The regular meeting of the Council of the Municipality ofBayham was held on Thursday,August 1, 2013 in the Council Chambers. Present were Mayor Paul Ens, Councillors WayneCasier, Tom Soufhwick and Ed Ketchabaw, Administrator Kyle Kruger and Clerk LyndaMillard.

Deputy Mayor Cliff Evanitski was absent.

John Spriet Jr., Engineer, of Spriet Associates was in attendance to present the DrainageReport. The watershed area contains approximately 0.5 hectares of farmland, containing4 newly created residential lots, located in Lot 124, Concession NTR fronting on thenorth limit ofDomielly Drive.

The proposed work will be constructed in accordance with Drainage Act guidelines andthe cost will be assessed against property Roll No. 004-09700, owned by Soreny Farms.

The Drainage Superintendent noted that the Provisional by-law requires first and secondreading and the setting of a date for the Court of Revision.

Q. Councillor Casier questioned where the branch would tie in.A. Mr. Spriet responded that the farmland property is tributary to, and will tie in to DrainNo. 7 of the Straffordville Drain.

Q. Mayor Ens questioned the capacity of the drain.A. Mr. Spriet confirmed that the new branch should not overload the existing drain.

Moved by Councillor T SouthwickSeconded by Councillor W Casier"WHEREAS, municipal building officials are the main practitioners of the OntarioBuilding Code (OBC) and use the OBC on a daily basis in the carrying out of theirduties;

AND WHEREAS Bill 124 passed in 2005 required all municipal building officials toundertake a series of qualification exams;

AND WHEREAS a subsequent regulation 332/12 (knowledge and maintenanceexaminations) requires our already quaUHed officials to re-qualify by taking asimilar series of quaUfication exams again;

AND WHEREAS this re-quaUfication process wiU provide municipalities withfinancial hardships in terms of registration costs, mileage costs, days away from theoffice to undertake their regular duties in performing timely inspections that isexpected by the buUding industry;

AND WHEREAS, municipal buUding officials acknowledge the need to stay currentwith legislation and to undergo necessary training to do so;

AND WHEREAS, the builders and home owners will suffer slower response timefor building permits and inspections untU all of the buUding officials are qualified;

AND WHEREAS, there may be an increase to permit fees to absorb the additionalcosts due to training/courses, examinations, travel, accommodations, additionalstaffing;

NOW, THEREFORE, the Municipality ofBayham, in support of the SouthwesternChapter of the Ontario BuUding Officials Association resolves;

THAT any amendments to the OBC include provisions for training opportunitiesrather than requalification examinations as the means by which building officialsremain current of changes to the OBC;

THAT municipal building officials, as the primary practitioners of the OBC,receive the same treatment as plumbers, electricians, professional engineers andarchitects with regards to exemption from re-qualification;

THAT the negative impact and delays that Ontario regulation 332/12 will have onthe issuance of permits, inspections and response times to inquiries by municipalbuilding officials should be taken in to consideration;

(a) Staff Memorandum and Letter from Stantec Consulting regarding RichmondCommunity Water Tender Results.File: E01

WaterAVastewater Manager Ed Roloson noted that all submissions failed to meet thenecessary requirements for approval.

He noted that staff propose to incorporate scaled down modifications to keep thecontractors interested and reduce costs significantly.

During construction, delivery twice daily by a local water hauler will ensure potablewater for the existing users from the Secondary Water System. This will have minimalimpact on the pressure at the tower on Nova Scotia Line. The water will be tested on thetruck and at the Richmond station.

MOE approval is based on the design of the system and does not require inspection. Staffare working with the MOE to ensure full compliance before turning on the valve for thenew system.

Request to be a delegation before Council on August 15, 2013

Dear Paul Ens and Council,

Subject: Re: Requested amendment to Open Air Bum Permit

I would like the opportunity to speak before Council regarding proposed changes to the existingguidelines of the Open Air Bum Permit. While the distance from a burning to a building

In the month of August, the police attended my home at 11 857 ElUott Road, stood with me andobserved both visually and by smell, the saturation of the smoke coming from a burning at 11887Elliott Road. The smoke filled up my home and burned my lungs/throat, and the police, whilesympathetic, noted that because the neighbours were technically and legally following the bylawrequirements for an Open Air Bum that I would have to follow-up the issue with Council tochange the bylaw. While my neighbours are technically following the bylaw requirements, theyare being incredibly inconsiderate of me and my family by positioning their fire pit so the windpicks up the smoke and directly saturates our home, rendering it essentially unlivable for theduration of the bum.

I would like to request a change to the current Open Air Bum Permit to include a piece aboutconsidering common decency and human life when it comes to neighbours living adjacent to anybums. In this particular case, my neighbours are clearly aware of the common wind directions(west to east) and the fire pit is positioned exactly east behind our house so that smoke almostalways drifts to our house during our neighbours' burnings. Additionally, while I recognize thatwe live in a commercially zoned area, my neighbours' business directly deals with timber woodshavings and they have many more bums than an average household. As a cancer survivor, I amconcerned about any toxicity in the air, and I have no control over the contaminants in the smokewhich also causes a great deal of anxiety.

The Lands & Waters Staff applied to various funding sources to help defray costs withthe Naturalization Demonstration Project. RBC Blue Water Project has confirmed their

fhcontribution of $40,000. On June 14 there will be a cheque presentation event held atthe Tillsonburg office to coincide with the fourth annual RBC Blue Water Daycelebration. LPRCA and RBC Staff will be joined by local dignitaries to plant prairiegrass on the front slope of the office property. The celebration begins at 10am.

Discussion continued on the environmental benefits of the naturalization project.

d) SHORELINE MANAGEMENT PLAN PROPOSAL

Staff has been working with Kettle Creek Conservation Authority to researchefficiencies of scale between the two organizations. The main project to come out ofthis process was a joint approach to update their respective Shoreline ManagementPlans. Since the initial discussions, Catfish Creek Conservation Authority and LowerThames River Conservation Authority have requested to join the collaborative toimplement a Shoreline Management Plan within the County of Elgin in 2014. An RFPwould be issued by the entire group to hire a consultant on the project.

Environment Canada is working with the group to provide flood modeling and help withsecuring funding for the project.

The Norfolk County Shoreline Management plan is scheduled to be implemented sometime in 2013.

f) DART PROTOCOL REPORT

The DART (Drainage Act and Section 28 Regulations) Team was formed in 2008 toexplore solutions to streamline the process between the Drainage Act and Section 28Regulations of the Conservation Authorities Act. Thanks to the work of DART there isnow a new provincial policy providing guidelines to CA staff and municipal drainagedepartments. Staff requested Board endorsement of the new protocol.

g) BACKUS MILL CONDITION REPORT

The Field Superintendent reviewed the history of the Mill including the last majorupgrades that were completed in 1956. Each year, field staff inspects the Mill andcomplete minor repairs and adjustments once the spring flooding has subsided. Thisyear, the damage exceeded staff capabilities and an engineering firm was brought in toreview the structure. Based on the advice from Spriet and Associates, staff requestedto allocate funds from other capital projects to complete a short-term repair to the Mill

and to strike a subcommittee to launch a major public fundraising campaign to overhaulthe building.

The Mill is currently closed due to safety concerns.

The Field Superintendent responded to the various questions from the Board andassured everyone that a complete overhaul would take place as soon as funds could besecured.

The Board requested a separate reserve item to be added to the 2014 budget formaintenance and repairs to the Mill.

A Joint Statement from the Elgin Area Water Supply System, theMiddlesex-London Health Unit, and Elgin'St. Thomas Public Health

The Elgin Area Water Supply System, Elgin St. Thomas Public Health and the Middlesex-London HealthUnit are advising that recent routine water quality monitoring has detected slightly elevated sodiumlevels in the water produced by the Elgin Area Water Supply System. For healthy individuals, the sodiumconcentrations that have been found do not pose a health risk, however provincial legislation requireswater system operators to advise local Medical Officers of Health when a sodium sample result exceeds20 milligrams per litre (20mg/L). Elgin St. Thomas Public Health and the Middlesex-London Health Unitare therefore advising local physicians of the situation. Patients on sodium restricted diets are beingmade aware so they can consider all potential sources of sodium, including municipal drinking water.

Elgin Area Water Supply System regularly monitors and tests municipal drinking water quality and asnoted above/ recently found sodium levels in the treated drinking water has at times exceeded thereporting requirement. Based on sample results in 2013 to date, the average sodium level in the treateddrinking water is 19.8mg/L, ranging between 18.8mg/L and 21.2mg/L

The naturally occurring sodium levels found in Lake Erie can range between 8mg and 14mg per litre. Asmuch as three quarters of the sodium in treated drinking water can come from lake water, with theremainder coming from the water treatment process.

The amount ofsodium consumed from drinking water represents a very small percentage of the totalamount of sodium consumed by the average person in a day. Most Canadians consume approximately3400mg of sodium per day, with the main source being processed foods and beverages. At a sodiumlevel of 20mg/L, drinking two litres of water from the Elgin Area Water Supply System each day wouldcontribute about 40mg of sodium to the total daily intake.

The Elgin Area Water Supply System serves the municipalities of Southwold. What is sodium?

Sodium is a naturally occurring mineral in food and water, and is a necessary element of humannutrition. Typically the consumption of sodium from food is much higher than from drinkingwater.

How does sodium get into the drinking water?

Sodiumis a min®Tal_that occurs naturally in raw water sources. At the Elgin Area Primary WaterSupply System (EAPWSS), naturally occurring sodium in Lake Erie can contribute as much asthree quarters of the sodium in the drinking water. The lake water's naturally occurring sodiumlevels range between 8 mg/L and 14 mg/L. with the remainder of the sodium in the treateddrinking water coming from the water treatment process.

When a sodium sample result indrinking water exceeds 20 mg/L, the Medical Officer of Health informs physicians and otherhealth professionals to help people following sodium restricted diets control their sodium intake.

How much sodium is in drinking water supplied from the EAPWSS?Recently the EAPWSS has found that, at times, the sodium levels in treated drinking waterexceed the 20 mg/L reporting threshold. Based on 2013 test results, the EAPWSS "treateddrinking water has an average sodium level of 19.8 mg/L, ranging between 18.8 mg/L and21.2mg/L

The human body requires sodium to maintain blood pressure, control fluid levels and for normalnewe and muscle function. Food products, not water, are the major dietary sources of sodium.Sodium is also found in drugs such as antacids, laxatives. aspirin and cough medicines, as wellas table salt. One teaspoon of table salt contains 2300 mg of sodium.

The Elgin County O.P.P. Detachment is committed to working collaboratively with all of ourmunicipal partners and community stakeholders.

Historically, members of the Elgin County O.P.P. have provided security/policing roles at Stag &Does, held in community owned facilities. These members execute their duties in aprofessional manner and are compensated in accordance with 0.P.P. Paid Duty Policy.

Unfortunately, some privately arranged functions involve activities that contravene the LiquorLicense Act and Gaming Control Act. The presence of O.P.P. members gives an inferencepolice condone unlawful actions and thus place the O.P.P. in a negative position with respect toliability.

Subsequently, in consultation with the Elgin Group Police Services Board, Elgin County O.P.P.will no longer provide Paid Duty officers at Stag and Doe licensed events. This letter is beingprovided in anticipation of necessary amendments to current by-laws and/or municipal alcoholpolicies.

Please be aware of practical alternatives available to municipalities to continue these functions,such as employing private security firms or municipalities obtaining liquor licenses formunicipal/community buildings.I am available for further consultation or discussion if you have any further inquiries with respectto this change in our policy.

Purpose

This report is to provide information regarding economic development initiatives currently in place.

Background

At its meeting of July 18, 2013, Council requested that staff provide a report on economicdevelopment initiatives currently underway. Staff have included a review of organizations andassociations in place or available.

Staff Comments

The following is an outline of the principle economic development items/activities and partnershipsthat the Municipality is involved with or are available:

2. Area Participation

Elgin Business Resource Centre (Elgin Community Futures Development Corporation).

Elgin CFDC operates across the County and provides a number of services to area businessand organizations. Bayham has assisted/participated with promotional items distribution, localpromotion, joint meetings, and short term "satellite" office space.

Otter Valley Chamber of Commerce Liaison Committee.

This committee comprised of representatives from Bayham Council and the OVCC wasfanned in 2008 as a replacement for the municipal Economic Development and TourismCommittee(s), as it had become difficult to recruit volunteers for those committees.Unfortunately, the Liaison Committee also has not met for a long period of time.

Elgin County Economic Development and Tourism Department

The County has established this department for several years to undertake economicdevelopment initiatives for the area. Bayham participates with the supply of links, informationon activities, information on industrial lands, and participation in initiatives such as BR & Eprograms.

3. Miscellaneous Initiatives

The Municipality also carries out various initiatives that may be annual or "as required", including:Memberships - annual memberships with County ofElgin Tourism, OVCC, Tourism London

Tourism advertising - Daytripping, Port Bunvell Park Guide, etc..

Promotional brochures - Port Burwell, Discover Bayham, Bayham Events.

Individual studies/items - Waterfront Master Plan, Ferry Services Feasibility report, Heritage.

Master Plan, "value-added" agricultural zoning provisions, broadband projects, BizPal, MEDTtours, TODS signage, etc.

Local event partnerships - OVCC Business Resource Package and Business Expo are previous.

BEING A BY-LAW TO AMEND BY-LAW No. Z456-2003, AS AMENDED

WHEREAS the Council of the Corporation of the Municipality ofBayham deems it necessary to amendZoning By-law No. Z456-2003, as amended;

THEREFORE, the Council of the Corporation of the Municipality ofBayham enacts as follows:

1) THATBy~law No- 2456-2003, as amended, is hereby further amended by amending Schedule"H", Map 1 by deleting from the Village Residential (Rl) Zone, and adding to the Site-SpecificVillage Residential (Rl-11) Zone, those lands outlined in heavy solid lines and marked Rl-11 onSchedule "A" to this By-law, which schedules are attached to and form part of this By-law.

BY-LAW NO. 2013-075

A BY-LAW TO CONFIRM ALL ACTIONS OFTHE COUNCIL OF THE CORPORATION OFTHE MUNICIPALITY OF BAYHAM FOR THE

REGULAR MEETING HELD AUGUST 15, 2013

WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powersof a municipal corporation are to be exercised by the Council of the municipality;

AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are tobe exercised by by-law;

AND WHEREAS the Council of the Corporation of the Municipality ofBayham deems itadvisable that the proceedings of the meeting be confirmed and adopted by by-law.

THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITYOF BAYHAM ENACTS AS FOLLOWS:

1. THAT the actions of the Council of the Corporation of the Municipality ofBayham inrespect of each recommendation and each motion and resolution passed and otheraction by the Council at the regular meeting held August 15, 2013 is hereby adopted andconfirmed as if all proceedings were expressly embodied in this by-law.

2. THAT the Mayor and Clerk of the Corporation of the Municipality ofBayham arehereby authorized and directed to do all things necessary to give effect to the action of theCouncil including executing all documents and affixing the Corporate Seal.
