The Board of Trustees of the Lake County Water Authority (LCWA), 27315 SR 19, Tavares, FL 32778-4251 requests that interested parties respond to the solicitation below by 4:00 pm, July 20, 2021. Letter of interest packages may be obtained by emailing or calling Jason Danaher, at [email protected] or (352) 324-6141.
Through the Lake Denham Muck Farm Restoration project (PROJECT), the successful respondent will survey, design, permit, monitor, and construct the restoration tasks detailed below. The PROJECT area is shown in Attachment A, Figure 1. The LCWA intends to offer mineral rights within a portion of the project area to the successful respondent in exchange for property maintenance, water/nutrient management, and comprehensive site restoration. The vertical and horizontal extents and potential value of extractable minerals (e.g., peat) are currently unknown. Prior to receiving mineral rights, the successful respondent will develop a project work plan, schedule and budget that is approved by and cost-neutral to LCWA and that is consistent with the LCWA’s project objectives as follows.
The objective of the PROJECT is to remove a portion of disturbed nutrient-enriched soils along with underlying peat. This effort is intended to reduce the phosphorus and nitrogen load to Lake Denham and may also provide opportunities for new fisheries resources and public recreation through site restoration. Approximately 345 acres of the total 759-acre parcel were previously converted for agriculture use and are considered a potential area to implement the proposed PROJECT (Attachment A, Figure 2). Removal of these soils from the former agricultural portion not only prevents potential release and downstream transport of the associated nutrients but is also expected to provide hydrologic benefits by increasing the available on-site water storage and further reducing loading to Lake Denham. Indirect benefits associated with additional water storage may include improving aquifer recharge conditions and reducing downstream flood potential.

BACKGROUND:
The Lake County Water Authority (LCWA) recently acquired the Lake Denham Muck Farm (parcel number 321924000100001300) as part of an ongoing effort to provide water quality improvements within Lake County (Attachment A, Figure 1). The acquisition was specifically intended to assist with the achievement of the Lake Denham total phosphorus (TP) and total nitrogen (TN) Total Maximum Daily Load (TMDL) reduction goals established by the Florida Department of Environmental Protection (FDEP). The LCWA intends to implement water quality improvement projects within the parcel that reduce downstream nutrient loading to Lake Denham and restore the site to offer passive recreational opportunities for the public.

INSTRUCTIONS TO RESPONDENTS
1. DEFINITIONS
The definitions of capitalized terms used in this solicitation are defined herein. A response to this solicitation shall include these Instructions to Respondents, any addenda published by the LCWA, the Letter of Interest submitted by Respondent (“Letter of Interest”), and all required certifications and affidavits.

4. LETTERS OF INTEREST OPENING

The Florida Public Records Act, §119.071(1)(b), Fla. Stat., exempts sealed Letters of Interest from inspection and copying until such time as the LCWA provides notice of an intended decision pursuant to §120.57(3)(a), Fla. Stat., or until 30 days after opening the Letters of Interest, whichever is earlier. This exemption is not waived by the public opening of Letters of Interest.

Unless otherwise exempt, Respondent’s submittal is a public record that is subject to disclosure upon expiration of the above exemption. If any information submitted with the Letter of Interest is a trade secret as defined in §812.081, Fla. Stat., and exempt from disclosure pursuant to §815.04, Fla. Stat., Respondent must clearly identify any such material as “CONFIDENTIAL TRADE SECRET” in its submittal and explain the basis for such exemption. The LCWA reserves the right, in its sole judgment and discretion, to reject a submittal for excessive or unwarranted assertion of trade secret confidentiality and return the submittal to Respondent.
5. PREPARATION AND ORGANIZATION OF LETTERS OF INTEREST
A. Instructions for Submitting Responses in “Hard Copy” Paper Format to LCWA office:1. Respondents must submit the following fully completed documents on reproduced copies of the

2. Respondents shall provide one (1) original and five (5) copies3. Please identify the original Letter of Interest submittal package as “ORIGINAL.”4. In order to assist the LCWA’s review process, each submittal package shall be bound or submitted in
three-ring binders with tabbed dividers for the Criteria identified in the Evaluation Criteria.5. All blank spaces on the Letter of Interest Form shall be typed or legibly printed in ink.6. Respondents may team with other firms in the form of a joint venture, partnership, or contractor-
subcontractor relationship in responding to this solicitation. 7. A Respondent may not submit more than one response as a Primary Respondent whether submitting
as a single firm, or as part of a joint venture or partnership. However, a Primary Respondent may participate as a subcontractor on more than one response. Any Respondent that submits more than one response as a Primary Respondent will result in disqualification of the Respondent pursuant to Paragraph 9 – Disqualification of Respondents.
8. Each submittal must state how the project will be managed (hierarchal relationships, etc.) between the Primary Respondent and the partners in the joint venture or partnership, as applicable.
9. A subcontractor may be a part of more than one response.10. Respondents shall provide and complete the following forms and questionnaires and include them
in their Letter of Interest submittal under the tabs identified below (responses to the forms and questionnaires can be submitted on reproduced copies). Respondents shall include detailed information in a format of their choice for those tabs where no form is provided:

11. Respondent is encouraged to include as much pertinent data and information under each section as necessary to ensure proper evaluation of its qualifications. Each section shall be evaluated separately on its own merit.
In the event you decline to submit a Letter of Interest, the LCWA would appreciate submittal of the “No Response Form” provided at the end of the “FORMS” section to describe the reason for not submitting a Letter of Interest.
B. Instructions for Submitting Responses in Electronic Format to LCWA office:
1. Respondent must follow all procedures for electronic submission or the Respondent’s submission may be determined as “non-responsive” and rejected.
2. If the Respondent opts to submit its Letter of Interest in electronic format:a. All information required by the solicitation, including the forms and questionnaires listed
under Item 5.A. above must be completed (typed or hand written) and included in the submission in electronic format (forms must be completed and converted/scanned to PDF format (Adobe).

6. INQUIRIES AND ADDENDA
LCWA staff are not authorized to orally interpret the meaning of the specifications or other Agreement documents, or correct any apparent ambiguity, inconsistency, or error therein. In order to be binding upon the LCWA, the interpretation or correction must be given by the Contract Administrator and must be in writing. The Contract Administrator may orally explain the LCWA’s procedures and assist Respondents in referring to any applicable provision in the Request for Qualifications documents, but the Respondent is ultimately responsible for submitting the Letter of Interest in the appropriate form and in accordance with written procedures.
Every request for a written interpretation or correction must be received at least twenty-one (21) days prior to the opening of Letters of Interest in order to be considered. Requests may be submitted by e-mail at [email protected]. Interpretations, corrections, and supplemental instructions will be communicated by written addenda to this solicitation posted on Onvia DemandStar and www.lcwa.org to all prospective Respondents (at the respective addresses furnished for such purposes) not later than fourteen (14) days prior to the date fixed for the opening of Letters of Interest.
Submission of a Letter of Interest constitutes acknowledgment of receipt of all addenda. Letters of Interest will be construed as though all addenda had been received. Failure of the Respondent to receive any addenda does not relieve Respondent from any and all obligations under the Letter of Interest, as submitted. All addenda become part of the Agreement.
7. BUDGET
The LCWA intends for the successful respondent to utilize revenue generated by the project to complete the required restoration and has therefore allocated no budget to the project. LCWA has not verified the value of the extractable resources within the project area. The LCWA reserves the right to reject all Letters of Interest if subsequent negotiations with qualified Respondents does not result in the LCWA’s intended cost-neutral budget. In addition, the LCWA reserves the right to increase, decrease, or delete any class, item, or part of the Work in order to reduce costs for any reason. The LCWA may discuss alternatives for reducing the cost of the Work with Respondents and make such modifications as it determines to be in its best interest.
The successful Respondent will be responsible for determining the volume of saleable material within the PROJECT area and the associated expense or effort required to design, permit, construct, monitor, and reclaim the PROJECT area in addition to specific site restoration required by the LCWA. The successful respondent will be responsible for all cost items of the project including, but not limited to:
All necessary geotechnical investigations required for permitting the project to include, but not limited to, estimating the mining materials balance to include marketable material volume and the volume of any material that will be excavated but kept on site.
All necessary investigations required for permitting the project to include, but not limited to, estimating the quantity of marketable palm and/or cypress trees to be removed from the site.
All necessary hydrologic investigations to satisfy LCWA and applicable regulatory agencies associated with the PROJECT.
All necessary environmental investigations to satisfy LCWA and applicable regulatory agencies associated with the PROJECT.

Remediation efforts to address known contamination issues within the PROJECT area as indicated in Attachment B.
Existing levee maintenance and improvements Relocation of approximately 140,000 cubic yards of alum residual from the LCWA’s nutrient
reduction facility at 16100 County Road 48, Mt. Dora, FL 32757 to the PROJECT site for use in final site grading (Attachment A, Figure 3).
Development of an LCWA-approved mine plan and an associated reclamation/restoration plan that is suitable for permitting and includes the LCWA’s specific PROJECT objectives which generally include the establishment of public access, creation of suitable fisheries habitat, and improved management of water quality and quantity (Attachment A, Figure 4).
Preparation, submittal, payment, and receipt of all required state and federal environmental resource permit applications and successful receipt of permits prior to commencement of any mining activities.
Preparation, submittal, payment, and receipt of Lake County mining permit application and successful receipt of the permit prior to commencement of any mining activities.
Preparation, submittal, payment, and receipt of any other application state, local, or federal permits as required to implement the PROJECT prior to the commencement of any mining activities.
Mobilization/demobilization of all equipment and personnel required for the operation of equipment to facilitate the successful completion of mining operations
Removal of any equipment or other appurtenances in accordance with the approved mine plan at the conclusion of mining and restoration/reclamation.
Maintenance of State and Federal water quality standards and that all water discharged from the PROJECT site to meet or exceed the natural background concentrations of 0.03 mg/L TP and 1.07 mg/L TN beginning with contract execution and continuing throughout the life of the mine until the mine reclamation work is accepted by the appropriate regulatory agencies.
Successful completion of mine reclamation and PROJECT restoration plan and any required monitoring up to and including LCWA’s regulatory release from additional reclamation monitoring.
8. MIMINUM QUALIFICATIONS
Respondent must use the “Qualification” forms (GENERAL, SIMILAR PROJECTS, and CLIENT REFERENCES) provided in these documents to document the minimum qualifications listed below. Failure to include these forms with the Letter of Interest may be considered non-responsive.
a. Respondent (or a combination of the firm, individual, or project manager assigned to the work) must have successfully completed at least three projects of a similar nature (i.e., mine design, planning, permitting, construction and reclamation/restoration) within the fifteen years immediately preceding the date set for receipt of responses. Each project must have had a minimum project area of at least 50 acres (use the SIMILAR PROJECTS FORM to document).
b. Respondent (or a combination of the firm, individual, or project manager assigned to the work) must have no less than fifteen years of experience on projects of the nature specified above (Respondent-provided documentation).
c. Lead engineers associated with the work on this project must be currently licensed as a professional engineer through the Florida Department of Business and Professional Regulation and should have expertise in the following disciplines (all things being otherwise equal, those Respondents whose expertise encompasses a greater number of disciplines will receive higher scores) – provide a copy of license(s) with submittal:

d. Lead surveyors associated with the work on this project must be currently licensed as a professional surveyor through the Florida Department of Agriculture and Consumer Affairs and should have expertise in mine surveying – provide a copy of license(s) with submittal.
e. The Respondent shall include the following information to demonstrate that it's mining (sub)contractor currently possesses or has the ability to obtain all of the equipment necessary to accomplish the mining work, material transport, and mine site management. The Respondent’s mining (sub)contractor shall provide documentation to substantiate this requirement, along with ONE of the following: • Proof of current ownership of equipment unit(s) (i.e., copy of title certificate, purchase receipt, or other forms of documentation showing ownership of equipment) OR • A copy of current lease of equipment unit OR • A letter from an equipment vendor or vendors stating that it can provide the equipment within 30 days of the issuance date of a work order to the mining (sub)contractor (letter must be signed by a manager-level individual and be attested)
f. The Respondent shall include copies of safety and environmental protection plans including information to demonstrate that its mining (sub)contractors maintain a workforce professional trained in safety, environmental protection, and other applicable mining requirements.
h. The Respondent shall provide a list of all mine permitting, construction, and reclamation projects completed by its mining (sub)contractor within the past seven years. The list must include the project names, descriptions, awarding agencies, contract numbers, initial and final contract amounts, agency contacts with phone numbers and email addresses.
i. Respondent must provide three client references. At least one of the client references must be from the similar projects listed in response to sub-paragraph (a), above. No more than one of the client references may be from completed LCWA projects. If an LCWA project is cited, do not request a letter from the LCWA staff. The evaluation team will use the project’s closeout documents in lieu of a letter of reference and may consult with the LCWA project manager.

9. DISQUALIFICATION OF RESPONDENTS
Any of the following causes will be considered as sufficient grounds for disqualification of a Respondent and rejection of the Letter of Interest:
a. Submission of more than one Letter of Interest for the same subject matter by an individual, firm, partnership, or corporation under the same or different names;
b. Evidence of collusion among Respondents;c. Submission of materially false information with the Letter of Interest;d. Information gained through checking of references or other sources which indicates that
Respondent may not successfully perform the Work;e. Incomplete contractual commitment(s) to other persons or entities, which, in the sole
judgment of the LCWA, may hinder or prevent the prompt completion of the Work if awarded to Respondent;
f. Respondent is failing to adequately perform on any existing contract with the LCWA;g. Respondent has defaulted on a previous contract with the LCWA;h. The evidence submitted by Respondent, or the LCWA’s investigation of Respondent, fails
to satisfy the LCWA that Respondent is properly qualified to carry out the obligations of the Agreement in a manner acceptable to the LCWA and within the anticipated time specified (Paragraph 5, Tab 7);
i. Any other cause that is sufficient to raise doubt regarding the ability of a Respondent to perform the Work in a manner that meets the LCWA’s objectives for the Work.
j. Respondent did not attend the Mandatory Pre-Bid meeting on Tuesday, June 15, 2021 @ 10am EST located at 30553 Flatwoods Rd., Leesburg, FL 34748 (adjacent to Flat Island Preserve).
10. EVALUATION AND AWARD PROCEDURES
a. Letters of Interest will be evaluated by a staff Evaluation Committee (the “Committee) based upon the criteria and scoring set forth in “EVALUATION CRITERIA.” The Committee members will meet at LCWA headquarters or other locations as appropriate to discuss the Letters of Interest and their individual evaluations. Each Committee member will complete an evaluation form, from which the overall ranking of Letters of Interest is determined using the total sum of awarded points. Evaluation forms may be submitted at or subsequent to the Committee meeting. If it is determined that it will assist the Committee’s evaluation for some or all Respondents to make an oral presentation, such presentations will be scheduled at LCWA headquarters or other location as appropriate.
b. Following the evaluation process, the LCWA will submit the final ranking of Letters of Interest to the Board of Trustees for approval. All Respondents will be notified in writing of the Committee’s final ranking of Letters of Interest.
c. The Committee will meet in the location(s), time(s), and date(s), stated at beginning of the Request for Qualifications package, to evaluate and rank the Letters of Interest.
d. Contract negotiations will then commence with the Respondent(s) submitting the highest-ranked Letter of Interest. If negotiations fail with the highest-ranked Respondent(s), negotiations will proceed with the next highest-ranked Respondent, and so forth.
e. The Agreement(s) will be awarded to the Respondent(s) having the highest ranked Letter(s) of Interest, which successfully concludes negotiations with the LCWA [the “Successful Respondent(s)”].
f. If two or more Letters of Interest are equal in all respects, the Agreement will be awarded as follows: (1) to the Respondent that certifies compliance with §287.087, Fla. Stat., via the Drug-Free Workplace Form; (2) to a Respondent university in the State University System

pursuant to §373.63, Fla. Stat.; or (3) by lot.g. The LCWA reserves the right to award the Agreement(s) to the next highest ranked and
available Respondent in the event the Successful Respondent fails to enter into the Agreement, or the Agreement with said Respondent is terminated within 90 days of the effective date.
h. All Respondents will be notified of the LCWA’s intent to award or decision to award the Agreement. For the purpose of filing a protest, the time period will commence as provided in “NOTICES AND SERVICES THEREOF.”
11. PROJECT DESCRIPTION’S STATEMENT OF WORK
The PROJECT includes all permitting, design, remediation, construction, demolition, reclamation, restoration, treatment, and monitoring efforts required for all activities related to removing potentially marketable soils and trees within the PROJECT area based on the following requirements:
A. Within 60 days of award, the successful respondent shall enter into an agreement with LCWA to design, permit, construct, monitor, and reclaim/restore the PROJECT.
B. Within 30 days of CONTRACT execution, the successful Respondent shall submit a draft mining plan development schedule in accordance with Lake County Development Review requirements. The LCWA has conducted a preliminary meeting with Lake County Development Review to discuss permitting requirements. Preliminary comments and associated supporting documentation provided by Lake County Development Review are provided in Attachment C. The draft plan schedule shall include but is not limited to:
• Conceptual mine plan• Hydrology report• Environmental report• Engineering report• Fiscal and economic impact report• Traffic impact• Geotechnical report• Restoration/reclamation design that incorporates the LCWA’s conceptual elements as
shown in Attachment A, Figure 3
The successful Respondent will be responsible for updating the schedule, as necessary. The schedule will be utilized to monitor progress and schedule additional scope items listed below.
C. The successful Respondent shall coordinate with LCWA and FDEP to provide a site remediation plan that addresses contamination issues identified in Attachment B and shall implement the plan once approved and prior to 50% completion of mining activities.
D. The successful Respondent shall coordinate with LCWA to incorporate demolition and removal of an existing structure and concrete slab located on the north central edge of the parcel (outside of the restoration PROJECT footprint) and shall complete demolition and removal prior to 50% completion of mining activities.
E. The successful Respondent shall coordinate with LCWA to incorporate improvements to the

existing levee structures on the east, west and south portion of the parcel and shall complete prior to 50% completion of mining activities.
F. Prior to commencement of mining activities and within 18 months of contract execution, the successful Respondent shall be responsible for preparing and obtaining necessary local, state, and federal permits and shall be financially responsible for permit applications and all associated permit activities including any potential mitigation.
G. The successful Respondent shall mobilize/demobilize and operate any equipment required to construct the PROJECT.
H. Upon entering into a contract with the LCWA for the PROJECT and prior to any mine period management requirements, the successful Respondent will assume the operation and maintenance of existing pumps within the PROJECT area which control water levels within the PROJECT area or provide and maintain/operate additional similar pumps during project timeline. The successful Respondent shall operate these pumps in accordance within LCWA’s desired water level control ranges within the PROJECT area and will treat and monitor discharge as follows:
• The successful Respondent shall provide for the pre-treatment of any discharge from the PROJECT area to meet Class III water quality standards, and to maintain TP concentrations at or below 0.03 mg/L and TN concentrations at or below 1.07 mg/L.
• The successful Respondent shall provide the LCWA with monthly pump operation summaries and will provide daily monitoring during discharge events with results of any discharge analyses reported to LCWA within seven (7) days.
I. The successful Respondent shall be solely responsible for marketing and sale of any materials excavated from the PROJECT area and LCWA makes no claims regarding the value of such materials.
J. The successful respondent shall assess the actual quantities of alum residual at the LCWA’s Nutrient Reduction Facility, provide any necessary access improvements (or complete resulting repairs), and mobilize any equipment necessary for transportation of approximately 140,000 cubic yards of alum residual to the PROJECT site and shall incorporate the material as part of final site reclamation/restoration activities.
K. The successful respondent shall provide all required site monitoring prior to, during, and following mining and reclamation/restoration activities until the PROJECT site has been released from any necessary site reclamation monitoring.

13. EXECUTION OF AGREEMENT
Submittal of a Letter of Interest binds the Successful Respondent to perform the Work upon acceptance of the Letter of Interest and execution of the Agreement by the LCWA. Unless all Letter of Interests are rejected, a contract will be provided to the Successful Respondent, who must execute and return the Agreement to the LCWA within ten days of the date of receipt, along with the following:
a. A completed Internal Revenue Service Form W-9;b. Satisfactory evidence of all required insurance coverage;c. Proof satisfactory to the LCWA of the authority of the person or persons executing the
Agreement on behalf of Respondent; andd. All other information and documentation required by the Agreement.
The LCWA will not execute the Agreement until the above documents have been executed and delivered to the LCWA. The Agreement will not be binding until executed by the LCWA. A copy of the fully executed Agreement will be delivered to the Successful Respondent. The LCWA reserves the right to cancel award of the Agreement without liability at any time before the Agreement has been fully executed by all parties and delivered to the Successful Respondent. Failure upon the part of the Successful Respondent to execute the Agreement or timely submit the required evidence of insurance coverage, or any other matter required by the Agreement, will be just cause, if the LCWA so elects, for the recommended award to be annulled.
14. SIGNATURE AND CERTIFICATION REQUIREMENTS
An individual submitting a Letter of Interest must sign his/her name therein and state his/her address and the name and address of every other person interested in the Letter of Interest as principal. If a firm or partnership submits the Letter of Interest, state the name and address of each member of the firm or partnership. If a corporation submits the Letter of Interest, an authorized officer or agent must sign the Letter of Interest, subscribing the name of the corporation with his or her own name and affixing the corporate seal. Such officer or agent must also provide the name of the state under which the corporation is chartered, and the names and business addresses of the President, Secretary, and Treasurer. Corporations chartered in states other than Florida must submit evidence of registration with the Florida Secretary of State for doing business in the state of Florida. Respondent must certify that all persons or entities having an interest as principal in the submittal of the Letter of Interest or substantial performance of the Work have been identified in the Letter of Interest forms.
15. REJECTION OF LETTER OF INTEREST
Letters of Interest must be delivered to the specified location and received before the Letter of Interest opening in order to be considered. Untimely Letters of Interest will be returned to the Respondent unopened. Letters of Interest will be considered irregular and may be rejected if they show material omissions, alterations of form, additions not called for, conditions, limitations, or other material irregularities. The LCWA may consider incomplete any Letter of Interest not prepared and submitted in accordance with the provisions specified herein and reserves the right to waive any minor deviations or irregularities in an otherwise valid Letter of Interest.
THE LCWA RESERVES THE RIGHT TO REJECT ANY AND ALL LETTERS OF INTERESTS AND CANCEL THIS REQUEST FOR QUALIFICATIONS WHEN IT DETERMINES, IN ITS SOLE JUDGMENT AND DISCRETION, THAT IT IS NOT IN ITS BEST INTEREST TO AWARD THE AGREEMENT.

16. WITHDRAWAL OF LETTER OF INTERESTS
Respondent may withdraw its Letter of Interest if it submits such a written request to the LCWA prior to the designated date and hour of Letter of Interest opening. Respondent may be permitted to withdraw its Letter of Interest no later than 72 hours after the Letter of Interest opening for good cause, as determined by the LCWA in its sole judgment and discretion.
17. SUBCONTRACTS
Respondent must identify all portions of the Work Respondent intends to perform through subcontractors for each portion of the Work exceeding ten percent of the Work on the attached “Proposed Subcontractors” form. Respondent must submit with its Letter of Interest a list of all known subcontractors who will participate in more than ten percent of the Work. Acceptance of the Letter of Interest does not constitute approval of the subcontractors identified with the Letter of Interest.
18. EXAMINATION OF AGREEMENT DOCUMENTS AND WORK AREA
Respondent is solely responsible for being fully informed of the conditions under which the Work is to be performed in relation to existing conditions. Respondent is responsible for carefully examining the general area of the Work, the requirements of the drawings and other documents related to the Work, the time in which the Work must be completed, and any other details of the Work. Respondent must satisfy itself from its knowledge and experience or professional advice as to the character of the Work, the conditions and materials to be encountered, the character, quality, and quantities of the Work, and any other conditions affecting the Work, including surrounding land.
Failure to satisfy the obligations of this paragraph will not relieve a Successful Respondent of its obligation to furnish all material, equipment, and labor necessary to perform the Agreement and to complete the Work for the consideration set forth in its Letter of Interest. Any such failure will not be sufficient cause to submit a claim for additional compensation.
No verbal agreement or conversation with any LCWA officer, agent, or employee, either before or after the execution of the Agreement, will affect or modify any of its terms.
19. PUBLIC ENTITY CRIMES/DISCRIMINATORY VENDORS
In accordance with §287.133 and §287.134, Fla. Stat., a person or affiliate who has been placed on the convicted or discriminatory vendor lists following a conviction for a public entity crime or placement on the discriminatory vendor list may not submit a bid, proposal, or reply on a contract to provide any goods or services to a public entity; may not submit a bid, proposal, or reply on a contract with a public entity for the construction or repair of a public building or public work; may not submit bids, proposals, or replies on leases of real property to a public entity; may not be awarded or perform work as a Contractor, supplier, subcontractor, or contractor under a contract with any public entity; and may not transact business with any public entity in excess of the threshold amount provided in §287.017 for CATEGORY TWO ($35,000) for 36 months following the date of being placed on the convicted or discriminatory vendor lists.
20. FLORIDA SALES TAX
The LCWA is exempt from payment of state of Florida sales tax pursuant to §212.08(6), Fla. Stat.

21. NOTICES AND SERVICES THEREOF
The LCWA will publish notice of specifications and criteria, including addenda, intended agency decisions, or other matters pertinent to this solicitation on Onvia DemandStar and www.lcwa.org In addition, the LCWA will post notices of intended agency decisions at the LCWA’s office at 27351 SR 19, Tavares, FL 32778, on the date the publication is posted on the LCWA website, www.lcwa.org.
Notices that are posted on www.lcwa.org are deemed received at 8:00 a.m. on the next business day following the date posted. Notices that are posted at the LCWA’s office are deemed received at 8:00 a.m. on the next business day following the date of posting. Notices will be posted for a minimum of 72 hours following the time at which they are deemed received. The time period for filing a Notice of Protest pursuant to the LCWA bid and protest policy [Lake County Water Authority Resolution 2003-03] commences at the time notices are deemed received.
As a courtesy to Respondents, the LCWA may send copies of the notices of intended agency decisions via e-mail or facsimile to the address or phone number provided by Respondent. These courtesy communications neither constitute official notice nor vary the times of receipt set forth above.
22. PROTEST PROCEDURES
Pursuant to LCWA bid and protest policy [Lake County Water Authority Resolution 2003-03], any person adversely affected by the procurement methodology described herein, or the specifications or criteria, including addenda, must file a Notice of Protest within 72 hours after receipt of the solicitation documents or addenda.

DRUG-FREE WORKPLACE PROGRAM CERTIFICATION
Drug-free Workplace Program Requirements:
Pursuant to Section 287.087, Florida Statutes, whenever two or more RFQ which are equal with respect to price, quality, and service are received by the State or by any political subdivision for the procurement of commodities or contractual services, a RFQ received from a business that certifies that it has implemented a drug-free workplace program shall be given preference in the award process. In order to have a drug-free workplace program, a business shall:
1. Publish a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the workplace and specifying the actions that will be taken against employees for violations of such prohibition.
2. Inform employees about the dangers of drug abuse in the workplace, the person's or entity's policy of maintaining a drug-free workplace, available drug counseling, rehabilitation, employee assistance programs, and the penalties that may be imposed upon employees for drug abuse violations.
3. Give each employee engaged in providing the commodities or contractual services that are under RFQ, a copy of the statement specified in subsection 1 (above).
4. In the statement specified in subsection 1 (above), notify the employees that, as a condition of working on the commodities or services that are under RFQ, solicitation, or contract, the employee will abide by the terms of the statement and will notify the employer of any conviction or plea of guilty or nolo contendere and violation of Chapter 893 or any controlled substance law of the United States or any state, or a violation occurring in the workplace, no later than five days after such conviction.
5. Impose a sanction on, or require the satisfactory participation in a drug abuse assistance or rehabilitation program, if such is available in the employee's community, any employee who is so convicted.
6. Make a good faith effort to continue to maintain a drug-free workplace through implementation of this section.

All required policies shall include: (1) endorsement that waives any right of subrogation against the LCWA for any policy of insurance provided under this requirement or under any state or federal worker’s compensation or employer’s liability act; (2) endorsement to give the LCWA no less than a 30 day notice in the event of cancellation or material change. Certificates of Insurance must be accompanied by copies of the requested endorsements.
Any deductibles or self-insured retentions above $100,000 must be declared to and approved by the LCWA. Approval will not be unreasonably withheld. Contractor is responsible for any deductible or self- insured retention. Insurance must be placed with insurers having an A.M. Best rating of A-V or greater. LCWA receipt of insurance certificates providing less than the required coverage does not waive these insurance requirements.
Not all of the liability coverages shown below may be applicable to all Respondents. Liability coverage requirements will be reviewed and determined during negotiations with the Successful Respondent(s).
(a) Workers’ Compensation Insurance. Workers’ compensation and employer’s liability coverage, including maritime workers compensation, if applicable, in not less than the minimum limits required by Florida law. If Contractor claims an exemption from workers’ compensation coverage, Contractor must provide a copy of the Certificate of Exemption from the Florida Division of Workers’ Compensation for all officers or members of an LLC claiming exemption who will be participating in the Work. In addition, Contractor must provide a completed LCWA “Affidavit (Non-Construction)” for non-construction contracts. (b) General Liability. Commercial General Liability Insurance on an “Occurrence Basis,” with limits of liability not less than $1,000,000/$2,000,000, for personal injury, bodily injury, and property damage. Coverage shall include: (1) contractual liability, (2) products and completed operations, (3) independent contractors, and (4) property in the care, control, or custody of the Contractor. Extensions shall be added, or exclusions deleted to provide the necessary coverage.
(c) Automobile Liability. Minimum limits of $100,000/$300,000/$50,000.
(d) Professional Liability. (per claim) $2,000,000 single limits.
(e) Watercraft Liability. $300,000 for bodily injury and property damage.
(f) Pollution/Environmental Impairment Liability Coverage. Not less than $2,000,000 per occurrence and/or aggregate combined single limit, personal injury, bodily injury, and property damage (this may be added as rider to the general liability policy).
(g) Umbrella Policy. Minimum limits of $5,000,000.
