This toolkit includes information and legal resources (sample letters and fact sheets)that you can use to help your client if they have a problem with their credit report. Italso includes an accompanying information resource for you to give to your clients. 

So, what are credit scores?

A credit score or credit rating is a numerical score that creditreporting agencies generate from the information on the person'scredit report to rate a person's overall credit worthiness.  Differentreporting bodies might have different information about you andmay calculate your score in different ways. Businesses that allow customers to borrow money or to pay for goods and services at alater time are known as credit providers. Credit reporting bodies create credit scores andcredit reports based on information that credit providers have shared with them aboutindividual customers and their payment history. When making a decision about whetherto provide credit to a new customer, credit providers can access the person's credit scoreto assess how risky it would be for them to do so.

How long can

Your client can get one free credit report from each of thecredit reporting bodies every 12 months. Find out more inour How do I get a free copy of my credit report? legalresource.

Step 2:

Get a free copy of your credit report.

Many credit repair companies offer to clean a person'scredit report. But the truth is that your client is probablybetter off without them. Often, they don't succeed and theclient ends up paying hundreds of dollars for somethingthey could have done themselves  with the help of afinancial counsellor. Cleaning a credit report takes a bit ofwork, but depending on the circumstances, there might besome listings that your client is entitled to have removed. Your client can get free advice about this from a financialcounsellor.

If any of the information on the credit report is inaccurate, out-of-date, incomplete, irrelevant or misleading, your client has a right toobtain a correction - free of charge. If you find any of the followingmistakes, advise the credit reporting body of the mistake in writing.(Refer to our Removing a Listing sample letter.)

Step 3: Check for mistakes.

The debt should neverhave been listed.

The listing is inaccurate.

Was the listing inaccurate, out of date,incomplete, irrelevant or misleading?

If you answer yes to any of the following:

Was the debt more than $150? Was the debt more than 60 daysoverdue? Did they send you a written warningnot more than 90 days before thelisting was made? Has the debt been listed by abusiness that is a member of anOmbudsman or, alternatively, aCourt?

If you answer no to any of the following:For secured debts (e.g. car loan or homeloan): Was the last payment or last timeyou acknowledged the debt more than 15years ago?For unsecured debts (e.g. personal loan orcredit card): Was the last payment or lasttime you acknowledged the debt morethan 6 years ago?For matters that have been to court: Was thejudgment made more than 15 years ago?

The debt or court judgment is too old.

If you answer yes to any of the following:

The debt has been listed for too long.

For a court judgment: Was the judgmentlisted more than 5 years ago?For a debt: Was the debt listed morethan 5 years ago?

If all else fails, you can attempt to negotiate a settlementwith the credit provider who made the listing and, as part ofthe settlement, require that the listing be removed. Notethat if your client has already paid, you can request that thebusiness remove the listing but they are not obliged to. 

Step 5: Negotiate with the business.

Even if there has been no mistake on the credit report, ifyou can prove that there was a problem with the contractitself, you might be able to remove the listing. Was your client pressured into the contract? Was thecontract one they could clearly never afford? Was theinformation they were given inaccurate or misleading? Giveus a call to figure out if there was a problem with thecontract.

Step 4: Review the contract.

If the business refuses to correct a mistake on your client'scredit file, without good reason or sufficient evidence, youcan complain to the ombudsman scheme to which thecredit reporting body or credit provider is a member.
