Question 1: Please confirm if Section H should be completed for the SF330 form for the Proposer and Sub-consultants. Section H was required in previous proposal submittals.

Answer 1: Per section IV.B.7, Section H is not required from the proposer and subconsultants.

Question 2: Do our subconsultant’s projects also require the following Information? • Visual materials (i.e., photographs, drawings, brochures). • Information indicating whether the services were completed on time and within

budget. • Project owner’s contact information, including name, title, phone number, and

email. • Recommendation letter from the owner of the project on the owner’s letterhead

and/or final performance evaluation for the project on the owner’s letterhead or official form

• Copy of the final performance evaluation for a City project, provided that the final performance evaluation for the project is available through PASSPort

• Project Reference Form included as Attachment 5. Answer 2: The information listed is not required from subconsultants.

Question 3: Is the Section F of the SF330 also limited to 5 projects, or can additional projects be included in the SF 330 following the identical five (5) experience projects as previously showcased in the proposal?

Question 4: Is the Section E of the SF330 limited to only those staff listed in the Attachment 4, including Project Executive, Resident Engineer, Assistant Resident Engineer, and Office Engineer? Are additional (max 2-page) resumes for other titles (i.e. Senior Inspector, Inspector, etc.) permitted in the proposal?

Answer 4: Resumes are required for Key Personnel only.

Question 5: Please clarify exactly which forms are required for our subconsultants in addition to the SF330 and Attachment 6 Workload Disclosure, if any.

Question 6: On page RFP-13, item 3 - Past Experience states: “Provide examples of up to five (5) projects, completed within the last ten years, which demonstrate the proposer’s ability to provide quality resident engineering inspection services for infrastructure construction projects. Infrastructure construction projects include the following: streets, highways, sewers, water mains, sidewalks, pedestrian ramps, street lighting and traffic signal work…” Question: can we include an introduction to this section? Or do you want this section to just be project descriptions?

Answer 6: Firms may include an introduction to this section. However, please make sure to provide items a – d as specified on RFP-13.

Question 7: Are Attachment 3 (Iran Divestment Act) and Doing Business Data Form required to be submitted by subconsultants?

Answer 7: No, Attachment 3 (Iran Divestment Act Compliance Rider for NYC Contractors) and Attachment 10 (Doing Business Data Form) are not required to be submitted by the subconsultants.

Question 8: As per RFP page 3, second paragraph, last line: "…located throughout the United States, …" Are we talking about the United States or NY state?

Answer 8: The United States of America.

Question 9: As per RFP page 3, last paragraph before the table, 4th line: "Is limited to firms in which the total number of full-time staff …" Does full time staff include administrative and clerical employees, etc... or specific group of employees?

Answer 9: Please refer to Question 1 & 2 in the issued Addendum 3 Q&A.

Question 10: On Attachment 5, column two asks for “Project Type” and directs to RFP Section IV(B)(3)(a). However, there is no subsection (a). There is, however, a description of “infrastructure projects” which includes “streets, highways, sewers, water mains, sidewalks, pedestrian ramps, street lighting and traffic signal work.” Should each project fall into only one of these categories? For example, there is no “plaza” type listed, but a plaza project may cover streets, sidewalks, and street lighting.

Answer 10: Please refer to Question 21 in the issued Addendum 3 Q&A. Please see the revised Attachment 5 attached to Addendum 3.

Question 11: Should our org chart show up in both the Organization Capacity section as well as in our SF330?

Answer 11: Please provide one org chart in the proposal submission.

Question 12: A normal SF330 includes a Section H, but there is no mention of the Section H for the SF330 in the RFP. Is Section H not required in our SF330?

Answer 12: Per section IV.B.7, Section H is not required from the proposer and subconsultants.

Question 13: Per the RFP, the Proposal Checklist (Attachment 1) shall be completed and submitted with the Technical Proposal package. However, the RFP does not specify which part of the Technical Proposal the Proposal Checklist should belong to. Is there a specific section that the Proposal Checklist should be placed?

Answer 13: Firms may place the Proposal Checklist after the proposal’s cover letter.

Question 14: Per the RFP, subconsultants providing engineering, surveying, or geology services must have a Certificate of Authorization. Do subconsultants also need to submit their Certificate of Authorization?

Answer 14: Subconsultants are not required to submit their Certification of Authorization at the time of proposal submission.

Question 15: Regarding the Current & Anticipated Workload Disclosure form (Attachment 6), do all contracts need to be included or just construction inspection / REI projects?

Answer 15: Please refer to Question 27 in the issued Addendum 3 Q&A.

Question 16: Are the ARE and OE positions included in Key Personnel? Answer 16: Per Attachment 4, the Key Personnel positions listed are Project Executive, Resident

Engineer, Assistant Resident Engineer, and Office Engineer.

Question 17: Can the ARE and OE positions be provided by subconsultants, or must they come from the prime consultant?

Answer 17: Per Section IV.B.4, key personnel must be employees of the proposer or its subconsultants, except 1) the Project Executive must be a principal, an officer, or employee of the proposer, and 2) Resident Engineer must be an employee of the proposer.

Question 18: On page 3 of the contract, under Article 4.4, non-complex projects will be awarded on rotational basis. In the case that the firm does not have staff available at the time, or for whatever reason the DDC decides to “skip” the firm, would the firm will get the next opportunity lined up? Or will they have to wait until their turn after all others receive the project?

Answer 18: If a firm cannot provide the required staff or cannot provide qualified staff, then the firm will lose their turn. The firm will need to wait until everyone else had their turn in the rotation. Per Article 4.4.2, a firm may lose their turn when DDC has determined that NTE capacity has reached 100% or that the consultant is unable to provide the services in a satisfactory and timely manner.

Question 19: This question is in reference to the subject RFP. Please refer to page RFP13, under 3. Past Experience and Performance of Firm & Subconsultants (if any), under Proposer, see (d) recommendation letter from the owner of the project on the owner’s letterhead and/or final performance evaluation for the project on the owner’s letterhead or official form. A consultant that wishes to respond to the RFP as proposer. For the case of a consultant company that has performed services for a DDC project as subconsultant to a prime consultant, which party does the agency identify as the owner of the project?

Answer 19: In the evet the proposer is including a project owned by a municipality, public authority, or other bodies of government to demonstrate its past experience and performance, it is not required to submit a recommendation letter for those projects.

Question 20: Can we utilize our non- M/WBE sub-consultants RE’s and OE’s as part of our team? Answer 20: Per Section IV.B.4, the position of Resident Engineer must be a principal, an officer, or

employee of the proposer. However, the position of Officer Engineer may be filled by either the subconsultant or prime consultant.

Question 21: Past Experience and Performance of Firm & Subconsultants: Provide examples of up to five (5) projects, can we the prime submit 3 projects along with 2 from our non- M/WBE subs to make the 5 projects?

Answer 21: The prime consultant is required to provide examples of up to five (5) projects, completed within the last ten years. The subconsultant must also submit up to five (5) projects independently from the prime subconsultant.

Question 22: The requirement to submit five recommendation letters or final evaluations has created a hardship on both proposers and DDC personnel. Can interim evaluations be accepted in lieu of final evaluations?

Answer 22: Yes. Please refer to Question 17 in the issued Addendum 3 Q&A.

Question 23: Please advise if Attachment 13 is to be signed by the Prime only and we list each subconsultant on the form.

Answer 23: Attachment 13 is to be signed by the Proposer only listing the Proposer’s information.

Question 26: If a firm over 30 employees proposed in the A category, if they were deemed non-responsive for their prime submission, how will subconsultant submissions be treated? If that firm decided to propose in the A category and appears as a subconsultant in any B or C proposals, how will those be treated? Will they not be allowed to be a subconsultant in category B because that was their true category if they were to have proposed as a prime consultant based on their real number of employees? Or will they be barred from participating in any contract related to this solicitation (A, B, C) because they were found non-responsive from proposing in the wrong category?

Answer 26: If a firm has more than 30 employees, they will be considered for the appropriate category by DDC. As stated in the RFP, a firm can be a subconsultant in any Category other than the Category in which they have proposed as Prime. Therefore, in the example given, if a firm is not selected in the appropriate Category, they would not be acceptable as a sub in that Category, but they could be a sub in other Categories.

Question 27: Per the RFP, “Upon written notification, the proposer must submit the Fee Proposal in a clearly labeled, sealed package within ten (10) business days of such notice.” In our previous experience, we have submitted the fee proposal along with the technical proposal. Should the Fee Proposal (Attachment 7) be submitted to NYCDDC when we submit the Technical Proposal or should we not submit the Fee Proposal at the time of proposal submission?

Answer 27: The firm must not submit a Fee Proposal (Attachment 7) at the time of technical proposal submission. Per the instructions on Attachment 7, if requested in writing by DDC, the proposer shall submit Attachment 7 as its Fee Proposal.

Question 28: It is estimated to take two months to obtain the New York State Department of Education Authorization for a newly formed JV firm. To meet the criteria on RFP-13, “Section 7210 of the New York State Education Law requires that all business entities providing professional engineering services in the State of New York obtain a “Certificate of Authorization to provide Engineering Services in New York State” from the New York State Education Department. Please note that no award will be made to any proposing firm unless the firm is authorized by the New York State Education Department to provide professional engineering services in the State. A copy of the Certificate of Authorization (COA) must be provided with the proposal submission and annexed as Attachment 13. Proposers that do not submit their COA at time of proposal submission may be found nonresponsive.” If each firm comprising a JV entity holds valid Certificates of Authorizations when the proposal submission is made, and the JV entity has applied for the Certificate of Authorization for the JV entity prior to the submission, would this be acceptable to DDC?

Answer 28: Yes. As per Section II.C (RFP-4), if the JV is not already formed, then the COA is required form each of the JV partners at the time of proposal submission. The COA must be included

as part of Attachment 13. JV firms that do not submit their COA at time of submission may be found non-responsive. The COA for the JV entity must be submitted prior to award.

Question 29: Since our firm is relatively new and has not completed many projects, can we provide example projects which demonstrate the (firm’s) principal’s ability to provide quality resident engineering inspection services? We will claim this as personal experience and note such on the projects as well as Section F of the SF330. All projects shown will be those where the principals (which are) “KEY” Personnel were active participants.

Answer 29: Please refer to Addendum 3, amending the requirement with respect to proposers’ reliance on projects completed by principal(s) or other employees of the proposers, while affiliated with another entity.

Question 30: Can a firm submitting in Category C be a subconsultant to another firm on Category A and/or B?

Answer 30: Yes.

Question 31: Attachment 9 (MWBE) – our firm is a MWBE firm so we just need to fill the Company’s info in Attachment 9 and submit with the RFP, correct?

Answer 31: The firm must complete Attachment 9 (Schedule B: M/WBE Participation Requirements) in its entirety. Firms may put “TBD” for section II when filling out the form.

Question 32: Attachment 11 (Subcontractor Reporting)-Do we have to do anything now? Do we have to register the subcontract now in PIP system?

Answer 32: Subcontractor information is not required to be entered into the City’s web-based system at this time. We do recommend the prime should register in the Payee Information Portal system.

Question 33: Attachment 12 (Displacement Determination Form) – Do we have to submit Attachment 12 with the RFP?

Answer 33: No, you do not have to submit Attachment 12 with the proposal.

Question 34: On page RFP-13 section 3 under "Proposer" - subsection d calls for a recommendation letter from the owner of the project on the owner's letterhead and/or final performance evaluation for the project on the owner’s letterhead or official form. Is this something that the DDC EIC would be expected to provide?

We are submitting 5 completed projects which are City agency projects, yet on some, the final evaluations are not available through PASSPort as of date, nor letters of recommendation from the project owner are available. How can we proceed?

Answer 38: Please refer to Question 17 in the issued Addendum 3 Q&A and revised RFP-13 attached to Addendum 3.

Question 39: Can we include more resumes in our proposal in addition to the key required personnel and will those resumes be counted towards the total evacuation score?

Answer 39: No. The additional resumes will not be counted towards the total evaluation score.

Question 43: For the titles that require a NYS PE license, will DDC accept pending status provided the NYS PE license is received by NTP.

Answer 43: A valid NYS PE license is required at the time of proposal submission and Task Order selection.

Question 44: Is it the intent of the project to issue more than one (1) task within the same time period or will they be issued sequentially?

Answer 44: The task order will be sequential.

Question 45: Is this a federal, state, or city funded project? Answer 45: City funded only.

Question 46: Our firm is submitting as a JV. Our internal paperwork has been completed but we are uncertain if we will receive the JV COA before the proposal due date (We understand we must have it if we want to be awarded a contract as a JV). If the COA is not finalized before the proposal due date, please advise as to the following:

b. Do we submit separate SF330’s?

b. Complete the SF330 together as a JV. Please make sure to check off the “J-V PARTNER” box on SF330 Section C when listing all participating firms if submitting as a JV.

c. The JV needs to provide examples of up to five projects. No more than five (5) projects will be accepted, regardless of whether the proposer is a single firm or a joint venture. In the event that a proposer attempts to submit more than five projects, only the first five projects will be evaluated, and the remaining projects will be discarded without evaluation.

Question 47: We need a clarification on staff size as it relates to affiliated companies. Certain Engineering companies are organized in multiple corporations (NY corporation, NJ corporation etc.) each having a separate Tax ID, however they are identical in ownership and management structure and share all resources/qualification etc. For example, a company ABC Consultants has 125 employees under NY corp. and 50 employees under NJ corporation. Together (all offices of the proposer), they exceed 150 employees limit and are not eligible for Category B. Are they allowed to exclude NJ corporation employees to meet the Category B size limit?

Answer 47: Please refer to Question 3 in the issued Addendum 3 Q&A.

Question 48: On page RFP-14, the following is stated: The proposer shall annex to Attachment 4 the resume of each individual identified in the Attachment for a title of Key Personnel. The resume of each individual shall be limited to a total of two (2) pages. The proposer and each subconsultant shall provide a response to Sections E and G of Standard Form 330. Does this mean include a max 2-pg resume in additional to Section E OR provide the max 2-pg resume in Section E format?

Answer 48: Please refer to Question 13 in the issued Addendum 3 Q&A.

Question 49: We are an MBE Engineering firm, and very eager to do business with NYC, we are ready to submit our proposal for the subject RFP, but we have not received the certificate of authorization from the New York State Education Department yet. We are a registered professional corporate in NJ and we are authorized to practice engineering there. Myself and my partner (Owners) are both licensed professional engineers in NYS. I was in touch today with the New York State Education Department and they stated that they can’t guarantee that we will have the certificate before 10/22/2019 which is the deadline for the proposal. Can the certificate of authorization be submitted at a later time after the proposal?

Answer 49: The Certificate of Authorization is required at the time of submission. As per Question 12 of the issued Addendum 3 Q&A, a COA application cannot be included in the proposal submission and will be considered non-responsive.

Question 50: Question 27 from Addendum 3 Q&A indicates Attachment 6 (Workload) should include contracts as a prime and for work type similar to REI/CM services. Please clarify – we are not to include projects for other work types (i.e., design) or projects which we are a subconsultant?

Answer 50: No, the Prime is not required to include projects for other work types or projects which they were a subconsultant.

Question 51: Please refer to page Revised RFP-13 (12/2/19) and subsequent answer provided for Question 25 of Addendum 3. Under 3. Past Experience and Performance of Firm & Subconsultants (if any), under Proposer, see “Provide examples of up to five (5) projects completed within the last ten years, which demonstrate the proposer’s ability to provide…”

For Type A companies, as defined in the RFP as Total Full-Time Staff: 1-30, this requirement limits the submission of representative ongoing DDC projects that are either delayed by third parties (utility companies) or extended due to post-bid additions.

Please consider the following:

1. This is a limitation that does not reflect on the competency of the consultant or on the control of the agency to complete the projects.

2. Type A companies are being required to submit completed projects under the same timeframe conditions that much larger companies with significant more staff and resources, Type B and Type C, are required to.

3. This limitation prevents the submission of ongoing large and complex DDC projects that allows DDC to evaluate the consultant through interim evaluations (if available; see Question 17 of Addendum 3).

For all the stated reasons, we ask that the agency consider the inclusion of representative ongoing DDC infrastructure projects for small (Type A) companies.

Answer 51: As per section IV.B.3 of the RFP, the example projects must be completed within the last ten years. Projects that are active, and thus are not yet completed, do not qualify.

SECTION II. SUMMARY OF THE REQUEST FOR PROPOSALS A. Background and Objectives

The New York City Department of Design and Construction (“DDC”), Division of Infrastructure, intends to enter into up to thirty-one (31) requirements contracts for resident engineering inspection (“REI”) services as described below. The selected engineering firms will be required to provide all services necessary and required for the inspection, management, coordination and administration of the project, from commencement through substantial completion, final acceptance, and project close-out. The projects for which services are required shall be specified by the Commissioner on a Task Order basis and may be located in any of the five Boroughs. Selection of a firm for a specific category shall be in accordance with the process prescribed in Section V.A. of this RFP. Up to three (3) categories of contracts are being solicited. The categories are based on the number of full-time staff employed by the proposers. Pursuant to this RFP, the term “staff” means all employees of the proposer, except those performing administrative or clerical duties, employed by the proposer in all offices located throughout the United States, at the time of proposal submission. Only the full-time staff employed by the proposer ad included on the proposer’s payroll (except those performing administrative or clerical duties) should be counted for the purposes of determining the category size. Employees of affiliate, parent, or subsidiary companies should not be counted. The estimated REI Staffing Amount determines to which category of contracts the Task Order will be assigned. The estimated REI Staffing Amount referenced below does NOT include the Multiplier for Overhead and Profit.

REI Services Requirements Contract A: DDC intends to enter into requirements contracts with up to

six (6) qualified engineering firms to provide REI services for various infrastructure construction projects with an estimated REI Staffing Amount of $1,000,000 or less per project. Submission of proposals for this contract is limited to firms in which the total number of full-time staff is between one (1) and thirty (30). Any proposal for this contract submitted by a proposer that has more than 30 full-time staff may be found non-responsive.

REI Services Requirements Contract B: DDC intends to enter into requirements contracts with up to

fifteen (15) qualified engineering firms to provide REI services for various infrastructure construction projects with an estimated REI Staffing Amount greater than $1,000,000 and less than $3,000,000 per project. Submission of proposals for this contract is limited to firms in which the total number of full-time staff is between thirty-one (31) and one hundred and fifty (150). Any proposal for this contract submitted by a proposer that has fewer than thirty-one (31) or more than one hundred and fifty (150) full-time staff may be found non-responsive.

REI Services Requirements Contract C: DDC intends to enter into requirements contracts with up to

ten (10) qualified engineering firms to provide REI services for various infrastructure construction projects with an estimated REI Staffing Amount of $3,000,000 or more per project. Submission of proposals for this contract is limited to firms in which the total number of full-time staff is greater than one hundred and fifty (150). Any proposal for this contract submitted by a proposer that has one hundred and fifty (150) full-time staff or fewer may be found non-responsive.

proposal must include a letter signed by an authorized representative of each member indicating a willingness to accept joint and several liability.

3. Past Experience and Performance of Firm & Subconsultants (if any)

Section 7210 of the New York State Education Law requires that all business entities providing professional engineering services in the State of New York obtain a “Certificate of Authorization to provide Engineering Services in New York State” from the New York State Education Department. Please note that no award will be made to any proposing firm unless the firm is authorized by the New York State Education Department to provide professional engineering services in the State. A copy of the Certificate of Authorization (COA) must be provided with the proposal submission and annexed as Attachment 13. Proposers that do not submit their COA at time of proposal submission may be found nonresponsive.

Certification of Authorization (COA) “Renewal in Progress” will be acceptable at time of proposal submission, but no award will be made without a valid renewed COA. COA “Renewal in Progress” is defined as a submission accepted by NYS for a renewed COA. Acceptable proof of “Renewal in Progress” will be a copy of the renewal application already submitted to the NYS along with a copy of the expired COA. The deadline to submit the renewed COA will be upon written notification from DDC. Please note, applications for a new COA will be considered non-responsive if they are included as part of the RFP submission package.

Subconsultant(s) providing Engineering, Surveying, or Geology services must have a Certificate of Authorization from the New York State Department of Education in accordance with Article 145 of the New York State Education Law.

Firms proposing as a joint venture may meet the project submission requirements collectively (i/e, a joint venture may rely on the experience of its other joint venture(s) in order to meet the minimum experience requirements, set forth in this RFP).

Proposer:

Provide examples of up to five (5) projects, completed within the last ten years, which demonstrate the proposer’s ability to provide quality resident engineering inspection services for infrastructure construction projects. Infrastructure construction projects include the following: streets, highways, sewers, water mains, sidewalks, pedestrian ramps, street lighting and traffic signal work.

In determining compliance with the experience requirement for the proposing firm set forth above, the City may consider prior projects completed by principal(s) or other employees of the proposing firm while affiliated with another entity, subject to the condition set forth below:

• Any principal or other employee on whose prior experience the proposer is relying to demonstrate compliance with this experience requirement must have held the following: (a) a significant management role in the prior entity with which he/she was affiliated, and (b) a significant management role in the entity submitting the proposal for a period of at least six (6) months, or from the inception of the proposing entity.

For each item designated above, the proposer shall provide the following: (a) visual materials (i.e., photographs, drawings, brochures), (b) information indicating whether the services were completed on time and within budget, (c) project owner’s contact information, including name, title, phone number, and email; and (d) recommendation letter from the owner of the project on the owner’s letterhead and/or final performance evaluation for the project on the owner’s letterhead or official form. In the event the proposer is including a project owned by a municipality, public authority, or other bodies of government to demonstrate its past experience and performance, it is not required to submit a recommendation letter for those projects. If the final performance evaluation for the City project is available through PASSPort, the proposer must submit a copy of the performance evaluation in the proposal. In the event a final performance evaluation for a City project is not available, the proposer should submit copies of any most recent interim performance evaluation available for that City project.

No more than five (5) projects will be accepted, regardless of whether the proposer is a single firm or a joint venture. In the event that a proposer attempts to submit more than five (5) projects, only the first five (5) projects will be evaluated and the remaining projects will be discarded without evaluation.
