1.0 The COUNTY OF RIVERSIDE, herein called County, invites sealed bids for:

Asphalt Drain crack seal and seal coat work at the closed Coachella, Edom Hill and Mecca I landfills. Each landfill is located within the eastern portion of Riverside County as shown on Exhibit A; each site’s location is depicted on Exhibits B-1 through B-3; and each contains asphalt drainage structures of varying dimensions on landfill benches and slopes as shown on Exhibits C-1 through C-3. Project work shall include: (1) mobilization and demobilization to each landfill site, (2) preparatory cleaning and vegetation removal, (3) crack seal application, and (4) seal coat application.

1.1 Landfill Sites: The Contractor shall furnish all travel, parts, labor, materials, rentals, equipment, disposal,

NOTICE INVITING BIDS

4.0 UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT - The County has adopted the Uniform Public Construction Cost Accounting Act (Public Contract Code Section 22000 et seq.) pursuant to County Ordinance No. 757. The County through its Purchasing Agent may bid and award a contract pursuant to the procedures stated in the Act. The Purchasing Agent’s current maximum authority under the Act is $175,000 for a single contract. All applicable public works requirements still apply.

5.0 PREVAILING WAGES - This is a public works project subject to compliance monitoring and enforcement by the

California Department of Industrial Relations. The awarded bidder shall comply with all applicable provisions of the California State Labor Code regarding prevailing wages, Department of Industrial Relations Division of Apprenticeship Standards Labor and other requirements, including but not limited to Labor Code Sections 1771.4, 1773.1, 1774, 1775 and 1776.

County Purchasing and Fleet Services has obtained the most recent determination of general prevailing rates of per diem wages applicable to the work, and for holiday and overtime work, including employer payments for health and welfare, pension, vacation, and similar purposes; and this will be made available to any bidder upon request. This information can also be obtained at the California State Department of Industrial Relations, 464 West Fourth St., San Bernardino.

The awarded bidder shall post job site notices as prescribed by regulation. Contractor or subcontractor shall furnish records specified in Labor Code Section 1776 to the Labor Commissioner.

Pursuant to Labor Code Section 1771.1, any contractor submitting a bid, or subcontractor listed on the Bid Form, must be currently registered with the Department of Industrial Relations and qualified to perform public work pursuant to Labor Code Section 1725.5. No contractor or subcontractor will be awarded without proof of current D.I.R. registration.

6.0 LIQUIDATED DAMAGES - It is agreed by the parties to the contract that time is of the essence and that the

Contractor shall be responsible to acknowledge and demonstrate diligent and continuous progression of work through project completion. In the event each bid item is not completed within the duration set forth pursuant to this specification, damage will be sustained by the County and that it is and will be impractical and extremely difficult to ascertain and determine the actual damage which the County will sustain in the event of and by reason of such delay. Therefore, it is agreed the successful bidder shall pay to the County, as fixed and liquidated damages, and not as penalty, a dollar sum in the amount of $500.00 per calendar day, for each and every calendar day the delay in making delivery in excess of the time or times specified. It is further agreed that in the event such damages are sustained by the County, the County shall deduct the amount thereof from any moneys due or that may become due the vendor under the contract.

7.0 BID SUBMITTAL - All bids must be submitted on the five (5) page Contractor’s bid forms (pages 6 through 10)

including completed Designation of Subcontractors, Non-Collusion Affidavit, and a Bid Guarantee pages (pages 8 & 10). Bids received without these completed pages and Bid Guarantee bond or check will be rejected as non-responsive. Signed copies of each bid shall be sealed in an envelope labeled with the RFQ number, title of bid, and opening date and time. The bid response shall be delivered (no e-mail delivery) to Department of Waste Resources at the address noted on page 3 on or before 1:30 p.m. on the closing date listed above. The RFQ number, title, and closing date and time shall appear on the bid cover sheet. Under no circumstances will a bid be

accepted after the exact closing date and time. The County is not responsible for late or lost mail, or erroneous errors.

8.0 The awarded bidder must hold the required California license, in good standing with the Contractor State License

Board, at the time of submitting its bid and continuously thereafter until project completion. A subcontractor may possess the required license only if allowed by applicable law. Licensure statements are made under penalty of perjury.

9.0 The awarded bidder will be required to furnish performance and payment bonds and insurance documents in

accordance with the requirements stated in this RFB. Contact with County personnel, other than the Procurement Contract Specialist identified in this RFQ, regarding this procurement may result in disqualification of your bid submittal.

INSTRUCTIONS TO BIDDERS 1. THIS IS A PUBLIC WORKS PROJECT AND SUBJECT TO COMPLIANCE MONTORING (per SB-854)

AND ENFORCEMENT BY THE DEPARTMENT OF INDUSTRIAL RELATIONS. a. The awarded prime Contractor shall post job site notices as prescribed by regulation starting

January 1, 2015. Contractor or subcontractor shall furnish records specified in Labor Code section 1776 to the Labor Commissioner.

b. Registration with the Department of Industrial Relations: Pursuant to Labor Code section 1771.1, any Contractor bidding or subcontractor to be listed on a bid proposal subject to Public Contract Code section 4104, shall not be qualified to bid after March 1, 2015 unless currently registered and qualified to perform public works pursuant to Labor Code section 1725.5. No Contractor or subcontractor may enter into a contract after April 1, 2015, without proof of current registration to perform public works.

2. CONTRACTOR REGISTRATION – Contractor shall register online at www.Purchasing.co.riverside.ca.us with all current (if previously registered, please log-in and update) information, to be registered on the County’s database. This shall include the W-9 and IRS 147C forms as instructed on the web site.

3. PRICES/NOTATIONS - All prices/notations must be typewritten or written in ink. No erasures permitted. Mistakes shall be crossed out, corrections made adjacent and initialed by person signing document. Each item shall be bid separately. Signature must be of authorized representative/agent of bidding company.

4. FORMAT – Complete the Contractor’s bid forms (pages 7 through 17) including completed Designation of Subcontractors, Bid Guarantee, and Non-Collusion Affidavit pages (pages 9 through 11), filled out completely, dated and signed by the bidder or duly authorized representative/agent in accordance with the directions on the bid form. Each bid shall include a complete list of the Sub-Contractors proposed for every portion of the work, in accordance with Public Contract Code, Section 4100-4108, inclusive.

5. PRICING/TERMS/TAX - Prices shall be firm for 60 calendar days after the closing date. All pricing shall be quoted F.O.B. destination, (e.g., cash terms less than 30 days should be considered net) including applicable tax, permits, and licenses. The County pays California Sales Tax and is exempt from Federal excise tax. In the event of an extension error, the unit price shall prevail.

6. COUNTY’S RESERVATION OF RIGHTS - The County reserves the right to reject any or all offers, to waive any discrepancy or technicality or informalities in a bid or in the bidding, and to make the award in any manner determined by the County to be most advantageous to the County. The County recognizes that prices are only one of several criteria to be used in judging an offer and the County is not legally bound to accept the lowest offer.

7. WITHDRAWAL OF SUBMITTAL - A bid may be withdrawn only prior to the closing date and time. Withdrawal of a bid must be made in person by the bidder or someone authorized by him or her in writing. Proof of identification will be required for bid withdrawal. No bidder may withdraw his or her bid for a period of sixty (60) days after the time set for opening thereof.

8. DRAWINGS AND SPECIFICATIONS - All drawings and specifications, herein enclosed, become part of the bid documents. Additional sets may be provided if requested by bidders and deemed necessary and if there is sufficient time, (see Page 1 of “Public Works Notice Inviting Bid” Section 3.0 Timeline, Item 2 Drawings) for details.

9. INTERPRETATION OF THE BID DOCUMENTS - Discrepancies in and omissions from the plans, specifications or other bid documents or questions as to their meaning shall, at once, be brought to the attention of the County. Any interpretation of the documents will be made only by written addenda duly issued and a copy of such addenda will be mailed or delivered to each person or firm receiving a set of such documents. The County will not be responsible for any other explanations or interpretations. Should anything in the scope of the work or any section of the bid documentation specifications be of such nature as to be apt to cause disputes between the various trades involved, such information shall be promptly called to the attention of the County. By the submittal of a bid, the bidder will be held to have (1) personally examined the Edom Hill Landfill; (2) acknowledged opportunity provided by the County to visit the Coachella and Mecca I Landfill; (3) carefully and thoroughly read all documents related to this RFQ; and (4) satisfied himself as to his ability to meet all the difficulties attending to the execution of the work.

10. ADDENDA TO THE DOCUMENTS - The County reserves the right to issue such Addenda to the documents as it may desire at any time prior to the time fixed for receiving bids. A copy of all such addenda will be made available by the County. The number and date of each addendum shall be listed on the Contractor’s bid in the space provided.

11. BIDDER’S CHECK OR BOND - Each bid must be accompanied by a certified or cashier’s check or by a bid bond on the form supplied by the County, drawn in favor of the County in an amount not less than ten percent (10%) of the total bid. This check or bond shall be given as guarantee that the bidder, if awarded the bid, will execute and deliver the Contract documents and the required Payment and Performance Bonds in accordance with his bid accepted by the County. In default of execution of the Contract upon award and/or delivery of said Payment and Performance Bonds, such proposal, bond or check shall be held subject to payment to the County of the difference in money between the amount of the bidder’s bid and the amount for which the County may legally contract with another party to perform the said work, together with the costs to the County of redrafting, redrawing, and publishing documents and papers shall, in addition, be held subject to all other actual damages suffered by the County, as set forth on the Contract documents. Said check or bond will be returned upon the close of the period mentioned in Paragraph VII., above, and to the successful bidder upon execution of the bid documents. No bonds will be accepted unless submitted on the form supplied by the County.

12. AWARD OF CONTRACT - The bid documents shall be awarded upon issuance of a purchase order including the bid documents. The award of the Contract, if it be awarded, will be to the lowest responsible and qualified bidder based upon the total bid of all Bid Sites. The bidder agrees that if he is awarded the contract he will make no claim against the County based on ignorance or misunderstanding of the contract provision; and that the bidder fully understands the payment method for the work.

13. ADDITIONAL INFORMATION - The County reserves the right to require of a bidder, information regarding financial responsibility or such other information as the County determines is necessary to ascertain whether a bid is in fact the lowest responsible and responsive bid submitted, all references to an architect shall be deemed to refer to the County where no architect has been employed by the County.

APPENDIX A Asphalt Drain Crack Seal and Seal Coat

At the closed Coachella, Edom Hill and Mecca I Landfills Each landfill is located within the western portion of Riverside County as shown on Exhibit A; and each contains asphalt drainage structures of varying dimensions on landfill benches and slopes as shown for the above-mentioned sites on Exhibits C-1 through C-3. Project work shall include: (1) mobilization and demobilization to each landfill site, (2) preparatory cleaning and vegetation removal, (3) crack seal application, and (4) seal coat application.

1. SCOPE OF WORK: The Contractor shall furnish all travel, parts, labor, materials, rentals, equipment, disposal, transportation and supervision necessary for (1) mobilization and demobilization to each landfill site, (2) preparatory cleaning and vegetation removal, (3) crack seal application, and (4) seal coat application. All work is to be performed in strict accordance with these specifications and Exhibits A-C by the Riverside County Department of Waste Resources (County), and all items discussed at the mandatory bidders conference.

2. SEQUENCE OF WORK: Contractor shall sequence project work so as to expedite completion of all bid items at the Edom Hill Landfill. Once complete, Contractor shall expedite completion of all bid items at the Coachella Landfill; then Contractor shall expedite completion of all bid items at the Mecca I Landfill.

3. REQUIRED PERMITS/CERTIFICATIONS – Contractor(s) shall obtain any required permits and comply with all applicable Federal, State, and local regulations, including South Coast Air Quality Management District (SCAQMD) requirements for idling and fugitive dust control.

4. CONTRACTOR SCHEDULE – Within five (5) days after notification of award and prior to the start of work, the Contractor(s) shall provide a written construction schedule which shall address project start date and end date; and start/end dates for project work at each landfill site. Contractor schedule shall reflect sequence of work per Appendix A Section 2; and contract working days for Bid Sites. A contract working day is hereby defined as any day (except Saturdays, Sunday and designated County holidays) on which the Contractor is not prevented by inclement weather or resulting conditions from proceeding with at least sixty (60) percent of the normal labor and equipment force engaged in the controlling operation or operations for at least five hours. 5. CONTRACTOR WORK PLAN – Within five (5) days after notification of award and prior to the start of

work, the Contractor(s) shall provide a written work plan which includes a narrative discussion on the type and amount of equipment proposed for (1) preparatory cleaning and vegetation removal, (2) crack seal application, and (3) seal coat application. The work plan shall also address storage of materials and equipment onsite, track out prevention measures, dust control, and project employee names and titles/function(s).

6. CONTRACTOR SAFETY PLAN – Within five (5) days after notification of award, and prior to performing work, the Contractor shall provide a written project-specific safety plan to COUNTY for review and acceptance. Contractor safety plan shall address, but not be limited to, the following: Safety plan shall include project organizational chart and contact information; and shall address emergency and first aid protocol. Contractor shall provide listing for emergency response police/sheriff, fire, and ambulance for each project site as well as name, address and directions to the nearest hospital for each project site. Safety Plan shall include narrative discussion of first aid and fire prevention measures; and shall provide tailgate safety meeting information including scheduled date/time and discussion topics. Safety Plan shall also include safety data sheet information provided on the manufacturer website for seal coat and crack seal products. Contractor(s) shall be solely and completely responsible for work performed and the safety of all persons and property on the job sites during performance of service. Contractor(s) shall conform to all governing safety regulations including those of County. Full cooperation of the Contractor and its forces is required to assure safe working conditions. Therefore, it is necessary to emphasize that County will have full authority to eject any of the Contractor’s employees or subcontractors who do not immediately abide by directions of County. Contractor shall at all times keep each site neat, tidy, and free of waste materials or rubbish resulting from work. Toxic materials, including oil, fuel oil, gasoline, coolant, fluid filters, and other contaminants, shall be transported off site and disposed of at an approved facility. The Contractor shall adhere to the Riverside County Hazardous Materials Business Emergency Plans (BEPs) for each project site. Containers temporarily holding these toxic materials shall be covered, properly labeled and have no leaks, and shall be removed from the site as quickly as is reasonably possible. Upon award of Contract, the COUNTY shall provide Contractor with a digital copy of the BEP for each landfill and up to four (4) hard copies upon request. Any accidental spills or spills that are produced during routine equipment maintenance shall be cleaned up by removing all the contaminants and the contaminated soil, disposing of it at an approved facility, and replacing the removed contaminated soil volume with clean soil material. If an event of a spill occurs, the Contractor and/or its sub-Contractors shall follow the procedures outlined in the Site Safety Plan. The Contractor shall comply with and supplement, if necessary, the Riverside County Hazardous Materials Business Emergency Plans for landfills included in this project. Prior to beginning project work at each site, Contractor shall submit a separate Hazardous Materials Business Emergency Plan for each site to address Contractor activities if work/use includes storage, or potential storage of hazardous materials exceeding the following quantities: 55 gallons of liquids, 500 pounds of solids, or

200 cubic feet of compressed gases. In addition, the Contractor shall comply with the Riverside County Spill Prevention, Control, and Countermeasure (SPCC) Plans for each landfill, including but not limited to the submittal of a Business Emergency Plan and performance of required inspections, if the Contractor’s work requires the onsite storage of petroleum products (as defined in the SPCC Plan) or if the Contractor stores petroleum waste products onsite. Upon award of Contract, the Department shall provide Contractor with a digital copy of the SPCC Plan for each landfill and up to four (4) hard copies upon request. Contractor shall mobilize and maintain one (1) 2,500-gallon water truck or approved equal at each site on which the Contractor is actively engaged in work for crack seal (Bid Item #2), or seal coat (Bid Item #3). This water truck shall have working hose and fixed-sprayer attachments, and shall be maintained with a minimum half-load capacity. Contractor shall also maintain a minimum of five (5) working fire extinguishers at each landfill in which Contractor is engaged in project bid item work.

7. TIME OF COMPLETION –Contractor shall diligently and continuously prosecute all project work to final completion for the Bid Sites (Coachella, Edom Hill and Mecca I landfills) before the expiration of ten (10) contract working days from the project start date established in the Notice to Proceed issued by COUNTY. If necessary, Engineer may grant additional work days due to weather delays but any additional work days must be requested in writing by Contractor. In case all the work called for and all the conditions and requirements of the RFQ are not completed within the number of working days specified herein, liquidated damages of Five Hundred Dollars ($500) per day for each additional working day required to properly complete this project in excess of the allowed number of working days shall be paid by the Contractor to County. County may instead deduct this amount from payments due to the Contractor at the sole discretion of County.

8. MOBILIZATION, DEMOBILIZATION AND PREPARATION OF DRAINS (Bid Item #1):

A. Mobilization & Demobilization – The work covered in this section shall include all preparatory

work and activities including but not limited to those costs necessary for the movement of personnel, equipment, materials, supplies and incidentals to and from each project site. 1. Upon receipt of the Notice to Proceed, the Contractor shall furnish and mobilize all materials,

equipment, supplies, and personnel as necessary for the successful completion of the work. The Contractor shall also operate and maintain temporary works and equipment throughout the duration of construction. All temporary works, such as equipment staging and materials storage areas, shall fully comply with applicable rules and regulations of governing authorities and/or provisions stipulated in this RFQ. a. Contractor shall provide County a forty-eight (48) hour notice prior to mobilizing to each

landfill site.

b. Contractor shall obtain any and all necessary permits and permission to utilize public roads for all project mobilization and demobilization work. Access to each site is available through existing public roads.

c. Contractor shall mobilize and maintain one (1) 2,500-gallon water truck or approved equal at each site on which the Contractor is actively engaged in work for crack seal (Bid Item #2), or seal coat (Bid Item #3). This water truck shall have working hose and fixed-sprayer attachments, and shall be maintained with a minimum half-load capacity. Contractor shall also maintain a minimum of five (5) working fire extinguishers at each site in which Contractor is engaged in project work (Bid Items 1, 2 & 3). Smoking is prohibited at all landfill sites.

d. Contractor shall provide and maintain at least one portable toilet at each project site.

Sanitary facilities shall include twice-per-week servicing, and each unit shall include secondary containment.

e. Aforementioned materials shall be made available for use by employees associated with the construction project, including (but not limited to) the Contractor, the County, regulatory agency staff, and any other agencies involved with the construction project.

f. Contractor shall procure use of water at each project site for dust control or other project-related purposes.

2. Demobilization shall include but not be limited to cleaning installations and removal of temporary

structures as required by County. Throughout all phases of construction, including suspension of work or until final acceptance of the project, Contractor shall keep the work areas clean and free of refuse generated as a result of Contractor operations. Any such refuse shall be removed from the property no later than the end of each work day. The County shall have the right to determine what materials are refuse.

Preparation of Drains – Work for Preparation of Drains shall consist of furnishing all necessary labor, materials, equipment, tools and supervision for preparing existing asphalt structures to receive crack seal application (Bid item #2) and/or seal coat application (Bid item #3). County shall perform initial weed abatement and drain preparation work prior to Contractor mobilization to each landfill site as sequenced in Appendix A #2 on page 18. This County work shall include removal of most or all plant vegetation growing in asphalt drain cracks, and removal of most or all loose vegetation, debris, sediment, and materials from the surface of asphalt drainage structures. Contractor shall remove any and all remaining vegetation, debris, sediment, and loose asphalt materials from the surface of asphalt drainage structures immediately prior to crack seal and/or seal coat work.

B. Measurement and Payment – Payment for all work associated with mobilization, demobilization and preparation of drains shall be based on the lump sum price stated in Bid Item #1 - Mobilization, Demobilization and Preparation of Drains. Payment shall constitute full compensation for all labor, material, equipment and all other items necessary and incidental to complete this item of work. 9. CRACK SEAL (Bid Item #2): A. General - The work covered in this section shall include application of crack seal along all cracks in

asphalt concrete drainage structures that measure one-quarter (1/4) inch or greater in width.

B. Material - Shall be DEERY 200 Hot Applied Sealant or approved equal.

C. Execution 1. Contractor shall apply crack seal along all cracks in asphalt concrete drainage structures that

measure one-quarter (1/4) inch or greater in width. Crack sealant shall cover the full-depth section of each asphalt crack void.

2. Contractor shall heat sealant in a hot-oil jacketed melter capable of constant mechanical agitation and equipped with a calibrated thermometer to monitor sealant temperature. Material shall be heated to and maintained at Recommended Application Temperature during use. Material can be cooled and then reheated, but only if prolonged heating is avoided. Contractor shall ensure prolonged heating at or above Recommended Application Temperature does not occur as this may severely damage product. If overheating damage occurs, Contractor shall immediately drain machine completely and refill with new material.

3. DEERY 200 is pre-reacted and can be applied immediately after heating to Recommended

Application Temperature. With pavement temperature at 40°F (4°C) or higher, Contractor shall place material into clean, dry crack or prepared reservoir by means of a hand-held pour pot, wheeled push bander or wand applicator. Squeegee any excess sealant tight to pavement surface. Pavement may be warmed to 40°F (4°C) or higher with a Hot Air Lance.

C. Measurement and Payment - Payment for all work associated with application of Crack Seal shall be based on the lump sum price stated in Bid Item #2 – Crack Seal. Payment shall constitute full compensation for all labor, material, equipment and all other items necessary and incidental to complete this item of work. No additional compensation shall be given for Crack Seal completed outside the specified limits illustrated in theses RFQ attachments unless otherwise ordered in writing by County.

10. SEAL COAT – Bid Item #3: A. General - The work covered in this section shall include a seal coat application over all asphalt

concrete drainage structure surface areas. The following seal coat area limits for each of the three landfill sites were measured using aerial flight survey or conventional ground survey method. The total drain area for each site has been quantified by measuring true (three-dimensional) perimeter area limits for each drain. Contractor shall note additional seal coat area coverage to account for individual drain configurations is not included in these areas:

B. Materials - Seal Coat for the Edom Hill Landfill site shall be GuardTop latex sealer or accepted equal. Seal Coat for the Coachella and Mecca I Landfill sites shall be Gold Coat Seal HP 310 or accepted equal.

C. Execution:

For the Edom Hill Landfill site using GuardTop:

1. Contractor shall utilize a power blower to ensure asphalt surface is clean and free of all dirt, debris and existing pavement loose graveled particles.

2. Contractor shall not apply Seal Coat when the ambient temperature is below fifty-five (55) degrees. If ambient temperatures exceed one hundred (100) degrees, Contractor shall extra care should be taken in preparing the surface. Contractor shall not apply Seal Coat within forty-eight (48) hours of forecasted rain.

3. Contractor shall spray the asphalt surface with a mist of water in an amount that will leave

the surface damp and free of standing water or puddles. The misting procedure is critical when the ambient temperature is hot and on bright sunny days or when the pavement is excessively aged and porous. In these instances, the pavement will draw the water out of the seal coat at a more rapid rate than recommended unless the surface is pre-watered.

4. Seal Coat shall be mixed with water to obtain a desired consistency for the application area

as determined by the Contractor and County. The GuardTop manufacturer publishes that the maximum dilution for the product is 20% water to 80% GuardTop; and as pavement increases in roughness, the amount of dilution should be decreased. Contractor shall take due care for each application area to ensure product is not over-diluted with water.

5. Seal Coat application rate shall be 30-35 gallons per 1,000 square feet based on two coats

prior to water dilution of the product.

6. First Coat - Prior to applying the first coat, Contractor shall mist the surface with water. Contractor shall then apply Seal Coat using a truck mounted tank, wheeled container, or

can. Contractor shall spread the product in continuous parallel lines by means of spray application, rubber-faced squeegees or by broom. Contractor may complete this process by hand or by machine. Contractor tools shall be misted wet before use to avoid product adhesion. After material has been applied to the surface, Contractor shall spread the application by pulling the material toward the operator in a manner that will eliminate all ridges and air pockets.

7. Second Coat - After the first coat has completely dried, Contractor shall re-mist the surface with water, check to see that the surface is clean and free of all debris, and apply the second coat using the same application process as the first coat.

8. Within the first three days of application or as otherwise determined by County, a seal coat product representative shall visit the first project site to observe and verify proper application procedure. As determined by County, this verification may also include requiring the representative to perform a solids test and provide test results in order to verify the installed product is in accordance with the manufacturer’s specifications.

9. Contractor shall allow Seal Coat to dry a minimum of 24 hours before traffic is permitted; if

air temperature is below 75 degrees drying time may need to be extended.

For the Coachella and Mecca I Landfill sites using Gold Coat Seal HP 310: 1. Contractor shall clean, or sweep to ensure asphalt surface is clean and free of all dirt, debris

and existing pavement loose graveled particles.

2. Contractor shall spread seal coat material via squeegee or machine application. Seal coat material shall be spread evenly and in a uniform direction to eliminate gaps or ridges.

3. Gold Coat #310 may be diluted with quantity not to exceed 20% per volume. Do not over

dilute.

4. Seal Coat shall be mixed with water to obtain a desired consistency for the application area as determined by the Contractor and County. Gold Coat #310 manufacturer publishes that the maximum dilution for the product is 20% water to 80%; Gold Coat #310 and as pavement increases in roughness, the amount of dilution should be decreased. Contractor shall take due care for each application area to ensure product is not over-diluted with water.

5. Contractor shall not apply Gold Coat #310 Seal Coat when the ambient temperature is below Seventy (70) degrees. If ambient temperatures exceed ninety-five (95) degrees, Contractor shall take extra care in preparing the surface by misting pavement surface with fog system prior to application in accordance with manufacturer’s recommendations. Contractor shall not apply Seal Coat if wet or freezing weather is expected within twenty four (24) hours following application. On Hot days pavement should be misted with a fog system prior to application.

6. Seal Coat application rate shall be 15-30 gallons per 1,000 square feet. Depending on texture of pavement.

11. QUALITY ASSURANCE:

A. Contractor shall use an adequate number of skilled workmen who are thoroughly trained and

experienced in the necessary craft and who are completely familiar with the specified requirements and the methods needed for proper performance of all work contained in these specifications.

B. Contractor shall provide new materials consisting of the highest quality and workmanship in every detail.

C. Contractor shall be solely and completely responsible for the condition of the premises on which the work is performed and for safety of all persons and property on the site during performance of the contract. This requirement shall not be limited to normal working hours, but shall apply continuously throughout the project.

12. SCHEDULING:

A. Work to be performed during regular business hours, Monday – Friday 7:00 AM to 3:30 PM. B. The Contractor is advised that certain inconveniences may be encountered. Complete cooperation

between the Contractor and County will be necessary to expedite the work with the least amount of interference or delay.

C. The awarded Contractor is to provide County with daily schedule of activities. D. Upon Notice to Proceed, the project shall be completed within the allotted number of Contract

Working Days unless otherwise specified in writing and accepted by County.

13. SAFETY AND SPECIAL REQUIREMENTS: The successful Contractor will be required to provide the names, driver license numbers of all employees who will be working in this facility to allow the County to conduct a local background check.

14. CLEAN-UP: A. Contractor shall keep the work area shall be kept clean at all times during construction; and shall

protect ground and all adjacent surfaces by use of drip pans, tarps, and other means necessary. Contractor shall clean all liquid spills shall be cleaned immediately to the satisfaction of the County, and all debris shall be removed periodically during the workday so as not to be tracked into other areas or create a hazard to foot traffic. Contractor shall place all unused materials in a neat and orderly manner located in an area designated by County out of the path of others, unless otherwise specified in writing. County can at any time stop the job for any condition that he/ she may deem unsafe.

B. The Contractor shall supply their own trash receptacles and lawfully transport all trash and debris generated by the project off the project site to an appropriate dumpsite.

15. WARRANTIES:

A. All work shall be guaranteed by Contractor for a period of one (1) year from the recordation of the

Notice of Completion against any defects resulting from use of inferior materials, equipment or workmanship.

B. Contractor shall commence warranty work within two (2) weeks of written notice by the County, and shall diligently progress with warrantee work through final completion.

16. INSURANCE: As respects to the insurance section only, the COUNTY herein refers to the County of

Riverside, its Agencies, Districts, Special Districts, and Departments, their respective directors, officers, Board of Supervisors, employees, elected or appointed officials, agents, or representatives as Additional Insureds. Without limiting or diminishing the Contractor’s obligation to indemnify or hold the COUNTY harmless, Contractor shall procure and maintain or cause to be maintained, at its sole cost and expense, the following insurance coverage’s during the term of this Agreement. A. Workers’ Compensation:

If the CONTRACTOR has employees as defined by the State of California, the CONTRACTOR shall maintain statutory Workers' Compensation Insurance (Coverage A) as prescribed by the laws of the State of California. Policy shall include Employers’ Liability (Coverage B) including Occupational Disease with limits not less than $1,000,000 per person per accident. The policy shall be endorsed to waive subrogation in favor of The County of Riverside.

B. Commercial General Liability:

Commercial General Liability insurance coverage, including but not limited to, premises liability, unmodified contractual liability, products and completed operations liability, personal and advertising injury, and cross liability coverage, covering claims which may arise from or out of CONTRACTOR’S performance of its obligations hereunder. Policy shall name the COUNTY as Additional Insured. Policy’s limit of liability shall not be less than $1,000,000 per occurrence

combined single limit. If such insurance contains a general aggregate limit, it shall apply separately to this agreement or be no less than two (2) times the occurrence limit.

C. Vehicle Liability:

If vehicles or mobile equipment are used in the performance of the obligations under this Agreement, then CONTRACTOR shall maintain liability insurance for all owned, non-owned, or hired vehicles so used in an amount not less than $1,000,000 per occurrence combined single limit. If such insurance contains a general aggregate limit, it shall apply separately to this agreement or be no less than two (2) times the occurrence limit. Policy shall name the COUNTY as Additional Insureds.

D. General Insurance Provisions - All lines:

1) Any insurance carrier providing insurance coverage hereunder shall be admitted to the State of California and have an A M BEST rating of not less than A: VIII (A:8) unless such requirements are waived, in writing, by the County Risk Manager. If the County’s Risk Manager waives a requirement for a particular insurer such waiver is only valid for that specific insurer and only for one policy term.

2) The CONTRACTOR must declare its insurance self-insured retention for each coverage required herein. If any such self-insured retention exceeds $500,000 per occurrence each such retention shall have the prior written consent of the County Risk Manager before the commencement of operations under this Agreement. Upon notification of self-insured retention unacceptable to the COUNTY, and at the election of the Country’s Risk Manager, CONTRACTOR’S carriers shall either; 1) reduce or eliminate such self-insured retention as respects this Agreement with the COUNTY, or 2) procure a bond which guarantees payment of losses and related investigations, claims administration, and defense costs and expenses.

3) CONTRACTOR shall cause CONTRACTOR’S insurance carrier(s) to furnish the County of Riverside with either 1) a properly executed original Certificate(s) of Insurance and certified original copies of Endorsements effecting coverage as required herein, and 2) if requested to do so orally or in writing by the County Risk Manager, provide original Certified copies of policies including all Endorsements and all attachments thereto, showing such insurance is in full force and effect. Further, said Certificate(s) and policies of insurance shall contain the covenant of the insurance carrier(s) that thirty (30) days written notice shall be given to the County of Riverside prior to any material modification, cancellation, expiration or reduction in coverage of such insurance. In the event of a material modification, cancellation, expiration, or reduction in coverage, this Agreement shall terminate forthwith, unless the County of Riverside receives, prior to such effective date, another properly executed original Certificate of Insurance and original copies of endorsements or certified original policies, including all endorsements and attachments thereto evidencing coverage’s set forth herein and the insurance required herein is in full force and effect. CONTRACTOR shall not commence operations until the COUNTY has been furnished original Certificate (s) of Insurance and certified original copies of endorsements and if requested, certified original policies of insurance including all endorsements and any and all other attachments as required in this Section. An individual authorized by the insurance carrier to do so on its behalf shall sign the original endorsements for each policy and the Certificate of Insurance.

4) It is understood and agreed to by the parties hereto that the CONTRACTOR’S insurance shall be construed as primary insurance, and the COUNTY'S insurance and/or deductibles and/or self-insured retention’s or self-insured programs shall not be construed as contributory.

5) If, during the term of this Agreement or any extension thereof, there is a material change in the scope of services; or, there is a material change in the equipment to be used in the performance of the scope of work; or, the term of this Agreement, including any extensions thereof, exceeds five (5) years; the COUNTY reserves the right to adjust the types of insurance and the monetary limits of liability required under this Agreement, if in the County Risk Manager's reasonable judgment, the amount or type of insurance carried by the CONTRACTOR has become inadequate.

6) CONTRACTOR shall pass down the insurance obligations contained herein to all tiers of subcontractors working under this Agreement.

7) The insurance requirements contained in this Agreement may be met with a program(s) of self-insurance acceptable to the COUNTY.

8) CONTRACTOR agrees to notify COUNTY of any claim by a third party or any incident or event that may give rise to a claim arising from the performance of this Agreement.
