INTRODUCTION

DGFT or Directorate General of Foreign Trade is a government organization in India responsible for the formulation of EXIM guidelines and principles for Indian importers and Indian exporters of the country.

Before 1991, DGFT was known as the Chief Controller of Imports & Exports (CCI&E).

DGFT is the nodal body formulating the Export Import Policy.

The office of the Director General of Foreign Trade has opened a chat window on its website for interacting with the trade and industry to reply to queries on the Foreign Trade Policy.

This web based interface would be held from 3.00 pm to 5.00 pm on the second Wednesday of every month.

The RAs under DGFT have direct role in issuing various Authorisations under chapter-4 of the FTP/HBP which includes Advance Authorisations (AA), Duty Free Import Authorisation (DFIA).

The RAs under DGFT have direct role in issuing EPCG (Export Promotion Capital Goods Scheme) Authorisations under chapter-5 of the FTP/HBP which allow import of capital goods at zero/3 percent duty subject to Export obligation to be fulfilled as per conditions laid down in the FTP/HBP

All the Regional Authorities under DGFT have an important role in implementations of various schemes by Ministry of Commerce for the exporters falling under the jurisdiction. This include: Assistance to states for infrastructure development for

exports. Financial assistance to export promotion councils,

industry and trade associations, agencies of State Govt. Indian Commercial mission abroad and other persons as Market Access initiative.

Financial assistance for marketing development.

Registration with Director General of Foreign Trade (DGFT)

For every first time exporter, it is necessary to get registered with the DGFT (Director General of Foreign Trade), Ministry of Commerce, Government of India.

DGFT provide exporter a unique IEC Number. IEC

Number is a ten digits code required for the purpose of export as well as import. No exporter is allowed to export his good abroad without IEC number.

However, if the goods are exported to Nepal, or to Myanmar through Indo-Myanmar boarder or to China through Gunji, Namgaya, Shipkila or Nathula ports then it is not necessary to obtain IEC number provided the CIF value of a single consignment does not exceed Indian amount of Rs. 25, 000 /-.

Application for IEC number can be submitted to the nearest regional authority of DGFT

Application form which is known as "Aayaat Niryaat Form - ANF2A" can also be submitted online at the DGFT web-site: http://dgft.gov.in.

While submitting an application form for IEC number, an applicant is required to submit his PAN account number.

Only one IEC is issued against a single PAN number.

Apart from PAN number, an applicant is also required to submit his Current Bank Account number and Bankers Certificate.

A amount of Rs 1000/- is required to submit with the application fee. This amount can be submitted in the form of a Demand Draft or payment through EFT (Electronic Fund Transfer by Nominated Bank by DGFT.

Import Export code service Definition of IEC Code

IEC Code is unique 10 digit code issued by DGFT – Director General of Foreign Trade , Ministry of Commerce, Government of India to Indian Companies.

Application for Grant of IEC Number An application for grant of IEC number

shall be made by the Registered/Head Office of the applicant and apply to the nearest Regional Authority of Directorate General Foreign Trade, the Registered office in case of company and Head office in case of others, falls in the ‘Aayaat Niryaat Form - ANF2A’.

IEC No: Exempted Categories The following categories of importers or

exporters are exempted from obtaining Importer - Exporter Code (IEC) number: Importers covered by clause 3 (1) [except sub-

clauses (e) and (l)] and exporters covered by clause 3(2) [except sub-clauses (i) and (k)] of the Foreign Trade (Exemption from application of Rules in certain cases) Order, 1993.

However, the exemption from obtaining Importer-Exporter Code (IEC) number shall not be applicable for the export of Special Chemicals, Organisms, Materials, Equipments and Technologies (SCOMET) as listed in Appendix- 3, Schedule 2 of the ITC(HS) except in the case of exports by category(ii) above.

The physical application containing required documents should reach DGFT RLA concerned within 15 days of its online submission.

E-mail is not mandatory. If it is provided it will facilitate faster communication.

Two copies of the application in prescribed format (Aayaat Niryaat Form ANF 2A) must be submitted to your regional Jt.DGFT Office.

Each individual page of the application has to be signed by the applicant.

Part 1 & Part 4 has to be filled in by all applicants. In case of applications submitted electronically.

No hard copies of Part 1 may be submitted. However in cases where applications are submitted otherwise, hard copy of Part 1has to be submitted.

Only relevant portions of Part 2 need to be filled in.

Dgft office in Ludhaina

One regional licensing office of the Directorate General of Foreign Trade (DGFT) is set up in Ludhiana.

This office is second largest in northern India and handles an export of around 2 billion dollars per year.

The main functions of this office are to implement Foreign Trade Policy as announced by the Govt. of India, Ministry of Commerce from time to time.

Work allocation in ludhiana DEPB, Focus Market scheme, Export House,

IEC, Administration, Computerization, Hindi, General Branch, Litigation, Blank licence and cheque books, GSP, RTI, DDO(Cash), Aside scheme, REIC,  DEL,R & I, Quality Complaints, Post Audit, T.R.Refund, Parliament Question & any other work allotted by undersigned from time to time, Chapter 3 (excluding Focus Market Scheme),4 (excluding DEPB),5,8 and  Misc. Licences & ECA/Recovery of Penalties, RBI Recovery, Record ,Audit, PRO & any other work allotted by undersigned from time to time.

PROMOTIONAL MEASURES IN DGFT

Regional Sub-Committee on Quality Complaints (RSCQC) set up at Regional Offices of this Directorate shall investigate quality complaints received from foreign buyers.

  If it comes to DGFT’s notice or he has reason to

believe that an export or import has been made in a manner that (i) is gravely prejudicial to trade relations of India with any other country; and / or (ii) is gravely prejudicial to interest of other persons engaged in exports or imports; and / or (iii) has brought disrepute to the country; DGFT may take action against such exporter or importer in accordance with FT(D&R) Act, Rules and Orders made there-under and FTP
