4.0 Assessment

4.1 Considerations and assessmentThe application is to construct a category 3 levee as part of Stage 2 of the Roma Flood Mitigation Project.

The proposed development is identified as a category 3 levee as defined under the Water Act 2000. The matter of interest to the state for category 3 levees is community resilience.

The application has been assessed against the state development assessment provisions under Module 7 – Water Resources, Table 7.3.1: Operational work for a Category 3 levee.

The application has been assessed against PO1 in Table 7.3.1, which states that the levee must be designed, constructed and managed such that it maintains orenhances the resilience of impacted people to the potential impacts of the levee.

The assessment was based on the Guidelines for the Construction or Modification of Category 2 and 3 Levees.

The assessment of the application was based on information provided by the proponent in their initial application and following a request for further information. The applicant also provided a response to the questions outlined in section 6.9 of the Guidelines, which were designed to assist the proponent in addressing the requirements of the State Code.

DNRM staff reviewed the information provided, sought additional information andclarification from the proponent, and then determined whether the requirements of the State Code were met.

The assessment made was based on Regional Mitigation Combination 6, which was identified by the proponent as being the preferred option. It is recognized that the design of the levee based on this option is yet to be completed, and that there may be some minor changes to the final design. To address this issue, the conditions detail the additional modelling, assessment of impacts, and consultation with the community including affected parties that the proponent must undertake in accordance with the timeframes below.

Based on the consultation report provided, it is assessed that the consultation and collaboration with the community, up to the date of the application submission, hasbeen sufficient. It is considered that the community has been informed and has had an opportunity to provide input to the levee design.

As the levee design has not been finalized, in order to meet the resilience requirements of the State Code, the proponent needs to continue collaboration andinform the community throughout the design, commissioning and operation of the levee, including updating of the Local Disaster Management Plan, the Disaster Management Response Plan and Operations and Maintenance Manual.

The above requirements are specified in the recommended conditions in section 5.

The basis of the assessment was that, in order to build community resilience, the community should be informed about the impacts of the levee operating normally or failing, and should be able to have an input into its design. Ensuring the communityis fully informed and engaged will allow decisions to be made on an individual and community basis on planning for, responding to, and recovering from flood events.

The application is considered to satisfy all Performance Outcomes in Table 7.3.1 of the SDAP with the provision of the conditions below.

5.0 Recommendations

5.1 Technical agency advice for SARA as concurrence agencyOur department:(a) recommends the following issues be addressed by applying conditions that

should attach to any development approval (SPA section 287(1)(a)):

(b) The analysis detailed in 2(a) must be undertaken and presented at a minimum for the:

Pre Stage 2 levee condition;10, 20, 30, 40, 50 and 100 ARI design events; Design flood event (i.e. levee height as designed to withstand the 2012 flood level); and Overtopping scenario that will result in the largest impact on properties and people as a result of the levee being built (i.e. not necessarily the Probable Maximum Flood).

Note: Information is to be presented in a table supported by the model results showing the flood extent and afflux. Any benefits or disadvantages as a result of the levee, (e.g. flood preparation or evacuation), must also be documented.

3. Targeted consultation with the affected population must continue and they should be given an opportunity to provide feedback throughout the construction and commissioning of the levee.

(a) Targeted consultation must occur:i. Once the final design of the levee is completed

and before construction starts; andii. Through the commissioning phase.

AND

(b) Targeted consultation must include the provision of information in regards to:

i. the final levee alignment and design and how this may have changed from the conceptual design phase;

ii. any change in how flooding occurs in the area; iii. the refined risk assessment and the likely

impacts from the:o 10, 20, 30, 40, 50 and 100 ARI design events; o design flood event (i.e. levee height as

designed to withstand the 2012 flood level); and

o overtopping scenario that will result in the

v. the emergency management and evacuation plan implications for property and affected persons as a minimum the levee design height and the overtopping scenario.

Note: All targeted consultation and the key themes and issues raised by affected people must be documented and made available. How these themes and issues are addressed must also be documented and made available. This must include any submissions made as part of the public notification process for the development application.

4. In line with section 6.9 of the Guidelines, aAn assessment of the vulnerability and tolerability of the population at risk during flood events as a result of the Western Levee must be undertaken. The results of this assessment must be communicated to affected parties to allow them to respond to and plan for potential impacts.

Following detailed design and prior to levee commissioning

The Roma Flood Levee Operations and Maintenance Manual prepared by a Registered Professional Engineer of Queensland (RPEQ) must be updated to include the specifics of the Stage 3 (Western levee) and to clearly identify all operational and maintenance requirements and allocate corresponding responsibilities.

Upon completion of the works the subject of this approval and to be maintained at all times.

(a) recommends the following advice be provided to the assessment manager (SPA section 287(6)):

General advice1. DNRM recommends Maranoa Regional Council’s ‘Local Disaster Management Plan’

be amended once the final design of the levee and any refinements of the models are complete. Implementation and compliance with the procedures must take place in accordance with the requirements of the Queensland Local Disaster Management Guidelines (Disaster Management Act 2003).The ‘Disaster Management Response Plan’ should specifically deal with the affected people under the range of scenarios over the life of the levee, including the design flood event, overtopping scenarios and failure models in larger flood events. It is recommended that a copy of the amended ‘Disaster Management Response Plan’ be given to affected land owners and tenants.

DNRM – Land3. Ms McKenzie provided the following comments:

In relation to the diversion works, State Land is identifiedThere is currently a Recreation Reserve and an identified rubbish area (maybe contaminated land issues)There is a permit holder over the State Land.There is always the option for the permits to be cancelled.

DNRM Vegetation:5. Mr McAlister provided the following comments:

Provide a Map of Assessable Vegetation (PMAV) over the location of the development site. If the PMAV shows that assessable vegetation is being cleared, an assessment against Module 8 of the SDAP will be required.Mr McAllister acknowledged that the current state mapping may not be accurate of what actual vegetation is located on the ground.Provide a clearly defined analysis of vegetated area – this may require ground truthing.Provide an analysis of impacts to the watercourseIt was highlighted that the proposal may have the potential for vegetation offsets. This is considered unlikely, however the probability for vegetation offsets was discussed.

DILGP - Planning:

6. Mr Foley provided the following comments:The levee is categoried as a Category 3, which will be required to be referred to the State Assessment Referral Agency.It is a Development Permit for Operational Works - Impact Assessable.Mr Foley acknowledges that timeframes are keyMr Foley reiterated that SARA will try to avoid an information request – and that he was committed to keeping all lines of communication open.DILGP supports the 50% discount to fees, however the applicant will berequired to pay the full fee cost prior to receiving a refund.DILGP confirmed the total referral feed would be: :
