Courting trouble India must ready for a future where more literacy will mean more litigation

If the logjam in Indian courts is terrible today, it’s only going to get worse tomorrow – unless major course correction is undertaken with urgency. Chief Justice of India T S Thakur pointed out this Sunday that per capita litigation is dependent on literacy and prosperity. As the country succeeds in increasing literacy and prosperity, the courts’ caseloads will rise. To the extent that infrastructure deficiencies are to blame, there’s consensus that more courts and more judges are key to solving the problem of delay in the Indian judicial system. But the manner in which courts work and judges are appointed is also crying for reform.

Last October the apex court struck down the National Judicial Appointments Commission, envisaged by Parliament as a broader panel to choose judges, and upheld the exclusive authority of the collegium of judges to select higher judiciary candidates. At the same time, all five ruling judges found faults with the collegium. And now a member of the collegium itself has called for changing its opaque ways – Justice J Chelameswar has reminded all that judicial accountability is the best guarantee of judicial independence.

Many other doable reforms can help eliminate the pendency problem. For example, in the UK and Singapore the specification of time limits has minimised judicial delays. Indian courts need to likewise get out of the “tareekh pe tareekh” trap of endless adjournments. Another sensible measure is to discourage frivolous cases alongside the appeals clogging up our higher courts. To illustrate, while the US Supreme Court admits around 1% of all cases filed before it for hearing, a recent study found that its Indian counterpart admits 41%. Does the highest constitutional court of India really need to opine on wife swap among naval officers and culling of dogs in Kerala?

But the most urgent task is to resolve the Memorandum of Procedure for appointment and transfer of judges, where an eyeball to eyeball confrontation between government and the collegium has worsened the legal logjam. High court vacancies are now north of 40%. If government’s suggestions have been unacceptable, the collegium should itself propose reforms as even the bench that rejected NJAC noted reforms are needed. A great signal of increasing transparency would be making future positions on the MoP public. Judicial reform is now as vital as economic reform to secure India’s future.

Biryani patrol The beef issue hits the streets again, touching off spectres of vigilantism. Its timing suggests premeditated harassment

Governments of two states that have legislated against the consumption of beef are once again calling attention to the issue on the eve of Eid-ul-Zuha or Bakrid. The Haryana Gau Sewa Aayog has asked the state police to collect samples of biryani from Mewat and send them for testing. And following the rather belated but strong warning of the prime minister against vigilantism on behalf of cattle, Maharashtra has made it clear that private raiding parties will not be tolerated. Only the police are empowered to investigate charges of cows being butchered or transported. Haryana has specifically targeted biryani, a dish traditionally connected with the Muslim festival; while the Maharashtra order specifies that only goats can be legally transported and butchered, it draws attention to food habits associated with the festival. These moves may well be valid in law, but they unfortunately suggest that the state is bent on taking the joy out of the festival of one community. The threat of cow patrols invading private spaces to poke about in pots and pans does not set the mood for festivities.

Maharashtra has a brief history of raucous vigilantism, following the passage of a law criminalising the production, possession and consumption of beef. Thereafter, the high court exempted the consumption of beef brought in from outside the state from the ambit of the law, which prescribes a jail term of five years. In June this year, it set about recruiting a cadre of honorary animal welfare officers to act as its eyes and ears in its efforts to protect gau mata. When the police are already charged with the duty to move against those who break the beef laws, why was a cadre of snitches raised from the public deemed necessary? While Maharashtra appears to be proscribing public action now by warning against vigilantism, its record on illiberalism invites the suspicion that it is actually no different in attitude and intent from Haryana, which is pro-actively sending out biryani patrols to probe and pry.

If laws relating to beef must exist at all — and it is not blindingly obvious to the entire population that they must — then the police alone must have the mandate to enforce them, and certainly not as a blunt instrument against a particular community. This time, the festival of Eid has drawn the unhealthy attentions of two state governments to this trumped-up issue. Of course, other communities, including the historically disadvantaged and those located outside the geography of the mainstream, have traditionally used beef as a major source of protein. They have reason to wonder what the future holds for them.

One nation, one election?

Why would someone, particularly an enormously successful politician, want deliberately not to play up to his strength, was the question that struck me as I heard Narendra Modi forcefully making a case for simultaneous elections to Lok Sabha and state Assemblies in a recent interview. Electioneering has been one of the two major preoccupations in his tenure so far, the other being foreign visits. And, despite the reverses in Delhi and Bihar last year, no one comes within a mile of him as a campaigner.

Mr Modi’s ostensible logic that this idea would save costs and pave the way for uninterrupted governance remains just that, ostensible. The fact that the Prime Minister was following an idea first mooted by Lal Krishna Advani added to the intrigue, because that old warhorse is not exactly Mr Modi’s go- to person on any issue.

Then the penny dropped. One must ask the classic Latin question, cui bono ( who benefits)? Notwithstanding the handed down wisdom that the great Indian electorate votes differently in state and national polls, the ground reality is that whenever the general election coincides with that for some state Assemblies, the trends converge. In 2014, the Biju Janata Dal won Odisha by a landslide and cornered the lion’s share of the Lok Sabha seats from the state. The Telugu Desam Party in Andhra Pradesh and the Telangana Rashtra Samithi in Telangana enjoyed the same good fortune. The big loser in the three states was the poor old Indian National Congress, which also lost miserably across the nation. Similar patterns can be discerned in earlier elections as well. The dissolution of state Assemblies following the thumping victories of the Janata Party in 1977 and the Congress in 1980 resulted in spectacular wins for them in the states as well. The Bharatiya Janata Party ( BJP) won Haryana, Maharashtra and Jharkhand following the 2014 general election. All this further validates the convergence hypothesis.

Had all state Assemblies gone to polls in 2014, surely the BJP would have won handsomely in the states where it prevailed in the national elections. It would have avoided the ignominy of Delhi and Bihar in 2015.

It would have also had in its kitty Karnataka, Uttarakhand and Himachal Pradesh, and the biggest bonanza of all, Uttar Pradesh. The Congress cup of woes would have run over with a rump presence solely in the Northeast. The poll- savvy BJP top leadership – read Mr Modi and Amit Shah – could have hardly failed to realise this.

If such electoral behaviour holds in future elections, and there is no reason to believe it will not, only one party will benefit, no prizes for guessing which. With the Congress in decline, possibly terminal, the opposition space is scattered among regional satrapies and the Left, which is now confined to at most three states. Only the BJP has claims to power in most ( but not all) of the country. Any national wave, or even a ripple, could only be in its favour and it stands to gain states if it wins the Lok Sabha. Simultaneous elections would leave the BJP in a heads- I- win- tailsyoulose situation.

But the idea would entail major legislative headaches for the government before it could ever become a reality. The Representation of People Act (1951) would have to be amended to stipulate simultaneous and fixed terms for the national and state legislatures.

Situations of hung houses and loss of confidence would need to be resolved. The remedies could be relatively simple. If no party or coalition is able to cobble together a majority to be proven by a vote of confidence within say, a month of the constitution of the house, the body could be directed to elect a leader who enjoys majority support in another month’s time. No absences or abstentions would be allowed in this vote. If no candidate gets a majority, a recourse to either a run- off between the top two candidates, or use of second preferences, as is done in case of legislative council or Rajya Sabha elections would be possible.

A vote of no confidence to be effective must be accompanied simultaneously by a constructive vote of confidence for another leader, as is required in Germany.

A government, thus, cannot be toppled without installing another one since the legislative body cannot be dissolved before its term.

That would in turn mean rendering nearly toothless that most beloved ( of all ruling dispensations) Article 356 of the Constitution, which empowers the President to dismiss state governments, and suspend or dissolve state Assemblies. It might have to be amended, as also possibly Article 327 that governs legislative elections. That could well be too steep a mountain to scale, as the all- too recent parliamentary logjams show.

And what of us common folk? I had written earlier in these pages, “ Indians are election junkies, and that includes all of us — political parties, aspirants for seats, pollsters, pundits parsing straws in the wind, polls, results, anything really, and average citizenry who find the ballot dramas played out on their screens and in their papers as endlessly intriguing as family sagas” (“ The great Indian addiction,” January 18, 2015). Whatever shall we do while we wait for our quinquennial fix?

Handicaps in agri- research and education

Among them are inadequate funding, understaffing, gender issues, illogical curricula and inbreeding

What ails agricultural research and education system in India? This question is pertinent given that India prides itself in having one of the world’s largest and most extensive farm research and education networks functioning under the broad umbrella of the Indian Council of Agricultural Research (ICAR). It is manned by some of the most qualified and dedicated scientists. Yet, the overall out- turn of this network does not measure up to its potential. Many, if not most, of the game- changing innovations come from other, relatively smaller, research set- ups run by national or international bodies. This can be attributed largely to handicaps which this system has to cope with. These include, among others, inadequate funding, understaffing, gender issues, illogical educational curricula and rampant academic inbreeding with the institutions’ own pass- outs being absorbed in their faculties.

These constraints are evident from the latest data released by the agricultural science and technology indicators programme (ASTI) of the International Food Policy Research Institute ( IFPRI). It reveals that the overall spending on agriculture research and education is rather meagre, falling far short of actual needs. Against the target of investing one per cent of the agricultural sector’s gross domestic product (agri- GDP) on farm research and education, the actual spending is barely onethird of it — 0.3 per cent of agri- GDP. This compares unfavourably with China’s investment of 0.6 per cent of its agri- GDP in farm research. Worse still, the allocation has shrunk steadily from 0.34 per cent in 2000 to 0.32 per cent in 2009 and just 0.3 per cent in 2014. More disquietingly, bulk of the available funds ( 73 per cent) goes towards salaries alone, leaving little for actual research and teaching work.

Moreover, the overall strength of the scientific cadre, which is already inadequate for the size of the system, is gradually declining, instead of growing. The total count of full- time researchers dipped from 13,106 in 2000 to 12,746 in 2014, a drop of some eight per cent. Over 22 per cent of the sanctioned posts in the ICAR set- up and more than 38 per cent in the state agricultural universities are vacant.

As a consequence, the number of agricultural scientists per 100,000 farmers has ebbed from 5.52 in 2000 to 4.62 in 2014. The situation is rather disturbing in states like Jharkhand and Bihar which rely the most on agricultural development to alleviate poverty and improve the living standard of their people. They have only 1.6 and 1.7 scientists, respectively, per one lakh farmers. This is in sharp contrast to 18.4 scientists in Haryana and 15.5 in Punjab. Notably, some of the hilly states are also relatively better placed in this respect.

Uttarakhand and Jammu and Kashmir, for instance, have 24.7 and 19.7 scientists, respectively, per one lakh farmers.

The ASTI numbers bring out a clear gender discrepancy in the scientific cadres.

Only 18 per cent agricultural researchers are females; very few being in the research managerial positions. Such a situation is untenable considering that about a third of the country’s crop farmers, close to half of farm labourers, and about half of the postgraduate students in farm varsities are women. Improving gender balance among researchers and research managers will enable the country to more effectively address the priorities and challenges of all farmers, particularly female agriculturists, maintains the ASTI report.

A grave problem plaguing the agricultural universities is the undesirable practice of academic inbreeding.

About 80 per cent of the faculty of most universities comprise those who had taken their graduation and postgraduation degrees from the same universities.

This forecloses the possibilities of inflow of fresh ideas from other universities and institutions.

The course curricula of agricultural universities, too, are, by and large, misdirected.

Though about half of the employment opportunities for agricultural graduates are generated in the private sector, the curricula of most universities are targeted predominantly to meet the needs of the public sector. These issues need to be addressed suitably to make the Indian agricultural research and education more relevant to modern farming and let the system perform to its potential.

An office of loss After the categorical verdict of the Delhi High Court last month that the Capital is a Union Territory, it was quite clear that any decision made by Chief Minister Arvind Kejriwal without the Lieutenant Governor’s approval will be rendered illegal. Counsel for the Delhi government had to concede the point in court, leading to the appointment of 21 Delhi legislators as parliamentary secretaries being set aside. The appointments, made in March 2015, suffered from multiple legal infirmities. Apart from the lack of the LG’s concurrence, it raised the question of whether it was an ‘office of profit’ under the government, something legislators are barred from holding. The penalty stipulated in the Constitution for a legislator holding an office of profit is disqualification. The Election Commission has reserved its verdict on the question whether these 21 MLAs have incurred such disqualification, and it is possible for the Aam Aadmi Party now to ask the matter to be closed, citing the court’s setting aside of the appointments. At the same time, it cannot be denied that the EC could still choose to decide whether these MLAs had indeed held an office of profit for nearly a year-and-a-half. They had been rendered further vulnerable after the President withheld assent to a Delhi Bill to protect them from incurring disqualification — once again because it was introduced without the LG’s approval.

Mr. Kejriwal could have avoided this setback had he not given executive oversight responsibilities to so many of his party’s legislators. In practice, parliamentary secretaries are junior ministers. In this case, their appointment could also have been challenged on the ground that after their inclusion, the strength of the Council of Ministers had exceeded the constitutional limit of 10 per cent on the strength of the Delhi Assembly. In the case of other States, the limit is 15 per cent. In some States, parliamentary secretaries have been able to stave off disqualification by getting the post saved from disqualification by legislation. However, no one has been able to get around the numerical cap on the size of the Ministry under Article 164(1A) of the Constitution. All told, Mr. Kejriwal got himself into a legal quagmire by seeking to take on the LG in the belief he had the same leeway as other CMs did. He will continue to maintain that the post of parliamentary secretary, inasmuch as it entails no salary or perquisites, is not an office of profit. Yet, it cannot be denied that the issue has caused him loss — of face, of credibility and some of the moral righteousness that propelled him to power.

Chronicles in unlearning

A culture of obedience has dented the intellectual agendas of premier universities and institutions

When organisations of the Sangh Parivar periodically rail against “Macaulay’s children” and propose a review of the hold of western knowledge systems over Indian education, it should be widely

welcomed. After all, indigenous knowledge, as preliterate communities in India, for instance, have begun to point out, and as those who know our rich literary traditions have shown, have been monstrously ignored in the education system we have inherited. Why then does this announcement produce disquiet?

This is because the overall context of such pronouncements is one that is markedly anti-intellectual. Before this is decried as a baseless charge, let me provide some examples. Earlier this year, several “academics” denounced the overall editorship of the Murty Classical Library series under Professor Sheldon Pollock because he was not sufficiently “imbued with a sense of respect and empathy for the greatness of Indian civilisation.” Neither Prof. Pollock’s formidable knowledge of Sanskrit and other Indian languages nor his acknowledged stature as an academic could pass the litmus test of a worshipful loyalty to “Indian civilisation” as the foundational ground of all pursuits of knowledge. Were the signatories of the petition alarmed that Buddhist women poets have been allowed to be heard in that series? That Sufi singers have found new audiences? That Akbar’s life and times are being read by more than medieval historians?

A ‘cultural revolution’

Of late, many distinguished intellectuals have been replaced by dubious dabblers as chiefs in premier institutions of higher education and research across the country.

It would be a lazy error to read this as a mere change of guard, of places once ruled by some version of the luxuriantly varied Indian Left falling under the rule of the monotonous Right. No doubt, English-speaking intellectuals owing allegiance to one or another stripe of the Left/Congress enjoyed disproportionate power for decades, particularly in Delhi institutions, but normally no one doubted their intellectual abilities. The same cannot be said of the new appointees, who are taking major Indian institutions in directions that are not necessarily dedicated to the production and promotion of knowledge.

The home-grown “cultural revolution” that is under way is increasingly encouraging only obedience. The distinction between former leaders and the new heads lies not only in formal academic credentials; they must be placed within the larger framework of “national intellectual warming” that too loudly expresses doubt and distrust about intellectual life as we know it.

A senior Minister has openly called for an isolation of those he identifies as “intellectual terrorists”, internal enemies of the state who may critique the actions of governments and their armies. A good sign of the new hostility was the breathtaking declaration, in a pamphlet issued by the Jawaharlal Nehru University’s Akhil Bharatiya Vidyarthi Parishad unit to welcome new students, that departments of social sciences and humanities, whether in the Indian Institutes of Technology or in other universities, are the source of all agitators and should therefore be closely surveilled.

Now, for the first time in the last two centuries, we are witnessing a virulent form of anti-intellectualism which will leave a lasting impact on the future of a wide range of activities from filmmaking and art to other forms of knowledge-production. The visions that have been spelled out for programmes of research and for educational institutions put a low premium on open-ended, rigorous, creative intellectual activity of any kind.

Some recent examples will suffice, but they can be multiplied. The newsletters of the Indian Council of Historical Research are generously peppered with photographs of the current Chairperson and his pious homilies on a wide range of subjects. Here is a sampling of what appears more like a moralising discourse in a temple courtyard: “Our ancient literature vouchsafes that Indian social institutions enjoy solid cultural base reinforced by Dharma unlike modern intellectual propositions. As argued today, social institutions like marriage, family, community, tribe, society and state should not be understood as contractual… the Vedic marriage system is qualitatively different from the marriages of other religious belief systems or modern social marriages or live-in relationships where both enter into a conditional agreement unless they bind themselves for life.”

Generally, what does the Chairman see as the purpose of historical knowledge? “To shape the character of the people and in turn the nation.” Here we have a rather frank admission of what higher educational and research must be made to foster: nationalism of the kind dictated by the ruling party. No wonder, as Prof. Kumkum Roy has shown in her analysis of Rajasthan textbooks, Gandhi doesn’t get killed at all; he merely disappears from the book.

Obedience was on full display in some universities during the celebration of India’s Independence. Enjoined by the Ministry of Human Resource Development to record their “compliance”, the heads of premier educational institutions showed zeal at rangoli as well as national song renditions, as if to atone for the possibility of the university otherwise living up to its duty of encouraging critical thinking.

In other more predictable quarters, the attack on intellectuals has been reduced to unadorned abuse, as in the Organiser’s recent “review” of the book co-authored by Professor Romila Thapar on nationalism. When the “review” denounces the book’s “stinky logic of provincialising the otherwise wide-ranging cultural nationalism or Hindutva”, we realise that even intelligibility has become a dispensable virtue in such excoriating attacks.

Some robust memories

This is very bleak scenario. Still, we are left with some robust memories of how institutions could think under inspired leaders. In the 1990s, early years yet of the National Law School University in Bengaluru, Professor Madhava Menon invited human rights lawyer Nandita Haksar and feminist legal scholars Flavia Agnes and Ratna Kapoor to teach and conduct research. He recognised, in short, the intellectual importance of engaging with those whose views he may have cordially disliked, even opposed.

A more recent instance was that of the former Vice Chancellor of JNU, Prof. Sudhir Sopory, a celebrated biologist who respectfully followed not just the rules, but the norms that govern the university. He showed the greatest respect for disciplines, methods, and perspectives he knew not much about. In a farewell that endeared him to the teaching community, he declared his desire to return as a student of the School of Arts and Aesthetics at JNU, a relatively new and flourishing department. No greater compliment could be paid to the intellectual culture of the institution.

The current insistence on obedience, and the impoverished ideas of nationalism which university spaces are beginning to propagate, have already dented the intellectual agendas of such spaces. By turning universities and institutions of learning into places of unquestioning worship, we run the risk of being brought to our knees, in more ways than one.

दिुनया म ऐसे इलाके लगातार कम होते जा रहे ह, जो मानव की सिक्रय दखल से पूरी तरह मुक्त ह । करंट बॉयोलॉजी नाम की शोध पित्रका म प्रकािशत एक ताजा अ ययन के अनुसार अगर यही हाल रहा, तो सन 2100 तक दिुनया से जंगल का पूरी तरह से सफाया हो जाएगा। तब न अमेजन के जंगाल का रह य बच पाएगा, न अफ्रीका के जंगल का रोमांच रहेगा और न िहमालय के जंगल की मिृद्ध ही बच पाएगी। ग्लोबल वािमर्ंग की ओर बढ़ती दिुनया म हम िजन जंगल से कुछ उ मीद बांध सकत ेह, वे तो पूरी तरह ख म हो जाएंगे। िफलहाल दिुनया म महज 301 लाख वगर् िकलोमीटर जंगल ही बच गया है, जो पूरी दिुनया की धरती का 23 फीसदी िह सा है।

जंगल के ख म होने का अथर् है, धरती की ऐसी बहुत बड़ी जैव संपदा का न ट हो जाना, िजसकी भरपायी शायद िफर कभी न हो सके। अभी तक न ट होते जंगल और भिव य की उनकी र तार को देखते हुए दिुनया भर के वैज्ञािनक इस नतीजे पर पहंुचे ह िक यह धरती अपने जीवन म छठी बार बड़ ेपैमाने पर जैव संपदा के न ट होने के कगार पर पहंुच चुकी है। फकर् िसफर् इतना है िक इसके पहले जब भी मौसम या युग बदलने के साथ ऐसा हुआ, हमेशा ही उसके कारण प्राकृितक थे, लेिकन इस बार यह मानव िनिमर्त है। पहले प्रकृित की कुछ जैव संपदा न ट होती थी, तो उसके थान पर नई ि थितय के िहसाब से नई िवकिसत हो जाती थी। इस बार ऐसे नए िवकास की संभावना कम ही िदखाई दे रही है।

हालांिक इस मामले म िसफर् िनराशा ही िनराशा हो, ऐसा नहीं है। िपछले कुछ साल से पयार्वरण को लेकर िजस तरह की चेतना पूरी दिुनया म फैली है, उसके चलत ेलोग को जंगल की ज रत और अहिमयत समझ म आने लगी है। यह ज र है िक इसके बावजूद बढ़ती आबादी की ज रत पूरी करने के ऐसे िवक प हम अभी तक नहीं खोज पाए ह, िजनम जंगल को काटने की ज रत न पड़।े एक सोच यह भी है िक जब तक हम जंगल काटने पर पूरी तरह से रोक नहीं लगाते, तब तक िवक प खोजने का दबाव हम पर नहीं बनेगा और हम तमाम चेतना के बावजूद जंगल का सफाया लगातार करत ेरहगे।

कही ंपर यह सरकार की मजबूरी के कारण होगा, तो कही ंउ योग जगत के मुनाफे के िलए। इस बीच दिुनया म कुछ ऐसे प्रयोग भी हो रहे ह, जो भिव य म जंगल के िव तार की उ मीद भी बंधात ेह। जैसे एक प्रयोग है विटर्कल फािमर्ंग यानी बहुमंिजला खेती का। ऐसे ढांचे बनाने की कोिशश हो रही है, िजसम थोड़ी सी जमीन पर कई मंिजल बनाकर हर मंिजल पर खेती की जाए, तािक बाकी बची हुई जमीन पर िफर से जंगल लगाए जा सक। लेिकन िफलहाल यह दरू की कौड़ी लगता है और िफर घाटे का सौदा तो है ही। अगर धरती को बचाना है, तो ऐसे बहुत सारे बड़ ेकाम करने ही ह गे।

अब भी मुख्यधारा से दरू ह दिलत छुआछूत का पारंपिरक दोष आज भी हमारे समाज म कायम है। अब भी इसकी जडे़ ंगहरी ह। अलग-अलग ेिणय व पायदान के बहाने समाज के लाख लोग को उन काम म रमने को मजबूर िकया गया, िज ह आमतौर पर कलकं माना जाता है। उनका सामािजक बिह कार िकया गया। आजादी के बाद भारत छुआछूत को ख म करने को आगे बढ़ा था। सांिवधािनक प्रावधान के तहत 1950 म अनसुूिचत जाितय की सूची तैयार की गई, तािक उन लोग तक िवकास व सरकारी नीितय की रोशनी पहंुचाई जा सके। सुधारवादी काम िकए गए, कद्र व रा य िवधानमंडल , िसिवल सेवा और शैक्षिणक सं थान म उ ह आरक्षण िदया गया।

मगर, सच यही है िक दिलत आज भी दसूरे तमाम समुदाय की तुलना म यादा गरीब ह। आज भी 36 फीसदी ग्रामीण दिलत गरीबी रेखा से नीचे ह। असंगिठत म म भी उनकी भागीदारी काफी यादा है। 41 फीसदी दिलत पु ष और करीब 20 फीसदी दिलत मिहलाएं असगंिठत कामगार ह, जबिक गैर-अनसुूिचत जाित/ जनजाित पु ष म यह आंकड़ा 19 फीसदी व मिहलाओं म महज आठ फीसदी है। बमुि कल 13 फीसदी दिलत पु ष ही ऐसे रोजगार म ह, जहां से उ ह िनयिमत तनख्वाह िमलती है।

ऐसे म, हमारी सरकार को दिलत सशक्तीकरण को बढ़ावा देना चािहए, और इसके िलए सामािजक यवहार और सं थाओं को मजबूत करने की िदशा म आगे बढ़ना चािहए। ज रत िशक्षा पर भी यान देने की है। 11वी ंपंचवषीर्य योजना के अनुसार, दिलत ब च म ड्रॉप-आउट (पढ़ाई बीच म

छोड़ देना) काफी यादा है। आंकडे ़बताते ह िक 74 फीसदी दिलत लड़के और 71 फीसदी दिलत लड़िकया ंप्राथिमक व म य िव यालय की पढ़ाई बीच म ही छोड़ देते ह। साल 1931 म प्राथिमक कूल म दिलत ब च के दािखले की दर िसफर् चार फीसदी थी। दिलत ब च की प्रितभा को आज भी हतो सािहत िकया जा रहा है। म य उ तर प्रदेश के एक सुदरू गांव म हुआ एक िदलच प प्रयोग बताता है िक िजन दिलत छात्र ने पहेिलय को सुलझाने म पहले बेहतर प्रदशर्न िकया था, वे तब बुरी तरह िवफल रहे, जब उनकी जाित का पहले खुलासा कर िदया गया।

गरीब और दिलत के प्रित भेदभाव दरू हो, इसके िलए वंिचत घर के ब च को बेशक मु त म िकताब या िव विव यालय म मु त हो टल की सुिवधा दी जा रही है, मगर इन प्रयास से गरीबी और भेदभाव के ख म होने म लबंा वक्त लग सकता है। ज रत है ऐसे छात्र को बुिनयादी सुिवधाएं, मसलन िब तर, टेबल-कुरसी आिद िदए जाएं। इससे िशक्षा अिधक समावेशी होगी। इसके अलावा, कूल म ब च को कीडे ़मारने की दवा मु त िखलानी चािहए, तािक उनकी सेहत दु त रहे। इससे कक्षा से उनके अनुपि थत रहने की दर कम होगी और दिलत ब च के नामाकंन की दर बढ़ेगी।

दिलत उ यिमता भी एक बड़ा मु ा है। आज भी दिलत उ योगपित काफी कम ह, क्य िक यादातर दिलत पारंपिरक पेश म ही लगे हुए ह। वैसे, इन उ यिमय को भी भेदभाव रिहत सामािजक प्रित ठा हािसल नहीं है। देश का मानव िवकास सव कहता है िक महज 12 फीसदी दिलत पिरवार की पहंुच मुख्यधारा से जुड़ ेदो-तीन उ यम तक है, जबिक उ च वग म यह आंकड़ा 26 फीसदी है। भेदभाव, भूिमहीन होने का इितहास, सामािजक दबाव और नग य भागीदारी जैसी चीज दिलत उ यिमता की राह की बाधाएं ह।

इस ि थित म गांव और रा य के तर पर सुधार की दरकार है। हम महारा ट्र से सीखना चािहए। वहां अनुसूिचत जाित-जनजाित के कारोबािरय के िलए महारा ट्र औ योिगक िवकास िनगम के अधीन क्षेत्र म 10 फीसदी जमीन आरिक्षत कर दी गई है। यानी पंूजी की सम या तभी दरू हो सकती है, जब दिलत उ यिमता को यान म रखते हुए अिधक से अिधक ‘सोशल इंपैक्ट फंड’ के रा त ेखोले जाएं। हम उ यिमता कद्र के िव तार के बारे म भी सोचना चािहए, िजसम पंूजी को बढ़ावा देने और इंफ्रा ट्रक्चर पर खासा जोर हो। एक समाधान पारंपिरक िश प उ योग से जुड़ी सहकारी सिमितय और सं थाओं का िवकास भी हो सकता है। उमूर्ल म थली बुनकर िवकास सिमित इसका उ लेखनीय उदाहरण है। इससे मेघवाल समुदाय के 120 दिलत बुनकर पिरवार जुड़ ेह। आज इन दिलत का न िसफर् रहन-सहन बेहतर है, बि क यहां से अब पलायन भी क चुकी है। इतना ही नहीं, थानीय रोजगार के तमाम अवसर मानो पुनजीर्िवत हो गए ह।

दिलत को आिथर्क मदद की दरकार है। सच यही है िक कारोबारी क्षेत्र म दिलत की उपि थित बढ़ नहीं रही। साल 1990 म इस क्षेत्र म दिलत की उपि थित 9.9 फीसदी थी, जो साल 2005 म कम होते हुए 9.8 फीसदी हो गई। अनुसूिचत जाित/ जनजाित उ यिमय को प्रो सािहत करने का एक तरीका यह है िक हम इस तबके के संघषर् कर रहे उ यिमय की आिथर्क मदद कर और लघ ुव म यम उ योग को मजबूत करके उनके जिरये दिलत की उ यिमता को िनखार। इस िलहाज से टड अप इंिडया अिभयान म छोटे व म यम आकार के उ योग पर खास तव जो देना दिलत के िलए फायदेमंद होगा। वैसे यहा ंतेलंगाना से सीखा जा सकता है। तेलंगाना ने िजला औ योिगक कद्र के जिरये दिलत मिहला उ यिमय पर खासा यान देना शु िकया है। कनार्टक सरकार ने भी दिलत दगु्घ उ पादक के िलए यह नीित बनाई है िक उ ह महज 25,000 म एक जोड़ी गाय दी जाए, यानी 75,000 पये की सि सडी। यह एक अ छी शु आत है।

कृिष-क्षेत्र म भी दिलत की सुिवधाओं का ख्याल रखा जाना चािहए। भूिम का एक समान व पारदशीर् िवतरण असामा य सामािजक ढाचें को दु त करता है। भूिम सुधार से िमला-जुला नतीजा िनकला है। ि थित यह है िक आज भी जहा ं‘कागज ’ पर जमीन का िवतरण है, वहां दिलत को उनका हक नहीं िमल सका है। ग्रामसभा तर पर सामािजक ऑिडट के जिरये ही इसे ठीक िकया जा सकता है। वैसे, इसम रा ट्रीय अनुसिूचत जाित आयोग की िनगरानी म गिठत िवशेषज्ञ कमेटी की भी दरकार होगी, जो इस काम पर िनगाह रखे। हम न िसफर् भूिम सुधार की ज रत को समझना होगा, बि क कृिष म दिलत को बराबर का याय भी देना होगा।

आंध्र प्रदेश की रा य सरकार 1969 से एक योजना चला रही है, िजसके तहत सरकारी बंजर जमीन का बंटवारा भूिमहीन म, खासतौर पर दिलत म िकया जाता है। भूदान कायर्क्रम के तहत 1,13,972 एकड़ से अिधक जमीन 43,000 ज रतमंद को बांटे गए थे। कद्र सरकार को यह सुिनि चत करना चािहए िक िजन-िजन दिलत को जमीन िमली है, उ ह सामूिहक िसचंाई की सुिवधा भी िमले। साथ ही, बेहतर बीज, भंडारण की सुिवधा भी

उ ह िमलनी चािहए। भूदान का अथर् िसफर् भूिम का दान नहीं होना चािहए। आज हमारा समाज ऊंची-ऊंची उड़ान भर रहा है। महज एक पीढ़ी के भीतर वह सामतंवाद से उ तर-आधुिनकतावाद की ओर बढ़ता हुआ िदख रहा है। ऐसे म, यह नई और आधुिनक पीढ़ी की िज मेदारी है िक वह समाज म समानता लाए। दिलत की आजीिवका से जुड़ े इन तमाम मु पर आवाज बुलंद करने की दरकार है। िफरोज व ण गांधी, भाजपा सासंद

बाढ़ का जलवाय ुपिरवतर्न से जुड़ता नाता जमीनी हकीकत सुनीता नारायण

भीषण बाढ़ का सामना कर रहे िबहार के मुख्यमंत्री नीतीश कुमार जब प्रधानमंत्री नरद्र मोदी से िमले थे तो वह इस कदर यिथत थे िक उ ह ने रा य की हालत पर लाई आने की बात कही थी। उनके साथ हम भी िबहार की हालत पर कुछ आंसू बहा लेने चािहए। इस साल आई बाढ़ ने हमारी बदइंतजामी की पोल खोलकर रख दी। इस बाढ़ ने जलवायु पिरवतर्न की वजह से दिुनया के खतरे म पडऩे की शु आत भी कर दी।

हम इससे न केवल िचिंतत होने बि क भयभीत होने की भी ज रत है। हम इस बात का अहसास होना चािहए िक हमारे पास देर से कदम उठाने और दलगत राजनीित म उलझने का वक्त नही ंरह गया है। जलवायु के चलत ेखतरे म पड़ी इस दिुनया म हम दोहरी बाधा का सामना करने को मजबूर ह। हम यह सुिनि चत करना होगा िक न केवल हमारा िवकास सही रा ते पर बढ़े बि क हम इसे अभूतपवूर् तेजी और यापक पैमाने पर भी अंजाम देना होगा। इस साल आई बाढ़ इस मामले म अलग है िक देश के लगभग सभी इलाके इस प्राकृितक आपदा की चपेट म आए ह। बाढ़ का मतलब केवल पानी के घर के भीतर पहंुचना ही नही ंहै। बाढ़ अपने साथ कई िजंदिगया ंभी लेकर जाती है और अपने पीछे संपि त और फसल की बरबादी के िनशान छोड़ जाती है। इस तरह से िवकास के मोच पर कई वष की मेहनत से हािसल कामयािबया ंएक झटके म ही ख म हो जाती हं◌ै। यह भी साफ है िक हम बाढ़ के बारे म केवल तभी िचिंतत होते ह जब इससे शहरी आबादी प्रभािवत होती है। यहां तक िक उ तराखंड की भयंकर बाढ़ पर भी लोग का यान तभी गया जब उसम बड़ी संख्या म लोग के मारे जाने की खबर आने लगी।ं आम तौर पर बाढ़ से संबंिधत खबर को मीिडया म भी तव जो कम ही िमलती है। बाढ़ एक तरह की िवरिक्त का िह सा हो गई है। लोग यह मान बैठे ह िक यह तो हर साल आती है, इसम नया क्या है? इस बार की बाढ़ म नयापन यह है िक इसकी ती ता और आकार लगातार बढ़ रहा है। इस साल की बाढ़ आम तौर पर सूखे वाले िदन म आई है। यह भी प ट है िक इस बार की बाढ़ सामा य या अिधक बािरश के कारण नही ंआई है बि क बहुत यादा और भयंकर बािरश के चलते बाढ़ आई। इस तरह की बािरश थोड़ ेसमय म ही िकसी इलाके को पूरी तरह से पानी से लबालब कर देती है। िवज्ञान पित्रका 'डाउन टू अथर्' के अग त अंक म इस बाढ़ के नयेपन के बारे म पड़ताल की गई है। एक तरफ बाढ़ देश के बड़ ेइलाके को तबाह कर रही है क्य िक हमने बाढ़ की आशंका वाले इलाक म गंभीर कुप्रबंधन िकया है। हमने जानबझूकर नदी के डूब वाले इलाक , नाल और जलाशय के

आसपास अितक्रमण होने िदया िजससे हालात और िबगड़ गए ह। दरअसल निदय के िकनारे तटबधं बनाने से उसम गाद बनने लगती है िजससे उसका डूब इलाका िव तािरत हो जाता है। आज के दौर म जब निदय म पानी आता है तो वह जमीन की तरफ फैलने लगता है िजससे बाढ़ के हालात बन जात ेह। दसूरी तरफ कुछ नई बात भी हुई ह िजनम भारी बािरश की घटनाएं शािमल ह। भारतीय मौसम िवज्ञान िवभाग भारी बािरश की घटनाओ ंको दो समूह म वगीर्कृत करता है। अगर 24 घंटे के भीतर 124.5 िमलीमीटर से लेकर 244.4 िममी तक बािरश होती है तो उसे 'बहुत भारी' बािरश माना जाएगा जबिक उससे भी यादा होने पर उसे 'अ यिधक भारी' बािरश की ेणी म रखा जाएगा। अकेले जुलाई महीने म ही छह िदन असम म बहुत भारी बािरश हुई। म य प्रदेश के बुरहानपुर और बैतूल िजल म अकेले 12 जुलाई को इतनी बािरश हुई िक सारे िरकॉडर् टूट गए। उस िदन सामा य से 10 गुना अिधक बािरश दजर् की गई थी। वही ं20 अग त को िबहार के 12 िजल म बहुत भारी या अ यिधक बािरश के हालात पैदा हुए थे। हद तो यह है िक सूखे से जूझ रहे राज थान म भी 11 अग त को सामा य से 100 फीसदी यादा बािरश िरकॉडर् की गई थी। इसके पाली और सीकर िजल म उस िदन सामा य से 10 गुना बािरश हुई थी। इन सभी जगह पर एक खास तरह का पैटनर् देखने को िमला। पहला, एक झटके म ही सूखे का सामना कर रहा इलाका अचानक भयंकर बाढ़ की चपेट म आ गया। दसूरा, कई जगह पर भले ही पूरा रा य बाढ़ की चपेट म है लेिकन वहां पर कुल बािरश औसत तर से कम हुई है। मसलन असम का 90 फीसदी इलाका बाढ़ की िवभीिषका झेलने को मजबूर है लेिकन वहां पर कुल बािरश सामा य से 25 फीसदी कम हुई। ऐसे म हम इस बाढ़ के नयेपन को समझना होगा िजसम बहुत भारी बािरश की घटनाएं बढ़ी ह। वैज्ञािनक ने बहुत पहले ही हम आगाह कर िदया था िक धरती के गमर् होने से न केवल बािरश म बढ़ोतरी होगी बि क इस बािरश का िवतरण और प्रभाव भी काफी अलग होगा। शायद हम उसी प्रविृ त का सामना कर रहे ह। मेरे सहकिमर्य ने बादल की प्रकृित के बारे म भी अ ययन िकए ह िजससे एक और िचतंाजनक पहलू का पता चलता है। हमारे शहर म बड़ ेपैमाने पर फैला वायु प्रदषूण भी बादल के बनने की प्रिक्रया को प्रभािवत कर रहा है िजससे अ यिधक बािरश की घटनाएं देखने को िमल रही ह। वैज्ञािनक का कहना है िक मानव-िनिमर्त एयरोसॉल (बहुत छोटे आकार के काबर्िनक और अकाबर्िनक कण) के बादल के संपकर् म आने से मॉनसून म भी बदलाव होने लगा है। वैज्ञािनक का मानना है िक एयरोसॉल जलवा प के संघिनत होने की प्रिक्रया को तेज कर देत ेह िजनसे बड़ ेआकार के बादल बनते ह। वैसे यह तय नही ंहै िक इसकी वजह से हमेशा यादा बािरश ही होगी, कभी यह कम बािरश का भी सबब बन जाता है। इन अिनि चतताओं के बावजूद इतना तो तय है िक बदलाव बड़ी तेजी से और घातक हो रहे ह और हम इस पर गहराई से यान देने की ज रत है।

संपादकीय: िचतंा का िव फोट उ तर कोिरया ने एक बार िफर परमाणु हिथयार का परीक्षण िकया है। उसकी इस कार तानी पर वाभािवक ही दिुनया भर म तीखी प्रितिक्रया हुई है। दिक्षण कोिरया ने कहा है िक िकम ज ग-उन की ‘सनक भरी लापरवाही उ तर कोिरया को आ म-िवनाश की तरफ ले जाएगी।’ वही ंअमेिरकी रा ट्रपित बराक ओबामा ने उ तर कोिरया पर नए प्रितबंध लगाए जाने की चेतावनी दी है। स ने भी चेताया है। यहा ंतक चीन और पािक तान ने भी इस परीक्षण की खुलकर िनदंा की है, िजनके बारे म एक समय माना जाता था िक वे उ तर कोिरया की गुपचुप मदद करत ेह। आइएइए प्रमुख यूिकया अमानो ने भी उ तर कोिरया के िखलाफ नए प्रितबंध के संकेत िदए ह। िपछले ह त ेउ तर कोिरया ने िजस परीक्षण को अंजाम िदया वह उसका पांचवा ंएटमी परीक्षण है। पहला 2006 म हुआ था। िफर दसूरा 2009 और तीसरा 2013 म। चौथा परीक्षण इसी साल जनवरी म हुआ था।

उ तर कोिरया के दावे के मुतािबक इस बार का ‘दस िकलोटन का िव फोट’ चौथे परीक्षण का करीब दोगुना था। और भी िचतंा की बात यह है िक इस परीक्षण से कुछ ही िदन पहले उ तर कोिरया ने बैिलि टक िमसाइल के परीक्षण िकए थे, जो एटमी हिथयार को ले जाने म सक्षम होती ह। िलहाजा, दिुनया के माथे पर िचतंा की लकीर और उ तर कोिरया के पड़ोसी देश की घबराहट साफ पढ़ी जा सकती है। अब सवाल यह है िक उ तर कोिरया के शासक िकम ज ग-उन की इस िफतरत पर लगाम कैसे लगे।

उ तर कोिरया के िखलाफ अंतररा ट्रीय यापािरक प्रितबंध कई साल से जारी ह। इस साल जनवरी म हुए परीक्षण के बाद माचर् म उस पर अंतररा ट्रीय िशकंजा और बढ़ गया। अब कुछ और प्रितबंध लगाए जा सकत ेह। लेिकन अब तक का अनुभव बताता है िक प्रितबंध से उ तर कोिरया के लोग को भले तकलीफ उठानी पड़ी ह और वे दिुनया से कटे-कटे रहने को िववश ह , िकम ज ग-उन और उनके फौजी तंत्र को कोई फकर् नही ंपड़ा है। वैि वक सुरक्षा के िलए खतरा पैदा करने का उनका दु साहस उनकी तानाशाही की देन है। वे िसफर् अंतररा ट्रीय िचतंाओ ंके प्रित संवेदनहीन नही ंह, अरसे से अपने देश के लोग के मानवािधकार का हनन करत ेरहने म भी उ ह कोई िहचक नही ंहै।

िकम ज ग-उन के एटमी परीक्षण को देखत े हुए अमेिरका दिक्षण कोिरया म िमसाइल तैनात करने का िनणर्य कर सकता है िजसके साथ उसकी सुरक्षा संिध है। पर इससे तनाव और बढ़ेगा ही। छह देश के समूह ने वातार् के जिरए उ तर कोिरया को परमाणु-िवमुख करने की बहुत कोिशश की, पर वह नाकाम रही। ऐसी कोिशश िफर से करने म कोई हजर् नही ंहै, पर अ छा होगा िक उ तर कोिरया पर दबाव डालने की अंतररा ट्रीय रणनीित की कमान चीन को स पी जाए, जो कुछ साल पहले तक उसका खास मददगार था। इस पर भी िवचार करने की ज रत है िक परमाणु अप्रसार की नीित िकतनी कारगर है? यह नीित परोक्ष प से एटमी हिथयार और तकनीक पर कुछ देश के एकािधकार की ही नीित सािबत हुई है। दसूरी ओर, परमाणु हिथयार या तकनीक कही ंिकसी आतंकवादी संगठन के हाथ न लग जाए इस अंदेश ेसे दिुनया डरी रहती है। इसिलए अ छा होगा िक पूणर् परमाणु िनर त्रीकरण के ल य को अपनाया जाए और ज दी से ज दी उसे पा लेने की कोिशश हो।
