Please note that there are legally enforceable deadlines associated with this Citation. Failure to act may result in the System being billed at the County of San Luis Obispo Health Agency Public Health Department Environmental Health Services (hereinafter “SLOEHS”), hourly rate for the time spent on issuing this Citation. California Health and Safety Code (hereinafter “CHSC”), Section 116577, provides that a public water system must reimburse the SLOEHS for actual costs incurred by the SLOEHS for specified enforcement actions, including but not limited to, preparing, issuing, and monitoring compliance with a citation. At this time, the SLOEHS has spent approximately two hours on enforcement activities associated with this violation. If the System does not comply with the Directives set forth in this Citation, the System will receive a bill sent from the SLOEHS in January 2020. This bill will contain fees for any enforcement time spent on the System for the current calendar year. Any person who is aggrieved by a citation issued by the SLOEHS may file a petition with the State Water Resources Control Board (State Water Board) for reconsideration of the citation. Petitions must be received by the State Water Board within 30 calendar days of the issuance of the citation. The date of issuance is the date when the SLOEHS mails or serves a copy of the citation, whichever occurs first. If the 30th day falls on a Saturday, Sunday, or state holiday, the petition is due the following business day. The California Health and Safety Code (hereinafter “CHSC”), California Code of Regulations 24

(hereinafter “CCR”) Title 22, Chapter 14, Article 4, Section 64258 authorizes the Local Primacy 25

Agency, in this case the County of San Luis Obispo Environmental Health Services department 26

(hereinafter “SLOEHS”) to conduct enforcement actions and issue citations to a public water 27

system under the jurisdiction of the local primacy agency when SLOEHS determines that the 28

public water system has violated or is violating the California Safe Drinking Water Act 29

(hereinafter “California SDWA”), (CHSC, Division 104, Part 12, Chapter 4, commencing with 30

Section 116270), or any regulation, standard, permit, or order issued or adopted thereunder. 31

SLOEHS, acting by and through its delegation from the State Water Resources Control Board, 33

Division of Drinking Water, hereby issues this citation pursuant to Section 116650 of the CHSC 34

to the COUNTRY HILLS ESTATES WATER COMPANY (hereinafter “System”), for violation of 35

California Code of Regulations (hereinafter “CCR”), Title 22, Sections 64675 and 64690.10. 36

A copy of the applicable statutes and regulations are included in Appendix 1, which is attached 38

hereto and incorporated by reference. 39

STATEMENT OF FACTS 41

The System is classified as a community water system with a population of 81 consumers, 42

serving 27 connections. The System operates under Domestic Water Supply Permit issued by 43

SLOEHS on March 6, 2008. 44

The System is required to maintain a monitoring program for lead and copper levels at the 46

consumers’ tap. The System is required to complete standard monitoring, which is two 47

consecutive six-month standard monitoring periods from the same sample sites. The number 48

of tap sample sites required for the System is five, based on population. SLOEHS received data 49

for sampling done in November of 2017. SLOEHS received a subsequent data set in June of 50

2018, which met the two-consecutive six-month monitoring period requirement. However, 51

none of the sample sites in June 2018 were the same as the November 2017 sample sites. The 52

System had not requested a sample site change. If the System had requested a sample site 53

change, they would have been informed at that time that changing all five sample sites would 54

result in starting the standard monitoring over. The System was informed via email on August 55

8, 2018 that the sample sites from June 2018 did not match the November 2017 sample sites, 56

and an additional sample set matching the June 2018 sample sites would be due by December 57

31, 2018. SLOEHS has not received any data to date to indicate that sampling for the second, 58

consecutive monitoring period at the same five sample sites was completed. 59

The analytical results must be reported to SLOEHS within the first 10 days after the end of each 61

period during which monitoring was conducted. The Lead and Copper Rule Reporting Form 62

should also be completed and submitted to SLOEHS no later than the 10th day of the month 63

following completion of the analyses. 64

DETERMINATION 66

The System was required to collect and report lead and copper samples during two consecutive 67

six-month periods in 2017-2018. The System failed to collect and report the required number of 68

lead and copper analytical results to SLOEHS for the second, consecutive monitoring period of 69

the same five sample sites by December 31, 2018. Therefore, SLOEHS has determined that the 70

System has failed to comply with CCR, Title 22, Sections 64675 and 64690.10 during the 2018 71

calendar year. Because the sampling must be consecutive six-month periods, previous sample 72

results cannot be used. 73

DIRECTIVES 75

The System is hereby directed to take the following actions: 76

1. The System shall collect and report lead and copper samples at the same five sample 78

sites for two consecutive six-month periods in accordance with CCR, Title 22, Sections 79

64675 and 64690.10 no later than June 30, 2019 and December 31, 2019. Appendix 4: 80

Lead and Copper Rule Reporting Form shall be used to submit the results of this 81

monitoring to SLOEHS. 82

2. On or before July 1, 2019, notify all persons served by the System of the violation of 84

CCR, Title 22, Sections 64675 and 64690.10, in conformance with Sections 64463.7 and 85

64465. Copies of Sections 64463.7 and 64465 are included in Appendix 1. Appendix 2: 86

Notification Template shall be used to fulfill this Directive, unless otherwise approved by 87

SLOEHS. Section 64463.7 allows the System to utilize the 2018 Consumer Confidence 88

Report to meet the requirement of notification within a one-year period. In addition to 89

the required information for the Consumer Confidence Report, the System shall include 90

the following language in the Consumer Confidence Report: “We are required to 91

monitor your drinking water for specific contaminants on a regular basis. Results of 92

regular monitoring are an indicator of whether or not your drinking water meets health 93

standards. During 2018, we did not complete all monitoring for lead and copper 94

monitoring, and therefore, cannot be sure of the quality of your drinking water during 95

that time.” 96

The System shall include this violation in the 2018 Consumer Confidence Report in 98

accordance with CCR, Title 22, Section 64481(g)(1). If the System has already sent the 99

2018 Consumer Confidence Report to consumers, the System is required to send an 100

amendment to the report. 101

3. Complete Appendix 3: Compliance Certification Form. Submit it together with a copy of 103

the public notification required by Directive 2 to SLOEHS on or before July 31, 2019. 104

4. The System shall ensure that their lead and copper monitoring program is maintained in 106

accordance with the Lead and Copper Rule and that the analytical results are reported 107

to SLOEHS no later than the 10th day of the month following completion of the analyses. 108

Appendix 4: Lead and Copper Rule Reporting Form shall be completed and submitted to 109

SLOEHS no later than the 10th day of the month following completion of the analyses. 110

This Citation shall apply to and be binding upon Water System, its owners, shareholders, 141

officers, directors, agents, employees, contractors, successors, and assignees. 142

SEVERABILITY 144

The directives of this Citation are severable, and Water System shall comply with each and 145

every provision hereof, notwithstanding the effectiveness of any other provision. 146

FURTHER ENFORCEMENT ACTION 148

The California SDWA authorizes SLOEHS to: issue a citation with assessment of administrative 149

penalties to a public water system for violation or continued violation of the requirements of 150

the California SDWA or any regulation, permit, standard, citation, or order issued or adopted 151

thereunder including, but not limited to, failure to correct a violation identified in a citation or 152

compliance order. The California SDWA also authorizes SLOEHS to take action to suspend or 153

revoke a permit that has been issued to a public water system if the public water system has 154

violated applicable law or regulations or has failed to comply with an order of SLOEHS; and to 155

petition the superior court to take various enforcement measures against a public water system 156

that has failed to comply with an order of SLOEHS. SLOEHS does not waive any further 157

enforcement action by issuance of this Citation. 158

APPENDIX�1�APPLICABLE�STATUTES�AND�REGULATIONS�

LEAD�AND�COPPER�MONITORING�AND�REPORTING�VIOLATION��

�(b)�During�each�period,�each�system�conducting�reduced�tap�sampling�shall�collect�at�least�

one�sample�from�the�number�of�sites�based�on�the�number�of�people�served�specified�in�table�64675�A�under�Reduced�Tap�Sampling,�as�follows:�

(1)�The�sites�shall�be�representative�of�the�sites�required�for�standard�tap�sampling.��(2)�The�samples�shall�be�collected�during�the�months�of�June,�July,�August,�or�

�§64675.5.�Tap�Sampling�Frequency.�

(a)�A�system�shall�conduct�standard�tap�sampling�for�two�consecutive�periods;�thereafter,�tap�sampling�frequency�may�be�reduced�pursuant�to�section�64675�(General�Requirements�for�Tap�Sampling�for�Lead�and�Copper)�as�follows:�

(1)�If�a�system�has�90th�percentile�levels�that�do�not�exceed�0.005�mg/L�for�lead�and�0.65�mg/L�for�copper�for�two�consecutive�periods,�it�may�reduce�the�sampling�to�once�every�three�years�at�the�reduced�number�of�sites;��

(2)�For�systems�that�do�not�meet�the�criteria�in�paragraph�(1),�after�two�consecutive�periods�with�no�action�level�exceedance,�the�frequency�may�be�reduced�to�annually�at�the�reduced�number�of�sites,�if�the�system�receives�written�approval�from�the�Department�based�on�its�review�of�the�system’s�data.�After�sampling�for�three�years�(including�the�initial�sampling�year)�with�no�action�level�exceedance,�the�frequency�may�be�reduced�to�once�every�three�years�at�the�reduced�number�of�sites,�if�the�system�receives�written�approval�from�the�Department.�

�(b)�If�a�system�demonstrates�for�two�consecutive�periods�that�the�difference�between�the�

90th�percentile�tap�sampling�lead�level�and�the�highest�source�water�monitoring�result�for�each�period�is�less�than�the�reporting�level�for�purposes�of�reporting�(DLR),�pursuant�to�subsections�64678(a),�(b),�and�(c)�or�that�the�source�water�lead�levels�are�below�the�method�detection�level�of�0.001�mg/L�and�the�90th�percentile�lead�level�is�equal�to�or�less�than�the�DLR�for�each�period,�the�system�shall�conduct�tap�sampling�once�every�three�years.��Article�9.�Reporting�and�Recordkeeping�§64690.10.�Data�Reporting.�Each�system�shall�report�the�following�within�the�first�10�days�after�the�end�of�each�period�during�which�such�sampling�or�monitoring�was�conducted:�

(a)�For�lead�and�copper�tap�sampling:�(1)�The�results�of�all�tap�samples�including�the�location�of�each�site�and�the�associated�

tier�criteria�from�section�64676�(Sample�Site�Selection);��(2)�The�90th�percentile�lead�and�copper�concentrations�calculated�pursuant�to�section�

64678�(Determination�of�Exceedances�of�Lead�and�Copper�Action�Levels);�and�(3)�With�the�exception�of�the�first�period�of�tap�sampling,�an�identification�of�any�site�

that�was�not�sampled�during�previous�periods,�along�with�an�explanation�of�why�the�sampling�site�was�changed;�

�(b)�For�WQP�monitoring,�the�results�of�all�samples�collected�and�analyzed�pursuant�to�article�

4�(WQP�Monitoring)�of�this�chapter;���

(c)�For�source�water�monitoring:�(1)�The�results�for�all�samples�related�to�source�water�collected�and�analyzed�under�

article�6�(Source�Water�Requirements�for�Action�Level�Exceedances)�of�this�chapter;�and�(2)�With�the�exception�of�the�first�round�of�sampling�related�to�source�water,�an�

identification�of�any�site�that�was�not�sampled�during�previous�periods�along�with�an�explanation�of�why�the�sampling�point�was�changed;�and�

�(d)�The�results�for�any�samples�collected�and�analyzed�for�lead�and�copper�or�WQPs�in�

addition�to�those�required�by�this�chapter.��Article�4.�Local�Primacy�Delegation�§64258.�Enforcement.�

(a)�A�local�primacy�agency�shall�take�enforcement�actions�as�necessary�to�assure�that�all�small�water�systems�under�the�jurisdiction�of�the�local�primacy�agency�are�in�compliance�with�Division�104,�Part�1,�Chapters�4�and�5;�Division�104,�Part�12,�Chapters�4�and�5�of�the�Health�and�Safety�Code,�and�California�Code�of�Regulations,�Title�17,�Division�1,�Chapter�5,�Group�4�and�Title�22,�Division�4,�Chapters�14,�15,�15.5,�16,�17,�and�17.5.�

�(b)�A�local�primacy�agency�shall�notify�each�small�water�system�under�their�jurisdiction�of�

any�new�state�or�federal�drinking�water�requirements�applicable�to�those�systems.��Article�18.�Notification�of�Water�Consumers�and�the�State�Board�§64463.7.�Tier�3�Public�Notice.��

(a)�Each�water�system�shall�give�public�notice�pursuant�to�this�section�if�any�of�the�following�occurs:�

(1)�Monitoring�violations;��(2)�Failure�to�comply�with�a�testing�procedure,�except�where�a�Tier�1�public�notice�is�

required�pursuant�to�section�64463.1�or�the�State�Board�determines�that�a�Tier�2�public�notice�is�required�pursuant�to�section�64463.4;�or��

(3)�Operation�under�a�variance�or�exemption.��

(b)�Each�water�system�shall�give�the�public�notice�within�one�year�after�it�learns�of�the�violation�or�begins�operating�under�a�variance�or�exemption.���

(1)�The�water�system�shall�repeat�the�public�notice�annually�for�as�long�as�the�violation,�variance,�exemption,�or�other�occurrence�continues.��

(2)�Posted�public�notices�shall�remain�in�place�for�as�long�as�the�violation,�variance,�exemption,�or�other�occurrence�continues,�but�in�no�case�less�than�seven�days.�

(3)�Instead�of�individual�Tier�3�public�notices,�a�water�system�may�use�an�annual�report�detailing�all�violations�and�occurrences�for�the�previous�twelve�months,�as�long�as�the�water�system�meets�the�frequency�requirements�specified�in�this�subsection.���

�(c)�Each�water�system�shall�deliver�the�notice�in�a�manner�designed�to�reach�persons�served�

within�the�required�time�period,�as�follows:�����(1)�Unless�otherwise�directed�by�the�State�Board�in�writing�based�on�its�assessment�of�

the�violation�or�occurrence�and�the�potential�for�adverse�effects�on�public�health�and�welfare,�community�water�systems�shall�give�public�notice�by�

(A)�Mail�or�direct�delivery�to�each�customer�receiving�a�bill�including�those�that�provide�their�drinking�water�to�others�(e.g.,�schools�or�school�systems,�apartment�building�owners,�or�large�private�employers),�and�other�service�connections�to�which�water�is�delivered�by�the�water�system;�and��

(B)�Use�of�one�or�more�of�the�following�methods�to�reach�persons�not�likely�to�be�reached�by�a�mailing�or�direct�delivery�(renters,�university�students,�nursing�home�patients,�prison�inmates,�etc.):�

1.�Publication�in�a�local�newspaper;�2.�Posting�in�conspicuous�public�places�served�by�the�water�system,�or�on�the�

Internet;�or�3.�Delivery�to�community�organizations.�

(2)�Unless�otherwise�directed�by�the�State�Board�in�writing�based�on�its�assessment�of�the�violation�or�occurrence�and�the�potential�for�adverse�effects�on�public�health�and�welfare,�noncommunity�water�systems�shall�give�the�public�notice�by:�

(A)�Posting�in�conspicuous�locations�throughout�the�area�served�by�the�water�system;�and�

(B)�Using�one�or�more�of�the�following�methods�to�reach�persons�not�likely�to�be�reached�by�a�posting:�

1.�Publication�in�a�local�newspaper�or�newsletter�distributed�to�customers;�2.�E�mail�message�to�employees�or�students;��3.�Posting�on�the�Internet�or�intranet;�or�4.�Direct�delivery�to�each�customer.�

�(d)�Community�and�nontransient�noncommunity�water�systems�may�use�the�Consumer�

Confidence�Report�pursuant�to�sections�64480�through�64483,�to�meet�the�initial�and�repeat�Tier�3�public�notice�requirements�in�subsection�64463.7(b),�as�long�as�the�Report�meets�the�following:�

(1)�Is�given�no�later�than�one�year�after�the�water�system�learns�of�the�violation�or�occurrence;�

(2)�Includes�the�content�specified�in�section�64465;�and�(3)�Is�distributed�pursuant�to�paragraph�(b)(1)�and�(2)�or�subsection�(c).�

�§64465.�Public�Notice�Content�and�Format.�

(a)�Each�public�notice�given�pursuant�to�this�article,�except�Tier�3�public�notices�for�variances�and�exemptions�pursuant�to�subsection�(b),�shall�contain�the�following:�

(1)�A�description�of�the�violation�or�occurrence,�including�the�contaminant(s)�of�concern,�and�(as�applicable)�the�contaminant�level(s);�

(2)�The�date(s)�of�the�violation�or�occurrence;�(3)�Any�potential�adverse�health�effects�from�the�violation�or�occurrence,�including�the�

appropriate�standard�health�effects�language�from�appendices�64465�A�through�G;�(4)�The�population�at�risk,�including�subpopulations�particularly�vulnerable�if�exposed�to�

the�contaminant�in�drinking�water;�(5)�Whether�alternative�water�supplies�should�be�used;�(6)�What�actions�consumers�should�take,�including�when�they�should�seek�medical�help,�

if�known;�(7)�What�the�water�system�is�doing�to�correct�the�violation�or�occurrence;�(8)�When�the�water�system�expects�to�return�to�compliance�or�resolve�the�occurrence;�

(9)�The�name,�business�address,�and�phone�number�of�the�water�system�owner,�operator,�or�designee�of�the�water�system�as�a�source�of�additional�information�concerning�the�public�notice;��

(10)�A�statement�to�encourage�the�public�notice�recipient�to�distribute�the�public�notice�to�other�persons�served,�using�the�following�standard�language:��“Please�share�this�information�with�all�the�other�people�who�drink�this�water,�especially�those�who�may�not�have�received�this�public�notice�directly�(for�example,�people�in�apartments,�nursing�homes,�schools,�and�businesses).��You�can�do�this�by�posting�this�public�notice�in�a�public�place�or�distributing�copies�by�hand�or�mail.”;�and�

(11)�For�a�water�system�with�a�monitoring�and�testing�procedure�violation,�this�language�shall�be�included:��“We�are�required�to�monitor�your�drinking�water�for�specific�contaminants�on�a�regular�basis.��Results�of�regular�monitoring�are�an�indicator�of�whether�or�not�your�drinking�water�meets�health�standards.��During�[compliance�period�dates],�we�[‘did�not�monitor�or�test’�or�‘did�not�complete�all�monitoring�or�testing’]�for�[contaminant(s)],�and�therefore,�cannot�be�sure�of�the�quality�of�your�drinking�water�during�that�time.”�

�(b)�A�Tier�3�public�notice�for�a�water�system�operating�under�a�variance�or�exemption�shall�

(1)�An�explanation�of�the�reasons�for�the�variance�or�exemption;�(2)�The�date�on�which�the�variance�or�exemption�was�issued;�(3)�A�brief�status�report�on�the�steps�the�water�system�is�taking�to�install�treatment,�find�

alternative�sources�of�water,�or�otherwise�comply�with�the�terms�and�schedules�of�the�variance�or�exemption;�and�

(4)�A�notice�of�any�opportunity�for�public�input�in�the�review�of�the�variance�or�exemption.�

�(c)�A�public�water�system�providing�notice�pursuant�to�this�article�shall�comply�with�the�

following�multilingual�related�requirements:�(1)�For�a�Tier�1�public�notice:�

(A)�The�notice�shall�be�provided�in�English,�Spanish,�and�the�language�spoken�by�any�non�English�speaking�group�exceeding�10�percent�of�the�persons�served�by�the�public�water�system,�and�the�notice�shall�include�a�telephone�number�or�address�where�such�individuals�may�contact�the�public�water�system�for�assistance;�and�

(B)�If�any�non�English�speaking�group�exceeds�1,000�persons�served�by�the�public�water�system,�but�does�not�exceed�10�percent�served,�the�notice�shall�include�information�in�the�appropriate�language(s)�regarding�the�importance�of�the�notice,�and�the�telephone�number�or�address�where�such�individuals�may�contact�the�public�water�system�to�obtain�a�translated�copy�of�the�notice�from�the�public�water�system�or�assistance�in�the�appropriate�language;�

(2)�For�a�Tier�2�or�Tier�3�public�notice:�(A)�The�notice�shall�contain�information�in�Spanish�regarding�the�importance�of�the�

notice,�or�contain�a�telephone�number�or�address�where�Spanish�speaking�residents�may�contact�the�public�water�system�to�obtain�a�translated�copy�of�the�notice�or�assistance�in�Spanish;�and�

(B)�When�a�non�English�speaking�group�other�than�Spanish�speaking�exceeds�1,000�residents�or�10�percent�of�the�residents�served�by�the�public�water�system,�the�notice�shall�include:�

1.�Information�in�the�appropriate�language(s)�regarding�the�importance�of�the�notice;�or�

2.�A�telephone�number�or�address�where�such�residents�may�contact�the�public�water�system�to�obtain�a�translated�copy�of�the�notice�or�assistance�in�the�appropriate�language;�and�

(3)�For�a�public�water�system�subject�to�the�Dymally�Alatorre�Bilingual�Services�Act,�Chapter�17.5,�Division�7,�of�the�Government�Code�(commencing�with�section�7290),�meeting�the�requirements�of�this�Article�may�not�ensure�compliance�with�the�Dymally�Alatorre�Bilingual�Services�Act.�

�(d)�Each�public�notice�given�pursuant�to�this�article�shall:�

(1)�Be�displayed�such�that�it�catches�people’s�attention�when�printed�or�posted�and�be�formatted�in�such�a�way�that�the�message�in�the�public�notice�can�be�understood�at�the�eighth�grade�level;�

(2)�Not�contain�technical�language�beyond�an�eighth�grade�level�or�print�smaller�than�12�point;�and�

(3)�Not�contain�language�that�minimizes�or�contradicts�the�information�being�given�in�the�public�notice.��

Instructions for Tier 3 Monitoring Violations Annual Notice Template

Since most monitoring violations are included in Tier 3, you must provide public notice to persons served within one year after you learn of the violation [California Code of Regulations, Title 22, Chapter 15, Section 64463.7(b)]. Multiple monitoring violations can be serious. Each water system required to give public notice must submit the notice to the State Water Resources Control Board, Division of Drinking Water (DDW) for approval prior to distribution or posting, unless otherwise directed by the DDW [64463(b)].

Notification Methods

You must use the methods summarized in the table below to deliver the notice to consumers. If you mail, post, or hand deliver, print your notice on letterhead, if available.

If any non-English-speaking group exceeds 1,000 persons served by the water system, but does not exceed 10 percent served, the notice must (1) include information in the appropriate language(s) regarding the importance of the notice and (2) contain the telephone number or address where such individuals may contact the water system to obtain a translated copy of the notice from the water system or assistance in the appropriate language.

Corrective Actions

In your notice, describe corrective actions you took or are taking. Listed below are some steps commonly taken by water systems with monitoring violations. Choose the appropriate language, or develop your own:

� “We have since taken the required samples, as described in the last column of the table above. The samples showed we are meeting drinking water standards.”

� “We have since taken the required samples, as described in the last column of the table above. The sample for [contaminant] exceeded the limit. [Describe corrective action; use information from public notice prepared for violating the limit.]”

� “We plan to take the required samples soon, as described in the last column of the table above.”

After Issuing the Notice

Send a copy of each type of notice and a certification that you have met all the public notice requirements to the DDW within ten days after you issue the notice [64469(d)]. You should also issue a follow-up notice in addition to meeting any repeat notice requirements the DDW sets.

It is recommended that you notify health professionals in the area of the violation. People may call their doctors with questions about how the violation may affect their health, and the doctors should have the information they need to respond appropriately.

It is a good idea to issue a “problem corrected” notice when the violation is resolved.
