What Is Cyber Crime ?
Any criminal activity that uses a computer either
instrumentally , target or means for perpetuatingfurther crimes comes within the ambit of cyber
crimes.
A generalized definition of cyber crime may be,
³unlawful acts where in the computer is used either as a tool or target or both.´

What Is Cyber Law ?� Cyber Law is the System Of Regulations for the
Electronic usage of the Internet
� Simply speaking Electronic Cyber Law is the GenericTerm which refers to all legal and regulatory aspects
of the internet, world transaction system and

� In June, 2006, Nadeem Kashmiri, an employee atHSBC¶s call center in Bangalore, sold the customer
credit card information to a group of scamsters whoused the information to siphon off nearly Rs 1.8crores from bank accounts of UK based customers.
� An Indian engineer and former Intel employee,
Bbishwasmohan Pani has been charged as stealingsecret information from Intel for its new employer and Intel¶s rival advanced Micro Devices (AMD).

THE INFORMATIONTECHNOLOGYACT, 2000� The Information Technology Act 2000 came into
force in India on 17 October 2000. It extends towhole of India and also applies to any offence or contraventions committed outside India by any person (s 1(2),IT Act 2000).
� According to s 75 of the Act, the Act applies to any
offence or contravention committed outside India byany person irrespective of his nationality, if such actinvolves a computer, computer system or network located in India.

POSSIBLE RELIEFS TO A CYBER CRIMEVICTIM- STRATEGY ADOPTION� A victim of cybercrime needs to immediately report the matter
to his local police station and to the nearest cybercrime cell
� Depending on the nature of crime there may be civil andcriminal remedies.� In civil remedies , injunction and restraint orders , blocking of
websites, may be sought, together with damages, delivery upof infringing matter and/or account for profits.
� In criminal remedies, a cybercrime case will be registered by police if the offence is cognisable and if the same is noncognisable, a complaint should be filed with metropolitanmagistrate
� For certain offences, both civil and criminal remedies may beavailable to the victim

ANALYSIS
The statistics that have been obtained and reported
about demonstrate the serious internet crimes in theworld.
Just the ³phishing´ emails produce one billion dollars
for their perpetrators. In a FBI survey in early 2004,
90% of the 500 companies surveyed reported asecurity breach and 80% of those suffered a financial
loss.

ANALYSIS
A national statistic in 2003 stated that four billion
dollars in credit card fraud are lost each year. Only2% of credit card transactions take place over the
Internet but 50% of the four billion, are from
transactions online.
All these findings are just an illustration of the misuseof the internet and a reason why internet crime has to
be slowed down.

As we can clearly see from the above graph the yearly amount of cyber/internet fraud is increasing day by day and a major reason being theincrease in technology.

OFFICIAL WEBSITE OF MAHARASTRA GOVERNMENT
HACKED
MUMBAI, 20 September 2007 ² IT experts were trying yesterday torestore the official website of the government of Maharashtra, which was hacked in the early hours of Tuesday.
� R akesh Maria, joint commissioner of police, said that the state¶s ITofficials lodged a formal complaint with the Cyber Crime Branchpolice on Tuesday. He added that the hackers would be trackeddown. Yesterday the website, http://www.maharashtragovernment.in, remained blocked.
� Deputy Chief Minister and Home Minister R .R . Patil confirmed thatthe Maharashtra government website had been hacked. He addedthat the state government would seek the help of IT and the CyberCrime Branch to investigate the hacking.

� ³W e have taken a serious view of this hacking, and if need be thegovernment would even go further and seek the help of private ITexperts. Discussions are in progress between the officials of the IT
Department and experts,´ Patil added.� The state government website contains detailed information about
government departments, circulars, reports, and several othertopics. IT experts working on restoring the website told Arab Newsthat they fear that the hackers may have destroyed all of the website¶s contents.
� According to sources, the hackers may be from
W ashington. ITexperts said that the hackers had identified themselves as ³Hackers
Cool Al-Jazeera´ and claimed they were based in Saudi Arabia. They added that this might be a red herring to throw investigators off their trail . According to a senior official from the state government¶sIT department, the official website has been affected by viruses onseveral occasions in the past, but was never hacked. The official
added that the website had no firewall.

SUGGESTIONS
� To prevent cyber stalking avoid disclosing any
information pertaining to one self.� Always avoid sending any photograph online
particularly to strangers and chat friends as there have
been incidents of misuse of the photographs.
� Always use latest and up date anti virus software toguard against virus attacks.

SUGGESTIONS
� Never send your credit card number to any site that is
not secured, to guard against frauds.� Web site owners should watch traffic and check any
irregularity on the site.
