come down to an intent fight, prior to equitable hearing, 5 years prior, formed called d/c ever since onis when, prove intent, could be action, 5 yrs prior , docs were supposed to be trust, where are you records to prove that, when did it come into your mind , trust only forms, my original intent, 5 yrs prior, NOW question, do you have docs to prove you had the intent back then could argue FRAUD, 3 months before hearing, that was the intent, you win, if word documents back, have o give you back the original signed documents, you asked FOR THE DOCS BACK, prove THAT trust is current, if court orders docs given back, THEN where is there d/c relationship with out the docs, IF INTENT was post orig of form the trust, declaratory determination of the trust have to do the performance, of suffer contempt for not returning the documents.
