Mr. DeVincenzo asked several questions concerning the Diablo Canyon Nuclear Power Plant. Pacific Gas and Electric Company hae nearly completed construction of UniC 1 at the Diablo Canyon site, about 12 mQ.es from San Luis Obispo, California. Construction of Unit 2 at this site is= more than half completed. Construction Permits for these units were granted in 1968 and 1970, respectively. The Nuclear Regulatory Commission's staff ie currently reviewing the Company's application for Operating Licenses for these unites Our responses to Mr. DeVincenzo's questions, based on the staff's review to date, are given balov. s Mr. DeVincenzo asked how far the radiation vould go if chere were an earthquake and the plant should explode. As with other commercial nuclear power plants, wa requix'e that the Diablo Canyon Plant ba designed to safely vithstand severe earthquakes so that an earthquake cannot be expected to causa a release of significant amounts of radioactivity. Also, it is impossible for nuclear power plants to explode like a nuclear weapon. Hovever, we do evaluate, in a conservative manner, the potential consequences of postulated accidents, such as ruptures of reactor coolanC pipes, which could release radioactivity. Although these postulated accidents are very unlikely, safety features are provided in the plant to cope with them and to limit the amount of radioactivity that would ba released to acceptable levels as defined in 10 CFR Part 100, the Nuclear Regulatory Commission's "Reactor Sate Criteria" (a copy of vhich is enclosed). Mr. DeVincenzo asked where the radioactive wastes would ba buried. Tha radioactive wastes created by plant operation will nltinataly be shipped to government facilities for disposal. Your letter of October 22, 1975 to the U. S. Energy Research andDevelopment Administration, which forvaxded cha September 24 letter ofyour constituent,, Mr. DeVincenzo, has been referred to me and I am

pleased to respond.

Mr. DeVincenzo asked several questions concerning the Diablo CanyonNuclear Power Plant. Pacific Gas and Electric Company hae nearlycompleted construction of UniC 1 at the Diablo Canyon site, about 12mQ.es from San Luis Obispo, California. be stored to await final disposal. Tho specific method for final disposalof these highly concentrated vastes has aot yet, been selected. Howovox,the present storage methods are considered to be safe aad evaluations ofmethods suitable for the'ery long term are being conducted.

Hr.'oVincenzo suggested that the risks of having tho plant close byshould be borne by people living at another location if those peoplewant the electric power. Of course, ve wi11 not allov operation of the.plant unless ve can determine that such operation is safe. Hovovex, thissafety determination is independent of what segment of the populationlives near the plant and of the exteat, to which persons living near theplant utilize its elcctrica1 output. Nevertheless't is also worth notingthat the Diablo Canyoa site, is vaU. vithin Pacific Gas and ElectricCompany's service area, vhich covers most of Central an>I NorthernCalifornia.

Hr. DeVinccnzo ashsd if there is any vay to stop the constructioa. TheCommission's staff does not have any xeason at, this time for stopping

'onstruction. Tho Atomic Safety 'and Liceasiag Hoard is expected to beginpublic hearings near the plant site within the next fev months toconsider the issuance of Operating Licenses for the Mablo Canyoa Plant.Members of the public may,-at the discretion of the presiding officer,participate in tho hearings by making licdtod appearances. A personmaking a limited appearance may state his position aad may also raise'questions which he vould 1Qce answered. If tho questions are relevant tothe proceeding, the presiding officer may direct that they be aaswerod by

~ tho parties. A member of tho public may, alternately, petition for leaveto intervene. If the petition vere allowed he could become a pazty andparticipate more fully in the proceeding (including.introducing motions,presenting'evidence and cross maunining witnesses).. Howevers sinco thodeadline for such petitions vas November 19, 1973 for tlio'ablo CanyonPlant, such a petitioa would nov need to make a substantial showiag ofgood cause for late filing in order to 'be granted. The standards againstvhich a late petition vous,d be fudged are sot, forth ia Section 2.714 of10 CPR Part 2, tho Nuclear Regulatory Commission's "Rules of Practica"(a copy of which is enclosed) ~ If Hr. DoViaceazo should wish toparticipate in tho proceedings, either by a limited, appearance or bypetitioning for leave to intervene, he should follow tho procedures inthe enclosed Federal Register Notitco. Ho should substitute NuclearRegulatory Commissioa, Washington, D. C. 20555 for Atomic Energy Commissionin tho addresses given in the Notice.

Finally, ?|r. DeVincoazo asked about the number of units planned anddiscussed the temptation for sabotage. LTo have reviewed Pacific Gas andElectric Company's proposed measures to protect tho Diablo Canyoa Plant

The response to Representative Lagomarsino's letter concerning hisconstituent, Mr. DeVincenzo, is late because I postponed writing ituntil the last minute.

At the time the letter was received I was quite busy, primarily withmatters related to the recent serious schedule slip on Diablo Canyon.In addition, I underestimated the time needed for processing bythinking in terms of the simple green ticket letters which the branchchief signs. Of course, once I wrote it, all parties cooperated andtyped it and concurred very quick1y.
