CV-R0-0515-2012 DIANE PEIGLER, COUNCILWOMAN, RESPONDENT RESTRAINING ORDER THIS MATTER having come before the Court on February 24, 2012, on Petitioners' written affidavit containing allegations of potential physical or verbal abuse against Tribal Officials, and Councilpersons and members of the staff and/or otherwise certain and irreparable injury, and concerning the above named persons, HEREBY FINDS AND RECOMMENDS: 1. This matter is within the jurisdiction of the Court pursuant to Tribal Code 1-1-17 as a civil controversy involving members of a federally recognized tribe. RESTRAINING ORDER

THIS MATTER having come before the Court on February 24, 2012, on Petitioners'

written affidavit containing allegations of potential physical or verbal abuse against Tribal

Officials, and Councilpersons and members of the staff and/or otherwise certain and

irreparable injury, and concerning the above named persons, HEREBY FINDS AND

RECOMMENDS:

1. This matter is within the jurisdiction of the Court pursuant to Tribal Code 1-1-17 as a

civil controversy involving members of a federally recognized tribe. The civil

jurisdiction of the Isleta Tribal Court shall extend to all civil proceedings wherein one

party is the Pueblo of Isleta, a wholly owned entity thereof, or an official or

employee and to all civil proceedings in which the cause of action arises on Pueblo

lands.;

2. Having considered the Petitioners' affidavit, the Court finds probable cause to

believe there is a need to assure the affiant/petitioners that they shall be free from

violence and/or otherwise certain and irreparable injury.

3. Based on this information, IT IS THEREFORE ORDERED that the Court shall

immediately issue a Restraining Order providing:

A. The parties shall not have direct or indirect personal contact with one another.

B. Neither party shall go within One Hundred (100) yards of wherever the other

party may be, including but not limited to each others' current place of residence

and employment.

C. Neither party shall damage any property owned by the party. This includes

personal/private property within either party's property.

D. The Respondent shall be prohibited from attending Tribal Council Meetings.

E. The Respondent shall not engage in any travel/training as a Councilwoman; is

not to represent Tribal Council on Pueblo of Isleta committees, and is not

allowed to represent the Pueblo of Isleta in any way as a Tribal Councilwoman,

as per the suspension order issued by the Pueblo of Isleta Ethics Board.

F. The Respondent shall cease intimidation and harassment of Tribal Officials and

Tribal Employees.

G. The Respondent shall be prohibited from entering tribal government buildings

unless on personal business.

H. The Respondent shall cease malicious and slanderous content from social media

including, but not limited, to blogs and facebook. See Exhibit A and B.

THIS RESTRAINING ORDER SHALL REMAIN IN FULL FORCE AND EFFECT PENDING A HEARING ON

THIS MATTER. FAILURE TO ADHERE MAY RESULT IN FURTHER JUDICIAL PROCEEDINGS.

Essentially, the letter is a demand for Councilwoman Zuni to return $725 for work she was paid for research and writing the 3rd Quarter Report. The delay in approval and publication was a direct result from strict direction (from Fred and Barbara) ONLY to include material and content that was to be approved by the Tribal Council Meeting Minutes process. This demand letter is nothing more than a personal attack to defame Councilwoman Zuni's integrity. The report has been ready and waiting to be placed on the agenda since late December 2011.

So as a tribal member I can take an accusation to council on any council member to have them removed for unethical conduct and it should stick...then if I were to be on council I better cover my A## because my reports may be delayed so that it looks like I am not doing my job. Wait a minute, wait a minute, if the Isleta Tribal Council want to start hauling people into Tribal Court then they'd better take it from the top...other Tribal Councilors and POI employees are allowed to fleece our tribal coffers: Mark Dixon has unpaid fees for months (runs to pay them to avoid embarrassment) and Dixon enjoys the privilege of have his housing issue is "ON HOLD" and avoids being hauled into Tribal Court - while Isleta evicts mothers and their babies; Cynthia Jaramillo was allowed have her Tribal Council duties interrupted to attend UNM for the Summer 2011 and Fall 2011 terms and received still her stipend / compensation; Pablo Padilla, (Isleta Tribal Attorney) enjoyed FREE - comped Hard Rock Hotel rooms on at least seven (7) different occasions. Talk about Hypocrisy!

Perhaps Tribal Members can make a formal request to attend (shadow) on future junkets. It's worth pursuing because there is a long list of upcoming travel the Tribal Council / Governor for 2012.

Darrell M Anzara I used to joke and say that we got all the APD rejects for our police force, doesn't seem much of a joke now. We are requiring people to go through a background check to live here. What did Gallegos go through to get hired? My father being a former BIA officer with a lot of experience says, that so called background check isn't worth the $50 you pay for. There is only so much you can get with just a social security number. An extensive background check requires finger prints and lengthy application process that sometimes goes back to your childhood. The scary thing is mat this list couia stretch even turtner it someone investigated and reported more.

in Linda Zuni Today we witnessed a dictatorship government in action. Gov. Lujan and the Isleta Tribal Council would rather arrest innocent Tribal Officials than remove Lt. Gov Torres who was convicted of DUI in Los Lunas Magistrate Court. They have their priorities all screwed up.

Mark Dixon was busted for recording in our traditional kivas and he's got his ass firmly planted on his tribal council chair! Fred, Cougar, Barbara and Cynthia when you are you going to address that issue?

Cynthia Jaramillo was arrested in July 2008 for assault & battery on a minor child and then she was CONVICTED in January 2008• Fred, Cougar, Barbara and Mark when you are you going to address that issue? Cynthia should never have been allowed to run for tribal council let alone dog catcher!

Regina Jojola I find it so saddening that our leaders choose to write policies and procedures and yet cannot seem to follow them. When that occurs it sends out a message that we are unable to govern ourselves. I agree that this is a way to keep Diane from questioning things that are happening that are not in the best interest of our people and speaking the concerns of her constituents. As a tribal member I feel that politics is no place for hypocrisy, yet we see it-time-and-time again,Sovereignty-is-what-we scream from the mountain top, yet we cannot handle governing by a constitution!! Justice seems to not exist In this community and that is sad especially when we are to teach our children the right path and to be proud of who they are as American Indians. Regina Jojola Well, I am pretty sure that each case is different but the outcomes of the cases are either convicted or not and that is what determines a violation of the code of ethics. If you are convicted then you did something unethical, if it has not been determined then you are innocent until proven guilty! That is how Justice works not the opposite, that is called a cartoon on the comedy channel. Just saying! An assumption does not land you in the newspaper as convicted nor with a conviction in tribal court for assault on a minor. Once again just saying! Sorry just a firm believer in Justice and truth. Honesty is the face of Integrity!!

Please note the typographical errors and the directive made by motion on September 13, 2011. If the Ethics Code is valid, then the Tribal Council Members who voted to direct Kateri Jojola and Matthew Zuni to file a complaint against me are in violation of the Ethics Code. According to the Ethics Code, a complaint should be file with the Ethics Board, the Tribal Council should not deliberate on

a complaint.

Note the professionalism of the author (Vice-President Joseph "Cougar" Lucero). Isn't it embarrassing that this letter went out with all these mistakes? Again, you be the JUDGE!

FACTS REGARDING FEBRUARY 2012 TRIBAL NEWSLETTER

Due to the recent misinformation published in the Isleta Tribal Newsletter for February 2012, by Governor Frank Lujan, I feel it is necessary to correct the Governor with FACTS. When I took my oath to fulfill my position as an elected official I took it with all my heart to help my fellow community members.

Here are the facts:

■I am the only person raising constitutional challenges to the Ethics Code. I hired attorney, Alvin Garcia, and he is helping me with my case before Tribal Court. Councilwoman ReGina Zuni has not She is representing herself.

■The Tribal Council did not strongly support the Ethics Code. It passed with 5 persons voting in favor and 4 persons voting against and 3 persons were absent. That is not strong support.

■Governor Frank Lujan states that the Board consists of 5 persons. It does not. According to the Ethics Code, it is supposed to consist of 3 persons. The Board took actions against me as a two (2) person Board. This is a violation of the Code assuming that it is valid. Furthermore, one of the Board Members, Judith Durzo, does not meet the qualifications to serve as a Board Member. She is already employed by the Tribe and persons serving on the Board are not permitted to be employees of the Tribe. This is based upon the language of the Ethics Code assuming that it is valid. So, I will not recognize the Ethics Board because it is operating illegally.

■I did not appear before the Ethics Board on the frivolous claims filed against me and because the Ethics

Code is unconstitutional. It is unconstitutional because the Code was never submitted to the Secretary of Interior as required in Article X of the Tribal Constitution.

■Governor Lujan states we should be responsible for our own actions. I agree, we should be responsible for our actions. I am willing to be accountable to the People of Isleta and by all means to the People who

elected me to serve in office. I will not be accountable to the Ethics Board because it is operating in violation of the Tribal Constitution. The final authority on the meaning of the Tribal Constitution is the Isleta Appellate Court. It is not Frank Lujan, Fred Lujan or the Tribal Attorney, Pablo Padilla. Every Tribal

Member has the right to challenge decisions of the Tribal Council based on the Tribal Constitution and that is what I am doing. I am exercising my rights as a Tribal Member.

■The Tribal Council did not suspend Councilman Mark Dixon due to delinquent Tribal Council

Meeting Minutes. The Tribal Council suspended him because he represented tribal members

in Tribal Court. President Fred Lujan, Vice-President Joseph "Cougar" Lucero and Secretary Barbara Sanchez did not want the Tribal Council to discuss Councilman Mark Dixon's failure to properly complete over 100 sets of Tribal Council Meeting Minutes for the 2009-2010 Term. So, the Tribal Council never took any action against Councilman Mark Dixon's failure to complete the Tribal Council Meeting Minutes. It should be

noted that "I offered my assistance to Councilman Dixon in completing the 2009-2010 Tribal Council Meeting

Minutes numerous times."

I believe in consistency and fairness. Governor Lujan and several members of the Tribal Council are not acting

with consistency and fairness. For example:

■ Governor Lujan and Secretary Barbara Sanchez stated that the Tribal Council should not take any action

against Lt. Governor Eddie Paul Torres when the State of New Mexico charged him for DWI. They said he is

innocent until proven guilty. I agreed. I spoke out that it was not proper to take any action against Lt.

Torres until the State Court made a decision on the DWI charges against him. But, in my case, Governor

Lujan and Secretary Barbara Sanchez want the Ethics Board to punish me BEFORE the State Court makes a

decision on a CIVIL Case filed against me by Kateri Jojola and Matthew Zuni. This should show you the

hypocrisy of Governor Frank Lujan and Secretary Barbara Sanchez.

Also, if Governor Frank Lujan and the Tribal Council are concerned about ethical conduct of the Tribal

Council, they would speak out against Councilwoman Cynthia Jaramillo when she participates in Tribal

Council discussions and then votes upon construction contracts in which her brother is bidding on. If we

assume that the Ethics Code is valid, then Councilwoman Jaramillo is in violation of the Ethics Code. Yet,

Governor Frank Lujan and the majority of the Tribal Council remain silent. They keep quiet because they want

her support on their issues. This is politics!

Letter to the Community

This letter is for the entire community and to the people who voted for me to serve on the Isleta Tribal Council.

On January 24, 2011, I was placed on suspension from serving upon the Council. This means that I am prohibited from attending Council meetings and fulfilling my obligations as an elected official on the Council.

The Pueblo of Isleta Ethics Board suspended me because I did not appear before them to defend myself against frivolous claims. I refused to appear before the Ethics Board because it is functioning in violation of the Constitution. The Ethics Board is supposed to consist of three (3) persons and they are responsible for reviewing ethics complaints against elected or appointed tribal officials. This Board has the power to suspend tribal officials from office for ethics violations.

You may think that an Ethics Board is a good idea for our tribe. I thought the same as well and I voted to approve the Resolution that created this Board. Unfortunately, this Council has turned the Ethics Board into a political weapon. A majority faction of this Council is using the Ethics Board to silence opposition and criticism. I am realizing it was a serious mistake to create an Ethics Board. Unfortunately, we received very poor legal advice from the Tribal Attorney, Pablo Padilla, in the language contained in the Ethics Code.

To understand why this Ethics Code is a bad idea, I must give some background information.

This past year, Councilwoman Regina Zuni and I have been vocal about some critical issues. First, the Casino, we have been losing millions of dollars. Our revenue has been dropping consistently. We had a poor GM in place for a very long time. The President of the Council Fred Lujan and the Vice-President Joseph "Cougar" Lucero were protecting him. So, they were failing to place the Casino on the Council's agenda for discussion. Week after week several Council members would ask President Lujan to place the Casino on the agenda. President Lujan and Vice-President Lucero were ignoring the requests of the Council.

Finally, Councilwoman ReGina Zuni and I decided to use a special provision in the Tribal Constitution that would force the President to place the Casino on the Council's agenda. The Constitution requires the President to conduct a Special Council Meeting at

the request of three (3) Council members. So, ReGina and I asked Council members Fernando Abeita and Josephine Padilla to sign a document that would force the President to place the Casino on the Council's agenda. This was an extreme action because ordinarily any Council Member can ask for the President or Vice-President to place an issue on the agenda for discussion informally.

However, this past year, President Fred Lujan and Vice-President Joseph Lucero were unwilling to deal with the difficult issues that the Casino is facing. As of this day, we still have serious problems with our Casino. For example, Governor Frank Lujan increased the salary of the Acting GM by $ 87,000.00 without the consent and approval of the Council. This was very troubling because he does not have the authority to increase the salary of any employee unless the Council gives its approval. Also, we have many other Casino employees that have not received a salary increase for years. So, it seemed very unfair to me that the Governor would take this action without bothering to notify the Council.

Another serious problem concerned President Fred Lujan and Vice-President Joseph Lucero continuing to disregard a decision made by the Council concerning the installation of solar panels on our new Tribal Services building. This project would have cost our tribe millions and millions of dollars. This Council considered the idea and rejected the proposal. Yet, President Lujan and Vice-President Lucero continued to place this matter on the agenda again and again. It was concerning because the Council already rejected the idea. So, I could not understand why they were trying to force the Council to approve this project. The person proposing the project was the former Governor of Sandia Pueblo Stuart Paisano. Finally, Councilwoman Zuni and I challenged the President and Vice-President for continuing to place this matter on the agenda several times even after the Council discussed and rejected the idea. Of course, they were angry that we challenged their decision.

There are many other examples of President Lujan and the Vice-President Lucero using their positions to manipulate the Council. For instance, the Council rejected the idea of constructing a Natural Resources building that will cost our tribe $2.7 million and more. This was a project that the President and Vice-President were pushing. So, they waited until eau

back on the Council's agenda. They did this because all three of us were against the project. So, when we were gone, it allowed President Lujan to get the project approved. So, now our tribe will end up wasting millions of dollars to construct a building that we do not need at this time. At this time, we have been advocating the construction of a community building (which is utilized for receptions, graduations, weddings, dinners, etc.- because the old community building has been condemned. We strongly voiced our opinion in the need for an Assisted Living Facility to keep our elders at home instead of placing them in outside facilities (Laguna Rainbow, etc.).

This caused Councilwoman Zuni and Ito raise mores questions about the leadership of the Council. We, as a Council, have accomplished very little. So, we questioned the items placed on the agenda because often the issues they place on the agenda are of little importance and we accomplish nothing.

The council members that support President Lujan came to his defense. For instance, Secretary Barbara Sanchez and Cynthia Jaramillo feel that we should not question the President or the Vice-President.

Also, Councilwoman Jaramillo used her son to attack me. When this council was running for office, I questioned whether she meets the eligibility requirements for a seat on the Council. I questioned her eligibility because she was convicted of attacking a minor child. In November of 2007, Cynthia Jaramillo was at the Isleta Recreation Center and she brutally attacked a young girl. Cynthia, at the time, was in her late 40's. Her actions were caught on video and she was forced to plead No Contest, which is the same as pleading guilty. The court forced her to write an apology to the victim. And, so, when she was running for office, I questioned it. Barbara Sanchez immediately came to her defense and she was allowed to run for office despite her criminal conviction for attacking a minor. This is something that the majority of the community does not know. So, since that time, Cynthia Jaramillo, has been very angry with me. For those of you who do not know Cynthia, she is former Governor Alvino Lucero's daughter.

Cynthia's family is angry with me. So, last year, while I was having lunch at the Subway at Bosque Farms, Cynthia's son, Matthew Zuni came into the restaurant and began staring at me angrily. I asked him what was the problem and he continued to glare at me. I suppose he later went home and told his mother, Cynthia, about seeing me because he comes before the Council demanding that I be punished because he claimed that I attacked him and he was afraid of me. Of course he is lying because the manager at the Subway signed a statement that nothing happened. The Council discussed the issues and directed him and his girlfriend, Kateri Jojola, to file a complaint against me with the Ethics Board.

Cynthia Jaramillo also filed an ethics complaint against me because she was angry that I discussed her criminal conviction of attacking a child.

Phis was not the purpose of the Ethics Board. So, I spoke to an attorney and learned that the Council made some serious mistakes in the language contained in the Ethics Code. For example, the Ethics Code contains a provision that prohibits any tribal official from speaking publicly against decisions made by a majority of the Council. This is a violation of freedom of speech. The tribal attorney, Pablo Padilla, failed to properly advise the Council about that provision. Also, the Ethics Board is only able to function as a three person panel and they have been conducting business as a 2 person panel. There are several other problems with the Ethics Code. So, I am challenging whether this Ethics Code is in violation of the Tribal Constitution.

I know that some of you may be happy that I am suspended. But, we should understand a serious and dangerous problem that the Ethics Code creates. It allows two people on the Ethics Board to suspend people from office and prohibit people from running for office for six years. The Council can put whomever it wants on this Ethics Board. So, a majority faction of the Council can silence any other elected official that it does not like by sending a complaint to the Board. The Board is then able to suspend that person from fulfilling the duties that they were elected to perform. This means that the voters who put someone in office are having their voices silenced. This is something very dangerous. Even if you do not like me, this Board may be used against someone that you may vote for in the future. This Code allows the Council to circumvent the Constitution by allowing a two person Board to suspend persons for up to 90 days. This is dangerous for our Tribe because it eliminates opposition that a majority faction of the Council may face. The whole purpose of having 12 people serve on the Council is to ensure that entire community is represented. It is to force the Council to debate and discuss issues. Allowing an Ethics Board to place elected officials on suspension is not a good idea because it will prevent your voice from being heard.

I know I have little hope with our court system, but, that is my only choice at this point. It will be up to our judges to create good precedents or bad precedents for our tribe. Despite my suspension, win or lose, I will continue to fight because I see this Council accomplishing nothing and it is due to the poor leadership of President Fred Lujan and Vice-President Joseph Lucero.

For those of you who voted for me, I will continue to voice my opinion.
