market, the business climate is as competitive as it has ever been. After a gradual uptick in the economy, we are seeing an increase in not just remodeling, but new construction of commercial pools and spas as well. This all leads to an increase in demand for qualified organizations to maintain healthy bathing environments in these vessels. Many of the newer planned communities have multiple pools and spas that are used or available to hundreds of residents. The care and oversight of these bodies of water can be quite a formidable task. The person or organizations that care for these has a great degree of responsibility. In Florida, the state rule 64E-9 is our guideline of the standards for the care and upkeep of these public bathing places. Most in the pool industry around the country recognize that the state of Florida is the nation’s leader when it comes to safe and healthy public pools.

Appr¬¬¬oximately 4 years ago, The FSPA board of directors allocated for the creation of the Florida Public Pool Specialist course. This course is designed to teach and educate the students on the proper methods and certify that they have the knowledge and understanding of the complex and leading edge technology of Florida’s public pools. The course is insightful and relevant to today’s market. While it includes most situations found in and around pool and spa environments, it focuses on Florida specific applications to pump systems, filtration, and almost any situation that one may come across in public pool maintenance. The manual, which is an awesome reference and a must for any service organization, is easy to follow and has everyday applications that can be used in problem solving and estimating. The FSPA, as the course provider, has tried to make sure that the class instructors are also current and up to date on industry situations, by requiring that all instructors be current State of Florida certified swimming pool contractors.

The 16 hour course is jam packed with formulas and techniques that expose the student to both pre-existing pools and spas from years gone by, to today’s high tech controllers, sanitizer generators, and UV disinfectant systems.

Throughout the manual, the state of Florida codes that apply to that particular section are identified in a highlighted box to emphasize the importance of that technique. The manual also identifies which jobs can be performed by a Florida Public Pool Specialist and which jobs can only be performed by a licensed contractor.

While there are other certifications that have merit and are beneficial, The FPPS is genuinely a course and certification specifically designed for the pool technician in Florida. The state office has been receiving requests by entire service companies that are interested in having instructors teach this course to their entire organizations. They have found that the information being provided to their staff has not only helped their technicians save time and increase knowledge, but by better understanding these systems and techniques, they are also saving money and improving their bottom lines.

For a short period of time, the course has been discounted to FSPA members. Contact Mary Anderson at the state office to see if there is a class being offered close to you, or better yet, contact your local chapter. Many chapters are holding classes periodically throughout the state.

Contracts over $2,500 need clause addedGovernor Rick Scott recently signed House Bill 535, which includes important

updates to sections 489.1401-143,F.S., permitting payments to injured residential consumers from the Florida Homeowners Recovery Fund for both Division I and Division II scopes of work.

Effective July 1, 2016, all licensed contractors, both Division I and Division II, must ensure that the Florida Homeowner Construction Recovery Fund Notice is contained in their residential contracts.

After years of work between the Department of Health (DOH), the pool and spa industry, and the Building Officials Association of Florida (BOAF), the long awaited revisions to Florida’s public pool rule, better known as 64E-9, went into effect July 20.

This all started back in 2012 when legislation passed removing DOH’s authority over construction. After the original proposed revisions were provided as a draft, the Florida Swimming Pool Association put a task force together to review and comment. The FSPA, among others, worked to try to push back on some of the changes, not only providing input to DOH, but also to the Joint Administrative Procedures Committee (JAPC) who reviews all rulemaking.

In addition to the rulemaking process, legislative fixes were put forward in the years to come to help make clarifications to the original legislation. Further, FSPA worked with the United Pool & Spa Association (UPSA) to officially put together what is now known as the Public Pool Coalition. This was a way to ensure all parties were talking to each other and working thru the concerns together – it includes FSPA, UPSA, DOH and BOAF. FSPA still hosts monthly calls of the coalition, which not only has been working on the rule revisions, but any legislative or regulatory issues affecting public pools.

Although the industry did not get everything they wanted, hammering out the many details has produced a final product all can be proud of; specifically, the fact that critical life safety issues are still able to be addressed via DOH biannual inspections.

Now the industry must work with all parties to ensure the transition to the new rule is smooth. County health departments, building departments and local industry professionals must work together to ensure they understand how the new rule works in conjunction with the code requirements found in the building code.

Recently the seven year mark has passed since the Virginia Graeme Baker (VGB) Act required all commercial pool and spa drains to have new VGB certified covers. Part of the law also required manufacturers to provide a life span for each cover and a fair majority were between 5-7 years. Therefore, FSPA encourages contractors who installed these drain covers to a) notify their customers if their drain cover is set to "expire" and b) replace the covers correctly.

This first means that a licensed pool contractor should be doing the work. The licensed contractor should choose the right cover, install it correctly, provide both the customer and any regulatory body (i.e. health department) with the documentation the cover was replaced and when the new cover is set to expire, and finally the contractor should keep a copy of this information on file. Part of choosing the correct cover will mean ensuring that it is tested and certified for the flow rate that the pump can produce on that particular pool or spa. Further, while changing out the cover, make sure all components of the drain are in good condition. It is also important that the contractor use the new screws that come with the new cover - do not use the old screws!

Remember, VGB compliance also requires the replacement cover be compatible with the currently installed mounting ring and/or sump, which may require replacement if it is damaged. For example, if the screw holes are stripped out. Finally, always follow the manufacturer's instructions for installation. However, it is important to be mindful that Florida Public Pool Rule 64E-9, F.A.C., requires a limit of 1.5fps through the openings, which is more restrictive than the VGB Act, so it may not be in the instructions.

This year’s FSPA High School Invitational Swimming & Diving Meet marks the 39th year of this great event. More than 1,000 athletes will make their way to Stuart to compete against teams from all over the state and against swimmers of all different levels. Often misunderstood or thought of as “snake-oil” technology, ultraviolet (UV) systems are a key contributor in some commercial and institutional markets. For smaller pools there has been considerable confusion on the various types, the different applications, and the positives and negatives of each type. UV systems will continue play an increased role, so here is a quick review to help you stay out of trouble.

There are three major types of UV systems that are NSF (National Sanitation Foundation) Certified for use in commercial pools.

• Low Pressure (LP) o Use fluorescent-style lamps from 75-100 Watts each. The lamps are

housed in PVC chambers and include a power supply. • Low Pressure (LP) – High Output Amalgam

o Also fluorescent-style lamps but burn hotter with higher outputs and create both ozone and UV simultaneously. The chambers normally come in both polished stainless steel (SS) and PVC, and one manufacturer uses a Schedule 80 PVC jacket with a polished SS inner sleeve to maximize output via a reflective surface.

• Medium Pressure (MP)o These use smaller but much more powerful lamps, from 1.0-3.5 kW

(1,000-3,500 Watts) each. The housings, more compact than the LP models, are made of SS, and are equipped with wiper systems (to continually clean the glass), direct output reading (inside the chamber). They are more expensive than LP.

Positives and Negatives of UV:UV units do several things very well: Inactivate Cryptosporidium (Crypto),

Legionella, Giardia, and other harmful organisms on a single pass, and significantly reduce Chloramines in pool and spa water. They do so by altering the cell or DNA structure, and not by blasting the organism through oxidation. So they DO NOT significantly oxidize pool water or produce a treatment residual, and they WILL NOT save significant amount of pool chlorination costs.

They also require continual maintenance. Annual maintenance for LP units would include checking, cleaning or replacing the glass (quartz) sleeves, and replacing lamps if burnt out or weak (typically last 8,000 hrs). MP units require more expert maintenance with replacement of wipers, internal seals and gaskets, lubrication of wiper system, along with checking and replacement of quartz sleeves and lamps.

NSF Certification versus Validation:Two different animals, the difference between NSF Certification and

“validation” can be confusing. All pool equipment must be NSF Std 50 certified, but there is a completely different validation to EPA guidelines that provides positive proof of a 99.9% Cryptosporidium (Crypto) Kill on a single pass. This is a very specialized and expensive test as live Crypto is introduced into a test tank, re-circulated and passed through the UV system at various flow rates. Kill rates and maximum flow rate are established for EACH model tested.

This can cost more than $30,000 for each model, so manufacturers have

been selective on how many to test and will adjust pricing to eventually recoup their costs. What is now even more confusing is that NSF has recently established validation services, so you must be careful to distinguish which NSF testing was actually completed.

As of this writing, only Medium Pressure UV units have passed validation, although several Low Pressure Amalgam units report being nearing completion.

Testing and Transmittance:Another gotcha for UV is establishing how many GPM’s the system will

treat. Transmittance is a term for the estimated clarity of the water the units are treating - as the clearer the water, the more effective the UV treatment. Pool water is about 95%, ultra-pure laboratory water is 99%, and sewage flow is as low as 70%. Some manufacturers incorrectly rate their units based on 99% transmittance, in essence exaggerating the UV rated flow capability by up to 30%. Then a pool contractor installs the unit, and it doesn’t work… go figure. There is a goal to standardize all NSF pool testing at 95%, but that program is still in progress.

Interactive Water Features (IWF) (a.k.a. Splashpads)The Florida DOH code requires that all IWF’s utilize a UV unit that has been

validated to the flow of the feature pump, or you can install full flow filtration on the feature loop. Since full flow filtration is not rated to remove crypto and might require more maintenance than IWF’s normally receive, many owners opt for the UV option, albeit more expensive. Therefore you will need to provide a system (and testing certification) that is validated to handle the permitted feature flow.

DOH language resolved:Previously one could install a UV system as supplemental treatment

for chloramines and safety. Many DOH departments interpret the existing code language to require validated units – which is not the case and not the intent. Recently the Florida Public Pool Coalition was instrumental in revising code language to allow the use of NSF certified (not validated) UV units as supplemental treatment on pools, spas, etc. while IWF will still require validated units. Until this language is adopted by the building code, one must seek a

DOH variance before installing.

Permits:As a quick reminder, installation of UV constitutes a modification and requires

both DOH engineering and building permits. This is often overlooked, placing the contractor and owner in harms way.

In conclusion, while UV installations are simple enough, there are enough potholes in the road to make you quote and install with caution. Also until testing is standardized, you must make sure your unit is properly sized (with 95% transmittance) and until the DOH language is adopted by the building code, you must seek a variance. The best advice is for the pool professional to err on the side of caution.

Overtime threshold doubling The Department of Labor is finalizing a rule to update overtime protections.

The final rule, which takes effect on December 1, 2016, doubles the salary threshold - from $23,660 to $47,476 per year - under which most salaried workers are guaranteed overtime (hourly workers are generally guaranteed overtime pay regardless of their earnings level). Additionally, this new level will be automatically updated every three years to ensure that workers continue to earn the pay they deserve.

FSPA is working on additional information to share with members and plans are in place to offer a continuing education course at the February trade show on this topic.

Close your eyes and imagine a pool service person. What do you see? Your image likely includes a scruffy looking individual in old shorts, a t-shirt and flip-flops. You have probably caught a glimpse of this service person in the backyard as he or she nets the leaves from the pool and all is well as long as the swimming pool remains sparkly blue.

What you don’t know is the depth of knowledge this individual has about water chemistry or the proper installation and maintenance of swimming pool equipment. These are important details to consider. How can we ensure that all swimming pool service people possess the knowledge and skills required to maintain the health and safety of swimmers as well as the integrity of the structure and equipment in our pools?

It is time to bring the professional back to the pool service profession. It is our responsibility to train service technicians properly. Provide support and feedback to your technicians to ensure the work remains high quality. Show your customers and employees that you value professionalism by providing a work uniform or instating an employee dress code. More importantly, network with others in our industry. Encourage other swimming pool companies to join the FSPA to affect positive change in the service sector and beyond. Be a resource for service people, and let them be a resource for you. Call on licensed service companies for consultations to ensure the fidelity of your own equipment installers and “fire-up” personnel. Report companies and individuals who operate without a license to the DBPR if one is required for the work they are doing. These folks are destroying the work of builders and voiding manufacturer warranties every time they work on a swimming pool.

As members of the Florida Swimming Pool Association, we set the bar for swimming pool professionals. Let’s work together to spread the word that service is an integral part of our industry. Let’s encourage more licensed service professionals to become members of the FSPA and join us in our endeavor to provide quality work and ensure safety. Let’s work together to make that scruffy pool dude a thing of the past.

Heat is the number one weather-related killer in the United States, resulting in more fatalities each year than floods, lightning, tornadoes and hurricanes combined. In the heat wave of 1980, 1,250 people died. In 1995, heat claimed more than 700 lives in Chicago alone, making this the deadliest weather event in Chicago’s history.

The National Weather Service sends out notifications relating to extreme heat as conditions warrant. These may include Extreme Heat outlooks, Watches and Warnings or advisories as concerns for extreme heat are favorable, expected or if conditions exist.

The Heat index is a measure of how hot it really feels when relative humidity is factored in with the actual

air temperature. To find the Heat Index temperature, look at the Heat Index chart below. As an example, if the air temperature is 96°F and the relative humidity is 65%, the heat index ––how hot it feels––is 121°F.

The National Weather Service initiates alert procedures when the Heat index is expected to exceed 105°-110°f (depending on local climate) for at least 2 consecutive days.

Workers who are exposed to extreme heat or work in hot environments may be at risk of heat stress. Exposure to extreme heat can result in occupational illnesses and/or injuries.

Heat stress can result in heat stroke, heat exhaustion, heat cramps, or heat rashes. Heat can also increase the risk of injuries in workers as it may result in sweaty palms, fogged-up safety glasses, and dizziness.

Workers at risk of heat stress include outdoor workers and workers in hot environments such as construction workers, factory workers, firefighters, bakery workers, farmers, miners, boiler room workers, plus many others. Workers at greater risk of heat stress include those who are 65 years of age or older, are overweight, have heart disease or high blood pressure, or take medications that may be affected by extreme heat.

As reported previously, the Florida Supreme Court came out with rulings on April 28 and June 9 that, in essence, has unraveled the workers’ compensation system as we have known it since the 2003 reforms. On July 1, the National Council on Compensation Insurance (NCCI) submitted an amended rate increase request to the Office of Insurance Regulation (OIR) – NCCI is now suggesting a 19.6% increase (originally, after the April decision, it was 17.1%).

On August 16, at 9:00 a.m. in Room 401 of the Senate Office Building in Tallahasee, OIR will hold a Public Rate Hearing to determine what the actual rate increase will be and when it will go into effect.

Does your company have a specific driver policy that you review with newly hired employees as well as with all employees annually? If not, you are missing out on one of best risk management tools available to you.

Having an official, written driver policy shows both your employees and your insurer that you take the issue very seriously. Rightly so, considering the fact that you are entrusting an employee with a multi-ton moving object with your name on it.

Most importantly, it can help reduce claims and keep safety on the minds of your drivers. In this day and time, any risk management strategies that you can put into place will go a long way in controlling claims and, therefore, premiums.

The daily exposure to catastrophic claim is probably higher in the operations of your vehicles than in any other scope of your business. That is because it is constant, because auto accidents are occurring at a much more frequent rate these days, and because the dollar value of settlements is increasing.

Florida is busy again and growing again. Those two facts combined with the fact that your drivers are out on the road with many distractions, making important decisions independently, makes Florida roads more dangerous and leads to more accidents every day.

Outlined below are criteria of a good driver policy that can be used as the framework for your company’s driver policy. Please tailor it for your company’s needs. You should also review it with your attorney for their legal opinion as well.

Here are some thoughts for the agreement…

• Company vehicle will be used only for company business and never for personal use unless specifically authorized. If personal use of the vehicle is specifically authorized, only the employee will drive the vehicle.

• Emphasize defensive driving techniques and emphasize the driver take reasonable care in the operation of the company vehicle.

• Only company employees or other persons being transported for business purposes will be allowed as passengers and only previously approved company personnel are allowed to drive any company vehicle.

• No consumption of alcoholic beverages or other drugs is allowed prior to or while operating a company vehicle. Nor is operating a vehicle while under the influence of alcohol or other drugs. Nor is anyone else allowed to operate the vehicle under these conditions. No open container (alcohol) is ever allowed by driver or any passenger of a company vehicle.

• All traffic laws, ordinances, and regulations pertaining to the operation of motor vehicles will be obeyed at all times. The driver will pay any fines, parking tickets, or other assessments for violations of traffic laws, ordinances, or regulations imposed when they are the responsibility of the driver.

• Driver will wear a seat belt at all times and will require all passengers to do so as well.

• Prior to driving the vehicle, a safety check will be performed. This will include checking tires, lights, wipers, horn, turn signals, rear view mirrors, and brakes to be sure they appear to be in safe operating condition. If defects are noted, the driver will immediately report deficiencies to a supervisor or manager.

• In the event of an accident, the company automobile accident reporting procedures will all be adhered to.

• Driver should understand that if they are involved in an at fault accident with a company vehicle they will be required to attend a remedial driving school or attend a defensive driving course at their expense.

OSHA penalties increasing August 1 On November 2, 2015, Congress passed the Bipartisan Budget Act of

2015. That Act requires federal agencies, including OSHA, to adjust their civil money penalties based on inflation. Congress directed that the updated penalty amounts apply to all penalties proposed or assessed after August 1, 2016. Current penalty levels have been the same since 1990.

The Chapter kicked off their Independence Day celebration with a night at the ballpark on Sunday, July 3, at Bright House Field in Clearwater. We had more than 100 participants, including our pool professionals, their families and friends, enjoy an all-you-care-to-eat buffet, the baseball game, and an outstanding post-game fireworks show! Rep. Chris Latvala threw out an opening pitch. Thank you to everyone who came out to join us for an evening of food, fun and fireworks!

The Chapter Board met on Tuesday, July 5 at Queen’s Pizza in Clearwater. Thank you to Linda Bice and Gorman Company Clearwater for sponsoring the lunch. The Chapter meeting on August 9 will offer continuing education (2 CE hours). The program will be given by CES on oxidation reduction potential. This class will be held at Commercial Energy Specialists (CES).

The Chapter meeting on October 10 will be on green technologies. The Palm Beach Pool Show is scheduled for September 7 and the Chapter

Christmas Party is scheduled for December 10.Membership and Board meetings are held at Contractors Business Park,

2701 Vista Pkwy., Bldg. A, Ste. 9, on the second Tuesday of each month. You will be notified in advance if there is any deviance from this schedule. All are welcome to attend and participate in the discussions. Members may also complete a short survey posted on the Chapter home page at www.fspa-pb.com.

The Chapter annually participates in water safety programs, in particular for local children in need of learning to swim and for special needs children. The Chapter is seeking help from our members in providing these swim lessons through a matching grant program. Each $100 received will be matched. Please help us with your generous donations. Contact the Chapter office for additional information. If each member gives a small donation the Chapter can help many children learn to swim and potentially save many lives.

Mark your Calendar for September 7, 2016. The Palm Beach Pool Show is returning to the Marriott on Okeechobee Blvd., West Palm Beach. The show will be larger this year and include new features. Exhibitor registration is now accepted online at www.fspa-pb.com or by contacting the Chapter office. Thank you to all pre-registered exhibitors and for your auction donations.

On September 7 you can attend four hours of CILB approved continuing education classes. Here’s your chance to get a jump-start on the required 14 hours. Not a contractor? Not necessary! Register for classes and pick up on the skills needed to be a successful business owner or employee. FSPA members and employees may pre-register and attend for free. Non members may attend for $20 per class. Further information can be found on the Chapter home page.

The annual auction has us all spinning in excitement. Non pool-related items will be auctioned off with a new format for placing bids. Items such as cruises, movie tickets, gift baskets, golf and more will be available. Our priority goal is to make the event fun and rewarding for the many exhibitors and

The chapter had a luncheon meeting with the City of Tampa building inspectors. Bob Bass, Chief Construction Inspector, Gary Ferrell, Standard Plumbing Inspector and Gary Snodgrass, Standard Electrical Inspector came out and spoke and answered questions from attendees. Thanks to all for coming out.

The Chapter was represented at two locations, Brandon Aquatic & Sports Complex and Copeland Pool for The World’s Largest Swimming Lesson.
