FROM: Brenda Jensen, Director of Development Services MEETING: November 9, 2021 SUBJECT: Development of Master’s Business Park Third located approximately
1,930 feet west of Imperial Avenue and north of East Highway 30. PRESENTER: Mitch Humphrey, Buffalo Surveying Corp. Discussion: The applicant is requesting approvals for a vacation, rezoning, and final plat for property located
approximately 1,930-feet west of Imperial Avenue and north of East Highway 30. The property
owners seek to increase the lot size and adjust an ingress/egress easement to serve existing commercial and industrial lots. The proposed area is outside the corporate limits but within the two-mile extraterritorial jurisdiction. Subdivision Vacations The applicant is requesting to vacate two platted subdivisions: Master’s Business Park, which contains two lots (5.99 acres) and a 50-foot ingress/egress easement and Master’s Business Park Second, which contains one lot (3.71 acres) and right-of-way dedication for Hitchcock Avenue. The applicant is acquiring land which reconfigures the lots for development. Rezoning The applicant requests to rezone the acquired property, 1.37-acres, and a sliver of land, 0.07-acres, which was not part of the previous rezone requests with Master’s Business Park and Master’s Business Park Second. The request is to rezone the additional areas of land from AG, Agricultural District to M-1, Limited Industrial District. The proposed zoning classification ties to the existing property’s zoning classification. The surrounding zoning for the property is AG to the north and west, AG and M-2 to the south, and M-1 east. The Future Land Use Map (FLU) designation is GI, General Industrial. The M-1 zoning classification is compatible with the GI FLU designation; therefore, no amendment is required. The surrounding FLU designations are GI to the north, east, and west, and UR to the south. The existing land uses are vacant agricultural land to the north, east, and west with commercial/industrial development to the south. Lots 2 & 3 of proposed Master’s Business Park Third have existing businesses on the lots: Lot 3 contains a bus sales company, Coach Master’s, and Lot 2 has an agricultural equipment business, Nebraska Harvest Center. The M-1 zoning district allows for no residential uses, many commercial, industrial, and miscellaneous use types.

Final Plat The proposed plat for the Master’s Business Park Third contains three lots. The lots range in size from 3.12 acres to 4.05 acres. The lot widths and lot areas meet the minimum requirements of the M-1 zoning district. Access for the lots is from East Highway 30 and the proposed Hitchcock Avenue. A new ingress-egress easement provides one access point along East Highway 30 for Lots 2 & 3. Lot 1 will have access off of the proposed Hitchcock Avenue, when developed. The proposed Hitchcock Avenue will be located on the east side of the development and run north and south. As indicated on the Infrastructure Feasibility Plan, Lots 2 & 3 are already developed, which requires, at this time, no new detention. Detention will be provided for Lot 1 at the time of building permit. The proposed street connectivity and how it relates to surrounding development is also shown. Buffalo County provided a letter that pointed to the minimum standards for acceptance of roads. The Planning Commission approved a preliminary plat for Master’s Business Park Third and recommended approval of the final plat on October 15, 2021. A final plat has been provided, which meets the minimum requirements of the subdivision regulations. Comprehensive Plan Related Reference ‘Maintain fair and flexible zoning and land use regulations so that future commercial development activities can continue in Central Business District, 2nd Avenue, Highway 30 corridor, and Cherry Avenue corridor.’ (LU AS 3, Land Use Action Strategies, Page 219) ‘Provide opportunities for community development in an orderly and efficient manner so that entrepreneurs can build businesses that respond to consumer demand.’ (LU 1, Land Use Policies 219) ‘Continue to encourage compatible adjacent land uses during the planning and implementation of development activities’ (LU3, Land Use Policies, Page 219).
Staff’s finding of fact:
• The proposed zoning amendment is consistent with the existing zoning of the lots and compatible with the FLU designation and purpose.
• The lots are compliant with the zoning district’s site development regulations.
• This subdivision's layout is compatible with the surrounding land uses.
• The development has provided adequate connectivity to existing transportation networks.
• The development is consistent with the 2016 Comprehensive Plan, as referenced above. Fiscal Note: The City is not aware of any undue financial obligations affecting the City that may be associated with this project. Recommended Action: Staff recommends approval of the vacations, rezoning, and final plat, as presented.

WHEREAS, the Kearney City Planning Commission has received and recommended
the Kearney City Council approve a petition to vacate a portion of Master’s Business Park,
a subdivision being part of Government Lot 2 and part of Government Lot 3 located in the
South Half of the Southeast Quarter of Section 27, Township 9 North, Range 15 West of
the 6th P.M., Buffalo County, Nebraska; and
WHEREAS, said petition was duly signed by the owners of the land affected with the
express intent of replatting and dedicating the land as Master’s Business Park Third, a
subdivision being part of Government Lot 2 and part of Government Lot 3 located in the
Southeast Quarter of Fractional Section 27, Township 9 North, Range 15 West of the 6th
P.M., Buffalo County, Nebraska; and
WHEREAS, said petition to vacate has been presented to the President and Council
of the City of Kearney, Nebraska who deemed said vacation to be advantageous to and
in the interest of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF KEARNEY, NEBRASKA:
Section 1. That a portion of Master’s Business Park, a subdivision being part of
Government Lot 2 and part of Government Lot 3 located in the South Half of the Southeast
Quarter of Section 27, Township 9 North, Range 15 West of the 6th P.M., Buffalo County,
Nebraska described as Lot 1 and Lot 2, Master’s Business Park, a subdivision being part

of Government Lot 2 and part of Government Lot 3 located in the South Half of the
Southeast Quarter of Section 27, Township 9 North, Range 15 West of the 6th P.M.,
Buffalo County, Nebraska, as the same is filed in the Office of the Buffalo County,
Nebraska, Register of Deeds at Instrument No. 2011-3845, be and is hereby vacated in
accordance with the powers granted to the City of Kearney by Neb. Rev. Stat. § 19-917,
as amended.
Section 2. That the vacated afore-described portion of Master’s Business Park, a
subdivision being part of Government Lot 2 and part of Government Lot 3 located in the
South Half of the Southeast Quarter of Section 27, Township 9 North, Range 15 West of
the 6th P.M., Buffalo County, Nebraska shall no longer be or constitute any part of the
City of Kearney, and the public highways, streets, alleys, and public grounds located
therein, if any, shall revert to the owners of lots or lands abutting the same in proportion
to the respective ownerships of such lots or grounds.
Section 3. The public is also hereby notified that Ordinance No. 8522 is subject to
limited referendum for a period of thirty (30) days after the first publication of this
Ordinance and that, after the expiration of the said thirty (30) days, Ordinance No. 8522
and any measures related to it, will not be subject to any further right of referendum.
Section 4. To repeal all ordinances and resolutions or parts of ordinances and
resolutions in conflict herewith.
Section 5. That this Ordinance shall be, at the cost of the owners, certified at the
Office of the Register of Deeds and there recorded by said owners, and that the owners
shall cause the lands in the vacated portions of the subject plats vacated to be replatted
and numbered by the County Surveyor.
Section 6. This Ordinance shall be in full force and effect from and after its passage,
approval and publication according to law and shall be published in pamphlet form by

WHEREAS, the Owner agrees to waive their right to protest annexation into corporate limits at the request of the City; and
WHEREAS, the Owner agrees to waive all rights of protest to future improvement districts that may be created; and
WHEREAS, the Owner agrees to connect to City water and sanitary sewer, at which time the Owner’s water or sanitary sewer facilities become unusable and the respective City main is available within three-hundred-feet (300’) of the Owner’s property; and
WHEREAS, public improvements must be designed and constructed in compliance with the County Minimum Roadway Design Standards and/or any additional applicable County Standards;
NOW, THEREFORE, the undersigned Owner and the City of Kearney, Nebraska (hereinafter referred to as the “City”), in consideration of the mutual covenants and agreements herein contained, agree as follows.
OWNER AGREES AS FOLLOWS:
1) That by signing this Subdivision Agreement the Owner hereby agrees to construct the following improvements in accordance with Chapter 56, of the Kearney City Code: a) Construction of storm water management facilities, including detention/retention
facilities and any associated piping, culvert drainage structures or similar appurtenances, as shown on the Infrastructure Feasibility Plan for the Final Plat and the Preliminary Plat currently on file with the City of Kearney, Development Services Department, in accordance with the following requirements. i) To maintain said storm water facilities in perpetuity with all such maintenance
costs borne collectively and proportionally by each Owner of each lot of the subdivision in the drainage basin served by the detention facilities. This obligation shall attach to all lots in the subdivision and shall run with the land. This agreement will be filed with the Buffalo County Register of Deeds office duly noting this obligation for all property Owners in the subdivision. Should the Owner of the property within the subdivision fail to maintain the storm water detention facilities, the County and/or City is hereby granted the right to enter upon the property where the storm water detention facility is located and provide for such maintenance and shall charge the property Owners within this subdivision proportionally for any and all costs relating to said maintenance. The minimum charge for maintenance by the County and/or City, shall be one-hundred-dollars ($100.00) for a mobilization fee and thereafter at a rate of one-hundred-forty-dollars ($140.00) per hour or a fraction thereof said fees being subject to change in the future to account for inflation. Owner further agrees that the Final Plat for this subdivision shall include a written notation dedicating

the detention facilities to the use and benefit of each Owner of each lot in this subdivision and that said Owners collectively and proportionally shall be responsible for all ongoing maintenance costs required by said storm water facilities in perpetuity.
ii) To allow the County and/or City access to said storm water facilities in the event of an emergency or in the event that the Owner fails to maintain the facilities as required in this agreement. Owner further agrees in the event the County and/or City shall have cause to maintain the storm water facilities, any and all costs incurred by the County and/or City due to the maintenance of the storm water facility shall be paid by the property Owners of the subdivision on a collective and proportional basis.
iii) To comply with all requirements of the National Pollution Discharge Elimination System (NPDES) and to submit all required NPDES documents to the City. Owner is responsible for all costs to construct storm water detention and appurtenances as outlined in the Infrastructure Feasibility Plan.
2) Site grading may be substantial on some portions of the property. The Owner agrees that all grading and the expenses to grade the property will be the cost of the Owner.
3) Other utilities not operated by the City, the Developer agrees to negotiate with electric, telecommunications, gas and other utilities, if applicable.
4) Owner agrees that the cost to maintain and the maintenance of all open spaces in the subdivision, including storm water detention cells, un-paved road right-of-way, roadway medians, boulevards, public sidewalks and other public right-of-way and open spaces, will be the obligation and responsibility of the Owner or an association of property Owners.
5) To indemnify and hold harmless the City and its agents and employees against all claims, damages, loses, or expenses, including reasonable attorney’s fees that arise or allegedly arise out of the design or construction of the public improvements and the storm water management facilities, not due to the negligence or omissions on the part of the City, its agents and employees. Further, Owners agree to indemnify the City for any claims, damages, or expenses, including reasonable attorney’s fees that arise out of or allegedly arise out of the design or construction of said storm water management facilities, such as damaging storm water runoffs that are caused by Owner’s negligence or omission, or that of its agents or employees.
CITY AGREES AS FOLLOWS:
1) To participate in one of the following development tools, when public improvements, water and sanitary sewer, become necessary: a) To construction of qualifying future improvement districts, created in compliance
with Chapter 57 of the City Code,

b) To draft and comply with Article 13–Developer Constructed Infrastructure of Chapter 9 of the City Code, as it applies to future public improvements for the subdivision.
2) All other components of the storm drainage system, including storm water management facilities, such as detention basins, retention ponds, bio-swales, infiltration trenches, sediment basins, underground water storage, open ditches to storm water detention facilities and similar facilities shall not be the responsibility of the City and shall be maintained in perpetuity as specified in the “Owner Agrees” section of this agreement.
THE PARTIES AGREE AS FOLLOWS:
1) This instrument is the final expression of the agreement between the parties hereto and such agreement may not be contradicted by evidence of any prior oral agreement or of a contemporaneous oral agreement between parties that allegedly exists.
2) This instrument contains the entire agreement between the parties, and no statements, promises or inducements made by either party or agent of either party that are not contained in this written contract shall be valid or binding; this contract may not be enlarged, modified, or altered except in writing signed by both parties and endorsed on this agreement.
3) This agreement shall run with the land and be binding upon and inure to the benefit of the parties hereto and shall be binding upon heirs, executors, administrators, and subsequent title owners in interest, devisees, and successors of the Owner hereto.

Road Paving and Paving Cross Sections: There is no Road Paving and PavingCross Sections required as there will be no new public paving required for thisproject. Public road access to Lot 2 and Lot 3 will be with the use of a relocateddriveway along Highway 30 to be located on the common lot line between thelots. The relocation of the common driveway will require a driveway permitgranted by the State of Nebraska Department of Transportation. The existingdriveway in front of Lot 3 will be removed with a ditch section constructed tomatch the existing ditch along Highway 30. Public road access to Lot 1 will bealong Hitchcock Avenue. Hitchcock Avenue is planned to be constructed withthe impending development of the Prairie View Business Park project located tothe east of this site. Storm Water Management: Lot 2 and Lot 3 are developed and no additionalstorm water management is required unless additional development occurs inthe future, then a Storm Water Management Plan will be required as a part of theCity's permitting process. Lot 1 is undeveloped at the present time. Upon thedevelopment of Lot 1, a Storm Water Management Plan will be required for onsitedetention. A plan will be submitted to the City of Kearney when an applicationfor a building permit is submitted to the City of Kearney.
Public Paving Sewer and Water Financing: This site does not require pubicpaving, sanitary sewer or storm sewer construction.
Individual Well and Septic Placement: This site is located outside of the City ofKearney's service area and therefore no public sanitary sewer, and water lineconstruction will be required for this project. Connection to public sewer andwater may be required should services become available to the site. Thestructures located on Lot 2 and Lot 3 are presently served by the use of an onsiteindividual well and septic systems. Lot 1 will be served by and onsite anindividual well and septic system constructed at the time of development of thelot. Each lot is greater than 3.0 acres; therefore there is no requirement forsubdivision approval by the State of Nebraska Department of Environment andEnergy (NDEE) for compliance with NAC Title 124, Rules and Regulations for theDesign, Operation and Maintenance of Onsite Wastewater Treatment Systems toobtain City approval for this subdivision.
Road Paving and Paving Cross Sections: There is no Road Paving and PavingCross Sections required as there will be no new public paving required for thisproject. Public road access to Lot 2 and Lot 3 will be with the use of a relocateddriveway along Highway 30 to be located on the common lot line between thelots. The relocation of the common driveway will require a driveway permitgranted by the State of Nebraska Department of Transportation. The existingdriveway in front of Lot 3 will be removed with a ditch section constructed tomatch the existing ditch along Highway 30. Public road access to Lot 1 will bealong Hitchcock Avenue. Hitchcock Avenue is planned to be constructed withthe impending development of the Prairie View Business Park project located tothe east of this site. There will be no other direct access to West Highway 30granted along the frontage of any lot abutting Highway 30.

Planning Commission Kearney, Nebraska October 15, 2021 9:00 a.m. Chairman Dart called to order the City of Kearney Planning Commission meeting at 9:00 a.m. on Friday, October 15, 2021. The following members were present: Stan Dart, Monte Dakan, Jeremy Feusner, Dave Malone, Richard McGinnis, John Rickard, Brent Yaw, and Melissa Scott-Pandorf. The following member was absent: Joey Cochran. Melissa Dougherty-O’Hara, City Planner and Melia Schelstrate, Associate Planner were also present. Notice of the meeting was given in advance thereof by publication in the Kearney Hub, the designated method for giving notice, a copy of the proof of publication being filed with these minutes. Advance notice of the meeting was also given to the Planning Commission and availability of the agenda was communicated in the advance notice. All proceedings hereafter shown were taken while the meeting was open to the attendance of the public. ANNOUNCEMENT Chairman Dart announced that in accordance with Section 84-1412 of the Nebraska Revised Statutes, a current copy of the Open Meetings Act is available for review and is posted on the wall at the back of the Council Chambers. Mitch Humphrey from Buffalo Surveying Corp. presented this item to the Planning Commission. Mr. Humphrey represented Advent Group, LLC and Blessing Premier Property, LLC. This site is located west of Imperial Avenue on Highway 30, in the 6400-6500 block of East Highway 30, west of the recently approved Prairie View Business Park. The Master’s Business Park Development is comprised of Lot One of Master’s Business Park Second and Lots One and Two of Master’s Business Park. They are requesting to add a bit of ground to the lots and reconfigure the shape of the lots. Currently Master’s Business Park Second and Master’s Business Park are zoned M-1. Prairie View Business Park to the east was just zoned M-1. The zoning they are proposing for the small tracts of land that they are wanting to add would be compatible with the existing zoning in the area, as well as the future land use map and comprehensive plan. The tracts that they would like to rezone are 1.37 acres to the north edge of Master’s Business Park and 0.07 acres that Blessing Premier Property obtained when they purchased the ground around it a number of years ago. They didn’t realize that the 0.07-acre strip of land came with the deal. Both parcels do not conform to the standards, if not for size then for accessibility because the 0.07-acre piece of property is too small for that zoning classification and it’s along U.S. Highway 30 which is a controlled access highway. Advent Group, LLC is going to purchase the 1.37-acre piece, along with the 0.07 acre piece. After the vacation of Master’s Business Park and Master’s Business Park Second, the lots will be incorporated into a three-lot subdivision to straighten up the lot line. Lot One of Master’s Business Park Second is somewhat of an L-shaped lot, and Lots One and Two of Master’s Business Park are more or less rectangular type polygons. The access point for the lots is off of the existing driveway into where Advent Group has the bus facility where they sell and lease buses. The access then continues over to the farm machinery facility. An easement was placed across Lot Two because they couldn’t get another access point from the State for Lot One of Mater’s Business Park. Each lot of the new subdivision will be an excess of 3 acres so NDEE review is not necessary for compliance with the well and septic separation. They proved to the State that it would be to their benefit if the existing driveway and easement went away and the driveway was moved to the common lot line. Hitchcock Avenue, which was recently approved by City Council, creates better spacing and functionality for Lots Two and Three with one driveway. There is a field drive on the property that is no longer used for a number of years. The farmer who owned it found it better to access his field from Imperial Avenue anyway, so he never used it. As part of the deal they are going to reconstruct the ditch at

the field driveway in the southwest corner of Lot One, and reconstruct the ditch where the existing driveway is so that it won’t provide access. A new permit will be required for the construction of the new driveway that will access Lots Two and Three. Chairman Dart asked to clarify if Lot One of the final subdivision is accessed off of Hitchcock Avenue. Mr. Humphrey stated that is correct. The State doesn’t want anymore access points along the corridor, so the driveway will come off of Hitchcock Avenue. The permitting for the well and septic systems will be taken care of at the time of construction, as will City and State requirements for stormwater detention. Overall, the project consists of a three-lot subdivision with an ingress egress easement for Lots Two and Three, access off of Hitchcock Avenue for Lot One, and incorporating the three tracts, or two tracts that are unplatted, into the various lots. Member Malone asked if the easement off of Highway 30 for Lots Two and Three is an easement across State property. Mr. Humphrey stated that it will be an access point off of State property with a common easement on Lots Two and Three so that there is access to both lots. They designed the easement to be 66-feet wide total, which is probably an excess of what a normal ingress egress easement would need to be. They decided that the easement needed to be 66-feet wide and far enough north so that the machinery and the trucks that they bring in and out of the site can come off the highway, straighten out, and then peel off to their respective lots. Member Malone asked if there is a 40-foot surface coming off the highway. Mr. Humphrey stated the maximum width that they can have for a driveway is 40-feet wide, so it will be no more than 40-feet wide. Going onto the site, where it makes more sense to provide a little more width for access purposes, they have done that. Member Malone asked if the State has any plans to put a turning lane out there. Mr. Humphrey stated that at this point and time, the State doesn’t think a turning lane is necessary. However, they do traffic counts on a regular basis, and if the traffic warrants turn lanes or reduced speeds that will be address at that time in the future.

Member Rickard stated that there shouldn’t be too much additional traffic because those businesses have been there for an extended period of time. They are just changing the driveway location. Mr. Humphrey agreed. In fact, it is a better spacing according to what the State told him. Even though it is only a few hundred feet, it is better spacing so it’s a safer condition for the traffic flow along the highway. City Planner stated that the proposed zoning amendment is consistent with the existing zoning of the lots and compatible with the future land use designation purposes. Lots are compliant with the zoning district M-1 site development regulations, and the layout is not significantly changing and is compatible with the surrounding land uses. The development has provided adequate connectivity to existing transportation networks and is consistent with the 2016 comprehensive plans as referenced. Staff recommends approval of the vacations, rezoning, preliminary plat, and final plat all as presented.
