be in addition tofunds that would otherwise be available for lawenforcement. For example, funds previously bud-geted for the hiring of a new officer may not bereallocated to provide local matching funds forthe procurement of equipment, technology, sup-port resources or to pay overtime under COPSMORE.

The possibility of supplanting will be the subjectof careful application review, and possible pre-award review, post-award monitoring and audit.Any supplanting of non-federal funds by COPS

grant funds is a ground for potential suspensionor termination of grant funding, recovery of fundsalready provided, and other civil or criminal sanc-tions.

As part of this application, an agency must sign acertification that no supplanting of non-federalfunds will take place should a grant award bemade. This certification shall be treated as amaterial representation of fact upon which reli-ance will be placed in the Department of Justice’sdetermination whether to award this grant.

Single Point of Contact Review

Executive Order 12372 requires applicants fromState and local units of government, or other or-ganizations providing services within a State, tosubmit a copy of the application to the State SinglePoint of Contact (SPOC), if one exists, and if thisprogram has been selected for review by the State.(Indian tribal governments are exempt from thisreview.) The State Single Points of Contact arelisted in Appendix E of this application kit. Ap-plicants must contact their State SPOC to deter-mine if the program has been selected for Statereview. If the SPOC requires a copy of the COPSMORE Application, the applicant should stillsend the original application and two copies tothe COPS Office.

Audit Requirement

The Single Audit Act of 1984, and OMB Circu-lar A-128, “Audits of State and Local Govern-ments,” establish the requirements for organiza-tional audits that apply to COPS grantees. Therequired audits are to be on an organization-wide,rather than a grant-by-grant basis, and must bearranged for by the grantee in accordance withthe requirements of the circular.

munity Policing Act of 1994, programguidelines issued thereunder, or otherprovisions of federal law; or

• Failure to make satisfactory progress to-ward the goals or strategies set forth inthis application; or

• Failure to adhere to grant agreement re-quirements or special conditions; or

• Proposing substantial plan changes to theextent that, if originally submitted, wouldhave resulted in the application not be-ing selected for funding; or

• Failure to submit reports; or

• Filing a false certification in this appli-cation or other report or document; or

• Other good cause shown.

Prior to the imposition of sanctions, the COPSOffice will provide reasonable notice to thegrantee of its intent to impose sanctions and willattempt informally to resolve the problem. Hear-ing and appeal procedures will follow those inDepartment of Justice regulations in 28 CFR Part18.

Certification RegardingLobbying; Debarment,Suspension, and OtherResponsibility Matters; Drug-Free Workplace Requirements;Coordination and Non-Supplanting Requirements

Applicants should refer to the certification formin Appendix D to determine the certification(s)to which they are required to attest. Applicantsalso should review the instructions for certifica-tion included in the regulations referred to in thecertification form. As required by Executive Order 12549, Debarment and Sus-pension, and implemented at 28 CFR Part 67, for prospec-tive participants in primary covered transactions, as definedat 28 CFR Part 67, Section 67.510 —

A. The applicant certifies that it and its principals:

(i) Are not presently debarred, suspended, proposed fordebarment, declared ineligible, sentenced to a denial of Fed-eral benefits by a State or Federal court, or voluntarily ex-

cluded from covered transactions by any Federal depart-ment or agency;

(ii) Have not within a three-year period preceding this appli-cation been convicted of or had a civil judgment renderedagainst them for commission of fraud or a criminal offensein connection with obtaining, attempting to obtain, or per-forming public (Federal, State, or local) transaction or con-tract under a public transaction; violation of Federal or Stateantitrust statutes or commission of embezzlement, theft,forgery, bribery, falsification or destruction of records, mak-ing false statements, or receiving stolen property;

(iii) Are not presently indicted for or otherwise criminally orcivilly charged by a governmental entity (Federal, State, orlocal) with commission of any of the offenses enumeratedin paragraph (A)(ii) of this certification; and

(iv) Have not within a three-year period preceding this ap-plication had one or more public transactions (Federal, State,or local) terminated for cause or default; and

B. Where the applicant is unable to certify to any of thestatements in this certification, he or she shall attach anexplanation to this application.

3. DRUG-FREE WORKPLACE (GRANTEES OTHERTHAN INDIVIDUALS)

As required by the Drug-Free Workplace Act of 1988, andimplemented at 28 CFR Part 67, Subpart F, for grantees, asdefined at 28 CFR Part 67 Sections 67.615 and67.620 —

A. The applicant certifies that it will or will continue to pro-vide a drug-free workplace by:

(i) Publishing a statement notifying employees that the un-lawful manufacture, distribution, dispensing, possession, oruse of a controlled substance is prohibited in the grantee'sworkplace and specifying the actions that will be takenagainst employees for violation of such prohibition;

(ii) Establishing an on-going drug-free awareness programto inform employees about —

(a) The dangers of drug abuse in the workplace;

Although the Department of Justice has made every effort to simplify the application process, other provisionsof federal law require us to seek your certification regarding certain matters. Applicants should read theregulations cited below and the instructions for certification included in the regulations to understand therequirements and whether they apply to a particular applicant. Signature of this form provides for compliancewith certification requirements under 28 CFR Part 69, "New Restrictions on Lobbying" and 28 CFR Part 67,"Government-wide Debarment and Suspension (Nonprocurement) and Government-wide Requirements forDrug-Free Workplace (Grants)," and the coordination and non-supplanting requirements of the Public SafetyPartnership and Community Policing Act of 1994. The certifications shall be treated as a material representa-tion of fact upon which reliance will be placed when the Department of Justice determines to award thecovered grant.

(b) The grantee's policy of maintaining a drug-free work-place;

(c) Any available drug counseling, rehabilitation, and em-ployee assistance programs; and

(d) The penalties that may be imposed upon employees fordrug abuse violations occurring in the workplace;

(iii) Making it a requirement that each employee to be en-gaged in the performance of the grant be given a copy ofthe statement required by paragraph (i);

(iv) Notifying the employee in the statement required byparagraph (i) that, as a condition of employment under thegrant, the employee will —

(a) Abide by the terms of the statement; and

(b) Notify the employer in writing of his or her conviction fora violation of a criminal drug statute occurring in the work-place no later than five calendar days after such conviction;

(v) Notifying the agency, in writing, within 10 calendar daysafter receiving notice under subparagraph (iv)(b) from anemployee or otherwise receiving actual notice of such con-viction. Employers of convicted employees must providenotice, including position title, to: COPS Program, P.O. Box14440, Washington, D.C. 20044. Notice shall include theidentification number(s) of each affected grant;

(vi) Taking one of the following actions, within 30 calendardays of receiving notice under subparagraph (iv)(b), withrespect to any employee who is so convicted —

(a) Taking appropriate personnel action against such anemployee, up to and including termination, consistent withthe requirements of the Rehabilitation Act of 1973, asamended; or

(b) Requiring such employee to participate satisfactorily ina drug abuse assistance or rehabilitation program approvedfor such purposes by a Federal, State, or local health, lawenforcement or other appropriate agency;

(vii) Making a good faith effort to continue to maintain adrug-free workplace through implementation of paragraphs(i), (ii), (iii), (iv), (v), and (vi).
