1st Degree Murder

The premeditated and intentional killing of another person or viable fetus.

The planning part is huge which separates it from other murders.

Has to be clear evidence by police of premeditating.

2nd Degree Murder

The intentional killing of another person or viable fetus without planning beforehand.

NO PLANHappened on the spot but the defendant

still intended to take life.

Voluntary Manslaughter

Added element that reduces the crime from 2nd degree to VM is the heat of the moment/passion.

This means the person was raged with fury and had no control of the situation.

Involuntary Manslaughter

No intent to killNo intent to harm that would likely cause

death.Completely accidental.Punishment for this is lower as opposed to

voluntary, 2nd, or 1st.

Any force to remove an obstacle from an enclosure is a breaking.

Breaking and entering of any structure with intent to commit any crime.

Only burglary if you physically break a line in order to enter.
