Covid-19 Indonesian Legal Talking Points Industrial Activities are allowed to Resume During Public Health Emergency Period due to COVID-19 Outbreak.
Background
As the countermeasure against the Covid-19 outbreak, the Government has issued a set of regulations that enable each region to implement Large-Scale Social Restriction (Pembatasan Sosial Berskala Besar) (“PSBB”) subject to prior approval from Minister of Health*. The minimum implementation of PSBB includes temporary closure of
workplaces & limitation to activities in public places/facilities. However, on 9 April 2020, the Minister of Industry has issued Circular Letter No. 7 of 2020, which enables industries to resume its operation during the PSBB period after obtaining Industrial Operational & Mobility Certificate (“Certificate”) from the Minister of Industry. The Certificate
will allow such industries to carry out factory operations, office administration, and industrial activities mobility relating to the raw materials, auxiliary materials, finished goods, and/or workers – subject to compliance with the minimum health & safety protocols determined by Ministry of Industry under the Circular Letter of Industry No. 4 of 2020.

The Certificate may be issued within minutes as of the complete application submission and will valid throughout public health emergency period due to Covid-19.
The factory operational & office administration activities are required to comply with provisions under Circular Letter of Minister of Industry No. 4 of 2020, which provides health & safety protocols for factory operational in public health emergency period due to Covid-19.
Criteria of Industry Manufacturing companies in the form of
Industrial Companies (Perusahaan Industri) and/or Industrial Estate Company (Perusahaan Kawasan Industri); and
All sectors of industries.

1 Conduct screening to all workers through temperature check and screen individuals with respiratory symptoms such as coughs/flu/difficulty to breathe upon entering the factory area and shift changes;
2 If a sick worker is discovered in the company, it is prohibited for the worker to be involved in the company’s activity followed by a recommendation to check the relevant worker to health service facility of the company/government;
3 Ensure that any worker that is sick and has a history of traveling from states or zones/cities with local transmission of Covid-19 within the last 14 (fourteen) days to not enter the factory area. This matter must be informed through an announcement in the entrance area. For information on list of states with local transmission of Covid-19, it can be accessed to www.covid19.kemkes.go.id;

4 Ensure the availability of soap and flowing water to wash hands or alcohol-based hand sanitizer along with face masks, gloves and attire ensuring safety of the worker and the products produced;
5 Enhance frequency of routine cleaning among others by disinfecting public area such as bathrooms, registration and payment counters, and cafeteria especially at rush-hour;
6 Implement limitation of number of worker in using public facility such as praying spots, cafeteria, and toilet;
7 Provide supplements and nutritious foods for all workers;
8 Prepare a guide for workers containing instructions starting from the worker leaving his/her house until his/her return; and
9 Be involved in socialization of Healthy and Clean Lifestyle and information of Covid-19 through installations of banner, signs, graphic information in strategic areas in the factory area.
Health and Safety Protocols For Workers
1 During the time while in factory area, if a worker is sick, then the worker may not continue his/her work and directly check him/herself to the health service facility of the company/government;
2 Worker returning from states or zones/cities with local transmission of Covid-19 within the last 14 (fourteen) days must inform the company. If during the time while in the factory area the worker has fever or respiratory symptoms such as coughs/flu/difficulty in breathing, the worker must not continue his/her work and must check him/herself to the health service facility of the company/government;
3 Use face mask upon leaving the house and use face mask and gloves at all time while in the factory area;
4 Keep distance at least 1 (one) meter (social/physical distancing) and must not group at break time;
5 All worker must apply Healthy and Clean Lifestyle such as washing hands routinely using water and soap or alcohol-based hand sanitizer while also avoiding unnecessary touch of the face; and
6 Avoid handshake with other workers or other individuals and to consider adopting alternative greeting gesture.
