7. Process for Commission Nominations

Identify Communities Currently Underrepresented in the Commission Commission Member Norma Chavez-Peterson made a motion to adopt the proposed process for Commission Nominations and delineate the following four categories: Latino, Asian Pacific Islander, Youth, and the geographic Districts 1 and 3. Seconded by Commission Member Enrique Morones. Clarification is needed on the geographic distribution - to include residency or include work or is it the intent of the Commission that the Geographic Districts be residents. An amendment was made by Commission Member Gwen Sanders to include Native American as a category. The amendment accepted by original maker of motion (Commission Member Norma Chavez-Peterson) and was accepted by the second of the original motion (Commission Member Enrique Morones). Commission Member Gina Roberts suggested to amend the motion which has categories of Asian Pacific Islander, Youth, and the geographic districts 1 and 3, and Native American. To specify two seats for Latinos, one seat for API, preferably from Districts 1 and 3. Seconded by Commission Member Shane Harris. A substitute motion was made by Commission Member Norma Chavez Peterson to identify the gaps for Latino, API, D1, D3, and D5, and Youth. Seconded by Commission Member Estela De Los Rios. Establish Process for Nominating Individuals Process: Staff would send the Commission Members on Friday September 25, 2020 all applications for appointment received by 5:30 pm Thursday September 24, 2020. Each Commission Member reviews the applications and creates a short list of up to five individuals for commission consideration. Staff can provide a form to assist Commission Members in identifying individuals to address current areas of identified underrepresentation and identifying one individual that is proposed for consideration without being affiliated with any underrepresented community. Each Commission Member will send staff and Claudia G. Silva, their list of no more than five individual by Wednesday September 30, 2020 5:00 pm. Staff will compile Commission Member’s lists noting if names are identified multiple times. Staff will include the compiled list as well as the corresponding applications in the agenda materials for the October 6, 2020 meeting. The Commission will make nominations from the compiled list at the October 6, 2020 meeting. The Commission can nominate a slate for vote or can make motions for each individual nomination. Any individuals who want to apply must do so with the Clerk of the Board. Commission Member Gina Roberts made a motion to accept the proposal by the County of San Diego to evaluate the applicants. of Equity and Racial Justice HRC Staff Member Andrew Strong provided an update. The Consultant plans to attend the next HRC meeting on November 24th.

CLERB Executive Officer

The Board of Supervisors (“Board”), by ordinance, shall establish the

duties of the CLERB and its duties may include:

◦ Receive, review and investigate citizen complaints which charge peace officers or custodial officers employed by the Sheriff’s Department or the

Probation Department with:

excessive force,

discrimination or sexual harassment,

improper discharge of firearms,

illegal search or seizure,

false arrest,

false reporting,

criminal conduct, or

misconduct, defined as

An alleged violation of any general, standing, or special orders or guidelines;

An alleged violation of any state or federal law; or

Any act otherwise evidencing improper or unbecoming conduct.

The Board, by ordinance, shall establish the duties of the CLERB and its

duties may include:

◦ Review and investigate the death of any individual arising out of or in connection with actions of peace officers or custodial officers (with or without a

signed complaint)

◦ Prepare reports…on the results of any investigations conducted by CLERB in respect to the activities of peace officers and custodial officers, including

recommendations relating to…any trends in regard to employees involved in

citizen complaints.

◦ Prepare an annual report…summarizing the activities and recommendations of the CLERB, including the tracking and identification of trends in respect to all

complaints received and investigated during the reporting period.

◦ Review and make recommendations on policies and procedures of the Sheriff and the Probation Officer.

◦ Perform such other duties as the Board, by ordinance, may assign to the CLERB.

On June 23, 2020, the Board approved a series of actions to increase

independence and strengthen oversight of CLERB.

◦ To further its independence and to eliminate any appearance of impropriety, CLERB was re-assigned from the County’s Public Safety Group, the home of

several public safety agencies, to include the Sheriff’s Department and

Probation Department, to the County’s Finance and General Government

Group.

◦ Directed CLERB to revise its board member nomination and selection process to one that is more transparent to the public and incorporates community input

as part of the process.

◦ Directed an evaluation of CLERB’s workload and responsibilities, which resulted in the addition of a newly created Supervising Special Investigator position and

two new Special Investigator positions, doubling its investigative workforce

from three to six.

As the Board may direct CLERB to undertake additional duties by

ordinance, it amended Section 340.9 of the Code of Administrative

Ordinances to reflect additions to CLERB’s oversight role, including the

authority to investigate the following without the need for a citizen

complaint (effective December 17, 2020):

◦ incidents involving the discharge of a firearm by peace officers or custodial officers employed by the County Sheriff’s Department or the Probation

Department;

◦ the use of force by peace officers or custodial officers employed by the County Sheriff’s Department or the Probation Department resulting in great bodily

injury; and

◦ the use of force by peace officers or custodial officers employed by the County Sheriff’s Department or the Probation Department at protests or other events

protected by the First Amendment.

Subpoena power

Complainants and witnesses are interviewed, if

Peace officers are questioned in writing or in face-to-

face interviews, as needed

Applicable Department policies, relevant codes, and

case law are researched

If appropriate, further legal research is conducted by

County counsel or contract attorney

Photographs are taken and diagrams

are created, when needed

Detailed investigative reports are prepared for the

CLERB with Recommended Findings and the Rationale

used to determine the Finding

The case is placed on calendar for the next CLERB

meeting

CLERB members review each Investigative Report

◦ Where potential questions arise, the assigned investigator should be contacted in advance of the meeting date to attempt

to clarify or resolve questions

Established by a preponderance of the evidence, the

following definitions apply:

◦ Preponderance of the evidence: This preponderance is based on the more convincing evidence and its probable truth

or accuracy, and not on the amount of evidence.

◦ Preponderance of the evidence is required in a civil case and is contrasted with "beyond a reasonable doubt," which is the

more severe test of evidence required to convict in a criminal

trial.

Unfounded: The investigation shows that the alleged

act or conduct did not occur

Action Justified: The investigation shows that the

alleged act or conduct did occur but was lawful,

justified and proper.

Not Sustained: The investigation fails to

support the allegation, but the allegation

cannot be shown as false. There is

insufficient evidence to either prove or

disprove the allegation.

Sustained: The investigation supports the allegation

and the act or conduct was not justified (or was not

legal or proper).

Summary Dismissal is appropriate when:

◦ The CLERB does not have jurisdiction over the subject matter of the Complaint;

◦ The CLERB does not have jurisdiction because the Complaint was not timely filed; or

◦ The Complaint is so clearly without merit that no reasonable person could sustain a finding based on the facts.

It is the CLERB’s responsibility to judge every case on

the evidence, rules and law that apply to it alone

Personal experiences or individual beliefs generally

should have no bearing on how any case is decided

Public statements by CLERB members on factors

not in evidence can send the wrong

message to the public that CLERB members

are biased

CLERB has evolved into a very effective model of

civilian oversight and is a positive example for others

around the country.

We all have a stake in and a responsibility to maintain

the high standards that have been established. This

might require more time for some, but the results of

CLERB Staff and CLERB Member labors are well worth

the effort.

Overview The Leon L. Williams San Diego County Human Relations Commission (Commission) is required to

adopt a meeting schedule for each calendar year. Given the work related to creating the mission statement

for the Office of Equity and Racial Justice, and projected items at the beginning of 2021, staff suggests

two meetings in January, February and March, and one meeting a month thereafter. The dates listed

below do include Thursdays for the first three months so that a second meeting could be held that does

not conflict with the Board of Supervisors meeting calendar. We suggest the following dates, from 10:00

Dear Mayor Faulconer and Mayor-Elect Gloria,

The City of San Diego Human Relations Commission (HRC) is deeply disturbed by the reports of the hundreds of migrant children that continue to remain separated from their parents following the deportation and/or separation of their families after crossing the United States-Mexico Border as a result of the 2018 “zero tolerance” policy and the prior pilot program. The most current reports indicate that 666 children remain separated because the government is unable to locate their parents. As advocates to the Mayor and representatives of San Diego, a border city, and one of the busiest and largest land border crossings in the world, we request prompt and effective reunification of the children with their families and to cease any further attempts to separate immigrant families.

The mission of the City of San Diego HRC is to conduct and promote activities that foster mutual respect and understanding, to protect basic human and civil rights, and to create an atmosphere that promotes amicable relations among all members of the San Diego community. The HRC appreciates and recognizes the efforts being made to reunify these children with their families as quickly as possible, especially U.S. District Judge Dana Sabraw’s judicial efforts in the reunification process wherein on October 22, 2020 at the San Diego hearing, he requested the Justice Department explore ways in which the administration can make it easier to locate the parents of the separated children.

The HRC requests that the City of San Diego do everything in its power to swiftly reconnect these separated migrant families, support the requests to provide these families with any needed assistance and end the process of migrant family separation. This includes employing all the resources at our City’s disposal to assist with the search and reunification efforts, including perhaps, enlisting the services of the San Diego Police Department. The HRC also supports the request made by the American Civil Liberties Union (ACLU) to provide funding for the search efforts, which the HRC believes is vital. The HRC also supports Rep. Joaquin Castro’s call for a special Human Rights Commission formed to investigate the harm done through the mass separation of families, and to provide funding for the services these children and families might need once they have been reunited, which the HRC also believes is critically important.

As San Diego’s Strategic Plan on Immigrant and Refugee Integration notes, San Diego is a “welcoming community” that embraces immigrants. The HRC is strongly committed to this principle, to the prompt and effective reunification of the migrant children with their families, and to any necessary action to remedy the situation. If there is anything the HRC can do to support these efforts, or to assist you in your endeavors toward these goals, please call on us.
