IT IS RECOMMENDED THAT YOUR BOARD, ACTING AS THE GOVERNING BODY OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT:

1. Find that this contract work is categorically exempt from the provisions of the California Environmental Quality Act (CEQA).

2. Award the contract for AAs-Needed Flood Control Facilities Sweeping" to

Nationwide Environmental Services, a division of Joe’s Sweeping, Inc., located in Norwalk, California, to commence on the first Monday following Board approval, for a period of one year, with two 1-year renewal options not to exceed a total contract period of three years.

3. Delegate authority to the Director of Public Works to execute the contract

and to renew the contract for each one-year option, if, in the opinion of the Director, renewal is warranted, or, if necessary, to terminate the contract.

4. Authorize the contractor to proceed with the work in accordance with the

contract’s specifications, terms, conditions, and requirements.

5. Authorize Public Works to encumber an annual amount not to exceed $89,000, plus 15 percent for additional, unforeseen needs within the scope of this contract that may arise during the contract period. Funds are available in the 2003-04 Flood Control District Fund.

PURPOSE/JUSTIFICATION OF RECOMMENDED ACTION The purpose of this action is to award a contract to provide as-needed sweeping service at various flood control facilities throughout the County. The work to be accomplished will provide sweeping of streets and access roads leading in and out of the various flood control facilities which will reduce the amount of trash and dust on these streets and access roads. Implementation of Strategic Plan Goals This action is consistent with the County’s Strategic Plan Goals of Organizational Effectiveness and Children and Families’ Well-Being. This contract will improve internal operations through the utilization of this contractor’s expertise to effectively provide this service in a timely and responsive manner, as well as improve the quality of life in the County. FISCAL IMPACT/FINANCING This contract will be for an annual amount not to exceed $89,000, plus 15 percent for additional, unforeseen needs within the scope of this contract that may arise during the contract period. This amount is based on the contractor's proposed price to accomplish the work. This contract will commence the Monday following Board approval for a period of one year, with two 1-year renewal options not to exceed a total contract period of three years. We are also requesting the Board's authority for the Director to approve the optional years, if, in the Director's opinion, renewal is warranted. This contract may be canceled or terminated at any time by the Director without cause upon the giving of at least 30 days' written notice to the contractor. Funds are available in Public Works= 2003-04 Flood Control District Fund to cover the cost of this contract. Funds to finance the contract’s renewal years will be made available through Public Works’ annual budget process. There will be no impact on net County cost.

The Honorable Board of Supervisors November 13, 2003 Page 3 FACTS AND PROVISIONS/LEGAL REQUIREMENTS Prior to the Director executing this agreement which will be substantially reflected in Enclosure A, the contractor will execute and County Counsel will review it as to form. Public Works has evaluated and determined that the Living Wage Program (Los Angeles County Code Chapter 2.201) does not apply to this recommended contract which is for services required on an as-needed and intermittent basis. ENVIRONMENTAL DOCUMENTATION With respect to requirements of the CEQA, this contract work is categorically exempt as specified in Class 1(e) of the Environmental Document Reporting Procedures and Guidelines adopted by your Board on November 17, 1987, Synopsis 57. CONTRACTING PROCESS On August 5, 2003, Public Works solicited proposals from 76 independent contractors and general community business organizations to accomplish this work. A notice of proposal availability was placed on the County's bid website (Enclosure B) and an advertisement was placed in the Los Angeles Times. On September 10, 2003, four proposals were received. These proposals were first reviewed to ensure that they met the mandatory requirements outlined in the Request for Proposals (RFP). All proposals met these mandatory requirements and were then evaluated by an evaluation committee consisting of Public Works staff. The committee=s evaluation was based on criteria outlined in the RFP which included proposers' references, financial capabilities, staffing plan, equipment, and pricing. The evaluation committee rejected one proposal for failure to submit a staffing plan and equipment list, as well as submitting incomplete financial records. Based on this evaluation, Public Works is recommending that Nationwide Environmental Services, a division of Joe’s Sweeping, Inc., located in Norwalk, California, the highest-evaluated and lowest-cost proposer, be awarded this contract. The contractor is a certified Local Small Business Enterprise and received the preference in the evaluation. Enclosure C reflects the three proposers' minority participation. The contractor was selected upon final analysis and consideration without regard to race, creed, gender, or color.

The Honorable Board of Supervisors November 13, 2003 Page 4 The required Comprehensive General and Automobile Liability insurance certifications, naming the County as additional insured and evidence of Workers' Compensation insurance and performance security will be obtained from the contractor before any work commences. As requested by your Board, the contractor submitted a safety record which reflects that activities conducted by this firm in the past have met reasonable standards of safety. In accordance with the Chief Administrative Officer=s June 15, 2001, instructions, Public Works assures your Board that the contractor will not be required to perform services that exceed this contract=s approved amount, scope of work, and/or terms. IMPACT ON CURRENT SERVICES (OR PROJECTS) The award of this contract will not result in the displacement of any County employees. CONCLUSION One approved copy of this letter is requested.
