PUBLIC NOTICE DECLARATION OF BOATING ACTIVITY EXEMPTION Marine Safety Act 2010 (Vic) Section 203(3) I, CAMERON TOY, Acting Deputy Director, Operations and delegate of the Director, Transport Safety, waterway manager for the waters of Anglesea – Point Roadknight, make the following declaration under Section 203(3) of the Marine Safety Act 2010 (Act). For the purpose of the boating activity by Adventurethon Australia, on the waters between Anglesea and Moggs Creek, the masters of rescue the 2 personal water craft (PWCs) participating in the Adventurethon Demolish Anglesea are exempt from: 1. The requirement to not operate a PWC on the waters of Anglesea – Point Roadknight, as detailed in Clause 136.1 of Schedule 136, contained in the Notice of the Marine Act 1988 (Vic). EXEMPTION CONDITIONS: Both PWC masters must wear visible “Adventurethon” branding, and operate at a speed of less than 5 knots when within the PWC prohibited area detailed above. All persons involved in the event on board any vessel must be wearing a PFD at all times as detailed in the Marine Safety Regulations 2012. All competitors racing in the longest paddle course must carry a handheld flare. The exemption applies from 7:00 am to 12:30 pm on Saturday 14 and Sunday 15 April 2018 provided the stated safety controls and undertakings detailed in the Event Application and associated documentation are adhered to and are actively enforced by the event proponent.
