GENERAL REGULATION

Ar#ic&e $% Scope o' ad()#men# and )*(ec# o' app&ica#ion

1. Scope of adjustment:

This Decree reu!ates acti"ities re!ated to ur#an de"e!opment in"estment inc!udin: ur#anp!annin$ formu!atin and pu#!ishin p!ans to dep!o% the areas of ur#an de"e!opment$ performinin"estment in construction and operation and transfer of in"estment in ur#an de"e!opment projects.

2. Su#jects of app!ication

This Decree app!ies to orani&ations and indi"idua!s in the countr% and a#road in"o!"in inacti"ities re!ated to the in"estment in ur#an de"e!opment.

Ar#ic&e +% E,p&ana#ion o' #erm

'n this Decree( the terms are construed as fo!!o)s:

1. *r#an de"e!opment area is an area identified for ur#an de"e!opment in"estment in acertain period. The ur#an de"e!opment areas inc!ude: ne) ur#an de"e!opment area( e+panded ur#ande"e!opment area( reno"ation area( conser"ation area( ur#an reconstruction area and specificfunctiona! area.

*r#an de"e!opment area ma% inc!ude one or more ur#an functiona! areas. The ur#ande"e!opment area ma% #e )ithin the administrati"e #oundaries of one or more pro"inces or cities.The ur#an ro)th area ma% inc!ude one or more ur#an de"e!opment in"estment projects.

2. Ne) ur#an de"e!opment area is an area e+pected to #e formed a ne) ur#an center in thefuture under ur#an p!annin appro"ed #% the competent authorit%( and in"ested in ne) constructions%nchroni&in )ith the ur#an infrastructure.

3. ,+panded ur#an de"e!opment area is the ur#an de"e!opment area inc!udin the e+istinur#an area and ne) ur#an area )ith a s%nchronous connection )ith the ur#an infrastructure.

. *r#an impro"ement area is the ur#an de"e!opment area )hich is in"ested in constructionto impro"e the ua!it% of e+istin ur#an center( #ut does not a!ter the #asic ur#an structure.

. *r#an conser"ation area is the ur#an de"e!opment area in order to preser"e and refur#ishur#an historica! and cu!tura! "a!ues.

. *r#an reconstruction area is the ur#an de"e!opment area )hich is ne)!% #ui!t on the f!oor of the o!d #ui!dins demo!ished of the e+istin ur#an center.

. Specific functiona! area is an ur#an de"e!opment area to form specific functiona! areas

such as economic( tourist and resort areas( co!!ee campuses( etc.. *r#an de"e!opment in"estment project is the construction in"estment project of a #ui!din

or a comp!e+ of #ui!dins in an ur#an de"e!opment area decided and pu#!ished #% the competentauthorit%.

*r#an de"e!opment in"estment project inc!udin project of ur#an center construction and#ui!din construction in"estment project in ur#an centers.

. *r#an center construction in"estment project is a construction in"estment project of #ui!dins 4)hich ma% inc!ude: housin( infrastructure( pu#!ic #ui!dins( etc.5 on an assined !and areain the ur#an de"e!opment area under the p!annin appro"ed #% the competent authorit%.

*r#an center construction in"estment project inc!udes the fo!!o)in t%pes:

a5 Ne) ur#an center construction in"estment project is a construction in"estment project of a

ne) construction ur#an center on a !and area con"erted from other !and t%pes to ur#an construction!and$

#5 *r#an reconstruction project is a project )hich sha!! #ui!d ne) architectura! #ui!dins andinfrastructure on the f!oor of current #ui!dins demo!ished under the ur#an p!annin )hich hectaress#een appro"ed #% the competent authorit%$

c5 *r#an reno"ation and refur#ishment project is the upradin and reno"ation of e+terior side or #ui!din structure in the e+istin ur#an areas )ithout an% Chane of more than 106 of the!and use criteria of the area$

d5 *r#an preser"ation and refur#ishment project is the preser"ation and refur#ishment of cu!tura!( historica! and architectura! "a!ues of the #ui!dins and !andscape in the area of ur#an cu!tura!heritae$

e5 Project construction is mi+ed ur#an construction projects in ur#an areas thectarest caninc!ude ne)!%-constructed #ui!din( reno"ated and refur#ished #ui!dins.

10. 7ui!din construction in"estment project in ur#an center is the ne) constructionin"estment project$ either e+pandin or reno"atin and refur#ishin of architectura! #ui!dins andinfrastructure.

11. 'n"estor is orani&ation or indi"idua! )ith capita! or person assined to manae and usecapita! in order to in"est in ur#an de"e!opment projects.

12. 8e"e! 1 in"estor is the person assined #% the State to imp!ement the ur#an de"e!opmentin"estment project. The !e"e! 1 in"estor ma% #e:

a5 9unctiona! State manaement aencies$

#5 anaement 7oard of construction in"estment assined #% the competent state aencies

c5 ,nterprises of a!! economic sectors( cooperati"es$

d5 Po!itica! and socio-professiona! orani&ations ua!ified as prescri#ed #% !a).

13. Secondar% in"estor is the !e"e! 2 in"estor or in"estor of su#seuent !e"e!s in"o!"ed inur#an de"e!opment in"estment project throuh the !ease( assinment or transfer of !and use riht )ithinfrastructure under the ur#an de"e!opment in"estment project for in"estment in #ui!din construction.

3. ,nsurin the e+p!oitation and use of resources economica!!% and efficient!%$ en"ironmenta!protection and response to c!imate Chane( natura! disasters aimed at sustaina#!e de"e!opment.
