1 INTRODUCTION

1.1. Energizing Kowloon East Office wishes to

explore with an aim to understand the nature

and extent of interests as well as the underlying

concept of organizations that may be interested

in operating creativity, arts and culture

facilities under Kwun Tong Bypass along Hoi

Bun Road.

2 OVERVIEW OF SITES UNDER KWUN TONG BYPASS 2.1 Creativity, arts and culture facilities under Kwun Tong Bypass is an initiative to identify suitable spaces for artists, art groups and creative designers to operate in Kowloon East. The Project will adopt a partnership approach between Energizing Kowloon East Office and the operator. With the partnership approach, we intend to continue the present management style of Site 1 in providing a pleasant public space for public enjoyment. 2.2 The project aims to utilize unused spaces under the Kwun Tong Bypass and construct suitable facilities for creativity, arts and cultural use and to engage a non-profit making organization1 to manage, operate and maintain creativity, arts and cultural facilities for the public to enjoy. 2.3 The project includes three sites under the Kwun Tong Bypass with a total area of approximately 8,500m2 to be used as informal venues for creativity, arts and cultural activities. To support the activities, one of the sites, Site 1, has already been transformed into an Informal Performance Venue and opened to the public since January 2013. It is now under the management of Energizing Kowloon East Office. The other two sites are vacant government land and they will provide additional spaces for creativity, arts and cultural use. It is aimed that the new sites will carefully inject fresh elements within the fabric of Kwun Tong, adding new functions and synergy to the unique character of Kwun Tong waterfront.

2.4 A possible combination of the uses for the three sites are Informal Performance Venue (Site 1), Creative Hub (Site 2) and Multi-functional Space (Site 3) respectively2. The architectural design and building work will be undertaken by Government based on the selected operator’s design proposal with design and construction cost at approximately HK$20 million. 2.5 The Operator can commence operating Site 1 once selected around Q3 2014. Design and build works for Sites 2 and 3 will commence in parallel and target for completion around early 2016. It is anticipated that the tenancy agreement for operation of the facilities at the three sites would be for an initial period of 5 years with an option to be renewed for further period subject to agreement.

3 LOCATION 3.1 The vacant sites under Kwun Tong Bypass are located in Kwun Tong adjacent to the Kwun Tong Promenade and along Hoi Bun Road. Kwun Tong Promenade Phase 1 has been opened to the public since 2010, Phase 2 is under construction and will be completed at the end of 2014, altogether providing a 1km long waterfront park. The three sites are within 10 minutes on foot from Ngau Tau Kok Mass Transit Railway Station. 3.2 Kwun Tong, an area well known for its productive manufacturing centers and factories, accounted for one-fifth of Hong Kong’s total sales and work done in manufacturing industry in the hey days. Tens of thousands of workers have made a living in the factories of Kwun Tong and Kowloon Bay, reflecting Hong Kong’s “can do” spirit. Many of the industrial buildings built in the 1960s and 1970s have unique architectural interest and are still being actively used. In recent years, some of these premises have helped nurture Hong Kong’s creativity, arts and cultural services and industries and making Kowloon East an ‘incubator’ for artists and creative industries as designer workshops, studios, or rehearsal rooms. An earlier survey undertaken by the Hong Kong Art Development Council indicated that Kwun Tong and Ngau Tau Kok are popular places for the art creation activities3. Another survey4 undertaken by the Planning Department revealed that in KE over 500 establishments are operating as ‘cultural and creative workshop’ such as art/ music/ film studios.

The survey found that art creation activities are mainly located in Fo Tan (20.5%), Kwun Tong (19.6%), and Ngau Tau Kok (12.7%) and San Po Kong (10.6%). 5 VISION AND MISSION 5.1 In line with Government’s commitment to find opportunities to provide suitable spaces for artists, art groups and creative designers in Kowloon East, Energizing Kowloon East Office aims to utilize the unused spaces under the Kwun Tong Bypass for creativity, arts and cultural use and turn them into contemporary cultural hub in Kwun Tong for all to enjoy and contributing to enriching the lives of Hong Kong people.

6 ROLES AND RESPONSIBILITIES | MANAGEMENT ARRANGEMENTS 6.1 Government intends to support and drive the project in utilizing the unused spaces under the Kwun Tong Bypass for creativity, arts and cultural use. To administer the project effectively, Energizing Kowloon East Office will establish a dedicated Advisory Committee5 to consider the proposals and recommending the selected proposal and operator to Secretary of Development for approval. 6.2 The primary role of the operator is to come up with a layout plan to show the proposed outline design for the facilities within the given budget, business plan and carry out public engagement for its intended operation(s). The operator will be responsible to manage, operate and maintain6 the creativity, arts and cultural facilities. Funds generated from commercial activities are to be ploughed back for sustaining the overall operation of the creativity, arts and culture facilities within the tenancy/renewed tenancy period. 6.3 The proposed outline design submitted by the operator will be further developed under a partnership approach together with Energizing Kowloon East Office, Architectural Services Department and/or other government works departments into detailed design drawings for construction within the given budget. The works contract including site formation, building structure and E&M installations would be managed by ArchSD and other relevant government departments.

5 Advisory Committee is composed of members from Home Affairs Bureau (Culture), Commerce and Economic Development Bureau (Create HK) and Development Bureau (EKEO) to oversee, monitor and steer the development and operation of creativity, arts and cultural facilities under Kwun Tong Bypass. Advisory Committee is also charged with the duty to select and recommend an operator to Secretary of Development for endorsement. 6 Operator will be responsible for maintenance of the creativity, arts and cultural facilities except for the building structure and E&M installations constructed by the Government which will be maintained by Government.

7 OPPORTUNITY 7.1 Energizing Kowloon East Office recognizes that there are creativity, arts and culture operators who would be able to and interested in operating creativity, arts and culture facilities under Kwun Tong Bypass. Energizing Kowloon East Office wishes to identify interested parties with experience, capability, passion and drive to support the project. And through this Market Sounding Exercise (MSE), to better understand the nature and extent of interests as well as the underlying concept of the potential operators so that their views and feedback can be duly considered before the Invitation for Proposal (IFP) is invited around Q2 2014. 7.2 Parties interested should be non-profit making organizations with charitable status7 under Section 88 of the Inland Revenue Ordinance (IRO) (CAP. 112). 7.3 Interested parties in building and operating creativity, arts and culture facilities under Kwun Tong Bypass are welcome to express their interest and share with Energizing Kowloon East Office their ideas and concepts for operation. Information of the three sites is at Appendix 1.

8 MARKET SOUNDING EXERCISE 8.1 The purpose of this Market Sounding Exercise (MSE) is to ascertain interest from eligible organizations, on a non-committal basis, for operating creativity, arts and cultural facilities in the proposed framework. Interested parties are welcome to submit an MSE Respondent’s Information at Appendix 2 which allows Energizing Kowloon East Office to register their interests with reference to information that share their ideas and views. This will also facilitate the coming Invitation for Proposal (IFP) around Q2 2014. 8.2 This is not a pre-qualification exercise to shortlist or pre-qualifies any interested parties. Interested parties who do not submit for MSE will not be barred from filing future submissions for the project. Formal IFP for the project is expected to be issued around Q2 2014 with the target of executing a tenancy agreement around Q3 2014. 8.3 Interested parties are required to submit one original and two copies of MSE Respondent’s Information as per Appendix 2 In addition, a CD-R containing soft copy of MSE submission in both Microsoft Word (.doc) and Adobe Acrobat (.pdf) and scanned image of copies of relevant registration documents. The submission should be marked: “CONFIDENTIAL – Market Sounding Exercise for Operating Creativity, Arts and Culture Facilities under Kwun Tong Bypass” and submitted at or before 12:00pm Hong Kong time on 7 January 2014 to the following address:

9 NOTES ON PERSONAL DATA OF THE APPLICANTS Purposes of Collection 9.1 The personal data provided as part of Market Sounding Exercise (MSE) submission will be used by Government to process this MSE. The provision of personal data by means of MSE submission is voluntary. Classes of Transfer 9.2 The personal data provided by means of application to the project may be disclosed to other Government bureau, departments or authorized organizations for the purposes mentioned above. Access to Personal Data 9.3 Applicant has a right of access and correction with respect to personal data as provided for in Sections 18 and 22 and Principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance, Cap. 486. The applicant’s right of access includes the right to obtain a copy of the personal data provided in the application. Applicants are also entitled to make requests for correction of the personal data as appropriate. Enquiries 9.4 Enquiries concerning the personal data collected by means of this MSE exercise, including the making of requests for access and corrections, should be addressed to the Energizing Kowloon East Office, Development Bureau.

10 INTELLECTUAL PROPERTY RIGHTS 10.1 All submissions shall be the original works of applicants or shall not contain any materials infringing any third party intellectual property rights. Applicants should indemnify and keep the Government fully and effectively indemnified against all costs, claims, demands, expenses and liabilities of whatsoever nature arising from or incurred by reason of any such infringement or alleged infringement. 10.2 In making a submission, interested parties shall be deemed to have granted to the Government a freely transferable, royalty-free and irrevocable license to use, adapt and modify the ideas and proposals submitted and all intellectual property rights subsisting in the submissions for all purposes in respect of or in connection with the project. Interested parties shall, if required by the Government, do all things and execute all instruments or documents for the purpose of conferring the rights and interests on the Government. 10.3 The Government shall be entitled to disclose or make copies of any or all of the submissions for the purpose of considering the Creativity, Arts and Culture under Kwun Tong Bypass and to keep such copies for record purpose.

12 APPENDIX 2 CREATIVITY, ARTS AND CULTURE UNDER KWUN TONG BYPASS MARKET SOUNDING EXERCISE FOR OPERATOR RESPONDENT’S INFORMATION 1. Interested parties should submit the Market Sounding Exercise (MSE) containing the following information:

(a) About the respondent (i) name and background of the respondent organization including years

of creativity, arts and culture experience, management and operating experience of similar facilities over the past 5 years, number of employees and documentary proof of eligibility to apply;

(ii) name, telephone number and email address of contact person; and (iii) details of other partnering/assisting/supporting/ sponsoring bodies

involved. (b) About the project proposals (i) briefly describe your vision and aspiration for the project that is relevant

to the area of creativity, arts and culture; (ii) method of implementation including business plan and public

engagement methodology; (iii) preliminary sketch layout, work plan and timetable; and (iv) expected benefit/ achievements of the project. (v) Other views and comments on the project

2. The main submission should preferably be limited to six pages (in A4 size) and a minimum of font size of 12 points. Applicants may submit up to 3 images/drawings ( in A3 size ) to complement the main submission if necessary. 3. If a black rainstorm warning or typhoon signal No. 8 or above is hoisted between 9:00 a.m. and 12:00 noon on 7 Januar y 2014 , the deadline for submission will be extended to 12:00 noon on the following working day. 4.
