Enhanced Specification for Site Cleanliness and Tidiness

For the purpose of better cost-effectiveness in utilization of public funds in public works projects, a rational approach based on the specific needs of individual projects is introduced for adopting the enhanced specification for site cleanliness and tidiness specified by DEVB TC(W) No. 8/2010. In addition, under the circular, a certain percentage of the contract sum shall be allowed for Site Cleanliness and Tidiness depending on the scale of the contract. 4. Paragraph 8 of DEVB TC(W) No. 8/2010 is to be replaced by the following:

“8. For the purpose of better cost-effectiveness in utilization of public funds in public works projects, a rational approach based on the specific needs of individual projects to enhance the site cleanliness and tidiness is adopted. Subject to the approval of a D2 officer, works departments may adopt the enhanced specifications for site cleanliness and tidiness provided in this Circular if it is considered that the cleanliness and tidiness in the proximity of the Site may cause undue nuisance and impact to the public and thus arouse public interest, or there are other specific circumstances of the Sites. Upon the above approval, the Special Conditions of Contract, Particular Specification and Method of Measurement at Appendices A to C respectively, and the Bills of Quantities modelled on the sample at Appendix D(a) for works contracts and the Schedule of Rates modelled on the sample at Appendix D(b) for term contracts shall be incorporated into all such public works contracts including Building, Civil, E&M, Term and Design and Build contracts, tenders of which are invited on or after 15 June 2017. Tenderers’ attention should also be drawn to the requirements by means of the Notes to Tenderers at Appendix E.”

5. Paragraph 20 of DEVB TC(W) No. 8/2010 is to be replaced by the following:

“20. To encourage Contractors to carry out the cleaning and tidying work with due diligence, the rates for the items of Daily Cleaning and Weekly Tidying in the Bills of Quantities for contracts other than term contracts shall be pre-priced. The rates shall be estimated by the project officer taking into account the nature of works and extent of the Public Cleaning Areas of the Section of Works subject to a minimum of $1,000 per day and a maximum of $3,000 per day for each BQ item for payment of site cleanliness/tidiness pursuant to paragraph 11 above, with the total amount of all such BQ items not exceeding 2% of the estimated Contract Sum3.

3 Excluding the Contingency Sum and any sum allowed for fluctuations. For Design and Build contracts,

approximately 5% of the estimated Contract Sum should be considered as “design” fee and excluded.

Subject to the agreement of the directorate officer responsible, the cap of the total amount of 2% of the estimated Contract Sum could be increased for those contracts involve substantial cleaning/tidying works and with a relatively small estimated Contract Sum. Details of the calculation in deriving the rates is at the Sample Bills of Quantities for Works Contracts (Other than Term Contracts) for Payment of Site Cleanliness and Tidiness at Appendix D(a). For Term Contracts, the current practice of applying Schedule of Rates for Daily Cleaning and Weekly Tidying shall continue.”

6. Accordingly, Appendix D of DEVB TC(W) No. 8/2010 is to be replaced by the revised Appendix D attached herewith. Effective Date 7. This Circular takes effect on all tenders to be invited after 15 June 2017. Effects on Existing Circulars 8. This Circular shall be read in conjunction with DEVB TC(W) No. 8/2010. Enquiries 9. Works of various natures will have different level of cleaning/tidying requirements. For instance, the cleaning/tidying requirements for a works site involving mainly underground works will be low; whilst the same for a works site involving mainly earthworks will be high. The number of workers required for cleaning/tidying depends on the extent of the Public Cleaning Areas. For instance, the manpower required for a remote site with limited accessibility by the public, or a site with three sides bounded by vegetated slopes, will be on the low side. In general, a site with large Public Cleaning Areas will require more manpower to maintain its cleanliness and tidiness. The aforesaid factors shall in turn determine the rates of Items A and B. Project officer shall determine the appropriate rates to suit the actual site works nature with due consideration of the manpower required for cleaning/tidying of the Public Cleaning Areas. Subject to the agreement of the directorate officer responsible, the cap of the total amount of 2% of the estimated contract sum could be increased for those contracts involve substantial cleaning/tidying works and with a relatively small estimated Contract Sum.

Development Bureau Technical Circular (Works) No. 8/2010

Enhanced Specification for Site Cleanliness and Tidiness

Scope This Circular promulgates an enhanced specification on cleanliness and tidiness of public works sites. For the purpose of this Circular, cleanliness hereafter means both cleanliness and tidiness. Effective Date 2. The Circular is applicable to all public works contracts including Buildings, Civil, E&M, Term and Design and Build contracts, tenders of which are invited on or after 1 January 2011. Effect on Existing Circulars 3. This Circular supersedes WBTC No. 6/2002 and ETWB TCW No. 6/2002A. It should be read in conjunction with ETWB TCW No. 22/2003, 22/2003A and 19/2005. Background 4. Clause 38 of the General Conditions of Contract requires Contractors to keep the sites clean and hygienic, and the Contractors’ obligation on site cleanliness is

specified in Clause 1.32 and Clause 1.60 of the General Specification for Civil Engineering Works and the General Specification for Buildings respectively (hereafter collectively referred to as “General Specification”). 5. To enhance cleanliness requirements on construction sites over that stated in the General Specification, the then Works Bureau and Environment, Transport and Works Bureau have introduced via the promulgation of WBTC No. 6/2002 and ETWB TCW No. 6/2002A respectively a wider scope of responsibilities on public works Contractors on site cleanliness to, among others, include cleaning of areas with public interface. Contractors are required to carry out daily and weekly overall cleaning and tidying up of the Sites (hereafter respectively referred to as “Daily Cleaning” and “Weekly Tidying”), including those public areas and/or zones where no works except cleaning are to be carried out by Contractors and which have to be maintained open to the general public throughout the construction period. To suit the site condition, the actual public cleaning areas and/or zones required to be cleaned by the Contractor shall be determined by the Architect/Engineer/Maintenance Surveyor’s Representative for each work location of the Site. For the purpose of this Circular, such public areas and/or zones are hereafter referred to as “Public Cleaning Areas”. 6. Whilst the above requirements are to be maintained, further enhancement has been set out in this Circular to, inter alia, introduce pre-pricing of items for Daily Cleaning and Weekly Tidying in the Bills of Quantities for works contracts at an appropriate level so as to encourage Contractors to carry out the cleaning and tidying work with due diligence, assign a person of specified level to inspect the Site to ensure cleanliness and strengthen the administrative measures to monitor Contractor’s performance when deficiencies are identified. 7. In this Technical Circular, “Site”, “Contract”, “Contractor”, “Drawings”, “General Holidays” and “Works Order” carry the same meaning as that defined in the General Conditions of Contract for Buildings, Civil, E&M, Term and Design and Build contracts. The definition of “Site” also includes “Public Cleaning Areas” as described in paragraph 5 above. “Cleaning Day” means a day (which is not a General Holiday) for carrying out the Daily Cleaning of the Site in accordance with the Conditions of Contract. “Cleaning Week Day” means a day (which is not a General Holiday) in a week to be agreed by the Architect/Engineer/Maintenance Surveyor’ Representative within seven days of the Date for Commencement of the Works for carrying out the Weekly Tidying work of the Site in accordance with the Conditions of Contract. If the agreed day is a General Holiday, then the agreed day shall be the following day which is not a General Holiday. Policy 8. The Special Conditions of Contract, Particular Specification and Method of Measurement at Appendices A to C respectively, and the Bills of Quantities modelled on the sample at Appendix D(a) for works contracts and the Schedule of Rates

modelled on the sample at Appendix D(b) for term contracts shall be incorporated into all public works contracts including Building, Civil, E&M, Term and Design and Build contracts, tenders of which are invited on or after 1 January 2011. Tenderers’ attention should also be drawn to the requirements by means of the Notes to Tenderers at Appendix E. Guidelines 9. The item on site cleanliness for works contracts that are BQ based are to be marked “Quantity Provisional” to cater for Contractors over-running the time for completion of Contracts. Payment will continue to be made (if justified) throughout the construction period even if the Contractor is in culpable delay. The purpose of continuing the payment is to ensure that the Contractor shall continue the cleaning and tidying up of the Site irrespective of the work progress. The Architect/Engineer/Maintenance Surveyor shall, at his/her absolute discretion, instruct the cleaning and tidying up work to cease if he/she considers that the continuance of the cleaning and tidying up work serves no useful purpose for the Contract, or where there is more than one contract being carried out on the Site or Portions of the Site. This will not constitute a variation for the purpose of Clause 60 of the General Conditions of Contract. 10. The Contractor shall draw up in the Waste Management Plan/ Environmental Management Plan where appropriate the system of work on waste management, environmental management, cleanliness and tidiness of the Site including, but not limited to, the methods and provisions including the proposed areas for on-site sorting, separation, storage and disposal of waste materials, and the proposal of how to maintain the Site in clean and tidy condition. The Contractor shall provide the necessary facilities, receptacles and transport for the temporary storage, disposal and removal of different types of wastes. To assist in ensuring the overall cleanliness, the Contractor shall assign a person at supervisory level1 or higher to inspect the Site after the Daily Cleaning and Weekly Tidying work, except the Weekly Tidying work for contracts other than term contracts which are to be inspected by the Environmental Officer/ Assigned Person2. 11. If sectional completion is envisaged for a works contract, then separate BQ items shall be provided for cleaning and tidying up of each portion of the Site. Otherwise, variation may be necessary for cleaning and tidying up of different portions of the Site for sectional completion which is not envisaged at the time of preparing the tender documents. For the avoidance of doubt, there should be no separate BQ items for section which occupies the same portion of the Site. If the Contract is one subjected to payment for price fluctuation, then the item for payment of site cleanliness is also subjected to the same.

12. The Particular Specification at Appendix B specified the requirements for cleaning and tidying up of the Site including the Public Cleaning Areas pursuant to paragraph 5 above. Project officers may modify the Particular Specification to suit the special condition of the Site. 13. For Contracts where the area for the Works is defined, i.e. with fixed site boundary, the extent of Public Cleaning Areas to be included for daily and weekly overall cleaning and tidying up of the Site by the Contractor should be delineated in the Drawings. Whereas for Contracts where the area for the Works moved along with the progress of Works, such as road works, drainage works and mains laying, or where it is not practical to delineate the area for the Works in the Drawings, a statement should be given in the Particular Specification on the Public Cleaning Areas, e.g. the distance (preferably not less than 2.5m) around the periphery outside the barriers and/or hoardings. For the latter situation, the Architect/Engineer/Maintenance Surveyor’s Representative shall determine the Public Cleaning Areas on site for each work location based on the requirements in the Particular Specification and taken into account the actual site condition before work commenced. 14. The Architect/Engineer/Maintenance Surveyor’s Representative shall instruct the Contractor to clean and tidy up areas not within the Site if the rubbish and debris to his/her judgment, are likely in connection with the Works or disposal of by the persons working on the Site, and the Contractor shall not be entitled to claim for any additional cost due to such cleaning and tidying up work performed outside the Site boundary. Payment 15. Separate items for payment on site cleanliness are stipulated in the Bills of Quantities or Schedules of Rates to prevent Contractors from evading their general obligation. Contractors shall be required to maintain records on site cleanliness including, but not limited to, daily and weekly inspection checklists and photos taken at various work locations to be agreed by the Architect/Engineer/ Maintenance Surveyor’s Representative for monitoring of site cleanliness condition. 16. Payment can be made upon the satisfactory performance of the Contractor on site cleanliness in accordance with the Particular Specification, based on the inspection checklists and photos taken pursuant to paragraph 15 above. The Architect/Engineer/Maintenance Surveyor’s Representative may conduct regular inspections and surprise checks to verify the Contractor’s performance on site cleanliness in certifying payment. No measurement or payment shall be made to the Contactor if the Architect/Engineer/Maintenance Surveyor’s Representative is dissatisfied with the Contractor’s performance on the cleanliness of the Site on the day (which is not a General Holiday) following the Cleaning Day or Cleaning Week Day. The Contractor should be notified as soon as possible if he is not paid for a Cleaning Day or Cleaning Week Day, and the non-payment should be recorded in writing or the Site Diary as appropriate together with the areas of dissatisfaction. Furthermore, the Architect/Engineer/Maintenance Surveyor’s Representative may have to step up his/her inspection frequency for checking the cleanliness condition of the Site in certifying payment.

17. The unit of measurements on site cleanliness for works contracts (other than term contracts) shall be in “day”. Payment shall be made for every Cleaning Day or Cleaning Week Day in accordance with the Particular Specification. The Contractor shall assign person(s) to carry out inspection and checking of the Site after completion of site cleanliness works on each Cleaning Day and Cleaning Week Day, and to complete the inspection checklist and prepare the photographs pursuant to paragraph 15 above for submission to the Architect/Engineer’s Representative for checking and recording in the morning of the day (which is not a General Holiday) following the Cleaning Day or Cleaning Week Day. 18. The measurement on site cleanliness for term contracts shall be in m2-day, which is the measurement of the Public Cleaning Areas required for cleaning by the Contractor for each Works Order in one day. The extent of such Public Cleaning Areas shall be determined by the Engineer/Maintenance Surveyor’s Representative in each Works Order issued. All the requirements, arrangement and payment on site cleanliness for term contracts are similar to those for work contracts mentioned in paragraph 15 to 17 above. To ensure proper execution of the cleaning and tidying up works for term contracts, the measurement or payment of the Schedule of Rates on site cleanliness for each Works Order requiring cleaning of Public Cleaning Areas shall be either full or nil. No partial measurement or payment shall be made for a Works Order for a day if the Engineer/Maintenance Surveyor’s Representative is dissatisfied with the Contractor’s performance on site cleanliness for any part of the Site of the Works Order on the day (which is not a General Holiday) following the Cleaning Day or Cleaning Week Day. 19. To avoid disputes on the site cleanliness condition, the Contractor shall be required every morning before work commenced to inspect and remove any rubbish and debris that may be littered by the public over the night before the inspection by the Architect/Engineer/Maintenance Surveyor’s representative. Furthermore, the Contractor shall not be entitled to measurement or payment of more than one day for the cleaning and tidying up work carried out by him for one day. The Architect/Engineer/Maintenance Surveyor’s Representative is advised to brief the Contractor on the Public Cleaning Areas required for cleaning, cleaning requirements, payment criteria and the warning mechanism for each work location or Works Order issued. To this effect, the Clauses given in Appendix A should be added in the Special Conditions of Contract to draw the attention of Contractors. 20. To encourage Contractors to carry out the cleaning and tidying work with due diligence, the rates for the items of Daily Cleaning and Weekly Tidying in the Bills of Quantities for contracts other than term contracts shall be pre-priced. The rates are based on a sum of 1 to 2% of the estimated contract sum of the Section of Works divided by the total number of Cleaning Days and Cleaning Week Days in the contract period for completion of that Section subject to a minimum of $1,000 per day for each item. Details of the calculation in deriving the rates is at the Sample Bills of Quantities for Works Contracts (Other than Term Contracts) for Payment of Site Cleanliness and Tidiness at Appendix D(a). For Term Contracts, the current practice of applying Schedule of Rates for Daily Cleaning and Weekly Tidying shall continue.

Performance Monitoring 21. The Architect/Engineer/Maintenance Surveyor shall maintain a record of payment and non-payment to Contractor on site cleanliness for a Contract. A Contractor who fails to perform satisfactorily on his duties of Daily Cleaning and Weekly Tidying as specified in the contract with non-payment for (i) two consecutive Cleaning Days or Cleaning Week Days, OR (ii) more than two Cleaning Days or Cleaning Week Days in any rolling five Cleaning Days or Cleaning Week Days can result in a verbal warning which shall be recorded in writing. If performance is not improved, a written warning will be issued which will result in “Poor” rating in the item for “Cleanliness of Site” in the report on Contractor’s performance. If the performance is still not improved, the Architect/Engineer/Maintenance Surveyor may, at his sole discretion, issue further verbal warning which shall be recorded in writing or issue further written warning which will result in “Very Poor” rating in the item for “Cleanliness of Site” in the report on Contractor’s performance. Following the issuance of written warning, a D1 officer or above of the project department shall interview the Contractor for immediate improvements. 22. The Departmental Safety and Environmental Advisor is required to carry out independent spot checking with a view to upholding the site cleanliness at a good standard.

Appendix A(a) - Special Conditions of Contract (Applicable to works contracts other than term contracts) SCC 1 (1) “Public Cleaning Areas” means those public areas

of the Site where no work is to be carried out other than cleaning by the Contractor and which have to be maintained open to the general public throughout the progress of the Works, the extent of which is specified in para. 1(a) of the Particular Specification Clause No. [ ]. (6) From the date for commencement of the Works to the date for completion of the Works, or the relevant Section, as the case may be, the Contractor shall, unless otherwise instructed by the *Architect / Engineer (except on a General Holiday) carry out either Daily Cleaning or Weekly Tidying. The time for commencing Weekly Tidying and the day of every week for the Cleaning Week Day shall be agreed with the *Architect / Engineer’s Representative within seven days after the date for commencement of the Works. If a day on which the Weekly Tidying is scheduled falls on a General Holiday, then it shall be carried out on the day following which is not a General Holiday.

(10) The Contractor shall not be entitled to any payment for Daily Cleaning or Weekly Tidying carried out if in the opinion of the *Architect / Engineer, such work has not been satisfactorily performed on the relevant working day.

Appendix B(a) - Particular Specification for Daily Cleaning and Weekly Tidying (Applicable to works contracts other than term contracts) [1] Site Cleanliness and Tidiness – Daily Cleaning and Weekly Tidying

(a) The Contractor shall perform Daily Cleaning and Weekly Tidying of the

Site including Public Cleaning Areas. The extent of the Public Cleaning Areas required for cleaning are delineated in the Drawing No. _______ / deemed to be within ___ metres [preferably not less than 2.5m] on the periphery outside the barriers or hoardings, or determined by the *Architect/Engineer’s Representative on site for each work location based on the requirements in the Particular Specification, and taking into account the actual site condition before work commences.

(b) The Contractor shall draw up, in the *Waste Management Plan/

Environmental Management Plan where appropriate, a system on waste management, and maintenance of cleanliness and tidiness of the Site including, but not limited to, the methods and provisions including the proposed areas for on-site sorting, separation, storage and disposal of waste materials, and the proposal of how to maintain the Site in clean and tidy condition. The Contractor shall provide the necessary facilities, receptacles and transport for the temporary storage, disposal and removal of different types of wastes.

(c) Daily Cleaning

(i) “Daily Cleaning” shall include cleaning and tidying up after work of tools, equipment, unused materials, storage areas and common areas such as passageways, daily removal of waste materials from works areas, removal of any rubbish and debris dumped into the Site by the public and, without derogating from the generality of the foregoing, shall include, but is not limited to, all the items subject to checking as listed in sub-clause (c)(ii).

(ii) The Contractor shall develop inspection checklist for Daily Cleaning for the approval of the *Architect/Engineer’s Representative. The inspection checklist shall be reviewed and updated whenever there is a change in work nature or work location and re-submitted for approval by the *Architect/Engineer’s Representative. The inspection checklist shall include an assessment on the cleanliness and tidiness of all work locations, plus the Public Cleaning Areas. Items to be checked against for each work location shall include, but are not limited to, the following:

− Maintenance of passageways, common accesses and public areas free of obstruction;

− Proper storage and stacking of materials;

− Proper placement and storage of tools and equipment after work;

− Proper sorting, storage and/or disposal of waste materials in accordance with the *Waste Management Plan/ Environmental Management Plan;

− Proper securing of hoarding, barriers, guarding, lighting, and signing of works;

− Prevention and removal of water ponds and flooding;

− Clearing of stockpiling and wastes arising from the Works;

− Conditions of cleanliness and tidiness of the Site including Public Cleaning Areas in the perspective of the general public; and

− Other cleaning requirements as instructed by the *Architect/Engineer’s Representative.

(iii) The Contractor shall assign person(s) at supervisory level or higher to inspect the Site after each Cleaning Day’s work. To assist the Contractor in ensuring the cleanliness and tidiness of the Site, the assigned person shall check the site condition, complete the inspection checklist, record the areas requiring improvements, and take photographs of areas where cleaning and tidying up works have been done and where improvement actions are required.

(iv) The Contractor shall notify the *Architect/Engineer’s Representative the time schedule for Daily Cleaning on every Cleaning Day and the name of the assigned person as referred to in sub-clause (c)(iii) above responsible for the inspection and checking after each Cleaning Day.

(v) The Contractor shall submit, at or before 10:00am of the day (which is not a General Holiday) following a Cleaning Day, the inspection checklist, records and photographs prepared pursuant to sub-clause (c)(iii) above to the *Architect/Engineer’s Representative for checking and recording. Submissions shall be in soft copy with *one set/ three sets of hard copies.

(vi) The *Architect/Engineer’s Representative may carry out dailyinspections and surprise checks to verify the Contractor’s performance on cleanliness and tidiness of the Site before the noonof the day (which is not a General Holiday) following a Cleaning

Day. The Contractor shall not be entitled to any payment for the item for “Daily Cleaning” for a Cleaning Day if the performance of the Contractor on cleanliness and tidiness for any part of the Site on that Cleaning Day is not carried out to the satisfaction of the *Architect/Engineer’s Representative. The *Architect/Engineer’s Representative shall notify the Contractor and record in the Site Diary for any non-payment of the item for “Daily Cleaning” on a Cleaning Day and the areas of dissatisfaction for improvement by the Contractor.

(vii) The Contractor shall in the morning of every Cleaning Day before work commences inspect and remove any rubbish and debris that may be littered by the public over the night within any area which cleanliness and tidiness the Contractor is required to maintain under this Contract before the inspection by the *Architect/Engineer’s Representative.

(viii) If a tropical cyclone warning signal (No. 8 or above), a Black Rainstorm warning or other special circumstances renders Daily Cleaning not possible or practical on a Cleaning Day (or if more than one Cleaning Day, Cleaning Days), the Contractor shall submit the detailed particulars of the circumstances for the consideration of the *Architect/Engineer’s Representative. The *Architect/Engineer’s Representative may, at his discretion, waive the Contractor’s duties and obligations in respect of Daily Cleaning on that particular Cleaning Day (or if more than one Cleaning Day, those particular Cleaning Days) and in such event, the Contractor shall not be entitled to any payment in respect of Daily Cleaning on that particular Cleaning Day (or if more than one Cleaning Day, those particular Cleaning Days).

(d) Weekly Tidying

(i) “Weekly Tidying” shall include the cleansing and tidying up of the common areas and accesses, cleansing and/or re-conditioning of hoardings, barriers, guarding, lighting, signage and/or traffic cones, cleansing of external covers for plant and equipment, removal of waste and debris etc. so as to ensure that the plant and equipment, hoardings, as well as the Site as a whole, to be clean and tidy in the perspective of the general public and, without derogating from the generality of the foregoing, shall include, but is not limited to, all the items subject to checking as listed in sub-clause (d)(ii).

(ii) The Contractor shall develop inspection checklist for Weekly Tidying for the approval of the *Architect/Engineer’s Representative. The inspection checklist shall be reviewed and

updated whenever there is a change in work nature or work location and re-submitted for approval by the *Architect/Engineer’s Representative. − Thorough cleansing of passageways, common accesses and public areas;

− Re-organizing of storage materials for better utilization of storage spaces and safe stacking if appropriate;

− Maintenance and re-conditioning of tools and equipment;

− Cleansing of external covers for plant and equipment;

− Collection and removal of disposed waste materials off site in accordance with the *Waste Management Plan/ Environmental Management Plan;

− Cleansing, re-conditioning and/or replacement of hoarding, barriers, guarding, lighting, and signage of works to good working condition;

− Clearing of drains and channels to prevent flooding; and

− Other cleansing requirements as instructed by the *Architect/Engineer’s Representative from the perspective of the general public.

(iii) The Contractor shall assign an Environmental Officer/ Assigned Person(s) to inspect the Site after each Cleaning Week Day’s work. To assist the Contractor in ensuring the overall cleanliness and tidiness of the Site, the Environmental Officer/ Assigned Person(s) shall check the site condition, complete the inspection checklist, record the areas requiring improvements, and take photographs of areas where overall site cleaning and tidying up actions have been done and where improvement actions are required.

(iv) The Contractor shall notify the *Architect/Engineer’s Representative the time schedule for Weekly Tidying on every Cleaning Week Day, and the name of the Environmental Officer/ Assigned Person(s) as referred to in sub-clause (d)(iii) above responsible for the inspection and checking after each Cleaning Week Day.

(vi) The *Architect/Engineer’s Representative shall, together with the Site Agent, check and inspect the overall cleanliness and tidiness of the Site on the day (which is not a General Holiday) following the Cleaning Week Day. The *Architect/Engineer’s Representative shall advise the Contractor whether his performance is to his/her satisfaction, or if not, where improvement actions are required.

(vii) The Contractor shall promptly rectify the defects identified by the Environmental Officer/ Assigned Person(s) as referred to in sub-clause (d)(iii) above, and/or the *Architect/Engineer’s Representative. The Contractor shall not be entitled to any payment for the item for “Weekly Tidying” for a Cleaning Week Day if the Contractor fails to rectify the identified defects pursuant to sub-clauses (d)(iii) and (d)(vi) above to the satisfaction of the *Architect/Engineer’s Representative before the end of the day (which is not a General Holiday) following the Cleaning Week Day.

(viii) The Contractor shall in the morning of every Cleaning Week Day

before work commences inspect and remove any rubbish and debris that may be littered by the public over the night within any area which cleanliness and tidiness the Contractor is required to maintain under this Contract before the inspection by the *Architect/Engineer’s Representative.

facilities, receptacles and transport for sorting, temporary storage, disposal and removal of different types of waste materials including, but not limited to, metals, papers and non-metallic inert construction and demolition (C&D) materials.

(c) Daily Cleaning

(i) “Daily Cleaning” of a Works Order shall include cleaning and tidying up after work of tools, equipment, unused materials, storage areas and common areas such as passageways, daily removal of waste materials from works areas, removal of any rubbish and debris dumped into the Site by the public and, without derogating from the generality of the foregoing, shall include but not limited to all the items subject to checking as listed in sub-clause (c)(ii).

(ii) The Contractor shall develop inspection checklist for Daily Cleaning for each Works Order after each Cleaning Day’s work for the approval of the *Engineer/Maintenance Surveyor’s Representative. The inspection checklist shall be reviewed and updated whenever there is a change in work nature or work location under such Works Order and re-submitted for approval by the *Engineer/Maintenance Surveyor’s Representative. (vii) The Contractor shall promptly rectify the defects identified by the assigned person as referred to in sub-clause (d)(iii) above, and/or the *Engineer/Maintenance Surveyor’s Representative. The Contractor shall not be entitled to any payment for the item for “Weekly Tidying” of a Works Order for a Cleaning Week Day if the Contractor fails to rectify the identified defects pursuant to sub-clauses (d)(iii) and (d) (vi) above to the satisfaction of the *Engineer/Maintenance Surveyor’s Representative before the end of the day (which is not a General Holiday) following the Cleaning Week Day.

(viii) The Contractor shall in the morning of every Cleaning Week Day

before work commences inspect and remove any rubbish and debris that may be littered by the public over the night within any area which cleanliness and tidiness the Contractor is required to maintain under this Contract before the inspection by the *Engineer/ Maintenance Surveyor’s Representative.

(ix) If a tropical cyclone warning (No. 8 or above), a Black Rainstorm

warning or other special circumstances renders Weekly Tidying not possible or practical on a Cleaning Week Day, the Contractor shall submit the detailed particulars of the circumstances for the consideration of the *Engineer/Maintenance Surveyor’s Representative. The *Engineer/Maintenance Surveyor’s Representative may, at his discretion, waive the Contractor’s duties and obligations in respect of Weekly Tidying on that particular Cleaning Week Day and in such event, the Contractor shall not be

xx.3 The extent of the Public Cleaning Areas required for

the item for “Daily Cleaning” for a Works Order on a Cleaning Day if the performance of the Contractor on cleanliness and tidiness for any part of the Site including areas other than the Public Cleaning Areas of such Works Order for that Cleaning Day is not carried out to the satisfaction of the *Engineer/Maintenance Surveyor’s Representative. Appendix E - Notes to Tenderers

“Tenderers should note the Special Conditions of Contract and the Particular Specification on “Site Cleanliness and Tidiness - Daily Cleaning and Weekly Tidying Up of the Site”. Separate items are stipulated in the *Bills of Quantities/Schedule of Rates for the cleaning and tidying up work of the Site, including Public Cleaning Areas which are required for cleaning solely by the Contractor and have to be maintained open to the general public throughout the construction period. The Particular Specification shall be strictly enforced by the *Architect/Engineer/Maintenance Surveyor. Failure to perform satisfactorily on Daily Cleaning and Weekly Tidying as specified in the contract with non-payment for two consecutive Cleaning Days or Cleaning Week Days, OR more than two Cleaning Days or Cleaning Week Days in any rolling five Cleaning Days or Cleaning Week Days can result in a verbal warning which shall be recorded in writing. If performance is not improved, a written warning will be issued which will result in “Poor” rating in the item for “Cleanliness of Site” in the report on contractor’s performance. If the performance is still not improved, the *Architect/Engineer/Maintenance Surveyor may, at his sole discretion, issue further verbal warning which shall be recorded in writing or issue further written warning which will result in “Very Poor” rating in the item for “Cleanliness of Site” in the report on contractor’s performance.”.
