Background
On February 6, 2001, the Board of Supervisors considered a report by the Planning Departmentregarding the process and timeline for designating the property referenced above as a future parksite. This report was prompted by Supervisor Beautz in response to neighborhood concernsrelated to the need to protect the remaining Monarch butterfly wintering habitat in the MoranLake area of Live Oak (Exhibit G of Attachment 6). The Board, following review of the report,directed Planning staff to process the amendment so that it could be included in the first round ofLCP amendments for 2001 (Exhibit F of Attachment 6).
The matter was scheduled for a public hearing before the Planning Commission on March 28,2001. The matter was continued to April 11,2001, at the request of the executor of the estate ofthe property owner and her attorney so that they could have sufficient time to prepare for thepublic hearing. The Commission considered the matter at its April 11, 2001, meeting (seeAttachment 5 - Minutes) and adopted a Resolution (Attachment 4) recommending that yourBoard adopt amendments to the General Plan/Local Coastal Program Land Use Plan and zoningto designate this site as a future park site. The matter is now before your Board for consideration.
Site Description
The site, located on the west side of East Cliff Drive, at the corner of Lake Avenue/Moran Way,is a level piece of land with numerous Eucalyptus trees scattered throughout the 33,018 squarefeet of the parcel (Exhibit E of Attachment 6). The property was listed as a park site in the 1978

Live Oak General Plan, the 1980 General Plan and in the 1983 Local Coastal Program. It wasdeleted from the 1994 General Plan/LCP during the early phases of the General Plan processbecause of the development and coastal permits that had been issued for a single family dwellingon the parcel. Those permits have expired and there are no pending applications.
Park Site Designation Process
The park site designation process involves both a General Plan/Local Coastal Program Land UsePlan amendment and a rezoning. The GP/LCP amendment would add the subject property to thelist of existing and future park sites in Figure 7-2 (Exhibit a of Attachment 1) as well as add aNeighborhood Park symbol to the property on the Live Oak Planning Area land use map.
The property would also be rezoned to add a “D” to the existing zoning of the property (R-l-5)to denote that the property is subject to the park site acquisition process (Attachment 2). Thispark site acquisition process would be initiated when an application for development is receivedby the County. It involves a review by County Parks staff of the future park site, followed byreview before the County Parks Commission and your Board.
CEQA Review
The designation of the property as a future site for a local park is categorically exempt fromCEQA (Attachment 3).
Discussion and Recommendation
The designation of this property as a future local park site is consistent with the County GeneralPlan/Local Coastal Program Land Use Plan policies which promote the acquisition of open spaceby public agencies to protect significant natural resources. According to an analysis of theMonarch butterfly population performed for the minor land division proposed three properties tothe west, this stand of Eucalyptus is a necessary part of the windrow which protects the roostingsites for the population of butterflies that roost inland of Moran Lake, near the County’s SewagePump Station. It is likely that any development of this parcel would result in the removal ofEucalyptus trees and the alteration of the wind patterns in this area. For that reason, it isappropriate for the County to designate this property as a site to be considered in the future foracquisition as a local park.
It is, therefore, RECOMMENDED that your Board:
1. Adopt the Resolution amending the General Plan/Local Coastal Program Land Use Planand Implementation Plan relating to the designation of APN 028-302-04 as a FutureCounty Park Site (Attachment 1); and
2. Adopt the Ordinance Amending Chapter 13.10 of the Santa Cruz CountyCode to rezoneAPN 028-302-04 from the R-l-5 (Single-family residential, 5,000 square feet per dwelling)to the R-l-5-D (Single-family residential, 5,000 square feet per dwelling, designated park

3. Certify the CEQA exemption (Attachment 3); and
4. Direct the Planning Department to include this amendment as a part of the next round ofLocal Coastal Program Land Use Plan amendments to be submitted to the CaliforniaCoastal Commission for review and certification.

RESOLUTION TO AMEND THE GENERAL PLAN/LOCAL COASTAL PROGRAM LANDUSE PLAN AND IMPLEMENTATION PLAN RELATING TO THE DESIGNATION OF
PROPERTY AS A FUTURE COUNTY PARR SITE
WHEREAS, the Board of Supervisors, on May 24, 1994, adopted the County GeneralPlan/Local Coastal Program Land Use Plan (GP/LCP) which designated certain properties as futureCounty park sites and on December 19, 1994, the County General Plan/Local Coastal Program wascertified by the California Coastal Commission; and
WHEREAS, on February 6, 2001, the Board of Supervisors considered a report regardingthe process for designating APN 028-302-04 as a future park site as a means to preserve portions ofthe habitat necessary for the winter roosting of the Monarch butterfly; and
WHEREAS, on February 6, 2001, the Board of Supervisors directed that APN 028-302-04be designated as a future County neighborhood park site in the County General Plan/Local CoastalProgram Land Use Plan and by adding the “D” Designated Park Site Combining District to the zoningdesignation of the property; and
WHEREAS, on April 11, 2001, the Planning Commission held a duly noticed public hearingto consider the amendments to the General Plan/Local Coastal Program Land Use Plan relating tothe designation of the property as a future park site, the staff report and all testimony and evidenceat the public hearing; and
WHEREAS, on April 11, 2001, the Planning Commission adopted a Resolutionrecommending that the Board of Supervisors adopt an amendment to the General Plan/ Local CoastalProgram Land Use Plan and an ordinance to designate APN 028-302-04 as a future local park siteand to rezone the property from the R-l-5 (Single-family residential, 5,000 square feet per dwelling)to the R-l-5-D ( Single-family residential, 5,000 square feet per dwelling, designated park site); and
WHEREAS, the Board of Supervisors, on April-1 7, 2001, held a duly noticed public hearingto consider the amendments to the General Plan/Local Coastal Program Land Use Plan relating tothe designation of the property as a future park site, the staff report and all testimony and evidenceat the public hearing; and

WHEREAS, the Board of Supervisors finds that the proposed General Plan/Local CoastalProgram Land Use Plan amendment and rezoning of the property to add the “D” designation will beconsistent with the policies of the General Plan and Local Coastal Program Land Use Plan, and willbe consistent with the objectives and land-use designations of the adopted General Plan/Local CoastalProgram Land Use Plan; and
WHEREAS, the proposed amendments to the General Plan/Local Coastal Program Land UsePlan have been found to be categorical exempt, consistent with applicable provisions of the CaliforniaEnvironmental Quality Act and the County of Santa Cruz Environmental Review Guidelines; and
WHEREAS, the Board of Supervisors finds that the proposed amendments are consistentwith the California Coastal Act.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the Board of Supervisorsof the County of Santa Cruz adopts the amendments to the County General Plan/Local CoastalProgram Land Use ‘Plan and implementing ordinances, as set forth in Exhibits A and B.
BE IT FURTHER RESOLVED AND ORDERED that these amendments to the General Planand County Code shall become effective following California Coastal Commission review andcertification.

ORDINANCE AMENDING CHAPTER 13.10 OF THE SANTA CRUZ COUNTYCODE CHANGING PROPERTIES FROM ONE ZONE DISTRICTTO ANOTHER
The Board of Supervisors of the County of Santa Cruz ordains as follows:
SECTION I
The Board of Supervisors finds that the public convenience, necessity, and generalwelfare require the amendment of the County Zoning regulations to implement thepolicies of the County General Plan and Local Coastal Program Land Use Plan regardingthe parcels listed below in Section III; finds that the zoning established herein isconsistent with all elements of the Santa Cruz County General Plan and the Local CoastalProgram; and finds and certifies that the proposed action is categorically exempt from theCalifornia Environmental Quality Act .
SECTION II
The Board of Supervisors hereby adopts the recommendations of the PlanningCommission for the Zoning Plan amendment as described in Section III, and adopts theirfindings in support thereof without modification as set forth below:
1. The proposed zone district will allow a density of development and types of useswhich are consistent with the objectives and land use designations of the adoptedGeneral plan; and
2. The proposed zone district is appropriate for the level of utilities and communityservices available to the land; and
3. The proposed rezoning is necessary to provide for a community-related use whichwas not anticipated when the Zoning Plan was adopted.
SECTION III
Chapter 13.10, Zoning Regulations, of the Santa Cruz County Code is hereby amendedby amending the County Zoning Plan to change the following property from the existingzone district to a new zone district as follows:

WHEREAS, the Board of Supervisors, on May 24, 1994, adopted the County GeneralPlan/Local Coastal Program Land Use Plan (GP/LCP) which designated certain properties asfuture County park sites and on December 19, 1994, the County General Plan/Local CoastalProgram &as certified by the California Coastal Commission; and
WHEREAS, on February 6,2001, the Board of Supervisors considered a report regardingthe process for designating APN 028-302-04 as a future park site as a means to preserve portionsof the habitat necessary for the winter roosting of the Monarch butterfly; and
WHEREAS, on February 6, 2001, the Board of Supervisors directed that APN 028-302-04 be designated as a future County neighborhood park site in the County General Plan/LocalCoastal Program Land Use Plan and by adding the “D” Designated Park Site Combining Districtto the zoning designation of the property; and
WHEREAS, on March 28, 2001, the Planning Commission held a duly noticed publichearing to consider the amendments to the General Plan/Local Coastal Program Land Use Planrelating to the designation of the property as a future park site, the staff report and all testimonyand evidence at the public hearing; and

WHEREAS, the Planning Commission finds that the proposed General Plan/Local CoastalProgram Land Use Plan amendment and rezoning of the property to add the “D” designation willbe consistent with the policies of the General Plan and Local Coastal Program Land Use Plan, andwill be consistent with the objectives and land-use designations of the adopted General Plan/LocalCoastal Program Land Use Plan; and
WHEREAS, the proposed amendments to the General Plan/Local Coastal Program LandUse Plan have been found to be categorical exempt, consistent with applicable provisions of theCalifornia Environmental Quality Act and the County of Santa Cruz Environmental ReviewGuidelines; and

ORDINANCE AMENDING CHAPTER 13.10 OF THE SANTA CRUZ COUNTYCODE CHANGING PROPERTIES FROM ONE ZONE DISTRICTTO ANOTHER
The Board of Supervisors of the County of Santa Cruz ordains as follows:
SECTION I
The Board of Supervisors finds that the public convenience, necessity, and generalwelfare require the amendment of the County Zoning regulations to implement thepolicies of the County General Plan and Local Coastal Program Land Use Plan regardingthe parcels listed below in Section III; finds that the zoning established herein isconsistent with all elements of the Santa Cruz County General Plan and the Local CoastalProgram; and finds and certifies that the proposed action is categorically exempt from theCalifornia Environmental Quality Act .
SECTION II
The Board of Supervisors hereby adopts the recommendations of the PlanningCommission for the Zoning Plan amendment as described in Section III, and adopts theirfindings in support thereof without modification as set forth below:
1. The proposed zone district will allow a density of development and types of useswhich are consistent with the objectives and land use designations of the adoptedGeneral plan; and

Commissioners:
On February 6, 2001, the Board of Supervisors considered a report by the Planning Departmentregarding the process and timeline for designating the property referenced above as a future parksite. This report was prompted by Supervisor Beautz in response to neighborhood concernsrelated to the need to protect the remaining Monarch butterfly wintering habitat in the MoranLake area of Live Oak (Exhibit G). The Board, following review of the report, directed Planningstaff to process the amendment so that it could be included in the first round of LCP amendmentsfor 2001 (Exhibit F).
Site Description
The site, located on the west side of East Cliff Drive, at the corner of Lake Avenue/Moran Way,is a level piece of land with numerous Eucalyptus trees scattered throughout the 33 ,O 18 squarefeet of the parcel (Exhibit E). The property was listed as a park site in the 1978 Live Oak GeneralPlan, the 1980 General Plan and in the 1983 Local Coastal Program. It was deleted from the1994 General Plan/LCP during the early phases of the General Plan process because of thedevelopment and coastal permits that had been issued for a single family dwelling on the parcel.Those permits have expired and there are no pending applications.
Park Site Designation Process - The park site designation process involves both a GeneralPlan/Local Coastal Program Land Use Plan amendment and a rezoning. The GPKLCP amendmentwould add the subject property to the list of existing and future park sites in Figure 7-2 (ExhibitB) as well as add a Neighborhood Park symbol to the property on the Live Oak Planning Arealand use map.

CEOA Review
The designation of the property as a future site for a local park is categorically exempt fromCEQA (Exhibit D).
Discussion and Recommendation
The designation of this property as a future local park site is consistent with the County GeneralPlan/Local Coastal Program Land Use Plan policies which promote the acquisition of open spaceby public agencies to protect significant natural resources. According to an analysis of theMonarch butterfly population performed for the minor land division proposed three properties tothe west, this stand of Eucalyptus is a necessary part of the windrow which protects the roostingsites for the population of butterflies that roost inland of Moran Lake, near the County’s SewagePump Station. It is likely that any development of this parcel would result in the removal ofEucalyptus trees and the alteration of the wind patterns in this area. For that reason, it isappropriate for the County to designate this property as a site to be considered in the future foracquisition as a local park.
It is; therefore, RECOMMENDED that your Commission adopt the Resolution RecommendingAmendment to the General Plan/local Coastal Program Land Use Plan and Implementation PlanRelating to the Designation of Property as a Future County Park Site.

ATTACHMENT 6ORDINANCE AMENDING CHAPTER 13.10 OF THE: SANTA CRUZ COUNTYCODE CHANGING PROPERTIES FROM ONE ZONE DISTRICTTO ANOTHER
The Board of Supervisors of the County of Santa Cruz ordains as follows:
SECTION I
The Board of Supervisors finds that the public convenience, necessity, and generalwelfare require the amendment of the County Zoning regulations to implement thepolicies of the County General Plan and Local Coastal Program Land Use Plan regardingthe parcels listed below in Section III; finds that the zoning established herein isconsistent with all elements of the Santa Cruz County General Plan and the Local CoastalProgram; and finds and certifies that the proposed action is categorically exempt from theCalifornia Environmental Quality Act .
SECTION II
The Board of Supervisors hereby adopts the recommendations of the PlanningCommission for the Zoning Plan amendment as described in Section III, and adopts theirfindings in support thereof without modification as set forth below:
1. The proposed zone district will allow a density of development and types of useswhich are consistent with the objectives and land use designations of the adoptedGeneral plan; and
2. The proposed z&e district is appropriate for the level of utilities and communityservices available to the land; and
3. The proposed rezoning is necessary to provide for a community-related use whichwas not anticipated when the Zoning Plan was adopted.
SECTION III
Chapter 13.10, Zoning Regulations, of the Santa Cruz County Code is hereby amendedby amending the County Zoning P%n to change the following property from the existingzone district to a new zone district as follows:

Members of the Board:
On January 23,2001, your Board approved a request from Supervisor Beautz to direct thePlanning Department to report back to your Board regarding the process and timelines associatedwith designating the property referenced above as a future park site. This letter will provide thatinformation to your Board.
The site, located on the west side of East CliffDrive, at the corner of Lake Avenue, was listed asa park site in the 1978 Live Oak General Plan, the 1980 General Plan and in the 1983 LocalCoastal Program It was deleted from the 1994 General Plan/LCP during the early phases of thegeneral plan process because of the development and coastal permits that had been issued for asingle family dwelling on the parcel. Those permits have expired and there ‘are no pending.applications.
Park Site Designation Process - The park site designation process involves both a GeneralPlan/Local Coastal Program Land Use Plan amendment and a rezoning. The GP/LCP amendmentwould add the subject property to the list of existing and future park sites in Figure 7-2(Attachment 1) as well as add a Neighborhood Park symbol to the property on the Live OakPlanning Area land use map.
The rezoning would add a “D” to the existing zoning of the property (R-l-5) to denote that theproperty is subject to the park site acquisitior$rocess. This process would be initiated when anapplication for development is received by the County. It involves a review by County Parks staffof the future park site, followed by review before the County Parks Commission and your Board.
The GP/LCP amendment and the rezoning would be subject to CEQA review (although it appearsthat an exemption is appropriate for this ‘project’), public hearings before the Planning

Al-LACHMENT 6Commission and your Board. Approval of the GP/LCP amendment would also be necessary fromthe California Coastal Commission.
Timeline - If so directed, Planning staff could begin processing this fairly minor work programtask immediately. Assuming that an exemption to CEQA was appropriate, the public hearingbefore the Planning Commission could be scheduled in early March, followed by a public hearingin mid-April before your Board. Thereafter, the amendment would be submitted to the CoastalCommission as a part of the First Round of LCP amendments in 2001.
Additional Actions - Currently, the County GP/LCP does not contain language which specificallyprotects the wintering sites of the Monarch butterfly. Although, the Monarch butterfly is notlisted as a protected species by either State or Federal regulatory agencies, it is appropriate toinclude specific language in the General Plan/LCP that identifies and protects Monarch butterflywintering sites and the windbreaks necessary for their use by the butterfly. This amendment to theGP/LCP should be presented for your Board’s consideration as a part of the Advanced Planningsection’s 2001-02 work program.
Recommendation - It is recommended that your Board:
1. Accept and file this report, and
2. Direct the Planning Department to process a General Plan/Local Coastal Program LandUse Plan amendment and rezoning to designate APN 028-302-04 as a future park siteaccording to the schedule discussed in the letter.
3. Direct the Planning Department to include in the Advanced Planning section’s workprogram for FY 200 l-02, for consideration by the Board, a General Plan/LCP amendmentto identify and protect the Monarch butterfly wintering habitat,

Dear Members of the Board:
As Board members may be aware, there is currently much concernwithin the Live Oak area regarding the eucalyptus trees .andmonarch butterfly habitat at Moran Lake. Issues includepreservation of the trees and habitat for monarch butterflies andthe safety of those living within the area when trees becomedangerous and need to be trimmed or removed. We have within thelast year funded management plans for both the County Parkproperty and the Sanitation District property to help toaccomplish these goals.
An .additional action that could be taken would be to ensure thatanother property that serves as a windbreak for the habitat andalso contains a eucalyptuir-, grove is preserved. Since thatproperty is privately owned, it is appropriate to designate thatproperty as a park site so that-if it comes up for development,the County would have the opportunity to purchase it. Attachedis a letter from one of many residents who have also requestedthis parcel be preserved;
I would thus propose that we refer the issue of designating APN028-302-04 as a park site to the Long Range Planning Division of

Dear Ms. Beautz,
This letter is to formally request that you support beginning the process of designating the
above mentioned parcel as appropriate for conservation as open space. I understand that this
process can not begin unless the Board of Supervisors allows it to proceed forward. With this
designation, I plan to seek out private funds for the parcel’s acquisition for the county. I urge
you to seek this approval from the Board, and believe that this is justified based on the following
considerations.
Moran Lake and Corcoran Lagoon characterize the local area in their combination of open
water and trees. Just as West Cliff has its Lighthouse Field, these two areas define the local area
as unique in its combination of reasonable development and preservation of undeveloped area.
The large eucalyptus that surround Moran Lake provide a community landmark that can be seen
easily from Main Beach or from boats on the ocean. In a sense they define PIeasure Point in this
way. The also act as a gateway to the neighborhood for drivers along East Cliff. The 104
micro-climate is very favorably affected by these trees, as they act as windbreak to protect the
neighborhoods from the strong ocean breezes. Moran Lake is also habitat to a large over-
wintering population of Monarch butterflies, which benefit from the windbreak provided by
these trees along the ocean.
This request falls well within two of the stated goals of the County General Plan. The
Conservation and Open Space Qment, 5-1, lists as goals:_‘ -,l -&en &ace Protection: To retain the scenic, wooded, open space and rural character of
Santa Cruz county; to provide a na 1 buffer between communities; to preventdevelopment in naturally hazardous areas: and to protect wildlife habitat and other naturalresources.
l Natural and Cultural Resource Protection: To protect and restore unique, rare, threatened,endangered and other natural and cultural resources that warrant preservation because oftheir biological value, scarcity, scientific value, aesthetic quality or cultural significance.
There are just three groups of trees left along the southeast side of the lake. One is on the
county right of way adjacent to the county park. The second was recently proposed to be

developed, but because of neighborhood opposition to the development, firmly rooted in county
law, the proposal was scaled back by the developer. This preserved a great deal of the trees in
this second group. The third group is Iocated on the subject parcel. This parcel is very
unattractive for development because of its logistics, in addition to its importance as one of the
last tree stands at the front of the lake area. Because of the conflict that any development on this
parcel will have with the tree stands on the property, and because of the parcel’s location on the
S-turn of East Cliff, there are hazards associated with development here. Objective 5.11 of the
Open Space Element of the General Plan states:
0 Ouen Space Preservation: To identify and preserve in open space uses those areas which arenot suited to development due to the presence of natural resource values or physicaldevelopment hazards.
In summary, because of the importance to the community of this undeveloped parcel as a visual
resource, because of the problems any development on this parcel would face, and because of
the importance of not removing trees in the Moran Lake monarch butterfly habitat area, I request
that the process of designating this parcel as appropriate for acquisition as open space begin as
soon as possible.
